Special Presentation: Laraine Pope presented information on ICRMP training. This training needs to be completed by the end of December, Bingham County needs 80% of the employees to complete this training to get the discount. The safety check payment is only for those who have completed all the training. She presented a PowerPoint to supervisors showing them how they can check to see if their employees have completed the training. Pam Eckhardt asked for clarification on what to do if an employee is in an accident in a county vehicle. Dave Lane explained that an officer needs to be called and they will make the determination on how to address the disabled vehicle. If the vehicle needs to be towed, please have it towed to the Bingham County Road and Bridge shop. Cleve Colson explained that if a tow truck is called to the scene the employee may need to pay at that time and submit that amount for reimbursement. Employee Recognition: Commissioner Manwaring announced that Amy Richards, Pretrial Coordinator has worked for Bingham County for five years. She was unable to attend, she will be presented with a mug and pin for her years of service. Commissioners: Chairman Carter wishes everyone a Merry Christmas. Commissioner Manwaring reminded everyone to be careful when walking outside, it is slick this time of year. Commissioner Bair asked for input on office staff vacuuming their own areas. Eric Jackson explained that he has had complaints about cleaning of the courthouse. He asked that if anyone has any other suggestions he would welcome them. She handed out a flier on Christmas at the Museum, it will be December 10-14th form 4:00 p.m. to 7:00 p.m. and December 15th from 10:00 a.m. to 4:00 p.m. There will be entertainment each week night and on Saturday. Santa and Mrs. Clause and their elves will be there on Saturday from 2:30 p.m. to 4:00 p.m. The county owns the museum but the Historical Society operates it. She encourages everyone to participate, there is no charge. She reminded everyone that the book, Reasons to Remember a book about Idaho Vietnam Veterans was donated by the author, Marilyn Whyte, to help raise funds for the Patriot Field Statue. Currently $110,000 has been raised for this purpose Commissioner Bair added that the monetary goal for the statute has almost been met. He asks everyone to spread the information, it is a tax deductible donation. These books would make a great Christmas present. Chase Hendricks presented information about legal notices that the county receives. He asks that whenever a notice is received – these could be in the form of a foreclosure, a claim, a complaint, bankruptcy or any other a legal action - it needs to be forwarded to the Clerk’s Office. By statute, the County Clerk if responsible for receiving and addressing these documents. Ms. Eckhardt announced that the swearing-in of Elected Officials will be held on January 14, 2019 at noon in Courtroom #1. She invites everyone to attend. Payroll: Lynette George explained that Patty Walters’ father passed away and she will be gone all week. She asked that employees make sure that their addresses are correct for W2 information. Changes will be made to payroll in January 2019. These changes include having all status change sheets for employees to Human Resources the Friday before 20th of the month, if they are not submitted by that date they will not be processed during that month. All new hires need to be hired prior to the 20th of the month if at all possible and if an employee is terminating after the 20th of the month please coordinate with payroll. The final date to turn in timesheets will now be is six days prior to payday. This will allow payroll to be processed on time. Patty will hand out a payroll cut-off calendar mid-December. Public Works: Dusty Whited explained that they are working on winter road maintenance. He requested that if there are bad areas in the county they would appreciate being made aware of these. Parks and Recreation/Emergency Management: Scott Reese thanked Building Maintenance for the updates to the Emergency Operation Center and the offices. Courts: Sheri Landon congratulated Cleve Colson on his appointment as the new Magistrate Judge in Bingham County. She also thanked Building Maintenance for their help in the Courtrooms. Building Maintenance: Eric Jackson asked that they be notified if there is anything that is being missed. Planning and Zoning: Allen Jensen thanked the Commissioners for passing the Comprehensive Plan. Drug Court: Cody Lewis announced that December 18th and 20th will be the dates of the Drug Court Graduations. They will have six people graduating this month. He thanked Building Maintenance for being so good to work with.

Prosecutor’s Office: Cleve Colson is fortunate to have been selected to fill the Magistrate position in Bingham County. He has really appreciated working with everyone and looks forward to working with everyone in a different capacity. He provided his thoughts on how to address payroll issues, he suggests moving payroll to a two week off-set which would fix many of the problems. Mr. Whited added that Road and Bridge would like to see this happen. Chairman Carter explained they tried to do this in the past and were told that this would be too much work for payroll. Mr. Colson added that if this is done, the first payday would have a two week lag time which may be difficult for the existing employees. Extension Office: Julie Buck announced that there will be an Idaho pesticide training on December 5th. There will also be economic outlook seminars offered. The Master Gardener program will begin in January. Open enrollment for 4H is happening now and there will be 4H volunteer training in January. Ms. Buck added that both she and Mr. Findlay have received funding from the University of Idaho for research. Information Technology: Tracy Reifschneider explained that the IT policy in the Employee Handbook has been updated. She provided a handout of the changes. Offices will be responsible for purchasing any equipment outside of what is issued by the IT Department, as described in section 31-10-2. Bingham County is currently budgeting $35,000 just on toner, she is hoping this change will help cut costs. Ms. Reifschneider clarified that all equipment will still need to be ordered through the IT Department but the department will be responsible for paying for extra equipment. This will allow the IT Department to make sure that it is compatible with other county equipment and programs. This will also help make sure that good decisions are being made about what is being purchased. Kristi Bell added that equipment needs to be standardized, if the equipment is not purchased through their department it may not work with county systems. Elections: Danette Miller thanked everyone for their support, it has been a busy election year. She wished everyone a Merry Christmas.

PROBATION SERVICES

The Commissioners met with Shawn Hill, Probation Services Director to discuss a request to increase the amount of hours the Drug Testing Lab Technician works from 35 hours to 40 hours a week. Mr. Hill has the money in his budget to cover the increased costs. The Commissioners approve this request, it will become effective on January 1, 2019.

PRIOR APPROVAL FOR PURCHASE

The Commissioners met with Tracy Reifschneider, Information Technology Director regarding the purchase of 10 PCs in the amount of $8,085.60 to be paid for out of fund 01-14-804-00. These are to replace outdated office machines throughout the county. The Commissioners approve this expenditure.

DRUG COURT

The Commissioners met with Cody Lewis, Drug Court Coordinator to discuss the following: Drug Court Graduations and the priority of payments in the Odyssey Court Management System.

TEMPORARY CHAIRMAN

In the absence of Chairman A. Ladd Carter on this afternoon, Commissioner Bair moved to appoint Commissioner Manwaring as temporary chairman. Commissioner Manwaring seconded the motion. Both were in favor.

COLLEGE OF SOUTHERN IDAHO-POST HIGH SCHOOL ENROLLMENT

A Certificate of Residency/Affidavit for Post High School Enrollment was approved and sent to the College of Southern Idaho for the following Bingham County student: Maggie M Sheetz.

TAX MATTER

The Commissioners met regarding RP0284303 and RP0252308, the following were approved: RP0284303 Bingham County, 2018 cancellation of tax in the amount of $31.50, the American Falls Reservoir District assessment was attached to the tax notice for this property and was also billed separately. This amount has already been paid by invoice. RP0252308 Dallin and Rachel Dawn Worthington, 2018 tax cancelation of $1,180.87 and value adjustment from $96,529 to $6,000 due to Assessor’s Office error. The home and outbuilding were put on two parcels in error.

CREDIT APPLICATION - SOLID WASTE

A Credit Application for the Solid Waste Department submitted by Quick Floor Covering, Idaho Falls, Idaho was approved and signed by Temporary Chairman Manwaring on this date.

The Commissioners met regarding a request to park a Veteran’s Administration van that serves Bingham County in the county parking lot when it is not being used to transport veterans. The Commissioners approve this request.

TAX MATTER

The Commissioners met regarding RP0100400, RP0201800 and RP8269080, the following were approved: RP0100400 Richard S Brower, 2018 cancellation of tax in the amount of $497.51 and value adjustment from $113,515 to $79,240 due to Assessor’s Office error, the Homeowners Exemption was removed from the parcel. RP0201800 Charles E McBurney, 2018 tax cancelation of $1,398.54 due to Assessor’s Office error, the Homeowners Exemption was removed from the parcel.

RP8269080 Randy and Shelley Savage, 2018 tax cancelation of $398.72 and value adjustment from $33,980 to $0 due to Assessor’s Office error, improvements were not transferred to this parcel. The taxes on the Primary Role are being cancelled the amount is being addressed on the Sub-Roll.

PLANNING AND ZONING – LOT-LINE ADJUSTMENT ISSUE

The Commissioners met with Allen Jensen, Planning and Zoning Administrator; Chase Hendricks, Civil Deputy Prosecutor and Carrie Hasselbring, Realtor regarding an issue with the buildability of property owned by Jerry and Connie Brower. Ms. Hasselbring explained the issue with a property, she is trying to sell this property for her client. The property was divided into 5 acre lots prior to 1999 to allow the lots to be buildable. When the lots were divided there was no access provided to lots not adjacent to a county road. In 2008 the Planning and Zoning Administrator provided her clients with a letter allowing them to do a lot-line adjustment on the property and these lots were re-recorded to add 50 foot easements to access interior lots. She is here today to ask the Commissioners to uphold the 2008 approval, which was approved by a county employee, even though it does not fit the stipulations of the current Bingham County Planning and Zoning Ordinance. She added that her clients have already spent close to $50,000 on this property trying to make the lots buildable, it is not fair to make them do more work when Planning and Zoning has been issuing building permits based on the 2008 lot-line adjustment.

Allen Jensen, Planning and Zoning Administrator explained that when this lot-line adjustment was done, the lots were no longer grandfathered as they were changed from their pre 1999 state. These lots are now required to follow the stipulations in the Bingham County Planning and Zoning Ordinance. As they are now, they are not considered buildable lots. In doing research on this issue, it was discovered that this issue was addressed with Ms. Hasselbring and her clients in 2009 during a Commission Meeting. At this time, they were informed by legal counsel that the Planning and Zoning Administrator did not have the authority to give approval to go against a county ordinance therefore it was not a legal decision. Chase Hendricks, Civil Deputy Prosecutor added that the Bingham County Planning and Zoning Ordinance governs the issue and is binding. Ms. Hasselbring’s clients were made aware of this in 2009 and should have addressed the issue at that time. Nothing has been done since that meeting to fix the issue. Mr. Jensen presented two options the lots can be put back to their pre 1999 state where they are considered buildable lots but have limited access or the better option is to follow the ordinance and subdivide this parcel.

Mr. Hendricks recommend that the Commissioners direct Planning and Zoning to follow the ordinance, now that everyone is aware of the issue it needs to be addressed. Chairman Carter added that this should have been taken care of in 2008, the Browers have been aware of the issue since then.

Ms. Hasselbring will encourage her clients to subdivide this property but the cost to do so may be an issue.

PRIOR APPROVAL FOR PURCHASE

The Commissioners met regarding the purchase of Security Cameras for the Probation Services Complex in the amount of $6,197.00. The cost will be shared between the Building Maintenance and Probation budgets. The Commissioners approve this expenditure.

TAX HARDSHIP APPLICATION

Laura Lora, Indigent and Veterans Services Supervisor met with the Commissioners to discuss an application for tax cancellation due to hardship for the following case: RP7039300 Angela T Flores. If the taxes are brought current the Commissioners agree to cancel all interest and penalty.

Laura Lora, Indigent and Veterans Services Supervisor met with the Commissioners to discuss applications for medical indigent services for the following cases: 2018-83, a 29-year-old married male with four dependents seeking assistance in the payment of medical bills relating to Appendectomy. Recommended to Approve; With Reimbursement, With Property Lien. 2018-87, a 46-year-old single male with no dependents seeking assistance in the payment of medical bills relating to Cervical Degenerate Disc Disease. Recommended to Approve; With Reimbursement, With Property Lien. The Commissioners unanimously voted to approve case numbers 2018-83 and 2018-87.

TAX HARDSHIP APPLICATION

Laura Lora, Indigent and Veterans Services Supervisor met with the Commissioners to discuss an application for tax cancellation due to hardship for the following case: RP1086500 Muffett Ann Hirning. After discussion the Commissioners do not feel as if sufficient evidence was provided to prove that there is a hardship. No action was taken.

PUBLIC WORKS

The Commissioners met with Dusty Whited, Public Works Director to discuss the following: Idaho Weed Conference and Idaho Weed Superintendents meeting, surplus of a Dodge pickup, crushing concrete at an Aberdeen site, the Bingham County Snowmobile Ordinance, an update on the Groveland Road Project and discussion on relocation of the Road and Bridge shop.

The highest bid was for $199,017 per acre from Chase Jones DBA Broadmouth Canyon Ranch LLC, 122 S Main Street, Firth Idaho. The buyer will have 90 days to make final payment.

PRIVATE EASEMENT VACATION PUBLIC HEARING - RUBY LANE SUBDIVISION

The Commissioners met with David Romrell, Bingham County Surveyor; Troy Lenhart, Road and Bridge Supervisor; Allen Jensen, Planning and Zoning Administrator; LeighAnn Davis, Assistant Planning and Zoning Administrator and Chase Hendricks, Civil Deputy Prosecutor to consider the vacation of shared access easements for driveways on Lots 1 and 2 and Lots 3 and 4 located on the final plat for the Ruby Lane Subdivision. Chase Hendricks, Civil Deputy Prosecutor explained that this hearing was called to address safety concerns the Bingham County Public Works Department has with the location of the driveways on the Ruby Lane Subdivision plat. He is suggesting that the Commissioners strike the driveways from the plat allowing home owners to determine placement of driveways with the approval of Public Works Department using Road and Bridge road standards. Troy Lenhart, Road and Bridge Supervisor explained that the shared driveways were originally requested by a neighbor and that is how they ended up being part of the plat. When a the property owner requested Public Works to assign an address for a new home, the site inspection showed that the platted location of the driveways are unsafe.

Mr. Hendricks stated that it appears the location of these driveways was approved and platted without actually looking at the location. Driveway locations should be part of the building permit process rather than being approved with the plat. Mr. Hendricks and the Public Works Director have talked to the developer/property owner to inform them of the situation and they have no objections to it. Commissioner Manwaring would like the county to help relocate any driveways that have been started to a safer location. Commissioner Manwaring made a motion to vacate shared access easements for driveways on Lots 1 and 2 and Lots 3 and 4 located on the final plat for the Ruby Lane Subdivision due to safety issues. Commissioner Bair seconded the motion, both were in favor.

BINGHAM MEMORIAL HOSPITAL – TERMINATION OF PRIMARY LEASE

The Commissioners met with Chase Hendricks, Civil Deputy Prosecutor regarding a Termination of Primary Lease between Idaho Health Facilities Authority and the U.S. Bank National Association for a 1999 Lease Agreement, recorded as Instrument No. 479355 and an Agreement recorded as Instrument No. 479356. Mr. Hendricks explained that this lease has been satisfied and this termination was agreed upon at a Commission Meeting held in August of 2018, this document should have been signed at that time. Mr. Hendricks is advising the Commissioners sign this document to allow the hospital to continue with other financial transactions that are being held up by this 1999 lease. The Termination of Primary Lease Agreement was signed by Temporary Chairman Bair on this date.

ROCKFORD AIRPORT

The Commissioners met with Earl Preston, Rockford Airport Lessee; Allen Jensen, Planning and Zoning Administrator; LeighAnn Davis, Assistant Planning and Zoning Administrator; Troy Lenhart, Road and Bridge Supervisor and Chase Hendricks, Civil Deputy Prosecutor to discuss renting water to irrigate the Rockford Airport and a the installation of a tower there. Also present were Doyle Hawker, Casey Hawker, Abner Sims, Daniel Figle and Brian Richardson, Interested Parties.

Mr. Preston explained that the Blackfoot Airport donated the historic light tower to him when it was removed from their airport. He erected this tower at the Rockford Airport after obtaining approval from the Federal Aviation Administration (FAA), the Bingham County Planning and Zoning Administrator and Parks and Recreation Director. It has come to his attention that there may have been a misunderstanding with this tower understands the Commissioners want to have it removed. Due to its historical nature and historical value, he would like to preserve it. If Bingham County does not want to have the tower at the Rockford Airport, he had approached the City of Blackfoot and Mayor Carroll who are willing to have the tower relocated to the greenbelt.

Commissioner Bair is upset that this tower was put up without the approval of the property owner – Bingham County. He added that this was also done without a building permit which is required. Mr. Preston explained that he spoke with Allen Jensen, Planning and Zoning Administrator about this and understood that if he had the tower engineered it could be put up. He was not told by Mr. Jensen that he would also be required to obtain a building permit. He added that he also met with the Commissioners to inform them of his plans and they did not object giving him the belief that they had no issues with this.

Mr. Preston paid for the costs associated with the tower and has no intentions of placing lights other than those required by the FAA. He did have the tower engineered as Mr. Jensen directed him to do and provided the Commissioners and Mr. Jensen the documents from the engineer.

Mr. Jensen explained the process to install a tower, including the requirement of obtaining a building permit.

Commissioner Manwaring believes this is a misunderstanding and explained that all that matters now is that things are done safely and correctly.

Commissioner Bair expressed his concern with the process not being followed.

Chase Hendricks, Civil Deputy Prosecutor recommends that the Commissioners take this information under advisement until Planning and Zoning can review the plans and issue a permit.

The Commissioners would like Mr. Preston to go through the process of obtaining a building permit for the tower and as long as it meets all the requirements and is safe, they have no objections to allowing the tower to remain where it is at the Rockford Airport.

Mr. Preston would also like to discuss renting water for irrigattion of the airport. He is expecting the cost to be around $20 per acre foot with a total cost of $350 per year. He is willing to pay for the costs of the water and will do the irrigation himself using tripod sprinklers.

The Commissioners would like to address the tower issue first before making any decisions on the request to rent irrigation water.

Additionally, Mr. Preston wanted to inform the Commissioners that the Blackfoot Airport will be closed the majority of the summer causing increased traffic at the Rockford Airport. The condition of the runway was discussed and it was decided that Mr. Preston will work with Mr. Reese to find grant opportunities available for the resurfacing of the runway. Public Works will assess the runway and let the Commissioners know what they believe the best option will be along with the costs associated with it before making any decisions on the issue.

MEMORANDUM OF UNDERSTANDING

The Commissioners met with Chase Hendricks, Civil Deputy Prosecutor; Sheriff Craig Rowland and Police Chief Kurt Asmus, City of Blackfoot regarding a Memorandum of Understanding between the Bingham County Sheriff’s Office and the City of Blackfoot Police Department regarding mutual assistant areas in the county. Also present were Jeff Gardner, Chief Deputy Sheriff and Scott Gay, City of Blackfoot Police Department. A Memorandum of Understanding between The City of Blackfoot and Bingham County was signed by the Commissioners on this date.

COLLEGE OF EASTERN IDAHO-POST HIGH SCHOOL ENROLLMENT

A Certificate of Residency/Affidavit for Post High School Enrollment was approved and sent to the College of Eastern Idaho for the following Bingham County student: Michelle R Allen.

PLANNING AND ZONING

The Commissioners met with Allen Jensen, Planning and Zoning Administrator regarding a request to waive fees for the installation of a furnace at 429 W. Highway 39 #33. This is a donation to the family for Christmas. The Commissioners approve waiving the $25 fee for this permit due to it being a donation to a family in need.

HUMAN RESOURCES

The Commissioners met with David Lane, Human Resource Director; Pam Eckhardt, County Clerk and Chase Hendricks, Civil Deputy Prosecutor to discuss open recruitments, changes to the Bingham County Employee Handbook and ADA issues at the Bingham County Historical Museum. Mr. Lane recommends Section 32 of the Bingham County Employee Handbook be changed as follows: 32.7 Vehicle Accidents

In the event of an accident, the driver shall, when possible, first check on the safety and welfare of all persons involved and seek immediate medical attention should it be required for themselves or others. The driver may move the vehicle to a safe location out of the way of traffic, if it is possible to do so in a safe manner.

32.7.1 The employee driver shall attempt to have a law enforcement agency investigate any accident that involves a County vehicle. This will help ensure that the County is protected from unwarranted claims. The employee shall not discuss fault with, or sign anything from, anyone except for a law enforcement officer, a representative of ICRMP, or an authorized representative of Bingham County.

32.7.2 In the event a tow truck is required, the employee shall coordinate with the local law enforcement agency on-scene when calling for a tow truck as they typically have tow trucks available on-call through a rotation system. However, if for any reason law enforcement personnel are not available to assist with the accident, and a tow truck is still needed, employees will contact the County Dispatch Center at (208)782-1234 for assistance. Once a tow truck is on scene, employees shall direct the driver to tow the County vehicle to the County’s Public Works Road & Bridge yard.

32.8 The employee shall notify his/her supervisor as soon as possible of the accident and report the extent of the injuries and property damage involved see also Section 5.2). The employee and supervisor must ensure that a post-accident drug screen is conducted, as soon as possible, to meet the requirements of Section 30,the Drug-Free Workplace policy.

32.9 The employee involved in the accident shall cooperate fully with ICRMP in the handling of the claim.

After discussion, the Commissioners approve the proposed changes to the Bingham County Employee Handbook.

The Commissioners met with Tim Solomon, Regional Business Manager for Rocky Mountain Power for an update on Rocky Mountain Power operations in Bingham County. Mr. Solomon gave an update on the replacement of the transition line through Bingham County and other general issues of the company.

AMENDMENT TO ELECTRONIC MONITOR – OMNILINK CONTRACT

The Commissioners met with Mary Reyes, Adult Probation Supervisor regarding an amendment to the original contract to include two “on the shelf” devices without being charged. Amendment No. 1 to Master Services Agreement – Offender Monitoring was approved and signed by Chairman Carter on this date.

BUILDING MAINTENANCE

The Commissioners met with Eric Jackson, Building Maintenance Supervisor to discuss the addition of a dividing curtain in the upstairs breakroom, remodel of the jail visiting office/pre-trial services area and the janitorial contract for the county. Mr. Jackson presented a bid in the amount of $3,389 for the installation of a dividing curtain in the upstairs breakroom and explained that there is possibly money in the Emergency Management budget to help cover the costs as the break room doubles as a command center during an emergency. The Commissioners added that there may also be some money in the 911 fund to help cover the costs with the breakroom also being a backup facility for dispatch if needed. Mr. Jackson will obtain more bids and look for other options before a final decision is made. The costs of the remodel of the jail visiting office/pre-trial services area will be covered by the Sheriff’s Office. Varsity Cleaners, the company providing janitorial services to the county, has agreed to reduce the price of services by approximately $750 per month if they are no longer responsible for vacuuming the individual offices in the county. The Commissioners directed Mr. Jackson to purchase vacuums for courthouse use, each office will now be responsible for vacuuming their own offices.
