Shri Raghuvir S. Desai, while functioning asWatchman in the Govt. High School, Malkarnem,Quepem during the period from 23-01-1999 to06-08-2003 has committed an offence of rape on minorchild of 8 years old schooling in the said School. Thesaid Shri Raghuvir S. Dessai has committed this offenceon 06-08-2003.

Taking into consideration the seriousness of theoffence Shri Raghuvir S. Dessai, watchman has beensuspended from services vide Order No. 44/272/2003//Adm.I/Vig-Cell/1038 dated 07-08-2003.

On a complaint filed by the parents of the girl child,a criminal case was lodged in the Court of the Ad-hocAsstt. Sessions Judge, Fast Track Court-II, South Goa,Margao which was registered under No. 34/2003 titledas �State V/s Raghuvir Desai�. On hearing theconcerned parties and considering the relevantevidence the Hon�ble Court delivered its judgmentin the matter on 13-06-2005 thereby convictingShri Raghuvir S. Desai, the accused in the said caseunder Section 376 and 342 of Indian Penal Code forwrongfully confining the girl child in the office of theschool and raping her in the school premises. Furtherthe Hon�ble Court vide judgment dated 15-06-2005 inthe said case has ordered the said accused to undergorigorous imprisonment for 10 years and also topay the fine of Rs. 5000/- and in default, to undergorigorous imprisonment for 4 months and order to paya fine of Rs. 500/- for the offence under Section 342 ofIndian Penal Code and in default of paymentof fine to undergo rigorous imprisonment for one month.

The said Shri Raghuvir S. Desai has challenged theabove referred judgments/order of the Hon�ble SessionJudge in the Bombay High Court of Panaji undercriminal appeal No.44/2006 which came to be decidedon 28-09-2006. The Hon�ble High Court has dismissedthe appeal having no merit in it.

With the aforesaid fact, it has been proved beyonddoubt that Shri Raghuvir S. Desai, the Watchman hasbrutally committed an heinous offence of rape on aminor girl child who was a student of that Schoolwhere the said Shri Desai was a Watchman.

I have carefully examined both the judgments ofHon�ble Sessions Court and High Court referred toabove, and also gone through the pros and cornsof the case and has come to the conclusion thatShri Raghuvir S. Desai, Watchman has committed anact of unbecoming of Government servant.

With the above said act, it is proved thatShri Raghuvir S. Desai, watchman has failed tomaintain absolute integrity, exhibited lack of devotionto his duties and acted in a manner of unbecoming ofa Government servant thereby violating Rule 3 (1) (i)(ii) and (iii) of the Central Civil Service (Classification,Control and Appeal) Rules, 1965.

On considering the act of misconduct elaboratedabove and on considering the gravity of the matter, Iam convinced that the official Shri Raghuvir S. Dessai,Watchman should be dismissed from the Governmentservice.

Now therefore, in exercise of the powers conferredunder Rule 19 (i) of the Civil Central Services (Classification,Control and Appeal) Rules, 1965 the undersigned inthe capacity of the Disciplinary Authority herebydismiss Shri Raghuvir S. Dessai, watchman fromGovernment Service with immediate effect.
