Recently, Josh and I had the pleasure of representing the La Crosse Area REALTORS® Association at the NAR REALTORS® Legislative Meeting in Washington, D.C. The meetings were filled with NAR Policies change updates, industry updates, trade show, legislative briefings and tons of networking. The main focus of these meetings was primarily the Hill Visits

and sharing our legislative concerns with our Legislators.

This year the issues were: Equality Act, Flood Insurance Issues and Qualified Opportunity Zones. Josh and I along with 50 REALTORS® from WI visited our WI Legislators to advocate on behalf of homeowners and our members.

The meetings closed with the Board of Directors Meeting. See the action items below:

• Approved a three-year extension of the $35 per member annual special assessment to fund NAR’s national ad campaign. The extension will continue the campaign through 2022.

• The Board also approved the 2020 NAR budget with no dues increase , as well as a Finance Committee recommendation that NAR return to a 50% reserve requirement of gross operating expense (from the current 40%) and that NAR target a 75% reserve. Membership for 2020 is budgeted at 1,340,000, and annual dues remain at $150.

• Approved a policy, effective on June 2, 2020, that REALTORS® shall not obtain, or make public, their home state and regional endorsement prior to six months before the beginning of the submission period in which the REALTOR® files application for NAR elected office.

• Revised MLS policy so that REALTOR® association-owned MLSs may charge participants and subscribers who don’t hold primary or secondary membership in the association a different amount than what’s charged to association members, provided that any increase is reasonable related to the actual costs of serving those members.

• Passed a policy supporting states’ and residents’ right to create laws aligned with their interests and to allow businesses that are properly registered and legitimate by state standards to have the ability to access banking services. The policy is a response to concerns that many states are legalizing cannabis use, but anyone engaged in transactions with cannabis-related businesses, including real estate professionals and property managers, are at risk of criminal and civil liability under federal law.

DO Focus your social media connections on people who live where you sell real estate. This will expand your local reach in the community.

DON’T Keep your profile description too simple. Be sure to include personal interests, as well as your profession. Your followers want to know a little bit about you to build a relationship.

At the NAR Meeting in May, Brian Stephan and Peggy Lovejoy were awarded the REALTOR® Emeritus status. The status is awarded in recognition of forty cumulative years of membership in the National Association of REALTORS® and have served at the Local, State, or National Association. Congratulations!

Please join us at our Annual Meeting in September to celebrate this achievement.

Congratulations to Ryan Olson

On May 17 in Washington D.C., Ryan Olson, Coldwell Banker River Valley, graduated with his Masters in Residential Real Estate Sales, Marketing and Management from the REALTOR® University. Ryan is at this time the only graduate in the State of Wisconsin and Minnesota!

Key Points

• A decision on an offer can be delayed until the seller concludes that all offers have been submitted.

• Be sure to clearly and carefully explain to the seller that a delay could mean losing a sale and owing you a commission based on a full price offer.

• Section 804(a) of Title VIII of the Civil Rights Act of 1968, as amended by the Fair Housing Amendments Act of 1988, states that it is unlawful to “refuse to sell or rent, after the making of a bona fide offer, a dwelling to any person because of race, color, religion, sex, handicap, familial status or national origin.”

Areas of Liability

The seller could be charged with discrimination for avoiding offers from minorities.

Actions to Take

• Remind the seller immediately of the fair housing laws regardless of whether a sales associate or broker is used and any obligation set forth in the listing agreement.

• Urge the seller to consider a good offer from a minority person in the same way that you would encourage consideration of a good offer from any other person.

• Be sure you objectively and fairly present, explain, and evaluate all offers to the seller.

• Never encourage a homebuyer to submit an offer because a seller is intending to discriminate against other people who have already submitted an offer.

• Present the same terms and conditions to all homebuyers.

• Never show favoritism toward any homebuyer submitting offers.

• If the seller delays decision and this leads to a “bidding war,” it is important that any minority homebuyer be given this opportunity to meet or beat any other offer.

“I don’t understand why you feel that Mr. and Mrs. Richardson are not the type you want to buy your home. They have made a good offer and are financially qualified. What type are you looking for?”

“I can respect your desire to consider all offers, and I will try to get a firm offer from the O’Brien’s immediately. But the Richardsons’ offer is a good one, and I would hate to see you lose out by delaying. Also, if you reject a full price offer, you must still pay my commission. Is there a reason you don’t consider the Richardson’s to be the type to buy your home?”

Legislative Meeting Update (cont’d from p.1)

• Adopted modifications to the association’s Housing Finance Reform Principles. The Trump Administration has made GSE reform a priority, and NAR supports reforms that align with these principles.

• Approved a policy that NAR supports prohibitions of housing discrimination against veterans provided programs such as VA home loans that are available only to give preference to veterans are not violations of the Fair Housing Act.

• Approved a policy that NAR opposes the use of excess reserves under the FHA Mutual Mortgage Insurance Fund for purposes other than reducing and/or eliminating the borrower’s mortgage insurance premium and/ or improving the operations of FHA; so long as it does not negatively affect necessary FHA reserves or artificially increase premiums.

• Amended Contested Application Procedures for Associations for the change of Jurisdiction to shorten filing timeframes and implement an electronic hearing process

• Approved a change to Standard of Practice 1-7 that clarifies that the practice of providing a timely written affirmation to the cooperating broker is a tool to reassure buyers and cooperating brokers that offers were handled properly.
