Notice is hereby given that on 16 December 2002 the Pine RiversShire Council adopted an amendment of its Planning Scheme. Thepurpose of the amendment is to exclude land located at RosalieWaters, 2703 Mt Mee Road, OCEAN VIEW 4521 and describedas Lot 3 RP 169608 Parish Pine from the Special Facilities (ChurchCamp and Retreat) zone and include the land in the SpecialFacilities (Honey Packing, Tourist Facility, Wedding ReceptionCentre and Conference Centre) zone. Short title1. This notice may be cited as the Taking of Easement Notice

(No 08) 2003.Easement taken [ss.6, 9(7) and 9(8) of the Act]

2. The Easements described in Schedule 2 are taken by IpswichCity Council for drainage purposes and vest in the Ipswich CityCouncil on and from 4 April 2003.Rights and obligations

3. That the rights and obligations conferred and imposed byeach Easement include the matters set out in Schedule 1.

SCHEDULE 1The Ipswich City Council (hereinafter with its successors referredto as ‘the Council’) shall have the full and free right and liberty forthe Council to use the easement described in the Schedule hereto(which easement is hereinafter referred to as ‘the said easement’)for the passage or conveyance of stormwaters and for any otherpurpose connected with drainage and from time to time to haveconstruct and thereafter forever to use and maintain on over throughor under the said easement drains pipes conduits and channelsincluding open cut drains and channels rainwater conduits and pipesand covered and uncovered drains for the passage or conveyance ofstormwater through or under the said easement and all equipmentand fittings in connection therewith and appurtenant theretoincluding surface manholes, vents, marker posts and plates andthereafter at all times to have full free and uninterrupted access tothe said drains pipes conduits and channels equipment and fittingsfrom the surface of the said easement and for the purposes aforesaidand for the purpose of patrolling, inspecting, replacing, cleansing,amending, enlarging, repairing and removing any such drains pipesconduits and channels equipment and fittings, full free anduninterrupted right and liberty at all times by day and by night intime of emergency and from time to time to enter upon and to go,pass and repass, over along and under the said easement or any partor parts thereof with or without engineers, surveyors, workmen,servants, agents, contractors or any of them and with or withoutvehicles, plant and equipment of any description, laden or unladen,and to dig into, sink shafts in, erect scaffolding upon and to openand break up the soil of the said easement or any part or partsthereof as well the subsurface as the surface thereof and to bringand place in and upon the said easement or any part or partsthereof and remove such materials, machinery, equipment, toolsand other articles and to do such other incidental works and thingsin the said easement as the Council and its successors shall in itsdiscretion think fit doing as little damage as may be and beingresponsible and held liable only for such damage to the RegisteredOwner for the time being as may be caused or suffered by reasononly of the neglect or default of the Council and its agents, servantsand employees and the Council agrees as follows:-

1. All drains, pipes, conduits and channels, equipment and fittingsinstalled in or placed upon the said easement shall remain theproperty of the Council.2. It shall be the duty of the Council to reinstate to the satisfactionof the Registered Owner the said easement and all fences, roads andpaved surfaces where the same have been damaged by the Councilin the exercise and performance of any of its rights and libertiesgranted herein.3. For the purpose of gaining access to the said easement theCouncil shall be entitled to pull down or break open any fencing onor adjacent to the said easement provided that where livestock arecontained within the fenced area sufficient notice shall be given tothe Registered Owner to enable the said livestock to be securelyheld.4. In lieu of reinstating any fence pulled down in accordance withClause 3 herein, the Council may install a gate the quality of thematerials and workmanship of which except with the RegisteredOwner’s consent shall be not less than the quality of the materialsand workmanship in the existing fence. All such gates shall becomethe property of the Registered Owner of the fence in which the gateis installed and thereafter shall be maintained by the said owner.5. The Registered Owner will refrain from any action likely tojeopardise or prejudicially affect the safety or reliable working ofany drains, pipes, conduits, channels, equipment or fittings installedin or placed upon the said easement and that the Registered Ownerwill at all times refrain from using the said easement in a mannerlikely to obstruct or unreasonably hinder access thereto by theCouncil; and without limiting the Registered Owner’s responsibilityherein it is expressly agreed that the Registered Owner may on thesaid easement place or erect any building, structure, pavement,road, filling, refuse, drain, fence or plant any tree or excavate anyhole, well, bore or tunnel only with the prior consent in writing ofthe Council.In considering any such proposal for consent, the Council may –(a) consent to the proposal; or(b) refuse to consent to the proposal; or(c) consent to the proposal subject to such conditions as the

(a) Appointees may be required to serve in any part of the State. Where a centre is included under “Locality”, the headquartersof the appointee will be at such centre unless otherwise determined.

(b) An appointment has been declared by the Public Service Commissioner, by gazette notice, to be a non-appealableappointment, pursuant to section 95 of the Public Service Act 1996.

(c) Also being advertised in daily press and/or internet/email advertising or technical journals.

(d) Appointment to a particular level will depend on qualifications and experience.

(e) The appointee may be appointed in a temporary capacity. If a tenured employee of the Public Service is selected forappointment, the officer will retain tenured status.

(f) Appointment may be made on the basis of a contract for a fixed term, pursuant to sections 69 and 70 of the Public Service Act 1996.

(g) Senior Officer levels (SO1 and SO2): salary sacrifice may be made for optional benefits of employer funded superannuationoptions and professional organisation membership fees.

(h) In accordance with section 5.13 of the Directive 4/02, Deployment and Redeployment, registered deployees will beconsidered on relative merit.

NOTICE OF A MINISTERIAL DESIGNATION OF LAND FOR COMMUNITYINFRASTRUCTURE - INTEGRATED PLANNING ACT 1997

I, ROD WELFORD, Attorney-General and Minister for Justice give notice that:

A Ministerial Designation has been made - Pursuant to section 2.6.7 and Schedule 6 to the IntegratedPlanning Act 1997, on 26 March 2003 I made a Ministerial Designation of land for communityinfrastructure.

Description of the land to which the Designation applies - The Ministerial Designation applies to the landlocated at 475 and 489 Archerfield Road, Richlands. The land is properly described as L.67 RP 50038 PAROXLEY being an area of 4527m2 and L.68 RP 50038 PAR OXLEY being an area of 4889m2.

Type of community infrastructure for which the land has been designated - The communityinfrastructure is for the proposed Western Districts Courthouse/Watchhouse. Development on the land forthe proposed courthouse includes 2 Magistrates Courts, mediation conference room, holding facilities,registry office and accommodation for staff, day facilities for external agencies, facilities for witnesses andvictims of domestic violence, watchhouse and associated infrastructure.

The land is proposed to be used for the following community infrastructure, as listed in Schedule 5 to theIntegrated Planning Act 1997:

(e) correctional facilities;

(r) storage and works depots and the like including administrative facilities associated with the provision ormaintenance of the community infrastructure mentioned in paragraph (e) and (s); and

(s) any other facility not mentioned in paragraphs (a) to (r) and intended primarily to accommodate governmentfunctions.

Reasons for the Designation – The reasons for the Ministerial Designation are set out in the attachedStatement of Reasons for a Ministerial Designation of land for community infrastructure under the IntegratedPlanning Act 1997.

Matters included as part of the Designation under s.2.6.4 of the Integrated Planning Act 1997 - Thecommunity infrastructure shall be provided generally in accordance with the site plan WDC 1, floor planWDC 2 and elevations WDC 3 of the Western Districts Courthouse Complex and Watchhouse prepared byProject Services.

STATEMENT OF REASONS

Requirement for Statement of Reasons

Pursuant to section 4(2)(d) of Schedule 6 of the Integrated Planning Act 1997 (“IPA”), I amrequired to state the reasons for the decision by me to make, under the IPA, a MinisterialDesignation of land for community infrastructure, in relation to the Western DistrictsCourthouse (“the Courthouse”).

Material on which findings and decision are based

In forming my decision to make a Ministerial Designation of land for communityinfrastructure in relation to the Courthouse, I had regard to the following material:

1. Ministerial Briefing Note dated 15 January 2002;

2. Memorandum regarding site for replacement of Inala Courthouse dated 14 September2001;

3. Memorandum of approval of expenditure dated 31 October 2002;

4. Plans for the Courthouse Complex and Watchhouse prepared by Project Services,Department of Public Works;

5. Rates search for lot 68 on RP 50038 dated 11 December 2001;

6. Rates search for lot 67 on RP 50038 dated 29 November 2001;

7. Search for information concerning Main Roads land requirement for road purposesdated 20 November 2001;

8. Brisbane City Plan 2000;

9. Brisbane City Council planning and development certificate dated 20 November2001;

10. Environmental Protection Agency search for environmental management register andcontaminated land register dated 20 November 2001;

11. Department of Primary Industries correspondence dated 3 December 2001 regardingsurveillance to ascertain the presence of red imported fire ant;

Relevant Facts

The following facts are relevant to my decision:

1. The following forms of infrastructure form part of the Courthouse -

(a) 2 Magistrates Courts;

(b) mediation conference room;

(c) holding facilities;

(d) registry office and accommodation for staff;

(e) day facilities for external agencies;

(f) facilities for witnesses and victims of domestic violence;

(g) watchhouse; and

(h) associated infrastructure;

2 . These forms of infrastructure fall within the following types of communityinfrastructure (numbered in accordance with Schedule 5 of the IPA):

(e) correctional facilities;


(r) storage and works depots and the like including administrative facilitiesassociated with the provision or maintenance of the community infrastructurementioned in paragraph (e) and (s); and

(s) any other facility not mentioned in paragraphs (a) to (r) and intendedprimarily to accommodate government functions.

3. L.67 RP 50038 PAR OXLEY and L.68 RP 50038 PAR OXLEY for the site of theproposed Courthouse (“the land”) has been acquired by the State;

4. The land is located at 475 and 489 Archerfield Road, Richlands;

5. The State intends to supply the above community infrastructure, as part of theCourthouse by 2004;

6. Supply by 2004 of the community infrastructure mentioned above as part of theCourthouse will satisfy the community’s expectations for the efficient and timelysupply of the infrastructure;

7. The environmental effects of the above community infrastructure have been assessed,as part of the Town Planning and Traffic Assessment Report;

8. There has been public consultation about the above community infrastructure, as partof the process for the Town Planning and Traffic Assessment Report; and

9. No properly made submissions were received in response to the public notice for theproposed designation of land for community infrastructure advertised on 19February 2003 for the Courthouse/Watchhouse.

Reasons for the Ministerial Designation

For the following reasons, I am of the opinion that a Ministerial Designation of land forcommunity infrastructure in relation to the Courthouse/Watchhouse should be made:

(a) as the infrastructure will satisfy budgetary commitments of the State governmentregarding the provision of justice facilities; and

(b) satisfy the community’s expectations for the efficient and timely supply of efficientjustice facilities.

Anyone, including commercial fishers, fishing groups, all levels of Government, interest groups and members of the public should note that results of the “dilly review” undertaken in accordance with the Fisheries (Spanner Crab) Management Plan 1999 (“the Plan”) can now be obtained on request. The Queensland Fisheries Service in accordance with section 78 of the Plan, undertook consultation about the use of dillies in the commercial Spanner Crab Fishery and provided the opportunity for anyone to comment on the Dilly Review Paper. Specifically comment was sought on— (i) The number of dillies that may be set or used on a line in managed area A, (ii) Whether the number of dillies that can be carried on a spanner crab fishing boat

should be limited in managed area A and/or managed area B, (iii) Whether the use of double mesh net on spanner crab dillies should be prohibited,

Notice is hereby given pursuant to Regulation 30(1) of the CourtFunds Regulations 1988 that

(a) (i) a person entitled to the amount mentioned in Nos.1 to 3of the list may apply to the Court or a Judge of theSupreme Court at Brisbane, on or before the 21st day ofMay 2003, to be given the security or paid the amount;and

(ii) a person entitled to an amount mentioned in Nos. 4 and 5of the list may apply to the Court or a Judge of the District

Court at Brisbane, on or before the 21st day of May 2003,to be given the security or paid the amount; and

(b) if an application is not made under paragraph (a), an ordermay be made that—(i) in the case of an amount of money - the amount be paid

into the Consolidated Fund; or(ii) in the case of a security - the security be sold and the

proceeds paid into the Consolidated Fund.
