POLEMOUNT AND PADMOUNT TRANSFORMERS NOTICE INVITING BIDS

CITY OF LODI, CALIFORNIA The City of Lodi hereby invites sealed proposals to furnish and deliver Polemount and Padmount transformers. This bid will be for a period of two years with an option for a third year. The City of Lodi gives estimates of transformers needed per year. The City of Lodi does not agree to purchase any set quantity but gives this number for estimating purposes only. Each bid shall be in accordance with this notice and specifications on file and available from Electric Utility Department, 1331 South Ham Lane, Lodi, CA 95242, (209) 269-4561. No bid will be considered unless it is submitted on a proposal form furnished by the City of Lodi. Sealed proposals shall be delivered to the Budget Manager at the Finance Department, 310 West Elm Street, Lodi, CA 95240 (P.O. Box 3006, Lodi, CA 95241-1910) at or before

11:00 a.m., Wednesday, August 19, 2020 At that date and hour said sealed proposals will be publicly opened and read in the Public Works Conference Room, First Floor, City Hall, 221 West Pine Street, Lodi, California. Bidders or their authorized representatives are invited to be present. If Covid-19 restrictions are still in force the bid opening will be on the steps of City Hall. The City of Lodi reserves the right to reject any or all bids, to waive any informality in any bid, to accept other than the lowest bid, or not to award the bid. Reference is hereby made to said specifications for further details, which specifications and this notice shall be considered part of any contract made pursuant thereto. A. The Budget Manager will receive sealed bids at the following address until

11:00 a.m., Wednesday, August 19, 2020 B. Bids shall be submitted under sealed cover, plainly marked “Bid Proposal – Polemount and

Padmount Transformers, Bid Opening August 19, 2020 Bids which are not properly identified may be disregarded. Bids which are not received by 11:00 a.m., Wednesday, August 19, 2020 will be returned to the bidder unopened.

BID OPENING A. At 11:00 a.m., Wednesday, August 19, 2020 or as soon as possible thereafter, in the

Public Works Conference Room, City Hall, 221 West Pine Street, Lodi, California, bids will be publicly opened and read. Bidders or their authorized representatives are invited to be present. If Covid-19 protocols are still in effect then the bid opening will occur on the steps of City Hall.

PROPOSAL FORM A. Prospective bidders are furnished with one proposal form included with the specifications. B. The proposal must be signed with the full name and address of the bidder, by an

authorized representative of the company. C. The City of Lodi (hereinafter “City”) reserves the right to accept other than the lowest

bid, or to reject any or all bids. D. When other than manufacturers are bidding, for example, distributors, bids from such

distributors must indicate the name of the manufacturer of the product offered and point of origin of the shipment.

REJECTION OF PROPOSALS

Bids may be rejected if they show any alteration of proposal form, additions not called for, or alternative bids not properly documented. Bids proposing equipment or materials with which the City has no prior in-service experience may be rejected. Erasures or irregularities of any kind may also be cause for rejection.

AWARD OF BID

A. The award of the bid, if it be awarded, will be to the single bidder with the best comprehensive pricing for polemount transformers and the bidder with the best comprehensive pricing for padmount transformers and whose bid proposal complies with all the requirements herein described. Evaluation to determine “lowest responsible bidder” will consider quoted price and estimated cost of “Load” and “No-Load” losses based upon losses quoted in the proposal. B. In evaluating the bids and determining lowest responsible bidder and lowest cost to the

City, the City will also consider the Sales Tax Credit in the amount of one percent (1%) of the purchase price of the materials or equipment, when such purchase is consummated at the retailer’s place of business and such business:

1. Is located within the City of Lodi, and 2. Is licensed by the California State Board of Equalization to collect sales tax at the local

place of business, and 3. Maintains a valid City of Lodi Business License.

C. Where alternative bids are received, the City Council reserves the right to select the bid most advantageous to the City. The award, if made, will be made within sixty days after the opening of the bids. Therefore, all bids must be valid long enough for the award to be made.

D. In case of tie bids, consideration will be given to bids as described in “Award of Bid”,

Paragraph B, above. If that section does not apply to resolution of the tie, the tie will be broken by a coin toss, conducted by the Budget Manager. Tie bidders will be notified and may be present.

QUALIFICATIONS OF BIDDERS The City of Lodi reserves the right to require any Bidder to submit a statement of facts in detail as to such manufacturer’s business and technical organization, financial resources, and plant availability to be used in performing the contemplated work. The City of Lodi reserves the right to reject any bid if the City of Lodi determines that the business and technical organization, plant, financial, and other resources or experience of the Bidder compared with work bid upon justifies such rejection. Bidders identified by the City of Lodi as having a history of poor performance for safety related material/equipment will be considered nonresponsive and the bid will be rejected.

ONLY BIDDERS MEETING THE FOLLOWING MINUMUM QUALIFICATIONS SHOULD

SUBMIT PROPOSALS.

1. Must have been in the business of supplying similar transformer products and in customer alliances (contracts) with similar requirements as specified for a minimum of three (3) years.

2. Bidder may be required to list five (5) customer references (preferably utilities) within the United States who have purchased similar items from your company. The references must include government or private industry accounts similar in scope to this bid. These references may be surveyed as to service only, not pricing or costs. Survey questions would involve order processing, delivery, returns and credits. Requirements above may be subject to validation from these interviews.

3. A SDS (Formerly Material Safety Data Sheet or MSDS) if applicable, is required for the item(s) indicated on this Bid Request. Please submit a complete SDS Form with your bid. SDS are also required with shipment.

EXCEPTIONS

Base bids must be for the exact conditions set forth in the Bid Request. If the Bidder’s equipment or services differ in any way, the bidder must itemize the differences in the bid under the “EXCEPTIONS to the SPECIFICATIONS” section on said item.

FOREIGN MATERIALS

Bids which include equipment or components that are not manufactured in the United States will be considered. However, Bidders must specifically list in their bids all such equipment or the components and state their source. All imported materials must meet the requirements of the applicable United States Codes and specifications.

DELIVERY Delivery time will be part of the bid evaluation, and delivery lead-time(s) shall be clearly indicated on the proposal. Delivery via enclosed van or flatbed truck (side-loaded only) shall be made to the City of Lodi Municipal Service Center, 1331 South Ham Lane, Lodi, CA 95242 only during normal receiving hours, 8:00 a.m. – 4:00 p.m., Monday through Thursday, excluding holidays.

TERMS OF AGREEMENT The City of Lodi intends to issue a series of Purchase Orders to provide for the purchase and delivery of Polemount and Padmount Transformers as required by the Lodi Electric Utility. A City of Lodi representative will issue purchase orders for goods on an as-needed basis. Quantities specified in the Bid Package are approximate and total of the bid will be used for the purpose of selecting the lowest responsible bidder. Based on prior years activity, the yearly expenditures is estimated to be $427,597.00 per year. The term of the pricing agreement shall be effective for two years with an option to extend for a third year. The extension is subject to: City of Lodi City Council annual approval of the year’s budget

The Vendor’s compliance with the terms and conditions as established by the proposal The Vendor’s satisfactory performance, and timely compliance with the requirements of this proposal

PRICES Prices to be F.O.B. delivered to 1331 South Ham Lane, Lodi, California 95242. No additional freight charges will be allowed. If mutually agreeable to all parties, the use of any resultant contract may be extended to other governmental agencies within California, whether a party to this solicitation/award or not. It should be understood that all terms and conditions, as specified herein, shall apply. Firm base price for shipments for the first two years (with an option for a third year) except copper and aluminum which is quoted at time of purchase

A. Aluminum The base price of aluminum shall be 0.66 $/lb. The selling price will be adjusted upward or downward for any increase or decrease in the price of aluminum as published in the “Platt’s Metals Week US Transaction, Monthly Average Report, MW US Market Index at the beginning of each month for released purchase orders. In the event the “Platt’s Metals Week MW US Market Index” lists two prices for aluminum, the City of Lodi will use the average of the two prices. The new price will be calculated using the weight of aluminum content as indicated on the individual bidding schedule.

B. Copper The base price of copper shall be 2.3525 $/lb. The selling price will be adjusted upward or downward for any increase or decrease in the price of aluminum as published in the COMEX, first position High grade at the beginning of each month for release orders. In the event the COMEX lists two prices for copper, the City will use the average of the two prices. The new price will be calculated using the weight of copper content as indicated on the bid schedule.

SALES AND USE TAXES All sales shall be subject to California Sales or Use Taxes in effect at the time of transaction.

PAYMENTS A. Invoices shall be submitted only for items and quantities ordered for release and delivery,

and delivered subsequent to such order release, and shall indicate sales or use taxes as separate items apart from the cost F.O.B. point of delivery. Purchaser’s item description and release number shall appear on all invoices. All invoices shall be rendered in duplicate.

B. Full payment by the purchaser shall not release supplier of the responsibility to fully carry

out all bid obligations nor be construed by supplier as acceptance of the work hereunder by purchaser.

GUARANTEES In addition to any or all guarantees mentioned elsewhere herein, the supplier shall replace, at no expense to the City of Lodi, any materials or equipment that contain defects due to faulty material, workmanship or design, within a period of one year after the materials or equipment have been accepted by the City. Where manufacturers’ warranties exceed one year, said warranties shall remain in effect for the full period of the warranty.

PURCHASES Any transaction made pursuant to this bid and subsequent award shall be covered by City of Lodi Purchase Order, and all terms included in Notice to Bidders, Information to Bidders, Proposal, and Specifications, shall be binding.

ADDITIONAL TERMS AND CONDITIONS

1. ACCEPTANCE AND AMENDMENTS: Any order of City of Lodi (hereinafter referred to as "City") made pursuant to this bid and subsequent award, becomes a contract, subject to the terms and conditions set forth in the Notice Inviting Bids, Information to Bidders, Additional Terms and Conditions, Proposal, Specifications, and those incorporated therein by reference, when acknowledgment has been signed and returned by bidder to whom said contract has been awarded (hereinafter referred to as "Seller"), or upon commencement of performance by Seller. Seller's different or additional terms and conditions are hereby objected to, and no additional or different terms and conditions of Seller, or agreement or understanding to modify contract shall be binding upon the City unless specifically agreed to in writing and signed by City's authorized representative(s). No other action by City shall constitute acceptance of Seller's different or additional terms and conditions.

2. COMPLIANCE WITH LAWS: In the performance of work required under any contract made

pursuant to this bid and subsequent award, Seller agrees to comply with all applicable federal, state and local laws, rules, regulations and ordinances, and shall hold City harmless from liability resulting from failure of such compliance.

3. FAIR LABOR STANDARDS ACT: Seller certifies that all equipment provided under any

contract made pursuant to this bid and subsequent award will be produced in compliance with all applicable requirements of Section 6, 7, and 12 of the Fair Labor Standards Act, as amended, and all regulations and orders issued by the U. S. Department of Labor under said Act.

4. INDEMNIFICATION/HOLD HARMLESS: Seller further agrees to indemnify and hold

harmless City from any and all losses, liabilities, damages, claims, demands, suits, actions, proceedings, subrogations and expenses, including court costs and reasonable attorneys' fees, relating in any way to any contract made pursuant to this bid and subsequent award, or the equipment manufactured and delivered thereunder, except for equipment manufactured entirely to City's specifications, and except for actions by City over which Seller has no control, which are claimed or made by any person, firm, or corporation, including employees, workers, servants or agents of Seller and Seller's subcontractors arising from any cause or for any reason whatsoever. Seller further agrees, upon receipt of notification, to promptly assume full responsibility for the defense of any and all such suits, actions, or proceedings which may be brought against Seller or against City.

5. PATENT INDEMNITY: Seller shall hold City, its officers, agents and employees, harmless

from liability of any nature or kind, including costs, expenses and attorneys' fees, for infringement or use of any copyrighted or uncopyrighted composition, secret process, patented or unpatented invention, article or appliance provided or used in connection with performance under the contract. Supplier may, at City's discretion, be required to furnish a bond or other indemnification to City against claims or liability for patent infringement. 6. DELIVERY: Time shall be of the essence under a contract made pursuant to this bid and

subsequent award, and if delivery of equipment is not made in the quantities and at the time(s) specified in the bid and subsequent contract, City reserves the right without liability, and in addition to its other rights and remedies, to take either or both of the following actions:

a. Direct expedited routings of equipment (the difference in cost between

the expedited routing and the order routing costs shall be borne by the Seller);

b. Terminate the contract by notice, effective when received by the Seller, as to ordered equipment not yet shipped, and to purchase substitute equipment elsewhere and collect from Seller the difference in costs between the substitute equipment and equipment ordered under the contract.

Neither City nor Seller shall be liable for excess costs of deliveries or defaults due to causes beyond its control and without its fault or negligence, provided, however, that when Seller has reason to believe that deliveries will not be made as scheduled, written notice setting forth the cause of the anticipated delay will be given immediately to City. If Seller's delay or default is caused by a delay or default of a subcontractor, such delay or default shall be excusable only if it arose out of causes beyond the control of both Seller and subcontractor and without the fault or negligence of either of them and the equipment to be furnished was not obtainable from other sources in sufficient time to permit Seller to meet the required delivery or performance schedule. City reserves the right to refuse or reject all shipments over and above the quantity or quantities stated in the contract.

7. CHANGE ORDERS: City reserves the right at any time to make written changes within the

general scope of the contract in any one or more of the following:

a. Specifications, drawings, and data incorporated in the contract where the items to be furnished are to be specially manufactured for City;

b. Methods of shipment or packing; c. Time of delivery; d. Place of delivery; e. Method of delivery; f. Quantities.

If any such changes cause an increase or decrease in the cost of or in the time required for the performance of the contract, an equitable adjustment shall be made in the contract price, or delivery schedule, or both. Any claim by Seller for adjustment in this cause must be approved by City's authorized representative(s) in writing before Seller proceeds with such change. Price increases shall not be binding upon City unless evidenced by a change order, amendment, or revision signed by City's authorized representative(s).

8. CANCELLATION: For Seller's failure to comply with any material terms or conditions hereof, or for failure to perform on all or any part of the undelivered portion of the order or contract, City may cancel the order, in whole or in part, without further liability to the City. Such cancellation, however, shall be without prejudice to claims of either party arising prior to cancellation and without prejudice to any claim City may have against Seller for breach inducing cancellation. Failure of City to insist on strict performance or observance by Seller of the order, these conditions or City's rights in any one or more instances shall not constitute a waiver by City of such performance, conditions or rights either then or in the future. Either party may cancel the order without further cost or liability to the other party in the event that any proceedings are instituted by or against the other party in bankruptcy or insolvency under any provision of the Bankruptcy Code, as amended, or in the event of any assignment for the benefit of creditors.

9. REMEDIES: Remedies of the parties of the contract include, but are not limited to, the

following:

a. If City cancels the contract in whole or in part as provided in Section 7, above, City may procure equipment similar to those canceled, by such means and under such terms as City deems necessary and appropriate, and Seller shall be liable to City for any excess costs for such similar equipment. Seller shall further be responsible for continued performance of any portion of the order not canceled according to the provisions of the contract;

b. The rights and remedies of the City provided in this clause shall not be exclusive and are in addition to any other rights and remedies provided by law, including consequential damages;

c. The failure of City to insist upon strict performance of any of the terms of the contract or to exercise any rights thereunder shall not be construed as a waiver of City's rights;

d. Seller may be excused from performance under the contract provided that Seller notifies City within five (5) days of discovery of any of the following events:

I. Acts of God, acts of public enemy, acts of civil authority with lawful jurisdiction over Seller, acts of war, fire, flood, unusually severe weather, earthquake, epidemic, quarantine restrictions, freight embargoes, or acts of City;

II. Seller's failure to perform is caused by default of a supplier or subcontractor and if such default arises out of causes beyond the control of both the Seller and the supplier or subcontractor and without the fault or negligence of either party;

III. Seller has made a good-faith effort to obtain supplies or services from other sources in such time to meet City's required delivery schedules, if such events named above cause supplier default.

10. NOTICE OF LABOR DISPUTES: Whenever an actual or potential labor dispute delays or

threatens to delay the timely performance of the order, Seller shall immediately notify City in writing of all relevant information with respect to such dispute.

11. ADDITIONAL CHARGES: No charges for packing, handling, drayage, or special shipping

containers or protective materials will be allowed or paid by City unless specified on the face of the contract, or specifically listed as an additional and separate charge on Seller's bid. Seller shall be liable for damage to equipment caused by improper packing, boxing, or crating.

12. SHIPMENT/RISK OF LOSS: Unless otherwise stated on the face of the contract, all

equipment shall be shipped F.O.B. destination, and Seller shall bear all risk of loss or damage of equipment covered by the order, except loss or damage occasioned by negligence of City, until final acceptance by City at delivery destination specified on the face of the order. City reserves the right to reject C.O.D. or collect shipments.

13. TITLE: Title to all equipment purchased under any order made pursuant to this bid and

subsequent award shall pass directly from Seller to City at the F.O.B. point specified in this bid and on the face of the order, subject to the right of City to reject equipment upon inspection.

14. INSPECTION/ACCEPTANCE: Payment for any equipment purchased under the contract

shall not constitute acceptance thereof. All equipment purchased thereunder is subject to inspection at City's discretion, either before or after acceptance, at City's option. City reserves the right to reject and refuse acceptance of equipment which is not in conformance with City's specifications, instructions, and drawings, and in conformance with Seller's warranties (express or implied). Equipment not accepted will be returned to Seller for full credit or replacement at City's option and at Seller's risk and expense, including demurrage and/or transportation both ways.

City shall not be liable for failure to accept any part of the equipment ordered, if such

failure is the result of any cause beyond the control of the City. Without limitation, among such causes are fires, floods, acts of God, strikes, casualties, delays in transportation, or partial or total closure of City's facilities. Acceptance of all or any part of the equipment shall not be deemed to be a waiver of City's right either to cancel or to return all or any portion of the order because of Seller's failure to conform to the contract, or by reason of defects or other breach of warranty or to make any claim for damages caused by improper boxing, crating, packing or shipping. Such rights shall be in addition to any other remedies provided by law.

15. LIENS, CLAIMS, AND ENCUMBRANCES: Seller warrants and represents that all

equipment delivered under any order made pursuant to this bid and subsequent award will be free and clear of all liens, claims, and encumbrances of any kind.

16. PAYMENT/DISCOUNT: Payment shall be made, upon submission of acceptable

invoice(s), for equipment delivered and accepted as specified herein and on the order. Drafts or statements will not be honored.

It is the City's intent to pay all invoices within 30 days following receipt of invoice or date

of delivery and acceptance, whichever is later. Test certificates must be furnished by the manufacturer prior to the City’s acceptance of the equipment. If invoice amount is in variance with contract amount, payment will be made within thirty days of resolution of variance and receipt of corrected invoice, if applicable.

17. RETURNS: All equipment purchased under an order made pursuant to this bid is subject

to City's inspection and approval as specified in Paragraph 14, above. Equipment rejected by City for cause shall be held for pickup, returned, or stored at Seller's sole expense. Where return is necessary due to Seller's error, City reserves the right to assess handling charges equal to Seller's standard restocking fee, as a percentage of the value of the returned equipment. Any costs incurred by City shall be promptly reimbursed to City by Seller.

18. WARRANTIES: Seller hereby warrants with respect to equipment furnished under any

order made pursuant to this bid and subsequent award, that: (1) Seller has good title to the equipment, (2) the equipment conforms to City's specifications, instructions, and/or drawings, (3) the equipment is fit for the purpose for which it is purchased, (4) the equipment is merchantable, (5) the equipment has no latent defect, and (6) the equipment has been manufactured in a good workmanlike manner using the highest quality material in conformity with the best standard manufacturing practices. This warranty shall survive any inspection, acceptance or return of any such equipment and shall apply to City and its customers.

19. DISPUTES/GOVERNING LAW: In any suit or action brought to enforce any term,

condition, or covenant herein, or to recover damages arising from any breach of the contract, the losing party shall pay to the prevailing party reasonable attorneys' fees and all other costs and expenses which may be incurred by the prevailing party in any such suit or action and in any reviews thereof and appeals therefrom.

The laws of the State of California shall govern any order made pursuant to this bid and

subsequent award, and the venue of any actions, disputes, or claims brought thereunder shall be venued in or transferred to the Superior Court of San Joaquin County, in the State of California.

( N a m e o f B i d d e r ) The undersigned, as bidder, declares to have carefully examined the Notice Inviting Bids, Information to Bidders, and Specifications filed for furnishing and delivering this equipment, and agrees to be fully informed regarding all of the conditions affecting the transformers to be furnished for the completion of the order, and further agrees that the information was secured by personal investigation and research and not from any estimate of a City employee, and that no claim will be made against the City by reason of estimates, tests or representations of any officer or agent of the City, and proposes and agrees if the proposal be accepted, to furnish the City of Lodi the necessary equipment specified in the bid in the manner and time therein set forth. It has been noted the City of Lodi reserves the right to accept all or part of this bid, to reject any or all bids, or to accept other than the lowest bid. Equipment listed herein is to be in accordance with the City of Lodi specifications attached hereto. The bidder will submit a detailed list of any and all exceptions taken to these specifications. In the absence of such a list, it will be understood that the bidder’s proposal is based on strict conformance to the specifications in all respects. 4.000 GENERAL REQUIREMENTS Electrical design and materials shall conform to the latest EEI-NEMA and ANSI Standards for Oil-Filled Equipment. It is the intent of these specifications to describe equipment of the best design and construction, and for the service for which it is intended. Consequently, it shall be the City’s desire to award contracts to the bidder who has demonstrated high quality by having a considerable number of transformers of the bidder’s manufacture in service on the lines of electrical utilities over a period of years.

4.001 TESTS Transformers shall receive at least the following tests in accordance with the applicable ANSI and NEMA Standards:

4.002 SERVICE The manufacturer shall own and operate a service shop in this vicinity, or the bidder may submit evidence of a repair contract with an approved service shop in this vicinity, which has been in effect for a period of at least one-year. (For the purpose of this specification, “Vicinity” shall mean a 200-mile radius of the City of Lodi).

4.003 GUARANTEE The manufacturer shall guarantee all equipment delivered under these specifications against any and all defects in material and/or workmanship for a period of at least one-year from date of acceptance. The manufacturer shall rectify all such defects by repair or replacement at the manufacturer’s sole expense and shall assume responsibility for associated shipping costs.

3. Ground lugs: Two (2) ground lugs which accept a range of #4 to 1/0 AWG copper shall be provided.

4. Paint: The coating system shall be in accordance with ANSI C57.12.28, latest revision. The finish color shall be Munsell Green No. 7GY3.29/1.5 (olive) and shall be applied on both the interior and the exterior of the transformer. Special attention shall be given to welds, seams, edges and rough spots. Minimum thickness shall be the greater of 3 Mils or any applicable ANSI standard.

5. Lifting lugs: Lifting lugs shall be provided on the tank and shall be located in such a way to avoid interference between lifting slings and any attachment on the transformer and to avoid scratching the transformer coating. On single phase units, the lifting lugs may be removable.

6. Tanks: Tanks shall be tested at a pressure equal to or greater than the maximum operating pressure and for a sufficient period of time to insure that all welds are free from leaks. Tank and radiator construction shall be consistent with good manufacturing and design practices prevalent in the transformer industry, and together they should contribute to a high quality product.

7. Nameplates: Stainless steel or anodized aluminum nameplate shall be securely attached to the transformer by means of metal screws, rivets or similar mechanical device(s). The letters and numbers shall be stamped or engraved on the nameplate. The nameplate shall include the words, “Fluid is less than one (1) p.p.m. PCB, at time of manufacture”, refer to section 4.006. The instruction nameplate shall contain the information specified in Section 5.12.2 of IEEE (ANSI) C57.12.00, latest revision. Bushing and fuse designations shall be marked by stenciled lettering on the tank. Decals will not be accepted.

8. Labels/Decals: (A) Blue colored “NON-PCB” placed by the nameplate (B) Teardrop-shaped “FR3” label placed on the exterior (C) “FR3” placed near fill/drain plug (D) Peak-temperature label, Omega 6MA-190/88-30, placed near but not over the fill-line on the faceplate (avoiding placing beneath any tank-penetrations).

9. Sound level: The sound level shall be equal to or less than that specified in EEI-NEMA Standards.

4.005 LOSSES

1. No-load: No-load (core) loss @ $3.75/watt 2. Load: Load (winding) loss @ $1.25/watt

3. Evaluation: The cost of losses will be added to the equipment price (bid price) F.O.B. Lodi, including maximum escalation and taxes, to determine the evaluated low bid of vendor otherwise meeting these specifications.

4. Guaranteed Loss Data: Bidders shall supply the following guaranteed loss data for use in the evaluation, in addition to other data listed in the specifications:

A. No-load losses in watts at rated secondary voltage.

B. Load losses in watts at rated secondary voltage and rated load. The standard

reference temperature for load-losses shall be 85º C.

C. Upon request, furnish certification/statement of the guaranteed loss measurement error of the test equipment and measurement method to be used, including the basis for determination of the accuracy of the test equipment and measurement method.

5. Certified Test Report: The successful bidder shall supply a certified test report of actual losses of the unit(s) to be supplied. The no-load and load losses for each class (type and rating) of transformer(s) will be averaged separately within their respective categories (no-load and load losses). If the average tested no-load (core) and/or load (winding) losses of the transformer class exceed the watt losses quoted in the proposal, the contract price shall be reduced by the above amounts per watt of actual class averaged no-load and/or actual load losses in excess of that quoted in the proposal. No-load loss penalties will be evaluated separately from load loss penalties. No additional payment will be made to the manufacturer or bidder for actual losses lower than the losses quoted in the proposal.

6. Certified Test report of Losses: The manufacturer shall submit certified test reports of losses prior to or at the time of shipment of the transformers.

4.006 PCB CONTENT Transformer fluid shall be guaranteed to contain less than one p.p.m. by weight (mg/kg) polychlorinated biphenyls (PCB). Certified test report of PCB content shall be produced upon request. The transformer nameplate shall include the words, “Fluid is less than one p.p.m. PCB at time of manufacture”.

4.007 DIMENSIONS and DRAWINGS

The overall dimensions of the units (height, width, and depth – height only for single-phase units) will be considered in the evaluation of the bid. For three-phase units, the bidder shall submit drawings of the units proposed in the bid.

4.008 LABELING The transformers shall be shipped without the Safety Labels per NEMA No. 260-1991. The City will affix its personalized “Mr. Ouch” label(s).

4.009 INSULATING FLUID

1. Shipped Filled: Transformers shall be shipped with insulating fluid (oil) installed, filled completely to their designed fill-level.

2. Type: The oil shall be FR3, natural-ester, derived from vegetable oils, complying with ASTM D6871 & IEC 62770 (latest versions). Fluid shall not be contaminated with mineral oil dielectric residue, such as may remain in transfer piping, or filter equipment if improperly purged (separate oil handling facilities and processes are recommended, to prevent cross contamination of natural ester and mineral oil dielectric fluids).

3. MSDS: Material Safety Data Sheets (MSDS) shall be submitted with each shipment of transformers. The manufacturer/bidder shall indicate the transformer serial number(s) for which the MSDS is applicable.

4.010 PADMOUNTED EQUIPMENT ENCLOSURES

A typical padmounted equipment enclosure consists of a surrounding case or housing for the equipment to prevent unauthorized access, to protect people against accidental contact with energized parts and to protect equipment against weather hazards. The enclosure is mounted on a pad, above ground level, and may be ventilated to permit circulation of air. Entry into the enclosure shall be through either access door(s) or hood(s) as specified.

1. Structural Strength and Integrity Test: The structural strength and integrity test shall comply with the latest NEMA and ANSI Standards for testing, design and enclosure security.

2. Construction shall be such that:

A. It prevents the entry of foreign objects, such as sticks, rods or wires.

B. It inhibits dismantling of the equipment.

C. It is free of areas which could provide access by forcing techniques.

D. Panels shall be fastened or hinged to resist disassembly, breaking or prying open from

the outside. Normal entry shall be possible only with the use of proper access tools. Latches and other provisions for locking hinged panels shall be furnished.

E. There shall be no exposed screws, bolts or other fastening or hinging devices which are externally removable (with the exception of penta-head bolts provided for extra security) that would provide access to energized parts of the enclosure.

F. The transformer tank and enclosure shall be constructed of minimum 14 gauge steel. The radiator(s) to be constructed of minimum 18 gauge steel.

G. In addition to the regular locking provisions, all access doors shall be secured by a recessed, captive, penta-head bolt. A penta-head bolt will be considered ”captive” when the retention scheme will prevent it from being readily removed during normal operation of the door(s) or hood(s). The recess is to be non-rotating. The dimensions of the penta-head bolt and non-rotating recess shall comply with Figure 1 of ANSI C57.12.28, latest revision. If all doors can be secured with a single bolt, one bolt will be sufficient.

H. Each latched door(s) shall be latched at a minimum of three points. In addition to the three point latching, one penta-head bolt shall be coordinated with the latch and padlock to prevent unlatching and insertion of the padlock into the hasp when and until the bolt head is completely seated. Low profile cabinets, with access flip-up hoods, need only padlock and penta-head bolt provisions, and shall be coordinated to prevent insertion of the padlock into the hasp until the bolt head is completely seated.

I. The padlocking device shall be so designed and located as to resist prying or breaking off by screwdrivers, wrecking bars, tire irons, single-socket lug wrenches or other readily accessible tools.

J. The edges of the access doors or hoods shall be formed to provide: a) close fitting

mating surface, with internal insertion prevention lip and b) rigid panel which, in conjunction with a handle-linkage-latching mechanism with three (or more) point latching, will resist bending in the event sufficient force is applied to distort the compartment door(s) and permit prying access to the door edges.

K. Hinge pins shall be passivated AISI (American Institute of Steel Industries) Type 304 stainless steel, or approved equal.

L. Hand-hole covers, if exposed when the enclosure is secured, shall be secured from the inside of the enclosure.

M. The bottom edge of the enclosure shall provide for flush mounting on a flat, rigid mounting surface to prevent wire entry into the compartment.

4.011 FUSES

The transformers shall be fused with RTE® Bay-O-Net fuse assemblies and in series Isolating Links. The fuse and link sizes are shown in tables A and C, respectively, for single-phase and three-phase units. The Bay-O-Net assembly shall be Cooper Power Systems with Flapper™ valve or ABB “DO III” with went hole and check valve. Fuse element(s) shall not be installed, but supplied in a bag attached to the fuse holder handle. If the manufacturer desires to install the fuse(s) an additional fuse(s) of the size and type specified shall be supplied in a bag attached to the fuse holder handle.

An oil-drip system similar to RTE® drip guard or a metal tray mounted on the tank wall below the fuse holder entrance shall be supplied. The metal tray shall be designed such that any insulating fluid captured in the tray will not drain onto bushings and/or cable assemblies located below the drip tray. Fastening of an oil drip device to the fuse assembly with a “U” bolt is not acceptable.

4.100 SINGLE PHASE UNITS

4.101 ENCLOSURE Transformer enclosures to be in conformance with section 4.010, of this specification, and be of the low-profile design. Maximum dimensions for units up to 75 kVA shall be no more than 38” wide, 42” deep, 34” tall; units 100 kVA and above shall be no more than 38” wide, 48” deep, 38” tall. The access door (hood) shall open to the top 180° and be removable. The design shall be dead front, loop-feed and primary connected wye. Cables shall enter and leave the transformer from below through openings in a pad. The front plate of the transformer tank shall be constructed (reinforced) in such a manner that tank pressure does not cause any reduction in clearances between the energized parts and grounded surfaces, i.e. deflection resulting in spades and bushings moving toward each other or the sides of the cabinet.

The Bay-O-Net fuse shall be positioned in such a way that the fuse assembly can be inserted and locked in any position without interfering with the closed door (hood).

4.102 TERMINALS

Primary and secondary bushing positions shall be in accordance with ANSI C57.12.25 Standards Type-1 arrangement, Figure 1 b, latest revision. Each low-voltage spade shall also have the following removable Homac ZEEBARs included and installed per Homac guidelines and Homac specified hardware: Homac ZEEBAR Part No. ZBT 4043-48. ZEEBARs shall be oriented with the cable-outlets hanging below the spade, positioned per the below drawing.

4.103 STANDARD ACCESSORIES

In addition to that specified in sections 4.000 – 4.012, of this specification, the transformers shall be provided with the following: 1. Each unit shall be equipped with a non-resettable device which detects and provides

external indication of internal transformer faults. This device shall also incorporate a pressure relief valve. The approved device shall be IFD Corporations catalog IFD-ORCA-10PSI-aA or approved equal. The device shall be designed to conform to IEEE Standard C57.12.20.

2. Low voltage terminal, 4-hole in-line spade type, per ANSI C57.12.25 Figure 4b (all

insulated), which may be rotated to allow convenient connection of cables. 3. Oil filler and drain plug.

4.200 THREE PHASE UNITS

4.201 ENCLOSURE

Transformer enclosure to be in conformance with section 4.010, of this specification. Maximum transformer height shall not exceed values listed in Table B, below. High and low voltage compartments shall be separated, the low voltage compartment door shall be equipped with a locking handle. In addition, the doors shall be so arranged that access to the high voltage compartment can be gained only after opening the low voltage compartment door. The doors shall be removable. 4.300 GENERAL REQUIREMENTS Electrical design and materials shall conform to the latest EEI-NEMA and ANSI Standards. It is the intent of these specifications to describe equipment of the best design and construction, for the service for which it is intended. Consequently, it shall be the City's desire to award contracts to the bidder who has demonstrated high quality by having a considerable number of transformers of bidder’s manufacture in service on the lines of electrical utilities over a period of years.

4.303 GUARANTEE The Manufacturer shall guarantee all equipment delivered under these specifications against any and all defects in material and/or workmanship for a period of at least one year from date of acceptance. Manufacturer shall rectify all such defects by repair or replacement at manufacturer's sole expense and shall assume responsibility for associated shipping costs.

The successful bidder shall supply a certified test report of actual losses of the unit(s) to be supplied. The no-load and load losses for each group (type and size) of transformer(s) will be averaged separately within their respective categories (no-load and load losses). If the averaged tested no-load (core) and/or load (winding) losses of the transformer group exceed the watt losses quoted in the proposal, the contract price shall be reduced by the above amounts per watt of actual group averaged no-load and/or actual load loss in excess of that quoted in the proposal. No-load loss penalties will be evaluated separately from load loss penalties. No additional payment will be made to the manufacturer or bidder for actual losses lower than the losses quoted in the proposal. Certified test report of losses shall be submitted by the manufacturer prior to or at the time of shipment of the transformer.

4.306 PCB CONTENT Transformer fluid shall be guaranteed to contain less than one p.p.m. by weight (mg/kg) polychlorinated biphenyls (PCB). Certified test report of PCB content shall be produced upon request. The transformer nameplate shall include the words; "Fluid is less than one p.p.m. PCB."

4.307 INSULATING FLUID

1. Shipped Filled: Transformers shall be shipped with insulating fluid (oil) installed, filled completely to their designed fill-level.

2. Type: The oil shall be FR3, natural-ester, derived from vegetable oils, complying with ASTM D6871 & IEC 62770 (latest versions). Fluid shall not be contaminated with mineral oil dielectric residue, such as may remain in transfer piping, or filter equipment if improperly purged (separate oil handling facilities and processes are recommended, to prevent cross contamination of natural ester and mineral oil dielectric fluids).

3. MSDS: Material Safety Data Sheets (MSDS) shall be submitted with each shipment of transformers. The manufacturer/bidder shall indicate the transformer serial number(s) for which the MSDS is applicable.

4.400 SINGLE PHASE UNITS

4.401 GENERAL

In addition to that specified in Sections 4.000-4.007, transformers shall be provided with the following:

Hanger brackets, welded to the tank. 7. Hanger brackets shall permit bolting of transformer directly to pole.

4.402 RATINGS AND DESIGN Transformers shall have the following ratings and design: 1. Distribution type, pole-bolted transformer. 2. 12,000-Volt Delta primary. 3. Single phase. 4. Without arresters and taps. 5. Conventional or CP type as specified on proposal form. CP transformers to have one

weak link (fuse) per primary bushing and a breaker on the secondary side. 6. Secondary voltage to be as specified on the proposal form. 7. kVA rating to be as specified on the proposal form.
