KSS College of Education, #1949/3, D.M.S. “Sadhana”, Last Bus Stop, Vidyanagar, Davangere District-577005, Karnataka had submitted an application to SRC, NCTE on 29.12.2001. The institution was granted recognition for B.Ed course on 04.01.2006.

The institution was also granted recognition for D.Ed. course on 04.12.2007 and that for M.Ed. course was given on 18.12.2007.

As per the decision of 175th meeting held on 13-14 May 2009, the institutions to which recognition was granted in temporary premises with a condition to shift to permanent premises within period of three years time limit of grant of recognition as per NCTE regulations 2002 notified in 18.11.2002 were considered. It was decided that institutions which had not shifted to the permanent premises even after the expiry of three years time limit be issued notice under Section 17 of NCTE Act. Accordingly, under Section17 notice was issued to the institution on 02.09.2009. The institution submitted its reply on 26.10.2009.

SRC in its 187th meeting held on 28-29 December 2009 considered the written representation and decided to withdraw recognition for B.Ed course with noted

reasons.

In the meantime, the institution had approached the Hon’ble High Court of Karnataka in W.P.3176 of 2010 and hence the withdrawal order could not be issued to the institution.

A letter was received from Sri.Ashok Haranahalli, Advocate by enclosing a copy of the order available on the High Court Website for immediate compliance. The order dated 02.02.2011 reads as under:

“Learned counsel for respondent submits that pursuant to the resolution No.3826 dated 29-30/12/2009 in withdrawing the recognition to the petitioner’s educational institute, the same has not been communicated to the petitioner and therefore the respondent seeks leave of the court to communicate that order. Permission is granted. Letter to be furnished to the learned counsel for petitioner within 10 days.”

Order withdrawing recognition was issued to the institution on 03.03.2011 for B.Ed course.

Thereafter, The Hon'ble High Court of Karnataka in W.P.3176 of 2010 dated 11.03.2011 passed the Order which reads as under:“… the 2nd respondent (NCTE) has to make an inspection of the new premises of the college in question. It should also accept the shifting fee from the petitioner. Therefore, the petitioner is directed to deposit a sum of Rs.40,000/- with the 2nd

respondent towards shifting fee within one weeks. The petitioner is further directed to deposit an additional sum of Rs.40,000/- with the 2nd respondent towards inspection fee within one week.”

The 2nd respondent was directed to inspect the new premises of the college in question within a period of four weeks from today and submit the report to the Court.

As per the directions of the Hon'ble High Court of Karnataka the institution in its letter dated 16.03.2011 submitted Rs.40,000/- vide DD.No.249036 dated 15.03.2011 towards shifting fee. The institution also submitted another letter dt.18.03.2011 by submitting another Demand Draft of Rs.40,000/- bearing No.121074 dated 18.03.2011 towards inspection fee. In this regard, it was pointed out that the institution submitted two Demand Drafts of Rs.40,000/- each. Inspection for shifting is to be conducted for three courses i.e D.Ed, B.Ed and M.Ed, therefore, the institution vide letter dated 23.03.2011 was requested to submit the Demand Draft of Rs.40,000/- more.

A Composite inspection of the institution was carried out for D.Ed. B.Ed and M.Ed courses on 29-30 March 2011, as per Court Orders. The inspection report along with VCD was forwarded to the Advocate for placing before the Hon'ble High Court of Karnataka along with detailed analysis.

(ii)(iii) The SRC in its 204th meeting held on 27-28 April 2011 considered the VT

Report, VCD and all the relevant documentary evidences and decided to issue Show cause Notice under Section 17 of NCTE Act.

Accordingly, Show cause notice was issued to the institution on 01.06.2011 for

all the courses. The institution submitted its written representation on 23.06.2011.which was placed in 208th meeting of SRC held on 13-14th July, 2011 and the SRC decided to withdraw the recognition of the institution for all the course i.e, D.Ed (APS05474), B.Ed(APS03826) & M.Ed( APS08208) courses on certain grounds.The Committee decided to withdraw recognition of the D.Ed course(APS05474) from the academic year 2012-13 so as to enable the ongoing batch of students in D.Ed course.if any , to complete their final year course.Accordingly, withdrawal order was issued to the institution vide Order No.F.No.APS05474-D.Ed./ APS03826-B.Ed./ APS08208-M.Ed ./KS/2011/30104 dated 5.9.2011Aggrieved by the withdrawal order, the institution preferred an appeal dated 07/09/2011 before the appellate authority ,which was heard on 03.11.2011.After perusal of documents, memorandum of appeal, Affidavit,VT report and after considering oral arguments advanced during the hearing, the council reached the conclusion that there was adequate ground to accept the appeal and reverse the SRC’s order dated 05-09-2011 vide Appellate authority order No.F.No.89-360/2011 Appeal/7th Meeting –2011 with a direction to the SRC for re- examination of the matter in totality, taking into consideration the abservation of the Council and for taking appropriate decision thereafter. Accordingly, the appeal was accepted and the order of SRC dated 05-09-2011 was reversed.

The secretary, KSS foundation Davanagere submitted its representation along with documents, appeal order to SRC vide its letter dt. 29.12.2011.

The representation along with details were paced in 218th meeting of SRC held on 28th February, 2012. The committee considered the appellate authority order and reply of the institution and decided to issue show cause notice for the following:-

There is a discrepancy in date/overwriting in building completion certificate submitted by the institution. Accordingly, a notice was issued to the institution on 02.04.2012. The institution submitted reply vide letter dt. 23.04.2013.

The SRC in its 237th meeting held on 5th – 6th Jan, 2013, considered the reply of the institution vide letter dt. 23.04.2012 and all the relevant documentary evidences and decided to serve final show cause notice under NCTE Act.

Accordingly, a final show cause notice was issued to the institution on 08.03.2013. The institution submitted a written representation on 28.03.2013.

The SRC in its 243rd meeting held on considered the written reply of the institution on the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

The institution is having only 8000 sq.ft of land area, which is grossly inadequate and requirement of 3500 sq.mtrs for offering D.Ed, B.Ed & M.Ed courses as per NCTE regulation 2009.

Up-to-date encumbrance certificate issued by sub-registrar is not submitted.Land is still in the name of the Society, not in the name of the Institution.

As per NCTE Regulations 2009, 8 (7) (iv) The society sponsoring the institution shall be required to transfer and vest the title of the land and building in the name of the institution within a period of six months from the date of issue of formal recognition order under sub-regulation (11) of Regulation 7. However, in case, the society fails to do so due to local laws or rules or bye-laws, it shall intimate in writing with documentary evidence, of its inability to do so. The Regional Office shall keep this information on record and place it before the Regional Committee for its approval.

Building completion certificate is not duly furnished with adequate information. Building completion certificate submitted is in the name of KSS foundation and not in the name of the College, hence, it is not clear whether the building completion certificate is exclusively for the course (B.Ed) being run by the institution or not. Type of roofing is not mentioned.

Notarised land usage certificate from the Revenue divisional office stating that the agriculture land converted to non-agriculture for the educational purpose is not submitted.

Based on the above points the Committee decides to withdraw the recognition of all the course viz., D.Ed (APS05474), B.Ed (APS03826) & M.Ed (APS08208) courses run by the KSS College of Education, 1949/3, D.M.S. “Sadana”, Last Bus Stop, Vidyanagar, Davangere District-577005, Karnataka, from the academic year 2013-14, in order to enable the ongoing batch of students in D.Ed, B.Ed and M.Ed courses, if any, to complete their course.

But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order. The Affiliating body / Examining board / body be informed accordingly. Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore, if any.

Aggrieved by the decision of SRC, the institution has approached Hon’ble Court in W.P.No.20868/2013 against SRC, NCTE and NCTE, New Delhi wherein SRC, NCTE is the 1st respondent and NCTE, New Delhi is the 2nd respondent.

A draft withdrawal order was prepared and put up for orders.

In the meantime, on 17.5.2013, a copy of Court Notice dated 16 th May, 2013 is received from the institution to appear before the Hon’ble Court within 5 days of the service of the notice in W.P. No.20868/2013 against the decision to withdraw recognition to B.Ed., M.Ed. and D.Ed. courses by SRC, NCTE.

An interim order is also served as under:- “Learned Sr. Counsel Sri. Subramanya Jois appearing for the petitioner would submit that in similar circumstances this court has granted interim order in W.P. 18924/2013 and seeks relief by a parity of reason. Accordingly, interim stay as prayed for till next date. Issue emergent notice re-rule. Post along with W.P.Nos.17161-17162/2013 on 5.6.2013.

Note : It is prayed to stay the withdrawal of recognition in respect of the KSS College of Education, Saraswathinagar, Davanagere-577004, under and in pursuance of Annexure-Q, dated 29/30.4.2013.”

A letter is addressed to the advocate to vacate the interim stay granted to the institution is sent on 27.5.2013. A brief of the case is also sent to the advocate for defending the matter on behalf of SRC, NCTE.

(iv)The Committee considered the matter and decided to get the ‘stay’ vacated through our advocate and also to inform the advocate to move for dismissal of petition filed by the petitioner.

(v)4. APS02383

B.EdSunitha Mahila

Mandali’s Gurukul

College of Education,

Mysore.KA

W.P.No.26012/2010 filed by Sunitha Mahila Mandali’s Gurukul College of Education, No.1241, Sri Ganesha Complex, Gurukulam 2nd stage, Near Trinetra Circle, Mysore-570002, Karnataka(APS02383) against NCTE, New Delhi and SRC, NCTE.

Sunitha Mahila Mandali’s Gurukul College of Education, No.1241, Sri Ganesha Complex, Gurukulam 2nd stage, Near Trinetra Circle, Mysore-570002, Karnataka(APS02383) was granted recognition on 8/11/2006 from the academic session 2006-07 with an annual intake of 100 students.

Based on complaint from Sri. Chikkanna, Governing Council Member, Gurukul B.Ed. College, Mysore regarding mis management of the funds collected as fees from the students without providing basic amenities. An inspection of the institution was conducted and based on the report of the Visiting team, the Committee in its 193rd meeting held on 21-22 June, 2010 decided to withdraw recognition of the institution for B.Ed. course and Withdrawal order was issued to the institution vide order No.F.SRO/NCTE/2010-2011/20051 dated 28.07.2010.

Aggrieved by the withdrawal order, the institution without preferring an appeal has approached the Hon’ble High Court of Karnataka vide W.P.No.26012 of 2010 filed by Sunitha Mahila Mandali.

Notice was received from Hon’ble court on the Writ petition on 09.09.2010. A letter was addressed to the Advocate on 14.09.2010 along with a brief of the institution for defending the case. But, on 8.12.2010, the institution has produced a copy of the stay order and has requested RD, SRC, NCTE to give a direction to CAC for admission of students.

On 15.12.2010, this office has issued a letter to the Special Officer for admission of students in lieu of stay order of Hon’ble High Court of Karnataka. A letter was also addressed to the Advocate on 22.12.2010 duly signing the statement of objections and affidavit for filing before the Hon’ble Court. On January 5, 2011, another letter was addressed to the advocate enclosing the documents for filing statement of objections.

On 28.02.2012, a complaint is received from Sri. M.C. Chikkanna, Ex-Member of Corporation, Governing Council Member, Gurukul B.Ed. College, Mysore alleging that the institution is offering not only B.Ed. course but also Nursing course and that whenever inspection team is arriving suitable arrangements were made by putting different boards at the same place and has requested to conduct an enquiry as to how the institution is running many courses at the same place without providing proper infrastructure.

On 14.09.2012 another complaint has been received from Sri.M.C.Chikkanna, Member, College Governing Council stating that

“Gurukul B.Ed College is running by violating the rules and regulations laid down by the government ,NCTE and Mysore University. Gurukul B.Ed College has permission for admission of 100 students. The college does not have the class rooms to accommodate 100 students. Library, Labs and computers are not available. On the whole the college does not have basic infrastructure for running the college. But still the college is running the B.Ed course. This only shows that the management officials are corrupt and the college is running owing to political pressure.Admission to Gurukul B.Ed College can be obtained in two ways.

(1) Students who pay the amount mentioned by the management authorities without asking for a receipt for the paid amount and questioning the misdeeds of the management will be admitted.

(2) Students get admitted by paying the amount fixed by the management but do not attend college. They come only for the exams. They are not supposed to question the lack of infrastructure and misdeeds of the management. Students are blackmailed that If questioned , their internal assessment marks will be cut.

The college does not have lecturers who are approved by the University. Lecturers are not appointed on the basis of qualification and interview. Lecturers are appointed on the recommendation of the secretary and president and the Managing Committee. Most of the lecturers are not qualified , instead of teaching the students they are collecting fees, admitting students to the college on commission basis .They are unfit to be called as lecturers. They can be called as brokers rather than lecturers. until they get the approval of the University, they will not function as lecturers, instead they will function as brokers for the management. Students who question these irregularities will be intimated to the management and their internal assessment marks will be cut.

Sunitha Mahila Mandali Trust is running various courses in Mysore and the these courses are run with the intention of making money only. In view of the illegal activities of the management, the government vide its office memorandum has cancelled the managing Committee and appointed an administrative officer. All the above said information is known to the authorities of Mysore University and college development council .Professor V.G. Talwar in the syndicate meeting of the University discussed the issue of Gurukul B.Ed College and decided to discontinue the affiliation of the college. I have enclosed the report in the newspaper regarding this.I am not wrong if is say that the college is existing in spite of all this means there exits corruption , political pressure and sexual favours. You are requested to take suitable action for the closure of this college which is running with illegal activities and irregularities and without the basic infrastructural requirements.”

The SRC in its 241st meeting held on 29th & 31st March and 1st April, 2013 considered the complaint letter dt. 14.09.2012 and decided to send the complaint matter to Registrar & Vice Chancellor of Mysore University for their comments. As per the decision of SRC, a letter was addressed to the Registrar and copy marked to the Vice-Chancellor on 01.06.2013.

In the meanwhile, on 19.3.2013 and 30.4.2013 a letter dated 26.2.2013 is received from the advocate, Ashok Haranahalli Associates stating that “the above writ petition is filed questioning the order dated 28.7.2010 passed by the 2nd respondent-SRC withdrawing the recognition granted to the petitioner-

institution.

The above court matter came up for consideration before the Hon’ble High Court today for preliminary hearing in ‘B’group. After hearing the matter, the Hon’ble Court granted time to the petitioner-institution to complete the new building and to comply with the NCTE regulations. It was also observed that till the completion of the building, the petitioner institution shall not make any admission of students. With the above observation, the writ petition was disposed off.

I have applied for the certified copy of the final order, and the same will be sent to you on its receipt.”

The Committee considered the Hon’ble High Court order and also letter from our advocate regarding “granting of time to the petitioner-institution to complete the new building and to comply with the NCTE regulations. It was also observed that till the completion of the building, the petitioner institution shall not make any admission of students”.

(vi)(vii) The committee decided and advised SRO to write to the lawyer to

file an appeal immediately and to cite the Hon’ble Supreme Court orders while filing the appeal. The Hon’ble Supreme Court order says:

Keeping in view, Supreme Court vide their order in Civil Appeal No. 1125-1128/2011 in SLP No. 17165-68/2009 filed by NCTE Vs ors, which reads as under:

“An institution is not entitled to recognition unless it fulfills the conditions specified in various clauses of the Regulations. The Council is directed to ensure that in future no institution is granted recognition unless it fulfils the conditions laid down in the Act and the Regulations and the time schedule fixed for processing the application by the Regional Committee and communication of the decision on the issue of recognition it strictly adhered to”.

Judgment passed by Hon’ble Supreme Court of India in SLP © No. 14020/2009 filed by Adarsh Shiksha Mahavidalaya & others Vs Subhash Rahaangdale & others is:

“ In future, the High Courts shall not entertain prayer for interim relief by unrecognized institutions and the institutions which have not been granted affiliation by the examination body and or the students admitted by such institutions for permission to appear in the examination or for declaration of the result of examination. This would also apply to the recognized institutions if they admit students otherwise than in accordance with the procedure contained in Appendix-1 of the Regulations”.

5. APS03222D.Ed-AIShreyas Teacher Training Institute,

W.P.No.14068/2011 filed by Shreyas Education Trust and another Vs. NCTE and another.

Shreyas Teacher Training Institute, Ramakrishna Extension, Srinivasapura Taluk, Kolar District-563135, Karnataka for offering D.Ed-AI with an existing intake of 90 students and additional intake of 30 students thus making an annual

intake of 120 students vide order dated 15.12.2004.

In the mean time NCTE, Hqrs vide its letter dated 19.11.2010 has forwarded a copy of the inspection report dated 14.06.2010. As there are deficiencies pointed out in the inspection report, NCTE Hqrs has decided that SRC, NCTE may look into the matter to ascertain the adherence of norms and standards by the institution and requested to take appropriate action.

Section I.02 The SRC in its 198th meeting held on 24-26 November 2010 considered the VT report and all the relevant documentary evidences and decided to issue showcause notice. Accordingly, Showcause Notice was issued to the institution on 11.01.2010. The institution has submitted its written representation on 03.02.2011.Section I.03 The SRC in its 201st meeting held on 22-23 February, 2011 considered the written representation and other relevant documents and found the reply unsatisfactory and unconvincing and hence decided that one Basic Unit of 50 students only for D.Ed course (APS00493) is permitted to continue; as built up area is inadequate to run any additional intake, the D.Ed-Al intake (in excess of basic unit of 50) (APS03222) be withdrawn. The committee further decided to inform the Affiliating/ Examining body for necessary action. Accordingly, withdrawal order is issued to the institution on 25.3.2011 for D.Ed. additional intake(APS03222) course.

Aggrieved by the withdrawal order, a writ petition No.14068/2011 is filed by Shreyas Education Trust questioning the order passed by NCTE dated 25.3.2011.

A letter is received from Ashok Haranahalli Associates dated 21.1.2013 received by this office on 30.4.2013 states that “The above matter listed before the court today for preliminary hearing. The matter was heard at length. In the course of the argument, it was pointed out by the counsel for NCTE that the petitioner institution is till today lacking in complying with deficiencies found by the SRC. After hearing the matter, the court has extended the time upto 4 months to comply with the deficiencies pointed out by the SRC and if so complied, the SRC has been directed to consider the matter and if necessary to conduct an inspection within one month thereafter.

I have applied for the certified copy of the said order and it will be sent to you as and when it is received.”

Till date there is no representation from the institution regarding the removal of the deficiencies pointed out in the withdrawal order dated 25.3.2011.

The Committee considered the matter and decided to write to the Lawyer to file an appeal against the Hon’ble High Court order where in the Court has directed the petitioner and “extended the time up to 4 months to comply with the deficiencies pointed out by the SRC and if so complied, the SRC has been directed to consider the matter and if necessary to conduct an inspection within one month thereafter”.

The lawyer to be informed to cite the Hon’ble Supreme Court order while filing an appeal prescribing a rigid time-schedule, The supreme court order reads as under:

The committee decided and advised SRO to process the case relating to the basic D.Ed (APS00493) course and put up in the meeting.

6. APS02187B.Ed

Sree Krishna College of Education,

Tumkur District

Sree Krishna College of Education, Mahalakshminagar, Batawadi, Tumkur District, -572101, Karnataka

The institution had submitted an application for starting B.Ed course on 20.07.2004. The institution was granted recognition on 09.12.2004 with an intake of 100 students with the condition to shift to its own premise within 3 years.

This office is in receipt of letter No.TY:VCPS:2011-12:98 dated 21.05.2011 from the Vice-Chancellor, Tumkur University, Tumkur by enclosing a list of 19 institutions with the committee observations by conducting inspections.

The SRC in its 206th meeting held on 9-10th June, 2011 noted the inspection report of the Vice-Chancellor, Tumkur University, dt. 21.05.2011 and the deficiencies in the 19 institutions in Tumkur District and decided to issue show cause notice under section 17 of NCTE Act. Accordingly, a show cause notice was issued to the institution on 11.07.2011. The institution had replied vide letter dt. 22.08.2011.

The Committee in its 211th meeting held on 21-23 September, 2011 considered the letter dt.21.05.2011 from Vice-Chancellor, Tumkur University pointing out deficiencies in the 19 Tumkur University colleges and also reply of the above institution dt. 22.08.2011 and other documents submitted by the institution and decided to cause composite inspection for all the courses at premises under Section 17 of NCTE Act, to verify whether the institution is maintaining instructional and infrastructural facilities as per NCTE norms. The institution was intimated for the same vide letter dated 4.10.201

Accordingly, the inspection of the institution was carried out on 29/10/2011. In the meanwhile, Tumkur University vide their letter received on 17.10.2011 had conducted re-visits to the institution during 15-19 and 27th of July, 2011. The management is also running D.Ed course in the same building.

The SRC in its 215th meeting held on 12th and 13th December, 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was

decided to serve Show cause Notice under section 17 of NCTE Act,for the following:-

The management has not submitted Re-inspection fee of Rs. 40,000/-As per VT report, total built up area available for B.Ed course & D.Ed course

together is 2300 sq.mrs. which is grossly inadequate for both the courses. As per NCTE norms 3000 sq.mrs Approved building plan by the competent civil authority is not submitted. The institution is required to submit fresh blue print and it should be clearly mentioning i.e. Khasara no, plot no, proposed course, total area, built up area duly approved by competent authority with resolution in all respect. If the institution is running other teacher education courses / other technical courses in the same premises, the institution is required to mention earmarked area for proposed course with total area and built up area.

Building completion certificate from competent Govt. authorized engineer is not submitted.

Original Land usage certificate from competent Govt. authority is to be submitted.

Non-encumbrance certificate from a competent Govt. authority is not submitted.

Byelaws of the Society are not submitted by the management. The Principal is not qualified as per NCTE norms. Experience certificate and

percentage of marks are not mentioned.The post of lecturer in foundation courses (one post) is vacant, not filled up.One post of Methodology courses (Six posts) is vacant, not filled up.Part time post of Lecturer in Art Education (one post) and Director of Physical

Education (one post) is not filled up.The staff list is not approved by the affiliating body.The management is paying salary to the staff is by cash not through Bank

Cheque.

Accordingly, a Show Cause Notice is issued to the institution on 13.02.2012. But, so far there is no reply from the institution.

The Committee in its 224th meeting held on 14-17 June, 2012 considered the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

The management has not submitted Re-inspection fee of Rs. 40,000/-. As per VT report, total built up area available for B.Ed course & D.Ed course together

is 2300 sq.mrs. which is grossly inadequate for both the courses. As per NCTE

norms 3000 sq.mrs Approved building plan by the competent civil authority is not

Aggrieved by the withdrawal order of SRC,NCTE, the institution filed an appeal before the appellate authority and the appellate authority vide order dated 03/01/2013 confirmed the order appealed against.

In the mean time , the institution has filed a writ petition in the hon’ble High Court of Karnataka in W.P.No. 3012/2013.

The institution has submitted a written representation on 06/03/2013 requesting for review of recognition withdrawal order .

The Hon’ble High Court of Karnataka in W.P.No. 3012/2013 dated 08/02/2013 has disposed the petition as under ;-“ It is seen that the Petitioner-institution is established since 2004-2005 and was running in a very disciplined manner by admitting candidates for all the academic years till now. The third respondent-NCTE having observed certain deficiencies, issued a Show Cause Notice on 11.07.2011 under section 17 of the NCTE Act, asking to reply within 30 days. However on 13.04.2012 itself reply is said to have been submitted by the Petitioner-institution. Ultimately, a final order has been passed by the third and the fifth respondents, in the middle of the year, to stop admissions for the academic year 2011-12..But what is to be noticed is, when an authority has raised certain queries or pointed out some irregularities or any other deficiency and asks the management to stop admissions for the academic year, it was for the institution to approach the authority well before starting admissions for the academic year the petitioner institution has also not approached this court seeking for any similar directions to consider its case. The petitioner could have questioned the same before commencement of admission or it could have sought for an interim order/interim direction seeking permission

to admit students. However, it is for the petitioner-institution to approach the respondent NCTE.Since the petitioner has approached belatedly regarding its grievance against the NCTE and also when the authorities have specifically directed the petitioner institution not to admit the students for the academic year 2011-12, the petitioner-institution can approach once again to take review of order passed by respondent-NCTE and seek for regularizing the admissions made without the permission of the Government or the University.With the above observation, this petition stands disposed of. ”Note :

1. It is observed from the court order dated 08/02/2013 that the institution has admitted students for the year academic session 2011-12.But the request of the institution is to regularize the admissions made for the year 2012-2013 that is after the issue of withdrawal order dated 09.07.2012

2. As seen from the court order, the institution has stated that it has submitted representation on 13.04.2012, but no representation is submitted to this office by the institution as per office records.

The above matter was considered by SRC in its 241st meeting of SRC held on 29th March to 1st April 2013 and the Committee decided as under:-“ To regularize 2011-2012 because of Court Order, Reject the request for 2012-2013,Reiterate our withdrawal order. Quote the court order about not showing any sympathy for admissions made in anticipation of Formal Recognition.”

On 03/04/2013, Secretary, Sree Krishna College of Education has submitted a written representation with a request for review of the recognition withdrawal order for the academic year 2012-2013 which is as under ;1. W.P.No. 3012/2013 dated 08/02/2013 on the file of High Court of Karnataka2. W.P.No. 12764/2013 dated 18/03/2013 on the file of High Court of Karnataka3. Withdrawal order dated 09/-07/2012

1. As you are aware the recognition of our college was withdrawn from your esteemed council owing to some deficiencies in the college on 09/07/2012 and the college was given time to appeal to the National Council, New Delhi within 60 days from the date of order passed.

2. Since we were given 60 days time for appeal we submitted the relevant documents as we had already complied with all the deficiencies listed by the SRC Inspection Committee and waited for further orders from the National Council. Since we had complied all the deficiencies, in anticipation of reconsideration of the withdrawal order from the NCTE, New Delhi we made the admissions for the academic year 2012 - 2013. As the time taken by NCTE, New Delhi to complete the procedure of disposing the appeal application took time till January 9th , 2013. It was inevitable for us to complete the admission procedure within time as per the calendar of events of Tumkur University as we had already made admissions before SRC,NCTE passed the withdrawal order of recognition.

3. Keeping in view of the future of students admitted for the academic session 2012-13 the withdrawal order was challenged in W.P.No. 3012/2013.The hon’ble High Court order dated 08.02.2013 passed an order directing to file a review petition for regularization of admission made for the year 2012-13 and also for

grant of recognition.4. We submit that we have submitted the review petition on 05/03/2013 to

review the order of withdrawal of recognition and also for regularization of admission made for B.Ed course for 2012-2013.

5. Since the same was not considered the review petition submitted in terms of the directions of the Hon’ble High Court in W. P. No. 3012/13 dated 08/02/2013 we have filed a writ petition No.12764/2013. The Hon’ble High Court vide order dated 18/03/2013 directed you to pass orders on review petition dated 05/03/2013 within three weeks. The copy of the order dated 18/03/2013 is enclosed herewith for your ready reference and to pass appropriate orders.

The Hon’ble High Court of Karnataka in W.P.No. 12764 dated 18/03/2013 has disposed the petition as under:-“ After the disposal of the writ petition, petitioner-institution has made a representation dated 05.03.2013 addressed to the Regional Director, Southern Regional Committee,National Council for Teacher Eduation,Bangalore making a request for review of the order withdrawing the recognition granted to the petitioner-institution and regularize the admissions already made.The present writ petition is filed making a grievance that this representation is not considered and therefore, a direction be issued to respondent No.1.

I find that the representation is made very recently on 05.03.2013.In the light of the observations already made by this court, I am sure the 1st respondent will consider the same in accordance with the law. Petitioner-institution is not justified in rushing to this Court within two weeks from the date of making such a representation even accepting the submission made by the learned counsel for the petitioner that it will affect the interest of the petitioner-institution. The fact remains that some reasonable time has to be granted to respondent No.1 to take a decision based on the observations made by this court. If the first respondent does not take any decision within a matter of three weeks from today, the petitioner can approach this court seeking a direction as sought in this writ petition. At this stage, I do not find any need to interfere in the matter. Hence the writ petition is disposed of with the above observations.”

The SRC in its 242nd meeting held on 14-16 April, 2013 considered the matter and decided that,

1) the admission of students by the institution for the sessions when the proceedings were in progress for removal of deficiencies was not correct and not in line with Hon’ble Supreme Court order, which reads as under:

Judgment passed by Hon’ble Supreme Court of India in SLP © No. 14020/2009 filed by Adarsh Shiksha Mahavidalaya & others Vs Subhash Rahaangdale & others is: “ In future, the High Courts shall not entertain prayer for interim relief by unrecognized institutions and the institutions which have not been granted affiliation by the examination body and or the students admitted by such institutions for permission to appear in the examination or for declaration of the result of examination. This would also apply to the recognized institutions if they admit students otherwise than in accordance with the procedure contained in Appendix-1 of the Regulations”.

2) Original order for withdrawal of recognition was correct because many deficiencies were there. It is reiterated that Southern Regional Committee has no power to ‘review’ the institutions request for ‘review’ can not, therefore, be considered.

As per the decision of SRC, a letter is addressed to the institution on 16.5.2013 along with a copy marked to the Advocate(copy enclosed).

In the meanwhile, on 22.5.2013, a copy of the Court Notice dated 14th May, 2013 in W.A. No. 1852 of 2013(EDN-REG-P) filed by Sree Krishna College of Education, Tumkur is received by this office on 22.5.2013. An interim order of stay is granted to the institution to issue Emergent Notice and Respondents 2 and 3 are directed to permit the petitioner to pay the examination fees in respect of 5 students who are taking up the examinations scheduled to be held on 15.5.2013 and subject to the result of this writ appeal(copy enclosed).

Further, a letter is addressed to the advocate for vacation of stay granted to the institution and to file a detailed counter affidavit for defending the matter on behalf of NCTE .

The Committee considered the direction (dt. 14.05.2013) of the Hon’ble High Court to permit the petitioner to pay the examination fees in respect of 5 students who are taking up the examinations scheduled to be held on 15.05.2013 and subject to the result of this writ appeal. Since the date of examination is over (i.e, 15.05.2013), it is decided by the committee to await the final orders of the Hon’ble High Court.

Further, 8(7)(i) of NCTE Regulations reads as under:

No institution shall be granted recognition under these Regulations unless the institution or society sponsoring the institution is in possession of required land on the date of application. Tland free from all encumbrances could be either on ownership basis or on lease from Government or Government institutions for a period of not less than 30 years. In cases where under relevant State or Union Territory laws the maximum permissible lease period is less than 30 years, the State Government or Union Territory Administration law shall prevail. However, no building shall be taken on lease for running any teacher training course.

In this application the following has been observed:

Although Gift Deed is registered in favour of the Trust, but in the Deed it is mentioned that the property described upon which Educational Campus is situated remained in the name of Donor Mrs. K. Umavathy herself. This need clarification from institution.

The above matter was placed before SRC in its 243rd meeting held on 29th April – 01st May 2013 and the committee considered the matter and observed that, “there is a mix up of two institutions – Amman Teacher Training Institute and Amman College of Education. Amman T.T.I have D.T.Ed and D.T.Ed-Al courses, whereas, Amman College of Education have applied for B.Ed-Al, but there is no reference to the basic course of B.Ed run by the Amman college of Education. The institution vide its letter dated 30.06.2009 submitted Rs. 40000/- information about college shifted to own premises was considered in SRC in its 181st meeting held on 20th-21st

August 2009 wherein, it was decided that the institution which have not shifted to the permanent premises even after the expiry of three years time limit be issued notice under Section 17 of NCTE Act for further action. Accordingly a notice has been issued to the institution on 16.09.2009. The institution vide its letter dated 01.10.2009 submitted reply to notice.

The inspection report was placed before 105th SRC meeting held during 02nd - 03rd December 2005.After considering the application and other relevant materials furnished by the applicant institution, had noted that the applicant institution does not fulfill the requirements and issued a notice on 12.12.2005 to the applicant institution under proviso to Section 14(3)(b) of the NCTE Act, 1993, thereby giving an opportunity to the said applicant institution to make a written representation in this behalf.The written representation submitted by the said institution 26.12.2005 was considered by the Regional Committee in its 106th

meeting held on 15th –16th

December 2005 and in 107th meeting held on 27th

December 2005 decided to accord recognition.Some of the institutions who have been granted recognition for the subsequent year have preferred appeal before NCTE, New Delhi to reconsider their cases of grant of recognition for the session 2005-06 itself instead of 2006-07. AP Rangareddi District – 501301, Andhra Pradesh for D.E.C.Ed Course of Two years duration under Section 14(1) of the NCTE Act, 1993 to the Southern Regional Committee, NCTE online on 28.09.2011 and physical application has been received in the office of SRC on 30.09.2011.

The application was scrutinized and a copy of application was sent to State Government for recommendation on 18.10.2011/03.12.2011 (Reminder). A deficiency letter was issued to the institution on 28.12.2011. Now the institution has replied to the deficiency letter on 23.02.2012.

The SRC in its 220th meeting of SRC held on 30-31st March 2012 considered the written reply of the institution vide letter dt. 23/02/2012 and other relevant documents and decided to cause inspection to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, under Section 14 (1) of NCTE Act.

Accordingly, the inspection of the institution was fixed between 1st – 5th of May 2012, the same was intimated to the institution on 25.04.2012. The inspection of the institution was conducted on 01.05.2012.

(i) The SRC in its 223rd meeting held on 29th-31st May 2012, considered the VT report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under section 14 (1) of NCTE Act.

Accordingly, a show cause notice was issued to the institution on 27.06.2012. The institution has submitted its written representation on 17.07.2012.

(ii)The reply of the institution to the show cause notice was duly considered and the reply is unconvincing and not satisfactory, deficiencies still persist as under:

As per on-line application, the course applied is for D.E.C.Ed and whereas the institution is requesting for D.El.Ed course. Change of course from on-line course is not permissible as per NCTE Regulations 2009.

In the approved building plan copy submitted, extent of land area, total built up area and proposed college name is not mentioned.

Building completion certificate submitted is not signed by the competent Govt. Engineer, Column No. 9 is not duly filledup for course name and column No, 11 type of roofing is not given.

Details of other courses being run by the institution are not given

The reply to the show cause notice is not satisfactory and unconvincing.

Under the above grounds and with reference to the totality of information collected & based on a collective application of mind, the SRC in its 228 th

meeting held on 24th-25th July 2012, decided as per NCTE Regulations 2009, to refuse and reject the application of the institution for recognition of D.E.C.Ed course.

Accordingly, a rejection order was issued to the institution vide No. F.No.SRCAPP937/ D.E.C.Ed/AP/2012-13/45092 dated 10.08.2012.

Aggrieved by the rejection order of SRC, the institution preferred an appeal to NCTE-Hqrs and the appellate authority in its order No. F.No. 89-16/2013Appeal/7th Meeting-2013 dated 14/05/2013 stated that

“…after perusal of the documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the council concluded that the matter deserved to be remanded to the SRC to examine the proposal of the institution for grant of recognition for D.El.Ed course as per the Regulations.

The council hereby remands back the case of Sri Vidya Vihar College of Elementary Education, Rangareddy, Andhra Pradesh to the SRC, NCTE for necessary action as indicated above.”

The Committee considered the matter, noted the Appellate authority order dt. 14/05/2013, wherein the appellate authority has remanded back to SRC to examine the proposal of the institution for grant of recognition for D.El.Ed course as per the Regulations. Accordingly the committee decided to process the application of the said institution for (D.Ed) D.El.Ed course as per the regulations.

9. APS04570/ APS04572

B.Ed/D.T.Ed

G.K. College of Education

and G.K. Teacher Training Institute,

G.K. College of Education and G.K. Teacher Training Institute, No.10/44, Small Street, Cheyyer Town, Thiruvannamalai, Pin - 604 407, Tamilnadu had submitted the applications for B.Ed on 22.05.2006. The institution was granted recognition for B.Ed course on 06.11.2007 with an annual intake of 100 students with the condition to shift to own premises within 3 years.

The institution its vide letter dated 10.07.2009 had submitted for a proposal for change of premises along with Rs.40,000/- at Pandiyampakkam Village, Cheyyar Taluk, Thiruvannamalai, Tamilnadu. The inspection of the institution was fixed between 11th - 16th April, 2011. The same was intimated to the institution on 06.04.2011. Accordingly, inspection of the institution at proposed premises for shifting was conducted on 22.04.2011.

The SRC in its 205th meeting held on 18th - 19th May, 2011 considered the VT Report, VCD and all the relevant documentary evidences and decided to serve Show cause Notice for both courses D.T.Ed & B.Ed under Section 17 of NCTE Act. Accordingly, a Show cause notice was issued to the institution on 15.06.2011. The institution had submitted its reply on 28.07.2011 and 23.08.2011.

The SRC in its 211th meeting held on 21st - 23rd September, 2011 considered the written representation of the institution dated 28.07.2011 and 23.08.2011 and other documents submitted by the institution and decided to cause composite inspection for all the courses (i.e. B.Ed, D.Ed) at the new premises under Section 17 of NCTE Act with a direction to the institution to submit duly filled in Questionnaire along with all the necessary documents for land, building approval and building completion certificate from a competent Govt. Engineer and other relevant documents along with Demand Draft of Rs.40,000/- inspection fee for each course being run, in favour of “The Member Secretary, NCTE” payable at Bangalore. Accordingly, a letter was issued to the institution on 16.11.2011.

The institution had submitted its reply on 21.12.2011 towards inspection fee bearing DD No. 103128 dated 15.12.2011 for Rs. 40,000/- for B.Ed course. The

institution had not submitted the necessary documents.

As regards D.T.Ed course the institution stated that the inspection of D.T.Ed course may not be done at this stage as the building for shifting the course was not constructed.

However, the inspection of B.Ed course was conducted on 07.02.2011.

In the meantime, the matter was again inadvertently placed before SRC in its 216th meeting held on 11th - 12th January, 2012 pending receipt of VT report in respect of B.Ed course and the matter was decided as under:-

B.Ed. Course (APS04570):

The SRC in its 216th meeting held on 11th - 12th January, 2012 considered the written reply of the institution vide letter dated 21.12.2011 and all the relevant documentary evidences and decided to serve Final Show Cause Notice under Section 17 of NCTE Act to B.Ed course (APS04570).

Accordingly, a Show cause notice was issued to the institution on 25.02.2012.

D.T . Ed. Course (APS04572):

The SRC in its 216th meeting held on 11th - 12th January, 2012 considered the written reply of the institution vide letter dated 21.12.2011 and all the relevant documentary evidences and it was decided to serve Show Cause Notice under Section 17 of NCTE Act to D.T.Ed course (APS04572). Accordingly, a Show cause notice was issued to the institution on 25.02.2012.

The institution had submitted its written representation on 15.03.2012 for B.Ed and D.T.Ed course. Since the said notices was issued on the basis of 216 th

meeting minutes without taking into consideration the visit conducted on 07.02.2012 in respect of B.Ed Course, therefore, the SRC, in the first instance, had to examine the VT report for B.Ed course and thereafter, the reply dated 15.03.2012 of the institution in respect of D.T.Ed course. The same is being done here under one by one.

The Southern Regional Committee in its 234th Meeting held on 17th - 18th

October, 2012 considered based on the VT reports, reply submitted by the institution to the show cause notice and other related documents, it is concluded that the management is not maintaining norms and standards prescribed by NCTE for both B.Ed and D.T.Ed course.

1. The institution is still not ready to shift D.T.Ed course even after the completion of more than 5 years. The management has accepted that the building is not constructed for D.T.Ed course.

2. Original certified copy of the land documents from Govt. authority is not submitted.

3. In the affidavit submitted, total built up area is not mentioned.

4. Original building completion certificate from competent Govt. engineer is

not submitted.

5. Notarized land usage certificate from the Revenue divisional office stating that the agriculture land converted to non-agriculture for the educational purpose is not submitted. Proceedings of Revenue Divisional Officer not submitted for conversion of land from agricultural to educational purposes.

6. Up-to-date notarized English version of encumbrance certificate issued by sub-registrar is not submitted.

7. Original FDRs of Rs. 5 lakhs & 3 lakhs towards endowment and reserve fund from a Nationalized Bank in joint account for each course is not given.

8. As per VT report, Others lab, Science lab, Psychology lab & Education Technology lab is inadequate and needs to be strengthened.

9. As per VT report, seating capacity in the library is only 25, which is inadequate for both the course i.e. B.Ed and D.T.Ed, as per NCTE norms.

10. As per VTR, No. of books available in the library is only 1500 for both D.T.Ed and B.Ed courses, which is less than the requirement as per NCTE norms for both the courses.

11. There are no subscribed Journals in the Library.

12. The B.Ed institution is also not maintained as per NCTE norms and standards. There are many deficiencies as listed above and the reply to the show cause notice is not satisfactory and convincing.

Based on the above points, the Southern Regional Committee in its 234 th

Meeting held on 17th - 18th October, 2012 decides to withdraw the recognition of the both B.Ed & D.T.Ed courses run by the G.K. College of Education and G.K. Teacher Training Institute, No. 10/44, Small Street, Cheyyer Town, Thiruvannamalai, Pin - 604 407. Tamilnadu from the academic year 2012-13 in order to enable the ongoing batch of students in B.Ed & D.T.Ed courses, if any, to complete their course.

Accordingly, withdrawal order was issued to the institution from the academic year 2012-13 on 27.11.2012 D.T.Ed. Course (APS04572) and for B.Ed. Course (APS04570).

The Southern Regional Committee in its 243rd Meeting held on 29th - 30th April, 2013 considered the Appellate authority order dt. 01.04.2013 and decided to process the application by re-examination so as to assess the claim of the appellant with regard to the adequacy of the available infrastructure and instructional facilities for B.Ed course exclusively and to take further action as per the Regulations and advised Southern Regional Office to put up the B.Ed case in the 246th SRC meeting.

(iii) Accordingly, the file is examined.

In the meantime, the institution vide letter dt. 10.05.2013 has requested “In view

of the order of the Appellate Authority passed on the above matter, we earnestly request your good self to kindly look into the issue as afresh and to pass necessary orders so as to enable our management to run the B.Ed, course with an annual intake of 100 students continuously uninterrupted., Since the academic year 2013-14 commences from 1st June, 2013, needful may be done at the earliest so as to enable us to go ahead with the B.Ed course for the academic year 2013-14 also in order to save the working days to be prescribed by the affiliating University / examining body”.

The Committee considered the Institutions request for closure of D.Ed course and decided to permit the closure by withdrawing the recognition for (APS04572) D.T.Ed course with effect from 2013-2014, in order to enable the ongoing batch of students in D.T.Ed, course, if any, to complete their final year course.

But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order.

The Affiliating body / Examining board / body be informed accordingly.

Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore, if any,

The Committee as per the decision of 243rd meeting held on 29-30th April, 2013 considered the appellate authority order dt. 04.05.2013 to process file of the institution to assess the claim of the appellant with regard to the adequacy of the available infrastructure and instructional facilities for B.Ed course exclusively, and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

(ii) The SRC in its 220th Meeting of SRC held on 30th – 31st March, 2012 considered the reply of the institution dt. 27.02.2102 and all the relevant documentary evidences, it was decided to serve Show cause Notice under Section 14(1) of NCTE Act.

(iii) Accordingly, a Show Cause Notice was issued to the institution on 27.04.2012. The institution was submitted its written representation on 21.05.2012.

The institution had submitted reply for Show Cause Notice after the expiry of stipulated time of 21 days period.

The Southern Regional Committee in its 223rd meeting held on 29th - 31st

May, 2012 considered the reply of the institution, which is received on 21/05/2012, i.e., after 24 (Twenty four) days from the date of issue of show cause notice dt. 27/04/2012 and with reference to the totality of information collected & based on a collective application of mind, the committee decided as per NCTE Regulations 2009, to refuse and reject the application of the institution for recognition of D.El.Ed-AI course

Accordingly, a rejection order was issued to the institution vide no. F.No. SRCAPP601(2012-13)/D.El.Ed-AI/AP/2011-12/43210 dated 27/06/2012.

Against SRC’s rejection order, the institution filed a writ petition in the Hon’ble High Court of Andhra Pradesh in W. P. No. 20386 and the Hon’ble High Court of Andhra Pradesh in its order dated 06/07/2012 in W.P.19915 of 2012 has stated that “the impugned decision to the extent of the petitioners herein is set aside and the Southern Regional Committee of N.C.T.E, Bangalore is directed to re-consider the second petitioner’s application, pass a detailed order and communicate the same to the petitioners within a period of one month from the date of receipt of a copy of this order. The writ petition is accordingly allowed – order follows”.

(iv) The SRC in its 228th meeting held on 24th – 25th July 2012 considered the Court directions, reply of the institution vide letter dt. 27.04.2012 and all the relevant documentary evidences and it was decided to serve Show cause Notice under section 15 (1) of NCTE Act.

Accordingly, Show Cause Notice was issued to the institution on 02.08.2012. The institution has submitted the written representation on 13/08/2012.

The SRC in its 231st meeting held on 22nd – 23rd August 2012 considered the reply of the institution dt.13-08-2012 and all other relevant documents and decided to cause inspection under section 14 (1) of NCTE Act, to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, as per the norms.

The SRC in its 233rd meeting held on 26th – 28th September 2012 considered VTR, VCD and all other relevant documents and decided to issue LOI. LOI was issued to the institution on 05.10.2012 for the academic session 2013-14. The institution replied to the LOI on 16.10.2012.

The SRC in its 235th Meeting held on 21st – 22nd November, 2012 considered the LOI reply and the committee noted the matter and decided to File an appeal and apply for stay.

Accordingly, a letter was sent the advocate on 05.12.2012.

A Hon’ble High Court order dated 09.11.2012 in W.P.No. 34752 of 2012 has been received in the office of SRC on 24.01.2013 read as hereunder:-

“…..respondent No.1 (SRC-NCTE) is directed to issue fresh orders by permitting the petitioner to commence D.El.Ed. Course for the academic year 2012-2013 forthwith including the same in the list of Colleges permitted for counselling. Subject to the above directions, this writ petition is disposed of. As a sequel to the disposal of the writ petition, W.P.M.Ps. are also disposed of as infructuous”.

The institution also preferred an appeal to NCTE H.Qtrs and the appellate authority in its order dt. 22.02.2013 stating as follows:-

“the committee noted that the Letter of Intent was issued for the next academic year as per the extent Regulations. Further, the formal recognition of the institution would be taken up only after the conditions in the Letter of Intent are fulfilled. Therefore, neither the Letter of Intent nor recognition can be issued for the academic year 2012-13. If such cases are considered favorably, this would lead to a large number of cases requesting for relaxation and the implementation of the provisions of the Regulations would be impossible.

The Committee after considering all the facts and noting all the provisions decided not to grant any relaxation to the applicant society namely Gokul Educational Society, Munugode By Pass Road, Nalgonda Village, Post & Taluk Nalgonda District, AP-508001.”

Writ appeal No.104 of 2013 dt. 14.02.2013 has been received from the Hon’ble High Court on 25.02.2013.

The SRC in its 239th meeting held on 26th-27th February 2013, considered the Hon’ble High Court of Andhra Pradesh dt. 09.11.2012 and decided as under:

“It is unfortunate that the lawyer has been slack in filing the appeal and securing ‘stay’. Pursue with him for action without further delay. If there is any difficulty in getting it done, issue Formal Recognition for 2012-2013, without

prejudice to our right to plead our cause separately, as directed by the High Court.”

A letter has been issued to Shri.K.Ramakanth Reddy intimating the decision of SRC on 10.04.2013. Reply from the Advocate is awaited.

In the meantime, the institution has submitted its written representation on 07.05.2013 stated that:-

“….we have approached NCTE, SRC and submitted the application for additional intake in the existing college in the name Gokul College of Elementary Teacher Education, Nalgonda.

After the completion of scrutiny as per the instructions of SRC NCTE inspection was conducted on 13th September 2012 on the basis of the VISTING TEAM REPORT and the documentary evidence Letter of Intent was issued to this college in the meeting of 233 rd held on 26th-28th

September 2012, for the academic year 2013-14.

As per the letter of intent we have been given 60 days of time for the submission of reply in the form of staff approval and conversion of Fixed Deposits in to joint account, we have submitted our reply on 16.10.2012 in the style of Fixed Deposits staff approval along with notarised affidavits having detailed information. Faculty members duly filled and signed by every faculty members.

In view of the above facts, I request you to kindly consider our proposal and issue formal recognition to this institution for additional intake for the academic year 2013-14. I am herewith submitting documentary evidence regarding Letter of Intent issued by SRC NCTE to your goodself.”

The Committee duly considered the written representation from the institution vide letter dt. 07.05.2013 and decided to inform the applicant institution that, in view of the Hon’ble Supreme Court order dt. 13.12.2012, after 3rd March, 2013, formal recognition can not be issued for any period earlier than 2014-15.

(vi) Accordingly show cause notice was issued to the institution 06/03/2012. The institution has submitted written representation on 22/03/2012 & 26/03/2012.

(vii) The SRC in its 222nd Meeting of SRC held on 09th – 10th May, 2012 considered the reply of the institution vide letter dt. 26-03-2012 and all the relevant documentary evidences and it was decided to serve Final Show cause Notice under section 14 (1) of NCTE Act.

Accordingly, Final Show Cause Notice was issued to the institution on 09.06.2012.The institution has submitted its written representation dt. 29.06.2012 received in the office of SRC on 05.07.2012 (by hand).

Further it is observed that the Land document reflects Sy No. 12/(regional language) whereas Building Completion Certificate and Encumbrance Certificate reflects Sy No. 10A. It needs clarification

The institution has submitted its reply after the stipulated time of 21 days.

Supreme Court vide their order in Civil Appeal NO. 1125-1128/2011 in SLP No. 17165-68/2009 filed by NCTE Vs ors, which reads as under:

“An institution is not entitled to recognition unless it fulfils the conditions specified in various clauses of the Regulations. The Council is directed to ensure that in future no institution is granted recognition unless it fulfils the conditions laid down in the Act and the Regulations and the time schedule fixed for processing the application by the Regional Committee and communication of the decision on the issue of recognition it strictly adhered to”.

The SRC in its 227th meeting held on 17th – 19th July, 2012 considered the reply of the institution, which is received on 05/07/2012, i.e., after 26 (Twenty Six) days from the date of issue of show cause notice dt. 09.06.2012 and with reference to the totality of information collected & based on a collective application of mind, the committee decided as per NCTE Regulations 2009, to refuse and reject the application of the institution for recognition of D.El.Ed course.

Accordingly, a rejection order was issued to the institution on 13/08/2012.

The institution filed a writ petition in the Hon’ble High Court of Andhra Pradesh ,W. P. No. 24349 and the Hon’ble High Court of Andhra Pradesh in its order dated 07/08/2012 has stated that “‘..respondent No.2[ SRC,NCTE] ought to have considered the petitioner’s reply regarding the discrepancy in the survey numbers and taken a

decision instead of rejecting their application on the ground that the reply was received beyond the stipulated time. In this view of the matter, respondent No.2 is directed to reconsider the petitioner’s application by considering the reply dated 29.06.2012 sent by the petitioners within a period of two weeks from the date of receipt of this order.”

In response to the court direction , the application was processed and placed before SRC. The SRC in its 231st meeting held on 22nd and 23rd

August 2012, decided to process the application.

Accordingly, as per decision of SRC the application was again processed and placed before SRC. The Southern Regional Committee in its 232nd meeting held on 29th – 31st August, 2012 considered the Hon’ble High Court order dt. 07/08/2012 and all other relevant documents and decided to cause inspection for the session 2013-14 under section 14 (1) of NCTE Act, to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, as per the norms.

Accordingly, the inspection of the institution was fixed between 20th -24th

September, 2012 the same was intimated to the institution on 14/09/2012 the Inspection of the institution was conducted on 22/09/2012.

(viii) The SRC in its 234th Meeting held on 26th-28th September, 2012 considered the VT report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under section 14 (1) of NCTE Act.

Accordingly, a show cause notice was issued to the institution on 16/11/2012.The institution has submitted written representation on 05/12/2012.

of the institution conducted by Directorate of Teacher Education, Research and Training Chennai, the committee in its 202nd meeting held on 14th-15th March 2011 decided to issue show cause notices. Accordingly notice was issued to the institution on 15.04.2011. The institution submitted its reply on 11.05.2011.

The SRC in its 205th meeting held on 18th-19th May 2011 considered the reply and decided to withdraw the recognition for D.T.Ed. course run by A.S. Teacher Training Institute, Madurai District Tamilnadu, with effect from 2012-13 to enable the present batch of student to complete the course. Accordingly, order withdrawing recognition was issued to the institution on 27.06.2011.

The institution filed WP No. 16535 of 2011 before the Hon’ble High Court of Madras at Chennai and the court has passed orders in judgment dt. 27.07.2011, which reads as under:

“….The matter is remitted back to the second respondent (DTERT, Chennai) to consider the explanation submitted by the petitioner Trust seeking time to complete the construction as well as the approval of staff granted by the second respondent and pass necessary orders within a period of eight weeks from the date of receipt of this order”.

Further, The DTERT, Chennai vide letter dt. 10.08.2011 has stated that the Hon’ble High Court in their order dt. 27.07.2011 made in W.P. No. 16535/2011 held that ”For the above reasons, I am of the view that the impugned order is unsustainable and the same is set aside. The matter is remitted back to the second respondent to consider the explanation submitted by the petitioner Trust seeking time to complete the construction as well as the approval of staff granted by the second respondent, and pass necessary orders within a period of eight weeks from the date of receipt of copy of the order”.

The Hon’ble court has set aside orders passed by the SRC-NCTE, Bangalore. In the circumstances, the DTERT, Chennai has requested SRC to intimate the action to be taken by them.

The SRC in its 211th meeting held on 21st-23rd September 2011 has taken note of the Hon’ble High Court at Chennai and decided to inform the institution to be prepared for inspection under Section of NCTE Act after 8 weeks from the date of receipt of Court orders. And also, DTERT be informed accordingly, and action be taken without waiting for confirmation of minutes.

Accordingly, inspection of the institution was scheduled on 15th-20th February 2011 and the status of the institution was intimated to DTERT on 13.01.2012. The institution vide letter dt.18.02.2012 stated that the construction of the building could not be completed due to consistent power failure and other labour problems. Further, the institution has also stated that the 90% of the building construction has been completed and the remaining 10% of the construction will be completed. Ready for occupation. But outer plastering work painting elevation work and portico works are only pending. Separate toilet blocks are ready for occupation. The institution has requested to postpone the inspection of the institution after 14th of April. In the meantime, DTERT Chennai vide letter dt.14.03.2012 had requested SRC, NCTE to intimate the action to be taken by the DTERT as early as possible since the time limit granted by the Hon’ble High Court of Madras has already been exhausted. Accordingly, a letter has been written to the DTERT, Chennai stating the facts of the case on 18.04.2012.

The SRC in its 221st meeting held on 19th-20th April, 2012 considered the request of institution vide letter dt. 18.02.2012 and other relevant documents and decided to cause inspection to examine whether the institution fulfils all the infrastructural and instructional requirements as per the norms, under Section 17 of NCTE Act. Accordingly, the inspection of the institution was conducted on 25.05.2012. The VT members has conducted inspection both B.Ed and D.T.Ed courses.

Further, the institution vide its letter dated. 10.05.2012 has submitted DD bearing no. 164450 dtd. 08.05.2012 for Rs. 40,000/- and DD bearing no. 164548 dtd. 09.05.2012 for Rs. 1,000/- towards inspection fee.

The SRC in its 226th meeting held on 09th-10th July, 2012 considered the VT Report, VCD of the institution and all the relevant documentary evidences and decided to serve Show Cause Notice under NCTE Act. Accordingly, a Show cause notice was issued to the institution on 26.07.2012. The institution had submitted its written representation on 31.08.2012.

The SRC in its 233rd meeting held on 26th -28th September, 2012 considered the reply of the institution vide letter dt. 31.08.2012 and all the relevant documentary evidences and decided to serve Final Show cause Notice under NCTE Act. Accordingly, a Show Cause Notice was issued to the institution on 29.10.2012. The institution had submitted its written representation on 12.03.2013.

The Committee considered the Institutions request for closure of D.T.Ed course and decided to permit the closure by withdrawing the recognition for (APS05442) D.T.Ed course with effect from 2013-2014, in order to enable the ongoing batch of students in D.T.Ed, course, if any, to complete their final year course.



Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore, if any, after ensuring settlement of all faculty/staff claims.

(ix) The SRC in its 205th meeting held on 18th-19th May 2011 considered the VT Report, VCD and all the relevant documentary evidences and decided to serve Show Cause Notice for both B.Ed & D.Ed course, under NCTE Act. Accordingly, a show cause notice was issued to the institution on 07.07.2011. The institution has submitted its written representation on 25.07.2011.

The SRC in its 203rd meeting held on 31st March & 1st April 2011, considered the written reply and other relevant documents and decided to cause composite inspection at the premises for both D.T.Ed (APS03635) and B.Ed (APS03634) under NCTE Act. The institution is directed to submit Demand Draft of Rs. 40,000/- inspection fee per course in favour of “The member Secretary, NCTE” Payable at Bangalore. Accordingly, the inspection of the institution was carried out on16.02.2012.

The SRC in its 229th meeting held on 30th-31st July 2012 considered the VT report, VCD and all the relevant documentary evidences and decided to serve Show Cause Notice under NCTE Act. Accordingly, a Show cause notice has issued to the institution on 24.08.2012. The institution had submitted its written representation on 27.09.2012.

The SRC in its 236th meeting held on 16th - 17th December 2012 considered the reply of the institution vide letter dt. 27.09.2012 and all the relevant documentary evidences and it was decided to serve Show cause Notice under NCTE Act, Accordingly, a Show Cause Notice was issued to the institution on 15.02.2013. Now, the institution vide its letter dtd. 04.07.2012 has stated that “ our application for permission for the change of Management of P.D.Rajan College of Education and P.D.Rajan Teacher Training Institute from Madras and Research Integrated Trust (MERIT) to P.D. As the academic year 2012-2013 has commenced and the Management of MERIT Trust has decided not to allow any confusion in the minds of the General Public and the students as to which Management is going to have control over P.D.R. College of Education and P.D.R Teacher Training Institute. MERIT Trust has decided to withdraw the Application submitted to NCTE (SRC), Bangalore letter dtd. 30.01.2012. Our Request for the Change of Management from MERIT Trust to P.D.Rajan Memorial Educational Society may be withdrawn.

We request that this withdrawal may be recorded and necessary orders may be issued regarding the withdrawal of our application for change of Management”.

The SRC may take a note regarding withdrawal of request of change of management.

The SRC in its 230th meeting held on 16th-17th August, 2012 considered the request of the management vide their letter dt.30.01.2012 for withdrawal of application for change of management from MERIT Trust to “P.D. Rajan Memorial Education Society”

The institution vide its letter dtd. 13.08.2012 has submitted DD bearing no. 882651 dtd. 10.08.2012 for Rs. 50,000/- towards change of place from Pattukonampatti to Pappireddipatti, Dharmapuri District for B.Ed course and had stated the following:-

“National Council for Teacher Education(SRC) Bangalore was pleased to accord Recognition to start B.Ed course by P.D.R. College of Education at Pattukonampatti, Pappireddipatti (Po) & (Tk), Dharmapuri District with an intake of 100 students from 2005-2006.

Based on the Recognition order of NCTE (SRC), Bangalore, Periyar University granted affiliation to P.D.R. College of Education from 2005-2006.

Consequent on the formation of Tamilnadu Teacher Education University, all the colleges of Education that were earlier affiliation to different Universities within their jurisdictions in Tamilnadu, came under the unitary control of Tamilnadu Teacher Education University w.e.f. 1.7.2007.

Madras Education and Research Integrated Trust (MERIT) proposes to shift P.D.R. College of Education functioning at Pappireddipatti (Po) & (Tk), Dharmapuri District to Sekkampatti, Mobripatti Panchayat, Dharmapuri District to a permanent building. The proposed change of location of P.D.R. College of Education has a permanent Building and other infrastructure facilities as per the norms prescribed by the National Council of Education. The library and faculty members will move over to the new place.

Under Regulation 8(11) of NCTE Act, a demand draft for Rs. 50,000/- from State Bank of India, Harur, Dharmapuri District is enclosed for necessary approval after due inspection of the institution at the new site viz Sekkampatti, Mobripatti Panchayat, Harur Taluk, Dharmapuri District. We are willing to submit any other particulars required by NCTE(SRC).

The SRC after considering the report of the visiting team as well as other relevant materials, granted recognition to the institution for offering B.Ed course with an intake of 100 students from the session 2002-2003 on condition to shift the institution to permanent premises vide order no. F.AP/NEW/B.ED/257/SRO/NCTE/2002-2003/6722 dated 04.04.2003.

And whereas the institution in its application stated that the institution possesses own land for construction of permanent building.

While going through the records submitted by the institution, it is found that:

The institution was not shifted to permanent premises as per norms and standards and conditions mentioned in recognition order dated 03.07.2003 Not Communicated the shifting of premises to the SRC and not paid the prescribed fees for shifting of premises.

The matter was considered by SRC in its 178th meeting held on 13th – 14th July 2009 and decided to issue show causes notice Under Section 17 of NCTE Act and obtain the following documents.

1) Demand Draft of Rs. 40000/- towards inspection fee in favor of “The Member Secretary, NCTE” payable at Bangalore should be submitted.

2) Land documents of the new building / location for having own land in the name of the institution / Society / Trust.

3) Building plan of the new building duly approved by the government authority.4) Building completion Certificate form the Government authorities in the prescribed

format (Format enclosed).5) Land Usage Certificate from the concerned Government authorities stating that

the land is exclusively permitted / sanctioned for Educational Purposes only should be submitted.

6) Encumbrance certificate from the competent Government should be submitted.7) Fixed Deposit Receipt of Rs. 5 lakhs kept in JOINT ACCOUNT with SRC in

Nationnalised Bank for a period of 5 years towards Endowment fund in ORIGINAL should be submitted.

8) Fixed Deposit Receipt of Rs. 3 lakhs kept in JOINT ACCOUNT with SRC in Nationnalised Bank for a period of 5 years towards Reserve fund in ORIGINAL should be submitted.

9) Certificate of Registration / Bye-law of the Society / Trust should be submitted.10) The affidavit in Rs. 100/- stamp paper in the prescribed format with Notary

Accordingly, notice was issued to the institution on 28.08.2009.

The applicant institution had submitted its written representation dated 16.09.2009 to SRC, NCTE along with the D.D of Rs. 40000/-. The inspection of the institution was conducted on 09.02.2011 and the report was received to SRC on 17.02.2011. The report was considered by SRC in its 208th Meeting on 13th – 14th

(x) The Committee in its 208th meeting held on 13-14th of July 2011 considered the VT report & VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under Section 17 of NCTE Act for the following:

1) As per building completion certificate, the built up area is 15,618 sq.ft. which is inadequate as per NCTE norms.

2) Education Technology lab, other lab/Physical Education needs to be strengthened.

Existing plan which is already submitted to you by our Society, the land is very far to the Malavalli Town. Therefore, the management has decided to construct the college building in the Sy.No. 551/A2, the said site is adjacent to existing B.Ed College building at Malavalli Town.Since we are not shifting the existing premises to new place. The remittance of Rs. 40,000/- will not arise. In the meanwhile we have already engaged an Engineer to prepare suitable plan for the said college to construct the building.”[[A letter was sent to the institution on 25/05/2009 with a request to pay the inspection fee along with the necessary documents.

The institution has not submitted any reply to the letter regarding shifting of premises, so far.

Now, the institution has sent a letter dated 06/05/2013 as follows ;

“ We have two deposit receipts for Rs. 5,00,000/- each for D.Ed and B.Ed College. It has matured on 05.05.2013.And it has to be renewed and the same has to be deposited in the Canara Bank, Malavalli Branch instead of Syndicate Bank, Mandya Branch. Therefore, kindly request you to duly sign on the back side of the deposit receipts with office seal and oblige .And also we are enclosing herewith 2 Nos. Deposit receipts.”

Two FDRs of Rs. 5 lakh each are enclosed.

From the above explanation and records it is observed that the institution has not submitted the FDRs of Rs. 3 lakhs each( Reserve Funds for B.Ed and D.Ed) maintained in joint account with the Regional Director, SRC.

The Committee considered the written reply of the institution on the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

The Institution was granted recognition in temporary premises to run D.Ed course on 29.11.2004 with a condition that it should shift to its own permanent premises in 3 years. i.e., on or before 29.11.2007. “ Bhagwan Buddha College of Education(B.Ed) is performing very well since 3 years in Malavalli Town, Mandya District, and Karnataka State, the only B.Ed College available in rural Malavalli Taluk. The building and land is situated in the main road and comfortable for the teaching, non teaching and also students.The building has been registered for 10 years lease in the Govt.Sub – Registrar’s Office, Malavalli Town on 03.08.2005(Lease deed copy enclosed).Society has purchased the following lands in the name of the President, Bhagwan Buddha Social and Educational Society, Malavalli,Mandya District.

Enhancement of intake from existing 50 to 100 students was permitted vide F.SRO/NCTE/D.Ed-A.I/2004-2005/4977 dated 26.12.2005 from the academic session 2005-2006 subject to certain conditions.

On 16/05/2013, a letter dated 15/05/2013 from the Secretary, Bharathi Education Trust has been received by this office on 16/05/2013 which is as under ;

“I the undersigned Secretary of Bharathi Education Trust intend to close the one unit of D.Ed course of Bharathi Teachers Training Institute under Bharathi Education Trust, K.M.Doddi. Please permit to close the one unit due to scarcity of students. Kindly oblige my request and countersign to withdraw the deposit amount of vide deposit receipt no.640455593070 of Rs. 5 lakhs and Receipt No. 64045594085 of Rs. 3 lakh respectively.”

The Committee considered the Institutions request for closure of D.Ed-Al course and decided to permit the closure by withdrawing the recognition for (APS01646) D.Ed-Al course with effect from 2013-14, in order to enable the ongoing batch of students in D.Ed-Al course, if any, to complete their final year course.

Digvijaya Rural College of Education, Hadavanahalli Gate, Near Mysore Cement Factory, Turuvekere Taluk-572211, Tumkur District, Karnataka had submitted an application for starting B.Ed course on 31.12.2003. The institution was granted recognition on 30.11.2004 with an annual intake of 100 students. This office was in receipt of a letter No.TY: VCPS: 2011-12:98 dated 21.05.2011 from the Vice-chancellor, Tumkur University, Tumkur by enclosing a list of 19 institutions along with their internal committee observations, requesting to initiate immediate action.

The SRC in its 206th meeting held on 09th-10th June, 2011 noted the inspection VT Report forwarded by the Vice-Chancellor, Tumkur University vide letter dated 21.05.2011 and the deficiencies pointed out in the 19 institutions in Tumkur District and decided to issue show cause notice under section 17 of NCTE Act. Accordingly, a show case notice was issued to this institution also on 08.07.2011. The institution submitted its reply on 09.08.2011.

The SRC in its 211th meeting considered the letter dt.21.05.2011 from Vice-Chancellor, Tumkur University pointing out deficiencies in the 19 Tumkur University colleges and also the reply of the above institution dated 09.08.2011 and other documents submitted by the institution and decided to cause composite inspection for all the courses at institution premises under Section 17 of NCTE Act, to verify whether the institution is maintaining instructional and infrastructural facilities as per NCTE norms. The institution is directed to submit certain documents within 30 days of the receipt of the notice, with Demand Draft of Rs.40,000/- as inspection fee towards the all the courses being run, in favour of “The Member Secretary, NCTE” payable at Bangalore.

Accordingly, a letter dated 19.10.2011 was addressed to the institution regarding the conduct of inspection between 28th October, 2011 to 2nd November, 2011. On 2.11.2011, this office has received a letter from Dr. U. V. Kumaran and Sri. S. Bangaraiah, both VT Members stating that the management was not ready to inspect the College during the specified date(s) and that the management had already informed to the Regional Director, NCTE to postpone the date of inspection.The SRC in its 215th meeting held on 12th –13th December, 2012 considered the matter and all relevant documents and decided to cause inspection to examine whether the institution fulfills all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, as per the norms and on payment of Rs. 40.000/- towards inspection fee. As per the decision of SRC, The visiting team comprising of Dr. S. Thangasamy, Director and Professor, Centre for Educational Research, Madurai Kamaraj University, Madurai and Dr. C. Raja Moauli, Professor, Dept. of Education, Dr. B.R. Ambedkar Open University, Hyderabad was proposed to the institution during 6th to 8th February, 2012. Accordingly, a letter was addressed to the institution on 18th January, 2012 to be ready for inspection.

Dr. S. Thangasamy, Director vide letter dated 31.1.2012 has stated that the VT members need not visit the college at Turuvekere taluk since it is a rural college. Further, there is no written letter from the institution requesting for postponement. Since the institution was not ready for inspection, a blank inspection report is submitted by the VT members.

the matter and it was decided to serve Final Show Cause Notice Under NCTE Act.

Accordingly, a Show Cause Notice was issued to the institution on 09.07.2012.

The institution has not submitted any reply , so far.

The institution has not submitted reply for Show Cause Notice even after the expiry of stipulated time of 21 days from the date of issue of the notice.



The committee considered the non-reply of the institution to the issue of show cause notice dt. 09/07/2012 and with reference to the totality of information collected & based on a collective application of mind, the committee decided as per NCTE Regulations 2009, to withdraw the recognition for (APS01905) B.Ed course with effect from 2013-14, in order to enable the ongoing batch of students in B.Ed course, if any, to complete their final year course.

A complaint has been received from Shri. R. Elango, Tamilnadu on 13.07.2010. The complainant has made the complaint against two colleges i.e. Arasu College of Education for Women, Karur and Ponkaliamman College of Education, Karur.

The SRC in its 194th meeting held on 21st-22nd July 2010 considered and decided to call for remarks with necessary documentary evidence on the specifics of the complaint from both the institutions and to obtain an affidavit from the complaint.

Accordingly, a letter was issued to the institution on 31.08.2010 and to the complainant on 01.09.2010 to submit the reply within 15 days. The reply from complainant was received on 13.09.2010. The complainant has submitted affidavit, copy of complaint, VT reports of Arasu College of Education and Ponkaliamman College of Education alongwith CD. But reply from both the above institutions is not received yet.

In the meantime, the Chairperson, NCTE vide his communication dated 16.07.2010 asked to look in to the matter immediately and instructed that if VT members found having submitted false report they should be blacklisted. A reply has been sent to CP, NCTE-Hqrs stating that the matter will be placed before SRC for appropriate action vide letter dated 03.08.2010.

SRC considered the reply of the complainant regarding the veracity of complaint in its 196th meeting held on 15th-16th September, 2010 and the committee considered the matter and noted the specific/serious deficiencies pointed out by the complainant. Remarks of the institution be placed before the committee for further necessary action. Final Report on the outcome of action taken be sent to the NCTE –Hqrs.

The institution has submitted its reply on 12.10.2010. The committee considered the matter in its 197th meeting held on 13th-14th October, 2010 and decided to cause inspection.

Accordingly, inspection of the institution was fixed between 15th-19th November, 2010 and the same was intimated to the institution on 09.11.2010. Meanwhile, a letter was received from the institution on 23.11.2010 requesting for postponement of the inspection as the college building work was not complete and it may be completed within three months and requested to fix the inspection after three months and the same was also informed to the VT members.

Accordingly, the inspection of the institution was re-fixed between 14th-17th

February, 2011 the same was intimated to the institution on 17.01.2011. The institution vide its letter dated 18.02.2011 again request to postpone the inspection for two months.

The institution vide its letter dtd. 24.12.2012 has submitted DD bearing no. 405906 dated 21.12.2012 for Rs. 50,000/- for shifting of premises to the following new address:-

The SRC in its 239th meeting held on 26th and 27th February, 2013 considered the request of the institution vide letter dt. 24/12/2012 for causing inspection at the new premises and decided to cause Shifting inspection at the new premises and to ascertain infrastructural and instructional facilities Under Section NCTE Act. subject to the condition that the deficiencies, if any, were duly rectified by the institution, as per the norms. The institution is directed to submit all the documents pertaining to new premises.

Accordingly, a letter was sent to the institution on 18.03.2013. The institution has submitted the documents dated 05.04.2013.

The Committee considered the written reply of the institution on the above matter and also the relevant documents of the institution and decided to withdraw recognition under NCTE Act for the following reasons:-

1. The institution does not have title to the land.

2. In the affidavit submitted, total built up area for the course being run is not mentioned.

3. In the approved copy of the building plan submitted, approving authority seal and signature is not clear, total earmarked built up area is not clear.

4. Original building completion certificate in a proper format from competent Govt. engineer is not submitted.

5. Notarised English version of Up-to-date encumbrance certificate issued by sub-registrar is not submitted.

Based on the above points the Southern Regional Committee in its 244th Meeting held on 09th - 11th May, 2013 decides to withdraw the recognition of the B.Ed course run by the Ponkaliamman College of Education, Thiruvalluvar Nagar, Bye-pass Road, Velayuthampalayam, Karur District-639117, Tamilnadu, from the academic year 2013-14, in order to enable the ongoing batch of students in B.Ed, course, if any, to complete their course.



Article IX. Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore, if any.Article X.As per the Decision of the Committee Withdrawal Order was prepared for issue. In the meantime, Court Order dated 15.05.2013. M.P.(MD).No. 2 of 2013 in W.P.(MD).No.8351 of 2013 was received from institution as well as from the Hon’ble High Court on 17.05.2013 and 28.05.2013 thus obtaining stay prior to the confirmation of Minutes.

Enhancement of intake of 10 seats from existing 25 to 35 has been permitted vide order F.No.F.SRO/NCTE/2012-2011/20588 dt. 23.08.2010.

A report is received on 14.09.2012 from the chairman & on behalf of members of Bangalore University Task force on M.Ed Colleges affiliated to Bangalore University.

The reports states that “the Task force visited 7 M.Ed Colleges affiliated to Bangalore University & submitted its report to the Hon’ble Vice Chancellor on 22nd

August,2012 & further a special meeting of Academic Council of Bangalore University was converted to discuss & approve the report of the Task force.

In the light of the above, the members of Task force thought of appraising SRC on its findings for kind notice & necessary action”.

The SRC in its 233rd meeting held on 26th –28th September 2012 considered the report of Bangalore University, Task Force of the 7 M.Ed colleges affiliated to Bangalore University vide letter dt 14/09/2012 & it was decided to serve Show Cause notice under NCTE act.

Accordingly, a show cause notice was issued on 19.11.2012. The institution has submitted a written representation on 11.12.2012.

The 241st meeting held 29th–31st March & 01st April 2013 considered the written reply of the institution on the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

1. No documentary proof is submitted towards removing the deficiencies pointed by the Task force committee.

2. From the reply of the institution, it appears that the management/institution has not initiated any steps to remove the deficiencies pointed out by the Task Force.

3. Approved staff list by the Bangalore University exclusively provided for M.Ed. course is not submitted.

4. The infrastructural and instructional facilities created by the institution as per

NCTE regulations, is yet to be ascertained as the institution is offering B.Ed.(AOS00249) and M.Ed.(APS09462) course.

5. Consolidated salary is paid and paid by cash. As per NCTE regulations, 2009, either UGC/Central/State Govt. salary is to be paid to the staff.

Based on the above points the committee decided to withdraw the recognition of the M.Ed course run by the Gold Field College of Education, Karahalli Extension, Kolar MainRaod, Bangarpet - 563114, Karnataka from the academic year 2013-14, in order to enable the ongoing batch of students in M.Ed, course, if any, to complete their course. But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order.The Affiliating body / Examining board / body be informed accordingly.

Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore, if any.

Accordingly, withdrawal order was issued to the institution on 16.5.2013.

In the meanwhile, on 08.04.2013, a letter is received from the Secretary, Subhashini Education Trust, enclosing a copy of the Writ petition No. 2602/2013(EDN-RES) & 7321-7338/2013 filed by the institution wherein the NCTE New Delhi is the 3rd

respondent and SRC-NCTE is the 4th respondent. The institution has requested for restoration of recognition.

The interim order dated 8.2.2013 is as under:- “A Writ petition filed by the above named petitioner under article 226 of the constitution of India, has been registered by this court. Read the IA 3/2013 filed on 4.2.2013 by the advocate for the petitioner for impleading the petitioners. After hearing, the Court made the following order:-IA 3/ 2013 is filed seeking permission to applicants to come on record as additional petitioners. For the reasons stated in the affidavit filed in support of this application, IA 3/2013 is allowed. Applicants/students are permitted to come on record by way of impleading.Impleading petitioners/students are permitted to take up the ensuing examination of M.Ed Course conducted b y the Bangalore University, subject to the result of the writ petition. Post this matter week after next. Petitioner’s counsel is permitted to amend the cause title.”

On 21.5.2013, a letter dated 16.5.2013 is received from the institution regarding the interim order of Hon’ble High Court of Karnataka at Bangalore along with a copy of Writ Petition No. 20892 of 2013(EDN-RES) filed by the institution praying to stay the operation and implementation of annexure-E the decision of the 241st meeting of the 1st respondent held on 29th and 31st March 2013 and 01/04/2013 and also to direct the 1st respondent not to post the said decision annexure-F in its website.

The Interim order dated 16.5.2013 is as under:-

“The learned counsel for the petitioner would contend that the facts and circumstances are identical with the facts and circumstances in writ petition Nos.17161-17162 of 2013(EDN-RES) where in this court has inclined to grant interim order of stay of the impugned order identical to the one challenged in the present writ petition.

is already lapsed. (Date of issue of FDR both 5 lakhs and 3 lakhs is 13.09.2008). As per the NCTE norms it should be of 5 years duration.

Accordingly, a Show Cause Notice was issued to the institution on 11.01.2011.The institution submitted its written representation on 24.02.2011.The SRC in its 203rd meeting held on 31st March to 1st April 2011 considered the written representation and decided to withdraw recognition for the following reasons :-

The management is running the institution in a FIVE storied residential building, which is unsuited to run the academic programme. No vacant land around the building as against the requirement of 2500 Sq. Mts of land as per norms. Playground is 300 meters away from the building and is being shared with other school.

The institute has not submitted the Land usage certificate from a competent Govt. approved authority.

The latest Building Completion Certificate from the competent Government Engineer is not submitted.

The building plan submitted is for different location other than the one proposed earlier/initially.

The FDRs of Rs. 5 Lakhs and 3 Lakhs are taken for 2 years only and the duration is already lapsed. (Date of issue of FDR both 5 lakhs and 3 lakhs is 13.09.2008). As per the NCTE norms it should be of 5 years duration.

Accordingly, a withdrawal order was issued to the institution on 06.05.2011Aggrieved by the withdrawal order, the institution preferred an appeal before the appellate authority on 27.6.2011. The appellate authority vide order dated 4.11.2011 made the following observations and confirmed the orders of SRC.“ The Council noted that the appellant submitted an application for grant of recognition of B.Ed course to the SRC on 29.12.2003 and along with the application he submitted a sale deed dated 08.02.2001 in favour of Dr.S.Raju, a member of the Society. SRC vide order dated 30.11.2004 granted recognition to the institution in rented premises to the institution. The institution vide letter dated 20.11.2007 submitted an application for shifting the premises. inspection of the new premises was caused on 26.10.2010.The VT mentioned availability of 16,102 sq.ft of built up area , but it did not mention the land area.The sale deed dated 27.09.2006 mentioned that a built up area of 6400 sq.ft of RCC roofed building comprising of basement ground, first ,second and third floor at Khata No. 13 (Site No. 13 and 14).The building plan submitted to SRC was ground, first and second floor and it mentioned availability of 2575.56 sq.ft area only. The Council observed that the institution did not have adequate land (2500 sq.mts required under the regulations in its new premises. The Sale deed also mentioned only 6400 sq.ft of built up area, further the appellant has been using a park as a play field as per the submission in the appeal and this park is not adjacent to the college building. The Council therefore came to the conclusion that there was no justification in accepting the appeal as the new premises does not have the adequate area for catering to the requirement of the B.Ed programme.”Further, the institution approached Hon’ble High Court of Karnataka vide W.P.No.7602 of 2012. The institution obtained stay for the orders of SRC and NCTE, New Delhi and a copy of the same was submitted to this office on 14.5.2012. Hence, a letter was addressed to the advocate to vacate the stay granted to the institution on 24.5.2012 and also on 25.6.2012.On 27.6.2012, a copy of the order dated 14.6.2012 extending the stay till the next date of hearing was received by this office.On 17.12.2012, the institution submitted a judgement copy dated 6.12.2012, in respect of W.P.NO.7602/2012, as per para 7,which stated as under:-“the impugned orders passed by the respondent authorities at Annexures A and Q are quashed. It is for the respondent authority to reconsider the representation and the material documents produced by the petitioner regarding shifting of the College from Chandra Layout, Vijayanagar to 80 ft. Road, Maruthinagar if need be, by once again deputing the Committee for inspection on payment of inspection fee by the petitioner, within 15 days from the date of receipt of this order. Within four weeks thereafter, respondent-authorities to get the inspection report and to take further action in accordance with law.”The SRC in its 239th Meeting held on 26th – 27th February 2013, considered the Court order dated 6.12.2012 and all other relevant documents and decided to cause

inspection on payment of inspection fee of Rs. 50000/-, under NCTE Act, to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, as per the norms.

The institution has remitted the inspection fee on 29.04.2013.

Accordingly, the inspection of the institution was fixed between 20th and 24th May and the same was intimated to the institution on 03/05/2013.

Section X.01 Accordingly, the inspection of the institution was carried out on 24.05.2013

The committee considered the matter and in compliance of the Hon’ble High Court order, VT report, VCD and other relevant documents of the institution are considered. Several serious deficiencies are still seen to exist as under: As per VT report, the building is in a commercial area.

As per VT report, total land area is only 95 x 40 = 3800 sq.ft.

As per VT report, building is a four stories building coming to 16,102 sq.ft.

As per VT report, multipurpose hall shed is covered with plastic sheet, which is not permissible as per NCTE regulations 2009. Multipurpose hall size is only 763 sq.ft, which is inadequate as per the requirement of 2000 sq.ft as per NCTE regulations 2009.

As per VT report, teaching staff list is not approved by University.

As per VT report, The Principal of the college is not having Ph.D qualification and has no 10 years experience in B.Ed College.

As per VT report, the institution has not submitted the profile of the teachers.

As per VT report, play ground of the college is away from the college building and is on lease basis from Muncipality.

As per VT report, the institution is lacking in infrastructural facilities and teaching list is not approved by the University.

Further,

Original certified copy of the land documents from Govt. authority is not submitted. The documents submitted refer to Khata No. 12 & 13, whereas all other documents refer to Khata Nos. 13 & 14. The land document produced is also incomplete. Property details are not fully submitted.

a) As per Khata No.13, built up area is only 2283.84 sq.ft. whereas as per Khata extract, 2323.13 sq.ft area comprising of basement, ground floor, first floor, second and third floor. Composite built up area of 6400 sq.ft of RCC roofed Red oxide flooring, brick wall and doors and windows of jungle wood.

b) At Khata No. 12, built up area is 689.30 sq.ft, whereas as per Khata extract, 689 sq.ft area comprising of basement, ground floor, first floor, second and third floor. Composite built up area of 1700 sq.ft of RCC roofed Red oxide flooring, brick wall and doors and windows of jungle wood.

Hence,

Site Area : 2283.84 + 689.30 = 2973.14 sq.ft.Built up area : 6400 +1700 = 8100 sq.ft.

As per the VT report, the land area possessed by the institution is 4275 sq.ft and the built up area comes to 4002 sq.ft.

Land document is submitted for Khata No. 13 and 12, but as per the copies of affidavit, building completion certificate and land usage certificate submitted for Khata No. 13 & 14 only.

From the above it is concluded that the land area is inadequate. As per 8 (3) Regulations 2009, Appendix 4 (5), total land area required is 2500 sq.mtrs. According to their own affidavit, total land area is 16,102 sq.ft. The Land documents, refers only to 2973 sq.ft. VT report also confirms the inadequacy.

Approved blue print of the building plan issued by competent civil authority is not submitted. The building plan is in the name of ‘Vijayanagar Educational Academy’, not in the name of the Institution. From this it is not clear whether the institution is meant for B.Ed course only or is offering any other course in the same building/premises. In the copy of the building plan submitted, total earmarked site area, built up area is not mentioned. Also, nomenclature wise class rooms, ET lab, Psychology lab, and Science labs are not reflected/mentioned in the building plan. An Auditorium of 1017 sq.ft and recreation centre of 488.16 sq.ft is shown in the building plan. Building plan submitted is for Khatha No. 13 & 14 but not for 12 & 13 as per sale deed submitted.

Original building completion certificate from competent Govt. authorized engineer is not submitted. Total built up area is 16102 sq.ft, whereas as per the VT report built up area is only 4002 sq.ft. Building completion certificate submitted is for educational institutions run by the college, it is not clear from this, whether the institution is offering any other course or is it meant for B.Ed course only. Building completion certificate submitted is for Khatha No. 13 & 14 but not for 12 & 13 as per sale deed submitted.

As per VT report & VCD, part of the roofing is ‘kutcha’ and not RCC.


As per VT report, seating capacity in the library is only 20, which is inadequate as per NCTE norms 2009 for the B.Ed course.

As per VT report, Education Technology lab and other labs are small in size and not conducive for conducting laboratory classes.

As per VT report, Science laboratory is being shared with attached School/College, which is not permissible as per NCTE regulations 2009.

Based on the above points, the institution does not qualify to be college of Education. the committee decides to withdraw the recognition of the B.Ed course run by the Vijayanagar College of Education, Vijayanagar Educationa Academy, 49, 6th Cress, 1st Stage, 2nd Phase, Chandra Layout, Vijayangar, Bangalore, Karnataka, from the academic year 2013-14, in order to enable the ongoing batch of students in B.Ed, course, if any, to complete their course.

St. John Sangam Trust, Perambalur District submitted two applications in the name and style of Thanthai Hans Roever Teacher Training Institute for Men and Annai Angel Teacher Training Institute for Women, Indira Nagar, Emabalur Post, Perambalur District, Pin-621212, Tamilnadu for seeking grant of recognition for D.T.Ed (APS03056) and D.T.Ed (APS03166) course on 31.12.2003. The application was processed and the recognition order was issued to the institution for D.T.Ed (APS03056) and D.T.Ed (APS03166) courses on 27.04.2005 with an annual intake of 50 students respectively, with the condition to shift to own premises within 3 years.

The State Government of Tamilnadu in its letter No.6987/UI/08-1 dated.20.03.2008 after an inspection by a Committee, pointed out some deficiencies in 54 D.T.Ed colleges in the state including this college. The State Government has informed that these institutions are not maintaining norms and standards as prescribed by NCTE and deficiencies of individual institution were also submitted as annexure.

The SRC in its 157th meeting held on 23rd-24th April, 2008 considered the complaint and decided to issue notice to these institutions under section 17 of NCTE Act, 1993 providing opportunity for making written representation, if any, as the specific deficiencies were pointed out. Accordingly, notice was issued to the institution on 16.06.2008. The institution had submitted its written representation on 09.07.2008.

The SRC in its 166th meeting held on 18th-19th October, 2008 considered the reply / written representation submitted by the institution and decided to cause inspection of the institution under section 17 of NCTE Act, to verify the veracity of the compliance as claimed by the institution and also the structural modifications / improvement / shifting to new building as claimed, on payment of re-inspection fee of Rs. 40,000/- by the institution. Accordingly, a letter was issued to the institution on 27.10.2008 seeking for re-inspection fee of Rs. 40,000/-. The institution vide its letter dtd. 14.11.2008 submitted bearing DD no. 994168 dtd. 05.11.2008 of Rs. 40,000/-

The SRC in its 217th meeting held on 08th-09th February, 2012 considered the request of the institution vide letter dt. 21.12.2010 and other documents of the institution and decided cause composite inspection at the premises. The institution is directed to submit the following within 30 days of the receipt of the notice, Duly filled in Questionnaire along with all the necessary documents for land, building approval and completion certificate from a competent Govt. Engineer and other relevant documents along with Demand Draft of Rs.40,000/- inspection fee towards the other Teacher Education programmes being run, in favour of “The Member Secretary, NCTE” payable at Bangalore. Accordingly, the inspection of the institution was carried out on 15.02.2012.

The SRC in its 224th meeting held on 14th-16th June, 2012 considered the VT report, VCD and all the relevant documentary evidences and decided to serve Final Show Cause Notice under NCTE Act. Accordingly, Show Cause Notice was issued to the institution on 09.07.2012.

The institution vide its letter dtd. 28.08.2012 has stated that “ the inspection of D.T.Ed at Thanthai Hans Roever Teacher Training Institute for Co-Education, Indira Nagar and Annai Angel Teacher Training Institute for Women, Roever Campus, Perambalur-621212, the admission of students was low and especially in the last two years, seeking admission for D.T.Ed (APS03056 and APS03166) at our institution was very very poor.

Hence, the management hereby decided that due to non-availability of students at Thanthai Hans Roever Teacher Training Institute for Co-Education, Indira Nagar and Annai Angel Teacher Training Institute for Women, Roever Campus, Perambalur-621 212, it would like to request the Regional Director, SRO, NCTE, Bangalore to pass necessary order for the withdrawn of recognition to Thanthai Hans Roever Teacher Training Institute for Co-Education, Indira Nagar and Annai Angel Teacher Training Institute for Women, Roever Campus, Perambalur-621 212 for D.T.Ed courses (APS03166 and APS03056).

The institution was granted recognition for D.T.Ed course on 20.01.2005 with an annual intake of 50 students and D.T.Ed-AI course on 24.10.2006 thus making an annual intake of 100 students which includes the existing intake of 50 and an additional intake of 50 students. Further, the institution had submitted the application for B.Ed course on 02.01.2006. The institution was granted recognition for B.Ed course on 09.01.2007 with an annual intake of 100 students, with the condition to shift to own premises within 3 years.

Tamilnadu for offering Annai Theresa Teacher Training Institute, Thammampatty, Salem District, Tamilnadu for conducting D.T.Ed, D.T.Ed-AI & B.Ed courses stating that the institution is lacking with regard to infrastructure and instructional facilities

The complaint was considered by SRC in its 182nd meeting held on 31st August 2009 and decided to issue show cause notice under section 17 of NCTE Act for all the courses in order to call for remarks on the complaint along with questionnaire. Accordingly, a show cause notice was issued for all the three courses on 01.10.2009. The institution had submitted its written representation on 22.10.2009.

The SRC in its 187th meeting held on 29th-30th December, 2009 considered the written representation of the institution and decided to cause Inspection under section 17 of NCTE Act. Again the matter was placed in SRC in its 192nd meeting held on 10th-11th

May 2010 and decided that “copy of the complaint “excerpts” pertaining to the concerned institutions had already been given to the concerned institutions and the remarks of the institutions were also obtained and considered by the SRC, and hence the visit to the institution be proceeded, without any further delay, in anticipation of the inspection fee of Rs.40,000/- payable on this account as upheld by the Hon’ble High Court of Madras.

As per the decision of SRC, inspection of the institution was conducted on 08 th June 2010. The VT report alongwith original file was considered by SRC in its 193 rd

meeting held on 21-22 June 2010. The Committee decided to issue notice to the institution for all the courses. Accordingly, a notice was issued to the institution on 29.07.2010. The institution had submitted its reply on 18.08.2010.

The SRC considered the reply in its 196th meeting held on 15th-16th September 2010 and the committee decided to cause re-inspection for all the courses on receipt of the filed in Questionnaire, including all the relevant documents. The committee decided that the Arul Teacher Training Institute bearing APS0 No. 8066 in the same campus be also be inspected to verify whether it has exclusive and separate infrastructure facilities.

A letter calling for documents alongwith Questionnaire was issued on 26.10.2010. The institution did not submit its reply. The inspection of the institution was fixed between 18-25 November, 2010 and the same was intimated to the institution on 08.11.2010. But, inspection could not be conducted by VT members because institution has not allowed VT members to inspect.

The institution had submitted its letter dated 23.11.2010 to the VT members “stating NCTE inspecting authority members visited our institution to inspect the institution on 23.11.2010. Already we filed a pending case to the high court, Chennai W.P.No. 25842/2010. We are expecting the stay order from the court. In this movement we are not able to face the inspection after getting the court order, if the court may be order to face the inspection., we will ready to cooperate the inspection.”

The Court order dated 19.11.2010 has been received from the Hon’ble High Court of Madras stating as follows:

“The learned counsel for the respondent has brought to the notice of this court that by proceedings dated 26.10.2010, the petitioner was served with a notice calling upon to produce certain documents, besides giving 15 days time for submission of the reply also. However, on receipt of the reply, the respondent can inspect and verify the stand

taken in the reply given by the petitioner institution. Besides, the power of inspection of the respondent with the petitioner institution cannot be curtailed basing on the last inspection done. According to the learned counsel, as far as the impugned notice dated 8.11.2010 is concerned, it is by mistake, the same has been issued and no further steps will be taken basing on the notice dated 8.11.2010, which is under challenge in this writ petition. However, depending on the reply to be furnished by the petitioner institution for the notice dated 26.10.2010, further steps, including inspection, will be done by the respondent institution.

Recording the above submission made by the learned counsel appearing for the respondent, this writ petition is closed, setting aside the impugned notice dated 8.11.2010. No costs. M.P. Nos.1 and 2 of 2010 are closed”.

The reply was not received from the institution to the notice dt. 26.10.2010. The SRC in its 200th meeting held on 20-21 January 2011 considered the matter and decided to issue notice under section 17 of NCTE Act to the institution giving 30 days time for reply to the earlier notice issued to the institution dt. 26.10.2010 calling for documents along with Questionnaire and then process the reply for inspection after submission of Rs. 40,000/- towards inspection fee for each courses being run by the institution.

A notice was again issued to the institution on 03.03.2011 to submit the relevant documents following as called for in letter dated 26.10.2010. The institution vide its letter dated 01.04.2011 instead of submitting enclosed above documents alongwith filled in questionnaire and DD of Rs.40,000/- requested to visit the college directly and consider the application and do the need full action as early as your favour.

The matter was considered by the SRC in its 204 th meeting 27th-28th April 2011 considered the VT Report, and it was decided to serve Final Show cause Notice under Section 17 of NCTE Act. Accordingly, a final show cause notice was issued to the institution on 27.05.2011. The institution had submitted its reply on 24.06.2011. Further, the institution vide its letter dt.12.07.2011 had submitted its proposal for shifting of premises alongwith Rs. 40,000/-.

The SRC in its 210th meeting held on 22nd-23rd August 2011 considered the written reply of the institution dt.24.06.2011 and all other relevant documents submitted by the institution and decided to cause inspection at the new premises to ascertain infrastructural and instructional facilities under Section 17 of NCTE Act.

Accordingly, inspection of the institution was conducted on 10.10.2011 for D.T.Ed course, 25.11.2011 for B.Ed and D.T.Ed-Al course.

The SRC in its 215th meeting held on 12-13 December, 2011 considered the VT Report, VCD and all the relevant documentary evidences and decided to serve Show Cause Notice under Section 17 of NCTE Act. Accordingly, a Show Cause Notice was issued to the institution on 30.01.2012. The institution had submitted its written representation on 27.02.2012.

The , the SRC in its 223rd meeting held on 29th -31st July, 2012 considered the Institutions request for closure of D.T.Ed & D.T.Ed-Al course and decided to permit the closure by withdrawing the recognition for (APS01289) D.T.Ed course& (APS05909) D.T.Ed-Al course with effect from 2012-2013, in order to enable the ongoing batch of students in D.T.Ed, & D.T.Ed-Al course, if any, to complete their final year course.

Based on the above points the committee decides to withdraw the recognition of the D.T.Ed and D.T.Ed-Al course run by the Annai Terasa Teacher Training Institute and Annai Terasa College of Education, No. 242/2, Sendarapatty Main Road, Koneripatty Post, Thammampatti, Salem District, Tamilnadu, from the academic year 2012-13, in order to enable the ongoing batch of students in D.T.Ed and D.T.Ed-Al course, if any, to complete their course.

Further, the SRC in its 223rd meeting held on 29th -31st July, 2012 considered the reply of the institution and all the relevant documentary evidences and decided to serve Final Show cause Notice to B.Ed course, Under NCTE Act for the following:

1. The Institution was granted recognition in temporary premises to run B.Ed course on 09-01-2007 with a condition that it should shift to its own permanent premises in 3 years. i.e., on or before 09-01-2010. The Institution is still running in temporary premises and not shifted to new premises even after a lapse of stipulated 3 years and after lapse of time period of more than 5 years and 4 months.

2. The institution has submitted, lease deed whichis not permissible as per NCTE regulations 2009.

3. Original building completion certificate from competent Govt. authorized engineer is not submitted.

The application was processed and recognition order was issued to the institution on 23.05.2006 for B.Ed course at No.62, Kalakad Road, Cheranmahadevi, Tirunelveli District, Pin - 627 414, Tamilnadu with the condition to shift to own premises within 3 years.

The institution vide its letter dated 15.04.2009 submitted Rs.40,000/- towards shifting of premises. SRC considered the matter in its 174th meeting held on 1st

May 2009 and decided to cause inspection to the newly constructed permanent building for shifting of B.Ed course and to verify the infrastructural and instructional facilities provided for both existing B.Ed and proposed M.Ed course.

Inspection of the institution for shifting of premises was conducted on 13.06.2009. SRC considered the VT report in its 177th meeting held on 22nd - 23rd June 2009 and decided to show cause notice. Accordingly, show cause notice was issued to the institution on 16.07.2009, the institution submitted its reply on 22.07.2009. SRC considered the reply in its 179th meeting held on 23rd July 2009 and the committee permitted the institution for shifting and also to convert from Women College to Co-education College. Accordingly, a letter was issued to the institution on 05.08.2009.

The Tamilnadu Teachers Education University forwarded a copy of show cause notice issued to the institution which was placed before SRC in its 202nd meeting held on 14th - 15th March 2011 and the committee considered the matter and decided to issue show cause notice under Sec 17 to the institution. Accordingly show cause notice was issued to the institution on 15.04.2011. The institution submitted its reply on 13.05.2011 for the following:

After going through the reply of the institution, VT report and VCD, the committee decided to cause Composite Re-inspection of the institution on submission of Rs.40,000/- towards each of the courses being run under Section 17 of NCTE Act. The institution is directed to submit the following within 30 days of the receipt of the notice, duly filled in Questionnaire.

Inspection was carried out on 27.07.2011.

The Committee in its 211 meeting held on 21st - 23rd September 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under Section 17 of NCTE Act for the following:

He has stated “ All the documents by NCTE are ready for despatch to the Regional Centre,soon. But the list of our Teaching Faculty is not approved by Calicut University for want of Government approval for shifting the venue of this College from Mandankavu to Parambinmukal. The approval of Government is expected to reach here immediately. Hence the delay in this regard may please be excused as piecemeal submission of documents would create problems. So the last date of submission of documentary evidences may please be extended a few more weeks”.

The institution was served with Final show Cause notice vide letter dt. 05/02/2013 to submit their reply within 21 days from the date of receipt of the Final Show Cause Notice. The institution has not replied within the stipulated time period.
