3.9.2 The principal use of land within Special Rural Zones shall be residential,howeveropportunitiesexist for rural/residentialandhobby farm lifestyles inaccordancewith the controls of this Schemeandto such an extent that theactivities undertakenwithin the areasso zoned, maintaina rural characterandthe areasas a whole do not havea detrimentaleffect on nearbyfarmingor otheruses.Ancillary land uses are listed in the Zoning and DevelopmentTable andAppendixIII. Ruralpursuitsas definedinAppendixVII are notpermittedusesin SpecialRural Zones.

3.9.3 In addition to a building licence, the Council’s prior approvalto commencedevelopmentis requiredfor all developmentincludinga singlehouseandsuchapplicationshall be madein writing to the Council and be subject to theprovisionof Clause6.1 of the Scheme.

3.9.4 In consideringapplicationsfor planningconsentCouncil shall ensurethat thedevelopmentproposedwill not result in any net exportof nutrients from theland to any wetland, water courseor undergroundaquifer and may requireno further clearing of remnantnativevegetation.

3.9.5 As a conditionof planningconsentfor developmenton eachlot, Council shallrequire the planting and maintenanceof at least 20 native or locallyacceptabletreescapableof growing to a height of at least 5 metres.

3.9.6 Applicationsfor planningconsentshall clearly indicatethelocation of existingremnantnativevegetationandwherenecessary,Cothicil may requirethat theremnantnative vegetationbe protected.

3.9.7 In order to conservethe featuresof the rural environment,all treesshall beretainedunlesstheir removal is authorisedby the Council.

3.9.8 The use of secondhandbuilding materials is prohibited unless the Councilgrantsspecialapprovalin writing.

3.9.9 All stormwatershall be retainedon sitewith no direct drainageinto watercoursesor wetlands.

3.9.10 Conventionalseptics shall be located at least 100 metres from any watercourseor wetlandwith a minimum of 2 metresvertical separationbetweenthe baseof the leach drain or soakwell and the highestknown groundwaterlevel or bedrock.

3.9.11 Alternativedomesticwastewater systemswill only beapprovedonceappropriate approvals have been obtained from the relevant State Governmentagencies.

3.9.12 When consideringproposalsfor rezoningof landto SpecialRural, Council willhaveregardto its Local Rural StrategydatedJanuary1993 andrequire:

a anywatercoursesor wetlandson the landto be adequatelyprotectedfromlanduses;

b the identification of managementtechniquesto reduceexisting or potential soil erosionproblems;

c preparationof a detail fire protectionstrategywhich makesprovisionforfirebreaksandfuel reducedareasaroundbuildings,fire vehicle access,firehydrantsor pipe standsandtanks,and adequatefire fighting equipment;and

d only considerproposalsoutsidethose areasidentified in the Local RuralStrategyonce the Strategyhas beenreviewedto include the additionalland.

3.9.13All land zoned Special Rural will be included within a DevelopmentAreaunless the land is already subdivided in accordancewith an overall sub-divisional layout plan.

3.9.14 Prior to supporting any subdivision of land within a Special Rural Zone,Council will requirethe preparationandapprovalof an overall subdivisionallayoutplan in accordancewith the provisionsof Clause4.2. Once the landhasbeensubdivided,Council will not supportthe further subdivisionof the land.

3.9.15 As a condition of subdivision approval, Council may request that thesubdivider be required to enter into an agreementwith Council for theplantingandmaintenanceof nativeor locally acceptabletree8within specifiedroad reservesin such a manneras to createan avenueof treeswithin thesubdivision.

3.9.16 In additionto such otherprovisionsof the Schemeas may affect it, any landwhich is includedin a SpecialRural Zone shall be subjectto those provisionsas may be specifically set out againstit in Appendix III.

3.9.17 Notwithstandingthe provisionsof Clause3.9, Council will haveregardto anyadopted planning policy or guidelines when considering developmentandsubdivisionproposalswithin SpecialRural Zones.

2.2 Matters to be Consideredby Council: Whenan application for planning consentis madewithrespectto land within a Reserve,the Council shall haveregardto the ultimatepurposeintendedfor the Reserveand the Council shall, in the caseof land reservedfor the purposesof a publicauthority, conferwith that authority before granting its consent.

2.3 Compensation:

2.3.1 Wherethe Council refusesplanning consentfor the developmentof a Reserveon the groundthat the land is reservedfor Local Authority purposesor for the purposesshown on the SchemeMap, or grants planningconsentsubjectto conditionsthat are unacceptableto the applicant,theowner of the land may, if the land is injuriously affected thereby, claim compensationfor suchinjurious affection.

2.3.2 Claims for such compensationshall be lodged at the office of the Council not later than sixmonthsafterthe dateof the decisionof the Council refusingplanningconsentor grantingit subjectto conditionsthat are unacceptableto the applicant.

2.3.3 In lieu of payingcompensationthe Council may purchasethe land affectedby suchdecisionof the Council at a price representingthe unaffectedvalue of the land at the time of refusal ofplanning consentor of the grant of consentsubject to conditions that are unacceptableto theapplicant.

PART 3-ZONES3.1 Zones:

3.i.i Thereare herebycreatedthe severalzonesset out hereunder:RESIDENTIALRURAL RESIDENTIALTOWN CENTRERURAL TOWNSITEINDUSTRIALFARMING

3.1.2 The zonesare delineatedanddepictedon the SchemeMap accordingto the legendthereon.

3.2 Zoning Table:

3.2.1 The ZoningTableindicates,subjectto the provisionsof theScheme,theseveralusespermittedin the SchemeArea in the various zones,such usesbeing determinedby crossreferencebetweenthelist of useson theleft handaideofthe ZoningTableand thelist of Zonesat thetop of theZoningTable.

3.2.2 The symbolsusedin the crossreferencein the Zoning Table havethe following meaning:"F’ means the use is permitted provided it complies with the relevant standardsand

requirementslaid down in the Schemeand all conditionsif any imposedby the Councilin granting planning consent.

"AA" meansthe Council may, at its discretion,permit the use.

"SA" meansthe Councilmay, at its discretion,permit the useafter noticeof the applicationhasbeengiven in accordancewith Clause6.2.

3.2.3 Whereno symbol appearsin the crossreferenceof a use againsta zonein the Zoning Tablethat use is not permittedin that zone.

3.2.4 Where in the Zoning Table a particular use is mentionedit is deemedto be excludedfromany otheruse which by its more generalterms might otherwiseinclude such particularuse.

3.2.5 If the use of land for a particularpurposeis not specifically mentionedin the Zoning Tableand cannot reasonablybe determinedas falling within the interpretationof oneof the usestheCouncil may:

a determinethat the use is not consistentwith the objectivesandpurposesof the particularzoneand is thereforenot permitted; or

b determineby absolutemajority that theproposedusemaybe consistentwith theobjectivesandpurposeof the zoneandthereafterfollow the advertisingproceduresof Clause6.2 inconsideringan applicationfor planning consent,following which the Council may, at itsdiscretion,permit the use.

3.2.6 Notwithstandingthat the use of land is not permitted in a zone in the Zoning Table, theCouncil maywith the prior written authority of theMinister andsubjectto following theadvertisingproceduresof Clause6.2, approveof the useof the land for thatpurposeif the Council is satisfiedby absolutemajority that:

a the proposeddevelopmentwill be consistentwith the orderly andproperplanning of thelocality and the preservationof the amenitiesof the locality; and

b the use of the land for that purposewill not haveanyadverseeffect upon the occupiersor usersof the developmentor upon propertyin or the inhabitantsof the locality or thelikely future developmentof the locality.

3.3 Rural ResidentialZone

The following provisionsshall apply to all land included in a Rural ResidentialZone in additionto any provisionswhich are more generallyapplicableto such land under the Scheme:

a the objectiveof theRural ResidentialZone is to selectareaswhereinclosersubdivisionwillbe permittedto provide for such uses as hobby farms, horsebreeding,rural-residentialretreats,and also to makeprovision for retentionof the rural landscapeandamenity ina mannerconsistentwith the orderly and proper planning of such areas;

b beforemaking provisionfor a Rural ResidentialZone, Councilwill prepare,or requiretheowners of the land to prepare,a submission supportingthe creation of the RuralResidentialZone and such submissionshall include:i a statementas to the purposeor intent for which the zoneis being createdand the

reasonsfor selectingthe particular areathe subjectof the proposedzone;ii a plan or plansshowingcontoursat suchintervalsas to adequatelydepictthelandform

of the areaand physical featuressuch as existing buildings, rock outcrops,trees orgroups of trees,creeks,wells andsignificant improvements;

iii information regardingthe method wherebyit is proposedto provide a potablewatersupplyto eachlot;

c provisionsfor developmentin specific Rural Residential Zonesshall be as laid down inSchedule2; the Schemeprovisionsfor a specific Rural ResidentialZone shall specify:i anyfacilities which the purchasersof thelots will be requiredto provide e.g. their own

potablewater supply, liquid or solid wastedisposal,etc.;

ii proposalsfor the control of land uses and developmentwhich will ensurethat thepurpose of intent of the zone and the rural environmentand amenities are notimpaired;

iii any specialprovisionsappropriateto securethe objectivesof the zone;

d the minimumlot size for subdivision in the Rural ResidentialZoneshall be shownin theSchemeMap;

e the Council shall require preparationof an Outline DevelopmentPlan before grantingand/orrecommendingapprovalto anysubdivisionandthe Outline DevelopmentPlanshallform the basis for subdivision.The Outline DevelopmentPlan shall show amongstotherthings:

i the proposedultimate subdivision including lot sizesanddimensions;

ii areasto be set aside for public open space, pedestrianaccessways,horse trails,communityfacilities, etc. as may be consideredappropriate;

iii thosephysicalfeaturesit is intendedto conserve;

iv the proposedstagingof the subdivision where relevant;

1 the proceduresfor preparation,adoption,and any departuresfrom or alterationsto theOutline DevelopmentPlanshall be in accordancewith Clause4.13.2 paragraphsa to einclusive of the Scheme.

3.4 Farming Zone The Council supportsthe continued use of land in the FarmingZone foragricultural production.It will only supportapplication for planning consentwhere the proposeduse is consistentwith continuedviability of rural use,and will be consistentwith rural characterand local amenities.

PART 4-DEVELOPMENT REQUIREMENTS4.1 Developmentof Land:

4.i.i Subject to Clause 4.1.2 a personshall not commenceor carry out developmentof any landzoned or reservedunderthe Schemewithout first havingapplied for and obtainedthe planningconsentof the Council underthe Scheme.

4.1.2 The planning consentof the Council is not requiredfor the following developmentof land:

a the use of land in a Reservewheresuchland is held by the Council or vestedin a publicauthority;

i for the purposefor which the land is reservedunderthe Scheme;or

ii in the caseof land vestedin a public authority, for any purposefor which such landmay be lawfully usedby that authority;

b the erection of a boundaryfenceexceptas otherwiserequiredby the Scheme;

c exceptas providedin Clause4.8the erectionon a lot of a singlehouse,including ancillaryoutbuildings,in a zonewhere the proposeduse is designatedwith the symbol "F’ in thecross-referenceto the zonein the Zoning Table;

d a developmentin the FarmingZoneoutsidethetownsiteson sheets1-6 for a usedesignatedwith thesymbol "P" or "AA" in the cross-referenceto the FarmingZone in theZoning Tableexceptwhere the developmentis on a lot which doesnot havefrontageto a constructedroad;

e the carrying out of any works on, in, over or undera streetor roadby a public authorityactingpursuantto the provisionsof any Act;

I the carrying out of works for the maintenance,improvementor other alterationof anybuilding, being works which affect only the interior of the building or which do notmateriallyaffect the externalappearanceof the building; or

g the carryingout of works urgentlynecessaryfor public safetyor for the safetyor securityof plant or equipmentor for the maintenanceof essentialservices.

4.2 DevelopmentLimited by Liquid WasteDisposal: The Council shall refuseto issue planningconsentfor any developmentif in the opinion of the Council adequateprovision is not made orcannotreasonablybe madefor the disposalof liquid wastesfrom that development.

4.3 Discretion to Modify DevelopmentStandards: If a development,other than a residentialdevelopmentor a developmenton a lot which does not havefrontageto a constructedroad, thesubjectof an application for planning consentdoes not comply with a standardor requirementprescribedby the Schemewith respectto that developmentthe Council may,notwithstandingthatnon-compliance,approvethe applicationunconditionallyor subjectto suchconditionsas theCouncilthinks fit. The powerconferredby this Clausemay only be exercisedif the Council is satisfiedthat:

a approvalof the proposeddevelopmentwould be consistentwith the orderly and properplanningof the locality and the preservationof the amenitiesof the locality;

b the non-compliancewill not haveany adverseeffect upon the occupiersor usersof thedevelopmentor theinhabitantsof thelocality or uponthe likely futuredevelopmentof thelocality; and

c the spirit andpurposeof the requirementor standardwill not be unreasonablydepartedfrom thereby.

4.4 ResidentialDevelopment:ResidentialPlanningCodes

4.4.1 Forthe purposeof the Scheme"ResidentialPlanningCodes"meansthe ResidentialPlanningCodes set out in A-ppendix 2 to the Statementof Planning Policy No. 1, together with anyamendmentstheretohereinaftercalledthe "H Codes".

4.4.2 A- copy of the R Codesshall be kept andmadeavailable for public inspectionat the officesof the Council.

4.4.3 Unlessotherwiseprovidedfor in the Schemethe developmentof landfor any of theresidentialpurposesdealtwith by the R Codesshall conform to the provisionsof those Codes.

4.4.4 The R Codedensityapplicableto land within the residentialandrural townsitezonesshallbe determinedby referenceto the R Code densitynumberssuperimposedon the areaswithin thatzoneshown on the SchemeMap as being containedwithin the outeredgesof the blackbordersor,where such an areaabutson anotherareahaving an R Code density, as being containedwithinthe centrelinesof thoseborders.

4.5 Special Application of Residential Planning Codes: Notwithstanding anything elsewherecontainedin the Scheme,the Council may consideran applicationto developa single houseon alot existing at thegazettaldateandwhich doesnotcomplywith therequirementsof minimumareaof land per dwelling and may grant approvalwith or without conditions, or may refuse theapplication.

4.6 Development of Lots Abutting UnconstructedRoads: Notwithstanding anything elsewhereappearingin the Schemewhere an application for planning consentis madein respectof landabuttingan unconstructedroad or a lot which does not havefrontageto a constructedroad theCouncil shall either:

a refuse the application until the road has been constructedor accessby meansof aconstructedroadis provided as the casemay be;

b grant the applicationsubjectto a conditionrequiring the applicantto pay a sumof moneyin or towardspaymentof the cost or estimatedcost of constructionof the road or partthereofand any otherconditionsit thinks fit to impose;or

c require such other arrangementsare made for permanentaccessas shall be to thesatisfactionof the Council.

4.7 Retentionof Vegetation:Not more than 2000 m2 including the areaof buildings on any lot inthe Farming zone shall be clearedof vegetation. If the Council is satisfied upon receipt of asubmissionthe clearing of an areagreaterthan 2000 m2 will not adverselyaffect the amenity,characterand landscapequalitiesof the areait may approvesuch land to be clearedsubject toconditionsas may be requiredby the Council. Whereit is proposedto clear in excessof 1 hectare,the consentof the Commissionerof Soil andLand Conservationwill be required.

4.8 Rural ResidentialZone:

4.8.i Developmentin a RuralResidentialZoneshall comply with the requirementsof the following:

a in additionto a building licence, the Council’sprior approvalto commencedevelopmentisrequiredfor all developmentincluding a singlehouseandsuch applicationshall be madein writing to the Council andbe subject to the provisions of Clause6.1 of the Scheme;

b not more thanone dwelling per lot shall be erected;

c in order to conservethe rural environmentor featuresof naturalbeautyall treesshall beretainedunlesstheir removal is authorizedby the Council;

d in order to enhancethe rural amenity of the land in areasCouncil considersdeficient intreecoverit may requireas a conditionof anyplanningapprovalthe plantingof suchtreesand/or groups of treesandspeciesas specified by the Council;

e any personwho keepsan animal or animals or who usesany land for the exerciseortraining of an animalor animals shall be responsiblefor appropriatemeasuresto preventdustpollution and soil erosion to the satisfactionof the Council. Where in the opinion ofthe Council the continuedpresenceof animals is likely to contributeor is contributingtodustpollution or soil erosion,noticemaybe servedon the owner of the land requiringtheremovalwithin the time specifiedin the notice of those animals specifiedin thenotice fora periodspecifiedin the notice.

4.8.2 In consideringapplication for planning consent for a proposeddevelopmentincludingadditionsandalterationsto existing developmentCouncil shall haveregardto the following:

a the colour andtextureof externalbuilding materials;

b building size, height, bulk, roof pitch;

c setbackand location of the building on its lot;

d architecturalstyle anddesign details of the building;

e relationshipto surroundingdevelopment;and

U other characteristicsconsideredby the Council to be relevant.

4.10 Car Parking:A personshall not developor use any land or erect use or adaptany buildingunlesscar parking spacesspecified by the Council are provided and such spacesare constructedandmaintainedin accordancewith the requirementsof the Council.4.11 HomeOccupation:4.11.1 The Council shall notgrant planningconsentto a home occupationunlessit is satisfiedthatthe use:

a will not prejudicially affect the amenity of the neighbourhoodby way of emissionsof anynature;

b will not occupy an areagreaterthan 20 squaremetres;

c doesnot require the provision of any essential servicemain of a greatercapacitythannormally requiredin the zonein which it is located;and

d is compatible with the principal usesto which the land in the zone it is locatedmay beput and will not in the opinion of the Council generatea volume of traffic that wouldprejudice the amenityof the area.

4.11.2 If an approvalto conducta homeoccupationis issuedto a specific occupierof a particularparcel of land, it shall not be transferredor assignedto any other person, and shall not betransferredfrom the land in respectof which it was granted.Should therebe a changeof theoccupier of the land in respectof which a home occupationapproval is issuedthe approvaliscancelled.4.11.3 If, in the opinion of the Council, a home occupationis causinga nuisanceor annoyancetoownersor occupiersof land in the locality the Council may rescindthe approval.4.ii.4 An approvalto conducta homeoccupationis issuedsubjectto an annualpermit which maybe renewedby application to the Council for planning consent.4.12 Town CentreDesign Control Area:4.12.1 The land in the Town Centre Zone is herebydesignatedas "Town CentreDesign ControlArea".4.12.2 Developmentwithin the Town Centre DesignControl Area will be subjectto the civic anddesign guidelinescontainedin this clauseandwhich are for the purposeof ensuring that suchdevelopmentwill not affect local amenity andwill enhancethe characterof the land in the TownCentrezone.4.i2.3 Site requirementsshall be as set out in Table 2 of the Scheme.4.i2.4 Developmentshall not exceed2 storeys in height except where Council considersthatparticularcircumstancesmaywarrant anexceptionbeing madeandprovidedtheintentionsof thisClauseare not compromised.4.12.5 In consideringan application for planning consentfor a proposeddevelopmentincludingadditionsandalterationsto existingdevelopmentin the Town CentreDesignControl AreaCouncilshall haveregardto the following:

4.i2.6 Landscapingshall complementthe appearanceof the proposeddevelopmentand the towncentre.

4.12.7 Layout of carparkingshall haveregardfor traffic circulationin existing carparkingareasandshall be integratedwith any existing and adjoining carpark.

4.13 Subdivision:

4.13.1FarmingZone: Thereshall be a presumptionagainstthe subdivisionof land in the FarmingZoneunlessthe Council is satisfied:

a thelots havealreadybeenphysically divided by significant naturalor man-madefeaturesunless adjoining land could be similarly subdivided and thereby, by the processofprecedent,leadto an undesirablepatternof land use in the areaor in lots too small forusescompatible with the prevailinguse in the areaor in ribbon developmentalongsideroads;

b the lots are for farm adjustmentand the erection of dwelling housesis restricted bymemorialson titles;

c the lots are for specific usessuch as recreationfacilities and public utilities;

d the lots are requiredfor the establishmentof uses ancillary to the rural use of the land,are requiredfor the travelling public andtourists suchas servicestationsandmotels, orfor homesteadlots to be excisedfrom a farming property for residentialpurposes.

4.13.2 ResidentialZone In the ResidentialZone the Councilmay requirepreparationof an OutlineDevelopmentPlan before granting and/or recommendingapproval to any developmentwhichinvolves subdivisionor follows subdivision andthe Outline DevelopmentPlan shall form the basisfor subdivision.

a the Outline DevelopmentPlan shall include

i the topographyof the area;

ii the location andwidth of proposedroads;

iii the location of recreation,open space,andpedestrianaccesswaysproposed;

iv the layout of comprehensivedrainage;and

v such other information as may be requiredby Council;

b if the Council resolvesto adoptthe Outline DevelopmentPlan it shall circulatetheOutlineDevelopment Plan to all owners of land within the area covered by the OutlineDevelopmentPlan with an invitation for submissionsto be lodged with Council withintwenty-onedays;

c the Council shall considerobjections,if any,to the Outline DevelopmentPlan and may,if the applicantagrees,amendthe Outline DevelopmentPlan after such considerationofobjections;

d theCouncil maydecide not to proceedor may submitthe Outline DevelopmentPlanto theCommissiontogetherwith the objectionsand requestthe Commissionto adopt the plansubmittedas the basis for approvalof subdivision within the areacoveredby the plan;

e any departuresfrom or alterationsto the Outline DevelopmentPlan may, subject to theapprovalof the Commission, be permitted if the Council considersthat the proposeddepartureor alteration will not prejudice the progressivedevelopmentof the areathesubjectof the Outline DevelopmentPlan.

PART 5-NON-CONFORMINGUSES

5.i Non-conformingUse Rights: No provision of the Schemeshall prevent:

a the continueduse of any land or building for the purposefor which it wasbeing lawfullyusedat the gazettaldate; or

b the carrying out of any developmentthereonfor which, immediately prior to that time, apermit or permits, lawfully requiredto authorizethe developmentto be carriedout, wereduly obtainedandare current.

5.2 Extensionof Non-conformingUse: A- personshall not alteror extenda non-conforminguse orerectalteror extenda building usedin conjunctionwith a non-conforminguse without first havingapplied for and obtainedthe planning consentof the Council under the Schemeand unless inconformity with any other provisionsandrequirementscontainedin the Scheme.

5.3 Changeof Non-conformingUse: Notwithstandinganythingcontainedin the Zoning Table theCouncil maygrant its planningconsentto the changeof useof anylandfrom a non-conforminguseto anotheruseif the proposeduseis, in the opinion of the Council, lessdetrimentalto theamenityof the locality than the non-conforminguse and is, in the opinion of the Council, closer to theintendedusesof the zone.

5.4 Discontinuanceof Non-conformingUse:

5.4.i When a non-conforminguse of any land or building hasbeendiscontinuedfor a periodof sixmonthsor moresuchland or building shall notthereafterbeusedotherwisethanin conformitywiththe provisionsof the Scheme.

5.4.2 The Council may effect the discontinuanceof a non- conforming useby the purchaseof theaffected property, or by the paymentof compensationto the owner or the occupieror to both theownerandthe occupierof that property,andmay enterinto an agreementwith the ownerfor thatpurpose.5.5Destructionof Buildings: If any building is, at thegazettaldate,being usedfor a non-conforminguse,andis subsequentlydestroyedor damagedto an extent of 75% or more of its value the landon which the building is built shall not thereafterbe usedotherwisethan in conformity with theScheme,and the building shall not be repairedor rebuilt, alteredor addedto for the purposeofbeing used for a non-conforminguse or in a manneror position not permittedby the Scheme.

PART 6-PLANNING CONSENT6.1 Application for PlanningConsent:Everyapplicationfor planningconsentshall be madein theform prescribedby the Council andin accordancewith the directionsthereon.

6.2 Advertising of Application:6.2.1 Wherean application is madefor planning consentto commenceor carry out developmentwhich involves an"SA" use the Council shall not grantplanningconsentto that applicationunlessnotice of the application is first given in accordancewith the provisionsof this Clause.

6.2.2 Wherean application is madefor planning consentto commenceor carry out developmentwhich involves an "A-A" use, or for any other developmentwhich requiresthe planningconsentofthe Council, the Council may give notice of theapplicationin accordancewith the provisionsof thisClause.6.2.3 Where the Councilis requiredor decidesto give noticeof anapplicationfor planning consentthe Council shall causeone or more of the following to be carriedout:-

a noticeof theproposeddevelopmentto be servedon the ownersandoccupiersof landwithinan area determinedby the Council as likely to be affected by the granting of planningconsentstating that submissionsmay be madeto the Council within twenty-onedays ofthe serviceof such notice;

b notice of the proposeddevelopmentto be publishedin a newspapercirculating in theSchemeArea statingthat submissionsmaybe madeto the Council within twenty-onedaysfrom the publication thereof;

c a signor signsdisplaying noticeof theproposeddevelopmentto be erectedin a conspicuousposition on the land for a period of twenty-onedays from the dateof publication of thenotice referredto in paragraphb of this Clause.

6.2.4 After expiration of twenty-onedays from the servingof notice of the proposeddevelopment,the publicationof noticeor the erectionof a sign or signs,whicheveris the later, the Council shallconsiderand determinethe application.

6.3 Determinationof Application:

6.3.1 In determining an application for planning consent the Council may consult with anyauthority which, in the circumstances,it thinks appropriate.

6.3.2 The Council having regardto any matterwhich it is requiredby the Schemeto consider,tothe purposefor which theland is reserved,zonedor approvedfor the useunderthe Scheme,to thepurposefor which land in the locality is used,andto theorderly andproperplanningof thelocalityand the preservationof the amenitiesof the locality, may refuseto approveany application forplanningconsentor may grant its approvalunconditionallyor subjectto suchconditionsasit thinksfit.6.3.3 Wherethe Council approvesanapplicationfor planningconsentunderthe Schemethe Councilmay limit the time for which that consentremainsvalid.6.4 DeemedRefusal:6.4.1 Wherethe Council hasnotwithin sixty daysof the receiptby it of an applicationfor planningconsenteitherconveyedits decisionto theapplicantor givennoticeof the applicationin accordancewith Clause6.2 the applicationmay be deemedto havebeenrefused.

6.4.2 Wherethe Council hasgiven noticeof anapplicationfor planningconsentin accordancewithClause6.2 and where the Council has not within ninety days of receipt by it of the applicationconveyedits decisionto the applicant,the applicationmay be deemedto havebeenrefused.6.4.3 Notwithstandingthat anapplicationfor planningconsentmaybe deemedto havebeenrefusedunderClauses6.4.1 or 6.4.2 the Council may issue a decision in respectof the applicationat anytime after the expiry of the sixty day or ninety day period specified in those Clauses,as the casemay be.6.5 Approval of Existing Development:6.5.1 The Councilmay give approvalof a developmentalreadycommencedor carriedoutregardlessof whenit commencedor was carriedout. Suchapprovalshall havethe sameeffect for all purposesas if it hadbeengiven prior to the commencementor carryingoutof the development,but providedthat the developmentcomplieswith the provisionsof the Schemeas to all mattersotherthan theprovisionsrequiring Council’s approvalprior to the commencementof development.6.5.2 The application to the Council for approvalunderClause6.5.1 shall be madein accordancewith the provisionsof Clause6.1.

6.5.3 A- developmentwhich was not permissibleunder the Schemeat the time it was commencedor carriedout may be approvedif at the time of approvalunderthis Clauseit is permissible.6.5.4 The approvalby the Council of an existing developmentshall not affect the power of theCouncil to take appropriateaction for a breach of the Scheme or the Act in respectof thecommencementof the developmentwithout approval.

6.6 Preservationof Buildings, Objects, or Places:6.6.1 If the Council resolvesthat, in its opinion, a building, object, or place is of historical orarchitecturalinterestor of outstandingnaturalbeautytheCouncil shall,within fourteendaysafterthe passingof that resolution, give written notice thereofto the owner of the building, object, orplace.The noticeshall set outthe termsof this Clause,andrequirethe owner to give prior writtennotice to theCouncil of anymaterialalterationor modificationproposedto bemadeto thebuilding,object or place.6.6.2 No alteration or modification to any building, object, or place which is the subject of aresolution underClause6.6.1 shall be commencedor carriedout, by any person,without havingobtainedplanningconsent.6.6.3 Wherea developmentthe subjectof an application for planning consentinvolves a materialalterationto, a materialmodificationof, or the destructiontotal or partial of anybuilding, object,or placethe subjectof a resolutionunderClause6.6.1, the Council, havingregardto the desirabilityof retaining that building, object, or place,may refusethe applicationor approveof it subject tosuchconditionsas the Council deemsnecessaryto protector preservethebuilding, object,or place.

6.6.4 Wherethe Council refusesapproval for the developmentof land on any ground set out inClause6.6.3 or grants approvalsubject to conditionsthat are unacceptableto the applicant, theowner of the land may, if the land is injuriously affected thereby, claim compensationfor thatinjurious affection in accordancewith the Act.

6.6.5 Claims for compensationunder this Clauseshall be lodged at the offices of the Council notlater than six monthsafter the date of the decision of the Council refusingapprovalor grantingapprovalsubjectto conditionsthat are unacceptableto the applicant.

6.6.6 In lieu of paying compensationthe Council may purchasethe land affected by the decisionof the Council at a pricenot exceedingthe value of the land at the time of refusal of approvalorof the grantingof approvalsubjectto conditionsthat are unacceptableto the applicant.

PART 7-ADMINISTRATION7.1 Powersof the Scheme:In implementingthe Schemethe Council has,in additionto all otherpowersvestedin it, the following powers:

a the Councilmay enterinto anyagreementwith anyowner,occupieror otherpersonhavingan interest in land affected by the provisionsof the Schemein respectof any matterspertainingto the Scheme;

b the Council may acquire any land or buildings within the District pursuant to theprovisionsof the Schemeor the Act;

c the Council may deal with or disposeof any land which it has acquiredpursuantto theSchemeor theAct in accordancewith law andfor suchpurposemay makesuchagreementswith other ownersas it considersfit;

d an officer of the Council, authorizedby the Council for the purpose,may at all reasonabletimes enterany building or landfor the purposeof ascertainingwhetherthe provisionsofthe Schemeare being served.

7.2 Offences:7.2.1 A personshall not erect,alter or add to or commenceto erect,alter or addto a building oruse or changethe use of any land, building or part of a building for any purpose:

a otherwisethan in accordancewith the provisions of the Scheme;

b unlessall consentsrequiredby the Schemehavebeengrantedandissued;

c unlessall conditionsimposedupon the grant and issue of any consentrequiredby theSchemehavebeenand continueto be compliedwith; and

d unless all standardslaid down and all requirements prescribedby the Scheme ordeterminedby the Council pursuantto the Schemewith respectto that building or thatuse of that part havebeenandcontinueto be compliedwith.

7.2.2 A- personwho fails to comply with any of the provisionsof the Schemeis guilty of anoffenceandwithout prejudiceto any otherremedygivenhereinis liable to the penaltiesprescribedby theAct.7.3 Act:7.3.1 Twenty eight 28 dayswritten notice is herebyprescribedas the notice to be given pursuantto Section 10 of the Act.7.3.2 The Council may recoverexpensesunderSection 102 of the Act in a Court of competentjurisdiction.7.4 Claims for Compensation:Exceptwhere otherwiseprovidedin the Scheme,the time limit forthe making of claims for compensationpursuantto Section 111 of the Act is six 6 monthsafterthe dateof publication of the Schemein the GovernmentGazette.

7.5 Appeals:An applicant aggrievedby a decision of the Council in respectof the exerciseof adiscretionarypower under the Schememay appealin accordancewith the rules and regulationsmadepursuantto the Act.

7.6 Power to Make Policies:

7.6.1 In orderto achievethe objectivesof the Scheme,theCouncil may makeTown PlanningSchemePolicies relating to parts or all of the SchemeArea andrelating to one or moreof the aspectsofthe control of development.7.6.2 A- Town PlanningSchemePolicy shall becomeoperativeonly after the following procedureshavebeencompleted:

a the Council havingpreparedandhaving resolvedto adopt a draft Town PlanningSchemePolicy, shall advertisea summaryofthe draftPolicy oncea weekfor two consecutiveweeksin a newspapercirculatingin the SchemeArea giving detailsof wherethe draft Policy maybe inspectedand where, in what form, and during what period being not less thantwenty-onedays representationsmay be madeto the Council;

b the Council shall review its draft Town Planning SchemePolicy in the light of anyrepresentationsmadeandshall thendecideto finally adoptthe draftPolicy with or withoutamendment,or to not proceedwith the draft Policy;

c following final adoption of a Town Planning SchemePolicy, details thereof shall beadvertisedpublicly anda copy kept with the Schemefor inspectionduring normal officehours.

7.6.3 A Town PlanningSchemePolicy may only be alteredor rescindedby:

a preparationandfinal adoptionof a new Policy pursuantto this Clause,specifically wordedto supersedean existing Policy;

b publication of a formal noticeof rescissionby the Council twice in a newspapercirculatingin the SchemeArea.

7.6.4 A Town PlanningSchemePolicy shall not bind the Council in respectof any application forplanningconsentbut beforemaking its decisionthe Council shall takeinto accountthe provisionsof the Policy and objectiveswhich the Policy was designedto achieve.

SCHEDULE 1

RegulatIon14 amended3. Regulation14 of the principal regulationsis amended-

a in subregulation5, by inserting after "in the licenceitself’ the following-" or by endorsementon the licence "; and

b by adding the subregulationfollowing-" 6 A- bookmaker’slicencewhich is endorsedto that effect authorizesthe

licensee to carry on the businessof a bookmaker,in relation to sportingeventsor contingenciesapprovedundersection4B, by meansof on-coursetelephonebettingconductedin accordancewith regulation71.

Regulation71 added4. After regulation70 of the principal regulationsthe following regulationis added.

"Thiephonebettingon sporting events71. 1 Whenbettingon a sportingevent, or a contingency,is approvedundersection4B of the Act a licenseewho is so authorizedby endorsementon thelicencemay carry on businessas a bookmakerby meansof on-coursetelephonebettingin relation to that sportingeventor contingency-

a in accordancewith the proceduresestablishedand approvedby theBoard for the conductof such betting,and not otherwise; and

b if the committee or other authority controlling the racecoursesopermits.

2 For the purposesof subregulation1 the Board has establishedthefollowing procedures-

a the telephonesystemto be usedshall be of a type approvedby the.Board;

b all inwardandoutwardtelephonelinesusedfor bettingpurposesshallhaveattachedsecurablevoice loggingequipmentof a type approvedbythe Board;

c consentto thevoice loggingof thebettingtransactionsis to be obtainedfrom all telephonebettors;

d all betting transactionsby telephoneshall be recordedthrough thevoice logging equipment;

e the full detailsof eachbetreceived,includingthebettingticketnumberand account number, shall be confirmed with the bettor by thebookmaker, or an agent or employee of the bookmaker,before theconclusionof the telephoneconservation;

f the tapesused to recordbettingtransactionsshall-i be held and distributedby stewards;ii at the end of each race meeting,be collected by the Betting

Steward,togetherwith the duplicatesportsbetting sheets;andiii be maintainedas bettingrecordsfor inspectionor audit by any

authorizedperson;and

g thevoiceloggingequipmentusedshall besealedby, andonly accessibleby or in conjunction with, a Betting Steward or other authorizedperson.

3 The detailsof all betsreceivedby telephoneareto be separatelyrecordedand, for the purposesof section 15 of the Act, included in the returnsto bedeliveredunderthe Act.

4 Whereanoffer of a betby telephoneis not confirmedas requiredby theproceduresestablishedby the Boardthat bettingtransactiondoesnot constitute a valid bet.
