assist you with that process. Buying or leasing a building or premises and getting a business licence are just two of the

many steps to complete. This handout includes details of the important things you need to consider and review when you

are starting a business in Sparwood, prior to entering into a lease or purchasing expensive equipment.

SIGNAGE

Confirm what type of sign(s) you can install and the type of sign permits required.

Before designing, purchasing or installing any signs, check with the Planning Department

to ensure that they will be permitted. There are limitations on the size and types of signs

you can install. A sign permit is required for any sign placed on a property or installed on

a building exterior. You will also be required to remove any previously installed signs that

do not meet the District’s Sign Bylaw requirements or obtain additional sign permit(s) for

signs which do meet the Bylaw requirements but were installed without a sign permit.

UTILITIES

Confirm whether a separate utility account is required.

Contact the Finance Department to set up your utilities account. If you want to know what the utility rates are

before you sign up, check the current rate schedule in our Utility and Solid Waste Management Bylaw.

OTHER AGENCIES

Confirm whether your business requires approvals from provincial agencies.

Depending on the type of business you are operating in Sparwood, you may require other permits or licences that

are not regulated by the District of Sparwood. Examples include liquor licences and health licences. It is important

to be aware of these requirements as they are in place to protect the safety and health of you, your customers and

the general public. Research what other approvals, permits or certificates you may require from other agencies,

including but not limited to the following.

You may need an operating permit from the Safety Authority if you are operating high voltage electrical equipment, hot water boilers, steam boilers, pressure vessels, or air conditioning and refrigeration systems, or if you are dispensing propane, natural gas or hydrogen.

FREQUENTLY ASKED QUESTIONS

What is a Zone?

All land within the District of Sparwood is assigned a zone under the District’s Zoning Bylaw. The zone on a property determines what uses are allowed, the dimensional requirements for lots, the height of buildings and how far they can be setback from a property boundary. The zone also determines the maximum density of buildings on a property and is typically measured as a Floor Area Ratio (FAR) and the maximum amount of constructed floor area (building space) in relation to the lot size.

The zoning on individual properties is identified on the District’s Zoning Bylaw maps (www.sparwood.ca/maps).

When is a Development Permit (DP) required?

A DP is required for all exterior renovations to a building or structure within a Development Permit Area.

Contact the Planning Department for more information regarding the requirements for a Development Permit.

When is a Building Permit required?

Building permits are required for new construction, temporary buildings and for alterations to existing construction. You should always review your building requirements with the District’s Building Official before starting a project.

When is a Sign Permit required?

Anyone intending to place a sign on the exterior of any building or structure, or on any property in the District, must apply for a sign permit with the Planning Department. The sign permit application will be reviewed for compliance with the District’s Sign Bylaw. If the proposed sign meets the Bylaw requirements, a Sign Permit will be issued to allow for installation of the proposed sign.

This requirement applies to both permanent and temporary signs (e.g. sandwich board or portable sign).

What is required for Outdoor Displays/Seating Area?

You will need to confirm with the Planning Department if your proposed business-use allows for outdoor displays or seating. If it does, there may also be limitations on the size and location - you need to confirm these limitations.

Any permitted display and seating that is located on a public right-of-way, such as a sidewalk, will require a Sidewalk Use Permit or Licence of Occupation. Contact the Planning Department for more information on the permit requirements.

Do I need to provide Off-Street Parking for clients?

Yes, the Off-Street Parking and Loading Bylaw regulates, by use, the number of parking spaces you are required to provide for your clients/customers on your property, including home occupation businesses.

When would I require additional business licences?

Businesses that carry on in more than one location (same owner) must obtain a separate licence for each location. If you are operating in Fernie, Elkford and Sparwood, you may qualify for an Inter-Community Business Licence.

BUSINESS LICENCES The District of Sparwood requires every person carrying on, maintaining, owning or operating within the District any profession, business, trade or occupation, to hold a valid business licence, including all sub-trades. The Business Licence must be visibly displayed on the premises. Licence holders operating a mobile business must carry the licence on his or her person while working in Sparwood.

The standard licence fee is $100.00 for a term of one calendar year. The fee for itinerant or seasonal businesses varies dependent on the term of the licence. An individual may apply for a multi-business licence to operate more than one business at the location.

BUSINESS LICENSING

What is a business licence?

A business licence is a government-issued permit that allows you to do business in a community. All individuals or businesses who sell or operate in the District of Sparwood require a business licence, regardless of what type of location that business operates from.

What does a business licence offer you?

Connections to financing, grants, economic incentives, local suppliers and staffing resources;

Timely notices and information about bid opportunities and emergencies;

Proof of your legitimacy to customers;

Promotion through Sparwood’s online business directory; and

Access to ever improving research and data (trade area, market, demographics, existing business, etc.)

Types of business licences

There are six types of business licences:

(1) If your business will be operating within a commercial or industrial area of Sparwood, you need a Basic Municipal Business Licence ($100). If your business has its main office outside the municipal boundary, but still serves customers within the District of Sparwood, you need a basic municipal business licence.

(2) If your business will be operating out of your home or another residential area, you need a Home Occupation Business Licence ($25 for Catalogue or Direct Sales and $100 for all other home occupations).

(3) If your business only operates seasonally, you need an Itinerant/Transient Business Licence (which can be issued for one day ($10), one month ($20), three months ($30), six months ($50) or a year ($100)).

(4) If your business relates to the coordination of major festivals or other special events, you will need a carnival, circus entertainment business licence per event ($100).

(5) If you are operating multiple businesses from the same location, you need a Multi-Business Licence ($100).

(6) If your business operates in Fernie and Elkford, in addition to Sparwood, you need an Inter-Community Business Licence ($100), which is a separate licence that can be obtained in addition to a basic municipal business licence. If you are not sure which licence is best for you, contact the Planning Department.

What is the difference between a “Home Occupation” and a home-based business?

A “Home Occupation” is a business that is conducted completely within the business owner’s home and which does not employ individuals who reside outside of that home (e.g. bed-and-breakfast, daycare, hairdresser, artist). Whereas a home-based business is typically a service business that uses space within their home as their office and may employ individuals outside of the home. The rule of thumb would be if the client is coming to the business it is a home occupation, if the business is going to the client, it is a home-based business.

How long does it take to process a licence?

The time required to process a business licence will vary depending on the application and the time of the year. A new application without a location might take as little as 1-2 business days, while a new application with a location could take up to three weeks.

Renewals are processed more quickly. If you come into the District Office with your payment ready you will receive your renewal immediately. However, if you mail your payment and renewal it might take 1-2 weeks before you receive your new licence.

Expiry

The majority of business licences expire on December 31st (seasonal licences are the exception). Renewal notices are mailed out prior to the expiration date.

ECONOMIC INCENTIVES

Economic Incentives

The entire community benefits when entrepreneurs invest in Sparwood by opening or renovating a business. To help make investing easier, we offer incentives that can reduce your building permit costs.

Through the District of Sparwood Energy Efficiency Incentive Program, builders are encouraged to participate in Sparwood’s Energy Efficiency Incentive Program. For homes that achieve EnerGuide 80 or better, Sparwood will rebate 50% of the building permit fees and 100% of the energy audit fees. That incentive, combined with the incentives from BC Hydro could add up to significant savings for a typical new home.

FortisBC Energy Rebate Centre for Business

Upgrading to high efficiency technologies and taking advantage of business rebates is easier than ever with the Energy Rebate Centre - your one stop shop for energy savings.

In collaboration with BC Hydro Power Smart, FortisBC's New Home Program encourages you to build energy-efficient homes. And better yet, you can select the rebates best suited for your development.

FREE Energy Assessments for small and medium sized businesses

Small and medium sized businesses in Sparwood may be eligible to receive a free energy efficiency assessment through the Business Energy Advisor (BEA) program, an initiative funded by BC Hydro and FortisBC.

A BEA can identify ways that your business can take advantage of available BC Hydro and FortisBC incentives to implement energy efficiency solutions that will help you save money on your electricity and gas bill.

To be eligible, small and medium businesses should have a commercial BC Hydro account and should not have a BC Hydro Key Account Manager. It is recommended that businesses inquire to determine their eligibility so that they can receive a visit from the BEA when they pass through Sparwood. To do so, you can either:

Home based businesses are not eligible due to the requirement for a commercial BC Hydro account.

Elk Valley Economic Initiative

The Elk Valley Economic Initiative (EVEI) has members representing the City of Fernie, the District of Sparwood, the District of Elkford, the Tobacco Plains Indian Band as well as the communities’ Chambers of Commerce and industry. They are supported by representatives from the BC Ministry of Jobs, Tourism & Skills Training, Community Futures East Kootenay, Invest Kootenay, Columbia Basin Trust and other economic development organizations.

The purpose of the EVEI is to collaboratively pursue regional economic development projects and initiatives in the Elk Valley striving to expand opportunities for existing businesses, attract new ones and diversify the types of businesses. In addition, they aim to increase the number of permanent, full-time residents who spend their money locally thereby contributing to the region’s sustainability.

I/We understand that this Home Occupation shall NOT:

Involve any internal or external structural alterations to the residence or accessory building; Involve any outdoor storage of products, materials or equipment;

Involve retail sales of goods not produced on the premises, except as permitted under Section 10.9(11) of Zoning Bylaw 264; Generate any offensive noise, odour, vibrations, smoke, gases, heat nor other objectionable effect; Indicate the presence of a Home Occupation, other than a permitted sign under the District’s Sign Bylaw; and

Involve persons other than residents.

I/We the undersigned confirm that I/we do not require a space in a commercial building to carry on this business and wish to use my/our place of residence as my/our business address. I/We confirm that not more than 2 customers, utilizing on-site parking spaces, will be permitted on the premises at any time. Zoning Bylaw No. 264, Section 10.9 Home Occupations

Home occupations are permitted in the following zones: RR-1; RR-1a; RR-1b; R-1; R-1a, RR-MH, R-MH; R-MP; R-2; R-3; A-1; S-

RR, PROVIDED THAT:

1. a Home Occupation shall be conducted only from and completely enclosed within, the dwelling unit or an approved accessory

building;

2. a Home Occupation shall not involve internal or external structural alterations to the said dwelling unit or approved accessory

building;

3. a Home Occupation shall be carried out only by residents of the dwelling unit and not more than two (2) persons resident in the

dwelling unit shall be engaged in a home occupation on the premises;

4. a Home Occupation shall not involve any occupation that emits any offensive noise;

5. a Home Occupation shall not involve any external storage of materials, containers or finished products(s);

6. there shall be no external indication that the dwelling unit or accessory building is used for a purpose other than a residential use,

except for a sign as permitted in accordance with Sign Bylaw and amendments thereto;

7. the storage of vehicles or equipment associated with a home occupation shall not be permitted on the property from which a

Home Occupation is conducted;

8. a Home Occupation in the R-3 Zone shall not generate any pedestrian or vehicular traffic, with the exception of a property

manager who operates a business managing the property or portions thereof in the same complex as they reside is permitted to

have clients visit the dwelling unit provided those clients reside in the same complex or site as the property manager; and in all

other zones, the volume of pedestrian or vehicular traffic must be kept below that which would be offensive to the residential zone

in which the Home Occupation is located;

9. off street parking is provided in accordance with "Off Street Parking and Loading Bylaw No. 495, 1988", and amendments

thereto;

10. in the case of rental/lease property, all applications for Home Occupations shall be approved by the landowner(s) prior to

application being processed by District of Sparwood;

11. a Home Occupation in the R-3 Zone shall not involve retail sales of any goods, except by remote means using mail, telephone or

electronic device; and in all other zones, a Home Occupation shall not involve retail sales of goods not produced on the

premises, except for products incidental to the service provided or retail sales by remote means using mail, telephone or

electronic device;

12. a Home Occupation shall not involve repairs or painting of vehicles, trailers, boats, snowmobiles, all terrain vehicles or

motorbikes;

13. kennels shall not be permitted as a Home Occupation except in the A-1 Zone;

14. a Home Occupation shall not involve any occupation that presents a fire hazard by virtue of manufacturing process or material

storage;

15. a Home Occupation shall not involve any occupation that discharges or emits odorous or noxious matters, vapours, gasses,

smoke, dust, heat, glare, radiation, litter or recurrently generated vibrations;

16. a Home Occupation shall not involve any occupation that interferes with electronic equipment or which creates electrical

interference to neighbouring property;

17. a Home Occupation in a R-MP or R-3 Zone shall not be permitted to operate a Day Care Centre.

18. Bed and Breakfast use is permitted as a Home Occupation.

19. A Home Occupation in a RR-1a or RR-1b zone does not include any business that would permit the coming and going of

customers or clients to the home.
