ATTORNEY'S REPORT

A motion passed to close the session to prevent the disclosure of information that is confidentialpursuant to sections 90-8, 90-14, 90-16, 90-21.22 of the North Carolina General Statutes and notconsidered a public record within the meaning of Chapter 132 of the General Statutes and topreserve attorney/client privilege.

End-of-Life Responsibilities and Palliative CareIt was previously decided to prepare a position statement regarding palliative care. Dr

Barrett and Dr Trado prepared the following position statement. It was noted that a copy of thedraft was sent to James A. Tulsky, MD, associate professor of medicine at Duke and director ofthe Program on the Medical Encounter and Palliative Care at the Duke and Durham VA MedicalCenters. Dr Tulsky's response was an enthusiastic endorsement of the statement, its languageand form. He expressed hope that the Committee and the Board would adopt it. The draft wasreviewed by the Committee and a minor change was made.

Recommendation to Board: That the following position statement be approved.

END-OF-LIFE RESPONSIBILITIES AND PALLIATIVE CARE

Assuring PatientsDeath is part of life. When appropriate processes have determined that the use of life-sustaining or

invasive interventions will only prolong the dying process, it is incumbent on physicians to accept death "not asa failure, but the natural culmination of our lives. "*

It is the position of the North Carolina Medical Board that patients and their families should be assured ofcompetent, comprehensive palliative care at the end of their lives. Physicians should be knowledgeableregarding effective and compassionate pain relief, and patients and their families should be assured such reliefwill be provided.

Palliative CareThere is no one definition of palliative care, but the Board accepts that found in the Oxford Textbook of

palliative Medicine: "The study and management of patients with active, progressive, far advanced disease forwhom the prognosis is limited and the focus of care is the quality of life.

" This is not intended to excluderemissions and requires that the management of patients be comprehensive, embracing the efforts of medicalclinicians and of those who provide psychosocial services, spiritual support, and hospice care.

A physician who provides palliative care, encompassing the full range of comfort care, should assess hisor her patient's physical, psychological, and spiritual conditions. Because of the overwhelming concern ofpatients about pain relief, special attention should be given the effective assessment of pain. It is particularlyimportant that the physician frankly but sensitively discuss with the patient and the family their concerns andchoices at the end of life. As part of this discussion, the physician should make clear that, in some cases,there are inherent risks associated with effective pain relief in such situations.

Opioid UseThe Board will assume opioid use in such patients is appropriate if the responsible physician is familiar

with and abides by acceptable medical guidelines regarding such use, is knowledgeable about effective andcompassionate pain relief, and maintains an appropriate medical record that details a pain management plan.(See the Board's position statement on the Management of Chronic Non-Malignant Pain for an outline of whatthe Board expects of physicians in the management of pain. ) Because the Board is aware of the inherentrisks associated with effective pain relief in such situations, it will not interpret their occurrence as subject todiscipline by the Board.

Joint Statement (Medical, Pharmacy & Nursing Boards) End-of-Life Responsibilities andPalliative Care - Draft Position Statement; Consideration Of

Mr. Watry has been working jointly with the executive directors of the Pharmacy andNursing Boards with follow-up from the End-of-Life Conference and one of the main elementsrequested as a result of that conference was a joint position from all three boards. Therepresentatives of these three boards are invited speakers to a national conference from theCitizen's Advocacy Center in Washington to address this issue and a key component of thisconference is highlighting the cooperative efforts of our three boards in North Carolina on thistimely issue. This group drafted a joint position statement from the three boards. The medicalcomponent of it reflects the previously adopted position statement of our Policy Committee.

Recommendation to Board: That the following position statement be approved.

JOINT STATEMENT ON PAIN MANAGEMENT IN END-OF-LIFE CARE

Through dialogue with members of the healthcare community and consumers, anumber of perceived regulatory barriers to adequate pain management in end-of-lifecare have been expressed to the Boards of Medicine, Nursing, and Pharmacy. Thefollowing statement attempts to address these misperceptions by outlining practiceexpectations for physicians and other health care professionals authorized toprescribe medications, as well as nurses and pharmacists involved in this aspect ofend-of-life care. The statement is based on:

the legal scope of practice for each of these licensed healthprofessionals;professional collaboration and communication among healthprofessionals providing palliative care; anda standard of care that assures on-going pain assessment, a therapeuticplan for pain management interventions; and evidence of adequatesymptom management for the dying patient.

It is the position of all three Boards that patients and their families should beassured of competent, comprehensive palliative care at the end of their lives.Physicians, nurses and pharmacists should be knowledgeable regarding effectiveand compassionate pain relief, and patients and their families should be assuredsuch relief will be provided.

Because of the overwhelming concern of patients about pain relief, the physicianneeds to give special attention to the effective assessment of pain. It is particularlyimportant that the physician frankly but sensitively discuss with the patient and thefamily their concerns and choices at the end of life. As part of this discussion, thephysician should make clear that, in some end of life care situations, there are

inherent risks associated with effective pain relief. The Medical Board will assumeopioid usein such patientsis appropriateif the responsible physicianis familiar withand abides by acceptable medical guidelines regarding such use, is knowledgeableabout effective and compassionate pain relief, and maintains an appropriatemedical record that details a pain management plan. Because the Board is awareof the inherent risks associated with effective pain relief in such situations, it will notinterpret their occurrence as subject to discipline by the Board.

With regard to pharmacy practice, North Carolina has no quantity restrictions ondispensing controlled substances including those in Schedule II. This is significantwhen utilizing the federal rule that allows the partial filling of Schedule II

prescriptions for up to 60 days. In these situations it would minimize expenses andunnecessary waste of drugs if the prescriber would note on the prescription that thepatient is terminally ill and specify the largest anticipated quantity that could beneeded for the next two months. The pharmacist could then dispense smallerquantities of the prescription to meet the patient's needs up to the total quantityauthorized. Government-approved labeling for dosage level and frequency can beuseful as guidance for patient care. Health professionals may, on occasion,determine that higher levels are justified in specific cases. However, theseoccasions would be exceptions to general practice and would need to be properlydocumented to establish informed consent of the patient and family.

Federal and state rules also allow the fax transmittal of an original prescription forSchedule II drugs for hospice patients. If the prescriber notes the hospice status ofthe patient on the faxed document, it serves as the original. Pharmacy rules alsoallow the emergency refilling of prescriptions in Schedules III, IV, and V. While thisdoes not apply to Schedule II drugs, it can be useful in situations where the patientis using drugs such as Vicodin for pain or Xanax for anxiety.

The nurse is often the health professional most involved in on-going painassessment, implementing the prescribed pain management plan, evaluating thepatient's response to such interventions and adjusting medication levels based onpatient status. In order to achieve adequate pain management, the prescriptionmust provide dosage ranges and frequency parameters within which the nurse mayadjust (titrate) medication in order to achieve adequate pain control. Consistent withthe licensee's scope of practice, the RN or LPN is accountable for implementing thepain management plan utilizing his/her knowledge base and documentedassessment of the patient's needs. The nurse has the authority to adjustmedication levels within the dosage and frequency ranges stipulated by theprescriber and according to the agency's established protocols. However, the nursedoes not have the authority to change the medical pain management plan. Whenadequate pain management is not achieved under the currently prescribedtreatment plan, the nurse is responsible for reporting such findings to the prescriberand documenting this communication. Only the physician or other healthprofessional with authority to prescribe may change the medical pain managementplan.

Communication and collaboration between members of the healthcare team, andthe patient and family are essential in achieving adequate pain management in end-

of-life care. Within this interdisciplinary framework for end of life care, effective painmanagement should include:

thorough documentation of all aspects of the patient's assessment andcare;a working diagnosis and therapeutic treatment plan includingpharmacologic and non-pharmacologic interventions;regular and documented evaluation of response to the interventions and,as appropriate, revisions to the treatment plan;evidence of communication among care providers;education of the patient and family; anda clear understanding by the patient, the family and healthcare team ofthe treatment goals.

It is important to remind health professionals that licensing boards hold eachlicensee accountable for providing safe, effective care. Exercising this standard ofcare requires the application of knowledge, skills, as well as ethical principlesfocused on optimum patient care while taking all appropriate measures to relievesuffering. The healthcare team should give primary importance to the expresseddesires of the patient tempered by the judgement and legal responsibilities of eachlicensed health professional as to what is in the patient's best interest.
