BY-LAWS

ARTICLE IName of Committee

The name of this committee shall be the VallivueSchool District Migrant/LEP Program ParentAdvisory Council (hereafter referred to as theVPAC).

ARTICLE UObjectives

The objective of the VPAC shall be to assist theIdaho Migrant and LEP Education Programs(hereafter referred to as the MLEP) in VallivueSchool District (hereafter referred to as the District)to bring about the cooperation and coordination ofmigrant and LEP parents who are of value to theschools in the intent to provide educationalprograms for migrant and LEP students. Inachieving this purpose, the VPAC shall provideadvice and assistance in:

5. Planning, developing, implementing, andevaluating the MLEP and disseminatinginformation relative to the objectives of theprogram.

6. Acting as a hearing board for any migrant/LEP group that may want to proposeadditional changes in/or to the District’sproposed Compensatory Education programs.

7. Developing programs in cooperation withexisting District programs.

8. Mobilizing and coordinating communityresources to address problems.

This section of the By-Laws shall in no way beconstrued as giving the VPAC a veto over Title I orover any other Compensatory Education programs.

I. The VPAC shall be an advising, coordinating,and evaluating agency in order to fUrther thepurpose of education and the specific purposeof these By-laws.

2. The VPAC shall have no power to enter intocontracts of any nature or to spend publicfunds.

ARTICULO INombre del comité

El nombre de este comité ha de ser Comité Asesorde Padres del Programa Migrante/LEP del DistritoEscolar de Vallivue (al cual se referirá en adelantecomo el VPAC).

ARTICULO IIObjetivos

El objetivo del VPAC ha de ser en asistir a losProgramas de Educación Migrante y LEP (al cualse referirá en adelante como el MLEP) en el DistritoEscolar de Vallivue (al cual se referirá en adelantecomo el Distrito) para conseguir Ia cooperación ycoordinación de los padres migrantes y con nifiosLEP quienes son de mucho valor pan las escuelasen su intento de suministrar programas educativospara los estudiantes migrantes y LEP. Con estepropósito, el VPAC debe proveer consejo yasistencia en:

I. Planeamiento, desarrollo, implementación yevaluación del MLEP y difundir informaciónrelativa a los objetivos del programa.

2. Actuar como comité de escucha pancualquier grupo migrante/LEP que quieraproponer cambios adicionales en ó pan lospropOsitos del Distrito en los programas de IaEducacion Compensatoria.

3. Desarrollo de programas en cooperación conlos programas existentes en el Distrito.

4. Movilizar y coordinar los recursoscomunitarios pan resolver problemas.

Esta sección de los Estatutos de ninguna manera sepuede interpretar como un poder del VPAC pandenegar o vetar programas de Titulo 0 deEducación Compensatoria.

I. El VPAC sera un ente consejero, decoordinación y evaluación enfocado eneducación y con los propésitos especificadosen estos Estatutos.

2. El VPAC no tendra ningün poder de celebrarcontratos de ningilna naturaleza o de gastarfondos püblicos.

3. In the absence of his/her written consent, nocommittee member shall be required toprovide any sum of money, property, orservice, other than services described herein,to the VPAC.

4. The VPAC shall have no power to bind anymember or the District to any debt, liability orobligation in the absence of an expresswritten authorization for the party to bebound.

5. The V1’AC shall have no powers beyondthose expressly set forth herein.

ARTICLE ifiMembership

Section 1. Confidentiality Statement for VPACAll information pertaining to these participants,including but not limited to, name, home telephonenumber and address, race, grades, and all otherinformation pertaining to any participant in theprogram must be kept highly confidential. VPACmembers shall not discuss or disclose anyinformation pertaining to any Migrant/LEPparticipant, now or in the future.

Section 2. Composition of the VIACThe committee should consist of fifteen (15)members. This is a committee formed by at leastone-third of migrant parents with children eligible toparticipate in the Migrant Education Program(MEP) and two-thirds of parents with childrenidentified to participate in the LEP Program.

Section 3. Election of MembersMembers will be elected from each of the schoolsand each school should have one to threerepresentatives. A single member can representmore than one school. Seven (7) or one half of themembers will be elected each year.

Section 4. Term of OfficeAll members of the VPAC shall serve a two (2)school year term with the right to be re-elected, foranother term through an alternating election processevery year.

Section 5. Voting RightsEach member shall be entitled to one vote and maycast that vote on each matter submitted to a vote ofthe VPAC. Proxy voting and absentee ballots shallnot be permitted.

ARTICULO mMembrecia

Sección 1. Declaraclon de Confidencialidad parael VPACToda Ia información referente a estos participantes,incluyendo pero no limitados a nombre, námero deteléfono y dirección, raza, grados, y el resto de Iainformación referente a cualquier participante en elprograma se debe mantener altamente confidencial.Los miembros del VPAC no deben discutir nidivulgar ninguna información referente a cualquierparticipante Migrante/LEP, ahora o en el futuro.

Sección 2. Composición del VPACEl comité consistirá de quince (15) miembros. Estees un comité formado por a lo menos un tercio depadres migrantes con niños elegibles a participar enel programa y dos tercios de padres con hijosidentificados pan participar en el programa de LEP(Proficiente en Ingles Limitado).

Sección 3. Eleccion de los MiembrosLos miembros serán elegidos por representación encada una de las escuelas y cada escuela debe tenerde uno a Ires representantes. Un solo miembropuede representar a más de tana escuela. Siete (7) ouna mitad de los miembros serán elegidos cada aflo.

Sección 4. Termino de NombramientoTodos los miembros del VPAC serán elegidos porun término de dos (2) afios escolares y podrán serreelegidos por otro término a través de un procesode elección altemante cada to.

Sección 5. Derecho al VotoCada miembro tendra derecho a un voto y podrausarlo en cada asunto que se Ileve a votación por elVPAC. No se permitirá votar por ausencia o porapoderado.

Section 6. Termination of MembershipA member shall no longer hold membership whenhe/she terminates his/her relationship with theDistrict. In the case of unjustifiable absence fromregular or extraordinary meetings, for three (3)consecutive meetings in one year, he/she shall bereplaced. The Secretary will contact this member inwriting.

Section 7. ResignationAny member may resign by filing a writtenresignation with the VPAC.

Section 8. VacancyAny vacancy on the VPAC shall be filled for theremainder of the unexpired term throughappointment from the interested candidates list, torepresent the appropriate school(s).

Sección 6. Terminación del Derecho de SerMiembroUn miembro dejará de ser miembro cuando terminesu relacion con el Distrito. En caso de que unmiembro se ausente injustificadamente de las juntasregulares o extraordinarias, por tres (3) juntasconsecutivas al aflo, el o ella será reemplazado. Elsecretario(a) se pondrá en contacto con el miembropor escrito.

Sección 7. RenunciaCualquier miembro puede renunciar enviando unacarta en Ia que se manifleste su deseo al VPAC.

Sección 8. VacantesCualquier vacante del VPAC será ocupada por loque queda del término. El nombramiento será de Ialista de candidatos interesados para representar a Iaescuela indicada.

ARTICLE IVOfficers

Section 1. OfficersThe officers of the VPAC shall consist of aPresident, Vice-President and Secretary/Treasurer.Officers’ immediate family members will bedisqualified to run for office for that particular term.The treasurer position will become independentonly when the VPAC has available finds toadminister and when the executive committeeconsiders it necessary.

Section 2. State RepresentativesThere will be two (2) State Representatives and two(2) alternates. They will take and bring informationand reports between the Region and State ParentAdvisory Committee meetings/trainings.

Section 3. Election and Term of OfficeThe officers of the VPAC shall serve up to a three(3) school year term with the option to advance intothe next position or resign from office withouthindering membership. Re-elections should followan ascending election process every consecutiveyear for one (1) vacant position at a time.Officers/representatives may be re-elected foranother term in a non-consecutive year.

ARTICVLO IVOficiales

Secclón 1. OflcialesLa mesa directiva del VPAC consistirá en unPresidente, Vicepresidente y Secretario(a)/Tesorero(a). Los miembros familiares inmediatosde los oficiales serán descalificados de participar enalgün puesto oficial durante ese término enparticular. La posición de tesorero(a) se convertiráindependiente solo cuando el VPAC tenga fondosdisponibles pan administrar y cuando el comitéejecutivo lo considere necesario.

Sección 2. Representantes al EstadoHabra dos (2) Representantes al Estado y dos (2)suplentes. Los representantes Ilevaran y traeráninformación y reportes entre el VPAC del distrito ylas reuniones /entrenamientos del Comité Asesor dePadres del Estado.

Seccion 3. ElecciOn y Térnilno deNombramientoLa mesa del comité del VPAC servirá hasta tres (3)aflos escolares con Ia opción de avanzar a IaprOxima posición o renunciar al puesto oficial sinrepercusión hacia Ia membresIa. Las reeleccionesdeberan de seguir un proceso de elección deascender cada alto por una (1) posición vacante a lavez. Los miembros de Ia mesa directiva podrán serreelegidos por otro término durante un alto que nosea consecutivo.

Section 4. Removal of an OfficerAny officer elected or appointed by the VPAC maybe removed by a two-thirds vote of all memberssifting on the VPAC whenever, in the judgment ofthe VPAC, the best interests of the VPAC would beserved thereby.

Section 5. VacancyA vacancy in any office because of death,resignation, removal, disqualification, or otherwise,should be appointed by the VPAC for the unexpiredportion of the term with at least a two-thirds of theirvotes. Appointees of a remaining term of less thanone (1) year shall have no restrictions to run foroffice in the following election year.

Section 6. PresidentThe President shall preside at all meetings of theVPAC, and may along with the Migrant Director..signall letters, reports, and other communications of theVPAC. In addition, he/she shall perform all dutiesincidental to the office of President and the VPACmay prescribe other duties from time to time. ThePresident shall be a parent representative, and underno conditions should the President be a Districtemployee nor an employee of the Idaho State MLEP.

Section 7. VIce-PresidentThe duties of the Vice-President shall be to representthe President in assigned duties and to substitute forthe President during his/her absence, and he/she shallperform such other duties as from time to time maybe assigned to him/her by the President or by theVPAC.

Section 8. SecretaryThe Secretary will keep records of the meetings andwill keep attendance records of the VPAC memberswith the help ofMLEP staff.

Sección 4. Eliminacion de un Oficial o de unRepresentante.Cualquier oficial elegido o nominado por el VPACpodrá 5cr removido de su posición con el voto de dostercera paftes de todos los miembros del VPAC,cuando sea para un mej or beneficio a juicio de losintereses del VPAC.

Sección 5. VacantesUna vacante que ocurra por muerte, renuncia,remoción, descalificaciOn u otros motivos deberá sercubierta por nombramiento del VPAC por el resto deltermino por a lo menos dos terceras partes de losvotos. Los elegidos a cubrir el resto de tin t&mino demenos de un (1) aflo no seran restringidos de laselecciones del próximo aflo.

Sección 6. PresidenteEl Presidente presidirá todas las reuniones del VPAC,y tendrá el poderjunto con el Coordinador delPrograma Migrante/LEP de firmar cartas, reportes, yotras comunicaciones del VPAC. Además, elPresidente Ilevara a cabo todas las obligaciones queestán a su cargo como lo indique el VPAC. ElPresidente sera un representante de los padres y bajoninguna circunstancia sera empleado del Distrito odel MLEP.

Sección 7. VicepresldenteLas responsabilidades del Vicepresidente serán derepresentar al Presidente cuando se lo indique, ysustituir al Presidente durante su ausencia. Ademástendrá otras responsabilidades que de vez en cuandoIc asigne el Presidente o el VPAC.

Secclón 8. Secretario(a)El Secretario(a) mantendrá toda Ia documentación delasjuntas y de Ia asistencia de los miembros delVPAC con la ayuda del personal del MLEP.

ARTICLE VSub-Committees

Section 1. Short/Long Term Sub-CommitteesThe VPAC may from time to time establish andabolish such sub-committees when necessary.Short-term sub-committees will be set up by theVPAC only for specific purposes and timeframes asneeded. There is no long-term sub-committee otherthan the executive committee which consists of thePresident, Vice-President, Secretary and at leasttwo (2) MLEP representatives and/or District staff.MLEP and District staff may act as consultants tothe special short-term sub-committee.

Section 2. MembershipUnless otherwise determined by the VPAC in itsdecision to establish a sub-committee, the Presidentof the VPAC shall appoint members to other specialsub-committees when necessary.

Section 3. Term of OfficeEach member of a sub-committee shall continue assuch for the term of his/her appointment or untilhis/her successor is appointed, unless the subcommittee shall be sooner terminated or abolished,or unless such member shall cease to qualify as amember thereof.

Section 4. RulesEach sub-committee may adopt rules for its owngovernment not inconsistent with these By-laws orwith rules adopted by the VPAC. The subcommittee shall report to the VPAC for action to betaken. Sub-committee decisions may be overruledby two-thirds of the VPAC executive committee.

SectIon 5. QuorumUnless otherwise provided in the decision of theVPAC designating a sub-committee, 51% of theestablished sub-committee shall constitute aquorum and the act of a majority of the memberspresent at a meeting at which a quorum is presentshall be the act of the sub-committee.

Section 6. VacancyA vacancy on the sub-committee may be filled inthe same manner as officers are originallyappointed.

ARTICULO VSubcomités

Seccion 1. Subcomités de Corto/Largo TérminoEl VPAC puede establecer o eliminar subcomitescuando sea necesario. Los subcomités de cortoplazo seran establecidos por el VPAC solamentepan propuestas y feehas especificas como seanecesario. No existe otro subcomite de largo plazoque el comité ejecutivo cual consiste del Presidente,Vicepresidente, Secretario (a), y de a lo menos (2)MLEP y/o personal del Distrito. EL personal delMLEP y Distrito pueden actuar como consultantespara los subcomités de corto plazo especiales.

Sección 2. Miembros de SubcomitésA no ser que el VPAC determine de otro modo alestablecer un subcomite, el Presidente del VPACnombrara a los miembros que servirán ensubcomites especiales cuando sea necesario.

Sección 3. Termino de NombramientoCada miembro de los subcomités mantendrá sucargo hasta que termine el nombramiento o hastaque su sucesor halla sido nombrado, a menos que elsubcomité sea disuelto o eliminado o que talmiembro cese de calificar como miembro.

Seccion 4. ReglasCada subcomité podra adoptar reglas paragobemarse, siempre y cuando sean consistentes conlos Estatutos adoptados por el VPAC. El subcomitedebe reportar al VPAC las acciones a tomar. Lasdecisiones de los subcomites pueden ser anuladaspor dos terceras partes de los votos del comitéejecutivo del VPAC.

Sección 5. Quorummenos que el VPAC decida lo contrario, el 51%

de los miembros constituiran quorum de unsubcomité y las decisiones de Ia mayoria de losmiembros presentes en una junta en Ia que hallaquOrum serán consideradas como actos oficiales delsubcomité.

SecciOn 6. VacanteUn vacante en un subcomite puede Ilenarse de lamisma manera en que se hizo en el nombramientooriginal.

ARTICLE VIMeetings and Attendance

Section 1. Regular MeetingsThe VPAC will meet at least three (3) times percalendar school year. The VPAC will schedule theregular meetings. However, the MLEP office cancall extra meetings when necessary. Trainingsessions can be offered in place of regularlyscheduled meetings.

Section 2. Special MeetingsSpecial meetings may be called by the President, bythe MLEP coordinator or by majority vote of theVPAC.

Section 3. Place of MeetingsThe VPAC shall hold its regular meetings and itsspecial meetings in an area within the District.

Section 4. Notice of MeetingsNotices will be sent for all regular and specialmeetings. Any change in the established date,time, or location must be given special notice.Any required notice shall be in writing and/or byphone and shall state the day, hour, and location ofthe meeting, and shall be delivered either

personally or by mail to each member not less thanfive business days or more than two weeks beforethe date of such meeting.

Section 5. DecisionsAll decisions of the VPAC shall be made onlyafter an affirmative vote of a majority of itsmembers in attendance, provided a quorum is inattendance.

Section 6. QuorumA quorum will consist of two-thirds of votingmembers and at least a 51 % representation of theschools of the District. In addition to theaforementioned criteria, at least one officer fromthe VPAC must be present.

Section 7. Conduct of MeetingsAll regular and special meetings of the VPACshall be conducted in accordance with ROBERT’SRULES OF ORDER or in accordance with anappropriate adaptation thereof.

ARTICULO VIJuntas y Asistencla

Sección 1. Juntas RegularesEl VPAC se reunirá por a lo menos (3) veces porailo escolar. El VPAC programará lasjuntasregulares. Sin embargo, el MLEP puede Ilamar ajuntas extraordinarias cuando sea necesario.Sesiones de entrenamiento pueden ser ofrecidas enlugar de una junta regular.

Sección 2. Juntas EspecialesJuntas Especiales seran anunciadas por elpresidente, por el coordinador del MLEP o por unvoto de Ia mayoria de los miembros del VPAC.

Secclón 3. Lugar de las JuntasEl VPAC tendrá sus juntas regulares y especiales enun lugar coordinado dentro del area del Distrito.

Sección 4. Recordatorio de las JuntasSe mandará aviso pan todas las juntas regulares yextraordinarias. Cualquier cambio de fecha, hon ositio establecidos tiene que darse aviso especial.Todo recordatorio será por escrito o por teléfono ydará el dia, Ia hora, y el sito de lajunta, y seentregará personalmente o por correo a cadamiembro no menos de cinco dIas y no mas de dossemanas antes de Ia reunion.

Sección 5. DecisionesTodas las decisiones del VPAC serán tomadassolamente si existe un voto afirmativo de Iamayoria de los miembros, siempre y cuando hallaquorum.

Sección 6. QuOrumEl quOrum consistirá de dos terceras partes del losmiembros actos para votar que estén presentes yexista una representaciOn del 51% de las escuelasdel Distrito. Además del criterio anotado, serequiere que al menos un oflcial del VPACeste presente.

SecciOn 7. Forma de Conducir las ReunionesTodas las reuniones regulares y especiales delVPAC deben conducirse de acuerdo con lasreglas de ‘ROBERT’SRULES OF ORDER’ (Reglasde Procedimiento de Robert) o de acuerdo conalguna adaptaciOn apropiada de las mismas.

ARTICLE VIIAmendments

These By-laws may be amended at any time bya two-thirds affirmative vote of the members ofthe VPAC and prior approval from the MLEPand/or District.

In witness whereof, the Vallivue School DistrictMigrant and LEP Education Program and MigrantEducation Parent Advisory Committee have causedthese By-laws to be duly executed on the 1tt day ofAugust of 2009.

ARTICULO WIEnmiendas

Estos Estatutos pueden ser enmendados encualquier momento por dos tercios del votoafirmativo de los miembros del VPAC y de laaprobación previa del MLEP y/o el Distrito.

Como testigos presentes, los Programas deEducación Migrante y LEP del Distrito Escolarde Vallivue y el Comité Asesor de Padres ha hechoefectivos estos reglamentos el dia iro del mes deAgosto de 2009.
