The actions of the administration in consulting with the MinnesotaDepartmentofEducation,causingaproposaltobepreparedforsubmissiononbehalfoftheboardtotheCommissionerofEducationfortheCommissioner'sReviewandCommentandtakingsuchotheractionsasnecessarytocomplywiththeprovisionsofMinnesotaStatutes,Section123B.71,asamended,areherebyratifiedandapprovedinallrespects.Theactualholding of the special election on School District Question 1 specified herein shall becontingentuponthereceiptofapositiveReviewandCommentfromtheCommissionerofEducationontheprojectsincludedinthatquestion.

    TheclerkisherebyauthorizedanddirectedtocausetheCommissioner'sReviewandCommenttobepublishedinthelegalnewspaperoftheschooldistrictatleasttwenty(20)butnotmore than sixty (60)daysprior to thedateof the specialelectionasspecified inparagraph3ofthisresolution.

    3. Theballotquestion shallbe submitted to thequalifiedvotersof the schooldistrictataspecialelection,whichisherebycalledanddirectedtobeheldonTuesday,May12,2015,betweenthehoursof7:00o'clocka.m.and8:00o'clockp.m.

    4. Pursuant to Minnesota Statutes, Section 205A.11, the school districtcombined polling places and the precincts served by those polling places, as previouslyestablishedanddesignatedbyschoolboardresolutionforschooldistrictelectionsnotheldonthedayofastatewideelection,areherebydesignatedforthisspecialelection.

    Theclerk isherebyauthorizedanddirected toprepareanotice toanyvoterswhowillbevotingatacombinedpollingplaceforthisspecialelection.Thenoticemustbesentbynonforwardablemailtoeveryaffectedhouseholdintheschooldistrictwithatleastoneregisteredvoter. Thenoticemustbemailedno later than fourteen (14)daysbefore thedate of the election. A notice that is returned as undeliverable must be forwardedimmediately to the appropriate county auditor. The notice must include the followinginformation: thedateof theelection, thehoursofvotingand the locationof thevoter'spollingplace. Thisnoticemaybe inthesameformasthenoticeofspecialelectiontobepublishedandposted.

    5. The clerk isherebyauthorizedanddirected to causewrittennoticeof saidspecialelectiontobegiventothecountyauditorofeachcountyinwhichtheschooldistrictislocated,inwholeorinpart,andtotheCommissionerofEducation,atleastseventyfour(74)dayspriortothedateofsaidelection.Thenoticeshallspecifythedateofsaidspecialelectionandthetitleand languageforeachballotquestiontobevotedonatsaidspecialelection.

    Theclerkisherebyauthorizedanddirectedtocausenoticeofsaidspecialelectiontobepostedattheadministrativeofficesoftheschooldistrictatleastten(10)daysbeforethedateofsaidspecialelection.

  • Theclerkisherebyauthorizedanddirectedtocauseasampleballottobepostedattheadministrativeofficesoftheschooldistrictatleastfour(4)daysbeforethedateofsaidspecial election and to cause two sample ballots to be posted in each combined pollingplaceonelectionday. Thesampleballotsshallnotbeprintedonthesamecolorpaperastheofficialballot.

    Theclerkisherebyauthorizedanddirectedtocausenoticeofsaidspecialelectiontobepublishedintheofficialnewspaperoftheschooldistrict,fortwo(2)consecutiveweekswiththelastpublicationbeingatleastone(1)weekbeforethedateofsaidelection.

    The notice of election so posted and published shall state the question to besubmitted to the voters as set forth in the form of ballot below, and shall includeinformationconcerningeachestablishedprecinctandpollingplace.

    Shall the school board of Independent School District No. 834(Stillwater Area Public Schools) be authorized to issue its generalobligation school building bonds in an amount not to exceed$97,500,000 toprovide funds for the acquisition andbettermentofschoolsitesandfacilities,includingtheconstructionandequippingofa classroom addition and various other improvements to theStillwaterHigh School site and facility to allow that facility to servegrades9to12andtheconstructionofanactivitycenteratthatsite;theacquisitionof land forand theconstructionandequippingofanelementary school facility and a transportation terminal; theconstructionofupgradesandimprovementstothePonyStadiumandvarious other athletic sites and facilities; and the acquisition andinstallation of HVAC systems and various other improvements toexistingelementaryschoolsitesandfacilities?BYVOTING"YES"ONTHISBALLOTQUESTION,YOUAREVOTINGFORAPROPERTYTAXINCREASE.

  • Opticalscanballotsmustbeprintedinblackinkonwhitematerial,exceptthatmarkstobereadbytheautomatictabulatingequipmentmaybeprintedinanothercolorink.Thenameoftheprecinctandmachinereadable identificationmustbeprintedoneachballot.Votinginstructionsmustbeprintedatthetopoftheballotoneachsidethatincludesballotinformation.Theinstructionsmustincludeanillustrationofthepropermarktobeusedtoindicateavote.Linesforinitialsofatleasttwoelectionjudgesmustbeprintedononesideoftheballotsothatthejudgesinitialsarevisiblewhentheballotsareenclosedinasecrecysleeve.

    8. If the school districtwill be contracting to print the ballots for this special

    election,theclerk isherebyauthorizedanddirectedtoprepare instructionstotheprinterforlayoutoftheballot.Beforeacontractinexcessof$1,000isawardedforprintingballots,the printer, at the request of the election official, shall furnish, in accordance withMinnesota Statutes,Section204D.04,a sufficientbond, letterof creditor certified checkacceptable to the clerk in an amount not less than $1,000 conditioned on printing theballots inconformitywiththeMinnesotaelection lawandthe instructionsdelivered. Theclerkshallsettheamountofthebond,letterofcredit,orcertifiedcheckinanamountequaltothevalueofthepurchase.

    9. The clerk is hereby authorized and directed to provide for testing of the

    opticalscanvotingsystemwithin fourteen (14)daysprior totheelectiondate. Theclerkshall causenoticeof the time andplaceof the test tobe given at least two (2)days inadvance of publication once in the official newspaper and by causing the notice to bepostedintheofficeoftheCountyAuditor,theadministrativeofficesoftheschooldistrict,andtheofficeofanyotherlocalelectionofficialconductingthetest.

    10. Theclerkisherebyauthorizedanddirectedtocausenoticeofthelocationofthecountingcenterortheplaceswheretheballotswillbecountedtobepublishedintheofficialnewspaperatleastonceduringtheweekprecedingtheweekoftheelectionandinthenewspaperofwidestcirculationonceon thedaypreceding theelection,oronce theweekprecedingtheelectionifthenewspaperisaweekly. 11. As required by Minnesota Statutes, Section 203B.121, the Board herebyestablishesaballotboard toprocess,acceptand rejectabsenteeballotsatschooldistrictelectionsnotheldinconjunctionwiththestateprimaryorstategeneralelectionorthatareconductedbyamunicipalityonbehalfoftheschooldistrictandgenerallytocarryoutthedutiesofaballotboardasprovidedbySection203B.121andotherapplicable laws. Theballotboardmustconsistofasufficientnumberofelectionjudgestrainedinthehandlingofabsentee ballots. The ballot boardmay include deputy county auditors and deputy cityclerkswhohavereceivedtraining intheprocessingandcountingofabsenteeballots. Theclerkortheclerk'sdesignee isherebyauthorizedanddirectedtoappointthemembersoftheballotboard. Theclerkor theclerk'sdesigneeshallestablish,maintainandupdatearosterofmembersappointedtoandcurrentlyservingontheballotboardandshallreporttotheBoardfromtimetotimeasto itsstatus. Eachmemberoftheballotboardshallbepaidreasonablecompensationforservicesrenderedduringanelectionatthesamerateas

  • otherelection judges;provided,however, ifastaffmember isalreadybeingcompensatedfor regular duties, additional compensation shall not be paid for ballot board dutiesperformedduringthatstaffmember'sdutyday.

    12. The clerk is hereby authorized and directed to begin assembling names oftrainedelectionjudgestoserveatthepollingplacesandcombinedpollingplacesduringthespecialelection. Theelection judgesshallactasclerksofelection,count theballotscastand submit the results to the schoolboard forcanvass in themannerprovided forotherschooldistrictelections. Theelectionmustbecanvassedbetweenthethirdandthetenthdayfollowingtheelection.
