- 2010 Infant Feeding Survey found that only19% of working mothers had access toworkplace facilities to express milk or tosupport breastfeeding

- Mothers returning to work full-time weremore likely to report that feeding had beenaffected by work than those working part-time (28% f/t compared to 12% working fewerthan 15 hrs/wk) (McAndrews and others 2012)

Half of all pregnant womensuffered a related disadvantage atwork, and that each year 30,000were forced out of their job (EOC2005)

In 2014, all the available evidencesuggests that such pregnancy andmaternity discrimination is nowmore common than ever

The LawWomen do not have a statutory right tobreastfeed on return to work HOWEVERbreastfeeding mothers have some legalprotection under health and safety and sexdiscrimination laws

The Law: Health and safety protection- Very few direct risks from working but

scientific evidence shows that the baby’shealth and mother’s health are put at risk ifthe mother does not breastfeed for 12 months

The Law: Health and safety protectionIf the woman’s work brings you into contact witha dangerous substance, the employer should takeappropriate steps to make the job safe.

If this is impossible, the woman may betransferred to a suitable alternative job orsuspended on full pay.

The Law: Health and safety protection- A risk assessment must be conducted- Risk must be mitigated- Employer must give information on action

taken to mitigate risk- If there are still risks and the woman wants

employer to take action, the employer mustbe informed in writing

The Law: Health and safety protection- Reasonable action should be taken to protect

the woman’s health and safety whilstbreastfeeding e.g. rest breaks, comfortableenvironment

- Note: the law does not currently allow asimple, straightforward right to breastfeedingbreaks.

The Law: Flexible working hours

- All employees (with at least 26 weeks' service)have the right to ask for flexible work.

- Employees have legal protection againstindirect sex discrimination

The Law: Discrimination law

A breastfeeding woman is protected againstsexual harassment which could includedetrimental treatment or offensive teasingbecause they are breastfeeding.

Maternity Action was funded by the Department ofHealth to develop a programme for delivery at locallevel to promote breastfeeding on return to work

ACAS guidance

We worked with ACAS, theGovernment’s employeradvisory service, on thedevelopment of their guidance,with a number of otherorganisations.

Rigorous process behind production of leaflet foremployers:

- Consultation and extensive research with projectreference group, which included representativesfrom the LCGB, Association of BreastfeedingMothers, NCT, La Leche League, specialist infantfeeding midwives and others.

- Consultation with ten employers (four small, onemedium, one large); studied draft leaflet(s) thentook part in a phone interview
