DESIGNATED HOUSES POSTED AT PUNE AND ONE GUEST HOUSE FOR OFFICERS AT MADHUBAN SBI QUARTER, PUNE

2 Eligibility Empanelled Contractors of SBI under appropriate category.Those eligible contractors who wish to apply must have Digital Signature as there will be E-reverse auction. Further, the contractors have to submit copy of Empanelment letter along with their documents in the technical bid. Tenders received from Contractors who are not eligible will be summarily rejected without assigning any reason thereof.

17 Concept of tender The tender concept is “two envelope Concept” Part-1 Technical bid and Part-2 Price bids for captioned work shall be enclosed in two separate envelopes super-scribed with the respective contents (Technical Bid & Price Bid respectively) to be submitted on the same date and time. The EMD shall be enclosed in third separate envelope and included in the technical bid envelope.

INSTRUCTIONS TO THE TENDERER'S

BUSINESS RULES FOR REVERSE AUCTION

A reverse action event will be carried out by M/s e-Procurement Technologies Pvt. Ltd. (abcprocure) among the venders whose technical bids are accepted, for providing opportunities to the venders/bidders dynamical through the reverse auction process, the lowest bidder (L-1) in reverse auction process will be identified.

1. For the proposed reverse auction, technically and commercially accepted bidders only shall be eligible to participate.

2. SBI will engage the services of a service provider who will provide all necessary training and assistance before commencement of online bidding on Internet.

3. SBI will inform the vendor in writing in case reverse auction, the details of service provider to enable them to contract and get trained.

4. Business rules like event date, time, start price, bid decrement, extensions etc. also will be communicated through service provider for compliance.

5. Vendor have to fix the compliance form in the prescribed (provided by the service provider) before start of reverse auction. Without this the vendor will not be eligible to participate in the event.

6. Reverse auction shall be conducted on schedule date and time.

7. At the end of reverse auction the lowest bidder value will be known in the network.

8. The lowest bidder has to fix the duly signed filled in prescribed format as provided to SBI though service provider within 24 hours of action without fail.

9. Any variation between the online bid value and signed document will be considered as sabotaging the tender process and will invite disqualification of vender to conduct business with SBI as per prevailing procedure.

10. In case SBI decided not to go for reverse auction procedure for this tender enquiry, the price bid and price impacts, if any already submitted and available with SBI shall be opened as per SBI standard practice.

BUSINESS RULE FOR FINALIZATION OF THE PROCUREMENT.

SBI shall finalize the procurement of the item against this Tender through reverse auction mode. SBI has made arrangement with M/s. e-Procurement Technologies Pvt. Ltd., Ahmedabad, (ETPL) who shall be SBI’s services provider for the same, Please go through the guidelines given below and submit your acceptance to the same along with your Commercial bid.

1. Computerized Reverse auction shall be conducted by SBI, on pre-specified date, while the vendors shall be quoting from their own offices/place of their choice. Inter-net connectivity and other paraphernalia requirements shall have to be ensured by vendors themselves. In the event of failure of their internet connectivity, (due to any reason whatsoever it may be) it is the bidders connectivity, (due to any reason whatso-ever it may be) it is the bidders responsibility/decision to send fax communication, immediately to ETPL furnishing the price, the bidder wants to bid online, with a re-quest to ETPL to upload the faxed price on line so that the service provider will up load that price on line on behalf of the bidder. It shall be noted clearly that the con-cerned bidder communicating this price to service provider has to solely ensure that the fax message is received by ETPL in a readable/legible form and also the Bidder should simultaneously check up with ETPL over phone about the clear receipt of the price faxed. It shall also be clearly understood that the bidder shall be at liberty to send such fax communications of prices to be uploaded by ETPL only before the clos-ure of Bid time and under no circumstances it shall be allowed beyond the closure of bid time. Such bidders have to ensure that the service provider is given a reasonable required time by the bidders to upload such faxed prices online and if such required time is not available at the disposal of ETPL at time of receipt of the fax message from the bidders, ETPL will not be uploading the prices. It is to be noted that either SBI or ETPL are not responsible for these unforeseen circumstances. In order to word off such contingent situation, bidders are requested to make all the necessary arrange-ments/alternatives, whatever required so that they are able to circumvent such situ-ation and still be able to participate in the reverse auction successfully. However, the vendor are requested to not to wait till the last moment to quote their bids to avoid any such complex situations.

2. ETPL shall arrange to train your nominated person(s), without any cost to you. They shall also explain to you, all the rules related to the reverse auction/Business rules document to be adopted along with bid manual. You are required to give your compli-ance on it before start of bid process.

3. BIDING CURRENCY AND UNIT OF MEASUREMENT: Bidding will be conduc-ted in Indian Rupees (INR) per Unit item rate.

BIDDING CURRENCY AND UNIT OF MEASUREMENT (for foreign bidders): Bidding will be conducted in Indian Rupees (INR) only per Unit item rate. THE EXCHANGE RATE APPLICABLE WILL BE INTIMATED A DAY BEFORE THE

DATE OF REVERS AUCTION thro’ email by SBI TO BOTH ETPL AND VENDORS ELIGIBLE TO PARTICIPATE IN REVERSE AUCTION.

4. BID PRICE: The Bidder has to quote the Total cost to SBI for the items specified in the BOQ provided along with the Technical Bid.

5. The technical & commercial terms as per SBI Tender terms & conditions.

6. VALIDITY OF BIDS: The Bid priced shall be firm and shall not be subjected to any change whatsoever.

7. At the end of the reverse auction, bidder has to provide a details break up for his low-est offer as per the price bid (BILL OF QUANTITIES) format mentioned in the tech-nical bid.

8. Bidding Example: The final rates of the items will have to be calculated in ratio to total amount quoted by the lowest bidder through reverse auction process and the amount quoted in the estimated price bid.

The total amount mentioned in the estimated price bid is Rs.2,000/- but the final L-1 amount quoted by the vendor through E-reverse auction is Rs.1,600/- then the K factor for L-1 vendor will be calculated as under:

Ratio K= (Total amount quoted by the lowest bidder through reverse auction process) / (The amount quoted in estimated price bid)

K= 1600/2000=0.8

The item wise final price to be confirmed by the vendor shall be as under:

The lowest bidder after the e-reverse auction process will have to fax and email the duly signed filled in prescribed format of Annexure-B to SBI through service provider within 24 hours of auction without fail.

9. Procedure of Reverse Auctioningi. Sealed bid Auction- The opening bid (in the initial auction) of the bidders shall

place a bid which shall be same as that quoted in their final sealed price submitted to SBI or less. The bidder shall ensure that their opening bid shall be same as that quoted in their final sealed price bid submitted against tender, if it is found to be otherwise at a later date, the bidder will be disqualified from the tender.

ii. English Reverse (no ties) (Reverse Auction) – SBI will declare its Opening price (OP), which shall be visible to all vendors during the start of the reverse auction. You will be required to start bidding after announcement of opening price and decrement amount.

iii. Sealed bid auction will be for 5 minutes and English Reverse (no ties) shall be for a period of one hour. If a bidder places a bid in the last 10 minutes of closing of the auction, the auction shall get extended automatically for another 5 minutes. In case there is no bid in the last 5 minutes of closing of auction shall get closed auto-matically without any extension.

iv. The bid decrement amount shall be specified by SBI before start of bidding.

10. Successful vendor shall be required to submit the final prices, quoted during the Eng-lish Reverse (no ties) in Annexure-III Format after the completion of auction to SBI, duly signed and stamped as token of acceptance without any new condition other than those already agreed to before start of auction.

11. During English (no ties), if no bid is received within the specified time, SBI at its dis-cretion, may decide to revise Opening price/scrap the reverse auction process/proceed with conventional mode of tendering.

12. Your bid will be taken as an offer for this Project. Bids once made by you cannot be cancelled / withdrawn and you shall be bound to supply as mentioned above at your final bid price. Should you back out and not supply and installation as per the rates quoted, SBI shall take action as appropriate.

13. You shall be assigned a Unique User Name and Password by ETPL. You are advised to change the password after the receipt of initial password from ETPL to ensure con-

fidentially. All bids made from the login ID given to you will be deemed to have been made by your company.

14. You will be able to view the following on your screen along with the necessary fields in the English Reverse (no ties) (Reverse Auction)a. Leading bid in the auction (only total price)b. Bid placed by youc. Opening priced. Your rank in the auction.

15. At the end of the reverse auction, SBI will decide upon the winner. SBI’s decision on award of contract shall be final and binding on all the bidders.

16. SBI shall be at liberty to cancel the reverse action process/tender at any time before ordering, without assigning any reason.

17. SBI shall not have any liability to bidders for interruption or delay in access to the site irrespective of the cause.

18. Other terms and conditions shall be as per your techno-commercial offers and others correspondence till date.

19. You are required to submit your acceptance to the terms/conditions/modality given above before participating in the reverse auction.

TERMS AND CONDITIONS OF REVERSE AUCTION

1. LOG IN NAME AND PASSWORD: Each bidder is assigned a Unique User Name & Password by ETPL. The bidders are requested to change the Password after the re-ceipt of initial Password from ETPL. All bids made from the Login ID given to bidder will be deemed to have been made by the bidder.

2. BIDS PLACED BY BIDDER: The bid of the bidder will be taken to be an offer to execute the work. Bids once mad by the bidder cannot be cancelled. The bidder is bound to execute the work as mentioned above at the price that they bid should any bidder back out and not make the supplies and installation as per the rates quoted, SBI and /or ETPL shall take action as appropriate.

3. LOWEST BID OF A BIDDER: In case the bidder submits more than one bid, the lowest bid will be considered as the bidder’s final offer to execute the work.

4. AUCTION TYPE: i) Sealed Bid Auctionii) English Reverse No Ties

5. DURATION OF AUCTION: The duration of Auction will be for an hour. If some-body is bidding just before 5 minutes of Auction closing the Auction will; get exten-ded for another 5 minutes (THIS SCHEDULE IS TENTATIVE. IF ANY CHANGE IN SCHEDULE, THE SAME SHALL BE COMMUNICATED TO YOU.

6. BID DECREMENT: The minimum Bid decrement shall be available to the Bidders at the start of the auction. The bidder can view the same by clicking on the item details at the start of the auction. The bidder can bid lower than the lowest bid in the auction by a decrement, multiple of the minimum Bid Decrement

7. VISIBILITY TO BIDDER: The Bidder shall be able to view the following on his

screen along with the necessary fields during English Reverse No ties Auction: - Leading Bid in the Auction - Bid Placed by him - Your Rank

8. AUCTION WINNER: At the end of the Reverse Auction SBI will evaluate all the bids submitted and will decide upon the winner.

9. GENERAL TERMS & CONDITIONS: Bidders are required to read the “Terms & Conditions” section of the auctions site using the Login ID and Passwords given to them.

10. OTHER TERMS & CONDITIONS:

- The Bidder shall not involve himself or any of his representatives in price manipu-lation of any kind directly or indirectly by communication with other suppliers/ bidders.

- The Bidder shall not divulge either his Bids or any other exclusive details of SBI to any other party.

- SBI’s decision on award of Contrast shall be final and binding on all the Bidders. - SBI along with ETPL can decide to extend, reschedule or cancel any Auction. Any

changes made by SBI and / or ETPL, after the first posting will have to be accep-ted if the Bidder continues to access the site after that time.

- ETPL shall not have any liability to Bidders for any interruption or delay in access to the site irrespective of the cause.

- ETPL is no responsible for any damages, including damages that result form, but are not limited to negligence. ETPL will not be held responsible for consequential damages, including but not limited to systems problems, inability to use the sys-tem, loss of electronic information etc.

N. M. - All the bidders are requested to ensure that they have a valid digital certificate well in advance to participate in the online event. - All the Bidders are required to submit the Agreement Form. (Annexure-II) Duly signed to M/s. e- Procurement Technologies Pvt. Ltd. Ahmedabad before due date. After the completion of the Auction event, all the Bidders have to submit the price a Break up immediately to M/s. e procurement Technologies Pvt. Ltd. Ahmedabad for further proceedings.

a. Site and its location:The proposed work is to be carried out at PUNE.

2.0 Qualification of the Tenderer2.1 All Tenderers shall provide Forms of Tender.

2.2 All Tenderers shall include the following information by producing relevant documents and certificate with their Tenders:

a) Conditions of the contract enclosed each page duly signed by the tenderer as token of acceptance. If any deviation is proposed by the tenderer the same must be clearly indicated and enclosed as deviation list but tenders with significant deviations list and merely enclosing tenderer’s printed conditions or their own terms and conditions will make the tender liable for rejection.

b) Earnest money deposit as laid down in these instructions to tenderers.

3.0 Tender documents:3.1 The work has to be carried out strictly according to the conditions stipulated in

the tender consisting the following documents and the most workman like manner.

The Tenderer shall be deemed to have examined all instructions, forms, terms, and specifications in the Documents. Failure to furnish the information required by the Tender Document or submission of a Tender not substantially responsive to the Tender Documents in every respect will be at the Tenderer’s risk and may result in the rejection of the Tender.

3.2 The above documents shall be taken as complementary and mutually explanatory of one another but in case of ambiguities or discrepancies, following order of preference shall take precedence in the order given below :-

5.0 Site Visit:5.1 The tenderer must obtain himself on his own responsibility and his own expenses all

information and data which may be required for the purpose of filling this tender document and enter into a contract for the satisfactory performance of the work. The tenderer is requested satisfy himself regarding the availability of water, power, transport and communication facilities, the character quality and quantity of the materials, labour, the law and order situation, climatic conditions local authorities requirement, traffic regulations etc.; The tenderer will be fully responsible for considering the financial effect of any or all the factors while submitting his tender.

6.0 Earnest Money:6.1 The tenderers are requested to submit Rs. 6,500/- in the form of DD of any

Nationalized bank drawn in favour of State Bank of India, payable at Pune.

6.2 EMD in any other form other than as specified above will not be accepted. Tender not accompanied by the EMD in accordance with clause 5.1 above shall be rejected.

6.3 No interest will-be paid on the EMD.

6.4 EMD of unsuccessful tenderers will be refunded within 30 days of award of Contract.

6.5 EMD of successful tenderer will be retained as a part of security deposit.

7.0 Initial Security Deposit:7.1 The successful tenderer will have to submit a sum equivalent to 2% of contract value

less EMD. By means of D/D drawn, in favour of State Bank of India. Within a period of 15 days of acceptance of tender.

8.0 Security Deposit:8.1 Total security deposit shall be 5% of contract value. Out of this 2% of contract value is

in the form of initial security deposit which includes the EMD. Balance 3% shall be deducted from the running account bill of the work at the rate of 10% of the respective running account bill i.e., deduction from each running bill account will be 10% till total 3% of contract value is reached. 50% of the total security shall be paid to the contractors on the basis of architect's certifying the virtual completion. The balance

50% would be paid to the contractors after the defects liability period as specified in the contract.

No interest shall be paid to the amount retained by the Bank as Security Deposit.

9.0 Signing of contract Documents:9.1 The successful tenderer shall be bound to implement the contract by signing an

agreement and conditions of contract attached herewith within 30 days from the receipt of intimation of acceptance of his tender by the Bank. However, the written acceptance of the tender by the Bank will constitute a binding agreement between the Bank and successful tenderer whether such formal agreement is subsequently entered into or not.

10.0 Completion Period:10.1 Time is essence of the contract. The work should be completed in all respects in

accordance with the terms of contract within a period of 60 Days from the date of handing over site or 15 days from the date receipt of letter of acceptance whichever is later.

11.0 Validity of tender:11.1 Tenders shall remain valid and open for acceptance for a period of three months from

the date of opening price bid. If the tenderer withdraws his/her offer during the validity period or makes modifications in his/her original offer which are not acceptable to the Bank without prejudice to any other right or remedy the Bank shall be at liberty to forfeit the EMD.

11.2 The rates quoted by the Contractor will hold good for the entire period of work and no compensation / escalation will be paid in any circumstances on this account.

12.0 Liquidated Damages:The liquidated damage shall be 0.5% per week subject to a maximum of 5% of contract Value. Refer Clause 9 of GCC.

13.0 Rate and prices:In case of item rate tender-The tenderers shall quote for individual item both in words and figures in Case of discrepancy between the rates quoted in words and figures the unit rate quoted in words will prevail. If no rate is quoted for a particular item the contractor shall not be paid for that item when it is executed.

The amount of each item shall be calculated and the requisite total is given. In case of discrepancy between the unit rate and the total amount calculated from multiplication of unit rate and the quantity the unit rate quoted will govern and the amount will be corrected.

The tenderers need not quote their rates for which no quantities have been given. In case the tenderers quote their rates for such items those rates will be ignored and will not be considered during execution.The tenderers should not change the units as specified in the tender. If any unit is changed the tenders would be evaluated as per the original unit and the contractor would be paid accordingly. The tenderer should not change or modify or delete the description

of the item.

If any discrepancy is observed he should immediately bring to the knowledge of the Architect/Bank. Each page of the BOQ shall be signed by the authorized person and cutting or overwriting shall be duly attested by him.

Each page shall be totaled and the grand total shall be given. The rate quoted shall be firm and shall include all costs, allowances, taxes, levies, transportation, etc.

The tender submitted on behalf of Company shall be signed by a person who has the proper legal authority on behalf of the Company to enter into the contract; otherwise, the tender is liable to be rejected. Each page of the tender document and each drawing accompanying is required to be signed by the authorized person submitting the tender, with the company seal as the token of their having examined and acquainted themselves with the General conditions of contract, drawings, specifications, special conditions of contract etc. The forms of tender are to be filled in completely. Any tender with any of the documents not signed is liable to be rejected.

The notation R.O. written against items of BOQ means ‘rate only” and the tenderer is to quote only unit rate in such cases.

14.0 The Tenderer shall fill in rates for all items of the Works described in the Schedule of Quantities along with total Tender price. In case if the rates are not filled for any of the Items of Schedule of Quantities, in such cases the tender shall be summarily rejected. Failure to comply with either of these conditions will make the tender liable for rejection.

15.0 If a bidder has not filled rate of a particular item then the highest rate filled for that item by one of the other bidders shall be considered while reviewing the bid.

NOTE : ALL RATES QUOTED BY THE CONTRACTOR ARE INCLUSIVE OF ALL TAXES LIKE GST, SERVICE TAX, CENTRAL SALES TAX, VALUE ADDED TAX (VAT), WORK CONTRACT TAX, CESS AS PER BUILDING & OTHER CONSTRUCTION WORKERS CESS ACT. OR ANY STATUTORY TAX APPLICABLE

16.0 The rates quoted in the tender shall include cost of all materials, labour & telephone rent and call charges, for execution of work at site, hire for any tools and plants, shed for materials, marking out and clearing of site, transportation complete, cleaning the buildings and surroundings after execution of the total works and dumping the waste at designated place as directed by the Owner in all respects. The rates quoted in the tender shall be treated as rated for finally completing the item of work.

17.0 The quantities furnished in the schedule of quantities are only probable quantities and are liable to alterations, by omission, deductions or additions to any extent at the discretion of Owner. Payments will be regulated on the actual quantities of work done at accepted rates. Any item of work may be omitted from the schedule of quantities and may be awarded to another agency at any time / stage of the work for which no compensation will be paid by the Owner i.e. for non-operated BOQ items and short closed BOQ items.

18.0 Where alternative items are given, the rates in figures and words are to be entered and not the amounts thereof. A tender which does not show the rates in figures and words for alternative items are liable to be rejected. The Owner reserves the right to take into account any of the alternative items during the execution of the work, partly or fully.

19.0 Errors in the Schedule of Quantities shall be dealt with in the following manner:

i In the event of a discrepancy between the rates quoted in words and the rates in figures, rate quoted in words shall be deemed to be correct.\

ii In the event of an error occurring on account of arithmetical calculations the same shall be corrected according to rates written in words and quantities in B.O.Q.

iii All the errors in totaling in the amount column and in carrying forward the totals shall be corrected. The tender total shall be accordingly amended.

20.0 The calculations made by the tenderer should be based upon quantities of the items of work which are furnished in the Schedule of Quantities, but it must be clearly understood that the contract is not a lump sum contract. The Owners do not in any way assure, represent or guarantee that the said probable quantities are correct or that the work would correspond thereto. The items of work irrespective of the quantities which may vary shall be carried out at the same accepted tender rates and no escalation in the rates will be entertained whatsoever. Any item of work may be omitted from the schedule of quantities and may be awarded to another agency at any time / stage of the work.

21.0 The tenderers must obtain for themselves on their own responsibility and their own expenses all the information which may be necessary, including risks, contingencies and other circumstances to enable them in making a proper tender and for entering into a contract, and must examine the drawings, specifications and conditions and inspect the site of the work, nature of the work, availability of power, water, shelter for workmen and all the matters pertaining thereto before submitting the tender.

Amendment of Tendering Documents:14 Before the deadline for submission of Tenders, the Owner may modify the Tendering

documents by issuing addenda.

14.1 Any addendum thus issued shall be part of the Tendering documents and shall be communicated in writing or by fax to all the empanelled contractors. The empanelled contractors shall acknowledge receipt of each addendum by fax to the Owner.

14.2 To give prospective Tenderers reasonable time in which to take an addendum into account in preparing their Tenders, the Owner may extend if necessary the deadline for submission of Tenders.

15 Language of Tender:15.1 The document shall be written in English language. The total amount should be written

in the same language.

22.0 Document comprising the Tender:No page of this Tender document shall be removed and the set must be submitted as it is. Each page of the Tender document form is to be signed by the Contractor and must bear the Seal of the Company/Firm.

The Tender submitted by the Tenderer shall comprise the following:Two Envelope system.

1. Envelope one containing following items:2. Earnest Money Deposit in a separate sealed cover

3. Covering letter with enclosures as specified in Tender Volume I: -Conditions of Contract

4. Technical Specifications/ Makes / Addendums, Tender Drawings

5. Envelope two – containing following items: a) Price schedule with prices (both in words and in figures) strictly in

accordance with the price schedule format of the tender document. Departure from the price schedule format may render the tender liable for rejection.

NOTE: - 1) IN CASE OF ANY CONDITION FOUND IN THE PRICE BID, SUCH BIDS SHALL BE SUMMARILY REJECTED.2) ALL PAGES OF TENDER DOCUMENTS SHALL BE SIGNED & STAMPED.

23.0 Format and signing of Tender document:15.1 The tenderer shall seal the bid in an envelope, duly marked as — TENDER FOR

ELECTRICAL WORK OF STATE BANK OF INDIA – TWO DGM DESIGNATED HOUSES POSTED AT PUNE AND ONE GUEST HOUSE FOR OFFICERS AT MADHUBAN SBI QUARTER, PUNE. Which shall documents mentioned in the “Instructions to Tenderers” and priced BOQ document in two envelopes. Please refer “Clause No. 15. in Instructions to Tenderers”.

23.1 The Tender shall be typed or written in indelible ink and shall be signed by a person or persons duly authorized to sign on behalf of the Tenderer. All pages of the Tender where entries or amendments have been made shall be initialed by the person or persons signing the Tender.

23.2 The Tender shall contain no alterations or additions, except those to comply with instructions issued by the Owner, or as necessary to correct errors made by the Tenderer, in which case such corrections shall be initialed by the person or persons signing the Tender. ANY CONDITIONAL TENDER WILL BE SUMMARILY REJECTED.

24.0 Sealing and marking of Tenders:24.1 The Tenderers are requested to quote their offers in Single sealed envelope containing

two envelopes as follows:

Envelope 1- Technical Bid: (1)Comprising of Earnest Money Deposit as per clause No.1 of GCC, Covering letter with enclosures as specified in Tender Volume I: -Conditions of Contract, Technical Specifications/ Makes / Addendums, Tender Drawings(2)All Tender documents except price bid (BOQ) duly sealed and signed.

Envelope 2- Commercial Bid: (1) Priced BOQ document duly signed in sealed envelope.Please refer “Clause No.12 and 15 in Instructions to Tenderers”.

The two envelopes shall be duly sealed indicating the name of work i.e. TENDER FOR ELECTRICAL WORK OF STATE BANK OF INDIA – TWO DGM DESIGNATED HOUSES POSTED AT PUNE AND ONE GUEST HOUSE FOR OFFICERS AT MADHUBAN SBI QUARTER, PUNE. and deposited in the tender box kept at the SBI Premises Department, Zonal Office, Sharda Chambers, 3rd Floor, 386/2 Shankar Sheth road, Pune-411 037, ON OR BEFORE DUE DATE OF SUBMISSION OF TENDER. NOTE: If item no. 1 and 2 in Envelope-1 are not compiled by the contractor then Envelope- 2 will not be opened. The tender will be rejected and will be returned to the contractor.

24.2 In addition to the identification required in Sub-Clause 17.1 the inner envelopes shall indicate the name and address of the Tenderer to enable the Tender to be returned unopened in case it is declared late, pursuant to Clause 18.0.

24.3 If the outer envelope is not sealed and marked as above, the Owner will assume no responsibility for the misplacement or premature opening of the Tender.

26.0 Deadline for submission of Tenders:Any Tender received by the Owner after the deadline of submission of Tenders i.e. 14/07/2017 upto 3:00 pm will be rejected and returned unopened to the Tenderer

27.0 Clarification of Tenders:To assist in the examination, evaluation, and comparison of Tenders, the Owner may, at his discretion, ask any Tenderer for clarification of his Tender, including breakdowns of unit rates. The request for clarification and the response shall be in writing or by fax, but no change in the price or substance of the Tender shall be sought, offered, or permitted.

28.0 Examination of Tenders and Determination of Responsiveness:Prior to the detailed evaluation of Tenders, the Owner will determine whether each Tender

(a) Has been properly signed and meets the requirements as in clause 2.0 in instruction to tenderers; (b) Is accompanied by the required securities and;(c) is substantially responsive to the requirements of the Tendering documents.

A substantially responsive Tender is one which conforms to all the terms, conditions, and specifications of the Tendering documents, without material deviation or reservation. A material deviation or reservation is one

(a) Which affects in any substantial way the scope, quality, or performance of the Works;(b) Which limits in any substantial way, inconsistent with the Tendering documents, the Owner rights or the Tenderers’ obligations under the contract; or (c) Whose rectification would affect unfairly the competitive position of other Tenderers presenting substantially responsive Tenders.

If a Tender is not substantially responsive, it will be rejected by the Owner, and may not subsequently be made responsive by correction or withdrawal of the nonconforming deviation or reservation.

29.0 Correction of Errors:Tenders determined to be substantially responsive will be checked by the Owner for any arithmetic errors. Errors will be corrected by Owner as follows:

29.1 Where there is a discrepancy between the rates in figures and in words, the rate in words will govern, and where there is a discrepancy between the unit rate and the item total resulting from multiplying, the unit rate as quoted will govern.

29.2 The amount stated in the Tender will be adjusted by the Owner in accordance with the above procedure for the correction of errors and shall be considered as Binding upon the Tenderer. If the Tenderer does not accept the corrected amount the Tender will be rejected, and the EMD will be forfeited

30.0 Evaluation and Comparison of Tenders:The Owner will evaluate and compare only the Tenders determined to be substantially responsive.

In evaluating the Tenders, the Owner will determine for each Tender the evaluated Tender Price by adjusting the Tender Price as follows:

(a) making any correction for errors; or(b) making an appropriate adjustments for any other acceptable variations,

deviations; and(c) making appropriate adjustments to reflect discounts offered.

31.0 The Owner reserves the right to accept or reject any variation, deviation, or alternative offer and other factors which are in excess of the requirement of the Tendering.

32.0 Award Of Tender32.1 Award criteria:

The acceptance of Tender will rest with the Owner, which does not bind itself to accept the lowest tender and reserves to itself the authority to reject completely / partially, any or all of the Tender/s received without the assignment of a reason.

The owner reserves to itself the right of accepting the whole or any part of the Tender and the Tenderer shall be bound to perform the same at the rate quoted. The Owner reserves to itself the right of omission of any item of work from the awarded tender at any time / stage during the execution of work and award the same to another agency / contractor.

Notification of award:The successful Tenderer will be issued a Letter of Acceptance (LOA) and the date of commencement of work shall be reckoned as the date of handing over site or seven days from the date of issue of letter of acceptance of the tender by the SBI whichever is later.

32.2 Security Deposit: See GCC clause 1.0.Failure of the successful Tenderer to comply with the requirement of clause 24.4.1 below shall constitute sufficient grounds for the annulment of the award and forfeiture of the EMD.

32.3 Signing of contract form:On the acceptance of LOA / Purchase Order and Security Deposit of the successful Tenderer, the Owner will send the Tenderer the contract form provided in the Tender document duly signed and sent along with the Tender incorporating all agreements between the parties. See clause 5.0 of GCC.

33.0 During Execution:The Contractor shall carry out all the works strictly in accordance with the drawing,

details and instructions of the Architects/PMC. If in the opinion of the Architect,

changes have to be made in the design, and they desire the contractor to carry out the same, the Contractor shall be bound to comply. The Architects/PMC decisions in such cases shall be final.

33.1 See clause 22 of GCC for valuation of variation/authorized extra work. It is further clarified that for all such authorized extra items where rates cannot be derived from the tender, the Contractor shall submit rates duly supported by rate analysis worked on the “market rate basis” for material, labour, hire / running charges of equipment and wastages etc. plus 15% towards establishment charges, contractor's overheads and profit. Such items shall not be eligible for escalation.

The rates shall be verified by the Architect/Consultant. And recommended to the owner for approval. The decision of the owner shall be final.

33.2 The Architects/PMC/ Owner may at any time / stage of execution demand for the Analysis of Rates for any item / items of work which in their opinion is / are abnormally high / low rates or required for the Analysis of Rates of other tender / extra item / items. The Contractor is bound to present the same and if the Contractor is unable to present a justified Analysis of Rates for any item / items, the rate / rates for such item may be adjusted accordingly and the decision of the Owner in such cases shall be final.

33.3 The Contractor shall get the quality of work done inspected for material and workmanship at different stages of execution as per instructions given by the Architects/PMC or their representative time to time. Any item of work done which is found not conforming to the Contract shall be rejected by the Architects/PMC. The decision of the Architects/PMC in such cases shall be final.

33.4 The Architects/PMC/ Owner may instruct at any stage of execution for testing of samples of any material taken at random. The Architects/PMC/ Owner will decide the testing laboratory / agency and the cost of testing including the expenses for sending the samples to the laboratory / agency and receipt of test reports shall be borne by the Contractor. The material shall be rejected in case the test reports are not within the permissible limits.

The Contractor shall have to present the invoice for purchased material from the manufacturer or from the dealer along with the certificate from the manufacturer. In case material is found to be of sub-standard quality, the same shall be rejected by the Architects/PMC/ Owner. The decision of the Architects/PMC in such cases shall be final.

33.5 The Contractor shall not be entitled to any compensation suffered by him on account of delays in commencing or executing the work whatever the cause of delay may be, including delays arising out of modifications to the work entrusted to him or in any subcontracts connected therewith or delays in awarding contracts for other trades of the project or in commencement or completion of such other works or in procuring Government controlled or other building materials for any other reasons whatsoever. The Owner shall not be liable for any sum besides the tender amount, subject to such variations as are provided for herein and as instructed by Architects/PMC/ Owner. However, necessary time extension will be given if the delays are not attributed to the Contractor.

This Agreement made at ……………………………….this …………….. day of………….. 2017.Between the State Bank of India, Pune Zonal Office, Premises department, 3rd floor Sharda Chambers, Shankar Sheth road, Pune and having one of the corporate offices at state bank Bhavan, Madame Cama Road, Nariman point, Mumbai-400021, Hereinafter referred to as “the Bank” (which expression shall unless it be repugnant to the context or meaning thereof mean and which expression shall unless repugnant to the context or meaning thereof shall include its successors and assigns of the first PART.

WHERESAS the Owner is desirous of carrying out ELECTRICAL WORK OF STATE BANK OF INDIA – TWO DGM DESIGNATED HOUSES POSTED AT PUNE AND ONE GUEST HOUSE FOR OFFICERS AT MADHUBAN SBI QUARTER, PUNE, and has prepared drawings and specifications describing the work to be done prepared by, Vastukala Design Build Solutions Private Ltd, Mumbai its Architects (hereinafter referred to as the Architects) and WHEREAS the said drawings and the specifications and the priced Schedule of quantities have been signed by or on behalf of the parties hereto and WHEREAS the Contractor has agreed to execute up to and subject to the conditions set forth herein (hereinafter referred to as “the work shown upon the said Drawings” and described in “the said Specifications” and the said “Priced Schedule of Quantities at the respective Rates mentioned in the Priced Schedule/ Purchase Order of Quantities attached.

And WHEREAS the Contractor has submitted Security Deposit of Rs. ………………..……………………………(Rupees.……………………….…………Only) with the Owner.

NOW IT IS HEREBY AGREED AS FOLLOWS:

(1) In consideration of the payments to be made to the Contractor as hereinafter provided he shall upon and subject to the conditions of contract execute and complete the works shown upon the said drawings and such further detailed drawings as may be furnished to him by the said Architects and described in the Specifications and the said Priced Schedule of Quantities.

(2) The Owner shall pay the Contractor such sums as shall become due and payable hereunder at the times and in the manner specified in the said conditions.

(3) The term the "Architects/PMC" in the said conditions shall mean the said Vastukala Design Build Solutions Private Ltd, Mumbai or in the event of their winding-up or ceasing to be Architects for the purpose of this contract, such other person or shall be nominated for that by the Owner, not being a person to whom the Contractor shall object for reasons considered to be sufficient by the Owner. Provided always that no persons subsequently appointed to be Architects under this contract shall be entitled to

disregard or overrule any decision or approval or direction given or expressed in writing by the Architects for the time being unless specifically approved by the owner.

(4) The tender drawings, agreement, documents and terms and conditions of NIT above mentioned shall form the basis of this Contract and the decision of the said Architects or the other Architects/PMC for the time being as mentioned in the Conditions of the Contract in reference to all matters of dispute as to the material, workmanship or account and as to the intended interpretation of the clauses of this agreement or any other document attached hereto shall be final and binding on both parties.

(5) The Owner through the Architects/PMC reserves to itself the right of altering the drawing and nature of work and of adding to or omitting any items of work and of having portions of the same carried out departmentally or otherwise and such alterations or variations shall be carried out without prejudice of this contract.

(6) The said Contract comprises the work above mentioned and all subsidiary works connected there within the same site as may be ordered to be done from time to time by the said Architects/PMC or the other Architects for the time being even though such works may not be shown on the drawings or described in the said specifications or the Priced Schedule of Quantities.

(7) The said conditions shall be read and construed forming part of this agreement and the Parties hereto will respectively abide by and submit themselves to the conditions and stipulations and perform the agreement on their parts respectively in such conditions contained.

(8) All disputes arising out of or in any way connected with this agreement shall be deemed to have arisen in PUNE and only the courts in PUNE alone shall have exclusive jurisdiction to determine the same.

(9) Arbitration: The Contract shall be governed by, and construed in accordance with the laws of India. Any dispute which cannot be amicably settled by the parties may be resolved through Arbitration as per clause 37.0 of GCC.

2.0 If the work or any part thereof is awarded to me/us, I/we undertake to perform the work in accordance with the contract documents as defined in the form of contract forming part of the tender documents and accept the terms and conditions of contract as laid down therein and undertake that on receipt of acceptance of tender and on confirmation. I/We will deposit such sums as may be necessary under the terms of contract and abide by the terms of the tender. GENERAL CONDITIONS OF CONTRACT

1.0 Definitions:"Contract means the documents forming the tender and the acceptance thereof and the formal agreement executed between State Bank of India (client) and the contractor, together with the documents referred therein including these conditions, the specifications, designs, drawings and instructions issued from time to time by the architects/ Bank and all these documents taken together shall be deemed to form one contract and shall be complementary to one another.

1.1 In the contract the following expressions shall, unless the context otherwise requires, have the meaning hereby respectively assigned to them.

1.1.1 'SBI’ shall mean State Bank of India (client) having its Corporate Centre at State Bank Bhavan, Madame Cama Road, Mumbai - 400021 and includes the clients representatives, successors and assigns.

‘Architects/consultants’ shall mean “Vastukala Design build Solutions Pvt. Ltd.”, Mumbai.

1.1.2 ‘Site Engineer' shall mean an Engineer appointed by the Bank as their representative to give instructions to the contractors.

1.1.3 ‘The Contractor' shall mean the individual or firm or company whether incorporated or not, undertaking the works and shall include legal personal representative of such individual or the composing the firm or company and the permitted assignees of such individual or firms of company.

The expression ‘works' or ‘work' shall mean the permanent or temporary work described in the "Scope of work" and / or to be executed in accordance with the contract and includes materials, apparatus, equipment, temporary supports, fittings and things of all kinds to be provided, the obligations of the contractor hereunder and work to be done by the contractor under the contract.

1.1.4 ‘Engineer' shall mean the representative of the Architect/consultant.

1.1.5 ‘Drawings’ shall mean the drawings prepared by the Architects and issued by the Engineer and referred to in the specifications and any modifications of such drawings as may be issued by the Engineer from time to time ‘Contract value shall mean the value of the entire work as stipulated in the letter of acceptance of tender subject to such additions thereto or deductions there from as may be made under the provision herein after contained.

1.1.6 ‘Specifications’ shall mean the specifications referred to in the tender and any modifications thereof as may time to time be furnished or approved by the architect/consultant "Month" means calendar month.

1.1.7 “Week" means seven consecutive days.

1.1.8 "Day" means a calendar day beginning and ending at 00 Hrs. and 24 Hrs. respectively

CLAUSE

1.0 Total Security Deposit:

Total Security deposit comprise ofEarnest Money Deposit Initial security deposit Retention Money

a) Earnest Money Deposit:The tender shall furnish EMD of Rs. 6,500/- in the form of DD of any Nationalized bank drawn in favour of State Bank of India, payable at Pune. No tender shall be considered unless the EMD is so deposited in the required form. No interest shall be paid on this EMD. The EMD of the unsuccessful tenderer shall be refunded soon after the decision to award the contract is taken without interest. The EMD shall stand absolutely forfeited if the tenderer revokes his tender at any time the period when he is required to keep his tender open acceptance by the SBI or after it is accepted by the SBI the contractor fails to enter into a formal agreement or fails to pay the initial security deposit as stipulated or fails to commence the work within the stipulated time.

b ) Initial Security Deposit (ISD):The amount of ISD shall be 2% of accepted value of tender including the EMD in the form of D/D drawn on any scheduled Bank and shall be deposited within 15 days from the date of acceptance of tender.

c ) Retention Money:Besides the ISD as deposited by the contractor in the above said manner the retention money shall be deducted from the running account bill at the rate of 10% of the gross value of work done by the contractor and claimed in each bill provided the total security deposit i.e. the ISD plus Retention Money shall both together not exceed 5% of the contract value. 50% of the total security deposit shall be refunded to the contractor without any interest on issue of Virtual Completion certificate by the Architect/consultant. The balance 50% of the total security deposit shall be refunded to the contractors without interest within fifteen days after the end of defects liability period provided the contractor has satisfactorily attended to all defects in accordance with the conditions of contract including site clearance.

2.0 Language:The language in which the contract documents shall be drawn shall be in English.

3.0 Errors, omissions and discrepancies:In case of errors, omissions and / or disagreement between written and scaled dimensions on the drawings or between the drawings and specifications etc., the following order shall apply.

I.Between scaled and written dimension (or description) on a drawing, the latter

shall be adopted.II.Between the written or shown description or dimensions in the drawings and

the corresponding one in the specification the former shall be taken as correct.III.Between written description of the item in the specifications and descriptions

in bills of quantities of the same item, the former shall be adopted. IV.In case of difference between rates written in figures and words, the rate in

word shall prevail.V.Between the duplicate / subsequent copies of the tender, the original tender

shall be taken as correct.

4.0 Scope of work:The contractor shall carryout complete and maintain the said work in every respect in strictly accordance with this contract and with the directions of and to the satisfaction of the bank to be communicated through the architect/consultant. The architect/consultant at the directions of the Bank from time to time issue further drawings and / or written Instructions, details directions and explanations which are hereafter collectively referred to as Architect’s /consultant's instructions in regard to the variation or modification of the design, quality or quantity of work or the addition or omission or substitution of any work. Any discrepancy in the drawings or between the BOQ and / or drawings and / or specifications. The removal from the site of any material brought thereon by the Contractor and any substitution of any other materials therefore the removal and / or re-execution of any work executed by him. The dismissal from the work of any person employed / engaged thereupon.

5.0 i) Letter of acceptance:

Within the validity period of the tender the bank shall issue a letter of acceptance either directly or through the architect by registered post or otherwise depositing at the address of the contractor as given in the tender to enter into a contract for the execution of the work as per the terms of the tender. The letter of acceptance shall constitute a binding contract between the SBI and the contractor.

ii) Contract agreement:On receipt of intimation of the acceptance of tender from the SBI / Architect the successful tenderer shall be bound to implement the contract and within fifteen days thereof he shall sign an agreement in a non-judicial stamp paper of appropriate value.

6.0 Ownership of drawings:All drawings, specifications and copies thereof furnished by the SBI through its architects / consultants are the properties of the SBI. They are not to be used on other work.

7.0 Detailed drawings and instructions:The SBI through its architects/consultants shall furnish with reasonable promptness additional instructions by means of drawings or otherwise necessary for the proper execution of work. All such drawings and instructions shall be consistent with the contract documents, true developments thereof and reasonably inferable there from. The work shall be executed in conformity therewith and the contractor prepares detailed program schedule indicating therein the date of start and completion of various activities on receipt of the work order and submit the same to the SBI through the architect / consultant.

8.0 Copies of agreement:Two copies of agreement duly signed by both the parties with the drawings shall be handed over to the contractor.

9.0 Liquidated damages:If The contractor fails to maintain the required progress in terms of clause 6.0 of GOC or to complete the work and clear the site including vacating their office on or before the contracted or extended date or completion without justification in support of the cause of delay, he may be called upon without prejudice to any other right of remedy available under the law to the SBI on account of such breach to pay a liquidated damages at the rate of 0.5% of the contract value which subject to a maximum of 5% of the contract value.

10.0 Materials, Appliances and Employees:Unless or otherwise specified the contractor shall provide and pay for all materials, labour, water, power, tools, equipment transportation and any other facilities that are required for the satisfactory execution arid completion of the work. Unless or otherwise specified all materials shall be now and both workmanship and materials shall be best quality. The contractor shall at all times enforce strict discipline and good order among his employees and shall not employ on the work any unfit person or anyone not skilled in the work assigned to him. Workman whose work or behavior is found to be unsatisfactory by the SBI/ architect/ consultant he shall be removed from the site immediately.

11.0 Permits, Laws and Regulations:Permits and licenses required for the execution of the work shall be obtained by the contractor at his own expenses. The contractor shall give notices and comply with the regulations, laws, ordinances rules, applicable to the contract. It the contractor observes any discrepancy between the drawings and specifications, he shall promptly notify the SBI in writing under intimation of the Architect/ Consultant. If the contractor performs any act which is against the law, rules and regulations he shall meet all the costs arising there from and shall indemnify the SBI any legal actions arising there from.

12.0 Setting out Work:The contractor shall set out the work and shall be responsible for the true and perfect setting out of the same and for the correctness of the positions, levels, dimensions, and alignment of all parts thereof and get it approved by the architect/ consultant before proceeding with the work. It at any time any error in this respect shall appear during the progress of the works, irrespective of the fact that the layout had been approved by the architect / consultant the contractor shall be responsible for the same ad shall at his own expenses rectify such error, if so, required to satisfaction of the SBI.

13.0 Protection of works and property:The contractor shall continuously maintain adequate protection. Of all his work from

damage and shall protect the SBI's properties from injury or loss arising in connection with contract. He shall make good any such damage, injury, loss, except due to causes beyond his control and due to his fault or negligence.He shall take adequate care and steps for protection of the adjacent properties. The contractor shall take all precautions for safety and protections of his employees on the works and shall comply with all applicable provisions of Govt. and local bodies safety laws and building codes to prevent accidents, or injuries to persons or property on, about or adjacent to his place of work. The contractor shall take insurance covers as per clause 26.0 at his own cost. The policy may take in joint names of the contractor and the SBI and the original policy may be lodged with the SBI.

14.0 Inspection of work:The SBI / Architect Consultant or their representatives shall at all reasonable times have free access to the work site and/ or to the workshop, factories, or other places where materials are lying or from where they are obtained and the contractor shall give every facility to the SBI, Architect / consultant and their representatives necessary for inspection and examination and test of the materials and workmanship. No person unless authorized by the SBI/ Architect / Consultant except the representative of Public authorities shall-be allowed on the work at any time. The proposed work either during its construction stage or its completion can also be inspected by the Chief Technical Examiner's organization a wing of Central Vigilance commission.

15.0 Assignment and subletting:The whole of work included in the contract shall be executed the contractor and he shall not directly entrust and engage or indirectly transfer, assign or underlet the contract or any part or share thereof or interest or interest therein without the written consent of the SBI through the architect and no undertaking shall relieve the contractor from the responsibility of the contractor from active superintendence of the work during its progress.

i) Quality of materials, workmanship and test:All materials and workmanship shall be best of the respective kinds described in the contract and in accordance with Architect /consultant instructions and shall be subject from time to time to such tests as the architect/consultant may direct at the place of manufacture or fabrication or on site or on approved testing laboratory. The contractor shall provide such assistance, instruments, machinery, labour, and materials as are normally required for examining measuring sampling and testing any material or part of work before incorporation in the work for testing as may be selected and required by the architect/ consultant.

ii) Samples: All samples of adequate numbers, size, shades, & pattern as per specifications shall be

supplied by the contractor without any extra charges. If certain items proposed to be used are of such nature that samples cannot be presented or prepared at site detailed literature / test certificate of the same shall be provided to the satisfaction of the architect/consultant. Before submitting the sample/literature the contractor shall satisfy himself that the material / equipment for which he is submitting the sample /

literature meet with the requirement of tender specification. Only when the samples are approved in writing by the architect / consultant the contractor shall proceed with the procurement and installation of the particular material / equipment. The above samples shall be signed by the architect / consultant for identification and shall be kept on record at site office until the completion of work for inspection / comparison at any time. The architect /consultant shall take reasonable time to approve the sample. Any delay that might occur in approving the samples for reasons of its not meeting the specifications or other discrepancies inadequacy in furnishing samples of best qualities from various manufacturers and such other aspects causing delay on the approval of the materials / equipment etc. shall be to the account of the contractor.

iii) Cost of tests: The cost of making any test shall be borne by the contractor if such test is intended by

or provided.

iv) Costs of tests not provided for: If any test is ordered by the Architect/Consultant which is either

a) If so intended by or provided for or (in the cases above mentioned) is not so particularized, or though so intended or provided for but ordered by the Architect / Consultant to be carried out by an independent person at any place other than the site or the place of manufacture or fabrication of the materials tested or any Government / approved laboratory, then the cost of such shall be borne by the contractor.

16.0 Obtaining Information related to execution of work:No Claim by the contractor for additional payment shall be entertained which is consequent upon failure on his part to obtain information as to any matter affecting the execution of the work nor any misunderstanding or the obtaining incorrect information or the failure to obtain correct information relieve him from any risks or from the entire responsibility for the fulfillment of contract.

17.0 Contractor’s superintendence:The contractor shall give necessary personal superintendence during the execution of the work and as long, thereafter, as the Architect / consultant may consider necessary until the expiry of the defects liability period, stated hereto.

18.0 Quantities:i. The bill of quantities (BOQ) unless or otherwise sated shall be deemed to have

been prepared in accordance with the Indian standard method of measurements and quantities. The rate quoted shall remain valid for variation of quantity against individual item to any extent subject to maximum variation of the contract value by 25%. All the amount paid under clause 20, 21 hereof as well as amounts of prime cost and provisional sums, if any, shall be excluded.

ii. Variation exceeding 25%: The item of work executed in relation to variation exceeding 25% shall be paid on the basis of provisions of clause 22(e) hereof.

19.0 Works to be measured:The Architect / Consultant may from time to time intimate to the contractor that he required the work to be measured and the contractor shall forthwith attend or spend a qualified representative to assist the architect in taking such measurements and calculations and to furnish all particulars or to give all assistance required by any of them. Such measurements shall be taken in accordance with the mode of measurements detailed in the specifications. The representative of the architect / consultant shall take joint measurement with the contractor’s representative and the measurement book shall be entered in the measurement book. The contractor or his authorized representative shall sign all the pages of the measurement book in which the measurements have been recorded in token of his acceptance. All the corrections shall be duly attested by both representatives. No over writings shall be made in the M book should the contractor not attend or neglect or omit to depute his representative to take measurements then the measurements recorded by the representative of the Architect / consultant shall be final. All authorized extra work, omissions and all variations made shall be included in such measurement.

20.0 Variations:No alteration, omission or variation ordered in writing by the Architect / consultant shall vitiate the contract. In case the SBI / Architect / Consultant thinks proper at any time during the progress of works to make any alterations in, or additions to or omissions from the works or any alteration in the kind or quality of the materials to be used therein, the Architect / Consultant shall give notice thereof in writing to the contractor or shall confirm in writing within seven days of giving such oral instructions the contractor shall alter to, add to, or omit from as the case may be in accordance with such notice, but the contractor shall not do any work extra to or make any alterations or additions to or omissions from the works or any deviation from any of the provisions of the contract, stipulations, specifications or contract drawings without previous consent in writing of the Architect / Consultant and the value of such extras, alterations, additions or omissions shall in all cases be determined by the Architect / Consultant and the same shall be added to or deducted from the contract value, as the case may be.

21.0 Valuation of Variations:No claim tor an extra shall be allowed unless it shall have been executed under the authority of the Architect / Consultant with the concurrence of the SBI as herein mentioned. Any such extra is herein referred to as authorized extra and shall be made in accordance with the following provisions.a.i. The net rates or prices in the contract shall determine the valuation of the extra

work where such extra work is of similar character and executed under similar conditions as the work priced herein.

ii. Rates for all items, wherever possible should be derived out of the rates given in the priced BOQ.

b. The net prices of the original tender shall determine the value of the items omitted, provided if omissions do not vary the conditions under which any

remaining items of works are carried out, otherwise the prices for the same shall be valued under sub- clause C hereunder.

c . Where the extra works are not of similar character and or executed under similar conditions as aforesaid or where the omissions vary the conditions under which any remaining items or works are carried out, then the contractor shall within 7 days of the receipt of the letter of acceptance inform the Architect / consultant of the rate which he intends to charge for such items of work, duly supported by analysis of the rate or rates claimed and the Architect / consultant shall fix such rate or prices as in the circumstances In his opinion are reasonable and proper, based on the market rate.

d. Mere extra work cannot be properly measured or valued the contractor shall be allowed day work prices at the net rates stated in the tender of the BOQ or, if not, so stated then in accordance with the local day work rates and wages for the district; provided that in either case, vouchers specifying the daily time (and if required by the Architect / Consultant) the workman's name and materials employed be delivered for verifications to the Architect / consultant at or before the end of the week following that in which the work has been executed.

e. It is further clarified that for all such authorized extra items where rates cannot be derived from the tender, the Contractor shall submit rates duly supported by rate analysis worked on the “market rate basis” for material, labour, hire / running charges of equipment and wastages etc. plus 15% towards establishment charges, contractor's overheads and profit. The rate shall be verified by the Architect/Consultant and recommended to the owner for approval. The decision of the owner shall be final. Such items shall not be eligible for escalation.

22.0 Final measurement

The measurement and valuation in respect of the contract shall be completed within six months of the virtual completion of the work.

23.0 Virtual completion certificate (VCC)On successful completion of entire works covered by the contract to the full satisfaction of the SBI, the contractor shall ensure that the following works have been completed to the satisfaction of the SBI.

a) Clear the site of all scaffolding, wiring, pipes, surplus materials, contractor’s labour, equipment and machinery.

b) Demolish, dismantle and remove the contractor's site office, temporary works, structures including labour sheds/camps and constructions and other items and things whatsoever brought upon or erected at the site or any land allotted to the contractor by the SBI, and not incorporated in the permanent works.

c) Remove all rubbish, debris etc. from the site and the land allotted to the contractor by the SBI and shall clear, level and dress, compact the site as required by the SBI.

d) Shall put the SBI in undisputed custody and possession of the site and all land allotted by the SBI.

e) Shall handover the work in a peaceful manner to the SBI.

f) All defects / imperfection have been attended and rectified as pointed out by the SBI to the full satisfaction of SBI.

Upon the satisfactory fulfillment by the contractor as stated above, the contractor shall be entitled to apply to the Architect / consultant is satisfied of the completion of the work. Relative to which the completion certificate has been sought, the Architect / consultant shall within fourteen (14) days of the receipt of the application for virtual consultant certificate, issue a VCC in respect of the work for which the VCC has been applied.This issuance of a VCC shall be without prejudice to the SBI's rights and contractor's liabilities under the contract including the contractor’s liability for defects liability period nor shall the insurance of VCC in respect of the works or work at any site be constructed as a waiver of any right or claim of the SBI against the contractor in respect of works or work at the site and in respect of which the VCC has been issued.

24.0 Work by other agencies:The SBI / Architect / consultant reserves the rights to use premises and any portion of the site for execution of any work not included in the scope of this contract which it may desire to have carried out by other persons simultaneously and the contractor shall not only allow but also extend reasonable facilities for the execution of such work. The contractor however shall not be required to provide any plant or material for the execution of such work except by special arrangement with the SBI. Such work shall be carried out in such manner as not to impede the progress of the works included in the contract.

25.0 Insurance of works34.1 without limiting his obligations and responsibilities under the contract the

contractor shall insure in the joint names of the SBI and the contractor against all loss of damages from whatever cause arising other than the excepted risks, for which he is responsible under the terms of contract and in such a manner that the SBI and contractor are covered for the period stipulated I clause 28 of GCC and are also covered during the period of maintenance for loss or damage arising from a cause, occurring prior to the commencement of the period of maintenance and for any loss or damage occasioned by the contractor in the course of any operations carried out by him for the purpose of complying with his obligations under clause.

a) The works for the time being executed to the estimated current Contract value thereof, or such additional sum as may be specified together with the materials for incorporation in the works at their replacement value.

a) The constructional plant and other things brought on to the site by the contractor to the replacement value of such constructional plant and other things.

b) Such Insurance shall be effected with an insurer and in terms approved by the SBI which approval shall not be unreasonably withheld and the contractor shall whenever required produce to the Architect / consultant the policy if insurance and the receipts for payment of the current premiums.

Damage to persons and propertyThe contractor shall, except if arid so far as the contract provides otherwise indemnify the SBI against all losses and Claims in respect of injuries or damages to any person or material or physical damage to any property whatsoever which may arise out of or in consequence of the execution and maintenance of the works and against all claims proceedings, damages, costs, charges and expenses whatsoever in respect of or in relation thereto except any compensation of damages for or with respect to:

a) This permanent use or occupation of land by or any part thereof. The right of SBI to execute the works or any part thereof on, over, under, in or

through any landsb) Injuries or damages t o persons or properties which are unavoidable

result of the execution or maintenance of the works in accordance with the contract.

Injuries or damage to persons or property resulting from any act or neglect of the SBI their agents, employees or other contractors not being employed by the contractor or for or in respect of any claims, proceedings, damages, costs, charges and expenses in respect thereof or in thereto or where the injury or damage was contributed to by the contractor, his servants or agents such part of the compensation as may be just and equitable having regard to the extent of the responsibility of the SBI, their employees, or agents or other employees, or agents or other contractors for the damage or injury.

Contractor indemnify SBI:The contractor shall indemnify SBI against all claims, proceedings, damages, costs, charges and expenses in respect of the matters referred to in the provision sub-clause of this clause.

Contractor's superintendence:The contractor shall fully indemnify and keep indemnified the SBI against any action, claim, or proceeding relating to infringement or use of any patent or design or any alleged patent or design rights and shall pay any royalties which may be payable in respect of any article or part thereof included in the contract. In the event of any claim made under or action brought against SBI in respect of such matters as aforesaid the contractor shall be immediately notified thereof and the contractor shall be at liberty, at his own expenses to settle any dispute or to conduct any litigation that may arise there from, provided that the contractor shall not be liable to indemnify the SBI if the infringement of the patent or design or any alleged patent or design right is the direct result of an order passed by the Architect / consultant in this behalf.

Third Party Insurance: 2.1.1 Before commencing the execution of the work the contractor but without limiting his obligations and responsibilities under clause 26.0 of GCC shall insure against his liability for any material or physical damage, loss, or injury which may occur to any property including that of SBI, or to any person, including any employee of the SBI, by or arising out of the execution of the works or in the carrying out of the contract, otherwise than due to the matters referred to in the provision to clause 26.0 thereof.

2.1.2 Minimum amount of Third Party Insurance:Such insurance shall be effected with an insurer and in terms approved by the SBI which approval shall not be reasonable withhold and for at least the amount stated below. The contractor shall, whenever required, produce to the Architect / consultant the policy or policies of insurance cover and receipts for payment of the current premiums.

2.1.3 The minimum insurance cover for physical property, injury, and death is Rs.5 lacs per occurrence with the number of occurrence limited to four. After each occurrence contractor will pay additional premium necessary to make insurance valid for four occurrences always.

34.2 Accidents or injury to workman:2.2.1 The SBI shall not be liable for or in respect of any damages or competition

payable at law in respect or in consequence of any accident or injury to any workmen or other person in the employment of the contractor or any sub-contractor, save and except an accident or injury resulting from any act or default of the SBI or their agents, or employees. The contractor shall indemnify and keep indemnified SBI against all such damages and compensation, save and except as aforesaid, and against all claims, proceedings, costs, charges and expenses whatsoever in respect thereof or in relation thereto.

2.2.2 Insurance against accidents etc. to workmen:The contractor shall insure against such liability with an approved by the SBI during the whole of the time that any persons are employed by him on the works and shall , when required, produce to the Architect / consultant such policy of insurance and receipt for payment of the current premium. Provided always that, in respect of any persons employed by any sub-contractor the contractor’s obligation to insure as aforesaid under this sub-clause shall be satisfied if the sub-contractor shall have insured against the liability in respect of such persons in such manner that SBI is indemnified under the policy but the contractor shall require such sub-contractor to produce to the Architect / consultant when such policy of insurance and the receipt for the payment of the current premium.

2.2.3 Remedy on contractor’s failure to insure:If the contractor fails to effect and keep in force the insurance referred to above or any other insurance which he may be required to effect under the terms of contract, then and in any such case the SBI may effect and keep in force any such insurance and pay such premium or premiums as may be necessary for that purpose and from time to time deduct the amount so paid by the SBI as aforesaid from any amount due or which may become due to the contractor, or recover the same as debt from the contractor.

2.2.4 Without prejudice to the other rights of the SBI against contractors. In respect of such default, the employer shall be entitled to deduct from any sums payable to the contractor the amount of any damages costs, charges, and other

expenses paid by the SBI and which are payable by the contractors under this clause. The contractor shall upon settlement by the insurer of any claim made against the insurer pursuant to a policy taken under this clause, proceed with due diligence to rebuild or repair the works destroyed or damaged. In this event all the monies received from the insurer in respect of such damage shall be paid to the contractor and the contractor shall not be entitled to any further payment in respect of the expenditure incurred for rebuilding or repairing of the materials or goods destroyed or damaged.

26.0 Commencement of Works:The date of commencement of the work will be reckoned as the date of handing over site or seven days from the date of issue of letter of acceptance of the tender by the SBI whichever is later.

27.0 Time for completion:Time is essence of the contract and shall be strictly observed by the contractor. The entire work shall be completed within a period of 60 Days from the date of commencement. If required in the contract or as directed by the Architect /consultant. The contractor shall complete certain portions of work before completion of the entire work. However the completion date shall be reckoned as the date by which the whole work is completed as per the terms of the contract.

28.0 Extension of time:If, in the opinion of the Architect/consultant, the work be delayed for reasons beyond the control of the contractor, the Architect / consultant may submit a recommendation to the SBI to giant a fair and reasonable extension of time for completion of work as per the terms of contract. If the contractor needs an extension of time for the completion of work or it the completion of work is likely to be delayed for any reasons beyond the due date of completion as stipulated in the contract, the contractor shall apply to the SBI through the Architect / Consultant in writing at least 30 Days before the expiry of the scheduled time and while applying for extension of time he shall furnish the reasons in detail and his justification if any, for the delays. The architect / consultant shall submit their recommendations to the SBI in the prescribed format for granting extension of time. While granting extension of time the contractor shall be informed the period extended time which will qualify for levy of liquidated damages. For the balance period in excess of original stipulated period and duly sanctioned extension of time by the SBI the provision of liquidated damages as stated under clause 9.0 of GCC shall become applicable. Further the contract shall remain in force even for the period beyond the due date of completion irrespective whether the extension is granted or not.

29.0 Rate of progress:Whole of the materials, plant and labour to be provided by the contractor and the mode, manner and speed of execution and maintenance of the works are to be of a kind and conducted in a manner to the satisfaction of the Architect / consultant should be the rate of the progress of the work or any part thereof be at any time in the opinion of the Architect / consultant too slow to ensure the completion of the whole of the work by the prescribed time or extended time for completion the Architect / consultant to expedite progress so as to complete the works by the prescribed time or extended time. Such communications from the Architect / consultant neither shall relieve the contractor from footing obligations under the

contract nor will he be entitled to raise any claims arising out of such directions.

30.0 Work during nights and holidays:Subject to any provision to the contrary contained in the contract no permanent work shall save as herein provided be carried on during the night or on holidays without the permission in writing of the Architect / consultant, save when the work is unavoidable or necessary for the saving of life or property or for the safety of the work in which case the contractor shall immediately advise the Architect / consultant. However the provisions of the clause shall not be applicable in the case of any work which becomes essential to carry by rotary or double shifts in order to achieve the progress and quality of the part of the works being technically required / continued with the prior approval of the Architect / consultant at no extra cost to the SBI.

31.0 No compensation or restrictions of workI.i. If at any time after acceptance of the tender SBI shall decide to abandon or

reduce the scope of work for any reason whatsoever and hence not required the whole or any part of the work to be carried out. The Architect / consultant shall give notice in writing to that effect to the contractor and the contractor shall act accordingly in the manner. The contractor shall have no claim to any payment of compensation or otherwise whatsoever, on account of any profit or advantage which he might have derived from the execution of the work fully but which he did not derive in consequence of the foreclosure of the whole part or part of the work.

I.ii. Provided that the contractor shall be paid the charges on the cartage only of materials actually and bonafide brought to the site of the work by the contractor and surplus as a result of abandonment, curtailment of the work or any portion thereof and then taken back by the contractor, provided however that the Architect / Consultant shall have in such cases the option of taking over all or any such materials at their purchase price or a local current rate whichever is less.

I.iii. “In cases of such stores having been issued from SBI stores and returned by the contractor to stores, credit shall be given to him at the rates not exceeding those at which were originally issued to the contractor after taking into consideration and deduction for claims on account of any deterioration or damage while in the custody of the contractor and in this respect the decision of the Architect / consultant shall be final.

32.0 Suspension of worki. The contractor shall, on receipt of the order in writing of the Architect /

consultant (whose decision shall be final and binding on the contractor) suspend the progress of works or any part thereof for such time and in such manner as Architect / consultant may consider necessary so as not to cause any damage or injury to the work already done or endanger the safety thereof for any of following reasons.

a) On account any default on the part of the contractor, orb) for proper execution of the works or part thereof for reasons other than the

default of the contractor, orc) for safety of the works or part thereof.

The contractor shall, during such suspension, properly protect and secure the

works to the extent necessary and carry out the instructions given in that behalf by the Architect / consultant.

ii.If the suspension is ordered for reasons (b) and (c) in sub-para (i) above:The contractor shall be entitled to an extension of time equal to the period of every such suspension. No compensation whatsoever shall be paid on this account.

33.0 Action when the whole security deposit is forfeitedIn any case in which under any clause or clauses of this contract, the Contractor shall have rendered himself liable to pay compensation amounting to the whole of security deposit the Architect / consultant shall have the power to adopt any of the following course as they may deem best suited to the interest of the SBI.a) To rescind the contract (of which rescission notice in writing to the contractor

by the Architect / consultant shall be conclusive evidence) and in which case the security deposit of the contractor shall be forfeited and be absolutely at the disposal of SBI.

b) To employ labour paid by the SBI and to supply materials to carry out the work, or any part of the work. debiting the contractor with the cost of the labour and materials (the cost of such labour and materials as worked out by the Architect / consultant shall be final and conclusive against the contractor) and crediting him with the value of the work done, in all respects in the same manner and at the same manner and at the same rates as if it had been carried out by the contractor under the terms of this contract, certificate of architect / consultant as to the value of work done shall be final and conclusive against the contractor.

c) To measure up the work of the contractor, and to take such part thereof as shall be unexecuted, out of his hands, and to give it to another contractor to complete in which case any expenses which may be incurred in excess of the sum which would have been paid to the original contractor, if the whole work had been executed by him (of the amount of which excess the certificates in writing of the Architects / consultant shall be final and conclusive) shall be borne by original contractor or otherwise, or from his security deposit or the proceeds of sale thereof, or sufficient part thereof. In the event of any of above courses being adopted by the SBI the contractor shall have no claim to compensation for any loss sustained by him by reasons of his having purchased or procured any material or entered into any engagements or make any advances on account of, or with a view to the execution of the work or the performance of the contractor and in case the contractor and in case the contract shall be rescind under the provision aforesaid, the contractor shall not be entitled to recover or to be paid any sum or any work thereto for actually performed under this contract, unless, and until the Architect / consultant will have certified in writing the performance of such work and the value payable in respect thereof, and he shall only be entitled to be paid the value so certified.

34.0 Owner’s right to terminate the contract:If the contractor being an individual or a firm commit any 'Act of insolvency' or shall be adjusted an insolvent or being an incorporated company shall have an order for compulsory winding up voluntarily or subject to the supervision of Govt. and of the Official Assignee of the liquidator in such acts of insolvency or winding up shall be

unable within seven days after notice to him to do so, to show to the reasonable satisfaction of the Architect / Consultant that he is able to carry out and fulfill the contract, and to give security therefore if so required by the Architect / consultant. Or it the contractor (whether an individual firm or incorporated Company) shall suffer execution to be issued or shall suffer any payment under this contract to be attached by or on behalf of any of the creditors of the contractor. Or shall or sublet this contract without the consent in writing of the SBI through the Architect / consultant or shall charge or encounter this contract or any payment due to which may become due to the contractor thereunder:

a) has abandoned contract; orb) has failed to commence the works, or has without any lawful excess under these

conditions suspended the progress of the works for 14 days after receiving from the SBI through the Architect / consultant written notice to proceed, or

c) has failed to proceed with the works with such diligence and failed to make such due progress as would enable the works to be completed within the time agreed upon, or has failed to remove the materials from the site or to pull down and replace work within seven days after written notice from the SBI through the Architect / consultant that the said materials were condemned and rejected by the Architect / consultant under these conditions; or has neglected or failed persistently to observe and perform all or any of the acts, matters or things by this contract to be observed and performed by the contractor for seven days after written notice shall have been given to the contractor to observe or perform the same or has to the detriment of good workmanship or in defiance of the SBI’s or Architect’s / consultant’s instructions to the contrary subject any part of the contract. Then and in any of said cases the SBI and or the Architect / consultant, may not withstanding any previous waiver, after giving seven days’ notice in writing to the contractor, determine the contract, but without thereby affecting the powers of the SBI or the Architect / consultant or the obligation and liabilities of the contractor the whole of which shall continue in force as fully as if the contract had not been so determined and as if the works subsequently had been executed by or on behalf of the contractor. And, further the SBI through the Architect / consultant their agents or employees may enter upon and take possession of the work and all plants, tools, scaffoldings, materials, sheds, machineries lying upon the premises or on the adjoining lands or roads use the same by means of their own employees or workmen in carrying on and completing the work or by engaging any other contractors or persons to complete the work and the contractor shall not in any was interrupt or do any act, matter or thing to prevent or hinder such other contractor or other persons employed for completing and finishing or using the materials and plant for the works.When the works shall be completed or as soon thereafter as convenient the SBI or the architect / consultant shall give a notice in writing to the contractor to remove his surplus materials and plants and should the contractor fail to do so within 14 days after receipt thereof by him the SBI sell the same by public auction after due publication, and shall adjust the amount realized by such auction. The contractor shall have no right to question any of the acts of the SBI incidental to the sale of the materials etc.

35.0 Certificate of payment:The contractor shall be entitled under the certificates to be issued by the Architect / consultant to the contractor within 10 working days from the date of certificate to the payment from SBI from time to time. The SBI shall recover the statutory recoveries other dues including the retention amount from the certificate of payment.Provided always that the issue of any certificate by the Architect / consultant during the progress of works or completion shall not have effect as certificate of satisfaction or relieve the contractor from his liability under clause.The Architect / consultant shall have power to withhold the certificate if the work or any part there is not carried out to their satisfaction.The architect / consultant may by any certificate make any corrections required in previous certificate.The SBI shall modify the certificate of payments as issued by the architect / consultant from time to time while making the payment.The contractor shall submit interim bills only after taking actual measurements and properly recorded in the Measurement books.The contractor shall not submit interim bills when the approximate value of work done by him is less than Rs. 2,00,000/- and the minimum interval between two such bills shall be one month. The final bill may be submitted by contractor within a period of one month from the date of virtual completion and Architect/Consultant shall issue the certificate of payment within a period of two months. The SBI shall pay the amount within a period of three months from the date of issue of certificate provided there is no dispute in respect of rates & quantities. The contractor shall submit the interim bills in the prescribed format with all details.

36.1. Basis of Payment in RA bills Payment in RA bills shall be based on quantity of work executed at site (as per the

item of work) & verified by Owner/Architects/PMC as per the item rate in work orders. Owner/ Architects/PMC is authorized to allow part rate/reduced rate for any item of work. The Architect shall specify the reason for the part rate payment in the RA bill.

36.2. Disallowance of payment If payment has been made in RA bill for any item of work but later on some defect is

noticed, Owner/Architects/PMC is authorized to disallow the payment in the subsequent bills till rectification of the work.

36.3. Final bill The final bill complete in all respect shall be submitted by the contractor within 60

days from the completion of the work. The bill should be accompanied with the following documents.

a.i. Job completion certificate.a.ii. No claim certificate on Owner/s prescribed proforma

a.iii. Site clearance certificate.a.iv. Indemnity certificate towards labour payment and all statutory payments.a.v. Certificate of test on materials etc.

a.vi. Statement of accounts showing the advances taxes, deductions, security deposit at a latest position duly attested by Owner.

a.vii. Certificate of joint measurement sheets – Duly signed by the Owner, Contractor and Architect/PMC.

a.viii. Copy of the insurance policy. (Workmen compensation act and contractors all risk policy).

a.ix. Contractor should submit as-built drawings 2 sets of hard copies.a.x. Contractor should submit Operation and Maintenance manuals and testing and

commissioning reports with Guarantee and Warranty certificates. a.xi. Original quality control record, measurement records and any other joint site

records maintain at site. No claim shall be entertained after receipt of final bill.a.xii. Settlement of final bill shall be made subject to deduction of all dues payable

by contractor, settlement of all disputes and furnishing of all required documents/clarifications and grant of extension of time, if any, by Owner’s competent authority.

36.4. ESCALATIONNo Escalation shall be paid on any account.

36.0 Settlement of disputes & arbitration:

37.1. All disputes or differences of any kind whatsoever which shall at any time arises between the parties hereto touching or concerning the works or the execution of maintenance thereof. This contract or the rights touching or concerning the works or the execution or maintenance thereof the construction remaining operation or effect thereof or to the rights or liabilities of the parties or arising out of or in relation there to whether during or after determination, foreclosure or breach of the contract within (other than those in respect of which the decision of any person is by the contract expressed to be final and binding) shall after written notice by either party to the contract to; other of them and to the appointment authority who shall be appointed for this purpose by the SBI be referred for adjudication to a sole arbitrator to be appointed as herein after provided.

37.2. For the purpose of appointing the sole arbitrator referred to above, the appointing authority will send within thirty days of receipt by him the written notice aforesaid to the contractor a panel of three names of persons who shall be presently unconnected with the organization for which the work is executed.

37.3. The contractor shall on receipt by him of the names as aforesaid select any one of the persons named to be appointed as a sole arbitrator and communicate his / her names to the appointing authority within thirty days of receipt by him of the names. The appointing authority shall thereupon without any delay appoint the said person as the sole arbitrator. If the contractor fails to communicate such selection as provided above within the period specified, the appointing authority shall make the selection and appoint the selected person as the sole arbitrator. If the appointing authority fails to send to the contractor the panel of three names as aforesaid within the period specified, the contractor shall send to appointing authority a panel of three names of three persons who shall be unconnected with either party. The appointed shall on receipt by him of the names as aforesaid select any one of the person named and appoint him as sole arbitrator within 30 days of receipt by the entitled to appoint one of the persons from the panel as the sole arbitrator and communicate his name to the appointing authority.

37.4. If the arbitrator so appointed is unable or unwilling to act or resigns his appointment or vacates his offices due to any reason whatsoever another sole arbitrator shall be appointed as aforesaid.

37.5. The work under the contract shall however continue during the arbitration proceedings and no payment due to payable to the contractor relating to the disputed items shall be withheld on account of such proceedings.

37.6. The arbitrator shall be deemed to have entered on the reference on the date he issues notice to both parties fixing the date of first hearing.

37.7. The a rb i t r a to r f rom t ime to t ime wi th the consent of the parties enlarges the time for making and publishing the award.

37.8. The arbitrator shall give a separate award in respect of each dispute or difference referred to him. The arbitrator shall decide each dispute in accordance with terms of the contract and give a reasoned award.

37.9. The fees, if any, of the arbitrators shall if required to be paid before the award is made and published, be shared equally by both parties.

37.10. The award of the arbitrator shall be final and binding on both parties.

37.11. Subject to aforesaid the provisions of the arbitration act 1940 or any statutory modifications or re-enactment thereof and the rules made there under, and the time in force shall apply to the arbitration proceeding under this clause.

37.12. In all cases where the amount of the claim is in dispute is Rs……………………..and the arbitrator shall give reasons for the award.

37.13. It is also a term of contract that if the contractor does not make any demand for arbitration in respect of any claim(s) within 90 days of receiving intimation from SBI that the bill after verification is passed for payment of a lesser amount or otherwise the contractor's right under this agreement to refer to arbitration shall be deemed to have been forfeited and SBI shall be relieved and discharged of their liability under this, agreement in respect of this claim(s). Further it is agreed that for the purpose of this clause such notice is deemed to been received by the contractor within two days of posting of the letter by SBI or delivered by hand immediately after receipt thereof by the contractor whichever is earlier. Further a letter signed' by the officials of the SBI the letter was posted to the contractor shall be conclusive.

37.0 Water supply

The contractor shall make his own arrangements for water required for the work and nothing extra will be paid for the same. This will be subject to the following conditions:

i) That the water used by the contractor shall be fit for construction purposes of water satisfaction of the Architect / consultant.

ii) The contractor shall make alternative arrangements for the supply of water if the arrangement made by the contractor for procurement of water in the opinion of the Architect/consultant is unsatisfactory.

38.1. The contractor shall construct temporary well/tube well in SBI land for taking for construction purpose only after obtaining permission in writing from the SBI. The contractor has to make his own arrangements for drawing and distributing the water at his own cost. He has to make necessary arrangements. To avoid any accidents or damages caused due to construction and subsequent maintenance of the wells. He has to obtain necessary approvals from local authorities, if required, at his own cost. He shall restore the ground to its original condition after wells are dismantled on completion of work or hand over the well to the SBI without any compensation as directed by the architect / consultant.

38.0 Power supplyThe contractor shall make his own arrangements for power and supply / distribution system for driving plant or machinery for the work and for lighting purpose at his own cost. The cost of running and maintenance of the plants are to include in his tender prices. He shall pay all fees and charges required for the power supply and include the same in his tendered rates and hold the owner free from all such costs. He has to obtain necessary approval from the appropriate authorities, if required.

39.0 Treasure trove etc.Any treasure trove, coin or object antique which may be found on the site shall be the property of SBI and shall be handed over to the bank immediately.

40.0 Method of measurementUnless otherwise mentioned in the schedule of quantities or in mode of measurement, the measurement will be on the net quantities or work produced in accordance with up to date. Rules laid down by the Bureau of Indian Standards. In the event any dispute disagreement the decision of the Architect / consultant shall be final and binding on the contractor.

41.0 Maintenance of registersThe contractor shall maintain the following registers as per the enclosed proforma at site of work and should produce the same for inspection of SBI / architect I consultant whenever desired by them. The contractor shall also maintain the records / registers as required by the local authorities / Govt. from time to time.

i) Register for cement / paint / lead / specific materialsii) Register for steeliii) Drawing register iv) Materials at site registerii) Register for secured advanceiii) Register for bulk age of sandiv) Register for silt testv) Register for sieve analysis for the fine aggregatevi) Register for sieve analysis for course aggregatevii) Register for slump testviii) Register for concrete cube testix) Register for hindrance to work

42.0 Price variation adjustment for all materials including labour in partial modification of the provision made elsewhere in this contract regarding the quoted rate being not subject to any variations price adjustments to the value of work payable to the contractor at tendered rates shall be paid towards variation in the prices of materials and labour in the manner specified hereunder. If after the written order to commence the work and during the operating period of this contract including any authorized extensions of the original stipulated period of completion.

(a) In partial modification of the stipulation that the rates quoted shall be firm and shall not be subject to any exchange variations, labour conditions, fluctuations in railway freight and any conditions whatsoever under this clause any increase or decrease in prices of materials and labour rates shall be adjusted on the basis of formula given below:

i) MATERIALS: Vm = (70/100)*[0.88v-(C+S+X)]*(WI-WIO)/WIO

Where:

Vm = Variation in material cost i.e. increase or decrease in the amount in rupees to be paid or recovered.

V = Value of work done excluding advances on materials, if any during the period under reckoning.

C = Cost of grey cement used in the workCovered by clause 22 of the general instruction to the contractor and special conditions.

S = Cost of steel used in the work

X = Cost of any other material supplied at fixed basic rate.

WI = Average All India wholesale Price Index for all commodities for the period under reckoning as published in the RBI Bulletin. In case the tender is opened on or before 10th day of a month, on Index, of previous month shall be considered.

WIO = Average All India wholesale Price Index for all commodities during the month of opening of the tender, as published in the RBI Bulletin.

ii) LABOUR: VL = (30/100)*[0.88V – (C+S)] *(I-IO)IO

Where:

VL = Variation in labour cost i.e. increase or decrease in the amount in rupees to be paid or recovered.

V, S & S = as stated under (i) above

I = Average All India Consumer Price Index Number for Industrial Workers declared by labour Bureau, Govt. of India as published in RBI, Bulletin, during the period under reckoning.

IO = All India Consumer Price Index Number for Industrial Workers declared by labour Bureau, Govt. of India as published in RBI, Bulletin, during the months of opening of the tender. In case if the tender are opened on or before 10th day of a month the index for last month shall be considered.

1. Adjustments based on the above formulae will be made for each bill as and when the indices are published. The contractors shall submit the bill for price adjustment with detail calculations.

2. The downward adjustment on account of labour element will be made only if the minimum wages also register corresponding fall compared to the minimum wages prevailing in the month of opening of the tenders.

3. The price adjustment clause shall be applicable only for the work executed during the contract period including authorized extension, if any. In case the work is not completed within the contract period including authorized extension and the provision of liquidated damages has to be enforced, this adjustment clause will not be applicable for work done during that period. It is also clarified that price adjustment clause will not be applicable to any extra variation items, the rates of which are based on prevailing market rate.

4. In view of the price adjustment in cost being covered as above, no other adjustments viz, increase or decrease due to statutory measures/levies, etc., will be allowed for any reasons whatsoever.

5. In case the bill is submitted to the Assistant Engineer prior to 15 th of a particular month, index for that month, index for that month will not be reckoned for calculating the average indices for arriving at the adjustment. If however, the bill is submitted on or after 15th, the Index for that particular month shall be taken into consideration.

6. Immediately on award of contract, the contractor shall register with the appropriate authority obtain Sales Tax Registration No. and produce the details thereof to the Bank within 30 days of the award of the work and in no case later than the submission of his first running bill.

7. The successful tenderers may also note that the Bank reserves the right to deduct Sales Tax on works contract applicable and to be levied under relevant Act, from the bills and amount due to them from Bank and remit the same directly to the Government in case they are not submitting the

proof/evidence of having paid the Sales Tax on work executed under this contract.

43.0 Force majeure1. Neither contractor nor SBI shall be considered in default in performance of their obligations

if such performance is prevented or delayed by events such as but not to war, hostilities revolution, riots, civil commotion, strikes, lockout, conflagrations, epidemics, accidents, fire, storms, floods, droughts, earthquakes or ordinances or any act of god or for any other cause beyond the reasonable control of the party affected or prevented or delayed. However a notice is required to be given within 30 days from the happening of the event with complete details, to the other party to the contract, if it is not possible to serve a notice, within the shortest possible period without delay.

1.1. As soon as the cause of force majeure has been removed the party whose ability to perform its obligations has been affected, shall notify the other of such cessation and the actual delay incurred in such affected activity adducing necessary evidence in support thereof.

1.2. From the date-of occurrence of a case of force majeure obligations of the party affected shall be suspended during the continuance of any inability so caused. With the cause itself and inability resulting there from having been removed, the agreed time of completion of the respective obligations under this agreement shall stand extended by a period equal to the period of delay occasioned by such events.

1.3. Should one or both parties be prevented from fulfilling the contractual obligations by a state of force majeure lasting to a period of 6 months or more the two parties shall each other to decide regarding the future execution of this agreement.

44.0 Local laws, Acts, Regulations:The contractor shall strictly adhere to all prevailing labour laws inclusive of contract labour (regulation & abolition act of 1970) and other safety regulations. The contractor shall comply with the provision of all labour legislation including the latest requirements of all the Acts, laws, any other regulations that are applicable to the execution of the project.

SPECIAL CONDITIONS OF CONTRACT

1.0 Scope of work:The scope of work is to carry out the ELECTRICAL WORK OF STATE BANK OF INDIA – TWO DGM DESIGNATED HOUSES POSTED AT PUNE AND ONE GUEST HOUSE FOR OFFICERS AT MADHUBAN SBI QUARTER, PUNE

2.0 Address of site:The site is located at Pune

3.0 Dimensions and levels:All dimensions and levels shown on the drawings shall be verified by the contractor on the site and he will be held responsible for the accuracy and maintenance of all the dimensions and the levels. Figured dimensions are in all cases to be accepted and no dimensions shall be scaled. Large scale details shall take precedence over small-scale drawing. In case of discrepancy the contractor shall ask for clarification from the Architect/ consultant before proceeding with the work.

4.0 Notice of operation:The contractor shall not carry out any important operation without the Consent in writing from the Architect / consultant.

5.0 Construction records:The contractor shall keep and provide to the Architect / consultant full and accurate records of the dimensions and positions of all new work and any other information necessary to prepare complete drawings recording details of the work as constructed.

6.0 Safety of adjacent structures and trees:The contractor shall provide and erect to the approval of the Architect/consultant such supports as may be required to protect effectively all structures and protective guards to trees which may be endangered by the execution of the works or otherwise take such permanent measures as may he required by the Architect to protect the trees and structures.

7.0 Temporary works:Before any temporary works are commenced the contractor shall submit at least 7 days in advance to the architect/consultant for approval complete drawing of all temporary work he may require for the execution of the works. The contractor shall carry out the modifications relating to strength, if required by the architect/consultant may require in accordance with the conditions of contract at his own cost. The contractor shall be solely responsible for the stability and safety of all temporary works and unfinished works and for the quality of the permanent works resulting from the arrangement eventually adopted for their execution.

8.0 Temporary roads:The contractor shall provide access roads to the site from the nearest main road at no extra cost and as directed by the architect / consultant. The contractor shall also responsible for proper maintenance of this access road and would take all care to see that existing services, if any, are maintained in working order at his own cost. The laying and maintaining the temporary roads within the site area shall be the

contractor's responsibility and the contractor shall take such measures that are necessary and as directed by the architect / consultant.

9.0 Water, power and other facilities:a) The rate quoted by the contractor shall include all expenses that are required for providing

all the water required for the work and the contractor shall make his own arrangements for the supply of good quality water suitable for the construction and good quality drinking water for their workers. It necessary the contractor has to sink a tube well / open well and bring water by means of tankers at his own cost for the purpose. The SBI will not be liable to pay any charges in connection with the above.

b) The rate quoted in the tender shall include the expenses for obtaining and maintaining power connections and shall pay' for the consumption charges.

c) The contractors for other trades directly appointed by the SBI shall be entitled to take power and water connections from the temporary water and power supply obtained by the contractor. However the concerned contractor shall make their own arrangements to draw the supply and pay directly the actual consumption charges at mutually agreed rates between them. All municipal charges for drainage and water connection for construction purposes shall be borne by the contactor and charges payable for permanent connections, if any, shall be initially paid by the contactor and the SBI will reimburse the amount on production of receipts.

d) The SBI as well as the Architect / consultant shall give all possible assistance to the contractors to obtain the requisite.

e) Permission from the various authorities, but the responsibility for obtaining the same in time shall be of the contractor.

10.0 Office accommodation:a) The contractor shall provide and maintain all necessary offices, workshops, stores,

shelters, sanitary facilities, canteens & other temporary structures for themselves in connection with the work at the site at their own cost after getting the approval form the architect/consultant.

b) A site office for the use of SBI/architect/consultant shall be provided by the contractor at his own expenses.

c) All temporary buildings and facilities as mentioned above shall be removed on completion of the work or at any other earlier date as directed by the architect / consultant.All the expenses for obtaining statutory approvals and maintenance of the above facilities as well as running expense shall be borne by the contractor at no extra cost. It is also the responsibility of the contractor to obtain statutory approvals for providing the above facilities.

11.0 Facilities for contractor's employeesThe contractor shall make his own arrangement for the housing and welfare of his staff and workmen including adequate drinking water facilities. The contractor shall also make the arrangements at his own cost for transport where necessary for his staff and workmen to and from site of work at his own cost.

12.0 Compliance with labour regulation:i. During continuance of the contract, the Contractor and his sub-Contractors shall abide

at all times by all existing labour enactments and rules made thereunder, regulations, notifications and bye-laws of the State or Central Government or local authority and

any other labour law (including rules), regulation bye laws that may be passed or notifications that may be issued under any labour law in future either by the State or the Central Government or the local Authority. The Contractor shall keep the Owner indemnified in case any action is taken against the Owner by the competent authority on account of contravention of any of the provisions of any Acts or rules made thereunder, regulation or notifications including amendments. If the Owner is caused to pay or reimburse, such amount as may be necessary to cause or observe, or for non-observance of the provisions stipulated in the notifications/bye laws/Acts/Rules /regulations including amendments, if any, on the part of the Contractor, the owner/Architects/PMC shall have the right to deduct any money due to the Contractor including his amount of security deposit. The Owner/Architects/PMC shall also have right to recover from the Contractor any sum required or estimated to be required for making good the loss or damage suffered by the Owner.

ii. The employees of the Contractor and the Sub-Contractor in no case shall be treated as the employees of the Owner at any point of time.

iii. No labour shall stay at site. Temporary storage space provision should be made by contractor.

iv. The rates shall be complete in all respects i.e. inclusive of all taxes, octroi, local taxes, packing and forwarding, work contract tax, service tax. Nothing on any account shall be paid over the approved rate. TDS shall be deducted at the rate of 2% on the sum paid/payable towards transfer of property in goods. TDS will be deducted at the time of credit of such sum to the account of the contractor or at the time of payment thereof in cash or by any other mode, whichever is earlier. Work contract tax shall be in the scope of contractor.

v. All specialized and specific jobs shall be carried out by approved agencies/venders only.

vi. The Contractor shall arrange temporary drinking water and sanitation facilities for his worksmen.

13.0 Contractors Engineer:The contractor shall deploy a Civil graduate Engineer with suitable experience of 5 years. The contractor shall furnish the name, bio data, experience of the personal required to be posted at site at the start of work.

14 .0 The quantity mentioned in the purchase order is only approximate in nature i.e., approximate quantified scope. Hence, the contractor should not claim any compensation towards non-operation of the part or total quantities and non-operated items listed in the Purchase order.

15 .0 Photographic monthly progress report in the prescribed proforma shall be submitted through the consultant before 2nd day of every month .The photograph should be taken before and after the work.

16 .0 Since the payments are based on actual site measurement, the contractors are advised to procure the materials based on actual site requirement. Payment will not be made for left out and unused materials.

17 .0 The contractor has to engage specialized agencies depending upon the nature and complexity of the work with the prior approval of the Owner for works. This does not in any way relieve the contractor of his obligations to get the quality work and architectural design as desired by the Owner / Architect.

18.0 Lighting of works:The contractor shall at all times provide adequate and approved lighting as required for the proper execution and supervision and inspection of work.

19.0 Firefighting arrangements:19 .1 The contractor shall provide suitable arrangement for firefighting at his own cost. For this purpose he shall provide requisite number of fire extinguishers and adequate number of buckets, some of which are to be always kept filled with sand and some with water. This equipment’s shall be provided at suitable prominent and easily accessible places and shall be properly maintained.19 .2 Any deficiency in the fire safety or unsafe conditions shall be corrected by the contractor at his own cost and to the approval of the relevant authorities. The contractor shall make the following arrangements at his own cost but not limited to the following.

a) Proper handling, storage and disposal of combustible materials and waste.b) Work operations which can create fire hazards.c) Access for firefighting equipment’s.d) Type, number and location of containers for the removal of surplus materials

and rubbish.e) Type, size, number and location of fire extinguishers or other firefighting

equipment.f) General housekeeping.

20.0 Site order book:A site order book shall be maintained at site for the purpose of quick communication between the architect / consultant. Any communication relating to the works may be conveyed through Records in the site order book. Such a communication from one party to the other shall be deemed to have been adequately served in terms of contract. Each site order book shall have machine numbered pages in triplicate and shall carefully maintained and preserved by the contractor and shall be made available to the architect / consultant as and when demanded. Any instruction which the architect / consultant may like to issue to the contractor or the contractor may like to bring to the architect / consultant two copies of such instructions shall be taken from the site order book and one copy will be handed over to the party against proper acknowledgment and the second copy will be retained for their record.

21.0 Temporary fencing / barricading:The contractor shall provide and maintain a suitable temporary fencing / barricading and gates at his cost to adequately enclose all boundaries of the site for the protection of the public and for the proper execution and security of the work and in accordance with the requirement of the architect / consultant and regulations of local authorities. These shall be altered, relocated and adopted from time to time as necessary and removed on completion of the work.

22.0 Site meetingsSite meetings will be held to review the progress and quality evaluation. The contractor shall depute a senior representative along with the site representative and other staff of approved sub-contractors and suppliers as required to the site meetings and ensure all follow up actions. Any additional review meetings shall he held if

required by the architect / consultant

23.0 Disposal of refuse:The contractor shall cart away all debris, refuse etc. arising from the work from the site and deposit the same as directed by the architect / consultant at his own cost. It is the responsibility of the contractor to obtain from the local authorities concerned to the effect that all rubbish arising out of contractor’s activities at the construction site or any other off-site activities borrow pits has been properly disposed off.

24.0 Contractor to verify site measurement:The contractor shall check and verify all site measurements whenever requested by other specialist’s contractors or other sub -contractors to enable them to prepare their own shop drawings and pass on the information with sufficient promptness as will not in any way delay the works.

25.0 Displaying the name of the work:The contractor shall put up a name board of suitable size as directed by the architect/ consultant indicating there in the name of the project and other details as given by the architect/consultant at his own cost and remove the same on completion of work.

26.0 Bar bending schedule:The contractor shall prepare a detailed bar bending schedule for all reinforced concrete works and got them approved by the architect / consultant well in advance.

27.0 As built drawings:

27 .1 For the drawings issued to the contractor by the Architect / Consultant. The architect / consultant will issue two sets of drawings to the Contractor for the items for which some changes have been made. From the approved drawings as instructed by the SBI / architect / consultant. The contractor will make the changes made on these copies and return these copies to the architect/ consultant for their approval. In case any revision is required or the corrections are not properly marked the architect / consultant will point out the discrepancies to the contractor. The contractor will have to incorporate these corrections and / or attend to discrepancies either on the copies as directed by the architect / consultant and resubmit to him for approval. The architect / consultant will return one copy duly approved by him.

27 .2 For the drawings prepared by the contractor.

27 .3 The contractor will modify the drawing prepared by him wherever the changes are made by the SBI / architect / consultant. And submit two copies of such modified drawings to the architect/ consultant for approval. The architect / consultant will return one copy of the approved drawing to the contractor.

28.0 Approved makeThe contractor shall provide all materials from the list of approved makes at his own cost and also appoint the specialized agency for the waterproofing anti-termite, aluminum doors and windows and any other item as specified in the tender. The .architect / consultant may approve any make / agency within the approved list as given in the tender after inspection of the sample / mock up.

29.0 Procurement of materialsThe contractor shall make his own arrangements to procure all the required materials for the work. All wastages and Losses in weight shall be to the contractor’s account.

30.0 Excise duty, taxes, levies etc;The contractor shall pay and be responsible for payment of all taxes, duties, levies, royalties’ fees cess or charges in respect of the works including but not limited to sales tax, tax on works contract excise duty, Service Tax, VAT and octroi, payable in respect of materials, equipment plant and other things required for the contact. All of the aforesaid taxes, duties, levies, fees and charges shall be to the contractor’s account and the SBI shall not be required to pay any additional or extra amount on this account. Variation of taxes, duties, fees, levies etc if any, till completion of work shall be deemed to be included in the quoted rates and no extra amount on this account. Variation of taxes, duties, fees, levies etc if any, till completion of work shall be deemed to be included in the quoted rates and no extra claim on this account will in any case be entertained. If a new tax or duty or levy or cess or royalty or octroi is imposed under as statue or law during the currency of contract the same shall be borne by the contractor.

31.0 Excise duty, taxes, levies etc.;

While quoting their rates the tenderer should include the following if otherwise not stated herein before.a) Necessary cost of taking samples of materials supplied by them for construction including cement and steel, wood/tiles etc., testing of the same at Govt.’s / approved laboratory including transportation, cost of the samples, as and when required and as instructed.b) Submission of test reports of other materials as may be specified by Architects or Bank’s Engineer.

c) Taxes such as GST VAT, Sales Tax, Service Tax, Excise, Insurance duties & premiums, ESI, PF, labour charges, Approval charges etc.

32.0 Acceptance of tenderThe SBI shall have the right to reject any or all tenders without assigning any reason. They are not to bound to accept the lowest or any tender and the tenderer or tenderers shall have no right to question the acts of the SBI. However adequate transparency would be maintained by the SBI.

V I . SAFETY CODE

First aid appliances including adequate supply of sterilized dressing and cotton wool shall be kept in a readily accessible place.

An injured person shall be taken to a public hospital without loss of time, in cases where the injury necessitates hospitalization.

Suitable and strong scaffolds should be provided for workmen for all works that cannot safely be done from the ground.

No portable single ladder shall be over 8 meters in length. The width between the side rails shall not be less than 30 cm. (clear) and the distance between two adjacent rungs shall not be more than 30 cm. When a ladder is used an extra mazdoor shall be engaged for holding ladder.

The excavated material shall not be placed within 1.5 meters of the edge of the trench or half of the depth of trench whichever is more. All trenches and excavations shall be provided with necessary fencing and lighting.

Every opening in the floor of a building or in a working platform be provided with suitable means to prevent the fall of persons or materials by providing suitable fencing or railing whose minimum height shall be one metre.

No floor, roof or other part of the structure shall be so overloaded with debris or materials as to render it unsafe.

Workers employed on mixing and handling material such as asphalt, cement mortar or concrete and lime mortar shall be provided with protective footwear and rubber hand-gloves.

Those engaged in welding works shall be provided with welder's protective eye shields and gloves.

(i) No paint containing lead or lead Products shall be used except in the form of paste or readymade paint.

(ii) Suitable facemasks should be supplied for use by the workers when the paint is applied in the form of spray or surface having lead paint dry rubbed and scrapped.

Overalls shall be supplied by the Contractor to the painters and adequate facilities shall be provided to enable the working painters to wash during the periods of cessation of work.

Hoisting machines and tackle used in the works, including their attachments, anchorage and supports shall be in perfect condition.

The ropes used in hoisting or lowering material or as a means of suspension shall be of durable quality and adequate strength and free form defects.

8 Retention Money : The retention money shall be deducted from the running account bill at the rate of 10% of the gross value of work done by the contractor and claimed in each bill provided the total security deposit i.e. the ISD plus Retention Money shall both together not exceed 5% of the contract value. For additional details, see GCC clause 1.

9 Minimum value of work for each RA Bill

Power Panels:The Power panels shall be fabricated from MS sheet steel 16 gauge and shall be of compartmental design. The main supporting framework shall be of angle iron or of heavier gauge sheet metal. The panel shall be self-supporting design, dust and vermin proof, dead front and fully inter locked with isolating switches. The panel-mounted switches shall have Interlock defeat for testing and inspection.The panel shall be designed so as to facilitate inspection, cleaning and repairs. The clearance between phase to phase and phase to earth or metal parts shall be as per relevant IS standards. The metering instruments like volt meter, ammeter etc. shall be flush mounted and shall be of 1.0 class accuracy and of standard design size shall be 96 mm x 96. All indication lamps shall be of neon type.The panel shall have separate cable ally and a bus bar chamber. The bus bars shall be rigid hard drawn tinned electrolytic copper & sleeved with heat shrinkable sleeves. The current density shall not exceed 1.25 amp per sq. mm. and the neutral bus shall be rated for capacity of phase bus unless otherwise stated in schedule of quantities/drawings. However, the minimum size of bars shall be 25mm x 3mm.The panel shall be powder coated comprising of degreasing and de-scaling in sulphuric acid etc. with synthetic enamel paint for smooth finish. The color of paint shall be battle-ship Grey or as directed. The Panel shall be tested at site before commissioning. The Panel drawings shall be got first approved from Consultants before taking up for fabrication.All wiring inside the panel shall be done with switchboard copper conductors/cables soild copper links. The insulators for supporting the Bus-Bars shall be epoxy based cast resin. All hinged doors shall be earthed with flexible braided copper earth. An earth bus of copper shall be fixed along the length of the panel at the lower section. Adequate ventilation for the panel shall be provided. Logic diagram of operation of switches shall be painted on the panel. The name plates for each feeders shall be of engraved design and pasted to the respective switch gear. The letters shall not be less than 10mm size for individual feeders and not less than 18mm for the main feeders. All switchgear to be mounted in the panel shall be as per schedule of quantities. Switch Fuse Units :Switch Fuse Units shall be of sheet metal or iron clad with HRC fuses as described in schedule of quantities. The unit shall be of robust construction of standard specified make. design to withstand adverse working conditions. It shall have quick break type mechanism with ON and OFF position indicators of the operating handle. The switch shall be interlocked so that the unit cannot be opened in ON condition. The interior shall be so arranged that clearance from live parts are adequate and shrouded. Manufacture’s instructions shall be followed for installation of switch fuse units. The switch shall be solidly earthed. The switch shall be mounted on walls on angle iron support grouted to wall. The supports shall be treated for rust treatment & painted with 2 coats of synthetic enamel paint. The height of the switch board shall be such that it is accessible for operation & maintenance.Cables : Cables shall confirm to IS 1554-1976. Cable shall be heavy duty, armoured, PVC insulated & PVC sheathed 1.1 MV grade aluminum or copper. Cable shall be fixed with G.I. spacers & saddles at an interval of 45 cms and on every side of bends. The bending radii of cables shall be as per manufacturers instructions and in no case it shall be less than 12 times the overall diameter of the cable. Cable shall be so installed that they are not subject to mechanical damage. If there is a bend in the cable enclosed in a conduit, care has to be taken to prevent undue compression of insulation. This applies also to the top of vertical runs of longer than 5 meters where there could be compression caused by the weight of unsupported vertical cables. Cables may rest without fixing in horizontal runs or ducts or trunkings. The cables run in cable trays shall be permitted unless the cables exceed the standard drum length. Joints if so necessary shall be located in accessible position. Termination of the cables shall be done with heavy duty copper/Aluminum lugs and brass cable glands.Cables laid underground shall be to a minimum depth of 750 mm. It shall be ensured that cables laid underground are free of water lines, sewage lines etc. The trenches shall be at least 30 cm wide &

filled with 10 cms thick of layer of dry sand on which the cable shall be laid. Further, 10 cms thick sand layer shall be put on the cable over which a brick layer shall be kept. The trench shall than be back filled with soft earth, rammed and consolidated to original level. Cable route indicators shall be laid at intervals of 20 metres and at all change in directions. For cables laid on walls aluminum tags shall be fixed showing the size of the cable and the feeder number of the cable. These tags shall be at each ends and at least one or two places at intermediate positions. The mode of measurement of the cables shall be as follows :xiv) For top entry of the cable, the measurement shall be taken up to the bottom of the switch-gear.xv) For bottom entry of the cable, the measurement shall be taken up to the top of that switch board.

No wastage shall be allowed for measurements.

Distribution Boards :(d) These shall be of sheet metal and of standard design with copper bus bars. The board shall be

fixed at accessible heights. The boards shall be solidly fixed to walls/partitions, concealed of open as directed. All connections inside the distribution board shall be neatly arranged and tied with PVC strings. The MCB’s shall be of 9 KA for fault level. The distribution board shall be suitably earthed. Legend shall be written on D.B. & Circuits.

(e) The Distribution Board circuitry shall be as per the schematic/given in Drawing.(f) The Sheet steel used for fabrication shall be of CRCA of 14/16 SWG. The Board shall be suitable

for wall mounting. It shall be totally enclosed, Dust Proof & vermin proof. The fabrication shall be as per relevant is Specifications for degree of protection by enclosure for low voltage switch-gear IP 52. The Equipment such as MCB, ELCB, Insulators, Bus-Bars shall be as per relevant is specification with latest amendments.

(g) The Sheet steel shall be smoothly finished, leveled and free from flaws. All doors, removable covers shall be Gasketed all round the perimeter.

(h) The Service Voltage is 440 volts & Busbar will be Electrolytic copper. The copper busbar shall be tinned throughout the length.

(i) The door interlock shall be provided so that it shall not be possible to open the door with breaker in close position.

(j) Enough space shall be provided for termination. The minimum two earth terminals shall be provided for each D. B. The Board shall be factory wired with proper ferruling.

(k) Adequate shrouds shall be provided for avoiding accidental contact with Live Terminals, Busbar etc.

(l) The Conduit knockout shall be provided for Conduit Entry.(m)The guaranteed technical particulars shall be provided for the MCB & ELCB etc.(n) The engraved black anodised labels shall be provided on all feeders.(o) All Steel works shall undergo a process of degreasing, pickling in acid bath, phosphating.(p) This shall be followed by two coats of primer and two coats of final finish paint, both applied

Point Wiring b) Metal Conduits:f . All conduit pipes shall confirm to IS 9537 PART-II 1981. Metal conduits shall be ERW black

enameled 20mm/25mm as the case may be depending upon the number of wires permitted. The conduits shall be fixed to walls/ceiling with M.S. saddles and spacers at an interval of 1 meter and on either side of bends.

g. All conduit accessories shall be 15 gauge & bends shall be of inspection type. All bends, couplers, threaded portions etc. shall be painted with anti-corrosive paint. Bends in the pipes shall be done with bending hickeys.

h. All pipes shall be cleaned for sharp burrs. Switch boxes shall be of G.I. 16 G/14G. The switch boxes shall be concealed as per site requirement & as per Architect’s/Consultant’s Instructions.

Point shall be controlled with 5A switch or directly from DB as specified in schedule of quantities. Where plate type switches are not specified the switch-board shall have 3mm thick hylum sheet on which switches shall be mounted.

i . While laying the conduits in the slab before casting the slab, all drops shall be laid accurately to fall in position of the switchboard. Junction boxes shall be sand filled. All joints shall be airtight. Conduits shall be fastened to the re-enforcement properly so that the conduits do not get dislocated while casting the slab. All conduits shall have 18 swg fish wire.

j . The conduit shall be of 16 guage unto 32mm dia and 14 guage above 32mm dia. reputed and approved make conforming is specification. Conduit shall be Heavy guage rigid PVC with All accessories/fittings including ordinary & inspection tees; bushings, reducers, junction boxes, terminal boxes, saddles and steel supporting materials shall be of the same as of the conduit. The contractor shall have dies for threading of conduit.

k. The conduit shall run along walls, ceiling, flooring in accordance with layout drawings.l . The conduit shall be field bend as far as possible with reasonable long radius. The conduit bends

shall be free from cracks, other damage to the pipe or its coating and shall not have pipe section unduly flatten..

m. The conduit joint shall provide the structural rigidity and low electrical resistance. n. All open conduit ends shall have bushings and all threads shall be cleaned and well painted with

coating or red lead & oil. All burrs shall be smoothened and cleaned.o. The conduit shall be supported with saddles at regular interval of 1000mm. The saddles shall be

fixed with Rawal plugs and M. S. screws of 3mm size.p. The No. of wires through a given diameter of conduit shall be as per is specification.q. When two length of conduit are joined together through a coupling, running threads equal to the

full length of the coupling shall be provided on any one length. Conduit length exceeding 8 meter length shall be provided with junction boxes.

r . Conduit & accessories shall be securely fixed before any operation like concrete pouring plastering etc. The conduit shall be fixed by clips which shall not cause deformation of conduits. The conduit fixing shall be at regular intervals not exceeding 1.5 meter. At the bends the fixing shall be secured by fixing clips at 150mm. All the supporting holes are to be drilled by electric drill machine.

c) Pvc Conduits:The PVC Conduits shall confirm to latest IS standards and shall be of medium gauge. The conduits shall be joined with PVC adhesive at joints. The Conduits shall be fixed to walls/ceilings with GI, Spaces and Saddles at an interval of 60 cms & on either side of bends. The number of wires drawn in the conduits shall be as per table 1. The point wiring shall be controlled as in (a) above. The wiring shall be done with 2nos. of 1.5 sq.mm (Phase & Neutral). & 2.5 sq. mm. (earth) PVC insulated, copper conductors, multi stranded and color coded with green as earth and black neutral. The circuit wiring shall be with 3 nos. of 2.5 sq. mm. PVC insulated, copper conductors, multi stranded from distribution board to switch board and the rate shall be included in the point wiring unless otherwise stated in schedule of quantities. All other details shall be as for metal conduits.

d) Casing Capping/Trunk And Trunkling :PVC casing shall be fixed, wooden partitions by means of screws spaced not more than 60 cms apart. Holes for fixing the PVC capping shall be done by drilling machine only and these holes shall be plugged with PVC plugs or grips to which the screws shall be fastened. No less than I inch PVC casing shall be used. All bends, tees, joints etc. shall be done in workman like manner with standard accessories. The number of wires in PVC casing capping shall be limited to a fill factor of not more than 60%. The point shall be controlled by 5 amp switch. The switch boards shall either be flush mounted with partitions or surface mounted or concealed mounted as per site requirements and as directed. The wiring shall be carried out as described in (a) and (b) above.

This wiring shall not be done for concealed wiring & wiring over the false ceiling work

Circuit Wiring

b) The Circuit wiring shall comprise of laying PVC conduit from lighting distribution board to the first switch board & pulling of wires within the conduits with 2.5 Sq.mm copper wire, PVC insulated, 100v grade wire.

c) The scope includes all materials & labour with Installation. It also includes making proper connection in the Distribution board & switch board.

d) In case of group control directly from Distribution Board, the primary point shall be from D.B. to the first point and secondary point and from first point to the next point looped. The point shall terminate into the 3 plate-ceiling rose.

Switch Board

The lighting switch board boxes shall be MS/ zinc passivated with 16 guage made suitably for controlling group of light/fixture or light control as indicated in the drawing. The switch board boxes shall be suitably in the office area as concealed type. All the switch boxes shall be provide with removable cover with proper provision of Plate/Piano type switches.

Wiring Methods

v) The wire pulling in conduits shall be in accordance with standard practices. All the wires in a particular section by conduit shall be bunched together and pulled at a time.

vi) The wires used shall be colour coded with Red wires for R phase, Yellow wire for Y phase, Blue wire for B phase Black wire for neutral and Green wire for each continuity conductor.

vii) All the wires shall be purchased directly form the manufacturers and approved by the consultant.viii) All the wire shall be insulated with adequate thickness of extruded PVC.ix) All wires shall be of 1100v grade conforming to is 694 with latest amendment.x) All the wire ends shall be ferruled with colour codes & numbers. xi) All the circuits shall be identified at both ends of the circuit.xii) A maximum of 3 lights to be switched on one switch of 5A.xiii) The wiring shall be carried out with multi stranded PVC insulated copper wires of 1.5

sq. mm. 2Nos (Phase & Neutral) & 2.5 sq.mm. (Earth). In all cases the earth shall be of green color and neutral shall be black color. All wires used shall be of 660 V grade. The point wiring shall be inclusive of circuit wiring from Distribution Board to the switch-board unless otherwise stated in schedule of quantities. The circuit wiring shall be with 3 nos. of 2.5 sq.mm PVC insulated multi stranded copper conductors color coded as detailed above. The rate shall also be inclusive of any chasing as directed by the Architects/Consultant/Client’s Engineer to conceal the drops and finishing the same.

5a/15 Amps. Switch Socket Outlet Wiringb. The Point wiring for 15 A Switch socket outlet includes running of 3 x 4.0 sq.mm PVC insulated

stranded copper wire through conduit from the distribution panel board to the individual S/S/O c. Two nos of 15 A S/S/O are to be looped in and controlled by MCB of 20 Amps in the distribution

board at each floor. The circuit length shall not exceed a length of 70 meters.d. All the wires for the S/S/O shall be pulled through separate conduit system (not to be mixed with

light 5 Amps S/S/O etc.)

5 Amps Switch Socket Outlet2. The point wiring for 5 Amps switch socket outlet includes running of 3 x 2.5 sq.mm copper

conductor, PVC insulated, 1100v grade wires in PVC conduit from the light distribution board to the Individual socket.

3. A maximum of 6/8 Nos. socket are to be looped in & controlled by MCB in the lighting distribution board. The circuit length shall not exceed 75 meters.

15/5 A Switch Socket Outletiii) It shall be of approved make conforming to latest is standards. The three-pin socket shall be

provided with safety shutter to prevent accidental contact with live parts.iv) The box for socket outlet shall be suitable for concealed/surface mounting and should be supplied

by the Manufacturer with the switch & socket unit.

20 Amps Point Wiring

ii) The 20 A SP MCB with Reyrolle socket is to be provided including running of 3 x 4.0 sq.mm PVC insulated stranded copper wire through PVC conduit from distribution board to the individual switch.

iii) One switch is to be provided in one circuit and controlled by one MCB of 20 Amp in the distribution board at each floor.

iv) All the wires for the switches shall be pulled through separate conduit system ( not to be mixed light, 5 A S/S/O etc.)

Telephone Points

v) Telephone Points shall include supply & installation of 25mm diameter PVC conduit & Accessories along with 2 pair/4 Core wire from Tag Block to Individual Point along with the Conduit. The Telephone wire shall be of oelton make or of approved sample.

vi) The Conduit shall be laid concealed in slab/wall/beam column etc., from the Telephone Box to the Individual Telephone socket outlet Point as market in the Drawing.

vii) In case of provision for further point for Telephone G.I. Pull wires shall be laid inside the entire length of conduit.

viii) The Telephone Tag Block of M.S. shall also be provided by the Contractor including latest Type of Terminal strip cover extra as per MTNL approved list.

Earth Pits / StationThe earthing station shall be done as per IS 3043 (1981) and as per drawing no. E1. The earth pit shall be atleast 2.5 mtrsdeep with GI plate electrode shall be hot dipped of 600mm x 600mm x 6mm thick. The size for copper electrode shall be 600 x 600 x 3mm thk. An alternate layer of salt and charcoal shall be filled up to 200 mm above the top of the electrode. The electrode shall be connected with 25mm x 6 mm thick GI Flat which shall be terminated with nuts and bolts into brick masonry chamber on top. The brick masonry chamber shall be of size 300mm x 300mm x 300mm deep which will carry the finneling arrangement for watering. A GI Flat of 25mm x 3 mm from brick masonry chamber to the switch gear inside the switch room shall be laid underground and / or fixed to walls and the rate for this shall be paid as a separate item.

Installation Of Electric FittingsAll electrical fittings shall be fixed with down rods or on round blocks as stated in schedule of quantities. The down rods shall be 20 mm dia and 1.6 mm wall thickness of ERW black enameled MS. The down rods shall be fixed with ball and socket joints check nuts etc. Special fixtures like spot lights etc. shall be fixed to the false ceilings as per manufacturer’s recommendations. The fittings shall be connected with 3 core 0.5 sq. mm. flexible copper cord / cable from ceiling rose and suitable earthed. Testing Of Electrical InsulationThe following tests shall be carried out after completion of the electrical insulation work.xi. Insulation Resistance Test.xii. Polarity Test of Switches.xiii.Earth Continuity Test.

1) Insulation Resistance Test : The insulation resistance shall be measured by applying between earth and whole system of conductors or any section thereof with all fuses in place and all switches closed (except in earthed concentric wiring) all lamps in position and both poles electrically connected together., or direct current pressure of not less than twice the working pressure, provided that it need not exceed 500 volts for medium voltage circuits, be applied. Where the supply is derived from 3 wire DC or Poly phase A.C. System, the neutral pole of which is connected to the earth either direct or through added resistance, the working pressure shall be deemed to be that which is maintained between the phase conductor and the neutral. The insulation resistance measured in mega ohms between all conductors connected to one pole of phase conductor of the supply and all the other conductor and switches in off position it’s value shall be not less than as specified below:

The insulation resistance measured in mega ohms shall not be less than 50 mega ohms divided by the number of outlets or when PVC insulated cables are used for wiring , 12.5 mega ohms divided by the outlet subject to a minimum value of 1 mega ohm.

A preliminary and similar test may be made before lamps etc. are installed and in this event the insulation resistance to earth shall not be less than 100 mega ohms divided by the number of outlets or when PVC insulated cables are used 25 mega ohms divided by the number of outlets subject to a minimum of 1 mega ohm.

2) Polarity Test of Switches : In a 2 wire system a test shall be made to verify that all switches in every circuit are fitted in the same conductor throughout and such conductors shall be labelled or marked for connection to the phase conductor or to the non-earthed conductor of supply.

In a 3 wire or 4 wire insulation a test shall be made to verify that every non linked single pole switch is fitted in a conductor which is labelled or marked to one of the phase conductor of supply.

3) Earth Continuity Test : The Earth Continuity Conductor including metal conduits and metallic envelopes of cables in all cases shall be tested for electric continuity and electrical resistance of the same along with the earthing lead but excluding any added resistance or earth leakage circuit breaker measured from connection with earth electrode to any point in the earth continuity conductor in the completed insulated shall not exceed 1 ohm.
