• The vast majority of students with disabilities are accessing the
Mississippi College and Career Readiness Standards just like their
nondisabled peers. The student’s Individualized Education Program
(IEP) should identify the child’s strengths, needs, academic goals,
and accommodations necessary to support the student in attainment
of the MCCRS and corresponding coursework.
• All students with an IEP will be required to meet the graduation
requirements for the Traditional Diploma. They will have an
opportunity to earn endorsements above the MS Traditional Diploma
just as their non-disabled peers do. Additional endorsements
include: Academic, Career and Technical, and Distinguished
Academic.

SB 2432 - Mississippi Occupational Diploma for
students with disabilities and career track program;
repeal.
• Provides that the Mississippi Occupational Diploma for
students with disabilities shall not be available to any
student entering the ninth grade in the 2017-2018 school
year or thereafter.
• Amends code section to provide that the Career Track
Program for students not pursuing a Baccalaureate
degree shall not be available to any student entering the
ninth grade in the 2017-2018 school year or thereafter.
• This act shall take effect and be in force from and after
July 1, 2017.

• Process must be implemented that encourages and
allows students currently pursuing an MOD to change or
switch to the new MS Traditional Diploma.
• Students are allowed to stay enrolled up to age 20 to
continue working towards this goal.
• Students who enrolled in 9th grade prior to 2017-18
would be allowed to complete the MOD curriculum if
their IEP Committee continued to determine this was the
students least restrictive environment.

The OSE has reviewed information in
consideration of establishing a State-defined
Alternate Diploma that would be available to a
student with a Significant Cognitive Disability
(SCD). The Every Student Succeeds Act (ESSA)
allows the inclusion of students with disabilities
who are awarded a State-defined Alternate
Diploma to be included in the State’s adjusted
cohort graduation rate.

The State-defined Alternate Diploma must be:
1) Standards-based;
2) Aligned with the State requirements for the regular high
school diploma; and,
3) Obtained within the time period for which the State
ensures the availability of a free appropriate public

Data Reporting
• Parents must be involved in state and local report card
design.
• Report cards must include full accountability information.
• State and local report cards must include district- and
school-level per-pupil expenditure, calculated uniformly
statewide.
• States must improve transparency of postsecondary
enrollment data to provide greater insight into student
preparation for postsecondary education.

HB 567 - Compulsory-school-age child; revise definition of by increasing required age to
18 years.
• Revises the definition of a compulsory-school-age child by increasing the maximum age
required for compulsory attendance to include children who have not attained the age of 18
on or before September 1 of the calendar year
• This act shall take effect and be in force from and after July 1.
HB 263 - Anti-bullying Law; revise provisions for required establishment of policies for
by school districts
• Clarifies conduct that is considered bullying behavior
• Revises the provisions to be included in a school districts' anti-bullying policies
• Requires school districts to post the proper procedure for reporting bullying on their websites
• This act shall take effect and be in force from and after July 1, 2017.

SB 2461 - School district consolidation; require in Perry County.
• Provides that in the Perry County and Richton School districts there shall be an
administrative consolidation into one school district to be designated as the Perry County
School District effective July 1, 2019
SB 2463 – School district consolidation; require in Chickasaw County
• Provides that in the Chickasaw County and Houston Municipal Separate School District there
shall be an administrative consolidation into one school district to be designated as the
Chickasaw County School District effective July 1, 2019

SB 2273 - Cursive writing; direct State Board of Education to
require in elementary education curriculum.
• Requires the State Board of Education to ensure instruction in
cursive writing as a part of the basic Elementary Education
curriculum
• This act shall take effect and be in force from and after July 1.

HB 1413 - Suspension and expulsion; clarify terms of disciplinary
action resulting in and provide due process.
• Clarifies the difference between disciplinary actions imposed upon
students resulting in five or more days of suspension or expulsion
from school
• Provides the right to such students to a due process hearing at
which they may be represented by legal counsel, present evidence
and cross-examine school district witnesses
• Provides for the right of appeal to the local school board
• Stipulates that the burden of proof in all disciplinary proceedings
shall be substantial evidence
This act shall take effect and be in force from and after July 1,
2017.

DISTRICT/SCHOOL IMPROVEMENT & CONSERVATORSHIP
SB 2431 - Failing school districts; authorize the State Board of
Education to place into "District Transformation Status."
• Authorizes the State Board of Education to appoint an Interim
Superintendent as opposed to a Conservator for the administration
of schools in a school district in which the Governor has declared a
state of emergency for violations of accreditation standards
• Authorizes the State Board of Education to place a school district in
which the Governor has declared a second state of emergency for
violations of accreditation standards into "district transformation
status" until it has attained a "C" rating and may return to local
control
• Districts that are eligible to be absorbed by the Achievement School
District but are not shall develop and implement a district
improvement plan with prescriptive guidance from MDE
This act shall take effect and be in force from and after July 1.

DISTRICT/SCHOOL IMPROVEMENT & CONSERVATORSHIP
HB 875 - School accreditation and failing school districts; revise
process of state administration through process of district
transformation.
• Amends code sections relating to school and school district
accreditation, revises the designation of schools and school districts
under conservatorship as schools and school districts in district
transformation
• Renames the term conservator as interim superintendent
• Districts will have to maintain a “C” or better for five consecutive
years
• Districts not absorbed by the District of Transformation but are
eligible shall submit a district improvement plan to MDE for approval
• This act shall take effect and be in force from and after July 1.

DYSLEXIA
HB 1046 - MS Dyslexia Therapy Scholarship for Students with
Dyslexia; revise eligibility through Grade 12.
• Expands the eligibility for the Mississippi Dyslexia Therapy
Scholarship for students with dyslexia program to include students in
grade 1 through grade 12
NOTE: this has been amended as a choice bill

HB 1296 - Financial Transparency in Education Act; create.
• Creates the Financial Transparency in Education Act
• Requires each local education provider in the state to create and
maintain a searchable expenditure and revenue website that
includes detailed data on all monies received and expended in the
local school district
• Requires each local education provider to maintain the data in an
easily accessible, searchable and downloadable format, and to post
comprehensive figures on total expenditures and per-pupil spending
• Requires each local education provider to submit the summary data
to the state to be aggregated and made available online
• This act shall take effect and be in force from and after July 1.

SUPERINTENDENTS
HB 32 - School superintendents; require appointment of in the
event of vacancy in elected office of before January 1, 2019
• Provides for the appointment of the superintendent in school districts
with an elected superintendent of schools in the event a vacancy in
office occurs before January 1, 2019 (Approved by Governor,
January 17, 2017)
SB 2398 - Qualifications for school superintendents; revise
• Shall have not less than six years which shall include at least three
years of administrative experience as a school building principal
• Has to be in a school with an “A” or “B” accountability rating or a
school that increased its accountability rating by a letter grade
• If a superintendent was elected in the November 15 general election
that occurs before January 2, 2019, the office of superintendent
shall be appointed by the school board
• This act shall take effect and be in force from and after July 1.

Gov. Phil Bryant announced the third round of budget cuts for the
current fiscal year. We are working on how to absorb these cuts and
continue vital services to districts. MAEP was not spared in this latest
round of cuts.
