POLICY:

The Board of Directors and employees shall use their best efforts at all times to make decisions that are consistent with high principles, and to protect and enhance the value of properties of the members and LLBC. All Directors and employees shall exercise their power and duties in good faith and in the best interest of, and loyalty to LLBC. All Directors and employees shall comply with all lawful provisions of the Covenants and Restrictions, Constitution and By-laws, Policies and Procedures.

A conflict of interest exists whenever any contract, decision or other action taken by or on behalf of the Board would financially benefit: a Director, a Director’s relative, an employee, an employee’s relative or an entity in which a Director or employee has a personal financial interest.

Any conflict of interest, as defined above, shall be verbally disclosed to the Directors in open session at the first open meeting of the Board of Directors at which the interested Director or employee is present prior to any discussion or vote on the matter. After disclosure, the interested Director or employee may participate in the discussion, but shall not vote on the matter.

PROCEDURE: The minutes of the meeting shall reflect the disclosure made, the abstention from voting, the composition of the quorum and record who voted for and against.

Code of Ethics: In addition to the above, each Director and the Board as a whole and employees shall adhere to the following:

1. No contributions will be made to any political parties or political candidates by LLBC.2. No Director or employee shall solicit or accept, directly or indirectly, any gifts,

gratuity, favor, entertainment, loan or any other thing of monetary value from a person who is seeking to obtain contractual or other business or financial relations with LLBC.

3. No Director or employee shall accept a gift or favor made with intent of influencing decision or action on any official matter.

4. No Director or employee shall receive any compensation from LLBC for acting as a volunteer.

5. No Director or employee shall willingly misrepresent facts to the members of the community for the sole purpose of advancing a personal cause or influencing the community to place pressure on the Board to advance a personal cause.

6. No Director or employee shall interfere with a contractor engaged by LLBC while a contract is in progress. All communications with LLBC contractors shall go through the Board President or be in accordance with policy.

7. No Director or employee shall harass, threaten or attempt through any means to control or instill fear in any member, Director, employee or agent of LLBC.

8. No promise of anything not approved by the Board as a whole can be made by any Director or employee to any subcontractor, supplier, or contractor during negotiations.

9. Any Director convicted of a felony shall voluntarily resign from his/her position.10. No Director or employee shall knowingly misrepresent any facts to anyone involved

in anything with the community which would benefit himself/herself in any way.

Any contract entered into in violation of this policy shall be void and unenforceable. In such event, the Board, at the next meeting of the Board, shall vote again on the contract, decision or other action taken in violation of this Policy.

In every organization it is necessary to establish a framework within which the efforts of the members, management, and elected leaders can be directed in a manner to advance the objectives of both the overall organization and the interests of the individual members. This Policy and Procedures Manual has been designed to be a working guide for current and future Board of Directors and club management to aid them in administration of Loch Lomond policies and procedures. These written guidelines should increase understanding, reduce the need for personal interpretations, and help ensure uniformity with administration.

Any policy, however properly formulated, is only as good as its implementation. The key to the implementation of policy is the Board of Directors on Board related issues and club management on club operational issues. It is, therefore, your duty to apply these policies and procedures consistently and fairly.

If club members or club management have any problems or suggestions regarding the policies and procedures in this manual, they should contact a member of the Board of Directors.

SUBJECT: DISTRIBUTION OF MANUAL POLICY #: 3

POLICY:

This manual is being distributed to each Loch Lomond member of the Board of Directors and to the Club Manager. Each director and the manager is assigned a numbered manual and is responsible for it. A copy is maintained at the Beach Club desk and is available for members’ review. The secretary of the Board of Directors is responsible for collecting manuals when a manual holder leaves their position, assuring they are updated and current, and re-issuing to new Board members or club managers.

PROCEDURE:

Any Board of Director member or Club Manager who leaves his position should return their respective manual to the secretary of the Board.

POLICY:

The foundation for this Policy and Procedures Manual is the Loch Lomond Beach Club By-laws, Covenants and Restrictions. In order to provide further guidance in administration of the Loch Lomond Beach Club, it will be necessary to create new Policies and Procedures and/or update existing Policies and Procedures.

A simple majority of the total duly elected Board of Directors may approve a new policy or revised policy by vote at a regularly scheduled Board of Directors meeting.

PROCEDURE:

All approved policies will be recorded by the secretary in the minutes of that meeting.

The secretary will assure that the approved policy (ies) are typed in the policy and procedure format, signed by the current president, and distributed to Policy and Procedures Manual holders within 30 days of the approved date.

Periodically, the secretary will update and reissue an updated log to be placed in the front of each manual.

Periodically, the secretary will update and distribute revised table of contents.

Prior to the beginning of every third year, beginning 2014 (April 1 st), the secretary will audit and update as necessary in order to assure that they are current for the coming fiscal year.

POLICY:

The annual meeting of the Loch Lomond Beach Club, Inc. shall be held at 2754 28 th Street, Birchwood, Wisconsin on the second Saturday in June of each year at two o’clock p.m.

PROCEDURE:

1. Notice of the annual meeting of the corporation shall be in writing to each regular member appearing on the books of the corporation not less than ten days prior to the meeting.

2. Business conducted at the annual meeting shall consist of:

a. Election of directors when vacancy appears

b. Membership approval of annual budget

c. Any business that properly comes before the Board

3. Regular member may cast one vote per each Maintenance Assessment paying lot owned.

4. Associate members may attend the annual meeting as spectators.

5. Regular members will check-in upon arriving at meeting to receive proper number of ballots.

Attachments A,B,CPOLICY:All owners of lots in the development, except for Barron County owned lots, Tax Deed lots, LLBCI lots, Developer owned lots ie Melar, all owners of member lots in the Loch Lomond Beach Club, Inc. will be assessed an annual maintenance assessment (to be identified as MA) in order to provide funds to operate and maintain the common property and facilities.

PROCEDURE:

1. The amount of the MA will be based upon the budget and approved on an annual basis by the Board.

2. Property owner rates (multiple lot discounts apply only after payment on the full rate lot has been paid):

First lot - full rate

Second lot - 50% of full rate

Additional lots - 25% of full rate

All lots retain their current classification (1st lot, 2nd lot, additional lots) as of April 1st until the next fiscal year.

Lots listed as any type of trust, company or corporation must have on file with the Loch Lomond Beach Club a designated person, along with their current address, to be included on the membership card who is to be responsible for all payments due to the club. (Attachment 6A).

If a lot has multiple owners listed on the deed (other than spouses), one owner must be designated as the individual responsible for payment of the maintenance assessment and all other payments due Loch Lomond Beach Club, Inc. A current address for that individual must be on file. (Attachment 6A) All owners listed on the deed are members. Membership cards will be issued to members and sent to the responsible party. Only one statement per lot will be sent.

speculative building will not be required to pay MA provided: they or their families do not make any personal use of any of the land or club facilities; allow other persons to camp, place a trailer upon, or utilize the lots for any purpose with or without payment; maintain the payment of county property taxes, and maintain the property in good order. Should any of the foregoing not occur, the developer status shall be forfeited and regular MA will be required. Persons wishing to be classified as non-voting developers, must receive approval for such status from the Board of Directors of Loch Lomond Beach Club, Inc.

4. All current property owners of the preceding year will be mailed a notification of the MA for the next fiscal year (April1 – March 31st) no later than March 31st.

An early discount may be offered to those members owning property prior to April 30 th. Payment less early discount must be received by April 30 th in order to qualify for the discount.

Multiple lot discounts will be allowed only on lots that are titled identically. i.e.,

Husband and wife on one lot, husband only on second lot will not qualify for multiple lot discount.

5. Persons who purchase Barron County Tax lots and wish to become LLBC members, Developer lots, or LLBCI lots during the fiscal year will be assessed the MA prorated from the date of closing to the end of the fiscal year. Succeeding years MA shall not be prorated.

Purchase and payment of the MA received during April of the Fiscal Year will be allowed the Early Payment Discount rather than proration.

6. A letter will be sent to all owners who do not pay their MA(s) by May 15th of the current fiscal year, stating that the use of club facilities or services (i.e., clubhouse, pool, tennis courts, docks, boat

landing, garbage dumpsters, etc.) will not be allowed until the MA(s) until the MA is brought current on all lots owned .

7. Any MA unpaid by August 15th will be considered delinquent. A past due letter (Attachment 6b) will be mailed to the owner of record. If there is no response from the member by September 15 th a lien will be filed on the property and a letter notifying the member of the lien will be mailed (Attachment 6c) per policy 8.

8. An interest rate of 18% per year will be assessed on all past due balances.

9. Pursuant to Article VIII of the By-Laws of Loch Lomond Beach Club, “Persons acquiring lots subject to the Declarations, by accepting deeds thereof, or by signing contracts to purchase the same, shall become personally obligated to pay all outstanding Maintenance Assessment, including interest, upon the lot or lots acquired or to be acquired by such persons and shall be subject to the lien enforcement procedures authorized by law.”

Loch Lomond Beach Club no longer offers new seasonal memberships. Seasonal memberships entitle cardholders to all Loch Lomond Beach Club privileges, except voting rights at the annual meeting.

PROCEDURE:

1. The Board shall have the right to revoke any seasonal memberships for violation of Loch Lomond Beach club rules. A prorated refund will be returned to the cardholder.

2. Annual seasonal membership Maintenance Assessment shall be 178.5% of regular membership annual Maintenance Assessment.

Loch Lomond Beach Club may file a lien against property where the Maintenance Assessment is past due.

PROCEDURE:

1. Property owners who do not pay their Maintenance Assessment (MA) by August 15 th of the fiscal year will receive a Past Due letter stating payment must be received by 30 days from the date of the letter or lien proceedings will begin.

2. If payment is not received by the set date (see above) and no payment arrangement has been made, a lien will be filed with Barron County in the amount of the current MA or the balance of the current years’ assessment plus a $35 (plus mailing costs) lien fee.

3. A lien letter will be sent stating a lien has been filed on the property and if payment is not received 30 days from the date of the letter and no payment arrangements have been made the account may be turned over for collection.

4. Property owners who have had a previous lien (s) and are again delinquent will be subject to a lien (s) amendment that identifies interest and additional maintenance assessment in the lien (s).

5. Initial liens and amended liens will be directed by the Club Treasurer and referred to the Assistant Treasurer for filing on an annual basis.

6. Property owners who do not pay their Maintenance Assessment by October 15 th of the fiscal year may be subject to further legal action. This could include liens, small claims court, judgments or foreclosure action.

The annual budget of "The Woods" will provide for: The operation and maintenance of the Loch Lomond Beach Club and other common facilities owned by the organization; the establishment of depreciation schedules for capital items and their replacement. The annual budget and Maintenance Assessment are approved by the membership at the annual June meeting.

1. The Board of Directors will prepare an annual budget (see Attachments 9A and 9B) in September and October for the fiscal year beginning April 1st and ending March 31st.

2. The budget will include provisions for the replacement of capital items.

3. The Board will give preliminary approval of the budget and Maintenance Assessment pending final approval by the voting membership.

4. The Board will present the budget for final approval by the voting membership at the annual meeting at the Loch Lomond Beach Club in June of the current fiscal year.

5. The Board will monitor the budget by comparing expenditures to projected costs and take necessary action to remain within the budget.

6. In case of unusual or catastrophic occurrences, the Board will take action within the interest of the organization and report to the membership as soon as possible.

OBJECTIVE:

To define the procedure for invitations to non-member tax lot owners to become members of the Loch Lomond Beach Club, Inc., and to define the use of Loch Lomond Beach Club Inc. Facilities and properties by non-member tax lot owners.

POLICY:

Any tax deed lot owner whose property lies within "The Woods" development will be invited to become a regular member of the Beach Club.

PROCEDURE:

1. Non-member tax lot owners will be extended a written invitation (see Attachment 11A) to join the Beach Club with regular membership status at any time conditioned upon their returning each lot to full covenant coverage by recordation of an appropriate document with the office of the Register of Deeds for the county in which said lots are located.

2. Non-member tax lot owners and their immediate families or household may be guests of the Beach Club for a one day visit to inspect the facilities prior to requesting a membership application.

For the purposes of this policy, an immediate family is defined as spouses or live-in-companions plus their children and grandchildren, including step-children, foster-children, and equivalent relationships.

3. Owners of tax deed lots who became members prior to the effective date of this policy shall be informed how to return their lots to full covenant coverage, but refusal to do so shall not affect membership status.

RESPONSIBILITIES

The Board may delegate any or all of the responsibilities of the above procedures to a committee of the Board, an officer agent, or employee of the Beach Club.

Welcome to "The Woods" development. Your purchase of a tax deed lot gives you the opportunity to become part of a unique community of friends. We invite you to make a visit to the clubhouse and receive a tour of the amenities we offer and also learn how you can become a regular member of the Loch Lomond Beach Club, Inc. Please contact the clubhouse manager, Georgia Buchner, to make an appointment for a tour.

Ownership of a tax deed lot is subject to covenants and restrictions and is eligible for a regular membership of LLBC located at 2754 28th Street on Red Cedar Lake.

A copy of the covenants and restrictions that correspond with your lot can be obtained from the Barron County Courthouse or from LLBC. Two of the most common questions regarding the covenants and restrictions concern the process to obtain a temporary dwelling permit for using a camper or trailer on your lot and the process for approval of a structure or building. Habitation of a temporary structure (i.e., camper or trailer) must have a temporary dwelling permit. All building plans and specifications must be submitted to and approved by the LLBC Architectural Control Committee prior to commencement of building.

Applications for either a temporary dwelling or proposed building permit can be obtained through the LLBC clubhouse. The applications are approved by the LLBC Architectural Control Committee or by the Board of Directors. A copy of each permit application is enclosed for your use. The forms would need to be completed and returned to LLBC for approval.

POLICY:

Loch Lomond Beach Club may sell property that they own which is not essential to the operation of the Club, to buyers on a sealed bid basis, after the impending sale of the property has been announced and publicized to the members of the Club and to other potential buyers. In addition, the Club may accept deeds for property which are offered as gifts to the Club. Proceeds from the sale of purchased or donated property will be used to purchase additional tax lots as they become available, with the expectation they will be sold to persons that would become Maintenance Assessment paying members of the Loch Lomond Beach Club.

PROCEDURE:

1. The Club may have pieces of property which may be suitable for purchase by present or prospective members of the Loch Lomond Beach Club.

a. The costs incurred by the Club to obtain and transfer the property will be the minimum sales price of the property.

b. All proceeds from the sale of the property will be used to purchase tax lots on a limited basis.

2. Existing property owners may wish to donate property to the Loch Lomond Beach Club. The Board of Directors will act on these donations, if they meet the qualifications listed below:

a. There may be no liens or any other encumbrances on the property being donated, except the property may be considered if the only lien or encumbrance is a lien of the Loch Lomond Beach Club.

b. The donator of the property may responsible for the legal be fees, the registration fees, and any closing costs associated with the donated property.

c. The Board may waive any requirements which it deems are in the best interest of the Loch Lomond Beach Club.

3. Once ownership has been transferred to the Loch Lomond Beach Club, the following action may be taken in order to put the property in a Maintenance Assessment paying situation:

a. The property may be advertised in local newspapers, indicating the price of the property. The transfer would also include a contract stating the new owner would abide by the covenants and restrictions of the Beach Club and a pledge to keep current on Club Maintenance Assessment in the future.

b. The Club may place “For Sale” signs on the property which it wishes to sell. In addition, the Club may advertise to property owners on Red Cedar Lake indicating they can become members of the Loch Lomond Beach Club with all the benefits of membership by purchasing a lot and paying annual Maintenance Assessment.

c. The Club may list any property it owns with real estate firms with which it has a close working relationship.

d. The Club may run a raffle on such lots in order to get ownership in the hands of Maintenance Assessment paying members.

e. The Club may use any other means which it deems to be reasonable, to dispose of property and to put the property into Maintenance Assessment paying status.

POLICY:

Loch Lomond Beach Club, Inc. shall elect a Board of Directors at the corporation's annual meeting to manage all businesses and affairs of the corporation. Article V, Section 1a of the Club by-laws instructs the Board to hire a management team for the corporation and fix their compensation. In return for said compensation, club management agrees to manage, to the best of their abilities, all facilities, amenities and businesses of the Loch Lomond Beach Club located at 2754 28th Street, Birchwood, Wisconsin 54817.

PROCEDURE:

1. Club management shall consist of a Club Manager and an Assistant Manager when deemed necessary by the Board.

2. Board will annually assign a Board liaison.

3. The terms of the employment contract(s) begin April 1 and terminate March 31 of said fiscal year.

4. Hours of operation shall be reviewed annually by the Board by the April Board meeting.

5. Management shall administrate LLBC's Constitution, By-laws, amendments, Covenants and Restrictions, Policies and Procedures and carry out functions and duties.

6. Management shall prepare all correspondence pertaining to the Beach Club business in a professional manner.

7. Management, along with the Club's social activities committee, shall prepare a complete yearly activities schedule in accordance with hours of operation and yearly seasons.

8. Management presents a clubhouse report monthly for the Board meetings. This report is to cover activities, attendance and all situations and proposals under the manager's jurisdiction.

9. Management shall maintain clubhouse and grounds, including parks as stated in the Manager's Manual and in employment contract.

10. Management shall operate Club and plan expenditures and activities within constraints of the Club's yearly budget.

maintenance and operation of the Club. This action is subject to direction from the Board and budget guidelines. Each employee shall receive a copy of their position description.

12. Management shall operate the Club in accordance with the Manager's Manual. All employees shall be subject to a preseason performance evaluation (see Attachment 13A). These evaluations shall be gone over privately with employee stressing strong points and emphasizing weak points and means of correcting these short comings. The Board of Directors shall file the manager's evaluation (see Attachment 13B), with the Board President discussing evaluation with management. The manager shall file all other Club employee evaluations. These performance evaluations shall be kept in a confidential file in the Beach Club office.

13. The Board shall determine salaries and selection for management by their February meeting. Contracts will be signed at this time.

14. Management shall work cooperatively with the Club Treasurer by submitting monthly bills and assisting in preparation of monthly financial reports.

15. Management shall be responsible for banking of Club funds and submitting report to the treasurer.

POLICY:

The Loch Lomond Beach Club shall maintain and manage a clubhouse store for sale of goods and merchandise to members and their guests.

PROCEDURE:

1. Clubhouse personnel only shall transact sales to members and their guests within guidelines set by the Board of Directors and Wisconsin State Law.

2. The Club Manager is responsible for proper training of personnel in proper sales procedure and etiquette.

3. Store inventory status shall be taken weekly and inventory re-supplied as needed.

4. The manager and/or interior maintenance assistant shall comprise a yearly written inventory to be placed on file in the office for use by future management.

5. All sales, cash or charge, shall be entered on cash register under appropriate type of transaction.

6. Charges (members only) shall be written on proper invoice with members receiving their appropriate copy. (Charges include store, dock rental, waste area and any additional charges other than the annual Maintenance Assessment.)

A charge invoice will be mailed or emailed out monthly. It is the management’s responsibility to check files to validate charges.

Monthly charges that are $10 or less will be emailed (if email is on file). For members without email on file, one phone call will be made. Members not responsive to the phone call or email will be charged a $5 handling fee for mailing an invoice or statement.

Charge accounts that are more than 2 months overdue shall have their charging privileges suspended and the association reserves the right to turn such balances over for collection. A membership card for the new fiscal year will not be issued to members having past due store balances. Members having their store account turned over for collection will have their charging privileges permanently revoked.

7. The manager shall submit store bills and income received initialed with appropriate budget

heading to the Financial Secretary; i.e., store sales, annual meeting, etc.

8. Gas sales shall be for marine use only and at posted hours.

9. The store will target a 30% average mark-up on merchandise including sales tax.

10. Manager shall leave $100 change in cash register at the opening of each day. The manager shall remove any excess amounts of cash on hand during busy days and be responsible for those funds. At no time shall large amounts of cash or checks be left overnight at the Beach Club.

11. Liquor license applications are obtained from Cedar Lake Township Secretary.

Slip Rental Fee: The Board, prior to each fiscal year, establishes slip rental fees after reviewing area slip rental rates, cost of replacement, maintenance and slip rental demand.

Members Only: Due to limited slip availability, associate members are not eligible for Timeshare rental.

Slip Transfer: Slips may not be subleased and are non-transferable, including due to sale of property or in a will, trust or other document. Slips remain the property of LLBC.

Timeshare slip rental:

1. Long Term Slips Current slip renters may retain a slip from year to year, if they have paid the rental fee by April 30. If not paid by April 30, the slip will be offered to the next person on the List.

2. Twelve Week Timeshare Slip Rental: The purpose of these slips is to provide the membership an opportunity to rent a slips on a time limited basis. These Timeshare Slips are available to members who have contacted Manager via email and are on a current list.. There are two twelve week timeshare periods. No list shall survive beyond April 30, each year.

3. Multiple Timeshare Slips: Members of an immediate family are limited to a single Timeshare Slip rental, unless a slip is available and there are no names on the List.

2. Temporary slips may be used by any member or associate member for up to a maximum of two (2) hours.

3. There is no charge to use a temporary slip.PROCEDURE:

1. Annual slip rental charges are communicated to the membership via the newsletter and email and to the previous years’ slip renters via a spring billing by the Assistant Treasurer. The Assistant Treasurer maintains a separate line on the budget and expense report for slip rental fees collected.

2. The Club Manager will offer reserved slips billed by the Assistant Treasurer, but not paid by April 30, to the next person on the List.

3. The Club Manager maintains the official List. 4. Each slip renter must provide their own insurance coverage for property damage and

liability coverage.5. Any violation of these Policies and Procedures is cause for termination of the rental

agreement and the rented slip to be returned to the Beach Club slip pool.

d. Discuss county planning or any other related issues.

7. The Facilities and Maintenance Committee shall meet to:

a. Review facilities, grounds and equipment relative to monthly operation plan (May - September).

b. Discuss priority needs with operational budget and costs in mind.

c. Develop and update 5-year facilities, maintenance and equipment plan as basis for capital improvements portion of annual budget to be completed by February of each year.

d. Report to Board on recommendations for annual maintenance plans, monthly priorities and evaluations and 5-year facilities and equipment plans.

8. The Social Activities Committee with the assistance of the Club Manager shall compose a yearly clubhouse social activities calendar to be mailed out to the membership with the spring newsletter.

This committee is responsible in assisting club management with the operations of these activities. This may be accomplished by enlisting help from selected club volunteers, Social Activities Committee members, or club staff. The lunch served prior to the annual membership meeting fall in the jurisdiction of this committee.

The committee chairperson shall report to the Board any new activity ideas or any changes in the present activity calendar.

9. The Long Range Planning Committee will develop and update facilities, maintenance and equipment plan beyond 5 years.

6. We/I understand that members may store the seasonal dwellings at the LLBCI storage areas located on Loch Lomond Boulevard with permission from LLBCI on a space available basis.

7. We/I understand that LLBCI may, as its sole discretion, extend the period that a temporary dwelling may be kept on a lot upon a written request for such an extension.

TEMPORARY DWELLING PERMITS-TRAILERS

Each of the Covenants and Restrictions for the various divisions in "the Woods" require a special written Temporary Dwelling Permit from Loch Lomond Beach Club, Inc.

The Board of Directors have adopted a Temporary Dwelling Permit from which provides that temporary structures are permitted between the first Saturday in April and the last Sunday in October of each calendar year provided such permission is granted by the Planning Commission.

Situations have arisen where members and non-members alike have not signed Temporary Dwelling Permits and have left trailers on their lots and also where members and non-members alike have not complied with the permit requirements.

This Policy addresses these violations and provides a procedure for resolving the same.

PROCEDURE:

The person or persons violating the Temporary Dwelling Permit requirements shall be notified by Certified Mail, Return receipt requested, that they are in violation of either the Plat Restrictions or the Temporary Dwelling Permit, or both, and of the date by which remedial action must be taken. Personal Service of said notice may also be accomplished by the Sheriff Service or by a Process Server or by mail and publication when appropriate.

2. If remedial action is not taken within the time specified in said notice, the matter shall be referred to the legal counsel for Loch Lomond Beach Club, Inc. for such further action as is deemed appropriate.

3. If said Temporary Dwelling violates any local, state, or federal health laws, said authorities may be notified of said violations in addition to other action taken.

The Board of Directors desire to establish a procedure to enforce the Loch Lomond Beach Club, Inc. Covenants and Restrictions.

This Policy adopts such a procedure.

PROCEDURE

1. Upon discovery of any person or persons constructing any improvement to a lot located in "the Woods" subject to Loch Lomond Beach Club, Inc. Building Covenants and Restrictions shall be notified in writing of the need for compliance with the Loch Lomond Beach Club, Inc. Policies, the same procedure shall be used for improvements actually completed which are not in compliance.

2. Said notice shall be served upon the owner or owners of said lot and may be served upon any agent of said owner or upon any lender or contractor.

3. Such notice shall be served either by personal service or by certified mail return receipt requested and the same may be served by mail and publication where appropriate.

4. Said notice shall inform the recipient of the need for compliance and that further action will be taken if necessary to enforce the building restrictions.

5. If said notice is not complied with, the matter shall be referred to legal counsel for Loch Lomond Beach Club, Inc. for such further action as is deemed appropriate.

6. Loch Lomond Beach Club, Inc. may also notify any local, state, or federal municipality or agency of such noncompliance in addition to other actions taken.

1. The term "member" means the person in whose name a membership card is issued. Each owner of a lot is entitled to receive a membership card issued in such person's name upon payment of the yearly maintenance assessment. In cases of multiple lot ownership a membership card will be issued to each owner as indicated on the deed.

2. Except for the purchase of goods or gasoline, no member or guest shall be permitted to use any of the club facilities without first registering each day at the Clubhouse.

3. No person may register as a guest unless a member registers them or unless a member authorizes such guest registration in writing for delivery to the club manager in advance or at the time of guest registration. Guest registration authorization forms are available at the beach club desk. Any other form of authorization must include the name of each guest, the member responsible for the guest, the specific length of stay, the member's signature and the membership card number (LBD=Lot/Block/Division). This authorization is not to exceed a two week period.

4. The aggregate number of guests registered at any time per membership may not exceed ten unless prior arrangements are made and may include the payment of special fees approved by the manager. The manager may request board approval at his discretion. A fee may be charged.

5. Members are prohibited from resale or other commercial use of their membership.

POLICY:The Loch Lomond Beach Club provides limited secure storage areas known as the vehicle storage areas. These areas are to be used for short term storage only. The areas are to be kept as orderly as possible.

PROCEDURE:

1. The storage areas are provided only for members in good standing.

2. All items stored must display a storage area number. The numbers are available from the club management. The storage area sticker with the LLBC number must be on the tongue or other very accessible spot. Replacement stickers for those showing wear can be obtained from the club management. An inventory of all items in the storage areas will be on file at the Beach Club.

3. All items in storage must be on a trailer or have wheels and be movable for storage area maintenance. Items in storage may not be locked to the fence or stored in a manner to make their movement difficult for management.

4. Items may be stored for up to 8 months after which they must be removed from storage for at least 3 months. Any items stored past 8 months may be subject to a storage fee. Storage fees are set by the Board of Directors. Items deemed to be abandoned may be disposed of.

5. Management will inventory the storage areas periodically to determine which items are subject to storage fees.

6. Members will be required to sign a release form before items will be stored in the storage areas.

7. Items will be arranged to best utilize the space available.

All purchases must be made in accordance with the Conflict of Interest Policy.

PROCEDURE:

For Purchases Under $2000Purchases under $2000 may be made at the Manager’s discretion provided the purchase does not cause any budget category to exceed the current annual budget. In an emergency situation where either the continuing operation of the club’s services or the member’s safety is involved, the Manager may exceed this amount but must inform the Board as soon as possible.

For Purchases Between $2000 and $10,000The Board must pre-approve purchases between $2000 and $10,000. Approval can be obtained at a Board meeting or by email. A majority is required for a Board meeting approval. For email approval, no fewer than four Board members must approve.

For Purchases Over $10,000For purchases over $10,000, the following conditions must be met:1. A written and comprehensive Request for Proposal (RFP) must be approved by the

Board.2. The RFP must be submitted to multiple vendors with the goal of obtaining a

minimum of three separate bids. The Board must approve the list of vendors under consideration.

3. The RFP will be distributed to the vendors as simultaneously as possible, and each vendor will be given the same amount of time to reply.

4. No vendor will be favored in any way nor will be given information not available to all vendors.

5. The written response to the RFP will be the only information the Board will use to evaluate the vendor’s proposed work product. No other “side commitments” or
