Article 2. (a) The general body of the Devalaya shall be composed of the founder Mahajans mentioned in th~ annexed list and those persons professing Hindu religion, who may in future be admitted as Mahajans by the managing committee of the Devalaya irrespective of caste, creed, class, sect. or family group to which such person may belong on payment of such enrolment fee as may be prescribed for the purpose by the General Body of the Devasthan which fee in no case shall totally exceed to Rs. 5001/-

(b) Any person once enrolled as Mahajan shall enJoy rights, privileges, h'onours and obligations alongwith all other Mahajans as per the laws and bye~laws in force unless he is prevented to enjoy the same in terms of these bye-laws or the laws in force.

Article 3. (a) The right of all Mahajans including of those who may be admitted as Mahajans in terms 6f prece.ding article is hereditary and perpetual in the ma:sculine lineage and is transmitted from generation to generation by consanguinity or by legal and religious adoptions. This right is effective once a person of major age and is duly enrolled as Mahajan including those who may be admitted as. Mahajans in terms of preceding article.

(b) The list of all the Mahajans shall be properly maintained by the managing committee and a upto date copy of the same shall be displayep on the notice board of the Devalaya in the month of January every year.

Article 4. (a) All those professing the Hindu religion-, urespective of caste, creed or family group shall be allowed according to usage and customs to render worship in the premises of the Devalaya and also to perform rites/acts to institute festivities and to make donations to Devalaya.

(b) Such acts shall however be in no way entitle them to claim Mahajanship of the Devalaya.

Article 5. Every Mahajan shall pay to the Treasurer of the Devalaya a fixed annual subscription or such fee as may be prescribed for the purpose by the General Body of the Mahajans of the Devalaya.

(a) There being incurred any extraordinary expenses which the treastry of the Temple cannot afford or there being a deficit in the ordinary expenses under resolution of the Mahajan Body a subscription among the Mahajans will be opened.

Article 6. 'The member of the managing committee shall be res1)Onsible tb carry out the duties and work relatmg to the Temple without any remuneration.

5. The miscellaneous articles and utensils.

All the above lmmovable and movable assets will be listed in the inventory book of the Temple.

Article 7. (3) The employees of Devalaya who are in use of landed properties of Devalaya.in lieu of their services shall not have the right to sell, mortgage or otherwise dispose off such properties. After the resignation or termination from the services of the Devalaya he/they should immediately hand over the property/properties peacefully to the Devalaya.

(4) Body of Mahajans have the nght to suspend or terminate the service of the employee who brings obstructions directly or indirectly to the interest of movable and immovable properties of the Temple.

Income and Expenditure:

Article 8. (1) Income consist of"

a) Income derived from immovable properties.

b) Interest on funds of the Temple.

c) Gifts and donations in cash.

d) Income defived from various religious acts.

e) Offers given by the MahaJans and Devotees m the form of articles. 0

f) The proceeds of auctioned articles on festivities.

g) Subscription, entrance and other fees.

h) Eventual receipts.

8. (I)(a) Every Mahajan has to pay Mahajanship in every year of Rs. 100/-.

8. (II) The Expenditure consist of:

a) Maintenance, decoratlOn and cleanliness of the Temple.

b) Festivities and religious performance of the Temple.

c) Land revenue and other Taxes.

d) Towards modification, sup~rvision and construction of Temple.

e} Towards management and salaries of servants.

f) Eventual expenses.

8. (2)(b) Oil expenses or Lighting of Nandadeep expenditure.

Worship, annual Festivities, Religious Performances of Mahajans and Devotees:

Article 9. (1) Daily worship: Every morning and evening there shall be lighting of permanent nandacteeps. The ceremonies of the morning shall be over by the mid-day by doing Naivedya and of the light upto twenty hours, but they may be extended on feasts day.

Article 10. Annual Ceremop.ies

1. In the mo'nth of .Chaitra:

a) Varsha Pratipada (Gudi Padva)

b) Shn Vajarenass -puja (Mathan) with the help of Vangdies and Budvant

2. In the Month of Vaishakh:

a) Akshaya T;uthiya (Akhtay)

a) GadeJagan -with the help of Budvant.

4. In the month of Ashad:

a) Ashad poornima.

5. In the month of Shravana:

a) Every Monday there will be puja in main temple i.e. Garuvaipurush Temple.

b) Poornima.

6. In the month of Bhadrapada:

a) Naveam Trutiya (Navim).

b) Ganesh Chaturthi.

7. In the month of Ashwin:

a) Navaratra -Shudha Pratipada.

b) 5th day-Shudha Panchami Small Navami (Dhakli Nom).

c) 7th day Shudha Saptami Vodly N avami (Vodli Nom).

d) Diwali.

8. In the month of Kartik:

(a) Shudha Pratipada-Balipratipada.

b) Shudha Dwadashi -Tulshiviwah.

c) Poornima.

9. In the month of Paushya:

(a) Makar Sankranti

10. In the month of Magha:

a) There is old immemorial custom of celebra­ting/having medicin~ (Vakad) with the help of 2nd Vangadi. ..

b) Mahashivaratri.

b) Shudha Dashmi -Pooja.

c) Shudha Chaturdashi -Shigmo last.

d) Shudha Poornima. -Palki proceeding from Gharwaipurush 1'emple tv Siddhpurush Temple after having Word from Shri Shantadurga Avtar. Budvant Avtar (Gavki Adhikari) and Panchbhas Avtar. Again there will be a Shri Shantadurga Avtar at Shri Siddhapurush Temple after having the word from the said Avtar, Divjam and Gudi utsav start and in certain cases above mentioned two Avtars exists,..Kaul Prasad from Shantadurga A vtar.

e) Vaidya Tritia-Gadja Matha and Akshapan. Every Amavasya of the year Mawhanaivedhya (Vadi) in the Main Temple of Shidhapurush (Garavaypurush) with podd from Mahajan.

Article 10. (a) The specific traditional duties and privileges assigned to some representatives of founder Mahajans in certain religious performances are maintained as they haVe been doing hitherto.

Article .11. The Devotees who desire toperlorm the below mentioned religious ceremonies shall pay besides the respective expenses to celebrate particular ceremony. The below mentioned fees subject to such modifications as may be made by the body of Mahajans from time to time.

Article 11. a) Every Mahajan's pooja have to be done without any charges Le. whatsoever pooja item should be fulfilled by the Mahajan himself to make the pooja. in his name.

Employees - Their duties and Remuneration:

Article 12. The employees, staff of the Temple are:

Devli -On every festival day at the time of pooja Devli have to put shinga phuke and also at the time of Shigmo.

Clause (a) The employees staff of the Templ~ referred m this article shall perform their duties carefully and with the trust under the supervision of the managing committee and/Budvant

Clause (b) Duties of pujarilVelip- It is the duty of pu]ari/velip to collect the flowers, Tulsi, in the morning cleaning the Temples Devara, oiling and lighting the Nandadeeps placed in the Gharbagraha and other places, to dictate the pooja and other ceremonies of mahajans and devotees at their costs, to make artis, prasad etc. to place the image in palki, to stay in the Temple during the respective timeMtable, to maintain in his possession the objects and clothes of daily. use of the' deity.

Clause (c) Duties of vangdis- On every festival( /ceremonies days it is the duty of vangadis to be present in the Temple and should perform his/their traditional religious duties.

Clause (d) Duties of Devli- It is his duty to clean all the Temples before 7.30 a.m. He should bring in the morning the flower and Tulsi. In addition to this whenever there is any Devakrutya, he has to keep everything ready for the sa!?e, also to tell the Devotees to take prasad in their turn. At night he is required

to light and put off the lamps, to decorate palankin, closing of doors at night, he IS a secretary to the Budvant.

Clause (e) Duty of blacksmith- To repair the small works of the Temple, to repair the Palankin, Kalas etc. It is his duty to be present In the Temple on all festIval days if need arises.

Clause (f) Duty of Gosavi- It is the duty of the Gosavi to arrange food and keep It· ready to perform the shudi day ( after death) as well as to be present on harvesting day.

Clause (g) Duty of Mhalo- His duty is to render service of hair dressing of every Mahajan at his residential place.

Clause (h) Duty of Modgin- To be present in the Temple or usual meeting place in the month of Bhadrapad and to bnng the Ganesh deIty and also

.keep ready Divjam putting the coconut oil on the Divja Utsav day and also to ready horse on Gudi Padva day.

Clause (i) Duty of washerman (Modvoll)- His duty is to keep ready platform at the occasion of marriage ceremony and wash the God's clothes.

Clause (j) Besides the services normally done in the Temple each one of"the employee IS bound in duty to render occasional services of their competency according to the customs followed upto the date.

(b) Besides the pujari or other servants there may be more remunerated staff if necessary, according to the needs of service if being left to the managmg committee and Budvant to eng,age such staff fixing the remuneration to be pald to them provided there are sufficient funds to meet the expenditure which acts of the managing committee should be later on confirmed by the general body of the Mahajans in the immediately next meeting.

Remuneration of the employees:

Clause I. Pujari/Velip- He wlll be remunerated by yearly salary) of Rs. 100/-.

Clause 2. Vangadis~ Will be remunerated by yearly salary of Rs.lO/-.

Clause 3. Blacksmith- Yearly salary or kind crop (Rice) (Row Rice 100 kg.).

Clause 4. Devli- He will get 1/8 share of nee,' coconuts, and other eatable commodities offered to the deity by the devotees and Maha)ans. (25 kg. nce, 2~ coconuts).

Clause 5. Gosavi- Yearly salary of Rs. 100/- or kind crop (rice 25 kg.).

Clause 6. Mhalo- Yearly salary of Rs. 500/- or kind crop. (Rice 200. kg.).

Clause 7. Modgun- Yearly salary of Rs. 10/- and subscription of Re. 1/- or 2 bananas from each woman

those will be present to celebrate the festivity of Divjam.

Clause 8- Modvoll (washerman)- Yearly salary of Rs. 50/- or kind crops. .

Penal and other Disposition:

Article 13. (a) The. following are the punishments prescribed for those servants who will not perform his/their duties in right manner or disobeying the orde~s of Mahajan sabha or managing committee in relation to Temple Administration.

Clause 1. The servant who do not comply his/their duties shall be punished by the managing committee and Budvant warning for the first time with suspension for the second time and for third time his services shall be terminated by the managing committee and Budvant with prior consent of General Body Meeting of Temple who should decide the issue even in ordinary session.

(b) The managing committee or the General Body shall nqt inflict any penalties on the Mahajans or the employees of the Devalaya unless they are given opportunities of being heard to defend their case.

(c) Against the penalties imposed by the managing committee and Budvant there shall be an appeal to the General Body of the Devalaya and then after one may approach the Administrator of Devalayas.

Other Dispositions:

(d) The pujari/Velip shall not solemnize any worship without prior collection of respective fees as prescribed In article 11 by passing. a receipt over a signature of the secretary of the Managing Committee of the Temple.

(e) The religious duties or any other religious performances shall be performed through the Velip/pujari. In case the pujari/velip is absent the Velip's/pujari's son will do the same.

(f) Proceeds of worship not shown in the article 11 wlll be distributed at 25% to the Temple Treasury.

Article 14. The Administration of the Devalaya shall be regulated by these bye-laws and by the Regulamento das Mazanias in force as well as by any general or special laws and regulations applicable or which may be applicable to such institution in future.

(a) It is prohibited in the temple for any person to smoke, to spit, to enter inside the Temple with covered feet, drunk with any stimulating liquid or any attitude or gesture of arranging conflicts or quarrels,

(b) It is vested on the General Body of Mahajans the power to resolve the matters inherent to the worship resolution where they are not specifically vested in the Managing Commi,tee.

(c) Amendments, changes, alterations or modi­fications of legal provisions in these bye-laws will be done by the 2/3 majority of the Body of Mahajans. Notwithstanding the above proviSion, the bye-laws

regarding customs and traditions pos~ibly will not be changed.

Article 15. Budvant- He is the head of vlllag,!, Mahajans and five vangdis.

(a) To perform any religious festivities, Budvant should call the meeting of Mahajans and vangdis as usual meeting place by sending the message with DevIi. With· his (Budvant) abse.nce vangdis and pujari/Velip have no right to do any. religious festivities. Even marriage ceremony on the attached ground (Mandd) of Gharvaipurush Temple (main temple of sidhapurush) as per our custom and tradition followed from last many generations.

(b) Any absence of Vangdis during the religious ceremony/ Festivals then that festival/ceremony should be kept pending till the Budvant take appropriate decision. His decision is final after due enquiries with Mahajans.

(c) Budvant should be hereditary or should be any member of his family with his permission.

(d) With his words religious festivals/ceremonies start or end. (Sanganyo, Pauni, Sakarpuddo, village meeting with vangdis and Mahajans.)

(e) To perform any religious ceremony/festivals. Mahajans have to give podd to the above mentioned Temple. Then the pujari/Velip has/have to do the puja.

(f) To appoint any vangdi, then there should be Budvant and rest vangdis at the time of prassad taking.

(g) Every festival start from Garvaipurush Temple to rest of the temples on their' festival day.

(h) Tulshi- Vrundavan and Ganesh Chaturthi is common to all Mahajans, Villagers. (Only one Tulshi Vrundavan of all Mahajans)

Article 16. The keys of Gharvaipurush Mot and that of Shri Siddhapurush Devasthan shall be with the Budvant.

Article 17. The above constitutional bye-laws and regulations shall come into force within five days after its publication in the Official Gazette.

Signatures of the members of special committee appointed by the Govt. by order No. 15/11/98/CAN/ /DEV/1223 dated 16/10/1998.

Article 18 -All the Administration management and other affairs shall be regulated and performed as prescribed by the "Regulamento dasMazanias" amended upto date.

In exercise of the powers conferred upon me under Section 112 of the provisions of Motor Vehicles Act, 1988 (Central Act 59 of 1988) and after consulting the Superintendent of Police (North), Panaji, I hereby order the construction of "Speed Breakers" on the road leading towards Curca~Batim from Goa Velha, near Popular High School within the jurisdiction of Village Panchayat, Goa Velha in Tiswadi Taluka.

Further, in exercise of the powers conferred on me under Section 116 of the said Act, I also authorise the erection of Traffic Sign Boards "Speed Breakers" and "Drive Slow Speed Breaker Ahead" at the' appropriate place against the above Speed Breaker in order to regulate the motor vehicular traffic.
