In partial modification of the GovernmentNotification published in the Official Gazette,

Series I No. 36 dated 05-12-2013, the Governorof Goa is pleased to amend the scheme called“Kissan Mitra”.

Amendment of Rule 5.— The followingprovision shall be substituted, namely:—

The following scheme for Constitution andAdministration of the Consolidated SinkingFund of Government of Goa is transcribed herebelow for publication of the same in the OfficialGazette for general information of public.

This supersedes the earlier Notification readhereinabove and the said scheme shall beeffective from the date of publication of thisNotification in the Official Gazette.

--------Revised Model Scheme for Constitution andAdministration of the Consolidated Sinking

Fund of Government of Goa1. Title of the scheme.— The scheme shall be

called ‘Consolidated Sinking Fund Scheme’(hereinafter referred to as ‘the Fund’) of theGovernment of Goa (hereinafter referred to as‘the Government’).

2. Constitution of the Fund.— The Fund willbe constituted by the Government of Goa forredeeming its outstanding liabilities.

3. Objective of the scheme.— The Fund is tobe utilised as an Amortisation Fund forredemption of the outstanding liabilities of theGovernment commencing from the financialyear 2020-21.

4. Commencement of the Operation of thescheme.— The Fund shall come into force witheffect from the financial year 2015-16.

Explanation.— (a) The Fund shall substitutethe extant CSF scheme adopted by theGovernment.

(b) The outstanding balances of the extantCSF scheme as at end-March 2015 shall betransferred to the Fund.

(c) The interest accrued and accumulated inthe Fund only shall be utilised towards theredemption of the outstanding liabilities of theGovernment as hereinafter provided.

(d) The Fund shall not be utilised for anypurpose other than redemption of theoutstanding liabilities of the Government:

Provided that the net incremental annualinvestment of States (i.e. outstanding balanceover and above the level in the correspondingperiod of the previous year) shall be eligiblefor availing Special Drawing Facility (SDF) suchthat the availment of SDF under this provisiondoes not exceed the Normal WMA limit.

(e) The outstanding liabilities is defined tocomprise of internal debt and public accountliabilities of the Government.

5. Contributions to the Fund.— TheGovernment may contribute to the Fund on amodest scale of at least 0.5 per cent of theoutstanding liabilities as at the end of theprevious year beginning with the financial year2015-16. The Government shall make effortsto raise the minimum contribution every year.There is no ceiling on such contributions to theFund in terms of number of times of makingcontributions in a year. It is open to theGovernment to invest in the Fund from theGeneral Revenue at any time or from othersources such as disinvestment proceeds to theFund, at its discretion. The Government shallnot fund its contribution to the Fund out ofborrowings from the Reserve Bank.

6. Relationship of the Fund with GeneralRevenues.— The corpus of the Fund comprisingthe periodic contributions as well as theincome accruing to the Fund shall be keptoutside the General Revenue of theGovernment. The Fund shall be utilised in themanner prescribed in this scheme.

7. Administration of the Fund.— The Fundshall be administered by Central AccountsSection of the Reserve Bank of India at Nagpur(hereinafter referred to as the Bank), subjectto such directions/instructions as theGovernment may issue from time to time.

8. Investment of the corpus of the Fund.— Theaccretions to the Fund shall be invested inGovernment of India dated Securities, TreasuryBills, Special Securities of GoI and SDLs of otherStates of such maturities as the Bank maydetermine from time to time in consultationwith the Government.

Explanation.— (a) The accretions to the Fundshall include the periodic contributions and theincome accruing to the Fund from investmentthereof.

(b) The Bank will make available thesecurities for investment either from its owninvestment portfolio or by acquiring thesecurities from the secondary market, withoutloading any charge other than that indicatedin paragraph 10.

9. Account Transactions.— (a) The Bankwould arrange to raise a debit to the accountof the Government maintained with it as perthe advice of the Government.

(b) The contributions to the Fund shall beinvested by the Bank in Government of IndiaSecurities as indicated in paragraph 8 inmultiples of Rs. 10,000/-.

(c) The periodic accretion to the Fund byway of interest income shall be reinvested bythe Bank in a similar manner, in multiples ofRs. 10,000/-.

(d) The investments held in the Fund andmaturing during currency of the scheme shallbe reinvested in accordance with paragraph 8.

(e) No withdrawals will be allowed from theFund until 2020-21:

Provided that States that have already setup the Fund under the earlier scheme maywithdraw an amount in a year after the lock-inperiod stipulated in the earlier scheme. Theamount shall not exceed the amount ofredemption due for that year in respect of openmarket borrowings.

Explanation.— (a) Withdrawals may beallowed in the financial year 2020-21 from outof the interest income accrued and accumulatedin the Fund up to the financial year 2019-20towards the redemption of the outstandingliabilities of the Government as per itsdirections. Similarly, withdrawals may beallowed in the financial year 2021-22 from outof the interest income accrued and accumulatedin the Fund up to the financial year 2020-21towards the redemption of the outstandingliabilities of the Government as per itsdirections and so on.

(c) The debit to Government on account ofthe periodic installments will be accountedunder the major head 8222 (Reserve Funds).On the maturity of the loan, the balanceoutstanding under the head 8222 (sub-headSinking Fund) is credited to the head 8660(Miscellaneous Government Account) LedgerBalance Adjustment Account.

(d) The Bank shall scroll to the Governmentthe debit on account of investment less theincidental charges in the usual course.However, in order to ensure that theinvestment transactions of the Fund do not getmixed up with other transactions, these willbe indicated distinctly in separate scrolls.

(e) The Bank shall arrange to collect intereston the investments and credit the same to theFund on the due dates.

(f) On the maturity of the securities, the Bankshall arrange to redeem the securities. In caseof premature disinvestment to meet the liabilityon account of the claims to be paid, the Bankwill decide on the securities to be encashed inconsultation with the Government and sell thesecurities at the ruling price and credit theamount realised, less incidental charges to theFund. As in the case of debit scrolls, the Bankshall use separate scrolls for the receipts.

(g) The provision for expenditure on accountof the periodic contributions shall be made inthe Budget of the Government under therelevant head. The extent of expenditure to befinanced from the Fund shall be withdrawnfrom the Fund by the disposal of theinvestment.

(h) The Bank shall open a Current Accountand Subsidiary General Ledger Account inthe name of the Fund and furnish to theGovernment as at the end of September andMarch each year, a statement showing thedetails of investments.

10. Service charges for administration of theFund.— The Government shall pay to the Banka commission at the rate of 1/8 per cent of oneper cent on the turnover of the Fund or at therate to be mutually decided from time to time.

11. Accounts and Audit.— The accounts ofthe Fund and the investments shall bemaintained by the Accountant General of theState in the normal course. The Bank willmaintain subsidiary accounts in such mannerand details as may be considered by theGovernment in consultation with theAccountant General.

12. Savings.— The Government shall issueinstructions relating to the provisions of thescheme as may be considered from time to timeto enable smooth functioning of the scheme.In case of any difficulty in the operation of anyprovision of scheme, the Government may, ifsatisfied, relax the provisions.

Revised Scheme for Constitution andAdministration of the Guarantees Redemption

Fund of Government of Goa1. Title of the scheme.—The scheme shall be

called ‘Guarantees Redemption Fund Scheme’(hereinafter referred to as ‘the Fund’)

2. Constitution of the Fund.—A ‘GuaranteesRedemption Fund’ shall be constituted by theGovernment of Goa (hereinafter called theGovernment) for meeting its obligationsarising out of the Guarantees issued on behalfof State level bodies.

The Fund shall be constituted in the PublicAccount and classified under the head “—General and Other Reserve Funds —Guarantees Redemption” in the accounts of theGovernment.

3. Objective of the scheme.—The Fund shallbe utilised for meeting the payment obligationsarising out of the guarantees issued by theGovernment in respect of bonds issued andother borrowings by the State LevelUndertakings or other bodies and invoked bythe ‘beneficiaries’.

Explanation.—(a) The accumulations in theFund shall be utilised only towards thepayment of the guarantees issued by theGovernment and invoked by the beneficiaryand not paid by the institution on whose behalfguarantee was issued:

Provided that the net incremental annualinvestment of States (i.e. outstanding balanceover and above the level in the correspondingperiod of the previous year) shall be eligiblefor availing Special Drawing Facility (SDF) fromthe Reserve Bank of India (hereinafter referredto as the Bank) such that the availment of SDFunder this provision does not exceed theNormal WMA limit fixed by the Bank.

4. Commencement of the operation of theScheme.—It shall come into force with effectfrom the financial year 2015-16.

5. Contributions to the Fund.— (a) The Fundshall be set up by the Government with aninitial contribution of minimum one per cent ofoutstanding guarantees at the end of theprevious year and thereafter minimum 0.5 percent every year to achieve a minimum level of3 per cent in next five years. The Fund shall begradually increased to a desirable level of 5per cent. If guarantees have been invoked orare likely to be invoked, additional Funds (overand above 5%) shall be maintained.

(b) It is open to the Government to increasethe contributions to the Fund (beyond 0.5 percent annual) at its discretion and also basedon its assessment of likely invocation ofguarantees. The balance in the Fund shall beincreased with contributions made annually orat lesser intervals.

(c) It is open to the Government to increasethe contributions to the Fund at its discretion.

In order to enable transfer of the total amountof contribution to the Fund, the Governmentwould make suitable Budget provision on theexpenditure side of their budget under the head“—Relief on Account of Guarantees Invoked— Guarantees Redemption Fund—Transfer toReserve Fund and Deposit Accounts—Guarantees Redemption Fund”.

(d) The Government shall not fund itscontribution to the Fund out of borrowings fromthe Bank.

6. Relationship of the Fund with GeneralRevenues/Public Account.— (a) The corpus ofthe Fund comprises an initial amountdemarcated by the Government, annual orother contributions made by the Governmentthereto as also periodic accretions by way ofGuarantee Commission collected from theinstitutions in respect of whose bonds//obligations, the Government had issued theguarantee, in addition to the income accruingto the Fund.

(b) The Fund shall be kept outside theGeneral Revenues of the Government and shallbe utilised only in the manner prescribed inthis scheme.

7. Administration of the Fund.—The Fundshall be administered by Central AccountsSection of the Bank) subject to such directions//instructions as the Government may issuefrom time to time.

8. Investment of the corpus of the Fund.—Theaccretions to the Fund shall be invested inGovernment of India Dated Securities, TreasuryBills, Special Securities of the GoI and StateDevelopment Loans of other States of suchmaturities as the Bank may determine from timeto time in consultation with the Government.The Bank shall make available the securitiesfor investment either from its own investmentportfolio or by acquiring the securities from thesecondary market, without loading any chargeother than that indicated in paragraph 11.

9. Accounting of Transactions.— (a) Theresponsibility for the administration of theFund will rest with the Government. TheGovernment will decide all matters connectedwith the investment of the corpus of the Fund,reinvestment/disinvestment, obligations andapplication of the Fund, etc.

(b) The Government will, from time to time,issue instructions to the Bank. The Bank willimmediately arrange to make the necessaryinvestment. The Bank would scroll to theGovernment the debit on account of theinvestment and other incidental charges likebrokerage, commission etc. in the usualcourse. However, in order to ensure that theinvestment transactions of the Fund do not getmixed up with other transactions, these maybe indicated distinctly in separate scrolls.

(c) On receipt of the scrolls the investmenttransactions would be accounted for under thehead “—General and Other Reserve Funds—Guarantees Redemption Fund InvestmentAccount”. However, the incidental charges likebrokerage, commission etc. shall be accountedfor as a charge on the Fund.

(d) The Bank will arrange to collect intereston these securities and credit the same to the

Fund on due date. Further, these would requireto be invested as in the case of thecontributions by the Government i.e. inaccordance with the investment normsprescribed in para 8 above. On maturity of thesecurities, the proceeds will be collected andcredited to the account of the Government orreinvested on the basis of instructions receivedfrom the Government, i.e. in accordance withthe pattern outlined in para 8 intra. As in thecase of the debit scrolls, the Bank shall useseparate scrolls, for the receipts.

(e) On receipt of instructions from theGovernment, the Bank will arrange to sell thesecurities at the ruling price through itsMumbai office and credit the amount realised,less incidental charges, to the account of theGovernment.

(f) The receipts on account of maturity orsale of the securities would be taken to theaccount of the “Guarantees Redemption FundInvestment Account”. The incidental chargeson sale would be charged on the Fund.

(g) The provision for expenditure on accountof the Guarantees Redemption will be made inthe budget of the Government under therelevant heads. Only the actual amount ofguarantee redemption expenditure shall bebrought in account under the head — Relief onaccount of Guarantees invoked — GuaranteesRedemption Fund.

(h) The Bank shall arrange to redeem thesecurities on maturity. In case of prematuredisinvestment to meet the liability on accountof the claims to be paid, the Bank shall decideon the securities to be encashed in consultationwith the Government and sell the securities atthe ruling price and credit the amount realised,less incidental charges to the Fund.

(i) The Government will pay the Bank, acommission at the rate determined by the Bankin consultation with the Government. Thesecharges shall also be borne by the Fund as inthe case of the charges indicated in paras —and —. The loss or gain on the sale of securitiesshall also be taken to the Account of the Fund.

Explanation.— (a) The debit to Governmenton account of such withdrawal will beaccounted under the major head—. On thematurity of the loan the balance outstandingunder the head — (sub-head GuaranteesRedemption Fund) is credited to the head—(Miscellaneous Government Account) LedgerBalance Adjustment Account.

10. Functions of the Bank managing theFund.— (a) The Bank will be guided by thedirections of the Government in all mattersconcerning the investment/reinvestment/dis-investment/reallocation/withdrawals time totime of the Fund and will act accordingly.

(b) The Bank would arrange to raise a debitto the account of the Government maintainedwith it as per the schedule of contributionsset out in paragraph 5.

(c) The contributions to the Fund shall beinvested by the Bank in Government Securitiesas indicated in paragraph 8. The periodic

accretion to the Fund by way of guaranteecommission, contributions by the Governmentand interest income shall also be invested bythe Bank in a similar manner.

(d) The withdrawals may be made from outof the balance accumulated in the Fund up tothe date towards the redemption of theguarantees invoked and to be paid by theGovernment, as per its directions orGovernment shall have the option to withdrawexcess fund over 5 per cent of outstandingguarantees of the previous year.

(e) The Bank will submit periodical statementof balances/advices regarding the changestherein in consultation with the Government.

The following draft rules which theGovernment of Goa proposes to make inexercise of the powers conferred by sub--sections (1) and (2) of section 128 read with

section 58 of the Goa Housing Board Act,1968 (Act No. 12 of 1968) (hereinafter referredto as the “said Act”), are hereby published asrequired by sub-section (1) of section 128 ofthe said Act, for the information of all personslikely to be affected thereby and notice ishereby given that the said draft rules will betaken into consideration by the Governmenton the expiry of fifteen days from the date ofpublication of this Notification in the OfficialGazette.

All objections and suggestions to the saiddraft rules may be forwarded to the JointSecretary (Housing), Government of Goa,Office of the Goa Housing Board, Porvorim,Goa, before the expiry of the said period offifteen days so that they may be taken intoconsideration at the time of finalization of thesaid draft rules.

DRAFT RULES

In exercise of the powers conferred bysub-sections (1) and (2) of section 128 readwith section 58 of the Goa Housing BoardAct, 1968 (Act No. 12 of 1968), and all otherpowers enabling it in this behalf, theGovernment of Goa hereby makes thefollowing rules, namely:—

1. Short title, application and commence-ment.— (1) These rules may be called the GoaHousing Board (Registration, Allotment andSale of Tenements) Rules, 2015.

(2) They shall apply to sale of tenementssituated in the area comprised in housing//building scheme sanctioned under said Act.

(3) They shall come into force from the dateof their publication in the Official Gazette.

2. Definitions.— In these rules, unless thecontext otherwise requires,—

(a) “Act” means the Goa Housing BoardAct, 1968 (Act No. 12 of 1968);

(b) “Administrative Charges” means anysuch charges fixed and collected by theBoard for specific purpose;

(c) “allotment committee” meansallotment committee stated in rule 11;

(d) “allottee” means a person to whoma tenement has been allotted;

(e) “applicant” means a person whoapplies in Form II for the allotment oftenement either online or in such othermanner as specified by the Board;

(f) “auction” means a public sale oftenement in which eligible applicants bidagainst each other until a highestconsideration is reached;

(g) “Board” means the Goa HousingBoard established under section 3;

(h) “consideration” means the sale priceof a tenement fixed by the Board from timeto time;

(i) “Conveyance Deed” means a deed ofsale executed between the Board and theallottee by which tenement alongwithproportionate share of undivided land istransferred to the allottee on such termsand conditions as specified by the Board;

(j) “e-application Form” means acomputer programme version of a paperApplication Form II filled electronicallyand submitted online;

(k) “ex-servicemen” means a personwho is registered as such and issued withthe Ex-serviceman Identity Card by theDepartment of Sainik Welfare, Governmentof Goa;

(l) “family” means the applicant and ifmarried, the spouse and dependentchildren of the applicant;

(m) “family income” means total annualincome of the family, derived from allsources during preceding financial year onthe date of application;

(n) “family income level group” meansgroup of the population classified accordingto their level of family income such asEconomically Weaker Sections, LowIncome Group, Middle Income Group andHigher Income Group by the Board withthe approval of the Government;

(o) “Form” means a form appended tothese rules;

(p) “Freedom Fighter” means a personwho has been registered as such by theHome Department, Government of Goa;

(q) “Government” means the Governmentof Goa;

(r) “Income Certificate” means certificateof income issued by the CompetentAuthority;

(s) “initial deposit” means deposit of anamount as specified by the Board made inadvance;

(t) “lot” means an activity by whichnumbers are drawn with the help of amachine or by electronic method or by anyother method, to determine the winningnumber;

(u) “Other Backward Classes” are thosecommunities, excluding creamy layer, whichhave been so notified by the Governmentfrom time to time and as certified by theCompetent Authority;

(v) “Para-Military Forces” means a personwho is serving or has served in the BorderSecurity Force (BSF), Central Reserve PoliceForce (CRPF), Central Industrial SecurityForce (CISF), Indo Tibetan Border Police(ITBP), Assam Rifles, etc. and includeswidow of those personnel who have killedin action on production of a certificate fromDefence or similar Authorities;

(w) “Payment Gateway” means aninternet transaction facility that allows theBoard to accept credit/debit card or anyother electronic mode of payment of theapplicant;

(x) “Person with disability” means aperson suffering from not less than fortyper cent of any of the following disabilityas certified by the Goa Medical College:

(i) blindness or low vision(ii) hearing impairment

(iii) locomotor disability or cerebral palsyincluding all cases of orthopaedically handi-capped persons;

(y) “Penalty” means a fine imposed bythe Board upon the allottee for violatingany law, rule or terms and conditions ofallotment;

(z) “Registered Housing Society” meansa society formed under rule 18 of theseRules;

(aa) “Sale” means sale of a tenement onoutright basis;

(ab) “Scheduled Castes” are those classeswhich have been notified as such under theConstitution (Goa, Daman and Diu)Scheduled Castes Order, 1968; and ascertified by the Competent Authority;

(ac) “Scheduled Tribes” are those classeswhich have been notified as such under theConstitution (Goa, Daman and Diu)Scheduled Tribes Order, 1968; and ascertified by the Competent Authority;

(ad) “Scheme” means housing/buildingscheme sanctioned under the said Act, inthe area vested in the Board, comprisingtenements build by the Board;

(ae) “service Charge” means charges inrespect of common services;

(af) “tenement” means a residentialhouse/flat/apartment/bungalow includingcommercial spaces such as shop, office, etc.built by the Board in housing/buildingscheme.

3. Disposal of tenements.— The disposal oftenements shall be on sale (either by openauction or a lot) or by any such manner asspecified by the Board from time to time; withprior approval of the Government.

4. Fixation of tenements price.— The Boardshall fix the consideration of a tenementpayable by the allottee, including the minimumprice per square meter for auction, from timeto time. Such consideration shall be final andbinding on the allottee.

5. Funding of scheme.— The Board may,from time to time, determine source of fundsfor implementation of scheme, dependingupon the cost of the scheme/project. This may

be generated by way of sale of tenement orby obtaining housing loan from HUDCO(Housing and Urban Development Corporationof India)/Government Enterprises/Banks orany other financial institutions, as the casemay be.

6. Conditions of eligibility.— (1) The applicantmust have been born in the State of Goa andshall be a resident of State of Goa for the lastfifteen years; and one of his/her parentsshould be born in State of Goa and also aresident of State of Goa for the last twentyfive years.

(2) The applicant and his/her family shouldnot own a tenement or a plot of the Boardanywhere in the State of Goa and an affidavitto this effect shall be produced in Form Ihereto.

(3) The applicant shall fill in only onee-application Form either in his/her own nameor in the name of any other member of his/herfamily and shall apply only in one category towhich he/she may belong, namely, either as amember of the general category or in any ofthe reserved categories specified in theserules:

Provided that reserved category may alsoapply against general category, if so desired:

Provided further that he/she shall not beeligible for allotment of two tenements, ifsuccessful in both the categories.

In case, there are no applications from anyparticular reserved category, the quotaearmarked for such category shall be addedto the general category.

(4) The applicant should have attained theage of 18 years at the time of makingapplication.

7. Classification of tenements.— The Boardshall fix the family income level in respect ofthe following group of population and decidenumber of tenements to be allotted to each ofsuch group, with the prior approval of theGovernment:—

(a) Economically Weaker Section (EWS);

(b) Low Income Group (LIG);

(c) Middle Income Group (MIG);

(d) Higher Income Group (HIG).

8. The reservation of tenements to be disposedby outright sale under lot.— The reservationof tenements to be disposed by outright saleunder lot for the persons belonging tofollowing categories shall be as under:—

(a) Scheduled Castes — 1%(b) Scheduled Tribes — 2%(b) Other Backward Classes — 5%(c) Freedom Fighters — 1%(d) Ex-Servicemen including

personnel of Para MilitaryForces, if any — 2%

(e) Persons with disabilities — 1%

9. Notice of registration.— (1) The Boardshall issue an advertisement in the form of anotice on its website and at least in twolocal newspapers inviting e-applications forsale of tenements, as per the procedurespecified therein, by such date which shallnot be less than 15 days from the date ofissue of the advertisement.

(2) The notice shall consist of all the detailssuch as last date to apply, tenement details,initial deposit, reservations, website, etc.

10. Submission of application forRegistration.— (1) The applicant shall applyonline in Form II hereto in pursuance of noticeissued under rule 9 and make payment ofnon-refundable registration fees fixed by theBoard from time to time as administrativecharges.

(2) In addition to above registration fees,initial deposit as specified by the Board shallbe made alongwith the application form.

(3) Only those applicants who have beenqualified from the 1st draw for the allotmentof tenement shall submit the self-attestedcopies of the mandatory documents including

original Affidavit indicated in Form II to theBoard before the date of scrutiny for allotmentof tenement under lot, failing which, his/herapplication shall be liable for rejection and15% initial deposit shall be forfeited to theBoard and the balance amount shall berefunded to the applicant without anyinterest.

(4) If the applicant applies for auctioncategory, the applicant shall submit the self--attested copies of the mandatory documentsincluding original Affidavit indicated in FormII to the Board before the date of scrutiny toparticipate in auction proceedings, failingwhich, his/her application shall be liable forrejection and 15% initial deposit shall beforfeited to the Board and the balance amountshall be refunded to the applicant withoutany interest.

(5) The Board shall carry out transactionsthrough payment gateway only.

(6) Incomplete applications submitted bythe applicants shall be summarily rejected.

(7) No withdrawal of application shall beallowed once it is uploaded on the website.If an applicant withdraws from the schemeafter depositing the initial deposit, 5% of thedeposit shall be forfeited to the Board andthe balance amount shall be refunded to theapplicant without any interest only after thescheme is closed.

11. The Allotment Committee.— The Boardshall form Allotment Committee consisting offollowing:—

(2) The Allotment Committee may co-optany one member from the Board/Governmentofficial not below the rank of Section Officer.

12. Allotment of tenement on outright saleunder lot.— (1) Every online application shallbe generated with a computerized serialnumber.

(2) Online draw shall be held within 10days after the expiry of the last date of onlineregistration.

(3) All applications received from thereserved category, shall be kept separate,category wise. Where, there are noapplications from any reserved category, thequota earmarked for such category shall beadded to the general category.

(4) A draw shall be held of the eligibleregistered applicants of the respectivecategories separately, for the allotment oftenements including equal number ofapplicants to be kept as “Wait List” to coverthe possibility of applications in the “MainList” being rejected on scrutiny.

(5) A separate list in a sequential mannerof draw, category wise (Reserved andGeneral) of the successful applicants shall beprepared and displayed on the website/noticeboard.

(6) The Allotment Committee shallscrutinize the applications in a sequentialmanner as shown in the displayed list andthe final eligibility list shall be prepared anddisplayed. If any applicant is found to beineligible, he/she shall be liable for rejectionand 15% initial deposit shall be forfeited tothe Board and the balance amount shall berefunded to the applicant without anyinterest.

(7) The final eligibility list of the Generaland Reserved Category shall be merged anda single eligibility list shall be displayed.

(8) An online draw for the allotment oftenements shall be held on the day and timefixed.

(9) The final allotment list indicating serialnumber of application form and the tenementsnumber will be displayed on the website//notice board.

(10) On display of final allotment list, initialdeposit of the applicants who did not get thetenement, shall be refunded within 10 workingdays after the final list is published. Thedecision of the Secretary/Managing Directorin the matter of allotment of the tenementshall be final and binding on the allotteesand no appeal thereon shall be entertained.

(11) The tenement offered shall be on as iswhere is basis and the allottee shall not haveany right to complain or raise any objectionabout nature, condition or planning, etc., orto claim any damage or compensation on anyaccount from the Board.

13. Conditions of payments of considera-tion.— (1) The order of allotment of tenementshall be issued to the allottee in Form IIIhereto as per the final allotment list.

(2) The allottee shall convey his/heracceptance of order of allotment of tenementin Form IV hereto within three working days,to the Board.

(3) The allottee shall pay the fullconsideration of the tenement allotted withina period of 45 days of receipt of the order ofallotment failing which the order of allotmentof tenement shall stand cancelled without anyfurther notice and the entire initial deposit ofthe applicant shall be forfeited to the Board:

Provided that an application made to theBoard stating reasons for non-payment beforeexpiry of the said stipulated period, the Boardmay extend the period of payment ofconsideration subject to payment of penalinterest of 10% for the first 25 days and 15%for further period of 25 days. No furtherextension shall be granted beyond 95 daysand the tenement shall revert to the Boardforfeiting the entire initial deposit withoutfurther reference to the applicant and noappeal shall be entertained thereon.

(4) In case the applicant effects only partpayment of the consideration within theextended period then the allotted tenementshall be reverted to the Board therebyforfeiting the entire initial deposit in favour ofthe Board and the part payment made shallbe refunded to the applicant without anyinterest and no appeal shall be entertainedthereon.

(5) A sale letter shall be issued in Form VIhereto only on full payment of considerationand the physical possession of the tenementshall be handed over to the allottee.

(6) The scheme may be declared closed bythe Managing Director as soon as the entireallotment process is over.

14. Allotment of tenement on outright saleunder auction.— (1) Every online applicationshall be generated with a computerized serialnumber.

(2) The Allotment Committee shallscrutinize all the applications within 20 daysafter the expiry of the last date for submissionof online application and the list of theapplicants who are eligible to participate inthe auction shall be displayed. If any applicantis found to be ineligible, he/she shall be liablefor rejection and 15% initial deposit shall beforfeited to the Board and the balance amountshall be refunded to the applicant withoutany interest.

(3) Auction shall be held amongst eligibleapplicants in the presence of Secretary//Managing Director of the Board at the place,date and time mentioned in the notice ofadvertisement on website and the planshowing tenement number, area, etc. shall bedisplayed at the place of auction.

(4) The applicants shall sit according totheir registration number at the venue duringthe auction.

(5) The particular bidder shall increase thebid price per sq. mt. as specified by the Boardfrom time to time.

(6) There shall be at least 2 applicantbidders present for the auction proceedings

for each tenement, failing which, the biddingshall defer.

(7) The Managing Director may postpone//cancel/defer the auction proceedings of anyparticular tenement/tenements, as the casemay be, at any time without assigning reasonsthereof.

(8) The decision of the Managing Directorin the matter of allotment of tenement byauction to the highest bidder shall be finaland binding on the allottees and no appealthereon shall be entertained.

(9) The tenement offered shall be on as iswhere is basis and the allottee shall not haveany right to complain or raise any objectionabout nature, condition or planning, etc., orto claim any damage or compensation on anyaccount from the Board.

15. Conditions for payments of auctionconsideration.— (1) The highest bidder shallbe declared as successful and order ofallotment shall be issued in Form III hereto tothe successful bidder of a tenement. Theallottee shall pay the consideration of thetenement allotted within a period of 25 daysof receipt of the order of allotment failingwhich order shall stand cancelled without anyfurther notice and the entire initial deposit ofthe applicant shall be forfeited to the Board.No part payments shall be accepted.

(2) The allottee shall convey his/heracceptance of order of allotment of tenementin Form IV hereto within three working days,to the Board.

(3) A sale letter shall be issued in Form VIhereto only on full payment of considerationand the physical possession of the tenementshall be handed over to the allottee.

(4) The scheme may be declared closed bythe Managing Director as soon as the entireallotment process is over.

16. Execution of Conveyance Deed oftenement.— (1) On payment of fullconsideration of the tenement, the allotteeshall apply to the Board for execution ofConveyance Deed towards transfer oftenement within the period of 60 days from

the date of taking over possession, failingwhich, a penalty shall be imposed as specifiedby the Board from time to time.

(2) The Board shall execute a ConveyanceDeed after inspecting the tenement and theallottee shall get it registered with theconcerned Sub-Registrar. The stamp duty andregistration charges shall be borne by theallottee.

17. Penalty for misrepresentation,suppression of facts or for contravention of anyof the conditions of the rules.— (1) If it is foundat any stage that the applicant has givenfalse information or has suppressed anymaterial facts or has contravened any of theterms and conditions of these rules, theapplication shall be rejected and the allotmentof tenement, if already made shall standcancelled without prejudice to the right of theBoard to take any other action under the lawin force.

(2) In any circumstances, the allottee shallnot sell the tenement and after the expiry of10 years from the date of registration ofConveyance Deed on payment of 10% of thetotal selling price to the Board and a copy ofthe said transaction duly registered shall bedeposited in the Board for verification of saleprice. An undertaking in this regard shall besubmitted by the allottee in Form V appendedhereto.

18. Formation of Housing Society.— (1) Theallottee shall form a society under the GoaCo-operative Societies Act, 2001 (Goa Act 36of 2001) for the proper maintenance, running,up keeping and keeping in good repaircommon areas and for carrying out current aswell as urgent repairs towards commonservices.

(2) The Society shall produce a certifiedcopy of the registration to the Board.

(3) The Society and each of its constituentmembers shall be responsible for ensuringthat:—

(a) No damage or deterioration to theproperty handed over in terms of agreementunder these rules is caused;

(b) No installation or equipmentconnected with, as provided as part ofwater supply, sewerage, storm waterdrainage, electricity or other service shallbe tampered with;

(c) No obstruction to common areas shallbe carried or misuse of the property shallbe made such as:—

(i) occupying common passage,staircase, approaches and like;

(ii) throwing garbage or refuse withinthe precincts of the property or outside it;

(iii) keeping a vehicle so as to obstructthe free movement; and

(iv) creating insanitary or nuisance;

19. Other conditions.— (1) The power toamend any of the provisions of these rulesshall vest with the Government.

(2) The Board may impose any terms andconditions not specifically covered under theserules as may be decided in this behalf fromtime to time, with the approval of theGovernment.

(3) Every allottee shall deposit an amountwith the Board specified from time to timetowards maintenance fund till such time thesociety is formed. The balance amount, if anyshall be transferred to the Society on itsformation.

(4) The allottee/society shall have theproportionate share of the undivided land ofthe respective scheme/project subject tocondition that there shall not be any objectionfor carrying out any development by the Boardon the balance area of the sector as per thepermissible FAR as and when required andalso the allottee shall not cause anyobstruction to an official, duly authorized bythe Board in discharging his/her duties inconnection with the matter arising out of themanagement of the property.

The allotment of tenement is subject to the following conditions:

(1) On payment of full consideration of the tenement, the allottee shall apply to the Board for executionof Conveyance Deed towards transfer of tenement within the period of 60 days from the date of takingover possession, failing which, a penalty shall be imposed as specified by the Board from time to time.

(4) Allottee shall not cause any obstruction to an official, duly authorized by the Board so as to createdifficulties in the discharge of his/her duties in connection with the matter rising out of the managementof the property.

(5) If it is found at any stage that the applicant has given false information or has suppressed anymaterial facts or has committed breach or contravened any of the conditions of these rules, the applicationshall be rejected and the allotment of tenement, if already made stands cancelled without prejudice tothe right of the Board to take any other action under the law in force.

(6) In any circumstances, the allottee shall not sell the tenement to any person.

(7) On breach of conditions, penalty @ 5% on the total consideration of tenements shall be levied tosuch allottee.

“Scheme for setting up of Gymnasium injurisdiction of local bodies for the

benefit of Youth”

1. Introduction.— The State of Goa, which ishaving one of the higher literacy rate is alsoknown for its active youth populationrepresenting nearly 60% of the total population.It has been the continuous endeavour of theState Government to ensure that the youthremain healthy and are kept away from manymodern vices. If youth of the country remainhealthy and take utmost care of their healthboth (body and mind) they are able to lead ahealthy and energetic life until old age. TheState Government desires to promote youthwellness as the prime objective to curtail ahealthy lifestyle for the young. In this respect,it is proposed to set up bare minimumexercising facilities at level of local bodies interms of establishing gymnasium and hencethis scheme.

2. Short title.— (i) The scheme will be calledas “Scheme for setting up of Gymnasiums injurisdiction of local bodies for the benefit ofYouth”.

(ii) The scheme will come into force from thefinancial year 2015-2016 and will be reviewedevery 03 years.

3. Objectives.— (i) The objective of schemeis to ensure that the youth from different partsof the State, take up to weight training, BodyBuilding, Weight Lifting, Power Lifting at avery young age, so as to create awarenessabout health and healthy lifestyles.

(ii) The Gymnasium once set up will beutilized by boys, girls, men and women of allages (at least up to 60 years age). Theendeavour of the Government will be to createhealthy society through promotion of abovephysical culture activity.

(iii) The Gymnasium shall be set up ineducational institution of Higher Education,Village Panchayat, Municipalities or will be setup by the DSYA in such areas, where the needarises, as per Government decision.

4. Fee Structure.— Any individual attendingthe Gymnasium shall pay the prescribed fees.There shall be separate fees for Students.

(i) Students(a) One time registration fees Rs. 100/(b) Monthly fees Rs. 100/-

(ii) Non Students (Employed)(a) One time registration fees Rs. 150/-(b) Monthly fees Rs. 200/-

(iii) Non Students/Youth/Adults(a) (Unemployed) One Time Rs. 100/- registration fees(b) Monthly Fees Rs. 100/-

(5) Minimum set of equipments to be set up inthe Gymnasium.—

6. Eligibility:— The Educational Institutionsof Higher Education, Village Panchayats,Municipality desirous of setting up ofGymnasium with the Directorate of Sports &Youth Affairs shall provide the following:

(i) Proper ventilated room of minimum of65 sq. mts.

(ii) The room shall have water andelectricity connection and separate toiletfacility for male and female adjoining thisfacilities.

(iii) The place will have to be providedby Village Panchayat, Municipality orEducational Institutions free of cost. Theexpenditure towards water and electricitywill be incurred by this agency requestingfor the setting up of Gymnasium. In theevent, Directorate of Sports and Youth Affairsdesires to provide the set up, Directorate ofSports and Youth Affairs can in associationwith Youth Clubs/Sports Associationsprovide the set up, subject to the conditionthat the area/place is allocated by theSports/Youth Clubs/Association.

(iv) The responsibility of appointing asuitable Gym Instructor, Gym Attendant,will lie with the concerned agencyrequesting for a Gymnasium.

(v) As far as the Gymnasium set up by theDirectorate of Sports and Youth Affairs in itsown premises/Government premises isconcerned, the expenditure on Gymequipment, water, electricity bills will beincurred by the Directorate of Sports andYouth Affairs. DSYA will engage services ofGym Instructor and Gym Attendant onContract basis or from The Sports Authorityof Goa, as the case may be.

7. Timings of Gymnasium.— The Gymnasiumwill remain open for 8 hours in two sessions.The Gym will be closed on all Sundays and onPublic Holidays.

(i) Morning 6.00 a.m. to 10.00 a.m.

(ii) Evening 4.00 p.m. to 8.00 p.m.

8. Quantum of Financial Assistance under thescheme.— (i) The Directorate of Sports & YouthAffairs will provide for the set of equipmentsas per clause (5) as also, their replacement inthe event of equipment becoming obsolute ornon-replacable condition.

(ii) All other costs shall be borne by theagency concerned.

9. Redressal of Grievances and Dispute.— Forgrievances, if any, arising out of implementationof this scheme, the Secretary to theGovernment in charge of the subject shall hearand decide such matters and the decision ofthe Secretary to the Government in this regardshall be final and binding on all concerned.

“Scheme for issue of the SportsEquipments/Kit/Costume to meritoriousSportspersons and to Government and

Government Aided Educational Institutionsin the State”

1. Objectives.— (a) The scheme intends topromote individual sportspersons for ensuringhis/her meritorious performance in Inter-national/National/State level Tournaments indifferent games/sports by providing sportsequipments/kits, to enable them to meet therequirements of the sport discipline concernedwithout incurring additional financial burdenon such individuals who have excelled andshown meritorious performances in recognisedsports disciplines.

(b) It is noticed that many EducationalInstitutions do not have adequate sportsequipments which in turn deprives studentsfrom regular practice and also to take part invarious games/tournaments/competitions.The scheme intends to provide the Schoolauthorities with basic sporting infrastructurein terms of sports equipments and sports kitso as to facilitate the students of Pramiry,Secondary and Higher Secondary Schools, bothin Government and Government AidedInstitutions. This measure will help encourage,motivate and attract students to participatein Games and Sports. The provision of SportsEquipments will help the Physical Education

Teachers to effectively organize and trainstudents in various games and sports.

2. Eligibilty condition and procedure to availthe benefit.—(A) For individual Sportspersons:—

(i) Any individual Sportsperson who hasexcelled at International/National/State levelin such sport disciplines, as specified withAnnexure to this scheme.

(ii) The eligibility for award of sportsequipments shall be decided by a committeeheaded by the Director of Sports & YouthAffairs, Dy. Director of Sports, Asstt. Director(Sports) and Asst. Director (PE).

(iii) The committee shall assess theapplication upon receiving appropriaterecommendation from the concerned StateSports Association/National Federation towhich discipline the sportspersons belongs to.

(iv) The individual sports must not be inreceipt of any such financial assistance fromthe State Government or State Governmentautonomous body etc.

(B) For Government and Government AidedSchools:—

(i) All the Government and GovernmentAided Primary, Secondary & Higher SecondarySchools in the State of Goa.

(ii) The major eligibility criteria shall be:—

(1) Past performance of the School atTaluka/District/State level.

(2) Reports of APEO/SSO/TSO/ZSO//relating to the potential emerging talent inthe schools under their jurisdiction.

(3) Performance of the Physical EducationTeachers in the Schools, in relation toorganising and conducting sporting activityin the Institution concerned.

(4) The grants of Sports equipments//kits shall be based on the decision takenby the committee comprising of Director ofSports & Youth Affairs, Dy. Director ofEducation (Academic), Dy. Director of Sportsand Asstt. Director (Physical Education).

3. Financial Assistance for MeritoriousSportspersons.— (i) For MeritoriousSportspersons— Sports equipments/kit worthRs. 10,000/- and for Educational Institutions—Sports equipments/kit worth Rs. 40,000/- shallbe considered.

(ii) The Educational Institute will avail thebenefit every alternate year on rotation basisto be decided by the Director of Sports & YouthAffairs.

4. Relaxation of the provision of the scheme.—The Government shall be empowered to relaxany or all clauses or conditions of the schemein genuine cases for issue of the Sportsmaterial, based upon the recommendation ofthe committee concerned and with priorapproval of the Finance Department.

5. Interpretation of the provision of thisscheme.— If any question arises regardinginterpretation of any clause, word, expressionof the scheme, the decision about theinterpretation shall lie with the Government,which shall be final and binding on allconcerned.

6.
