To Whom it May Concern: Pro-ACTION shareholders of CMKM have established the COALITION for the particular purposes of uncovering the truth pertaining to CMKM, coercing the perpetrators to compensate CMKM shareholders for the harm that has been perpetrated against them, making certain that said perpetratorsare held accountable for their malfeasance, and for the general purpose of forcing governmental agencies to comply with the true purpose of their existence. On January 4, 2010, A. Clifton Hodges, Esq., Hodges and Associates, filed a 3.87 trillion dollar Bivens Action, Civil Action No. 1000031, David Anderson, Lt. And yet the COALITION has incredibly received no response from any of the entities towhich/whom it has filed complaints and forwarded its extensive evidence which leads to thefollowing disturbing realization: THE ENTITIES WHO ARE MANDATED TO PROTECTINVESTORS AND TO INVESTIGATE COMPLAINTS ARE JUST AS INEPT ANDCORRUPT AS THE PERPETRATORS, AND IN MANY INSTANCES THEY ACTUALLYAID AND ABET THE PERPETRATORS.

A case in point is Eagletech Communications (Eagletech) in which the perpetrators were foundguilty of RICO charges in US District Court. But instead of pursuing the perpetrators, the SEC,as is its MO, deregisters the victim of the crime, Eagletech. And because Eagletech is not anisolated occurrence, but appears to be just one example of the SEC's ongoing and coordinatedeffort to violate securities and other laws, the SEC violates the Racketeer Influenced and CorruptOrganization (RICO) Act.

TIMELINE OF PAST AND CURRENT FRAUD BEING COMMITTED AGAINST CMKMSHAREHOLDERS:

1. Circa March 2009, the COALITION files complaints with the RCMP and FBI and presents itsextensive evidence to those governmental entities. Furthermore, many CMKM shareholders fromthe United States contact their representatives pertaining to CMKM. Nobody responds.

2. Because those entities breached their mandated duties by failing to protect investors and toinvestigate complaints, the COALITION filed on November 6th, 2009, a WRIT OF SUMMONSand STATEMENT OF CLAIM in the SUPREME COURT OF BRITISH COLUMBIA againstthe SEC for the purpose of exposing the SEC for being inept in its handling of the previousCMKM management's pump and dump scam and for being corrupt in its handling of the illegalnaked short selling (NSS) of CMKM's stock, which caused innocent CMKM shareholders to losehundreds of millions of dollars in the scam, an indeterminable amount of money in the NSS, andpossibly their valuable mining claims in both the scam and the NSS.

3. On December 16th, Al Hodges pronounces to CMKM shareholders that Robert A. Maheucollected and set up under the auspices and approval of governmental agencies monies, funds,settlements and trusts (monies) earmarked for distribution to CMKM shareholders.

4. Circa December 2009, the US Treasury allegedly taxes those monies.

5. On January 4th 2010, Reece Hamilton (wyatt11_11), one of the plaintiffs in the Bivens Action,proclaims the following in a public forum:

6.  On  January  4,  2010,  Al  Hodges  files  the  Bivens  AcNon  which  includes  seven  plainNffs.  AlHodges  announces  in  public  forums  that  all  shareholders  are  represented  in  the  Bivens  AcNon.The  following  is  a  COALITION  PR  pertaining  to  the  Bivens  AcNon:

Bivens  Class  AcNon  law  suit  seeking  $3.87  trillion  in  damages  was  filed  on  January  4,  2010against  five  present  and  five  past  Security  and  Exchange  Commission  commissioners.  A.  ClihonHodges  of  Hodges  and  Associates,  Pasadena,  Ca,  filed  the  suit  on  behalf  of  seven  namedplainNffs  and  "all  others  similarly  situated".

The  suit  alleges  CMKM  Diamonds,  Inc.  was  used  as  a  vehicle  in  a  joint  sNng  operaNon  conductedby  the  SEC,  the  Department  of  JusNce  (DoJ)  of  the  United  States,  Robert  A.  Maheu  and  others.The  suit  contends  between  June  1,  2004  and  October  28,  2005  "a  total  of  2.25  trillion  'phantom'shares  of  CMKM  Diamonds,  Inc.  were  sold  into  the  public  market  through  legiNmate  brokers,illegiNmate  brokers  and  dealers,  market-­‐makers,  hedge  funds,  ex  clearing  transacNons  andprivate  transacNons."

The  class  acNon  suit  further  alleges  the  'SecuriNes  and  Exchange  Commission  and  theDepartment  of  JusNce,  with  assistance  from  the  Department  of  Homeland  Security  (DHS),believed  and  developed  evidence  that  said  short  sellers  were  uNlizing  their  acNviNes  to  illegallylaunder  moneys,  wrongfully  export  moneys,  avoid  payment  of  taxes,  and  to  support  terroristoperaNons.'

The  twenty-­‐page  complaint  states  the  SEC,  DoJ  and  the  DHS,  "consented  to,  facilitated  andsupported  the  conferences  between  Robert  A.  Maheu  and  his  associates  on  the  one  hand  andthe  wrongdoing  short  sellers  on  the  other,  all  for  the  purpose  of  se3ling  the  potenNal  liability  ofsaid  wrongdoers  with  consent  of  the  US  Government  and  a  representaNon  of  no  criminalprosecuNon  for  such  illegal  sales."

According  to  Al  Hodges  filing,  between  March  2004  and  August  2006  a  se3lement  was  reachedon  behalf  of  CMKM  Diamonds,  Inc.  by  Maheu,  with  assistance  from  others,  and  the  allegedwrongdoers  who  had  engaged  in  naked  short  selling  of  CMKM  Diamonds,  Inc.  stock  and  cellarboxing  the  company.  "In  exchange  for  a  US  Government  promise  of  no  prosecuNon  for  suchsales,  the  wrongdoers  each  promised  to  pay  negoNated  amounts  to  a  frozen  trust  for  disbursalat  a  later  Nme."

The  suit  contends  these  monies  and  other  monies  resulNng  from  the  sale  of  claims  to  foreignenNNes  were  collected  for  the  benefit  of  the  shareholders  of  CMKM  Diamonds  Inc.,  and  arebeing  held  in  a  trust,  or  held  in  trust  by  the  Depository  Trust  &  Clearing  CorporaNon  and  theUnited  States  Treasury.

The  $3.87  trillion  dollar  lawsuit  states  demands  for  the  release  of  said  monies  has  been"repeatedly"  presented  to  the  SEC  and  'agents  and  employees  of  the  SEC  and  the  DoJ  haverepresented  repeatedly  that  the  release  of  the  monies  was  imminent."

The  Al  Hodges  complaint  charges,  "As  a  result  of  the  Defendant's  misconduct,  each  of  thenamed  plainNffs  and  all  of  those  similarly  situated,  have  been  denied  their  ConsNtuNonal  rights,including,  but  not  limited  to,  their  Fihh  Amendment  right  to  be  secure  in  their  property,  freefrom  taking  without  just  compensaNon  and  without  due  process  of  law,  and  have  sufferedinjuries  and  property  loss  in  excess  of  Three  Trillion  Dollars."

7.  On  February  4,  2010,  the  COALITON  peNNons  the  Supreme  Court  of  BriNsh  Columbia  for  adefault  judgement  against  the  SEC.  The  Court  decided  the  COALITION  would  have  to  re-­‐servethe  SEC  before  the  Writ  of  Summons  and  Statement  of  Claim  against  the  SEC  could  moveforward.  Because  the  release  of  monies  earmarked  for  distribuNon  to  CMKM  shareholdersappeared  to  be  imminent,  the  COALITION  dropped  its  Writ  against  the  SEC.  The  COALITIONrespecnully  requested  that  the  Court  demand  that  said  monies  be  released  to  CMKMshareholders.  The  Court  denied  the  request.

8.  From  February  4,  2010,  to  February  15,  2010,    Al  Hodges  proclaims  in  the  public  forums  thatmonies  earmarked  for  distribuNon  to  CMKM  shareholders  had  to  be  released  within  the  90  daysthat  the  monies  were  taxed,  and  that  the  enNNes  that  failed  to  do  so  would  be  violaNngintrnaNonal  laws.

Thank  you  for  speaking  with  me  earlier  today  and  explaining  that  Mr.  Markowitz  was  out  for  therest  of  the  day.  We  discussed  briefly  the  nature  of  my  request  and  you  suggested  that  I  forwardthe  appropriate  informaNon  to  your  a3enNon  via  e-­‐mail  for  Mr.  Markowitz’s  review  on  hisreturn  Monday,  March  1,  2010.  The  informaNon  is  as  follows:

•  I  am  a  California  trial  a3orney  with  some  40  years  experience  in  State  and  Federal  Court,  aswell  as  other  jurisdicNons.

•  In  January  of  this  year  I  filed  a  Bivens  Class  AcNon  against  the  five  sisng  SEC  Commissions  andfive  past  SEC  Commissioners  seeking  some  3.87  Trillion  Dollars  in  damages  for  the  taking  ofproperty  by  unconsNtuNonally  withholding  consent  to  distribute  such  sums  as  had  previouslybeen  collected  for  the  benefit  of  50,000  +  shareholders  of  CMKM  Diamonds,  Inc.;  a  conformedcopy  of  the  complaint  is  a3ached.

•  The  SEC  Office  of  General  Counsel  has  agreed  to  accept  service  on  behalf  of  the  sisngCommissioners;  the  other  commissioners  are  currently  being  served.

•  The  weight  of  opinion  is  that  this  liNgaNon  will  not  be  allowed  to  proceed  into  the  discoverystages  and/or  to  trial;  there  is  mounNng  evidence  that  a  distribuNon  of  funds  to  theshareholders  is  on  the  near  horizon.

•  I  am  advised  that  a  porNon  of  trust  funds  previously  ear-­‐marked  for  distribuNon  to  supportthe  U.S.  DomesNc  Se3lement  Fund  Program  currently  in  process  were  distributed  to  the  UnitedStates  Treasury  facility  in  New  York  City  on  December  31,  2009  through  and  with  the  assistanceof  the  New  York  Federal  Reserve  Bank  in  New  York  City.

•  I  am  advised  that  these  trust  funds  totaled  4.2  Trillion  Dollars  and  were  paid  into  the  U.S.Treasury  as  and  for  taxes  due  to  be  paid  from  the  trust(s)  upon  distribuNon  of  the  trust  assets.

•  I  am  further  advised  that  pursuant  to  Federal  Banking  RegulaNons,  New  York  State  BankingRegulaNons,  and  the  MarNn  Act,  inter  alia,  the  transferred  funds  could  be  held  without  returnfor  a  maximum  period  of  Nme  under  any  circumstances  for  forty-­‐five  days  or  unNl  midnightFebruary  14,  2010.

•  I  am  further  advised  that  the  U.S.  Treasury  has  not  remi3ed  these  funds,  is  sNll  possessed  ofthese  funds  and  more  importantly  the  trust(s)  assets  have  not  been  distributed.

•  The  above  circumstances,  upon  proof,  demonstrate  serious  criminal  violaNons  of  the  statutesreferred  to  above.

•  I  represent,  at  least  as  the  Class  Counsel,  a  number  of  New  York  residents  who  arebeneficiaries  of  these  trust(s)  and  are  among  the  50,000  +  shareholders.  I  know  many  of  thesepeople  on  a  personal  basis  in  addiNon  to  being  their  counsel  of  record  and  can  a3est  to  theirsevere  and  conNnuing  damage  suffered  and  being  suffered  as  a  result  of  the  non-­‐distribuNonand  non-­‐receipt  of  the  afore  menNoned  trust  assets;  some  of  them  are  also  anxious  to  visit  youin  person  and  describe  their  conNnuing  outrage.

Demand  is  hereby  made  that  your  office  iniNate,  at  the  earliest  possible  Nme,  an  invesNgaNoninto  the  criminal  acNviNes  of  those  persons  within  your  jurisdicNon  whom  have  contributed  toand  otherwise  facilitated  these  criminal  acts.  I  would  be  happy  to  discuss  these  facts  with  you  atyour  early  convenience.  Please  feel  free  to  contact  me  directly  at:  (626)  564-­‐9797.  Thank  you  inadvance  for  your  prompt  a3enNon  to  this  ma3er.

10.  On  March  30,  2010,  Al  Hodges  is  interviewed  by  the  Manha3an  Examiner  in  which  he  isquoted:  “They  [the  government]  used  the  shareholders  without  their  consent  to  perform  this‘sNng  operaNon’  for  NaNonal  Security  interests,  and  it  wouldn’t  have  worked  the  way  it  workedif  they  had  disclosed  it.  On  the  other  hand,  it  isn’t  right  to  bury  a  company  and  put  them  out  ofbusiness  for  the  purpose  of  trapping  people  who  are  using  the  company  to  cheat  thegovernment,  to  line  their  own  pockets,  and  to  fund  their  operaNons  against  the  United  States.As  noted  above  in  complaint  paragraph  34,  and  per  Hodges,  a  deal  was  eventually  reached  withthe  aforemenNoned  criminals;  they  paid  the  government  resNtuNon  for  documented  illegalacNons,  and  in  turn,  were  offered  immunity  from  prosecuNon.  Rob  Maheu  had  all  these  peoplein  a  big  room  in  Las  Vegas,  and  made  [an]  offer  to  them.  Every  person,  organizaNon  andrepresentaNve  in  that  room  stepped  up,  and  either  transferred  money  while  they  were  there,  oragreed  to  transfer  money  upon  some  further  schedule  to  avoid  indictment."  Hodges  also  said,  “Ihave  a  witness  who  was  there,  who  saw  it,  and  part  of  the  2.25  trillion  phantom  shares  isdocumented  by  that  person’s  observaNons  of  how  many  shares  were  represented  in  that  room.

HOW  MUCH  MONEY  DID  THE  FEDS  REALLY  COLLECT  FOR  RESTITUTION?"  "People  are  going  tolaugh  and  N3er  about  the  amount  of  money  that  is  being  claimed,  but  understand  the  contextof  the  lawsuit,”  he  said,  before  concluding,  “we  are  not  asking  the  government  to  pay  us  $3.87trillion,  what  we’re  asking  is  for  them  to  release  the  funds  that  have  been  collected  for  us.”Thus,  the  implicaNon  is  that  this  sum  also  incorporates  substanNal  puniNve  damages.In  the  end,Hodges  believes  the  U.S.  government  is  going  to  se3le  the  case  before  it  actually  moves  to  trial.On  this  possibility,  he  said,  “I  think  its  in  the  process  of  happening  as  we  speak.”

11.  Hodges  and  Associates  INTERIM  UPDATE  (04-­‐27-­‐2010):

I  have  previously  stated  that  I  would  not  provide  an  “update”  unNl  we  had  confirmaNon  ofeconomic  receipt  or,  I  became  convinced  that  payment  to  CMKX  shareholders  would  not  beforthcoming  in  a  Nmely  manner.  This  “Interim  Update”  is  the  excepNon  that  proves  the  rule,  soto  speak.  However,  it  has  been  a  relaNvely  long  period  [certainly  more  than  I  originallyanNcipated]  since  I  communicated  with  the  shareholders  at  large,  and  there  is  materialinformaNon  to  impart.

Before  providing  some  informaNon  about  what  has  been  transpiring  and  our  current  status,  letme  address  a  few  other  ma3ers:

•  I  am  an  a3orney  and  have  been  retained  by  seven  brave  and  excepNonal  shareholders  thatrepresent  a  cross  secNon  of  the  proposed  class.

•  The  Bivens  acNon  which  I  have  filed  not  only  sets  forth  the  facts  as  I  know  them,  it  seeks  tobecome  a  class-­‐acNon  on  behalf  of  all  shareholders.

•  At  this  instant  in  Nme  however,  I  literally  represent  only  the  seven  named  plainNffs;  as  a  result,I  am  constrained  in  the  types  and  extent  of  informaNon  which  I  can  provide  to  putaNvemembers  of  the  class.

•  In  the  unlikely  event  that  this  liNgaNon  conNnues  forward,  a  moNon  will  be  filed  with  theCourt  requesNng  that  a  class  be  cerNfied.  If  granted,  at  that  point  I  will,  presumably,  beappointed  by  the  Court  to  conNnue  acNng  as  counsel  for  the  class;  thereaher,  the  Court  will  berequired  to  approve  any  and  all  se3lements,  and  others  ma3ers.

•  The  status  of  the  liNgaNon  can  at  all  Nmes  be  monitored  on  PACER;  as  a  result,  we  do  notrespond  to  inquiries  at  my  office;  accordingly,  please  do  not  contact  us  directly  for  suchinformaNon.

•  For  everyone’s  informaNon,  all  defendant’s  have  been  served,  and  an  iniNal  schedulingconference,  originally  set  by  the  Court  to  be  held  on  April  26,  2010  has  been  conNnued  bymutual  agreement  of  the  parNes  [with  consent  of  the  Court]  to  July  26,  2010.

•  The  liNgaNon  will  be  aggressively  pursued  unNl  such  Nme  as  all  CMKX  shareholders  have  beenpaid.

In  a  similar  vein,  please  understand  that  we  are  not  involved  in  any  ongoing  negoNaNons  withthe  SEC  and/or  their  representaNves  with  a  view  to  compromising  and/or  otherwise  a3empNngto  resolve  claims  of  the  shareholders.  We  have  set  forth  in  the  complaint  what  the  shareholdersare  enNtled  to  receive;  compromise  is  not  anything  that  the  shareholders  want,  desire,  or  wouldtolerate  or  accept.  

The  belief  of  some  that  yelling  and  screaming,  loudly  and  publicly  enough,  can  somehow“force”  release  of  the  CMKX  moneys,  is  erroneous  and  misplaced;  it  will  not.  Having  said  that,  Ido  believe  that  media  exposure  is  beneficial  in  the  sense  that  it  keeps  the  pressure  on  the  enNrefinancial  community.

Inquiring  minds  want  to  know:  what  is  our  status;  what  has  been  going  on;  what  is  holding  upeconomic  receipt;  when  will  our  money  be  released;  and  how  much  money  is  there?  Let  meaddress  each  of  these  quesNons,  to  the  extent  I  am  able,  separately:

1.  How  Much  Money  –  As  I  have  said  before,  we  have  persuasive  evidence  to  all  of  the  factsalleged  as  such  in  the  complaint;  accordingly,  there  is  a  total  of  3.87  Trillon  Dollars.

2.  When  is  Release  –  The  CMKX  distribuNon  funds  will  be  released  within  a  very  short  Nme  aherthere  is  confirmaNon  of  Economic  Receipt.  What  does  that  mean?  It  means  that  currently  inprocess  is  a  massive  shih  of  wealth  within  the  US  and  the  world  community;  that  includes:  payout  of  all  the  domesNc  se3lements;  insNtuNon  of  the  US  dollar  re-­‐funding  project;  pay  out  ofworld  se3lements;  and,  distribuNon  of  funds  to  many  other  programs.  This  involves  a  total  ofmore  than  $  42  Trillion.  Economic  Receipt  occurs  when  all  trustees  have  access  to  all  of  thefunds  they  are  responsible  for.

3.  Our  Status  –  We  are  literally  on  the  thresh-­‐hold.  This  means  that  the  “work”  remaining  to  befinished  will  not  consume  more  hours  than  can  be  accomplished  within  one  day.  We  have  beenat  this  point  now  for  more  than  a  few  weeks.  

4.  The  Delay  –  Although  I  could  write  a  book  about  what’s  been  going  on  behind  the  scenes  tocause  this  addiNonal  delay,  I’ll  try  to  give  you  the  condensed  version:  

First  -­‐  Please  be  aware  and  understand  that  there  is  an  economic  war  raging  in  the  background.  

Second  -­‐  The  naked  corrupNon  that  is  endemic  in  D.C.  is  more  than  most  can  comprehend;  it  isclear  that  these  miscreants  have  no  regard  for  the  US  ConsNtuNon,  Federal  Laws  andRegulaNons,  nor  even  any  sense  of  simple  morality.  They  are  convinced  that  they  are  above  anyconstraint  that  might  apply  to  lesser  mortals  and  that  no  enforcement  acNvity  will  ever

successfully  address  them.  I  hasten  to  add  that  such  opinions  are  not  universal;  having  said  that,it  is  more  widespread  than  not.

Third  -­‐  These  miscreants  are,  in  effect,  fighNng  for  their  lives  –  at  least  that  part  of  their  livesthat  establishes  an  environment  in  which  they  can  conNnue  to  lie,  cheat,  steal,  and  mortgageyour  progeny’s  lives,  all  for  their  personal  gain.  Accordingly,  they  will  fight  unNl  the  doors  are  allclosed  by  a  power  that  they  cannot  subvert.  That  fight  conNnues  as  I  prepare  this  interimupdate.

Fourth  -­‐  The  good  news  is,  we  are  winning  the  ba3le.  The  circle  within  which  these  bad  applescan  operate  draws  inexorably  smaller  with  each  a3empt  to  bribe,  suborn  and  otherwise  corruptthe  system,  and  the  people  within  it.  By  way  of  example,  I  was  advised  that  over  the  weekendone  State  Department  person,  10  bankers  and  18  Federal  Reserve  people  were  arrested  anddealt  with.

Fihh  –  By  what  date  will  we  have  Economic  Receipt,  you  ask.  We  will  have  it  when  this  iniNalba3le  phase  comes  to  a  successful  conclusion.  That  will  be  in  the  very  near  future  in  myopinion;  the  current  schedule  based  on  advice  I  received  this  ahernoon  is  that  it  should  all  befinished,  with  funds  in  the  Trustee’s  hands,  by  week’s  end.

•  Accordingly,  on  May  19,  2010  an  agent  of  Interpol  began  a  hand-­‐carry  trip  through  Li3le  Rock,Arkansas,  to  Charleston,  South  Carolina,  and  then  on  to  Richmond,  Virginia;  the  hand-­‐carried  item  waspresented  to  the  Bank  of  America  officer  this  morning.

•  The  Bank  of  America  officer  then  advised  the  Paymaster  authority  that  Mr.  Leon  Pane3a  had  instructedBank  of  America  that  no  World  Global  Se3lement  funds  were  to  be  disbursed  without  express  personalapproval  from  the  President  of  the  United  States.

•  I  became  aware  on  May  27,  2010  that  President  Barack  Obama  had  personally  intervened  in  thescheduled  May  27  release  of  funds,  and  had  instructed  that  the  funds  be  held  unNl  aher  the  U.S.Memorial  Day  Holiday.

•  As  any  further  delay  in  disbursement  of  these  funds  will  engender  considerable  harm  to  many,  and  iswithout  any  legal  basis,  I  wrote  to  President  Obama  pusng  him  on  noNce  and  soliciNng  his  cooperaNon.[A  copy  of  that  le3er  is  a3ached].

•  My  le3er  to  President  Obama  was  distributed  to  all  parNes  dealing  with  the  World  Global  Se3lementfunds,  to  both  poliNcal  parNes  in  Washington,  D.C.,  to  the  DemocraNc  Caucus  and  its  counsel,  to  theBlack  Caucus  and  its  counsel,  and  to  President  Obama’s  priest.

The  le3er  was  also  submi3ed  to  the  BriNsh  Royal  Monarchal  Power  through  your  good  offices;  Mr.  L.H.Bonney,  Sr.  has  also  verified  that  a  copy  of  the  le3er  was  submi3ed  to,  and  received  by,  Her  Majesty,Queen  Elizabeth  II  through  MI-­‐5  and  MI-­‐6.  

•  Counsel  for  the  Black  Caucus  immediately  recognized  that  a  criminal  offense  had  been  commi3ed;  headvised  that  he  would  directly  inform  the  President  by  reading  the  le3er  to  him  on  Air  Force  One  today,as  well  as  advise  the  President  of  his  personal  responsibility,  over  the  four  day  weekend,  for  costs  in  the“Billions  of  USD”.  Said  counsel  also  stated  that  “if  release  [of  the  funds]  was  not  taken  care  of  today  –they  [the  Black  Caucus]  would  wash  their  hands  of  him  [President  Obama]”.

•  Vice  President  Biden  was  also  informed  of  the  May  27,  2010  le3er,  provided  a  copy,  and  discussed  theveracity  of  President  Obama  taking  direcNons  from  former  President  G.H.W.  Bush;  he  indicated  thatPresident  Obama’s  ciNzenship  status  was  being  used  as  very  effecNve  leverage  against  the  President.

•  Vice  President  Biden  also  admi3ed  that  he  was  personally  compromised,  and  therefore  unqualified  tosucceed  President  Obama  in  the  event  that  the  President’s  tenure  is  a3acked.

|•  It  now  appears  that  it  is  only  a  ma3er  of  Nme  before  formal  process  is  insNtuted  to  remove  PresidentObama  from  office;  however  the  “Succession  List”  has  now  been  severely  compromised  by  the  failure  tocomplete  distribuNon  of  the  subject  funds.

•  I  was  advised  at  noon  Nme  this  date  that  the  on-­‐site  Paymaster  authority,  Mr.  L.H.  Bonney,  Sr,  hadconfirmed  at  Bank  of  America  that  no  communicaNon  had  been  received  from  President  Obamaregarding  authorizaNon  for  release  of  the  Se3lement  funds;  accordingly,  he  was  returning  to  Ohio.  

•  Prior  to  Mr.  Bonney’s  departure  he  further  advised  that  all  collected  funds  were  in  a  “locked-­‐down”mode,  and  that  all  else  is  now  in  wri3en  form  for  further  use  in  resolving  the  issue  of  final  distribuNon  of

these  Se3lement  funds.  

[InserNon  by  the  Editor:  However  $1.8  trillion  was  stolen  from  the  funds  as  will  be  reported  in  the  subsequent  analysis].

As  I  have  previously  indicated,  I  am  persuaded  by  these  facts,  that  only  the  direct  intervenNon  of  theRoyal  Monarchal  Power  will  be  efficacious  in  bringing  this  ma3er  to  conclusion.  To  secure  release  ofthese  Se3lement  funds,  it  is  now  imperaNve  that  the  Royal  Monarchal  Power  exercise  that  power,  as  aU.S.  Treasury  lien-­‐holder,  to  effectuate  Nmely  resoluNon.  

Any  further  delay  will  not  only  jeopardize  the  severely  stressed  world  financial  condiNon,  but  willcertainly  serve  to  encourage  those  seeking  even  further  delay.

I  write  to  you  on  a  most  urgent  basis  to  solicit  the  assistance  of  INTERPOL  in  securing  the  release  offunds  now  being  held  in  the  U.S.  for  distribuNon  to  some  20  line  item  trustees/payees  as  defined  by  therecent  BASEL  conferees,  which  distribuNon  has  been  pending  now  since  January,  2010.  

I  write  to  you  as  counsel  for  Michael  C.  Co3rell,  B.A.,  M.S.,  of  Erie,  Pennsylvania,  USA,  and  hiscorporaNons:  Pennsylvania  Investments,  Inc.,  registered  in  the  Commonwealth  of  Pennsylvania,  andCo3rell  SecuriNes  Limited,  registered  in  England  and  Wales,  and  as  counsel  for  some  50,000shareholders  of  CMKM  Diamonds,  Inc.  

As  of  noon  Nme  on  this  date,  I  am  advised  and  understand  the  following:

•  World  Global  Se3lement  funds  have  been  collected  and  remain,  inter  alia,  in  the  custody  of  the  Bankof  America  in  Richmond,  Virginia.

•  Funds  sufficient  to  cover  all  disbursements  to  be  made  by  the  authority  of  the  Paymaster  have  beenconfirmed  this  date  to  remain  in  the  custody  of  Bank  of  America.  

•  The  Paymaster  authority,  Mr.  Lindell  H.  Bonney,  Sr.,  has  spent  more  than  eight  weeks  over  the  past

three  months,  in  Richmond,  for  the  purpose  of  concluding  these  transfers  in  accord  with  the  BASELagenda.

•  Mr.  Bonney  and  his  associates  have  returned  to  Richmond  this  date  for  the  purpose,  again,  ofconcluding  these  transacNons;  they  were  then  advised  by  the  U.S.  Senate  Banking  Commi3ee  Chairmanand  the  U.S.  Senate  Finance  Commi3ee  that  such  transfers  could  not  proceed  as  they  conNnue  to  beblocked  by  Mr.  Leon  Pane3a,  among  others.

•  I  have  previously  wri3en  to  President  Barack  Obama  and  to  Her  Majesty,  Queen  Elizabeth  II;  copies  ofthis  correspondence  are  a3ached  hereto  for  your  informaNon  and  review.  

•  Any  further  delay  in  disbursement  of  these  funds  will  engender  considerable  harm  to  many,  and  iswithout  any  legal  basis.  I  hereby  urge  your  assistance  and  request  intervenNon  by  the  several  plane  loadsof  INTERPOL  agents  who  have  been  sworn  to  assist  in  ferreNng  out  financial  misdeeds,  and  bringing  themiscreants  to  jusNce.  

I  am  persuaded  by  these  facts,  that  the  direct  intervenNon  of  INTERPOL  is  absolutely  required,  from  thisNme  forward,  to  assist  the  Paymaster  authority  in  fulfilling  his  instrucNons  to  finish  these  se3lementpayments,  and  to  finally  bring  this  ma3er  to  conclusion.  Release  of  these  Se3lement  funds,  which  hasnow  been  delayed  for  nearly  six  months,  must  be  made  forthwith.  

It  is  now  imperaNve  that  this  ma3er  be  concluded;  further  delay  is  simply  unacceptable.  Such  delay  notonly  puts  all  of  us  in  jeopardy,  it  encourages  and  emboldens  those  who  seek  to  destroy  not  only  theseSe3lements  but  the  enNre  world  structure.  

I  respecnully  demand  that  INTERPOL  act  consistent  with  the  charter  given  to  them  by  President  Obamain  his  December,  2009  ExecuNve  Order,  and  subsequently  by  the  A3orney  General  of  the  United  States.Circumstances  now  dictate  that  direct  intervenNon  is  a  must.  Thank  you  in  advance  for  your  help,  andyour  willingness  to  support  the  U.S.  ConsNtuNon;  it  is  appreciated  by  many,  and  will  indeed  have  asignificant  impact  on  the  future  financial  health  of  the  world.

AH:  your  Honor,  first  of  all  let  me  concede  the  point  raised  in  your  tentaNve  that  this  is  not  your  usual  Bivens  case.That  is  clear  for  everyone  I  think.  As  a  house  keeping  ma3er  on  page  one  there  is  a  typographical  error,  in  themiddle  paragraph  the  AdministraNve  Law  Judge’s  finding  was  in  2005  not  in  2010.

Judge:  Thank  you.

AH:  Having  said  that,  let  me  refer  you  to  the  second  issue  raised  by  the  government  first.  It  asks  the  quesNonwhether  or  not  there  are  property  rights  at  issue  in  this  case.  And  very  simply  what  we  have  alleged  is  ,  let  me  backup  a  second.  We  have  alleged  a  scheme,  in  effect  a  sNng  operaNon,  judged  from  the  outside  not  from  the  inside.Basically  the  sNng  operaNon  was  an  operaNon  put  into  effect  through  the  Office  of  Homeland  Security,  theDepartment  of  JusNce,  and  the  SEC  Commissioners.  

What  we  have  alleged  is  that  the  SEC  Commissioners  as  opposed  to  the  Agency  itself,  coordinated  with  these  otherinsNtuNons  and  at  their  request  and  in  concert  with  them  began  a  program,  whereby,  this  company  was  raided.

The  SEC  Commission  was  fully  aware,  at  all  Nmes,  of  the  amount  of  naked  shorNng  going  on  in  this  company.  

The  then  Chairman  of  the  commission  has  been  quoted  on  several  occasions  as  saying  this  was  the  most  heavilynaked  shorted  company  in  the  history  of  the  world.  As  we  have  alleged  in  our  complaint  one  day,  which  I  believewas  in  April  2005,  some  more  than  90  billion  shares  of  this  company  were  traded  in  one  day.  I  have  tesNmony  from,which  is  not  alluded  to  in  our  current  complaint,  but  I  can  provide  tesNmony  from  registered  NSASDA  companies,that  were  in  business  at  this  Nme,  who  report  that  they  were  told  “it’s  free  money”.  You  can  sell  as  many  shares  asyou  can  find  buyers  for  and  put  all  of  the  money  in  your  pocket.  You  don’t  ever  have  to  buy  the  share.  

They  were  on  a  no  borrow  list  to  begin  with,  at  that  point  in  Nme,  which  was  in  2005  primarily.  And  if  you  weregoing  to  borrow  shares  as  a  legiNmate  broker  in  that  point  in  Nme,  they  had  a  $2.50  requirement  for  borrowing.You  can  imagine  with  some,  I  think  they  averaged  during  that  Nme  17  billion  shares  a  day  being  sold,  this  is  anenormous  amount  of  money  for  people  to  be  borrowing  shares  to  be  sold  into  the  market.  They  were  being  soldfor  nothing,  that  is  how  they  drove  this  company  into  the  ground.  

They  did  it  because  there  was  evidence  by  the  government,  and  by  others,  associated  both  directly  and  indirectlywith  the  government,  that  this  money  was  being  sent  offshore.  It  was  being  accumulated  by  hedge  funds  offshore,it  was  being  sent  to  Iraq,  it  was  being  sent  to  Iran,  it  was  being  sent  to  Afghanistan,  it  was  being  sent  to  Hezbollah,this  was  one  of  the  means  in  which  these  terrorist  organizaNons  were  uNlizing  them  to  fund  their  operaNons.  

Having  said  that,  I  recognized  when  I  prepared  this  complaint  at  the  Nme  the  company  was  being  de-­‐listed,  and  theNme  this  original  agreement  was  made,  we  did  not  have  a  basis  to  sue  the  SEC,  the  SEC  commissioners,  or  anybodyelse.  Because  in  fact,  as  the  Court  correctly  points  out,  in  regard  to  (quoted  a  case)  it  said  the  shareholders  don’thave  a  right,  they  don’t  have  a  property  interest.  If  they  did  not  have  that  right  at  the  Nme  the  agreement  wasmade,  at  the  Nme  the  original  ultra  _______  criminal  acts  by  these  Commissioners  took  place.  

However,  what  this  complaint  speaks  to  is  at  quite  a  later  date  aher  the  company  was  de-­‐listed  in  October  of  2005,and  they  sNpulated  to  that  delisNng,  Then  we  go  forward  and  what  immediately  happened  was  a  Task  Force,including  one  primary  and  past  board  of  director  members,  Mr.  Bob  Mahue,  who  is  no  longer  with  usunfortunately,  became  the  head  of  that  Task  Force.  His  appointed  duNes,  and  the  Task  Force  appointed  duNes,were  to  have  the  shareholders  pull  copies  of  their  shares,  pull  cerNficates  for  every  share  that  was  legiNmately  thenowned  because  it  had  been  bought  and  paid  for,  and  based  upon  that  share  cerNficate  pull,  then  turn  around  andliquidate  the  company.  

At  the  Nme  the  company  decided  it  was  going  to  liquidate  itself  and  distribute  its  remaining  assets  to  itsshareholders  the  property  rights  a3ached  to  each  of  the  shareholders  because  at  that  point  in  Nme,  this  was  inearly  2006,  they  had  a  right  to  believe  that  what  was  in  their  future  was  a  distribuNon,  a  prorate  per  sharedistribuNon  of  the  assets  that  the  company  then  owned.  The  company  then  owned  all  of  these  monies  that  hadbeen  accumulated  and  put  into  trusts.  The  company  also  owned  shares  of  stock  in  a  company  called  Entourage  andthey  had  other  assets.  They  did  not  have  any  substanNal  liabiliNes.  

So  the  share  holders,  from  that  point  forward,  had  a  property  right  that  is  protectable  under  the  ConsNtuNon.  It  isthat  claim  that  we  are  basing  our  complaint.  Having  said  that,  once  we  get  past  the  property  rights  issue,  I  certainlyunderstand  the  Courts  concern  and  I  have  reviewed  my  complaint,  about,  perhaps  the  use  of  some  in  arnullanguage  when  I  referred  to  the  SEC  rather  than  specifying  that  it  was  the  SEC  commissioners  that  we  are  aimingthis  at.

The  reason  we  are  aiming  only  at  the  SEC  commissioners  is  because  under  the  statutory  scheme  that  was  set  upaher  the  Great  Depression,  the  SEC  commission  and  commissioners  individually  have  the  sole  and  exclusive  right  tomake  the  decisions.  For  example  with  this  firm,  when  this  company  was  de-­‐listed  in  October  of  2005,  it  waspursuant  to  an  AdministraNve  Law  Hearing  that  took  place  here  in  Los  Angeles,  a  full  day  down  in  Federal  Court,that  I  a3ended.  

The  AdministraNve  Law  Judge  then  rendered  a  tentaNve  decision.  It  was  her  decision  but  it  was  tentaNve  in  thesense  that  it  had  no  power  and  had  no  effect.  The  only  Nme  that  it  became  effecNve  was  when  the  companybecame  de-­‐listed  on  October  24th  or  25th  of  that  year  when  the  Commission  met  and  together  agreed  that  thiscompany  should  be  de-­‐listed.  

They  are  the  only  people  who  have  the  power  to  make  these  kinds  of  decisions.  They  are  the  people  who  spoke  tothe  other  governmental  agencies  and  to  the  people  represenNng,  at  least  ostensibly  the  company  at  that  point  inNme,  with  this  agreement  to  uNlize  this  company  without  knowledge  to  the  shareholders  as  part  of  a  sNngoperaNon  to  trap  all  of  these  hedge  fund  people.  That  started  way  back  in  2004.  

But  it  was  those  commissioners  acNng  in  an  improper  and  ___________  and  probably  criminal  way  because  theirmandate  under  the  law  is  to  protect  the  shareholders.  They  were  doing  exactly  the  opposite.  They  were  enteringinto  an  agreement  they  knew  way  going  to  damage  he  shareholders,  it  was  going  to  drive  this  company  out  ofbusiness,  which  it  did,  and  without  noNce  in  a  big  secret.  It  was  only  those  commissioners  who  took  that  acNonthat  we  are  aiming  this  complaint  at.  

We  have  named  the  commissioners  that  have  sat  since  that  Nme  because  it  is  our  posiNon  that  having  denied  thesepeople  payment  these  commissioners  have  signed  on  raNfying  the  acts  of  their  fellow  criminals  or  miscreants,  atleast,  and  at  the  end  of  the  day  refuse  to  release  this  money.  Money  that  has  been  collected.  We  are  not  suing  theSEC,  we  aren’t  suing  the  government.

Judge:  who,  in  your  analysis,  is  the  trustee  of  the  funds?  Who  holds  the  funds?

AH:  There  are  actually  several  trustees  who  hold  the  funds,  one  of  whom  is  currently  the  DTCC.  I  only  say  thatbecause  I  know  the  funds  are  on  deposit  with  the  DTCC.

Judge:  OK  spin  that  out  for  me.

AH:  The  deposit  for  a  trust,  clearing  corporaNon,  they  are  the  clearing  house  for  all  the  financial  transacNonsbasically  that  they  placed  in  __________

Judge:  Privately  or  publicly?

AH:  They  are  a  private  company  but  they  act  a  public  one.

Judge:  As  opposed  to  governmental

AH:  It  is  not  a  governmental  agency  in  the  same  sense  that  the  Federal  Reserve  Banks  are  not  government.

Judge:  What  document  governs  the  terms  under  which  they  hold  those  funds?

AH:  A  trust  agreement.

Judge:  Between?

AH:  Between  the  people  who  provisionally  set  this  up

Judge:  Who  are?

AH:  One  of  whom  was  Bob  Mahue.

Judge:  As  an  employee  of  the  SEC?

AH:  Not  as  an  employee  of  the  SEC  in  any  sense  of  the  word,  he  was  at  one  Nme  on  the  Board  of  Directors  of  thecompany  CMKX  Diamonds.

Judge:  right

AH:  He  never  acted  on  behalf  of  the  SEC.

Judge:  What  control  does  the  sec  have  over  this  trust  fund?

AH:  They  don’t  have  any  direct  control  over  the  trust  fund.  The  agreement,  however,  that  was  originally  enteredinto,  as  I  understand  the  tesNmony  of  my,  what  I  have  been  able  to  accumulate  without  the  opportunity  to  doactual  discovery,  my  understanding  is  that  Bob  Mahue  and  several  of  his  associates  entered  into  a  deal  first  withthe  Department  of  JusNce,  they  got  the  SEC  on  board  through  the  commissioners  by  talking  to  several  of  them.Primarily  Christopher  Cox.

Judge.  Who  is  a  defendant,  a  named  defendant  who  used  to  be  the  Chairman?

AH:  The  essence  of  the  agreement  they  made  was  that  in  order  to  make  this  sNng  effecNve  the  company  would  goand  pump  its  stock,  which  it  did,  the  government  would  assist  in  that  operaNon,  which  it  did

Judge:  How?

AH:  There  is  evidence  that  they  paid  for  some  of  the  expenses  associated  with  a  car,  a  drag  racing  car  that  hadCMKX  painted  on  the  outside  of  it  that  was  being  very  publicly  bandied  about  the  internet  and  raced  in  variousjurisdicNons.  One  of  their  ex-­‐employees  a  gentleman  named  Roger  Glenn,  an  a3orney,  he  used  to  be  an  a3orney  inNew  York  with  the  law  firm  _______________  signed  on  to  increase  the  stock  at  the  request  of  the  SEC,  I  am  told.He  came  on  to  or  into  CMKX  in  2004.  

When  he  arrived  there  the  number  of  authorized  shares  for  the  company  some  where  of  100  or  200  billion,  I  forgetexactly  what,  when  he  leh  some  nine  or  ten  months  later  the  number  of  authorized  shares  had  illegally  andimproperly,  under  every  law  that  I  am  aware  of  at  least,  had  been  raised  to  800  billion  shares.  And  this  companyeventually  sold  some  700  billion  shares  of  stock.  And  there  is  over  that  many  outstanding  ____________,  703

billion  plus.

Judge:  Why  isn’t  your  client  against  the  clearinghouse  acNng  as  trustee  for  these  funds?

AH:  Because  that  would  be  like  suing  the  escrow  company.

Judge:  Yeah  but  the  escrow  company  has  the  funds.

AH:  As  I  started  to  say,  here  is  the  simple  answer,  your  Honor,  as  I  started  to  say  a  few  minutes  ago  and  I  probablydid  not  finish.  The  original  agreement,  there  was  a  war  that  ensued  aher  the  sNng  got  under  operaNon  becausewhat  the  sNng  always  contemplated  was  that  Mr.  Maheu  would  collect  all  of  these  bad  doers,  the  hedge  fundpeople  and  people  like  T.D.  Waterhouse  and  all  the  other  stock  brokerage  houses  around  who  were  naked  shorNngthis  company,  collect  them  all  in  a  big  room  and  offer  them  a  deal  for  two  reasons.  

First  of  all  to  collect  money  for  CMKX  for  what  had  been  done  to  them.  And  second  of  all  to  teach  these  people  alesson  that  there  were  people  out  there  watching  what  was  going  on.  Hopefully  that  would  head  them  off  fromconNnuing  in  such  illicit  and  illegal  and  improper  behavior.  That  was  in  fact  done  and  I  have  a  witness  that  wasthere  when  it  was  done.  

They  had  a  room  about  three  Nmes  the  size  of  your  courtroom  in  which  they  had  representaNve  from  all  of  thesebrokerages  from  all  over  the  world.  They  watched  a  video  presentaNon,  because  Mr.  Mahue,  as  the  court  may  beaware,  was  at  one  Nme  closely  associated  with  the  CIA,  Howard  Hughes  and  all  kinds  of  other  people.

Judge:  I  was  going  to  ask  you  whether  that  was  the  same  Bob  Maheu.

AH:  It  is  indeed  the  same  one,  a  gentleman  I  happened  to  make  acquaintances  with  in  the  70’s  to  my  good  fortune.At  any  rate  all  of  these  people  were  in  this  room  and  were  shown  a  video  and  a  slide  presentaNon  of  all  of  theevidence  of  their  wrongdoing  and  they  were  offered  an  opportunity  to  either  step  up  and  sign  away  your  moneyand  pay  a  reasonable  amount  for  each  transacNon  you  did  illegally  and  improperly  or  go  walk  out  of  here  and  getprosecuted  and  go  to  jail  because  what  you  did  was  criminal.  

Every  single  person  in  that  room  stepped  up  and  made  a  deal.  Aher  that  Nme  there  became  a  big  conflict  betweenthe  SEC  commissioners  and  the  other  governmental  enNNes  who  were  supporNng  the  SEC  commissioners  aboutwho  was  going  to  have  the  right  to  release  this  money  to  the  shareholders  and  when.  My  understanding  is  that  itwent  on  for  some  number  of  months  but  ulNmately  the  SEC  commissioners  prevailed  and  convinced  Mr.  Maheuand  his  associates  that  it  had  to  be  their  decision  because  only  they  and  the  rest  of  the  government  coulddetermine  when  this  Nng  had  fulfilled  its  funcNon.  

That  was  the  basis  on  which  he  gave  them  the  power  to  make  this  decision  about  when  the  money  is  to  bereleased.  It  is  my  understanding  that  every  trust  that  is  currently  being  held  for  release  of  this  money  is  being  heldby  a  person  who  is  sworn  to  observe  that  requirement.  That  the  SEC,  the  US  government  whoever  ____  thispayment,  goes  first.  Since  my  informaNon  is  that  was  the  SEC  commissioners  that  have  this  power,  this  is  why  theyare  the  defendants  in  this  case.

AH:  this  money  was  supposed  to  have  been  released  within  a  year  of  the  Nme  the  company  was  originally  de-­‐listedin  October  of  2005.  This  is  now  almost  October  of  2010,  some  4  years  past  that  Nme.  It  is  taking  only  because  theyrefuse,  not  withstanding  informaNon  they  have  conNnued  to  give  to  ____________,  they  conNnue  to  refuse  torelease  this  money.  If  they  don’t  release  they  money  then  it  is  a  taking.  Because  they  are  prevenNng  what  isrighnully  ours  for  us  to  receive.  That  is  why  it  is  a  taking.

SEC:  Thank  you  your  Honor.  I  have  to  admit  most  of  what  I  just  heard  I  heard  for  the  first  Nme  because  most  of  itwasn’t  in  the  claim.

Judge:  I  found  it  very  educaNonal.

SEC  Indeed.  True  or  not  I  don’t  know  but  we  are  here  to  discuss  what  is  in  the  complaint  today.  We’re  not  here  togive  oral  argument  and  give  tesNmony  to  facts  no  one  has  any  idea  about,  certainly  not  myself.  We  are  here  to  talkabout  what  is  in  the  complaint,  whether  it  was  properly  pled  under  rule  8,  the  ___decision  and  _________.  As  thisCourt  pointed  out  in  its  tentaNve  it  is  not  properly  pled.

Judge:  Yeah  I  am  saNsfied  with  that  in  the  tentaNve.  The  case  would  be  for  the  plainNff  to  dismiss  the  plead  to  re-­‐plead.  I  guess  what  I  am  really  interested  in  is  whether  this  is  an  appearance  claim  given  the  nature  of  the  assetraid  whether  sovereign  immunity  applies.

SEV:  Well  I  suppose  they  can  sue  a  government  official  under  Bivens  for  any  violaNon  of  civil  rights  whether  it  hasto  do  with  money  or  not.  I  don’t  know  any  disNnguishing  facts  in  this  case  that  would  prevent  them  from  beingsued  individually  under  Bivens  if  there  are  sufficient  facts.

Judge:  Well  if  you  concede  in  theory  that  a  ConsNtuNon  violaNon  of  the  taking  clause  could  be  asserted  against  anindividual  an  individual  government  worker.

SEC:  Well  I  haven’t  researched  that  so  I  don’t  know  the  answer  to  that  specifically.  We  asserted  on  our  brief  theoriginal  invest  property  because  pursuant  to  the  complaint  the  SEC  had  the  discreNon  to  release  funds,  if  in  factthere  are  these  funds  in  existence,  that  discreNon  alone,  under  the  case  law  that  we  cited  suggests  that  they  don’thave  the  property  rights.  But  the  answer  to  your  quesNon  is  I  don’t  know.

Judge:  Well  there  are  two  quesNons  I  guess.  One  is  there  a  property  right  and  is  the  conNngent  asset,  if  you  will,subject  to  distribuNon  to  the  plainNffs  at  the  will  of  the  commission.  But  there  is  a  separate  issue  is  whether  thenature  of  the  relief  sought  here  is  such  that  it  can  only  be  asserted  against  the  commissioners  in  their  officialcapacity.

SEC  Well,  I  don’t  think  the  government  has  a  way  of  stopping  the  release  in  official  capacity  or  in  any  way.

Judge:  Well  I  understand  that,  the  issue  is,  is  there  some  manner  which  these  crimes  could  be  asserted  against  the

individual  defendants  in  their  individual  capaciNes  or  is  the  relief  sought  by  definiNon  relief  that  can  only  be  soughtin  their  official  capacity  in  which  case  there  can  be  no  private  claim  they  would  be  enNtled  to  sovereign  immunity  intheir  official  capacity

SEC  That  may  be  the  case,  I  don’t  know  the  answer  to  that.  I  think  the  court  is  inclined  to  be  consistent  with  itstentaNve  as  far  as  the  pleading  requirements.  I  think  the  plainNffs  have  an  opportunity  to  re-­‐plead  to  amend  thecomplaint.  We  will  certainly  deal  with  the  issue  that  the  Court  raised  on  further  briefing,  I  imagine  there  will  be  anaddiNonal  moNon  to  dismiss  in  the  future.  But  that  being  said  clearly  these  are  high  level  government  officials,  theydon’t  deserve  to  be  sued  and  discovery  taken  of  them.  I  am  not  specific,  obligaNons  have  been  made  by  some  andnone  have  been  made  to  a  distant  point.  

I  hear  some  issues  were  addressed  during  oral  argument  that  I  didn’t  see  in  the  complaint,  even  assuming  thoseare  true  there  is  nothing  specific  to  these  SEC  commissioners  other  than  the  fact  that  they  some  how  have  the  solediscreNon  to  make  every  single  decision  at  the  SEC.  I  don’t  buy  that.

Judge:  Mr.  S-­‐-­‐-­‐-­‐  it  might  be  easier  to  assess  whether  claims  can  be  asserted  against  the  commissioners  asindividuals  if  we  have  a  complaint  that  complies  with  __________.

SEC  That  may  be  true,  yes.  If  it’s  in  a  fact  complied  and  fisng  the  requirements  of  _________  and  it  can  passqualified  immunity  which  also  remains  in  the  court  obviously  doesn’t  need  to  address  right  now.  But  if  and  whenthe  Court  decides  it’s  been  properly  pled  then  I  think  qualified  immunity  should  be  addressed.

Judge:  Well  what  I  am  going  to  do  is  dismiss  with  ________  to  re-­‐plead  for  failure  to  meet  the  Rule  8  requirements.Again  not  to  dismiss  the  claims  against  them  in  their  official  capacity  as  a  ma3er  of  sovereign  immunity  and  leavethe  other  issues  unNl  we  have  pleading  that  passes  muster.

17.  Hodges  and  Associates  Update  (08-­‐15-­‐2010):

1.  How  Much  Money  –  As  I  have  said  before,  we  have  persuasive  evidence  to  all  of  the  factsalleged  as  such  in  the  complaint;  accordingly,  there  is  a  total  of  3.87  Trillion  Dollars.

2.  When  is  Release  –  The  CMKX  distribuNon  funds  will  be  released  within  a  very  short  Nme  aherthere  is  confirmaNon  of  Economic  Receipt.  What  does  that  mean?  It  means  that  currently  inprocess  is  a  massive  shih  of  wealth  within  the  US  and  the  world  community;  that  includes:  pay-­‐out  of  all  the  domesNc  se3lements;  insNtuNon  of  the  US  dollar  re-­‐funding  project;  pay-­‐out  ofworld  se3lements;  and,  distribuNon  of  funds  to  many  other  programs.  This  involves  a  total  ofmore  than  $  42  Trillion.  Economic  Receipt  occurs  when  all  trustees  have  access  to  all  of  thefunds  they  are  responsible  for.

3.  Our  Status  –  As  I  advised  in  April,  we  are  literally  on  the  thresh-­‐hold.  This  means  that  the“work”  remaining  to  be  finished  will  not  consume  more  hours  than  can  be  accomplished  withinone  day.  We  have  been  at  this  point  now  for  more  than  three  months  [!].  

4.  The  Delay  –  Although  I  could  write  a  book  about  what’s  been  going  on  behind  the  scenes[and  may  one  day]  to  cause  this  addiNonal  delay,  I’ll  try  to  give  you  the  condensed  version:  

First  -­‐  Please  be  aware  and  understand  that  there  is  an  economic  war  raging  in  the  background;this  war  is  between  those  who  have  controlled  this  planet  for  the  last  hundred  and  fihy  years,and  we  who  think  that  it  must  stop.  

Second  -­‐  The  naked  corrupNon  that  is  endemic  in  D.C.  is  more  than  most  can  comprehend;  it  isclear  that  these  miscreants  have  no  regard  for  the  US  ConsNtuNon,  Federal  Laws  andRegulaNons,  nor  even  any  sense  of  simple  morality.  They  are  convinced  that  they  are  above  anyconstraint  that  might  apply  to  lesser  mortals,  and  that  no  enforcement  acNvity  will  eversuccessfully  address  them.  I  hasten  to  add  that  such  opinions  are  not  universal;  having  said  that,it  is  more  widespread  than  not.  I  can  add  that  some  large  number  of  bankers  and  others  havenow  been  arrested  and/or  indicted;  this,  in  combinaNon  with  substanNal  repatriaNon  of  “stolen”moneys,  is  having  a  significant  impact  on  the  balance  of  power  shihing  in  our  favor.

Third  -­‐  These  miscreants  are,  in  effect,  fighNng  for  their  lives  –  at  least  that  part  of  their  livesthat  establishes  an  environment  in  which  they  can  conNnue  to  lie,  cheat,  steal,  and  mortgageyour  progeny’s  lives,  all  for  their  personal  gain.  Accordingly,  they  will  fight  unNl  the  doors  are  allclosed  by  a  power  that  they  cannot  subvert.  That  fight  conNnues  as  I  prepare  this  interimupdate.

Fourth  -­‐  The  good  news  is,  we  are  winning  the  ba3le.  The  circle  within  which  these  bad  applescan  operate  draws  inexorably  smaller  with  each  a3empt  to  bribe,  suborn  and  otherwise  corruptthe  system,  and  the  people  within  it.  

Fihh  –  By  what  date  will  we  have  Economic  Receipt,  you  ask.  We  will  have  it  when  this  iniNalba3le  phase  comes  to  a  successful  conclusion.  I  sNll  believe  that  will  be  in  the  near  future;  themost  recent  schedule,  based  on  communicaNon  I  received,  was  that  it  should  have  beenfinished  by  August  13;  somehow  at  the  very  last  moment,  the  bank  was  not  available  [?]  toconclude  the  necessary  transfers.  This  newest  problem,  I’m  told,  is  being  dealt  with  thisweekend.
