Special Instructions to Local Audit Parties

Months selected for detailed audit.

04/2014 and 3/2015 In case of audit for more than one year, 2 additional months remittances will be checked by

LAPs one of the month will be March.

Rationalisation of department of State Excise and Entertainment Duty has been

approved vide PAG’s order dated 21/01/2015. According the LAP is instructed to

prepare single Inspection Report for State Excise and Resident Dy. Collector

incorporating the points raised on audited Distilleries/Wineries/SSKs and Taluka

Magistrates respectively. Similar types of paras should be consolidated with their

respective controlling offices i.e. RDC &SE.

Non recovery of differential amount of Supervision Charges is regular objection raised

during audit State Excise Department. The non recovery of Supervision charges should be

calculated from the date of issue of enhanced orders and not retrospectively. Necessary

provision in this regard may be considered before incorporating in the LAR.

Levy of license fees is calculated on the basis of census date. LAP may specifically

mention the date of publication of census data and the date from which it is effective for

recovery of license fees in the objection.

LAPS should include the duties of Heads of the Department (HOD) in introductory part of

the Draft Local Audit Report.

As per regulation no.183 of Regulation on Audits and Accounts 2007 issued by C

&AG of India, as the inspecting officer may hold a meeting with the officer in charge as

soon work of audit commences. In the meeting, the audit objectives and criteria, general

state of internal controls and areas of focus, concern or high risk identified by Audit may

be discussed.

As per regulation no.191 of Regulation on Audits and Accounts 2007 issued by C

&AG of India, the inspecting officer and officer in-charge shall discuss the draft

inspection report with the officer in-charge of the auditee unit at the close of the. A

written record of the proceeding of the meeting duly signed by both the parties should

be kept in the Draft LAR positively.

The LAPs are instructed to examine the Internal Control Mechanism and proper

maintenance of registers and records in respect of each auditee units and include them in

the Local Audit Report (Instructions issued by Pr. A.G. during the review of IRs). The

internal audit report may also be scrutinized and comments included in the Inspection

Report.. All the LAPs are instructed to verify whether all the records prescribed in the

respective manuals of the department have been properly maintained/updated etc.

Comments on non-maintenance of proper records /non- updation of details etc. is required

to be commented along with the lapses on the internal control system.

LAPs are directed to obtain the dated initials of the head of the office in the LARs.

Name and Designation of the Head of the Department, Address, Pin Code No. and

Telephone No. should also be mentioned in Title Sheet. It is observed that correct

telephone number and Fax Nos of the Department is not mentioned in the Title Sheet.

All LAP members are directed to hand over the LAR to Headquarters before taking

outstation transits so as to avoid undue delays in receipt and issue of LARs. LARs should

be properly documented with attestations.

PDP register may be referred to and Parties may collect PDP files for verification of

compliance.

All 'NIL Reports' are to be supported by justification.

In the justification note for Nil I.R, Kindly specify

(a) What are the checks that were to be applied? The list of checks should be given.

(b) What was the check done by audit? Actual work done half margins issued etc. should

be mentioned.

(c) What was the basis on which the Sr. AO/AO/AAO/SO satisfied himself/herself that the

checks applied were satisfactory and no objection was taken in I.R. This should be

recorded clearly. (As per instruction issued by DAG/SRA during the review of LARs).

Analyses of arrears are to be made to find out the reasons and may be commented suitably

in Local Audit Report. Stages at which pendency’s are noticed may also be incorporated in

the introduction to the LAR. Trend of increase or decrease in arrears over the previous

years and adequacy of steps taken for recovery has to be examined by all LAP members. A

separate Para may be raised on huge arrears.

Despite repeated instructions, it is seen that outstanding paras are not verified properly.

This is being viewed seriously by the Pr. A.G. All the old paras should be discussed with

the head of the department & compliance obtained on it. The LAPs may discuss the action

taken in respect of each paras and record the reasons for closing/retaining the paras

alongwith necessary Key Documents.

It is noticed that in many cases it is replied that action in under progress, recovery will be

made, demands are raised etc. If demand notices have been issued copies should be asked

for and checked. What is the follow up action taken after demand notices were issued.

Paras should contain proper Rule, Act, Section, Sub-Section, Clause, Class etc.

Confirmation of fact and figures with the unit head in clear terms.

All the Key Document must be enclosed with HM’s.

At least two Annexures should be prepared. One attached with H.M. and other with I.R.

The format of all the Annexures prepared should be detailed and uniform.

Objections on Non-recovery should not be beyond the period covered by audit and in no

cases where demand notices have been issued in that year be included.

All LAPs should ensure that the LARs are duly paged before submitting to Hqrs.

Tour diaries duly countersigned should be submitted to HQrs immediately on completion

of audit.

Figures of revenue for the last 3 years may be incorporated in Part-A: Introductory and

Trend of Revenue analysed and commented.

The name of the LAP Members should be included in the introductory part of all the Draft

Inspection Report.

Instruction/observation of Pr. Accountant General during review of Inspection Reports of

ORA wing may be complied/adhered to by the entire LAP member.

Duty point within 200 km from Hqrs., LAP may avail AN/FN transit on Friday/Monday

before 2nd and 4th Saturday
