3:45-4:45Patent Reform: Two Sides of the Same Coin

There is patent legislation (H.R. 2795) currently pending before Congressthat may bring the most sweeping changes to U.S. patent law since the 1952Patent Act. H.R. 2795 has been hotly debated before Congress and in various forums. Numerous "marked-up" versions of the bill now exist.Most contingents support the bill to the extent they believe it will improvethe quality of patents. Provisions of the bill that are focused more on litigation reform and harmonization, however, have received mixed reviewsand some of those provisions have become hot buttons for various industrygroups. The two industry groups who define the edges of the spectrum onthe debate are the biotechnology/pharmaceutical industry and the techindustry. This panel brings together representatives from both groups for a round table discussion of their views on the changes proposed in H.R.2795 and the various drafts. The panel will discuss numerous issues,including:

� Institution of post-grant opposition proceedings, the standard ofreview therein and the "second window" for filing oppositions
