Conservation is defined as “the careful use of natural resources (such as trees, oil, etc.) to prevent them from being lost or wasted.” The beauty of conservation, other than the fact that we leave our planet in good condition, is that many conservation efforts can actually save you money. In addition, working with your state and the National Restaurant Association (NRA) can save you money on your conservation efforts.
The NRA has created a conservation program specifically for restaurants and if you are a member of NMRA, you are also a member of NRA and can access their Conserve program for free.
The Conserve Sustainability Education Program is an online resource to help restaurants reduce operating expenses and leave a lighter footprint on our environment. Participants can design your own personalized program tailored to and consistent with your individual concept, whether you are just starting out or looking to expand upon existing conservation efforts. Conserve should be your next step and it’s online and easy-to-use.
“By implementing steps from the Conserve program, we reduced our electrical and gas bill by about 4% - when you’re paying $10,000/month, that’s quite a sum,” says Greg Aardal, The Angus Barn ltd, participant in the NRA’s Conserve Sustainability Education Program.Conserve is free to all members. You can utilize more than 90 industry-tested best practices and 64 educational how-to videos at no cost. In addition, you get online resources and peer learning opportunities.“I’m not really a green person, but I am,” says Joey Terrell, owner of a Leadership in Energy and Environmental Design (LEED) registered restaurant and participant in the NRA’s Conserve Sustainability Education Program. “I also like money and that’s green. Owning a restaurant is like a hole in your pocket, so it really helps to conserve when you should. ”
Unfortunately, on January 1, 2014 incandescent light bulbs will be phased out. Fortunately, NMRA and NRA are participating in a discount program designed to save our members money on LED lighting through North American LED (NALED) a leader in electronics and lighting solutions. NALED is providing members the most frequently used lighting products for front of the house, back of the house and external lighting needs. PNM is also offering a rebate program for those in their service area.
The good news is that we can take steps to do our part on conservation of our planets resources. The bad news is that the EPA is coming down hard on municipalities for fats, oils and grease (FOG) in sewage systems which mean that those very same cities are going to start coming down hard on our industry. The updated ordinance could become law in late 2013 or early 2014 depending on a certificate of approval by the EPA and approval by the Water Authority board. NMRA has submitted testimony that this would be a burden on our restaurant community but it looks like authorities will pass this burdensome law anyway. I hope that you all enjoyed and had a successful summer season. Now, we must get ready for the best season in New Mexico - fall. That means Balloon Fiesta, the changing of the leaves, harvest time and the wonderful smell of green chile roasting in the air.
It is also a time for restaurateurs - the great operators that we are - to look at our operations and see how we can improve our costs and efficiency. The simple thing an operator can do is maintenance on existing equipment. A small task like making sure the gasket on your walk-in door has a tight seal and having your heaters professionally tuned up for the winter can make a significant difference. You should also clean or install new filters on walk-in motors, reach in deli’s and ice cream freezers. Take a look at any other equipment that might need some maintenance work done and remember that fixing a small problem is always less expensive than ignoring it and allowing it to become a big problem.
Another simple change is your light bulbs. Switch out your old school, fluorescent light bulbs for the new incandescent bulbs. You may incur some expense now, but it will save you money and energy in the long run. Utility companies like PNM and New Mexico Gas Company have programs in place to help conserve energy and supply rebates.
To go “green,” you may even want to look at installing solar panels or small wind turbines at your establishment. You can also purchase recycled and recyclable products from your purveyors. There are many ways you can recycle your food and cardboard/paper waste. For these endeavors, you may want to seek some professional help from one of our many trusted partners.

The first sign that full implementation was not going to occur January 1, 2014 was when the Employer requirement for informing employees was postponed from March 1st this year until Oct 1st. The information employees were to receive concerned their healthcare options to include information on Healthcare Exchanges.
Then in July we learned main elements of the Employer Mandate were postponed until January 1, 2015. The reason was simple. This extremely burdensome part of the law has many issues. Thanks to the efforts of the National Restaurant Association (NRA), the lobbying efforts of operators and other major organizations, the Obama Administration had no alternative but to delay implementation of this part of the law. But our good work does not end here. We need to continue to work with the Administration and Congress to modify three elements of the law that have major implications on our industry and were the primary reasons for pushing the Employer Mandate back:
1) Defining a full time work week at 40 hours instead of the ACA's current 30 hour definition
2) The calculation for determination of a "large" company (i.e. 50 or more full time employees and full time equivalents)
3) The implementation of the auto enrollment for companies with 200 employees or more
Our industry is very much impacted by all three of these elements of the ACA. The 30 hour work week
redefines the threshold for full and part-time employees which has real unintended consequences. Many of us as operators have shared the implications of this element with our Congressional representatives and their staff in an effort to demonstrate why this simply does not work for our industry. The restaurant industry by its very nature, has high attrition, accommodates flexible hour needs of staff and does not fit nicely into a typical eight hour a day, five days a week business model.
The full-time employee calculation is burdensome and complex because of our industry's attrition and part-time workforce as well. This calculation has the unintended consequence of having many of us in, and around, the full-time, 50 threshold contemplating ways to modify work hours and/or changing our business model (i.e. number of days open, lunch and dinner only, etc.)
The third issue, Auto Enrollment, simply has many parts of the law that are not understood or have not been written as of yet. The NRA will continue to educate the Administration and Congress on the impact of these elements of the law on our industry. I also encourage all of you familiar with how it impacts your business to contact your Congressional leadership as well. There is much that needs to be modified or eliminated from the new law. It is only thru our individual efforts and the good work of the NRA that we can be successful.

I mentioned a few quarters ago I would provide additional updates on the Affordable Healthcare Act (ACA) for many reasons, primarily because many elements of this new law could not be understood and/or were not yet defined.

This past session, two bills we have been working on for quite some time finally passed the legislature and were signed into law by the Governor. These bills went into effect in July.
The bills I am talking about are the Sunday Liquor Sales at 11 a.m. and the Alcohol Server/Removal of the 4th Degree Felony for Serving to a Minor on the First Offense.
First of all, a big “thank you” to those in the legislature who supported the measures, to the Governor for giving them the seal of approval and to our partners that worked tirelessly to achieve success. Passing these bills took teamwork and perseverance.
The Sunday Liquor Sales at 11a.m. legislation was brought to the legislature by the Hospitality Retailers Association and NMRA was proud to support it. The bill allows your establishment that
is in an area of the state which already approved Sunday liquor sales to begin serving at 11a.m. While we had wanted the Sunday sales to begin at 10 a.m., the bill was amended in committee to begin at 11 a.m. Well, 11a.m. is better than noon. This is a step in the right direction. Perhaps we can return to Santa Fe to support legislation in the future to begin at 10 a.m.
Now, on to the complicated bill of the Alcohol Server Training Frequency and Reduction of the 4th Degree Felony. The Petroleum Marketers Association led the charge on this one and we were very pleased to partner with them to secure the passage of this bill. This bill started off as two separate bills. Two years ago we negotiated with the Governor’s office and all parties agreed it would be best to combine these issues. First, what the bill does is reduces the first-degree felony for a certified server who sells
alcohol to a minor to a misdemeanor on the first offense. Secondly, it increases the frequency a server has between Alcohol Server certifications. The old law allowed for certification renewals every five years; however this law requires them every three years. This was the trade off for removing the first-degree felony on a first offense. While we do not condone serving alcohol to minors in any event, this allows for a mistake to be made and not have a felony charge on the server.

In order to comply with the U.S. EPA National Pollutant Discharge Elimination System (NPDES) permit for its Southside Water Reclamation Plant (SWRP), the Albuquerque Bernalillo County Water Utility Authority is proposing an updated Sewer Use and Wastewater Control Ordinance along with a new Fats, Oils and Grease (FOG) Policy.
The FOG Policy is of particular interest to restaurant and food service owners and operators. The new FOG Policy includes the following changes:
• Grease removal systems must be cleaned at least every 6 months
• Grease removal systems must be functional
• Grease removal systems must be cleaned out when the grease and solids comprise 25% or greater of the depth of the system
• Grease removal system pumper must be in compliance
• Restaurants/food service operations must keep manifests on grease removal system maintenance
• Failure to comply can result in Administrative Assessments to water bill ranging from $50-$500
The updated ordinance could become law in late 2013 or early 2014 depending on a certificate of approval by the EPA and approval by the Water Authority board.

Trinity Hotel in Carlsbad, N.M. is a three-in-one experience filled with an inviting atmosphere and warm welcomes. The hotel, restaurant and coffee shop located in one historic building allow guests to take a step back in time while still enjoying modern cuisine and amenities.
The building was constructed in 1892 by Pat Garrett, famous for killing Billy the Kid, as the First National Bank until it closed three years later. Since then, the building has been home to a newspaper, barber shops, thrift shops and the Red Cross. The Carlsbad Irrigation District was the only business that maintained throughout the years until the building was bought in 2007 by the Trinity’s three main owners, Dale Balzano, son Derek Balzano and Michael Moore.
The hotel has a total of nine luxurious suites; two downstairs and seven upstairs. Room 206, or the Safe Room, is one-of-a-kind in the world with the old second-story bank safe renovated into a media room.
A few steps away on the ground floor guests, and the public, can grab a bite to eat in the restaurant.
Executive Chef Luis Martinez was originally raised in an Italian kitchen in Loma Linda, Calif. and has been with the restaurant since it opened in 2009. The restaurant’s signature dessert is Tiramisu made from scratch by Martinez every night. The menu consists of various steaks, pastas and homemade sauces as well as a guest favorite, the Besito Caliente Goat Cheese.
“I’ve had several professional food reviewers say it’s the perfect appetizer,” says Janie Balzano, wife of owner Dale Balzano. “So that is quite the compliment.”
The appetizer is made of “New Mexico’s Besito Caliente blackberry chipotle glaze atop of goat cheese.” However, it is not the only dish with New Mexican flare. The Chicken Bolloco fettuccine
has a green chile infused alfredo sauce and is popular among both local and international guests.
“People from Japan, China, Russia and Germany love the Trinity,” says Balzano. “They love the food and they love the wine!”
The restaurant features 24 varieties of local wine, with help from Paolo D’Andrea from Luna Rossa Winery. Free wine tastings are offered Mondays-Saturdays.
Wayne Roberts, a front desk host at the hotel, has been with Trinity since it opened. He has one-on-one talks with guests and knows first-hand why they keep coming back.
“It’s consistently good,” says Roberts. “They love the specialty desserts and the service is always top notch.”

Gadsden High educator was recognized during National ProStart Educator Excellence Awards
The Hospitality Industry Education Foundation (HIEF) of the New Mexico Restaurant Association in partnership with the National Restaurant Association Educational Foundation (NRAEF) has named Shari Anderson of Gadsden High the New Mexico 2013 ProStart Educator Excellence Award recipient.
The NRAEF's ProStart Educator Excellence Awards recognize exceptional educators who utilize the ProStart program in their classrooms. Each participating state restaurant association nominates its leading educator who has demonstrated a strong commitment to his or her students and to the ProStart program. Award recipients were honored at the NRAEF's Educator Excellence Awards Dinner at the Hotel Sax Chicago on Friday, May 17.
"ProStart educators work exceptionally hard to give their students the opportunity to gain real-world experience through a curriculum that teaches all facets of the restaurant and foodservice industry," said Rob Gifford, executive vice president of philanthropic initiatives for the National Restaurant Association Educational Foundation. "The Educator
Excellence Award winners lead and inspire their students to succeed and are setting a high standard of excellence for students and the industry. They are very deserving of this honor.
Shari Anderson’s love of food began early in life by observing accomplished
culinary role models in her family. Her mom and grandmother instilled the pride of preparing healthy comfort foods on a limited budget, which Shari used working as a personal chef and in catering events.
Shari Anderson landed her ultimate dream position by combining her passion for cooking with her love of teaching when she was hired to teach the ProStart program at Gadsden High School. When Shari took over, the program had a dilapidated kitchen, leaking roof, and low student enrollment. She quickly updated the kitchen interior, and worked to get the roof repaired. A lot of recruiting and visibility on campus resolved the enrollment challenge, along with participation in the New Mexico ProStart invitational. Gadsden High School has represented NM three times at the National ProStart Invitational and placed in the top three levels at state in the culinary category over seven years.
According to the National Restaurant Association, total restaurant and foodservice employment is projected to grow by 11 percent over the next 10 years. The Foundation is committed to ensuring it supports the development of a highly-trained and professional talent pool through scholarships and educational programs such as ProStart, a two-year program that brings the industry and the classroom together to give 95,000 high school students nationwide a platform to discover new interests and talents, while opening doors to fulfilling careers.
