housing Business Law shall be established asfollows :

Article 1., Any person who intends to make anapplication for permission to issue deposit re-ceipt combined with instrument for pledge orwarehouse warrant (hereinafter referred to asthe "warehouse instruments") in accordancewith the provision of Article 2 of the Ware-housing Business Law (Law No. 41 of 1935;hereinafter referred to as the "Law") shallsubmit in duplicate a written application forpermission for the issuance of the warehouseinstruments stating the matters listed belowto* the Minister of Transportation through theChief of Regional Maritime Bureau or theChief of Regional Land Transportation Bureauwho has the jurisdiction over the locality ofthe main office and two copies thereof to theChief of Regional Maritime Bureau or theChief of Regional Land Transportation Bureauwho has the jurisdiction oyer the locality ofthe branch office, respectively :(1) Full name or title ofapplicantand locality
of the main office;(2) Reasons why such application is necessary.
To the written application referred to in thepreceding paragraph shall be attached the fol-lowing documents :(1) Business program;
a. Name and locality of the officeJb, Outline of warehouses (per Form No. 1):
i. Name and locality;ii. Floor space or capacity;
iii. Structure;
iv. Whether the warehouse is owned orloaned ;v. In easeof a warehousewith constanttemperature, its lowest temperature pre-scribed by the regulation;
vi. Whether or not the warehouse in-struments are issued ;
vii. Kind of goods to be stored.c. Form of warehouse instruments,
(2) Business rules:a.. Matters concerning the line of business;b. Matters concerning warehousing of goods
% deposited;c. Matters concerning the warehouse in-
struments ;d. Matters concerning the insurance for
loss of goods deposited ;e. Matters concerning responsibility ,/or
goods deposited or exemption there from ;f. Matters concerning compensation for
loss of goods deposited ;g. Matters concerning custody of goods de-* posited ;
h. Matters concerning storage, handling'charges, fees, etc.;
i. Matters concerning delivei^y of goodsdeposited,
(3) Tariff:a. Storage;b. Handling charges.
(4) Other documents:a. In case of a juridical person, the docu-
ments listed below:i. Statement of historical record;
ii. Copy of the articles of incorporationand certified copy of the register;
iii. Inventory, balance sheet, statementof profit and loss, statement of disposalof profit and loss and business report forthe latest business year;
iv. Personal histories of officers.b. In case of a natural person, the docu-
ments listed below:i. Abstract copy of the census register;
ii. Personal history;iii. The latest tax-payment certificate;iv. Report on properties.
c. Table showing estimated volume of goodsto be stored in a year as classified by thekind of goods;

d. Estimate of income and expenditure inone year;
e. Specification of warehouse (as per FormNo. 2);
f. Plan showing structure of the warehousefor which the issuance of warehouse in-struments is intended ;
^g; Sketch around the warehouse and planshowing arrangement of warehouses andtheir floor spaces;
h. Statement of outline of cargo handlingmachines and other appurtenances ;
i. Statement of outline of collateral busi-ness or side business, if applicable.
(Reporting of Alteration of Business Program,etc.)
Article 2. Any person who intends to make areport on the alteration of the business pro-gram, business rules or tariff in accordancewith the provision of Article 3 or Article 7-(2)of the Law shall submit in duplicate the re-port on alteration of the business program,etc., stating the matters listed below, to theMinister of Transportation through the Chiefof Regional Maritime Bureau or the Chief ofRegional Land Transportation Bureau whohas the jurisdiction over the locality of the of-fice concerned, in the case of the businessprogram or business rules referred to in Arti-cle8 of the Law, 15 days prior to the day ofsuch alteration, in the case of the tariff refer-red to in the same Article, 30days prior to theday of such alteration, and in the case of thebusiness program, business rules or tariff re-ferred to in Article 7~(2) of the Law, within30 days after such alteration, respectively:(1) Full name or titleof reporter and locality
of the main office;(2) Items altered;
(3) Reasons why such alteration is necessary;(4) Date of alteration.
2 So far as loaning of warehouse or custodianwarehousing is concerned, a report shall besubmitted within 30 days after the alteration,irrespective of the provision of the precedingparagraph.
3 To the report provided for in paragraph 1shall be attached the following documents:(1) In case of a new construction, increase,
reconstruction, purchase, or great repair ofwarehouse,' or of loaning of warehouse, orcustodian warehousing, specification of thewarehouse, sketch of environs of the ware-house, plan showing arrangement of ware-houses and their floor'Spaces and plan show-ing structure of the warehouse where thewarehouse instruments are issued ;
(2) In case the person who has obtained,thelicence as provided for in Article 1 of the

Law intends to issue warehouse instrumentsfor any warehouse where the warehouse in-
Tstruments have not hitherto been issued(excepting the case coming under the preced-ing item), documents mentioned in the pre-ceding item;
(3) In case the form of warehouse instrumentis changed, forms of warehouse instrumentsold and new;
(4) In case the business rules is revised, oldand new business rules;
(5) In case the tariff is changed, old and newtariffs.
(Piling of Periodical Report)Article 3. In accordance with the provision of
Article 7 of the Law, the warehouseman whohas obtained the licence as provided for inArticle 1 of the Law shall without delay file*the undermentioned periodical reports, induplicate respectively, with the Minister ofTransportation through the Chief of RegionalMaritime Bureau or the Chief of RegionalLand Transportation Bureau who has thejurisdiction over *the locality of the office con-cerned :(1) Reporto*n the monthly volumes of deposited
good! warehoused and delivered and the
volume of stockon hand as of the end ofeach month (as per Form No. 3);
(2) Report on the monthly amounts of ware-house instruments issued and recovered andthe amount outstanding thereof as of theend of each month (as per Form No, 4);
(3) Inventory, balance sheet, statement ofprofit and loss and statement of disposal ofprofit and loss and business report at theend of each business term.
(Filing of Casual Report)Article 4. In accordance with the provision of
Article 7 of the Law, the warehouseman whohas obtained the licence provided for in Article1 of the Law shall, in the case falling underany of the following items, file without delaythe casual report stating to that effect induplicate with the Minister of Transportationthrough the Chief of Regional Maritime Bureauor the Chief of Regional Land TransportationBureau who has the jurisdiction over the local-ity of the office concerned:(1) In case he has changed his full name or
title, or locality of the main office;(2) In case he has revised the articles of in-
corporation ;(3) In case he has been declared bankrupt;(4) In case he has newly established or in-
creased appurtenant equipments or he hasmade a great alteration to the existing equip-ments;
(5) In case he has suspended or discontinued,

wholly or partly, this warehousing business,or resumed, wholly or partly, such suspendedwarehousing business ;
(6) In case he has commenced a collateralbusiness or a side business or discontinued it;
(7) In case any of the officers has beenchanged ;
(8) In case any of the officers had been indictedand the definite decision has. been giventhereto ;
(9) In case there has taken place a seriouslawsuit concerning warehousing business andin case the decision has been given thereon;
(10) In case any other serious matter concern-ing warehousing business has occurred.
2 To the report provided for in the precedingparagraph shall be attached the undermen-
1 tioned documents:(1) In case the full namehasbeen changed,an
abstract copyofthe census register; #(2) In case where a juridical person has
changed its title or locality of the main office,an abstract copy of the register;
(3) In case where the articles of incorpora-tion has been revised, copies of old and newarticles of incorporation ;
(4) In case where any of the officers has beenchanged, his personal history.
(Report on the Commencement of WarehousingBusiness)
Article 5. Any person who intends to make areport on the commencement of warehousingbusiness in accordance with the provision ofArticle 7-(2) of the Law shall submit in dupli-cate the report on the commencement of ware-housing business stating the following mattersto the Minister of Transportation through theChief of Regional Maritime Bureau or theChief of Regional Lanjd Transportation Bureauwho has the jurisdiction over the locality ofthe main office within thirty (30) days afterthe commencement of the said business, andtwo copies thereof to the Chief of RegionalMaritime Bureau or the Chief of Regional LandTransportation Bureau who has the jurisdic-tion over the locality of the branch office, re-spectively :
(1) Full name ortitle of reporter and localityof the main office;
(2) Timeof commencement of the said business.2 To the report referred to in the preceding
paragraph shall be attached the following'documents :(1) Business program:
Matters asmentioned in Article 1 paragraph2item (1) a) and b);
(2) Business rules:Matters as mentioned in Article 1 para-
graph2 item (2) a), b),d),e),f), g), h)and i);
(3) Tariff:Matters as mentioned in Article 1 paragraph
2 item (3);(4) Other documents:
1) In case of a juridical person, the state-ment of historical record, copy of articlesof incorporation, certified copy of registerand personal histories of executive officers ;
2) In case of a natural person, an abstractcopy of the census register and his personalhistory ;
3) Specification of -warehouse, sketch ofenvironment of the warehouse and planshowing the arrangement of warehouses,and dimensions thereof.
(Filing of Periodical Report by the Ware-houseman other than Those who have Obtain-ed the Licence as prescribed in Article 1 ofthe Law)
Article 6. In accordance with the provision ofArtiole 8 of the Law, the warehouseman otherthan those who have obtained the licence asprescribed in Article 1 of the Law shall,without delay, file the report on the monthlyvolumes of deposited goods warehoused anddelivered and the volume of stock on hand asof the end of each month in duplicate with theMinister of Transportation through the Chiefof Regional Maritime Bureau, or the Chief ofRegional Land Transportation Bureau who hasjurisdiction over the locality of the office con-cerned.(Filing of Casual Report by the Warehouseman
other than Those who have Obtained theLicence as Prescribed in Article lv of theLaw)
Article 7. In accordance with the provision ofArticle 8 of the Law, the warehouseman otherthan those who have obtained the licence asprescribed in Article 1 of the Law shall, inthe case falling under any of the followingitems, file, without delay, a casual report stat-ing to that effect in duplicate with the Min-ister of Transportation through the Chief ofRegional Maritime Bureau, or the Chief ofRegional Land Transportation Bureau who hasthe jurisdiction over the locality of the officeconcerned :
(1) In case he has changed his name or title,or the locality of the main office;
(2) In case the articles of incorporation havebeen changed ;
(3) In case he has been declared bankrupt;(4) In case he has suspended or discontinued
to operate warehousing business;(5) In case the executive officers has been
changed ;(6) In case other important fact has occurred
in relation to the warehousing business.

2 To the report referred to in the precedingparagraph shall be attached the followingdocuments :(1) In case he has changed his name, an ab-
stract copy of the census register;(2) In case a juridical person has changed its
title or the locality of the main office, anabstract copy of register-book ;
(3) In case the articles of incorporation havebeen revised, copies of new and old articlesof incorporation ;
(4) In case any of the executive officers hasbeen changed, his personal history. ^
(Administrative Government Offices Enable toOrder to Submit Reports, etc.)
Article 8. The administrative government officereferred to in Article 8 paragraph 1 of theLaw shall be the Minister of Transportationand the Chief of Regional Maritime ftureau
or the Chief of Regional Land Transportation
Bureau,(Identification Card Testifying to Official
Status)Article 9. The identification card (as per Form
No, 5) referred to in Article 8 paragraph 2 ofthe Law shall be issued by the Minister ofTransportation, or the Chief of RegionalMaritime Bureau, or the Chief of RegionalLand Transportation Bureau.(Periodical Inspection on the Business of Is-
suance of Warehouse Instruments)Article 10. In accordance with the provision of
Article 8 of the Law, the Minister of Trans-portation and the Chief of Regional MaritimeBureau or the Chief of Regional Land Trans-
portation Bureau shall, once every year, causethe competent officials to conduct a periodicalinspection on the conditions of the business ofissuance of warehouse instruments held by theperson who has obtained the licence prescribed
in Article 1.2 The provision of the preceding paragraph
does not affect the powers of the Minister ofTransportation and the Chief of RegionalMaritime Bureau or the Chief of RegionalLand Transportation Bureau to cause, as oc-casion demands, the competent officials to in-spect the conditions of business managementand equipments of the warehousemen.(Requirements for Business Program, etc.)
Article ll. The requirements as pr-ovided for inthe respective items of Article 9 paragraph 1of the Law shall be as follows:
(1) The structure and equipments of ware-house:
1) That they have proper intensity accord-ing to the condition of the site of the ware-house and the nature of deposits;
2) That effective fire-protection and fire-fighting structure and equipments such as
fire-proof structure, fire-protection structureor fire-extinguishers are furnished accord-ing to the condition of the site of the ware-house and the nature of deposits;
3) That effective burglar-proof structure and
equipments such as side-walls, fences,lighting or alarm bell or signals arcfurnished according to the condition ofsite of the warehouse and the nature ofdeposits ;
4) That effective equipments such as water-proof, anti-dampness and rat-proof equip-ments are furnished according to the con-dition of the site of the warehouse and thenature of deposits;
5) That in case of a warehouse with con-stant temperature.appropriate structureand equipments are furnished to enable itto keep the inside of the warehouse con-
stantly at the temperature prescribed bythe regulation.
(2) Business rules:1) That the matters listed in Article 1 para-
graph 2 item (2) are precisely stipulated in
the business rules;2) That there is no possibility that thein-
terest of depositors or the bearers of ware-house instruments is unduly prejudiced ;
3) That the business rules shall not be sodevised as to unduly lessen the respon-sibility of the warehouseman ;
4) That the business rules shall not""involveany factor which may make the manage-ment of the warehouse business unsound,
(3) Tariff:That the charges and fees are fixed on the
basis of those as specified by Notification in.consideration of reasonable prime cost for

Article 12. The procedures for holding a publichearing in accordance with the ^provision ofArticle 9 paragraph 2 of the Law shall be setforth by the Minister of Transportationseparately.

(Report on the Succession of WarehousingBusiness)
Article 13. The person who has succeeded to the
warehousing business by succession under theprovisions of Article ll of the Law shall with-out delay submit the report on the successionto the warehousing business stating the mat-ters listed below in duplicate to the Ministerof Transportation through the Chief of Re-gional Maritime Bureau or the Chief of Re-gional Land Transportation Bureau who hasthe jurisdiction over the locality of his mainoffice:
* (1) Full names of successor and successee1
(2) Locality of the main office;
(3) Lineal relations of the successor with the
successee ;(4) Time of commencement of succession ;^
(5) Scope of warehousing business succeeded.
2 To the report referred to in the precedingparagraph shall be attached the followingdocuments :
(1) A certified copy of census register, per-
sonal history, latest tax-payment certificateand report on properties; %
(2) Written consent of the successor, otherthan the reporter on the succession of thewarehouse concerned by the reporter.
(Succession of Rights and Obligations basedupon the Licence for Issuance of Warehouse
Instruments)Article 14. Any person who intends to make an
application for approval to succeed the rightsand obligations based upon the licence for is-suance of warehouse instruments in accordancewith the provision of Article ll-(2) of the Lawshall submit the application for approval tosucceed the licence for issuance of warehouseinstruments stating the matters listed belowin duplicate to the Minister of Transportationthrough the Chief of Regional MaritimeBureau or the Chief of Regional Land Trans-portation Bureau who has the jurisdiction overthe locality of his main office:
(1) Full name ov title of successor and suc-
cessee;(2) Localities of both successor's main office
and successee's main office;
(3) Scope of warehousing business to be suc-ceeded ;
(4) Reasons why such succession is necessary;
(5) The date of succession.

.2 To the application referred to in the preced-ing paragraph shall be attached the following
documents :
(1) Written consent of successee;
(2) Documents as mentioned in Article 1 para-graph 2 item (4) a) or b).
(Publication of Business Rules, etc.)
Article 15. The warehouseman shall make publichis business rules and tariff by means of post-ing at some place noticeable at the office con-
cerned.
(Announcement of Granting Licence for Is-suance of Warehouse Instruments, etc.)
Article 1*6. In case the granting of the licence
for issuance of warehouse instruments or thecancellation of the licence, the suspension ofthe issuance of warehouse instruments or thesuccession of the rights and obligations basedon the licence for issuance of warehouse in-struments has been effected, the Minister of
Transportation shall officially announce thematters listed below. The same shall applyto the case where the matters which had betenofficially announced were changed :
(1) Full name or title;
(2) Locality ofvmain office;
(3) In case the licence for issuance of ware-house instruments was granted or the licencewas cancelled, the date thereof;
(4) In case the rights and obligations on thelicence for issuance of warehouse instrumentswere succeeded, the date of succession;
(5) In case the issuance of warehouse instru-ments was suspended, the date of suspensionand the period of suspension. v
Supplementary Provisions :
1. This Ministerial Ordinance shall come intoforce as from the day (July 1, 1950) of enforce-ment of the Law for Partial Amendment tothe Warehousing Business Law (Law No. 106of 1950),
2., The Enforcement Regulations of the Law forPartial Amendments to the Warehousing Busi-ness Law (Ministry of Commerce and IndustryOrdinance No. 6 of 1935) shall be abolished.
3. The provision of Article 5 shall apply mu-tatis mutandis to the report prescribed inparagraph 2 of the Supplementary Provisionsof the Law for Partial Amendment to theWarehousing Business Law.

with constant temperature.
3. "Floor space or capacity" will be shown, in the case of warehouse with constant tem-
perature, in cubic tsubo and in the case of other warehouses, in tsubo.
4. The column "Outline of structure" shall be filled per each building according to the fol-
lowing examples :
Example: Reinforced-eoncrete built, 5 storied including basement; brick built and asbes-
tos-slate-roofed one-storied warehouse : godown-style, tile-roofed one-storied warehouse ;
wood-frame mortar coated tile-roofed one-storied warehouse ; etc.
5. In the column of "Kind of goods to be stored" shall be entered, as for ordinary ware-
house, such items as general goods, A-class dangerous goods, B-class dangerous goods and
specially dangerous goods and as for refrigerating chamber, such items as marine pro-
ducts, farm products, live-stock, ice and others. i
6. "Lowest temperature prescribed by the regulation" shall be entered only in the case of
warehouse with constant temperature.^i

(Excerpt from the Warehousing Business Law)
Article 8, The administrative government office may, when it is deemed necessary* order
the person who has the warehouseman to submit reports on his business or cause
competent officials to inspect the condition of business management and equipments
of the warehouseman.
In conducting the inspection in accordance with the provisions of the preceding
paragraph the competent officials shall carry their identification cards testifying to
their official status.
The inspection as provided for in paragraph 1 shall not be construed as being
authorized for the purpose of criminal search.
Article 14. In case the warehouseman falls within the purview of any of the following
items, he shall be liable to a fine not exceeding ten thousand (10,000) yen:
2. In case he has failed to make a report in accordance with the provisions of Article
7 or 8 or has made a false report, or has refused, prevented or evaded the in-
spection prescribed in Article 8.
