1 Purpose and Structure of the DocumentThe main objective of the present document is to provide a set of practical Operational Guidelines for the management and staff of the Public Procurement Regulatory Commission (PPRC). The Guidelines are based on the new Rules of Procedure of the PPRC1, which, in turn, are based on the Law on Public Procurement (LAW No. 04/L-042, 18/19 September 2011, hereinafter “PPL”). The Guidelines have been prepared in order to facilitate the introduction of the Rules of Procedure as well as guide the management and staff of the PPRC through the various review and administrative procedures that are part of their daily operations.

The present document has been prepared in the context of Task 3.5.2 (“Write operating guidelines for all institutions - including KIPA”) of the project “Support to Public Procurement Reform, EuropeAid/126497/C/SER/KOS”.

Both the Rules of Procedure and the Operational Guidelines concentrate on changes, or improvements proposed by this project regarding the role and operation of PPRC. These changes have been initially introduced and justified in the Deliverable “Managerial and Organisational Review of Public Procurement Regulatory Commission (PPRC), Public Procurement Agency (PPA), Procurement Review Body (PRB)” which was submitted in July 2010 and corresponded to the Project Deliverables D3.1 – D3.3. More importantly, the same changes were included in the PPL, proposed by this project and enacted on 17/18 September 2011.The Operational Guidelines provide a structural and coherent presentation of the overall organization, roles, responsibilities and authorities, as well as specific instructions for the implementation of certain functions of the PPRC. In that sense, they could serve as an internal guide for all employees of the PPRC, enhancing the understanding of each employee about his or her responsibilities towards the organisation and the general public. Moreover, they could provide the basis for training material useful when introducing new personnel or assigning new responsibilities to existing personnel. Finally, they could serve as a reference guide to support the internal control processes of the organisation.

To accomplish its purpose, this report is structured as follows:

o Chapter 2 briefly introduces the role and responsibilities of the PPRC, as defined by the Public Procurement Law. These need to be fully implemented in practice in order for the procurement system of Kosovo to be aligned to the European acquis.

o Chapter 3 provides an overview of PPRC’s new proposed organisational structure.

o Chapter 4 presents, with the aid of simple illustrative flowcharts, the main functions performed by the PPRC and identifies the responsibilities for their

implementation, linking functions and processes with the organizational chart and specific organizational roles.

o Finally, Chapter 5 presents the main job descriptions for PPRC staff, drawn in accordance with the PPL, the new Rules of Procedure and the analysis presented in Chapters 2 – 4 above.

2 Main Role and Responsibilities of the PPRC

2.1 References in the Law

The establishment of the PPRC - the Public Procurement Regulatory Commission is foreseen in paragraph 1.39 of Article 4 – Definitions. In paragraph 1.47 of the same article the Law establishes the Public Procurement Register and in paragraph 1.48 it defines the public procurement rules as the instructions, rules, documents, code of ethics, and standardized forms adopted and published by the PPRC.

The role and operation of the PPRC are detailed in Articles 86 – 93.

The references to PPRC in the Law may be grouped as follows:

2.1.2 PPRC WEB site and Public Procurement RegisterThe Law foresees for the PPRC a central role in the dissemination of the entire legal framework for public procurement in Kosovo.

Thus, according to paragraph 6 of Article 10 - Means to promote Transparency, the PPRC shall electronically publish the Law and the public procurement rules on its website, as well (paragraph 9 of the same article) any secondary legislation for the implementation of the Law.

Article 10 - Means to promote Transparency

9. In every case when PPRC, PRB, CPA plans to issue any secondary legislation for the implementation of this law, they are obligated to make this draft available to the public and interested parties, for a period of no less than fifteen (15) days for comments to the draft.

In addition the PPRC shall publish all contract notices on its WEB site and the Public Procurement Register, as well as the list of commodities or common use items the procurement of which has been assigned to the CPA.

Article 42 - Publication of Notices

2. Within two (2) days after the PPRC receives such a notice from a contracting authority pursuant to paragraph 1 of this Article, the PPRC shall publish all language versions of such notice on the PPRC’s website and in the Public Procurement Register. The PPRC can within the same time limit demand that the contracting authority rectifies mistakes and omissions in the notice. The contracting authority will in the cases covered by paragraph 4 of this Article publish and circulate corrections.

Article 95 - Procurement Activities of the CPA

2. The government as per the proposal from the Ministry of Finance shall establish a list of any commodities or common use items the procurement of which it has assigned to the CPA. Such list shall be adopted in the form of an Administrative Instruction. Such list and any amendment thereto shall be published in the media and made accessible on the PPRC website referred to in sub-paragraph 2.11 paragraph 2 of Article 87 of the this law.

2.1.3 Access to procurement activity informationAs one of the three procurement authorities of Kosovo, CPA has the right to gain access to any procurement activity information.

Article 10 - Means to promote Transparency

8. A contracting authority shall provide access to and copies of any procurement activity records, including confidential business information, and any other procurement related information to a review expert, the PPRC, the PRB and/or a review panel immediately upon the request or order of any of these. …

Article 21 - Restrictions on the Use of Articles 16-20

2. Furthermore, no information regarding the specific or general estimated value of a public contract or design contest, and no information regarding the funds available for the financing of such contract or design contest, shall be disclosed to any person until the procurement activity has been concluded. However, a contracting authority shall provide such information to the PPRC, CPA, a review expert, the PRB or a court immediately upon the request or order of any of these.

Article 80 - Composition and Decisions of the Jury

5. Only the decision of the jury shall be disclosed to a person who is not a jury member. The substance of the deliberations of the jury and the opinions of the individual jury members shall be maintained as confidential by all jury members. Except where required by a written order of the PPRC, the PRB or a court of competent jurisdiction, no jury member shall disclose or discuss the substance of such deliberations or the opinion of any individual jury member with any person who is not also a member of the jury.

Article 97 - Confidentiality

The CPA may protect from disclosure to the public or unauthorized persons information developed or received by the CPA during the conduct of its work, but only to the extent permitted by both the present law and the Law on Access to Public Documents. Notwithstanding the foregoing, the CPA shall provide access to and copies of any information and records in its possession or control, including confidential information and records, to the Auditor General, the PPRC and/or the PRB immediately upon the request or order of any of these. The CPA shall also provide access to and copies of such information and records to a court of competent jurisdiction if such access and copies are required pursuant to an order issued by such court.

2.1.4 Procurement Officers

Article 23 - Procurement Officers4. No person may serve as a Procurement Officer or as a staff member of a

Procurement Department unless and until he/she has executed a written declaration under oath declaring that he/she (i) is not ineligible to serve as Procurement Officer under this article, (ii) shall honestly and faithfully conduct the procurement activities of the contracting authority in strict conformity with this law, and (iii) shall professionally and immediately discharge all other duties specified in this law. The declaration under oath shall be submitted to the PPRC, which shall immediately register the declaration and provide the person submitting the declaration with a receipt evidencing such registration. The PPRC shall maintain all such declarations submitted in accordance with this Article in the PPRC’s publicly available records

Article 24 - Procurement Officers to Conduct Procurement Activities3. The Procurement Officer of a contracting authority shall be responsible for

immediately reporting to the PPRC any procurement activities of such contracting authority that are inconsistent with the present law.

4. In case of any indication that a procurement Officer has become ineligible to hold that position for a reason specified in paragraph 3 Article 23 of this law, the contracting authority shall immediately notify the PPRC. The PPRC decides whether such ineligibility exists, instructs, as the case may be. In case of the removal of the procurement Officer the provisions of the Law on Civil Servants apply.

Article 25 - Training of Procurement Officers1. KIPA in cooperation with PPRC is responsible to develop training modules

and curriculum for procurement qualifications. KIPA and PPRC is required to identify, experienced in public procurement, suitable to teach the procurement courses designed by PPRC. KIPA shall arrange for the development and delivery, of a procurement training courses having duration of at least fifteen (15) days. PPRC in cooperation with KIPA ensures that such courses are developed and delivered by a trained person or training organizations having substantial expertise in best international procurement practices and the procurement system of the EU.

8. Any procurement professional certificate issued by KIPA may be revoked by PRB if it is determined that the person holding such certificate does not meet, or no longer meets, the eligibility requirements specified in Article 23 of this law or has committed a serious violation of this Law or the procurement rules. If the holder of the certificate is a civil servant, the revocation process must comply fully with the requirements of the Law on Civil Servants. If the holder of the certificate is not a civil servant, the person shall first be entitled to receive ninety (90) days’ advance written notice of PPRC’s intent to revoke his/her certificate; and such notice shall give the affected person the right to challenge such action in accordance with the Law on Administrative Procedures and, if the person is dissatisfied with the result or the conduct of the process under such law, the person may submit a complaint on the revocation to the Supreme Court of Kosovo.

9. On request from a contracting authority PPRC determines whether the eligibility requirements specified in Article 23 for a procurement professional certificate are met. If PPRC considers that the requirements mentioned are not met, the PPRC submits their recommendation to PRB with a request for revocation of the certificate in accordance with the procedures mentioned in paragraph 8 of this Article.

2.1.5 Monitoring

Article 27 - Tender Dossier4. Whenever a procurement activity requires the publication of a contract notice,

the tender dossier must be completed before the publication of the contract notice; PPRC may decide on monitoring of this provision with sub-acts.

Article 42 - Publication of Notices 2. Within two (2) days after the PPRC receives such a notice from a contracting

authority pursuant to paragraph 1 of this Article, the PPRC shall publish all language versions of such notice on the PPRC’s website and in the Public Procurement Register. The PPRC can within the same time limit demand that the contracting authority rectifies mistakes and omissions in the notice. The contracting authority will in the cases covered by paragraph 4 of this Article publish and circulate corrections.

Article 81 - Contract Management Activities3. The contract management plan must at least include (i) the name of the

officer(s) of the contracting authority responsible for the management of the contract, and where applicable, the supervising qualified resident or project engineer(s); (ii) number and categories of assisting personnel available to the officer for contract management purposes, including externally recruited technical experts; (iii) a time schedule or a project plan Gantt charts, diagrams on contract management activities covering the duration of the contract. The PPRC monitors contract managing.

2.1.6 Notification of PPRC by contracting authorities

Article 24 - Procurement Officers to Conduct Procurement Activities4. In case of any indication that a procurement Officer has become ineligible to

hold that position for a reason specified in paragraph 3 Article 23 of this law, the contracting authority shall immediately notify the PPRC. The PPRC decides whether such ineligibility exists, instructs, as the case may be. In case of the removal of the procurement Officer the provisions of the Law on Civil Servants apply.

Article 32 - General Rules5. Notwithstanding the requirements established by paragraph 4 of this Article

when less than two responsive tenders or requests to participate have been submitted in response to an open procedure, a restricted procedure or negotiated procedure after publication of the contract notice, provided that a) the initial contract specifications are not changed and b) that the contracting authority has demonstrated that due to a severely limited competitive market for the contract in question a new open, restricted or negotiated procedure after publication of a contract notice will not result in an increased number of responsive tenders, where applicable, requests to participate, the contracting authority may waive the requirement. However the PPRC must be notified by the concerned contracting authority, within two days from the date of the decision, for the waiver of the requirement.

Article 35 - Negotiated Procedures Without Publication of a Contract Notice1. A contracting authority may use negotiated procedures without publication of

a contract notice to conduct a procurement activity only after it has complied with this Article. PPRC must be notified by the concerned contracting authority within two days of the date when decision about using such procedures has been taken. The contracting authority shall in the notification provide a detailed explanation of the facts considered and the justification for using the procedure.

Article 42 - Publication of Notices 1. A contracting authority shall immediately submit to the PPRC all language

versions of any notice that it has prepared pursuant to Article 39, 40 or 41 of this law. The PPRC shall establish rules governing the submission of such notices.

Article 61 - Abnormally Low Tendersa. The contracting authority is obliged to notify the PPRC within two days from

the date any rejection under paragraph 4 of this Article. The notification must provide the information, explanations and reasons mentioned in that Article.

Article 75 - Design Contest Notices When a contracting authority intends to conduct a design contest, the contracting authority shall prepare a design contest notice in the languages required by Article 13 of this law. The contracting authority shall immediately submit to the PPRC all language versions of such notice.

Article 78 - Design Contest Results Notice A contracting authority that has held a design contest shall, within two (2) days of the conclusion of such contest, prepare a notice on the results of the design contest in the languages required by Article 13 of this law. The contracting authority shall immediately submit to the PPRC all language versions of such notice.

2.2 Role and responsibilities (articles 86-93)

3 PPRC’s Organisational StructureThe structure of the PPRC is as follows:

The Agency is headed by its Director.

Departments, divisions and number of the suggested staff are described below:

4 Main Functions of the PPRCThe “logical” interconnection of the PPRC function is depicted in the following figure:

Based on the information and data collected and documented via the monitoring function, the PPRC will detect (a) gaps and deficiencies of the public procurement legal framework and will initiate the process for the necessary amendments, (b) training needs of the procurement officers and in cooperation with KIPA will elaborate the necessary training initiatives.

The certification function of the public procurement officers may be regarded as a function deriving from the training function.

4.1 Legal function

The Division of Rules, under the Department of Rules and Training of the PPRC is responsible to establish the rules and conditions governing the implementation of every type of public procurement activity in the Republic of Kosovo, including framework contracts (which are not covered by the present Public Procurement Law).

In addition the PPRC has to issue rules detailing the management of contracts.

The initiating event for interventions of the PPRC in the secondary Public Procurement Legislation will be repeating gaps and deficiencies detected and documents during monitoring of public procurement activities.

4.2 Training function

The Division of Training, under the Department of Rules and Training of the PPRC is responsible to support KIPA in the design and development of training modules and curriculum for the qualification of procurement officers. To this extent the Division of Training will exploit the gaps and deficiencies detected and documents during monitoring of public procurement activities.

The Division of Training, under the Department of Rules and Training of the PPRC is also responsible, together with KIPA to identify suitable trainers (individual trainers or training organizations) in public procurement to deliver the relevant courses.

The procurement training courses shall have duration of at least fifteen (15) days.

The trainers shall be experienced in public procurement training, in best international procurement practices and in the procurement system of the EU.

4.3 Certificate Revocation function

The Division of Rules, under the Department of Rules and Training of the PPRC is involved in the revocation of the certificates of the Public Procurement officers, according to the following work flow diagram:

Step 1: A contracting authority requests the PPRC to determine whether the eligibility requirements for a procurement professional certificate are met.

Step 2: In case the Division of Rules, under the Department of Rules and Training of the PPRC decides that the eligibility requirements are not met and the certificate should be revoked, the PPRC sends a revocation request to PRB.

In case the holder of the certificate IS NOT a civil servant, the PPRC shall notify him in written form (90) days in advance of the revocation request to PRB.

In case the holder of the certificate IS a civil servant, the certificate will be revoked by the PRB according to the Law on Civil Servants.

4.4 Monitoring function

The monitoring function is implemented by the Division of Monitoring, under the Department of Monitoring and IT, according to the following work flow diagram:

Step 1: Implementing the yearly monitoring plan, on an ad hoc basis or after a notification, the Division of Monitoring decides to monitor a specific procurement procedure of a contracting authority.

Step 2: A monitoring team is nominated, of procurement officers of the Division of Monitoring.

Step 3: The monitoring team undertakes the monitoring, following (indicatively) the following steps:

a. Collect the tender documentation (tender notice, tender documents, submitted clarification questions and relevant responses, if any)

b. Collect all submitted offers

c. Collect the entire evaluation documentation (decision for the formation of the evaluation committee, clarification questions to bidders and

relevant responses, if any, protocols of the evaluation committee, interim and final evaluation reports)

d. Perform conformity control of the entire procedure with the public procurement legal framework.

Step 4a: If there is no breach of the Public Procurement Law, the monitoring team drafts a positive monitoring report and the PPRC sends it to the Head of the Procurement Department of the respective contracting authority and to the relevant supervising body.

Step 4b: If minor procedural deviations of the Public Procurement Law have been documented, PPRC organizes a meeting with the participation of the politically responsible persons in the contracting authority to discuss the case, exchange oral explanations and elaborate remedies to be taken.

The monitoring team will draft a negative monitoring report in the form of a professional advice, incorporating the outcome of the above meeting.

PPRC sends the report to the Head of the Procurement Department of the respective contracting authority and to the relevant supervising body.

Step 4c: In case severe procedural deviations of the Public Procurement Law have been documented, the PPRC will consider the necessity to conduct an investigation and, in some cases, ask for the assistance of enforcement officials.

During the investigation

a. Selected officials of the contracting authority may be invited for hearings

b. Representatives of economic operators may be invited for hearings

c. Any other persons may be also invited, if the investigators decide that they may have relevant information

PPRC may decide to organize a meeting with the participation of the politically responsible persons in the contracting authority to discuss the case, exchange oral explanations and elaborate remedies to be taken.

The monitoring and investigation team will draft a negative monitoring report in the form of a professional advice, incorporating the outcome of the above meeting.

PPRC sends the report to the Head of the Procurement Department of the respective contracting authority and to the relevant supervising body.

PPRC sends the monitoring report to any other interested party, like Office of Central Auditor, Anticorruption Agency etc.

5 Job Descriptions of the PPRC

5.1 Monitoring Officer

Under the direct supervision and control of the Head of the Division and the Department Director the monitoring officer undertakes monitoring and investigation activities in Contracting Authorities, always observing the highest professional standards and ethical conduct.

He exercises his responsibilities respecting the Law of the Kosovo Civil Service, the Public Procurement Law, the Law on Public Financial Management and the Rules of Procedure of the Public Procurement Regulatory Commission , and any other relevant laws and regulations.

The monitoring officer (indicatively and not exclusively):

Participates in the elaboration and in the implementation of the annual monitoring plan.

Assist in the development and implementation of an effective monitoring system of contracting authorities, involving, among others, the elaboration of monitoring guidelines and checklists.

Oversees the implementation of the provisions of the Law on Public Procurement in Kosovo and the relevant procurement rules.

Observes and monitors procurement procedures at the Contracting Authority he is assigned to monitor.

Reviews procurement documentation, including bid documents, bid evaluation reports, contract awards and other procurement documents and gives professional advice to contracting authorities.

Participates and facilitate meetings with Contracting Authorities and prepares relevant supporting documentation.

Prepares written monitoring and investigation reports.

Identifies generic procurement issues, and assesses capacity of contracting authorities to procure efficiently and defines possible training needs.

Stays abreast of new processes, technologies, materials, purchasing methods, legal requirements and market conditions. Communicates to the Division and Department management on any significant factors that could affect the activity of PPRC.

Represents the Division and the Department at, if assigned to him, in various meetings with the administration, external agencies, professional organizations, and other groups. To this extent he elaborates and delivers presentations and training as required.

Is responsible for administrative issues of the Division, such as maintaining/revising policies and procedures, reporting administrative problems and using the PPRC’s systems and infrastructure with the necessary care.

Performs any other task assigned to him by the Head of Division and/or the Department Director.

5.2 Officer for Rules

Under the direct supervision and control of the Head of the Division and the Department Director the officer for rules elaborates rules and other parts of the public procurement legal system, always observing the highest professional standards and ethical conduct.

He exercises his responsibilities respecting the Law of the Kosovo Civil Service, the Public Procurement Law, the Law on Public Financial Management and the Rules of Procedure of the Public Procurement Regulatory Commission, and any other relevant laws and regulations.

The rules officer (indicatively and not exclusively):

Participates in committees as required.

Participates and facilitate team meetings, prepares supporting documentation and assists with strategy development.

Undertakes activities in designing and developing regulations, guidelines, directives, forms and standard procurement documents in accordance with the Public Procurement Law.

Undertakes the distribution of rules, guidelines, documents and forms (in electronic or in printed form) to all Contracting Authorities.

Monitor the implementation of public procurement rules by studying the monitoring and investigation reports elaborated by the Division of Monitoring.

Elaborates reports related to the implementation of public procurement rules in Kosovo and documented proposals for the enhancement of the public procurement legal system.

Identifies generic procurement issues and defines possible training needs.

Participates in the development of training material.

Undertakes training of public procurement officers as assigned to him.

Stays abreast of new processes, technologies, materials, purchasing methods, legal requirements and market conditions. Communicates to the Division and Department management on any significant factors that could affect the activity of PPRC.

Represents the Division and the Department at, if assigned to him, in various meetings with the administration, external agencies, professional organizations, and other groups. To this extent he elaborates and delivers presentations and training as required.
