THIRD AMENDED COMPLAINT, AMENDING COUNT XIV ONLY, AND JURY DEMAND

Plaintiff sues defendants and avers:

ALLEGATIONS APPLICABLE TO ALL COUNTS

1. This is· an action for damages in excess of Two Thousand Five Hundred

($2,500.00) Dollars.

2. The plaintiff is the duly-appointed Personal Representative of the Estate

of Ryan Pitzer, a deceased minor child. Plaintiff brings this action for the

benefit of the Estate, for his own benefit as the natural father of Ryan Pitzer

and for the benefit of his wife, Susan Pitzer, the natural mother of Ryan Pitzer.

As Ryan 1s parents, Donald and Susan Pitzer are 11survivors 11 as the same are

defined in §768.18 (Fla. Statute 1978). Plaintiff seeks to recover all the damages

to which the Estate and the survivors are entitled under the Florida Wrongful

Death Act (§768.16 et seq., Fla. Stats. (1978)).

3. Defendant, THE NEW AMERICAN LIBRARY, INC., d/b/a SIGNET BOOKS

(hereinafter referred to as 11S I GN ET 11) is a corporation operating, conducting

engaging in or carrying on a continuing business or business venture in the

State of Florida consisting of, inter alia, the publication and distribution for sale

of paperback books, and in particular, a paperback book known as II Let 1s Have

Healthy Children 11 by ADELLE DAVIS, identified as Signet Book No. E5346. A

copy· of the front and back cover of said book is attached hereto as Exhibit A.

4. The defendant, SIGN ET, has committed a tortious act in the State of

Florida as is more fully set forth in the following paragraphs, and/or in the alter-

native, has caused injury to the plaintiff within the State of Florida, which injury

arose out of an act or omission by the defendant, SIGN ET, outside of the State of

Florida, consisting of the manufacture, production, publication, editing, inspect­

ing, distribution and/or sale of the aforementioned paperback book, which was

purchased and used within the State of Florida by the plaintiff in the ordinary

course of commerce, trade or use and the use of said book by the plaintiff resulted

in the death of Ryan Pitzer, as is more fully set forth hereinafter.

5. ADELLE DAVIS, the author of the book described in paragraph 3 above,

died of cancer on May 31, 1974, while residing in the State of California. The .,

defendant, Paul Smith, Executor of the Estate of ADELLE DAVIS, a/k/a ADELLE

SI EGLI NGER is the legal successor in interest to the deceased, ADELLE DAVIS, is

legally responsible to respond in damages for ADELLE DAVIS 1 negligence, and is a

proper party defendant to this action.

6. The ADELLE DAVIS book referred to in paragraph 3 has caused injury

to the plaintiff within the State of Florida, and said injury arose out of, wholly

or in part, the authorship of the aforementioned book, which authorship occurred

outside of the S~ate. of Florida. At the time of the injury to the plaintiff, the

book was used or consumed within the State of Florida in the ordinary course of

commerce, trade or use and the use or consumption of the book resulted in the

injury complained of in this lawsuit, as is more fully set forth hereinafter.

7. At all times material, the Estate of ADELLE DAVIS SI EGLI NGER has

been earning royalties from the sale of the book 11Let 1s Have Healthy Children 11 in

the State of Florida, and such activities constitute operating, conducting, engaging

in or carrying on a business or business venture in the State of Florida within

the meaning of the Florida longarm statute.

8. Defendant, HARCOURT, BRACE, & WORLD, I NC. (hereinafter referred

to as II HARCOU RT 11), is a foreign corporation operating, conducting, engaging in

or carrying on a continuing business or business venture in the State of Florida

consisting of, inter alia, the publication, distribution and/or sale of books, and

in particular, the book known as II Let 1s Have Healthy Children" by ADELLE

DAV IS. This defendant had, at all times relevant herein, the ultimate editorial

responsibility for, and control over the contents of the hardcover edition of this

book, and the paperback edition, as well, which was published, distributed,

and/or sold in Florida by defendant, SIGNET.

9. Defendant, HARCOURT, has committed a tortious act in the State of

Florida as is more fully set forth herein, and/or in the alternative, has caused

injury to the plaintiff within the State of Florida, which injury arose out of an

act or omission by this defendant outside of the State of Florida, consisting of

the manufacture, production, publication, distribution, sale, editing and/or inspect­

ing of both the hard and soft cover editions of the aforementioned book, which

book was purchased and used within the State of Florida by the plaintiff in the

ordinary course of commerce, trade or use and the use of said book by plaintiff

resulted in the injuries complained of herein as more fully set forth hereinafter . .,

10. Defendant, HARCOURT, was at all times relevant to this action, and

still is the principal, warrantor, and indemnitor, and in effect, insurer, of its

agent or designee SIGN ET by the terms of their agreement dated January 19,

1976. The acts of SIGN ET in the printing, publishing and selling of the softcover

reprint edition of II Let 1s Have Healthy Children 11 were done within the actual or

apparent authority granted to SIGNET by HARCOURT. Under the terms of said

agreement, SIGN ET was under a contractual obligation to faithfully reprint the

text of the book. A. copy of the contract between defendants SIGNET and HAR­

COURT, reserving editorial control over the book to HARCOURT, is appended

hereto as Exhibit B.

11. The duty of HARCOURT, BRACE & WORLD, INC., to the public, con-

sumers, and the plaintiff was a non-delegable duty.

12. Defendant, MAKERS OF KAL, INC. is a corporation operating, conduct­

ing, engaging in or carrying on a continuing business or business venture in the

State of Florida consisting of the manufacturing, testing, processing, formulation,

packing, labeling, promoting, selling and distributing in tablet form of a product

known as potassium chloride.

13. Defendant, MAKERS OF KAL, INC., has committed a tortious act in the

State of Florida as is more fully set forth in the following paragraphs, and/or in

the alternative caused injury to plaintiff within the State of Florida, which injury

arose out of an act or omission by the defendant outside of the State of Florida,

which act or omission consisted of the manufacturing, processing, packaging,

labeling, promoting, selling and distributing in interstate commerce and in Florida

the product in tablet form denominated as potassium chloride, which product was

used and consumed within Florida by the plaintiff in the ordinary course of com-

merce, trade or use, and the use by the plaintiff resulted in the injuries com­

plained of herein as more fully set forth hereinafter.

14. Approximately nine months prior to April 1, 1978, Susan Pitzer, the

wife of the plaintiff herein and the mother of the deceased child, Ryan Pitzer,

purchased from a retail book seller in the State of Florida a copy of the book

described in paragraph 3 above. On or about April 1, 1978, Susan Pitzer con­

sulted the aforementioned book in order to receive guidance from said book in the

care and treatment of her infant son who was at that time suffering from colic.

On or about April 1, 1978, Susan Pitzer, while following the advice contained on .,

pages 241 through 243 of the aforementioned book, did administer to her son,

Ryan, the recommended dosages of potassium chloride set forth in the first full

paragraph contained on page 242 and as a proximate and direct result thereof,

her infant son, Ryan, did ingest a lethal dosage of potassium chloride and did die

on April 4, 1978 of potassium intoxicati0n.

15. The potassium chloride administered to plaintiff 1s decedent was manufac-

tured, tested, processed, formulated, promoted, compounded, packaged, labeled,

distributed and S(?ld by defendant MAKERS OF KAL, INC.

16. At all times material hereto, DONALD PITZER and his wife, Susan

Pitzer, were residents of and domiciled in Broward County, Florida, and further,

their minor child, Ryan, was born and lived his entire life in Broward County,

Florida, and the venue of the Estate of Ryan Pitzer is Broward County, Florida

17. As a proximate result of the defendants 1 wrongful acts, and the result-

ing death of Ryan Pitzer, the following damages have been incurred:

A. Mental pain and suffering of DONALD PITZER.

B. Mental pain and suffering of Susan Pitzer.

C. Medical and funeral expenses due to decedent 1s injury and death.

D. Al I other recoverable damages under law, including, but not

limited to those specified in Fla. Stat. §768.21.

COUNT I

NEGLIGENCE v. DEFENDANT DAVIS

18. ADELLE DAVIS did carelessly and negligently include in the book

referred to in paragraph 3 above a chapter entitled 11Abnormalities During Early

Babyhood 11, which chapter contained a discussion of the cause and treatment of

colic, said discussion being set forth on pages 241, 242 and· 243 of said book.

Included in the discussion on colic is a reference to a 11study of 653 sick babies 11

and included in the discussion is the following sentence, 11These doctors found

that most babies needed 3,000 miligrams of potassium chloride, (2/3 teaspoon),

before colic was corrected. 11

19. The author, ADELLE DAVIS, was further negligent or careless in some

or all of, but not limited to, the following respects:

A. She failed to independently verify the existence of the 11study 11

referred to.

B. She failed to independently verify the effectiveness and/or safety

of the advice contalned in the paragraph of her book referred to above.

C. She failed to warn readers of the aforementioned paragraph in her

book that some babies might have a sensitivity to potassium chloride which, when

given the dosages referred to in the aforementioned paragraph of her book, could

lead to potassium intoxication and resultant death.

D. She did negligently and carelessly invent from her own imagination

the 11study of 653 sick babies 11 and did further carelessly and/or negligently

invent from her own imagination the findings and suggestions of the imaginery

physicians referr~d to in the above-referenced paragraph of her book.

E. She represented to the public at large and to the plainti"ff in

particular that the book was comprised of true statements of fact that could be

relied upon, and in fact were relied upon by plaintiff, when instead the book

contained false statements of fact that were known or should have been known to

have been false in the exercise of reasonable care.

20. As a direct and proximate result of the negligence referred to above,

the minor child, Ryan Pitzer, ingested a lethal dose of potassium chloride on or

about April 1, 1978, resulting in his death on April 4, 1978, and the damages

previously described were incurred.

WHEREFORE, the plaintiff demands judgment against defendant, DAVIS, for

damages, plus costs and interest.

COUNT 11

INTENTIONAL TORT v. DEFENDANT DAVIS

21. The plaintiff, DONALD PITZER, as Personal Representative of the

Estate of Ryan Pitzer, incorporates herein by reference paragraphs 18-19.

22. The acts of this defendant as aforesaid were so grossly negligent,

and/or recklessly indifferent, willful and wanton, and/or malicious as to justify

the imposition of punitive damages.

23. As a direct and proximate result of the wrongful acts referred to above,

the minor child, Ryan Pitzer, ingested a lethal dose of potassium chloride on or

about April 1, 1978, resulting in his death on April 4, 1978, and the damages

previously described were incurred.

WHEREFORE, the plaintiff demands judgment against defendant, DAVIS, for

compensatory and punitive damages, plus costs and interest.

COUNT Ill

NEGLIGENCE v. DEFENDANT SIGNET

24. Defendant, SIGN ET, at all times material hereto, did carelessly and

negligently publish, edit, inspect, test, produce and/or distribute the book

referred to in paragraph 3 above. The negligence and carelessness of defendant,

SIGNET, included, but is not limited to, the following:

A. Failing to independently verify the effectiveness and safety of the

dosages of potassium chloride referred to on page 242 of the book.

B. Failing to independently verify the existence of the "study of 653

sick babies" and further, to independently verify the accuracy of the citation to

the alleged "study. 11

C. Failing to warn readers of the book, and in particular readers of

page 242, that some babies might have a sensitivity to the recommended dosages

of potassium chloride, which sensitivity could lead to potassium intoxication and

resultant death.

D. SIGN ET, knew or should have known that the book referred to in

paragraph 3 above contained inaccuracies, false citations of authority, misleading

statements of fact and opinion, and many items of medical and nutritional advice

which, if followed by a reader, would result in human harm, injury and suffering,

and in some cases, death.

E. SIGNET represented to the public at large and to the plaintiff in

particular that the book was comprised of true statements of fact that could be

relied upon, and in fact were relied upon by plaintiff, when instead the book

contained false statements of fact that were known or should have been known to

have been false in the exercise of reasonable care.

F. Wrongly advertised the contents of the book referred to in para-

graph 3 above as 11completely revised and updated. 11

G. Did on the back cover of the aforementioned book wrongly attribute

to ADELLE DAVIS "unsurpassed knowledge, long, personal experience and superb

common sense. 11

H. ·wrongly characterized the contents of the book as "wonderfully

thorough and practical information about the kinds of nutrients both mother and

child need. 11

I. Wrongly stated on the back cover of said book that the book

contained "methods that really work in dealing with so-called feeding problems. 11

J. Failed, through its gross indifference to the rights of others, to

include any warnings on or in the book as to the potential danger to readers of

the advice contained therein or at the very least, the need to independently

verify the advice, remedies and suggestions contained therein, notwithstanding .,

defendant, SIGNET'S, actual knowledge of the vast amount of criticism in the

medical field of ADELLE DAVIS' writings.

25. As a direct and proximate result of the negligence of this defendant,

the minor child, Ryan Pitzer, ingested a lethal dose of potassium chloride on or

about April 1, 1978, resulting in his death on April 4, 1978, and the damages

previously described were incurred.

WHEREFORE, the plaintiff demands judgment against defendant, SIGNET,

plus costs and in~ere~t.

COUNT IV

INTENTIONAL TORT v. DEFENDANT SIGNET

26. The plaintiff, DONALD PITZER, as Personal Representative of the

Estate of Ryan Pitzer, incorporates herein by reference paragraph 24.

27. The acts of this defendant as aforesaid were accomplished recklessly,

willfully, wantonly, maliciously, outrageously, fraudulently and/or grossly negli­

gently, so as to justify the imposition of punitive damages.

28. As a direct and proximate result of the wrongful acts of the defendant,

SIGNET, the minor child, Ryan Pitzer, ingested a lethal dose of potassium chloride

on or about April 1, 1978, resulting in his death on April 4, 1978, and the dam­

ages previously described were incurred.

WHEREFORE, the plaintiff demands judgment against defendant, SIGNET, for

compensatory and punitive damages, plus costs and interest.

COUNT V

STRICT LIABILITY v. SIGNET

29. Plaintiff, DONALD PITZER, as Personal Representative of the Estate of

Ryan Pitzer, incorporates herein by reference paragraph 24.

30. The book referred to in paragraph 3 above was produced, designed,

inspected, tested, edited, published and/or distributed in such a manner by

defendant, SIGN ET, as to make it unreasonably dangerous and otherwise defective.

31. As a direct and proximate result of the wrongful acts of the defendant,

SIGN ET, the minor child, Ryan Pitzer, ingested a lethal dose of potassium chloride

on or about April 1, 1978 resulting in his death on April 4, 1978, and the damages

previously described were incurred.

WHEREFORE, plaintiff demands judgment against defendant, SIGNET, for all

damages, plus costs and interest . .,

COUNT VI

EXPRESS WARRANTY v. SIGNET

32. The plaintiff, DONALD PITZER, as Personal Representative of the

Estate of Ryan Pitzer, incorporates herein by reference paragraphs 24 and 30.

33. The defendant, SIGN ET, expressly warranted the contents of the book

referred to in paragraph 3 above by stating, inter alia, on the cover thereof that

the book was "completely revised and updated" and further, stated on the back

cover of the afor:-eme_ntioned book that from the moment of conception, a child's

"future health and happiness depend on proper nutrition" and that the book

contained 11wonderfully thorough and practical information about the kinds of

nutrients both mother and child need, and methods that really work in dealing

with so-called feeding problems" and further, that the book can "make an all­

important difference in the healthy development of a young life--must reading for

every concerned and informed parent. 11

34. The exact nature and appearance of the above-referenced express

warranties are set forth on the attached copies of the front and back cover of the

book.

35. Notwithstanding the above-referenced express warranties, the said book

was not safe and effective as represented and, in fact, said book contained lethal

advice as to the treatment of colic on pages 241 through 253 of the aforementioned

book, and SIGNET thereby breached its warranties.

36. As a direct and proximate result of the breach of the aforementioned

express warranties by the defendant, SIGNET, the minor child, Ryan Pitzer,

ingested a lethal dose of potassium chloride on or about April 1, 1978, resulting

in his death on April 4, 1978, and the damages previously described were incurred.

COUNT VII

IMPLIED WARRANTY v. SIGNET

37. Plaintiff, DONALD PITZER, as Personal Representative of the Estate of

Ryan Pitzer, incorporates herein by reference paragraphs 24, 30 and 33-35.

38. The defendant, SIGNET, as a merchant ·,n th b k b e oo usiness, impliedly

warranted that the book referred to in paragraph 3 b a ove was reasonably fit for

its intended use as.,, inter a1·1a, a ·d d f gu1 e an re erence book for 11vital nutritional

do 1s and don 1t 1s for expectant th b b" mo ers, a 1es and ·growing children, 11 and was

otherwise of merchantable quality and fit for its intended use.

39. The defendant, SIGNET, breached its implied warranty of merchantability

and fitness, and as a proximate result of said breaches, the minor child, Ryan

Pitzer, ingested a lethal dose of potassium chloride on or about April 1, 1978,

resulting in his death on April 4, 1978, and the damages previously described

were incurred.

WHEREFORE,. th~ plaintiff demands judgment against defendant, SIGNf:,T, for

damages, plus costs and interest.

COUNT VI fl

VICARIOUS LIABILITY v. HARCOURT

40. Plaintiff, DONALD PITZER, as Personal Representative of the Estate of

Ryan Pitzer, incorporates herein by reference paragraphs 24-39.

41. Defendant, HARCOURT, by virtue of the premises, is legally responsible

or otherwise vicariously liable for the wrongful acts of SIGNET.

WHEREFORE, the plaintiff demands judgment against defendant, HARCOURT,

for damages that may be awarded against defendant SIGNET, whether compen­

satory or punitive, plus costs and interest.

COUNT IX

INDEPENDENT NEGLIGENCE v. HARCOURT

42. It was at all times relevant to this action the duty of HARCOURT, to

exercise ordinary and reasonable care not to expose potential consumers, and

members of the general reading public, to unreasonable risks of harm from the

use of its products and from the advice contained therein. Specifically, this

defendant had a duty to exercise reasonable care in the publishing, editing,

inspecting, testing, producing and/or distributing the hardcover edition of the

book II Let's Have Healthy Children". Inasmuch as HARCOURT had the ultimate

editorial responsibility with respect to both the hard and softcover editions, the

duties of this defendant as to the editing, inspecting, and testing of the advice

in said book extended to both the hard and softcover editions, such as the edition

purchased by Susan Pitzer. Said duty was non-delegable under the circumstances

here alleged.

43. Notwithstanding the duty owed by defendant to plaintiff's decedent,

defendant, HARCOURT, breached its duty in some or all of, but not limited to,

the following negligent acts:

A. Failed to independently verify the effectiveness and safety of the

dosages of potassium chloride referred to on page 242 of the· al;)ove referred to

book.

B. Failed to independently verify the existence of the "study of 653

sick babies" and further, to independently verify the accuracy of the citation to

the alleged 11study 11 •

C. Failed to warn readers that some babies might have a sensitivity

to the recommended dosage of potassium chloride, which sensitivity could lead to

potassium intoxication and resultant death.

D. Defendant, HARCOURT, knew or should have known that the book

referred to paragraph 3 above, which was published under the authority and

editorial control of this defendant, contained inaccuracies, false citations of author­

ity, misleading statements of fact and opinion, and many items of medical and

nutritional advice which, if followed by a reader, would result in human harm,

injury and suffering, and in some cases, death.

E. Notwithstanding defendant, HARCOU RT's, knowledge of the vast

amount of criticism in the medical field of ADELLE DAVIS' writings, said defendant

failed to include any warnings in the book as to the potential danger to the

reader of the advice contained therein or at the very least, the need to inde­

pendently verify the advice, remedies and suggestions contained therein.

F. HARCOURT represented to the public at large and to the plaintiff

in particular that the book was comprised of true statements of fact that could be

relied upon, and in fact were relied upon by plaintiff, when instead the book

contained false statements of fact that were known or should have been known to

have been false.

44. As a direct and proximate result of the negligence of this defendant,

the minor child, Ryan Pitzer, ingested a lethal dose of potassium chloride on or

COUNT X

INTENTIONAL TORT v. HARCOURT, BRACE & WORLD, INC.

45. Plaintiff, DONALD PITZER, as Personal Representative of the Estate of

Ryan Pitzer, incorporates herein by reference paragraphs 42-43.

46. The acts of this defendant as aforesaid were accomplished recklessly, .. willfully, wantonly, maliciously, outrageously, fraudulently and/or grossly negli­

gently so as to justify the imposition of punitive damages.

47. As a direct and proximate result of the foregoing wrongful acts, the

minor child, Ryan Pitzer, ingested a lethal dose of potassium chloride on or about

April 1, 1978, resulting in his death on April 4, 1978, and the damages previously

described were incurred.

WHEREFORE, the plaintiff demands judgment against defendant, HARCOURT,

for compensatory _and. punitive damages, plus costs and interest.

COUNT XI

STRICT LIABILITY v. HARCOURT

48. Plaintiff, DONALD PITZER, as Personal Representative of the Estate of

Ryan Pitzer, •incorporates herein by reference paragraphs 42-43.

49. Defendant, HARCOURT, was at all times relevant to this action, and

still is engaged in the business of publishing, editing, inspecting, testing, pro­

ducing, distributing and selling books including the book authored by ADELLE

DAVIS entitled 11Let 1s Have Healthy Children. 11

50. Since this defendant had the ultimate editorial responsibility with respect

to the contents of both the hard and soft cover editions of this book, and since

defendant SIGN ET was contractually obligated to faithfully reprint the text of this

book, both the hard and soft cover editions were produced, designed, inspected,

tested, edited, published and/or distributed as a matter of law by HARCOURT, in

such a manner as to make the book unreasonably dangerous, and otherwise defec­

tive.

51. As a direct and proximate result of the defects in and unreasonably

dangerous condition of the book, for which defendant, HARCOURT, is strictly

liable in tort, the minor child, Ryan Pitzer, ingested a lethal does of potassium

IMPLIED WARRANTY v. HARCOURT

52. Plaintiff, DONALD PITZER, as Personal Representative of the Estate of

Ryan Pitzer, incorporates herein by reference paragraphs 48-50.

53. Defendan!, HARCOURT, impliedly warranted that the book referred to

in paragraph 3 above was reasonably fit for the uses for which it was intended,

and was otherwise merchantable.

54. HARCOURT breached its warranties, and as a proximate result thereof,

the r;ninor child, Ryan Pitzer, ingested a lethal dose of potassium chloride on or

about April 1, 1978, resulting in his death on April 4, 1978, and the damages

previously described were incurred.

WHEREFORE, plaintiff demands judgment against defendant, HARCOURT, for

damages, plus costs 9nd interest.

COUNT XIII

NEGLIGENCE v. MAKERS OF KAL, INC.

55. Defendant, MAKERS OF KAL, INC., has been and is now engaged in

the business of manufacturing, processing, packing, labeling, promoting, selling

and distributing in interstate commerce a product denominated as potassium chlo­

ride. Said product of defendant has been and is now sold to consumers over the

counter in the State of Florida.

56. It was at all times relevant to this action the duty of defendant, MAKERS

OF KAL, I NC., to exercise ordinary and reasonable care not to expose potential

consumers, like the plaintiffs, to an unreasonable risk of harm from the use of its

products. This defendant had a further duty as an expert in this field to keep

informed of scientific knowledge and discoveries concerning that field.

57. Notwithstanding the duty owed by defendant to plaintiff, defendant

MAKERS OF KAL, I NC. negligently breached its duty to plaintiff in some or all

of, but not limited to, the following respects:

A. Failed to adequately test for harmful effects, and to properly

investigate the dangerous propensities of potassium chloride before manufacturing,

labeling, selling, and distributing said drug to members of the public.

tions for which potassium chloride is intended.

C. Failed to warn plaintiff, the general public or anyone of the

potential danger associated with the use of potassium chloride by children.

D. Failed to provide adequate directions for use of potassium chloride;

including but not limited to failure to warn against unsafe dosages or methods or

duration of administration or application of this substance as is necessary for the

protection of users.

E. Fail~d to adequately label said substance in accordance with the

provisions of 21 U.S.C.A §352 of the Food, Drug and Cosmetic Act, 21 U.S.C.A

§301 et seq.

F. Introduced or delivered for introduction into interstate commerce a

misbranded substance, 21 U.S.C.A. §§351, 352.

G. Failed to keep informed of scientific knowledge and discoveries

with respect to the potential dangers associated with the use of potassium chloride.

58. As a direct and proximate result of the negligent acts of defendant,

MAKERS OF KAL ( I NC., the minor child, Ryan Pitzer, ingested a lethal dose of

potassium chloride on or about April 1, 1978, resulting in his death on Apri\ 4,

1978, and the damages previously described were incurred.

WHEREFORE, the plaintiff demands judgment against defendant, MAKERS OF

KAL, INC., for damages, plus costs and interest.

COUNT XIV

INTENTIONAL TORT v. MAKERS OF KAL, INC.

59. The plaintiff, DONALD PITZER, as Personal Representative of the

Estate of Ryan Pitzer, incorporates by reference paragraphs 55 and 56.

60. Notwithstanding the duty owed by defendant to plaintiff, the defendant,

MAKERS OF KAL, INC., willfully, wantonly, maliciously, outrageously and with

reckless disregard for the rights of plaintiff and the public at large, and with

gross negligence, breached its duty to plaintiff in some or all of, but not limited

to, the following respects:

A. Failed to adequately test for harmful effects, and to properly

investigate the dangerous propensities of potassium chloride before manufacturing,

labeling, selling, and distributing said drug to members of the public.

B. Failed to include in labeling a statement of the diseases or con-

ditions for which potassium chloride is intended. For ease of reference, a copy

tiffs, is attached hereto as Exhibit C.

C. Failed to warn plaintiff, the general public or anyone, through the

label or otherwise, of the potential danger associated with the use of potassium

chloride by children.

D. Failed to provide adequate directions for use of potassium chloride,

through the label or otherwise, including but not limited to, failure to warn

against unsafe dosages or methods or duration of administration or application of

this substance as is necessary for the protection of users . .,

E. Failed to adequately label said drug in accordance with the pro-

visions of 21 U.S. C. A. Section 352 of the Food, Drug and Cosmetic Act, 21

U.S. C. A. Section 301 et ~.

F. Introduced or delivered for introduction into interstate commerce a

misbranded substance, as defined by 21 U.S. C. Sections 351 and 352.

G. Failed to keep informed of scientific knowledge and discoveries with

respect to the potential dangers associated with the use of potassium chloride.

61. As a ~irec;:t and proximate result of the reckless, willful, wanton,

malicious, outrageous and/or grossly negligent acts of defendant, MAKERS OF

KAL, I NC., described above, the minor child, Ryan Pitzer, ingested a lethal dose

of potassium chloride on or about April 1, 1978, resulting in his death on April

4, 1978, and the damages previously described were incurred.

WHEREFORE, plaintiff demands judgment against defendant, MAKERS OF

KAL, I NC., for compensatory and punitive damages, plus costs and interest.

COUNT XV

STRICT LIABILITY v. MAKERS OF KAL, INC.

62. The plaintiff, DONALD PITZER, as Personal Representative of the

Estate of Ryan Pitzer, incorporates by reference paragraphs 55-57.

63. The product referred to above was placed on the market, into the

stream of commerce, and disseminated to members of the public, in a defective,

u_nreasonably dangerous condition.

64. As a direct and proximate result of the defective and unreasonably

dangerous condition of its product, for which this defendant is strictly liable in

tort, the minor child, Ryan Pitzer, ingested a lethal dose of potassium chloride on

or about April 1, 1978, resulting in his death on April 4, 1978, and the damages

previously described were incurred.

potassium chloride on or about April 1, 1978, resulting in his death on April 4,

1978, and the damages previously described were incurred.

WHEREFORE, plaintiff demands judgment against defendant MAKERS OF KAL,

INC., for damages, plus costs and interest.

COUNT XVI I

CONCURRENT FAULT

69. The plaintiff, DONALD PITZER, as Personal Representative of the

Estate of Ryan Pitzer, incorporates by reference paragraphs 1-68.

70. All of the foregoing wrongful acts, concurrently, caused the damages

previously described, and defendants are thereby jointly and severally liable.

WHEREFORE, the plaintiff demands judgment against the defendants, jointly

and severally, plus costs and interest.
