Fiscal Year 2018: Focus on improving customer serviceWith $160 billion of premiums in 2017, Texas is the second largest insurance market in the nation and the eighth largest in the world. The Texas Department of Insurance (TDI) regulates more than 2,800 companies, almost 500,000 insurance agents, and 146,000 adjusters.

At TDI, we’re reviewing our processes with an eye toward improvement at every level. Each review uses three basic principles:

• Review and use best practices.• Modernize technology and processes.• Focus on clear communication.

Key consumer improvements include:• Reduced hold times: After Harvey, insurance agents and adjusters faced hour-long hold

times when they called us. Now they wait about a minute.• Redesigned website: The updated website makes information easier to find and works better

on phones and tablets.• Added consumer tools: We launched TexasHealthcareCosts.org where Texans can find the

cost of common surgeries, tests, and other procedures by ZIP code.• Made our materials easier to read: We revised forms and letters to simplify the language,

trained staff on plain language principles, and created a virtual focus group to help review our consumer materials.

Key process improvements include:• Modernized our open records system: An automated system provides better tracking and

more convenient options for requestors.• Shortened rule timelines: We streamlined development and internal review processes so

rule projects move faster.• Used technology better: We went through a comprehensive best practices review to improve

how we use our existing technology to process applications.• Streamlined filing requirements: We combined the rate and rule filings insurers are required

to send us. This eliminates the need to provide duplicate information and creates a more coordinated review process.

• Improved document management: We rolled out SharePoint to help streamline and better manage legal reviews and rule development.

Harvey responseHelping Texans recover and rebuild after Hurricane Harvey was a priority in FY 2018. The Texas Department of Insurance:

• Provided immediate help: We sent staff to the affected areas and extended call center hours into the evenings and on weekends to help consumers begin the claims process as quickly as possible.

• Resolved complaints: We helped consumers get an estimated $5.2 million in additional claims payments through our complaint process.

• Shared information: We developed English and Spanish resource web pages and videos and used social media to provide consumers with critical information.

• Worked to deter fraud: Our fraud investigators toured the area and coordinated with local law enforcement to help deter fraud and contractor scams.

• Paved the way to rebuild: Windstorm and inspection staff answered more than 32,000 calls and issued more compliance certificates than any year since 2009, to help homeowners begin rebuilding and making repairs.

• Licensed adjusters: We licensed 14,837 new adjusters and emergency adjusters in the 90 days after the storm.

• Monitored insurer response: We issued a data call and analyzed detailed claims information to assess the storm’s financial impact and monitor the market’s claims handling.

Texas Department of InsuranceTDI regulates the state’s insurance industry, oversees the administration of the Texas workers’ compensation system, performs the duties of the State Fire Marshal’s Office, and provides administrative support to the Office of Injured Employee Counsel – a separate agency.

The Texas Insurance Code requires TDI to:• Regulate the business of insurance in Texas.• Protect and ensure the fair treatment of consumers.• Ensure fair competition in the insurance industry to foster a competitive market.• Administer the Texas’ workers’ compensation system as provided by the Texas Labor Code.• Ensure that the Insurance Code and other laws regarding insurance and insurance companies

are executed.

The insurance commissioner is the agency’s chief executive and administrative officer. The commissioner administers and enforces state insurance laws and applicable laws that grant jurisdiction to TDI or the commissioner.

The Division of Workers’ Compensation (DWC), under the direction of the division’s appointed commissioner, oversees the administration and operation of the Texas workers’ compensation system. The division monitors compliance of all parties, taking enforcement action when necessary, to ensure that the Texas Workers’ Compensation Act, Texas Labor Code, and other regulations regarding workers’ compensation are implemented and enforced.

The governor, with advice and consent of the Texas Senate, appoints both commissioners for two-year terms.

• Communicating internally and externally, evaluating and adjusting the course of the agency in response to changes in conditions.

OfficesThe agency’s insurance and workers’ compensation headquarters are in Austin. To carry out insurance regulation responsibilities, TDI has offices across the state for financial and title examiners; fraud investigators; fire inspectors and investigators; windstorm inspectors; and workers’ compensation claims specialists, benefit review officers, and administrative law judges. Most offices also provide health and safety information.

The agency determines office locations according to claim activity and service demands. For example, financial examiner staff are in areas with major corporation headquarters, windstorm inspection staff are located along the coast to inspect and certify construction complies with windstorm building codes, while title examiners live and work throughout the state. Workers' compensation offices are in areas with high demand for claims services, customer service, and dispute resolution.

Administrative Operations DivisionThe Administrative Operations Division is responsible for the agency’s internal financial functions. Its responsibilities include:

• Provide operational support, including computer and database services, professional development, and training to TDI staff.

• Provide administrative support to the Office of Injured Employee Counsel.• Monitor compliance with legislative oversight requirements.• License people and entities involved in the sale of insurance products in Texas.

FY 2018 highlights:• Eliminated many paper applications for agent licenses and saved money by processing

more applications online.• Automated continuing education reminders, deficiency notices, and fines.• Implemented a system that allows job applicants to apply online, eliminating costly, time-

consuming paper applications.• Strengthened security by requiring multi-factor authentication to log into computer systems.

Undercover testing helps identify and correct data security weaknesses. Also increased staff training requirements.

• Rolled out SharePoint to help streamline and better manage legal reviews and rule development.

• Implemented Tableau software that allows the agency to view and analyze data more efficiently.

• Worked with the Texas Facilities Commission to modernize the Hobby building’s elevators, plaza, and lobby.

• Saved nearly $37,000 by completing the DWC Records Retention Center project three months ahead of schedule.

• Eliminated the fee for military personnel and family members who have a license in another state and apply for a similar license in Texas.

• Added license testing sites centers at military bases, universities, and colleges.

Agency AffairsAgency Affairs provides coordination and analysis to help executive leadership develop and monitor state and federal regulatory policy and legislative recommendations. The division includes Government Relations, which directs and tracks responses to legislative inquiries; monitors, tracks, and analyzes legislation affecting the agency and industry; and manages appointments to agency boards and committees.

FY18 highlights:• Led outreach to stakeholders to get suggestions for TDI’s biennial report on recommended

legislation, which is due December 31, 2018.• Provided legislative offices with updates on commissioner’s initiatives and implementation

of insurance bills from the 85th Texas Legislature.

Compliance DivisionThe Compliance Division protects consumers by overseeing insurance companies and agents and their interactions with consumers. The division includes the Consumer Protection Section and the Fraud Unit.

Consumer ProtectionThe Consumer Protection Section helps Texans resolve insurance complaints and provides insurance information to the public through a toll-free Consumer Help Line, outreach events, publications, and online.

FY 2018 highlights:• Implemented a new complaint processing and workflow system to improve efficiency.• Reorganized front-line staff resulting in better cross training and more flexibility during

high-volume events.• Answered more than 412,000 consumer calls.• Resolved nearly 20,000 complaints, helping consumers get $42.9 million in additional claim

payments and premium refunds.• Completed more than 500 outreach presentations to help consumers better understand

insurance.• Helped consumers after Hurricane Harvey, other storms, and widespread flooding in North,

Central, and Southeast Texas.

Fraud UnitThe Fraud Unit investigates allegations of insurance crimes and works with state and federal prosecuting agencies. Investigations typically involve one of the following types of fraud:

• Claim fraud committed by consumers or health care providers against insurance companies. This includes: staged or fake accidents; fake burglary and auto theft claims; arson for profit; claims for medical services that were not provided or were inflated; personal injury schemes; exaggerated claims; organized fraud schemes; disability claimant and provider fraud; and life insurance or annuity fraud.

• Agent crimes, such as issuing fictitious policies or stealing premium payments.• Insurance company officers’ and directors’ fraudulent activities, including false financial

statements to TDI and misuse of company funds.• The sale of insurance products not authorized by TDI or work done by individuals not licensed

to conduct the business of insurance in Texas.• Mortgage fraud, including fraud by escrow officers, title insurance agents, and title insurance

companies.

Fraud Unit investigators are commissioned state peace officers. The unit also has prosecutors in the district attorneys’ offices in Bexar, Dallas, Harris, Tarrant, and Travis counties.

FY 2018 highlights:• Referred 75 new suspects to state or federal prosecutors in 21 Texas counties, representing

$9.7 million in identified fraud.• Obtained $13.7 million in court-ordered restitution for fraud victims.• Worked on cases involving 79 individuals who were sentenced to a combined 182 years in

jail, 46 years of probation, 150 years of deferred adjudication, 4,200 hours of community service, and $64,050 in fines.

Key cases:• In Tarrant County, the former owner of Millennium Title was sentenced to 10 years in prison

and ordered to pay $8.6 million after a Fraud Unit investigation found she had stolen millions from her clients and investors. Millennium Title was ordered into liquidation.

• An attorney was convicted in Tarrant County of a third-degree felony for filing fraudulent lawsuits, also known as barratry. He was sentenced to five years’ in jail and ordered to pay $15,195 in restitution. His law office had filed suits and claims on behalf of storm victims that they were not aware of.

• A licensed insurance agent created fake annuity documents and defrauded an elderly victim. The agent was convicted in Swisher County and sentenced to life in prison and ordered to pay $100,000 to the victim.

Financial Regulation DivisionThe Financial Regulation Division ensures that insurers and HMOs have adequate assets to pay their claims and treat consumers as required by statute and rule. It uses a proactive approach and early intervention strategy to protect consumers and minimize the risk and impact of company insolvencies. Division responsibilities include:

• Perform solvency and market conduct surveillance.• Enforce managed care network adequacy standards.• Conduct continuous financial analysis and insurer monitoring.• Perform on-site financial, market conduct, title agent, and quality-of-care examinations.• Supervise insurers, insurance groups, and other risk-bearing entities.• License, register, and certify insurers.• Certify utilization review agents and independent review organizations.• Lead regulatory interventions including receivership for rehabilitation or liquidation.

Financial statements filed by authorized insurers and HMOs for calendar year 2017 reflected $160.5 billion in Texas premiums and $134.4 billion in claim payments. These companies reported $9.1 trillion in total assets, $7.6 trillion in liabilities, and $1.3 trillion in capital and surplus. Premiums reported by all other insurance companies for calendar year 2017 reflected $5.8 billion in Texas premiums.

FY 2018 highlights:• Implemented a risk-focused assessment process, which was developed as a best practice

among state regulators. The approach enhances early solvency detection through prospective risk analysis.

• Achieved a 25 percent increase in completed examinations through process and training improvements. We did this by improving how we scheduled examinations and leveraging work of other TDI programs, state regulators, and independent and internal insurer auditors. Overall, these changes reduce the cost of regulation without reducing the effectiveness of TDI oversight.

General Counsel/Chief Clerk DivisionThe General Counsel/Chief Clerk Division advises the commissioner on legal matters and topics, including state and federal law application, commissioner orders, appeals, and agency policy. The division also represents the agency in employment, state purchasing, and contract matters. The division is headed by the general counsel and includes three assistant general counsels and an assistant general counsel/chief clerk who manages the Chief Clerk’s Office and the Open Record’s Office.

The Chief Clerk’s Office certifies records; sends rule filings and notices to the Texas Register; sets cases with the State Office of Administrative Hearings; requests Attorney General representation; and provides agency court reporting services.

The Open Record's Office oversees the agency’s open records process and includes the agency public information coordinator. The agency processed almost 11,000 requests for public information in FY 2018. The agency also moved to a new open records system, replacing a 20-year-old legacy system. The new system provides better tracking and more convenient options for requestors, including on-demand status updates and electronic payments.

Internal Audit DivisionThe Internal Audit Division provides independent, objective assurance and consulting activities designed to improve the agency’s operations. The division helps the agency accomplish its goals and objectives by evaluating the effectiveness of risk management, controls, and governance throughout TDI. The Internal Audit Division provides analyses, appraisals, recommendations, counsel, and information that promotes effective control at reasonable cost.

FY 2018 highlights:• Redesigned the annual risk assessment process for audit planning to increase staff input.

Changes included sending out agencywide surveys instead of surveys to select management and incorporating information from division risk assessments.

• Adopted a more efficient operating structure by hiring another auditor instead of replacing an executive assistant and absorbing necessary administrative duties.

• Participated in an external quality assurance review of the internal audit division of the Texas Commission on Environmental Quality.

• Managed graduate students from the University of Texas McCombs School of Business as they conducted a self-assessment of the division using Texas State Agency Internal Audit Forum guidelines.

Legal and Enforcement DivisionThe Legal and Enforcement Division provides legal services to the commissioner and staff and takes enforcement action as necessary. A deputy commissioner heads up the division, which has two sections, the Legal Section and the Enforcement Section.

The Legal Section drafts rules, orders, and bulletins; provides support for legislative issues, litigation, and subpoenas involving the agency; and advises the agency on rate and form issues for all lines of insurance and other issues.

The Enforcement Section investigates alleged law and rule violations by insurance agents and companies, HMOs, and other licensed and unlicensed entities, and takes disciplinary action as necessary. The section also handles issues related to entities engaging in the business of insurance without the proper licensure, unfair or deceptive acts or practices, unfair claims settlement practices, and excessive rates. Penalties may include restitution to consumers, administrative penalties, cease and desist orders, license application denials, license revocations and suspensions, monitored probations, and rate reductions. The section also analyzes agency data to provide compliance monitoring and refers cases to the TDI Fraud Unit for criminal prosecution. The section works with the Office of the Attorney General on appeals of disciplinary actions and on other legal matters.

FY 2018 highlights:• Resolved more than 1,100 cases, of which 826 were concluded with an enforcement action.• Assessed $4.7 million in restitution and $6.3 million in penalties.• Resolved more than 400 enforcement cases related to licensing through commissioner’s

orders, license surrenders, and warning letters.

Public Affairs DivisionThe Public Affairs Division is responsible for responding to media calls, issuing news releases, and developing content for social media and other proactive communications. The division manages the agency's website and social media accounts, produces videos, and oversees an email subscription service to send out agency news and updates. Public Affairs also provides editing and design services to other TDI divisions, handles organizational and logistical support for conferences, and produces a weekly internal newsletter and the agency’s annual report.

FY 2018 highlights:• Redesigned the agency website. The updated site makes information easier to find and

works better on phones and tablets.• Developed a “Help after Harvey” section of the TDI website with English and Spanish

information and videos to help consumers file claims and avoid fraud.• Increased the number of subscribers to our email news service by 19 percent and used the

system to send out 5.2 million messages.• Coordinated an agencywide plain language initiative to make agency communications

easier to read. This included revising consumer forms and agent and adjuster letters. We also created a focus group of consumers and other stakeholders available by email to help review our consumer materials.

• Launched monthly Facebook Live events on a variety of topics as part of the agency’s social media outreach strategy.

Regulatory Policy DivisionThe Regulatory Policy Division regulates a wide range of products and coverages offered by insurance companies and HMOs. Specifically, the division oversees and manages regulatory matters, reviews form and rate filings, researches and collects data, publishes reports to help policymakers and consumers with insurance-related decisions, and manages the TexasSure Vehicle Insurance Verification program and other special policy initiatives.

Detailed information about form filings received and processed in FY 2018 can be found in Section IV: Data Tables.

FY 2018 highlights:• Collected information from health carriers on the average billed charges and carrier

reimbursement rates for certain health care services and published the information on a the new Texas Healthcare Costs website.

• Analyzed results from a special data call to determine the impact of Hurricane Harvey claims on the property and casualty industry.

• Streamlined and reduced the number of filings insurers need to submit. In December 2017, TDI eliminated manual rule filings and required insurers to submit the information in their rate filings. This change also improved the efficiency of manual rule reviews.

• Collected data for a legislative report about parity between medical and surgical benefits and mental health and substance use disorder benefits, as required under House Bill 10 from the 2017 Texas Legislature.

• Helped Financial Regulation approve insurer participation in TWIA’s assumption reinsurance depopulation program under Texas Insurance Code, Chapter 2210, Subchapter O.

• Surveyed voluntary market property insurers on potential market incentives to encourage them to write more wind and hail coverage on the coast under Texas Insurance Code 2210.015.

Inspections OfficeThe Regulatory Policy Division includes the TDI Inspections Office, which oversees amusement rides and insurer loss control inspections, evaluates and recommends building code standards, and conducts oversight inspections of professional engineers certifying structures for windstorm coverage. It includes the Windstorm Inspections Program to ensure compliance with building specifications for commercial and residential structures covered by TWIA.

State Fire Marshal’s OfficeThe State Fire Marshal's Office develops and promotes methods that help communities prevent and reduce fire losses. SFMO's responsibilities include:

• Investigating the cause and origin of fires.• Conducting building inspections.• Providing code enforcement.• Regulating the fire protection industry.• Oversight of public protection classification.• Developing and promoting fire prevention programs.

FY 2018 highlights:• Signed a new interagency fleet management agreement with the University of Texas, which

will result in lower rates to repair SFMO vehicles.• Made more licensing applications and renewals available online.• Launched a new permit system that allows retail fireworks businesses to make electronic

payments.• Referred 131 arson cases to prosecution, resulting in 74 arrests.• Assessed nearly $40,000 in penalties for fire alarm, extinguisher, sprinkler, and fireworks

violations.• Transferred management of the state’s arson lab to the Texas Department of Public Safety.

Division of Workers' CompensationThe primary duties of the Division of Workers’ Compensation (DWC) are to regulate and administer the workers’ compensation system in Texas, and to ensure that the Texas Labor Code regarding workers’ compensation is implemented and enforced. The basic goals of the Texas workers’ compensation system are to ensure that injured employees:

• Are treated with dignity and respect when injured on the job.• Have access to a fair and accessible dispute resolution process.• Have access to prompt, high-quality medical care.• Receive services that facilitate return to work as soon as it is considered safe and appropriate

by the employee’s health care provider.

DWC consists of the Commissioner’s Administration and five major program areas: Health and Safety, Compliance and Investigations, Hearings, Claims and Customer Services, and Business Process.

Commissioner’s AdministrationCommissioner’s Administration includes DWC Affairs and Strategic Planning, the Office of External Relations, the Office of the General Counsel, the Office of the Medical Advisor, and the Appeals Panel.

DWC Affairs and Strategic PlanningThe deputy commissioner for DWC Affairs and Strategic Planning serves as the chief adviser to the workers’ compensation commissioner and primary liaison with the insurance commissioner and TDI operations. The deputy commissioner assists the commissioner with strategic planning and policy guidance and oversees and coordinates executive decision-making for DWC. The deputy commissioner oversees the activities of the special advisor, who performs qualitative research and policy guidance on workers’ compensation issues. The deputy commissioner also oversees DWC Communications and the Workers’ Compensation Research and Evaluation Group.

DWC Communications develops and reviews internal and external communications for DWC, producing a variety of visual and print media that promote DWC’s mission, regulatory initiatives, programs, and educational outreach opportunities. DWC Communications also creates strategic plans for upcoming events and communication notices, edits all DWC-related external communications prior to public distribution, and manages distribution of those communications. Communications houses DWC’s media relations, and is also responsible for marketing DWC’s annual conference, which is the primary outreach and education event for the Texas workers’ compensation system. The agency’s translation services operate out of DWC Communications.

FY 2018 highlights include:• Completed plain language revisions to 30 of the most common letters that injured employees

receive to make them easier to read and understand. Work is underway to revise 100 other letters that are sent to injured employees.

• Redesigned and revised DWC web pages to enable injured employees and other stakeholders to navigate the site more easily and find information they need more quickly.

• Produced 14 videos in English and Spanish to help injured employees through the claims process, including videos on employee rights and responsibilities, benefit types, and how to resolve a dispute. Since March of 2018 these videos have received almost 9,000 views.

• Developed a video and web page to help first responders understand their unique rights in the workers’ compensation system.

Workers’ Compensation Research and Evaluation Group (REG) conducts research projects on systemwide issues, such as medical costs and utilization of care trends, return-to-work outcomes for injured employees, and employer participation in the workers’ compensation system. The Texas Legislature, stakeholders, and research entities across the country use and cite REG’s research studies on a variety of topics. REG also presents findings and produces an annual report card for certified workers’ compensation health care networks and political subdivisions. The workers’ compensation commissioner reviews and adopts REG’s annual research agenda.

FY 2018 highlights include:• Completed five research projects to examine the operational effectiveness of the workers’

compensation system:• The 2017 Annual Network Report Card, which compared medical costs, utilization of care,

access to care, satisfaction with care, return-to-work outcomes, and functional outcomes for 16 certified health care networks and political subdivision health plans with non-network claims. The report card continued to show that networks treat injured employees at lower costs and produce better outcomes compared to non-network claims.

• Injured Employees with Multiple Injuries, which studied how often multiple-injury claims occur in the Texas workers’ compensation system, estimated re-injury rates by demographic and injury characteristics, and examined risk factors for injuries by comparing injured employees with a single injury to those with multiple injuries.

• Outcome Comparisons of Return-to-Work Rehabilitation Programs, which studied return-to-work programs by accreditation status.

• Income Benefit Adequacy in the Texas Workers’ Compensation System, 2000-2014, which studied estimates of the extent to which lost wages are replaced by income benefits received by injured employees during the injury period.

• Access to Medical Care in the Texas Workers’ Compensation System, which measured the effectiveness of the workers’ compensation system to deliver timely and appropriate medical care to injured employees in Texas.

• Initiated five research projects:• Setting the Standard: An Analysis of the Impact of the 2005 Legislative Reforms on the

Texas Workers’ Compensation System, 2018 Results.• The biennial update of non-subscription estimates, entitled Employer Participation in the

Texas Workers’ Compensation System: 2018 Estimates.• Analyzed designated doctor program trends in the Texas workers’ compensation system.

• A study of the impact of DWC’s implementation of the Texas workers’ compensation pharmacy closed formulary, to include functional outcomes, return-to-work rates, and injured employee satisfaction.

The Office of External RelationsThis office handles all DWC government relations and legislative activities, as well as stakeholder outreach. It also coordinates DWC’s external communications to ensure consistency and cultivates positive relationships with the Texas Legislature and other stakeholders.

FY 2018 highlights:• Completed sessions on the basics of workers’ compensation and current issues with

legislative and state government staff.• Coordinated stakeholder outreach for all DWC rule projects and gathered input from system

participants on the impact of proposed rule changes. Many of these projects were the result of legislation passed in the 85th Texas Legislature, 2017.

Office of the General CounselThis office advises the workers’ compensation commissioner on legal matters affecting DWC, reviews litigation, and coordinates legal analysis of policy issues. It also advises DWC on legal matters relating to rulemaking, open records, legislation, policy, and specific legal issues involving various program areas. The office includes Self-Insurance Regulation, which issues certificates of authority to self-insure to qualified private employers. It also includes the administration of the Subsequent Injury Fund, which issues Lifetime Income Benefits to eligible injured employees and reimbursements to workers’ compensation carriers in accordance with statutory directives.

FY 2018 highlights:• Managed the adoption of new and amended agency rules addressing, among other

topics, preauthorization of compounded medications, the repeal of outdated rules, and telemedicine services within the workers’ compensation system.

• Developed case strategies and responsive pleadings in state and federal court regarding air ambulance litigation, which involved federal law challenges to DWC's authority to adjudicate fee disputes in accordance with current DWC fee guidelines.

• Developed new processes and forms assisting the Subsequent Injury Fund claims review process, recording payment information, and communicating reimbursement decisions.

Office of the Medical AdvisorThis office monitors health care quality in the workers’ compensation system by conducting health care provider and other system participant reviews. It also recommends rules and policies regarding medical care and medical delivery systems to the workers’ compensation commissioner, and determines which doctors meet the qualifications for serving as designated doctors.

The Appeals PanelThe Appeals Panel is the highest level in the workers’ compensation administrative dispute resolution process. It reviews appeals of decisions of administrative law judges (ALJs) in DWC contested case hearings (CCHs), except for appeals of decisions in medical necessity disputes.

The Appeals Panel issues written decisions in cases in which it affirms, reverses and renders, or reverses and remands a decision of the ALJ. The panel may only issue a written decision on an affirmed case to discuss a case of first impression, to address recent changes in law, or to correct errors made at the CCH level that do not affect the outcome of the hearing.

If the Appeals Panel does not issue a written decision in a case, a letter is sent to the parties notifying them that the ALJ’s decision has become final and has become the decision of the Appeals Panel. In FY 2018, the Appeals Panel issued 3,042 decisions (2,914 final letters and 128 written affirmed and reversed decisions). Beyond the Appeals Panel, the next step in the dispute resolution process is a request for judicial review.

Health and SafetyThe deputy commissioner for Health and Safety oversees the Health Care Business Management, Medical Fee Dispute Resolution, Workplace Safety, and Return-to-Work sections.

Health Care Business ManagementHealth Care Business Management supports the operations of the medical advisor and the Medical Quality Review Panel. The panel reviews the actions of doctors and other health care providers, insurance carriers, utilization review agents, and independent review organizations, and makes recommendations to the Office of the Medical Advisor. This section provides internal and external training on medical benefits, as well as outreach to encourage health care providers to participate in the Texas workers’ compensation system. It also researches and analyzes economic factors and treatment protocols to help the commissioner develop rules and guidelines for medical treatments and return-to-work programs.

FY 2018 highlights:• Encouraged quality-of-care improvements by investigating 155 complaints, which led to 10

referrals to Enforcement, 17 letters of education, and nine medical quality reviews.• Completed a Designated Doctor Plan-Based Audit of 10 subjects. The audit revealed that

the designated doctors referred injured employees for additional testing without the proper supporting documentation. In addition, their reports did not contain the information required by rule. As a result, all 10 subjects of the audit were referred to Enforcement.

• Initiated a Lumbar Spine MRI Plan-Based Audit of 10 subjects. The purpose of the audit was to evaluate the appropriateness of doctor decisions and recordkeeping in ordering lumbar spine MRIs prior to one month of conservative therapy.

• Initiated an Opioids Plan-Based Audit of 10 subjects. The purpose of the audit was to evaluate the appropriateness of health care provider decision-making and recordkeeping to support prescribing opioids for treatment plans tailored to specific injured employees.

Medical Fee Dispute ResolutionMedical Fee Dispute Resolution resolves disputes over the amount of payment for services determined to be medically necessary and appropriate for the treatment of a work-related injury.

FY 2018 highlights:• Resolved more than 4,400 medical fee disputes, with a total amount in dispute of $10.6

million. About $5.5 million was resolved through education and agreements, with $5.1 million resolved by DWC decisions.

• Continued to reduce a backlog of pending medical fee disputes from 17,054 in August 2009 to about 1,200 in August 2018. This does not include about 1,200 air ambulance disputes that were abated due to ongoing litigation. The reduction allows quicker resolution of new disputes and frees DWC resources for other priorities. Resolving disputes quickly benefits health care providers, insurance carriers, and injured employees.

Workplace SafetyWorkplace Safety provides Texas employers and employees with health and safety resources and services to help prevent occupational injuries and illnesses. This includes occupational safety and health consultations, safety training and educational materials, insurance company loss control inspections, a safety violations hotline, and Texas injury and illness data collection for the U.S. Department of Labor, Bureau of Labor Statistics.

FY 2018 highlights:• Presented Lone Star Safety Program awards to 10 companies with exemplary workplace

safety programs and low rates of work-related injuries and illnesses. Highlighting employers that have made safety a priority encourages others to participate in the program, which helps them save money and keep employees safer on the job.

• Helped employers improve safety programs and assess their work sites for safety by performing 3,159 safety inspections and consultations.

• Reduced workplace risk for thousands of employees by working with employers to remove 6,098 safety hazards.

• Provided direct safety intervention to 69,575 employees through face-to-face training, DVDs, and other safety products and services.

• Improved construction workplace safety and health hazard awareness by training 1,127 employees in 68 free OSHA classes.

• Worked to reduce fatal transportation incidents through online occupational driving safety guidance that was viewed more than 16,790 times. Workplace Safety also hosted three train-the-trainer classes for the National Safety Council’s “Our Driving Concern: Texas Employer Traffic Safety” program, and two “Drug Impairment Training for Texas Employers” courses.

Return to WorkReturn to Work provides internal and external training on the importance of bringing an injured employee back to work. This section also administers a grant program for small employers that provides reimbursement for workplace modifications that assist an employee’s return to work.

FY 2018 highlights:• Improved employee return-to-work rates by training 7,234 employers at 42 seminars and

presentations across the state.• Provided return-to-work outreach training to 291 health care providers to help improve

injured employee outcomes.• Provided 226,730 injured employees with return-to-work resources and a checklist to

enhance communication with their health care provider, insurance carrier, and DWC.• Provided return-to-work education through easily accessible web publications that were

viewed 6,671 times. System stakeholders also received 2,646 hard copies of DWC’s return-to-work publication.

• The percentage of network injured employees who went back to work after their injury increased by 7 percentage points, from 87 percent in 2011 to 94 percent in 2018. The return-to-work rate for non-network injured employees has remained relatively steady at 88 percent for the same timeframe.

Compliance and InvestigationsCompliance and Investigations monitors system compliance, pursues enforcement of violations under the Texas Labor Code, and oversees the investigation and prosecution of workers’ compensation fraud. Compliance and Investigations includes the following sections: Compliance Review, Monitoring and Analysis, Audits and Investigations; Enforcement; the Fraud Unit; and the Fraud Prosecution Unit.

Compliance Review, Monitoring and Analysis, and Audits and InvestigationsThis section is responsible for monitoring compliance by system participants. They analyze system data, identify noncompliance, make referrals for enforcement proceedings, perform audits, and administer the Performance Based Oversight program (a legislatively required biennial report card for insurance carriers and health care providers).

FY 2018 highlights:• Returned more than $350,000 to system participants by resolving more than 5,800

complaints.• Returned more than $420,000 to injured employees, their beneficiaries, and the Subsequent

Injury Fund by completing 59 performance audits.• Reviewed 152 health care providers for timeliness of filing the DWC Form-069, Report of

Medical Evaluations. Of those, 113 had scores placing them in the high performer tier, 30 were in the average performer tier, and nine had scores placing them in the poor performer tier.

• Reviewed 87 health care providers for documentation supporting why the injured employee was prevented from returning to work, as reported on the DWC Form-073, Work Status Report. Of those, 41 had scores placing them in the high performer tier, 29 were in the average performer tier, and 17 had scores placing them in the poor performer tier.

EnforcementEnforcement oversees the intake, investigation, and enforcement of alleged violations in the workers’ compensation system. Enforcement actions are generally based on priorities set by the commissioner, but may also be the result of the DWC’s medical review process, complaints, direct referrals to Enforcement, or other monitoring initiatives. Enforcement cases may be resolved through a consent order, warning letter, or may proceed to the State Office of Administrative Hearings (SOAH) for an evidentiary hearing. Medical review cases include an informal settlement process involving Medical Quality Review Panel members, respondents, and their attorneys.

FY 2018 highlights:• Opened 256 cases.• Assessed $815,755 in fines.• Conducted 165 investigations.• Resolved 19 DWC health care provider/designated doctor cases through monetary penalties,

continuing education, and cease and desist orders.

Fraud UnitThe Fraud Unit investigates allegations of workers’ compensation insurance fraud. Its responsibilities include reviewing fraud reports from system participants, conducting investigations, and working with state and federal prosecuting agencies. Investigations typically involve one of the following types of fraud:

• Premium fraud, committed by employers through misclassification and false certificates.• Insurance carrier fraud, which includes insurance carrier officers and directors who commit

fraudulent activities such as fictitious claims and kickbacks.• Health care provider fraud, which includes overbilling, up-coding, and billing for services

not provided.• Attorney fraud, which includes overbilling, false claims, and kickbacks.• Claimant fraud, committed by injured employees, which includes working and drawing

benefits, malingering, and false claims.

Fraud Prosecution UnitThe Fraud Prosecution Unit was formed in September 2017, in accordance with a budget rider passed by the 2017 Texas Legislature. The unit is embedded with the Travis County District Attorney’s Office and consists of four employees, including a prosecutor and an investigator.

FY 2018 highlights:• Opened 170 workers’ compensation fraud investigations.• Referred 29 workers’ compensation fraud cases for prosecution.• Obtained 13 indictments.• Obtained 14 convictions (11 injured employees, one employer, and two health care

providers.)• Obtained more than $470,000 in restitution to victims.

HearingsHearings oversees a multi-tiered administrative dispute-resolution system for indemnity disputes and certain medical disputes. This system starts with benefit review conferences (BRCs), in which the parties try to mediate their disputes, and then progresses to more formal contested case hearings (CCHs) if parties are unable to reach an agreement. At a CCH, the parties present evidence in support of their argument to an ALJ, who then issues a written decision on the disputed issues. These proceedings are held at DWC offices and other sites across the state. Issues not resolved to either party’s satisfaction through BRCs and CCHs may be appealed to DWC’s Appeals Panel.

FY 2018 highlights:• Facilitated the resolution of benefit disputes between injured employees and insurance

carriers by conducting 12,738 BRCs and 6,478 CCHs.• Shortened the time required to resolve disputes from an average of 151 days in FY 2017

to 122 days in FY 2018.• Improved efficiency by making it easier for parties to skip the BRC phase when they are

ready to proceed to hearing and an agreement is unlikely.• Improved efficiency by only scheduling a second BRC when doing so was likely to result in

an agreement or was necessary to develop facts. The percentage of disputes that included a second BRC decreased from 47 percent in FY 2017 to 40 percent in FY 2018.

• Continued implementing online dispute resolution to allow parties to participate remotely in BRCs by video conferencing, document sharing, and virtual breakout rooms for private caucuses. Conducted 20 video BRCs in Austin FY 2018 as part of an ongoing pilot project.

Claims and Customer ServicesClaims and Customer Services provides education and promotes informal dispute resolution by facilitating communication between system participants. Injured employees and other system participants who need information and assistance may visit one of 20 local offices or call the Claims and Customer Services line. Designated office staff are assigned as the DWC single point of contact for injured employees receiving services from DWC. Claims and Customer Services oversees the

FY 2018 highlights:• Provided information and assistance to about 150,000 injured employees and other system

participants in the virtual call center, assisted about 4,200 injured employees at offices, and processed more than 13,000 requests from insurance carriers or injured employees on a variety of issues.

• Increased outreach efforts by hosting 232 free education sessions across the state for injured employees as well as education presentations for treating doctors and employers.

• Conducted internal compliance workshops that resulted in the identification and referral of 4,043 potential administrative violations to Compliance and Investigations for further action.

• Facilitated dispute resolution by helping designated doctors obtain medical records needed to perform examinations for more than 900 claims.

• Implemented a new Spanish call center in El Paso to improve customer service for Spanish-speaking injured employees and to provide interpretive services to DWC staff in field offices.

Business ProcessBusiness Process is responsible for activities that support DWC's administration of the workers’ compensation system. This program area oversees Designated Doctor Education and Operations, Outreach Planning and Coordination, Information Management Services, and Records Management and Support.

Designated Doctor Education and OperationsDesignated Doctor Education and Operations provides education, training, resources, and direction to designated doctors and other system participants to ensure qualified doctors evaluate injured employees. This section also oversees designated doctor examination scheduling and testing, including test development and administration. In FY 2018, 331 doctors attended DWC-sponsored designated doctor certification courses, and 348 doctors attended other designated doctor training events.

FY 2018 highlights:• Adopted a rule that updates designated doctor qualifications and clarifies the method for

scheduling designated doctor examinations. The purpose of these changes is to increase physician participation in the designated doctor program, clarify qualification requirements for designated doctors, and increase the transparency of the program.

• Implemented a performance review plan for designated doctors to monitor the quality of their reports. The results of these reviews will assist in the recertification process and strengthen DWC’s efforts to provide education and feedback to doctors.

• Offered 10 case-based workshops for designated doctors through webinars, reducing costs for doctors attending the training.

Information ManagementInformation Management works to streamline and increase the effectiveness of service delivery and provides automated solutions to the business process needs of DWC and system stakeholders. This section also maintains processes for retrieving workers’ compensation claim data requested by system participants.

FY 2018 highlights:• Began a project to update one of DWC’s legacy systems, TXCOMP Provider, to a more

current technological platform. This project decreases risk for the agency and will make future system updates easier.

• Increased use of DWC’s electronic document processing services. These services, including faxback receipt and secure file transfer, increase the security of information submitted to DWC and further the goal of creating a paperless claims environment.

• Made improvements to DWC tracking of dispute outcomes for designated doctor reports. These technological improvements will result in more timely feedback to designated doctors regarding the use of their reports at CCHs held by DWC.

Outreach Planning and CoordinationOutreach Planning and Coordination oversees delivery of educational opportunities to system participants through education and conferences, speaking engagement coordination, and agency calendar management. This section also provides support for DWC internal and external training.

FY 2018 highlights:• Organized the annual Texas Workers’ Compensation Conference, providing educational

outreach to more than 950 attendees. The conference provides industry professionals practical information to improve workplace safety and enhance the quality of the Texas workers’ compensation system.

• Coordinated more than 565 presentations by DWC staff to external consumer groups.

Records Management and SupportRecords Management and Support maintains records associated with injured employee claim files and insurance coverage information. The group also facilitates the exchange of electronic records from external customers to DWC.

FY 2018 highlights:• Completed work with an external vendor to scan 13,000 boxes of paper claim file records

maintained at the DWC Records Center. The project increases record search efficiency, provides more secure storage, and saves hundreds of thousands of dollars in future annual rental costs.

• Implemented process improvements related to providing claim file information to authorized requesters. These improvements were a part of the implementation of a new open records request system, which allows external customers to request information online.
