Management 

Elton John’s immortal words have never been truer than when

an adverse incident occurs. The human part of us yearns to

apologize but we’ve been conditioned to think that doing so is

tantamount to admitting guilt—and for good reason. That was

true, until recently.

Now, all but a handful of states have “apology laws,” which

allow medical professionals to say they’re sorry, and show other

expressions of empathy or sympathy, without fear that their

words can be construed as admissions of guilt.

The U.S. Supreme Court recently heard oral arguments in a

False Claims Act (FCA) case, Universal Health Services v. United States ex rel. Escobar. The

Court is being asked by the government to affirm the validity of their so­called implied false

certification theory. This theory, advanced by the department of justice, attaches FCA liability

when a person submits any claim for payment to the government, including Medicare

payments.

The theory states that in submitting an invoice, you are implying that there are no violations

of any underlying laws relating to the claim for payment. This includes that it is accurate for

services rendered, and complies with regulations.
