June 8th, 2015 Honorable Mayor and City Council: Subject: Consent Agenda — Consider Demolition of Structure for Habitat for Humanity at 605 Castle Street. Terri Shultz, Executive Director of the Rutherford County Habitat for Humanity requests that the City demolish a sub-standard structure on property Habitat acquired in 2015 for property located at 605 Castle Street. Background: In the past, City Council has approved such demolitions to be performed by the Murfreesboro Street Department as a contribution to this worthy non-profit. Asbestos inspection and abatement was completed by AAT Environmental Inc. A summary letter of inspection and abatement is attached and the complete report is available upon request. Fiscal Impact: If approved, the Murfreesboro Street Department will do the work and the demolition material will be disposed at the landfill. Rutherford County waives the tipping fee for disposal. Recommendation: Staff recommends City Council’s approval of this request from Terri Shultz, Executive Director of the Rutherford County Habitat for Humanity, that the City demolish a sub-standard structure on property Habitat owns at 605 Castle Street. 1.0 Executive Summary Background on Asbestos Sampling On April 22, 2015, AAT Environmental Incorporated performed an A.S.H.E.R.A Asbestos Inspection of the building located at 605 Castle Street, Murfreesboro, Tennessee. The asbestos inspection was carried out at the request of Mr. Roy Saylor, Building Director for Habitat for Humanity. The Asbestos Inspection and Bulk Sampling were carried out in accordance with the requirements of Asbestos Containing Material in Buildings AHERA Regulations. All assessable areas of the building were inspected for suspect asbestos containing materials. Asbestos Hazard Emergency Response Act (A.H.E.R.A.) was created by the United States Environmental Protection Agency, EPA in 1986 for public and private schools to identify and manage asbestos building materials hazards in K through 12 schools operating in the United States. The purpose was to identify and manage the materials and development management plans to monitor and deal with these hazards either in place or by abatement.
The scope of the asbestos inspection was to consider and report on: a. The type, condition and extent of suspect asbestos containing building materials (SACBMs) in and outside the building in all reasonably accessible areas. b. Provide recommendations to ensure that areas of concern are made safe and that all suspect ACBMs are managed safely. During the inspection (39) suspect asbestos bulk samples were obtained of three (3) layers or backings were analyzed on unhomogenous materials, of these none 0) of the samples were found to be asbestos containing. The main body of the building was surveyed only;
a. All accessible ground floor, exterior, and roofing areas.

The following contains the results and recommendations of this survey.
2.0 Specific Exclusions Relating to the Inspection No inspection was carried out of interior flues, chutes, ducts, voids and any similar enclosed areas, the access to which would necessitate the use of specialized equipment or power tools, or which would have caused damage to decoration, fixtures, fittings or the structure of the building. We are therefore unable to report on the presence of asbestos in these areas, and accept no responsibility for the presence of asbestos in these areas. No inspection of live electrical or mechanical plant or similar requiring the attendance of a specialist engineer or maintenance worker was carried out. No inspection of any area requiring special equipment other than stepladders was carried out. No report has been made on any concealed spaces which may exist within the interior of the building where the extent and presence of these is not evident due to inaccessibility or insufficient knowledge of the structure of the building at the time of the survey.
3.0 Methodology The following methodology was utilized for the collection and analysis of the Asbestos Bulk samples. Each bulk sample was identified on a sample diagram with the corresponding identification sample number marked on the sample container. Samples have been taken from all materials which, upon initial visual inspection, appeared to contain asbestos with the exception of some items of mastic, resin or rubber, which contain asbestos where the quantity of those materials and the content of asbestos within the material is insignificant in terms of risk to health and safety. The bulk samples were analyzed utilizing Polarized Light Microscopy (PLM) with dispersion staining, per the EPA "Interim Method for the Determination of Asbestos in Bulk Insulation Samples, EPA 600/M4-82-020."
4.0 Observations and Recommendations The following observations were documented during the recent Asbestos Inspection: Building materials sampled found to be asbestos containing:
No Asbestos Materials were found to contain Asbestos greater than regulated amounts.
In the future if any asbestos material are identified a Tennessee licensed asbestos-abatement contractors should be utilized to perform the asbestos abatement. State of Tennessee Regulates all Disciplines of the Asbestos Industry, Asbestos Inspectors, Designers, and Project Monitors, Supervisor and Workers, are required to be licensed to these perform services. Notification to State and Local authorities is required prior to demolition and abatement.

7.0 Conclusions In event that any asbestos-containing materials should be discovered in the future (i.e. in a wall cavity), it should not be disturbed by drilling, sanding, chipping, grinding, or other breakage caused by physical or mechanical contact. Asbestos-containing material found in the future that is not abated should be managed by an Operations and Maintenance Program (O&M). An O&M Program consists of the following: -Notification plan -Respiratory protection program -Periodic surveillance program -Record keeping program -Medical surveillance program -Worker permit system -Employee training -Worker protection -Air Monitoring
8.0 Asbestos Abatement Cost Estimates The following prices are based on regional cost estimates, actual costs associated with this project will based on bids submitted for the asbestos abatement.

ORDINANCE 15-O-35 adopting a budget and appropriations ordinance providing for appropriations out of the general and special funds of the City of Murfreesboro, Tennessee, of certain sums to defray the current, necessary and special expenses of said City for the Fiscal Year 2015-2016, and for other purposes.
WHEREAS, the Municipal Budget Law of 1982, T.C.A. §6-56-201 et. seq., requires
adoption of an annual budget ordinance and balanced financial plans for
intragovernmental service funds; and,
WHEREAS, information on the anticipated revenues of the City and the estimated
expenditures for the last preceding fiscal year, the current fiscal year and the coming fiscal
year must be included in the annual budget ordinance; and,
WHEREAS, state law requires that the proposed annual operating budget be
published and a public hearing be held before final adoption of the budget ordinance; and,
WHEREAS, the City Charter also requires publication of a tentative budget and
public hearing prior to passage of an appropriation ordinance; and,
WHEREAS, the City Manager has, pursuant to the City Charter, submitted to the
City Council a budget covering in line item detail, by department and fund, estimates of the
expenditures and revenues of the City, which budget shall be revised as necessary to
support and be consistent with this budget and appropriations ordinance and other actions
of the City Council; and,
WHEREAS, the Council has carefully considered the budget as recommended by
the City Manager and previously discussed by the City Council, and comments made at
the public hearing held on June 4, 2015 and is prepared to adopt its financial plan for
Fiscal Year 2015-2016.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MURFREESBORO, TENNESSEE, AS FOLLOWS: SECTION 1. The amounts hereinafter listed are the estimated revenues and the
budgeted expenditures of the City of Murfreesboro, Tennessee, and the amounts specified
are hereby appropriated for the purpose of meeting the expenses of the various
departments, agencies, and programs of the City of Murfreesboro, Tennessee for the
fiscal year beginning July 1, 2015 and ending June 30, 2016, including the payment of
principal of and interest on bonds and other obligations of the City maturing in 2015-2016,
for the City’s General Fund and its special and intergovernmental service funds, to wit:

SECTION 2. The Personnel Costs authorized for expenditure in Section 1 are
based on the current, previously adopted, compensation and classification plan of the City
and the staffing levels hereinafter listed:

SECTION 3. All capital expenditures for which appropriations have been
previously made but not yet fully expended are hereby reauthorized to allow completion of
previously approved projects.
SECTION 4. All unassigned and unencumbered fund balances are hereby
reappropriated to their respective funds.
SECTION 5. That all payments made before the effective date of this Ordinance,
on account of and in pursuance of the appropriations hereinbefore made and provided by
this Ordinance in meeting the expenses and obligations of the City for the Fiscal Year
2015-2016, shall be charged against and be deducted from the respective sums
appropriated hereinbefore for the respective departments and accounts of the City's
government and for the payment of the principal of and interest on obligations of the City
to be paid during the Fiscal Year 2015-2016, the intention of this Ordinance in part being
to authorize and provide for the payment of the expenses and obligations of the City for
that part of the Fiscal Year 2015-2016 that may have already transpired at the taking effect
date of this Ordinance as well as for the entire Fiscal Year 2015-2016.
SECTION 6. That any appropriation made by this Ordinance, except
appropriations to meet the principal of and interest on bonds and other obligations to be
paid in the Fiscal Year 2015-2016 as hereinbefore provided for, shall be subject to
reduction, or to the transfer from one appropriation or fund to another, at any time by a
resolution of the City Council as to the unexpended portion of such appropriation or funds.
SECTION 7. That this Ordinance take effect immediately upon and after its
passage upon third and final reading, as an emergency Ordinance, an emergency
existing, and it being imperative to provide for the necessary expenses, general and
special, of said City of Murfreesboro for the Fiscal Year 2015-2016 at the earliest
practicable time, the welfare of the City requiring it.

ORDINANCE 15-O-36 providing for the levy and collection of a tax for the year 2015 upon all property, real, personal and mixed, within and subject to the jurisdiction of the City of Murfreesboro that is now taxable under the laws and Constitution of the State of Tennessee and the Charter of said City, and for the interest, penalties and costs to be added to such taxes after certain dates.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MURFREESBORO, TENNESSEE, AS FOLLOWS: SECTION 1.
(a) That the City Council having received from the City Manager the statement of
the valuation and assessment of taxable property within the City of Murfreesboro for the
year 2015, and the estimates of revenues to be received by the City of Murfreesboro for
the year 2015, pursuant to Section 83 of the Charter of said City, there be and is hereby
levied upon and assessed against every species of property, real, personal and mixed,
within the corporate limits and subject to the jurisdiction of the City of Murfreesboro that is
taxable by said City of Murfreesboro under the laws and Constitution of the State of
Tennessee (including the Charter of the City of Murfreesboro), for the year 2015, the sum
of One and 20.066/100 Dollars ($1.2066) on every hundred dollars worth of said property.
(b) The individual ad valorem property tax amounts shall be rounded to the nearest
dollar. Such rounding shall be applied uniformly to all property tax bills in the City for real
and personal property, and shall be accomplished by rounding amounts ending in $0.01 to
$0.49 down to the nearest dollar and amounts ending in $0.50 to $0.99 up to the nearest
dollar. Such rounding shall also apply to any interest or penalty added to delinquent taxes.
SECTION 2. That all such taxes shall be collected in the manner provided by the
Charter and Ordinances of the City of Murfreesboro and the laws of the State of
Tennessee not in conflict therewith.
SECTION 3.
(a) That all such taxes shall be and become past due and delinquent on and after
January 1, 2016, and interest at the rate of one percent (1%) per month and penalties in
the amount of one-half of one percent (½ of 1%) per month shall be applied and added to
the amount of such taxes on and after January 1, 2016. Both such interest and penalties
shall be added to the amount of the said taxes, and shall be paid by the taxpayer.
(b) All taxes remaining unpaid and delinquent on January 1, 2017, shall be promptly
certified to the City Back Tax Attorney for collection as provided by the Charter of the City
of Murfreesboro, unless such certification shall be delayed by resolution of the City Council
for a period or periods of time beyond said date of January 1, 2017; and the costs fixed by
the law of the State for collection of delinquent State or County taxes, exclusive of City
Back Tax Attorney's commission, shall be applied and added to the amount of such taxes,
to be paid by the taxpayer on and after January 1, 2017, or on and after such period or
periods of time to which said certification of such taxes to the City Back Tax Attorney may
be delayed or deferred by such resolution of the City Council.
SECTION 4. That this Ordinances take effect from and after its passage upon
third and final reading as an emergency Ordinance, an emergency existing, and it

being necessary that this Ordinance take effect at the earliest possible moment in
order to allow taxpayers to pay their taxes at the earliest possible time, and in order to
make available the revenues to be derived from the taxes herein levied to meet current
expenditures of the City, the public welfare and the welfare of the City requiring it.

ORDINANCE 15-O-37 amending the 2014-2015 Budget.
WHEREAS, the City Council adopted the 2014-2015 Budget by motion; and,
WHEREAS, the City Council adopted an appropriations ordinance, Ordinance 14-
O-33, on June 26, 2014 to implement the 2014-2015 Budget; and,
WHEREAS, it is now desirable and appropriate to adjust and modify the 2014-
2015 Budget by this Ordinance to incorporate expenditure decisions made during the
2014-2015 fiscal year.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MURFREESBORO, TENNESSEE, AS FOLLOWS:
SECTION 1. The 2014-2015 Budget adopted by the City Council is hereby
revised and amended as shown on Exhibit A, attached hereto.
SECTION 2. That this Ordinance take effect immediately upon and after its
passage upon third and final reading, as an emergency Ordinance, an emergency
existing, and it being imperative to provide for the necessary expenses, general and
special, of said City of Murfreesboro for the Fiscal Year 2014-2015 at the earliest
practicable time, the welfare of the City requiring it.

Regular Agenda June 4, 2015 Honorable Mayor and Members of City Council Re: Planning Commission Recommendations Background During its regular meeting on June 3, 2015 the Planning Commission conducted public hearings on the matters listed below. After the public hearings, the Planning Commission discussed the matters and then took action to recommend their approval.
a. Rezoning application [2015-412] for approximately 0.46 acres located along the east side of South Highland Avenue to be rezoned from RD to RS-4, Rutherford County Habitat for Humanity applicant.
b. Rezoning application [2015-413] for approximately 6.17 acres located at the southwest corner of Medical Center Parkway and Robert Rose Drive to be rezoned from MU to CH, Mr. Tommy Smith applicant.
c. Rezoning application [2015-414] for approximately 21.6 acres located along
Joe B Jackson Parkway to be rezoned from L-I to H-I, Mr. John Harney on behalf of Elam Road Partnership applicant.
Recommendation It is recommended that the City Council schedule the matters for public hearings. Concurrences The Murfreesboro Planning Commission has studied and conducted public hearings on each of these matters and recommends their approval. Fiscal Impact Staff is not aware of any fiscal impact that will result directly from this recommendation.
