Sanction of the Government is herebyaccorded for creation of one post of DirectorCivil Aviation, in the pay scale of PB 3,Rs. 15,600-39,100/- + Rs. 6,600/- GP in theDirectorate of Civil Aviation with immediateeffect, to be filled by Goa Civil Service Officers.

The expenditure on pay and allowancesshall be debited to the Budget Head: 3053—Civil Aviation; 02—Airports; 800—OtherExpenditure; 01—Establishment of AirportCell (Plan), 01—Salaries.

Read: Notification No. DCS/S/SKO-DBTK//2016-17/182 dated 25-5-2016 pub-lished in Official Gazette, Series INo. 10 dated 9-6-2016.

Whereas vide above read Notification theGovernment had decided to identify & registerthe Non LPG ration card holders from the State.Now that the Non LPG card holders have beenidentified, the Government is pleased to fix aquota of 15 Litres per household per month ofSuperior Kerosene Oil (SKO) quota from themonth of August, 2016 onwards.

This quota as per the decision of Governmentin Notification read above shall henceforthbe distributed only through Fair Price Shophaving kerosene licence.

sub-section (1) of section 40 of the NationalFood Security Act, 2013 (No. 20 of 2013), ishereby published (as indicated in the Annexurebelow) for information of all persons likely tobe affected thereby and notice of thirty daysfrom the date of its publication in the OfficialGazette.

Any views or suggestions, which may bereceived from any person with respect to thesaid draft rules before the expiry of the periodso specified, will be decided by the StateGovernment.

ANNEXURE

The Goa Food Security Rules, 2016In exercise of the powers conferred by

sub-section (1) of section 40 of the NationalFood Security Act, 2013 (No. 20 of 2013) theState Government is pleased to make thefollowing Rules, namely:—

1. Short title, extent and commencement.—(1) These rules may be called the Goa FoodSecurity Rules, 2016.

(2) It extends to the whole of the State ofGoa.

(3) It shall come into force upon itspublication in the Official Gazette.

2. Definitions.— In these rules, unless thecontext otherwise requires,—

(1) “Act” means The National FoodSecurity Act, 2013 (No. 20 of 2013).

(2) “Commission” means The Goa StateCommission for Women to exercise thepowers and functions of the Goa State FoodCommission referred to in section 16 of theAct.

(3) Words and expressions not defined inthese rules but defined in the National FoodSecurity Act, 2013, shall have the samemeaning assigned to them in the Act.

3. Identification of Eligible Households.— (1)Identification of Eligible Households shall bein accordance with the guidelines framed bythe State Government under section 10 ofthe Act.

(2) The State Government may, at suchintervals or any other time, it may deem fit,re-identify the eligible Households.

(3) The State Government may, if it deemsfit, by notification, amend the prescribedguidelines from time to time.

4. Grievance Redressal System.— (A) InternalSystem of Grievance Redressal:—

(1) The State Government shall set up full--fledged and efficient Internal System ofGrievance Redressal for speedy disposal ofthe complaint relating to the Act;

(2) The Internal System of GrievanceRedressal may also consist of—

(a) a helpline with toll free numberestablished for registering complaints andproviding information to the public;

(b) a Web-based grievance redressalportal;

(3) The officer in-charge of Civil Supplies atTaluka or any other officer not below the rankof the Mamlatdar/Jt. Mamlatdar authorized bythe Government shall be the Nodal GrievanceRedressal Officer with regards to TargetedPublic Distribution System at Taluka level.

(a) He shall redress all the grievancesof the Ration Card holders in respect ofnon-receipt of entitled quota.

(b) He shall conduct inquiry and takenecessary reports from the Inspector of CivilSupplies and accordingly dispose of thecomplaint.

(c) He shall redress the grievance soreceived within a maximum period of 45 daysfrom the date of receipt of the complaint.

(4) An appeal if any against the orders ofthe Nodal Grievance Redressal Officer may befiled with The District Grievance RedressalOfficer within a period of 30 days. Appeals filedbeyond the period of limitation are liable forrejection:

Provided that the Appellate Authority mayfor sufficient reasons condone the delay &decide the appeal.

(B) District Grievance Redressal:—

(I) District Grievance Redressal Officer.— (1)The State Government may by Notificationappoint any officer not below the rank ofDy. Collector as District Grievance RedressalOfficer.

(2) The officer already appointed shall bedeemed to be appointed under this rule (1)above.

(3) The District Grievance Redressal Officershall, on receipt of the complaint and appealagainst the order of Nodal Grievance RedressalOfficer either in writing or personally or throughhelpline or web, cause verification of thecomplaint received and address the concernto rectify the instance.

(4) The District Grievance Redressal Officershall redress the grievance so received as soonas may be but in any case within 60 days fromreceipt of the complaint.

(5) A quarterly report on No. of openingbalance of grievances, No. of grievancesreceived during the quarter, No. of grievancesdisposed of during the quarter and the No. ofpending grievances at the end of quarter shallbe submitted to the Director of Civil Supplies& Consumer Affairs, Panaji-Goa within a weekafter the end of quarter.

(II) Hearing before District GrievanceRedressal Officer.— (1) The District GrievanceRedressal Officer shall notify the days and timefor receiving the complaints under the Act.He shall nominate an appropriate officer//employee to receive complaints grievances onhis behalf.

(2) A fee of Rs. 200/- (Rupees two hundredonly) shall be obtained by affixing non-judicialstamp on the application in case the complaint//appeal is filed by persons other thanbeneficiaries and Rs. 50/- (Rupees fifty only)for beneficiaries. The complaints/appeals filedwithout affixing appropriate fees are liable foroutright rejection.

(3) The District Grievance Redressal Officershall hear complaint/appeals regarding non-

-distribution of entitled food grains, andmatters relating thereto.

(4) The process followed by the DistrictGrievance Redressal Officer for the inquiryshall be as follows:—

(a) He will verify whether there is aprima-facie substance in the complaint//appeal to proceed in the matter, if notdischarge the notice right away. If he issatisfied, that there is prima-facie groundsto proceed, he shall issue a notice to all theparties in the case about fixing date, timeand place for the hearing;

(b) On the date fixed for hearing he shallhear the parties and take such evidence asmay be given by them;

(c) If, on the date fixed by him, thedefending party is absent he may proceedto enquire the matter ex parte and decideaccordingly;

(d) After the enquiry, he shall makereasoned order giving directions to theconcerned Taluka Officer for implementationof the order.

(5) The direction and relief that can beprovided under sub-rule 3 above shall be asfollows:—

(a) Direction for provision of theentitlement not provided, within such periodnot exceeding thirty days;

(b) Any other appropriate direction;

(c) Direct an appropriate person orrepresentative to supervise the directionsissued in the matter.

(III) Appeal against the order of the DistrictGrievance Redressal Officer.— (1) Any personaggrieved by an order of the District GrievanceRedressal Officer shall prefer an appeal beforeGoa State Food Commission within 30 days ofthe order.

(2) Such appeal shall be accompaniedby such documents and a fee of Rs. 200/-by affixing non-judicial stamp on theapplication.

(3) Appeal filed without appropriate feesshall be summarily rejected.

(C) State Food Commission:—

(1) The Goa State Commission for Women orany other body as notified by the StateGovernment shall be the Goa State FoodCommission under the Act.

(2) Director of Civil Supplies and ConsumerAffairs shall be ex officio Member Secretary andshall provide all functional administrativesupport to the Commission in its dischargeof functions concerning the Act.

(3) A sitting fee of Rs. 800/- (Rupees eighthundred only) or any amount as may be fixedby Government from time to time shall be paidto the Chairperson and all the non-officialmembers per sitting per day or part.

(4) The Commission shall meet formally atleast once in a month in its headquarters orat its offices or at such other places as may bedecided by the Commission;

(a) As per the need and importanceof implementation of the Act in thoseplaces.

(b) The quorum for the meeting of theCommission shall be as per the requirementof the Women’s Commission:

Provided that for a meeting of theCommission to review any previous decisiontaken by the Commission or for considerationof any issue which could not be decided onaccount of equality of votes in favour of andagainst the resolution proposed, the quorumfor the meeting shall be all members beingpersonally present.

(c) The Chairperson of the Commissionmay instruct the Member Secretary to call ameeting of the Commission to be held at suchtime and at such place as the Chairpersonmay direct or as required. In addition, anytwo members of the Commission may

request for a meeting of the Commission atany time by sending a written request tothe Member Secretary with a copy tothe Chairperson. The Chairperson shalladjudicate on such request and may convenemeeting or reject the request for reasons tobe recorded.

(d) The Commission shall be entitled todecide urgent matters by circulation of thepaper to all the members.

(e) In case of a difference of opinion amongthe members of the Commission, the opinionof the majority shall prevail and the opinionof the Commission shall be expressed interms of the views of the majority. Eachmember of the Commission shall have onevote only. The Chairman shall have nocasting or second vote.

(f)All decisions, directions and orders ofthe Commission shall be in writing and shallbe supported by reasons. The decisions,directions and orders of the Commissionshall be available for inspection by anyperson. Copies of the same shall be madeavailable on the website of the Commissionor on the website of the Department of CivilSupplies and Consumer Affairs

(g) When the Chairperson of theCommission is unable to discharge thefunctions owing to absence, illness or anyother cause, the next senior member of theCommission shall discharge the functions ofthe Chairperson, until the day on which theChairperson assumes the charge of hisfunctions.

(5) The commission shall have the followingpowers, in addition to the powers providedin section 20 of the Act, for performing itsfunctions under sub-section 6 of section 16of the Act.

(a) To hear appeal over the decisions ofthe District Grievance Redressal Officers.The appeal shall lie within 30 daysfrom the date on which the decision

should have been made by or was actuallyreceived from the office of DGRO.

(b) While making a decision on the appealor the complaint, the State Food Commissionhas the power to require the DGRO or anyofficer responsible for providing anyentitlement under the Act to comply withthe Provisions of the National Food SecurityAct, 2013—

(i) Issue of ration cards or eligibilitycards upon satisfying the eligibilitycriteria.

(ii) Right to receive food grains atsubsidized prices by persons belongingto eligible households under AntyodayaAnna Yojana (AAY) or Priority HouseHolds (PHH).

(iii) Implementation of various schemesfor realization of entitlements under theAct.

(c) To summon DGRO or any other officialinvolved in the implementation of the Act,against which a grievance/complaint isreceived or whose presence is felt necessaryfor disposal of any matter before theCommission.

(d) To necessitate the presence of anyState Government Department officials andimplementation staff for any review meetingor any other related event.

(e) To direct any official to act in pursuanceof objectives of the Act or to perform anyfunctions necessitated to implement theprovisions of the Act.

(f) To decide on the appeals andcomplaints received and direct theappropriate authority to act accordingly.

(g) To visit and inspect any stock anddelivery point, fair price shop, office of DGROor any other office performing designatedfunctions related to the implementation ofthe Act.

(h) To commission any studies or enquiriesin pursuit of better understanding ofthe implementation, impacts of the Actand for necessary improvements in theimplementation processes.

(i) All orders and decisions of theCommission shall be authenticated by theMember-Secretary or any other officer ofthe Commission duly authorized by it onits behalf.

5. Vigilance Committees.— (1) The VigilanceCommittees constituted/revamped at differentlevels shall effectively function, on the duedates.

(2) The Vigilance Committee(s) willcomprise as under:—

I. At State level.— The State ConsumerProtection Council constituted undersub-section (1) of section 7 of the ConsumerProtection Act, 1986 shall also function asthe State Level Vigilance Committee undersub-section (1) of section 29 of the Act:

Provided that whenever such Councilmeets, to also discuss the complaints//grievances or undertakes a review of theimplementation of the National Food SecurityAct it shall invite all the members of theParliament as special permanent invitee tothe State Level Vigilance Committeemeeting as its ex officio Vice Chairmen.

II. At District level.— The DistrictConsumer Protection Council constitutedunder sub-section (A) & (B) of section 8 ofthe Consumer Protection Act, 1986 shall alsobe the District Vigilance Committee undersub-section (1) of section 29 of the Act.

III. At Taluka level.— The Nodal GrievanceRedressal Officer shall be the Chairpersonof the Taluka Level Vigilance Committee whoshall issue a notification constituting theTaluka Level Vigilance Committee withminimum of 5 members representing varioussections as provided under section 29(1) ofthe Act.

IV. At Fair Price Shop level.— TheChairperson/Sarpanch of the local body i.e.Municipality or Panchayat shall be theChairman of the Fair Price Shop levelVigilance Committee alongwith minimum3 (three) elected representatives ofthe local body for the Fair Price Shopslocated within the jurisdiction of the localbody.

(3) Powers of the Committees.— The VigilanceCommittees shall perform such functions andhave such powers as are prescribed undersection 29 of the Act.

(4) Meetings.— (1) (a) The State Level &District Level Vigilance Committees shall meetat least twice in a year or more as decided bythe Chairperson.

(3) A statement on number of meetingsheld during the financial year i. e. 31stMarch may be sent to the Director of CivilSupplies & Consumer Affairs, Panaji-Goawithin a week after the end of financialyear.

(4) The Taluka & Fair Price Shop levelVigilance Committees may also, in caseswhere it finds a matter to be of utmostimportance, send the information to theDistrict Grievance Redressal Officer.

6. Social Audit.— The Social Audits of theFair Price Shops shall be conducted everyyear by the concerned local body.

7. Keeping records in public domain.— All thematters as far as posible, related to PublicDistribution System shall be placed on thewebsite of the Department of Civil Supplies
