The September 5, 2011 issue of
TIME magazine has an
interesting feature article, How
To Save The Housing Market:
Destroy Houses; That and three
other radical ideas that could
jump-start the economy.
Frankly, my Montana farmer-
rancher grandfather and
Montana farmer-rancher father
would roll over if they had lived
long enough to experience this
time in United States history.
During the long Montana winters along the Hi-Line of Montana, where I grew up, Grandpa John and my father would salvage framing lumber and whatever else they could from no longer used buildings. The old schoolhouse; the former lumberyard; you get the
idea. Then they used the salvage to construct cribbed grain bins, framed barns, grain storage and even new home construction and remodeling.
Now, in Lakewood, Ohio, and other communities across the country, bulldozers and excavators are tearing down dilapidated row houses and elegant turn-of-the century Victorians. Partly destroying cities would never have been understood or tolerated in my grandfather’s and father’s generation, but now it is just another tool to get rid of the excess housing inventory that was spurred by high unemployment and economic hardship. By the way, the other three radical ideas: 1) Refinance home mortgages at today’s historically low interest rates. Problems with this include bad credit, underwater loans and bank’s current reflexive lending. Once again, the only way to make this work would involve government guarantees.

However, banks may be forced along by the $20 billion in penalties assessed by Uncle Sam for faulty lending. 2) Speedy foreclosure, as heartless as that sounds. More foreclosures earlier would have allowed the market to clear itself and recover earlier, according to housing economist, Thomas Lawler. A number of states are actually pursuing laws that would fast-track foreclosures. 3) The government could rent foreclosed homes, maintaining ownership, while sharing the profits with a private investor who manages the property, splitting the equity when the arrangement liquidates. Herein lies the problem; if the family could not afford the mortgage because of lost employment, how will they then pay rent?

Have any of you seen This is Spinal Tap? If not, my analogy will need a little explanation. In
the movie, a filmmaker is making a documentary about the world’s loudest rock band, Spinal
Tap. In one scene of the movie, the lead singer Nigel Tufnel, is explaining what makes their
amplifiers so special:
“The numbers all go to eleven. Look, right across the board, eleven, eleven, eleven, and . . .
Does that mean it’s louder? Is it any louder?
Well, it’s one louder, isn’t it? It’s not ten. You see, most blokes, you know, will be playing at
ten. Where can you go from there? Where?
I don’t know.
What we do is, if we need that extra push over the cliff, you know what we do?
Put it up to eleven.
Exactly. Eleven, one louder.”
For, Nigel, the amp going to eleven is a special, magical, “over the cliff” kind of thing. This
indescribable specialness of going to eleven captures the feeling of what I hope will be the
best Home & Ranch Expo; the 2012 Home & Ranch Expo. It’s even more than a eleven; it’s a
twelve!
To make that happen, I need your help. We will be holding our first committee meeting this
month Thursday, September 29th
Noon at the BBIA office. It doesn’t take a lot to create a
success; it just takes planning, preparation and execution. Also I need vendors, advertisers
and sponsors to help continue making our Home & Ranch Expo one of the best in the state.
Inside this month’s newsletter is your first look at the 2012 booth layout, vendor agreement,
advertising rates and sponsorship opportunities. Last year many waited too long and lost out
on valuable marketing potential. Don’t wait this year reserve yearly, $100 booth deposit
holds your place with final payment not due until January 15th

Stress is a normal psychological and physical reaction to the ever increasing demands of life. Surveys show that most Americans experience challenges with stress at some point during the year. In looking at the causes of stress, remember that your brain comes hard-wired with an alarm system for your protection. When your brain perceives a threat, it signals your body to release a burst of hormones to fuel your capacity for a response. This has been labeled the "fight-or-flight" response. Once the threat is gone, your body is meant to return to a normal relaxed state.
That's why stress management is so important. Stress management gives you a range of tools to reset your alarm system. Without stress management, all too often your body is always on high alert. Over time, high levels of stress lead to serious health problems. Don't wait until stress has a negative impact on your health, relationships or quality of life. Start practicing a range of stress management techniques today.
Step by Step Tips to Stress Management
1. Decide to make a change in how you manage stress.
2. Identifying your stress triggers. Some causes of stress are obvious - job pressures, relationship problems or financial difficulties. But daily hassles and demands, such as commuting, arranging day care or being overcommitted at work, can also contribute to your stress level. Positive events also can be stressful. If you got married, started a new job and bought a new house in the same year, you could have a high stress level. While negative events in general are more stressful, be sure to also assess positive changes in your life.
3. Once you've identified your stress triggers, you can start thinking about strategies for dealing with them. Sometimes the solution may be as easy as turning off the TV when the evening news is too distressing. Or, when you can't avoid a stressful situation, try brainstorming
ways to reduce the irritation factor.
4. And don't feel like you have to figure it out all on your own. Seek help and support from family and friends. You may want to ask them what stress-relief techniques have worked well for them. And many people benefit from daily practice of stress reduction techniques, such as mindfulness, tai chi, yoga, meditation or being in nature.
Stress won't disappear from your life. And stress management isn't an overnight cure. But with practice, you can learn to manage your stress level and increase your ability to cope with life's challenges.

My wife and I had the opportunity to be
on the Taste of the Bitterroot bus with
some 50 very good members and
associates. This new event was raved
about and many can not hardly wait for
next year to roll around. The builders were
all excited and proud to display their
beautiful homes and the mood was very
upbeat. I say thank you to my Lord every
day for being given the opportunity to live
in Montana among some of the finest
people in the world.

Your gut reaction might be that you
consider your home or business as
your greatest asset - and it may
certainly be your greatest physical
asset. But what happens when you
find yourself injured and unable to
work? What happens if you stop
getting a paycheck? Asking yourself
these questions, you will come to
realize that your health is your most
important asset. The fact is most
people are more diligent with oil
changes to keep their vehicles running
than they are in getting an annual
physical to stay healthy and proactive
with their overall health.
The Healthcare Reform law (known by
its acronym, ACA) was passed in March
2010, and mandated health insurance
programs to include full preventive
benefits. This means that physical
exams, immunizations, mammograms
and colonoscopies are covered at
100%.
Another element of the law takes
place in 2014 and concerns a mandate
to buy health insurance. This would
not take effect until 2014. The law was
structured in such a way that the
requirement to buy health insurance is
not technically a mandate, but is a tax
(not a fine or penalty) to be paid by
individuals and larger businesses who
do not have coverage.
Fine, you say, but how do I pay for it?
Think of it this way, if you cannot
afford to pay for your car’s
maintenance because the note is too
high, it is time to trade it in. Better to
have a Chevy you can maintain than a
Caddy that is burning oil. Health

Perhaps the most important and under
advertised part of the law is the “Small
Business Tax Credit”. This provides a
credit for up to 35% of your health
insurance costs during 2010 through
2013 and then a 50% credit in 2014
and 2015. The credit is greater for
smaller firms and grades down until it
stops at groups of 25 or more
employees. It also pays a higher credit
if the average salary is lower. For

Independent contractors are possibly the most misunderstood/misused category of workers in the business world. In today’s competitive business climate, using independent contractors (IC) is often a cost-effective way of conducting business.
WHAT IS AN INDEPENDENT CONTRACTOR?
Defined by law, 39-71-120 and 39-51-201 (15), Mt Code Annotated. A simplified definition is:
A) One who’s work is not controlled by others, and
B) Is engaged in his own trade, occupation, or business.
Weather one is an independent contractor or an employee is a complex issue. The Department of Labor and Department of Revenue have adopted the same definition to simplify the process of determination. Wage withholdings, unemployment insurance workers’ compensation, human rights and wage and hour issues are now decided using the same standards.
DO YOUR INDEPENDENT CONTRACTORS PASS THE TEST?
As an employer, you must ensure that your relationship satisfies all conditions of the “AB” Test. If your relationship with the independent contractor does not meet the conditions of the test, the worker is considered to be your employee.
A worker is presumed to be an employee unless he demonstrates freedom from control or direction over the performance of services, under the contract and in fact – the “A” test.
Consider the following under the “A” test:
Employer does not have control over the details of the work, but merely exercises the necessary control to achieve the ultimate result.
Employer does not furnish equipment.
Method of payment: for example – payment by the hour is more indicative of employee status while lump sum payment is more supportive of an independent contractor relationship.
The employer is exposed to liability for breach of contract if the worker is terminated.
The worker must also be engaged in an independent established trade, occupation, profession or business. (The “B” Test) During an audit, the following documentation should be provided to support the independent contractor status:
Copy of the written contract between the worker and the employer.
Proof the independent contractor advertises in the yellow pages or other public directory or advertisement.
Copy of the contractor’s business license or permit.
Business cards or printed invoices from the independent contractor.
Insurance certificates.
Taxpayer identification number.
Evidence (purchase agreements, titles or lease contracts) of the contractor’s investment in tools, equipment or specialized knowledge.
Consider these components when hiring “independent subcontractors” as failure to do so could leave you and your company substantially exposed. Would your workers compensation respond in the event the “independent” was injured? If he/she did not meet the definition of an IC they would be considered an employee covered under your company policies!

Among the ranks of associate
members are subcontractors, sales and
marketing specialists, architects,
interior designers, title and settlement
experts, lawyers, people in the
financial services industry, product
suppliers and manufacturers, and
many more who are essential to the
challenging task of providing housing
for a growing population.
Associate members are also essential
to the BBIA and to the NAHB
federation, offering sponsorships,
devoting countless hours at committee
meetings and volunteering at special
events, and strengthening our industry
in the process.
Most importantly, our associate
members help broaden our
perspective so that we can assess
issues more objectively in the context
of our entire industry.
In recognition of the thousands of
associates who volunteer their time
and services to NAHB and its state and
local affiliates, NAHB has designated
September as Associate Member
Appreciation Month. NAHB has always
appreciated the dedication and
enthusiasm of its associate members,
but in today’s unsettled – and

than ever.

month, for that matter – I urge all BBIA
members to get to know one another
better, learn about each others’
businesses and whenever possible, to
do business with other members.
Our HBA is strong when individual
members are strong, and doing
business with other members is a great
way to strengthen the association
while ensuring that the people you
work with understand the issues and
concerns that affect your day-to-day
operations.
NAHB has established an award to
acknowledge the importance of
associates to the national federation.
The NAHB Associate of the Year Award
recognizes associates who have made
outstanding contributions to their
local, state and national associations
and to the home building industry.
Each state is invited to submit one
nomination for the NAHB Associate of
the Year and the Society of Honored
Associates Awards. A panel of judges
selects up to five outstanding entries,
and the most outstanding associate is
named the Associate of the Year. The
others are inducted into NAHB’s
prestigious Society of Honored
Associates.
The Bill Polley BuildPac Award
acknowledges the associate member
who epitomizes the loyalty and diligent
BuildPac fundraising efforts of the late
Bill Polley, a past Associate BuildPac
Subcommittee chairman.

Nov. 14. What associate member
deserves to represent BBIA. More

EPA Publishes Final Lead RRP Rule
Attention multi-family property
owners/managers, painters, contractors and
other members of the regulated community:
EPA has published the final rule for the Lead
Renovation, Repair and Painting Rule (LRRP)
in the August 5, 2011 edition of the Federal
Register. The changes made to the LRRP go
into effect on October 4, 2011.
The good news is: EPA will not require
clearance and dust wipe testing!
There are several changes which will directly
affect your job sites. These are summarized
below.
1. Certified Renovators may collect a
paint chip, from the components to be
disturbed, for laboratory analysis. This
is an alternative to performing an EPA
recognized test kit. EPA will be
publishing guidance on how those
renovators previously certified will be
able to receive training on this option.
2. Vertical containment or equivalent
extra precautions in containing the
work area must be used on exterior
renovations performed within 10 feet of
the property line. By incorporating the
phrase “or equivalent extra
precautions” EPA is allowing
contractors to use the technique which
best suits the situation in order to
contain dust during an exterior
renovation. EPA is additionally allowing
the use of less than 10 feet (for
exteriors) and less than 6 feet (for
interiors) of plastic sheeting or other
impermeable material to be placed on
the ground/floor if used in conjunction
with a vertical containment.
3. EPA is clarifying that the prohibited
practices apply to all painted surfaces,
not just “lead-based paint.” To do this
EPA replaced the term” lead-based
paint” with “painted surfaces” and
added “painted surfaces” to the
definitions within the regulation.
4. HEPA vacuums must now be operated
in accordance with manufacturer’s
instructions.
5. EPA is clarifying that the on the job
training required to be provided by the
certified renovator refers to only those
lead-safe work practices required by
the LRRP.
6. The recordkeeping and post renovation
reporting requirements are modified to
include paint chip sampling results
similar to the previous requirements of
recognized test kits.
As you can see these changes are relatively
minor, allowing the certified renovator and the
renovation firms to stay in compliance with the
regulation without a significant change to their
business practices.
