Compliance Status of Environmental Clearance Conditions – “Bihar Iron Ore Mine -Project of M/s Nirmal Kumar Pradeep Kumar.” located at village Merelgara, Chaibasa, District West

Singhbhum, Jharkhand.

SPECIFIC CONDITIONS i. The project proponent shall seek and obtain, within a period of one year, approval under the

FC Act for diversion of entire forest land located within the mining lease. Mining in such leases, after expiry of period of one year, will be allowed only if the user agency either obtains approval under the FC Act for the remaining forest area for which approval under FC Act has either not been sought or has been declined by the MoEF. Status of Compliance:- Presently the mine is not in operation since November, 2011 for want of statutory clearances. In this regard, the project has applied for the diversion of the entire forest land area over 51.686 Ha (already diverted 3.700Ha & safety zone 2.00Ha) vide letter no. – NP/019/2010 dated 10.03.2010, which is under process at the Office of PCCF for approval. As per the Section 8(6) of MMDRA Act, 2015 the mining lease may be extended up to 31.03.2020. Similarly as per present circular dated 01.04.2015 from MoEF, Govt. of India the forest clearance over 13.96 Ha will be extended up to the coterminous of the extended lease period.

ii. The project proponent shall abide by the guidelines and/or mechanism put in place by the FC division of MoEF in respect of such cases of mines where forest clearance has been accorded to only a part of the forest land involved in the mine. Status of Compliance:- The mining operations were confined to the already diverted forest area of 3.700 Ha & Non Forest area of 15.095 Ha only, remaining the terms & conditions mentioned in the Forest Clearance order vide letter No. 10-120/FCE dated 03.07.1996.

iii. The project proponent shall seek and obtain the required clearance under Wildlife (Protection) Act, 1972 from the standing Committee of the National Board for Wild Life (NBWL) as and when applicable. Status of Compliance:-

At present it is not applicable, as there is no such clear legal delineation of Elephant Habitats & Corridors available within 10 Km radius of Buffer-zone. However, the same will be obtained as and when it is applicable.

iv. The project proponent shall obtain Consent to Establish and Consent to Operate from the Jharkhand State Pollution Control Board and effectively implement all the conditions stipulated therein.

Status of Compliance:- We have obtained the Consent to Establish order from Jharkhand SPCB vide letter No. PC/NOC/JSR/150/11-G-2656 on dated 31.12.2012 and renewed of Consent to Operate order granted vide letter no.-PC/JSR/Air/N-08/02-B-6264 on dated 20.12.2013. All the stipulated conditions in the above Consent to Establish & Consent Orders are implemented effectively.

v. Measures for conservation of flora & fauna observed in the study area shall be undertaken. Wild life conservation plan shall be implemented in consultation with the state Forests & Wild Life Department. Status of Compliance:- Site Specific Wild life Conservation Plan has been prepared by M/s. FEM Project, Ranchi with the budgetary provisions of Rs. 133.00 Lakhs towards implementation of the different activities of wild life conservation plan in consultation with the State Forests & Wildlife Department & submitted at Chief Wildlife Authority, Jharkhand vide letter No.NP/205/2013, dated 23.05.2013 the same has been under final approval.

vi. Adequate measures for control of air pollution in the area shall be taken and it shall be ensured that the pollution level do not exceed the prescribed limit. Status of Compliance:-

As the mines are not in operation since, Nov 2011, there is no such air pollution. For air pollution control measures i.e. suppressing dust particles, water sprinkling facility will be provided with mobile as well as fixed water sprinklers. Regular maintenance of vehicles will be done to minimize the generation of pollutant gaseous particles. Apart from that, as per the MoEF&CC/CPCB guidelines, ambient air quality monitoring will be carried out with the help RDS machines & handy samplers. We will abide by the condition and follow the standards & norms prescribed.

vii. Necessary prior clearance, as applicable shall be obtained from CGWA for working below ground water table. Status of Compliance:-

The ultimate working depth of the mines area is at 425 m AMSL and mines working is already intersected the ground water table, in this regard the project has obtained the requisite clearance from CGWA for pumping of the ground water vide letter no. 21-4 (68)/CGWA/MER/2011-1059 dated 12.08.2011.

Singhbhum, Jharkhand. viii. The company shall submit within 3 months their policy towards Corporate Environment

Responsibility which should inter-alia provide for (i) standard operating process/process to bring in to focus any infringement/deviation/violation of the Environmental or forest norms/conditions, (ii) Hierarchical system or Administrative order of the company to deal with the environmental issues and for ensuring compliance with the EC conditions and (iii) system of reporting of non compliances/violations of environmental norms to the Board of Directors of the company and/ or shareholders or stakeholders. Status of Compliance:-

Company has established the corporate Environmental Management Policy to the standards of ISO 14001 and following the laid down standard procedures; planning, implementation & operations, checking, internal audit etc. towards monitoring and reporting of the non-compliances/violations of environmental norms.

ix. The mining operations shall be restricted to above the ground water table and it should not intersect the ground water table. In case of working below the ground water table, prior approval of the Ministry of Environment and Forests and the Central Ground Water Authority shall be obtained, for which a detail hydro-geological study shall be carried out. Status of Compliance:-

x. The project proponent shall ensure that no natural water course and/or water resources shall be obstructed due to any mining operations. The first order streams and the seasonal nallahs originating from the mining lease area shall be protected. Status of Compliance:-

It is ensured that no natural water course is disturbed/ obstructed due to mining activity.

xi. The top soil, if any shall temporarily be stored at earmarked site (s) only and it should not be kept unutilized for long. The top soil shall be used for land reclamation and plantation.

Status of Compliance:-

The generated top soils during the mines operations are kept separately with necessary precautionary measures to preserve the nutrient value of the top soil with the grass seed applications. The same will be utilized after commencement of the mines operation as the mines is not in operation since November, 2011.

xii. At the conceptual stage an area of 3.7 ha of non forest land will be covered under waste dump. Monitoring and management of rehabilitated areas should continue until the vegetation becomes self-sustaining. Compliance status should be submitted to the ministry of Environment & Forests and its regional office, Bhubaneswar on six monthly basis. Status of Compliance:-

There are three (3 nos.) number of dumps. All the dumps have been planted with native species & application of mixed grass seeds along the slope to stabilize and also to reduce wash off in case of rain cut during monsoon. Dump details have been shown by Table 1.

Back-filled area will be reclaimed accordingly by plantation. Monitoring and management of rehabilitated areas will be continued until vegetation becomes self-sustaining.

xiii. Catch drains and siltation ponds of appropriate size shall be constructed around the working

pit, sub-grade dump, soil and mineral dump to arrest flow of silt and sediment directly into the agricultural fields and the water bodies. The water so collected should be utilized for watering the mine area; roads, green belt development etc. The drain should be regularly de-silted particularly after monsoon and maintained properly. Garland drain, settling tanks & check dams of appropriate size, gradient and length shall be constructed around mine pit & sub-grade dump to prevent run-off of water & flow of sediments directly into the agricultural fields and the water bodies and sump capacity should be designed keeping 50% safety margin over and above peak sudden rainfall (based on 50 years data) and maximum discharge in the area adjoining the mine site. Sump capacity should also provide adequate retention period to allow proper settling of silt material. Sedimentation pits should be constructed at the corners of the garland drains and de-silted at regular intervals.

Status of Compliance:-

Site-specific measures are taken care like dump slope stabilization by planting of trees, grass seed applications etc. Besides, check dams, check weirs were constructed at strategic points inside the ML area to control the silt carry-over along with run-off into nearby water bodies, etc. However, the total mine run off is diverted to the mines pit for recharge cum harvesting purposes. Details regarding retaining wall have been shown in Table 2.

xiv. Dimension of the retaining wall at the toe of sub-grade dump and OB benches within the mine to check run-off and siltation should be based on the rain fall data. Status of Compliance:-

A total length of 155 meters of retaining wall has been constructed at the toe of the OB & sub-grade dumps with proper dimensions i.e. 1.2 M X 1.0 M by considering the rain fall data. Photo of the same is attached as Photo 1 & 2.

xv. Plantation shall be raised in an area of 12.282 ha in forest land & 1.288 ha in non forest land during the conceptual period excluding safety zone. Status of Compliance:-

The project has done the plantations along with gap filling of 5027 numbers of saplings including gap filling & road side plantation till the reporting period inside the mining lease area including the safety zones, ML Boundary, Road Side, etc. Plantation will be done in an area of 12.282 Ha & 1.288 Ha @ 1500 / ha during the conceptual period. Details of plantation done have been shown in Table 3. Photo of the same is attached as Photo 3 & 4.

Singhbhum, Jharkhand. xvi. Effective safeguard measures, such as regular water sprinkling shall be carried out in critical

areas prone to air pollution and having high levels of particulate matter such as around loading and unloading point and all transfer points. Extensive water sprinkling shall be carried out on haul roads. It should be ensured that the Ambient Air Quality parameters confirm to the norms prescribed by the Central Pollution Control Board in this regard. Status of Compliance:-

Regular water sprinkling will be carried out by engaging mobile water tankers in the dust prone areas and it will be ensured that the Ambient Air Quality parameters confirm to the norms prescribed by the Central Pollution Control Board in this regard.

xvii. The project authority should implement suitable conservation measures to augment ground water resources in the area in consultation with the Regional Director, Central Ground Water Board. Status of Compliance:-

Site-specific measures are taken care like settling pits; check weirs were constructed at strategic points inside the ML area to control the silt carry-over along with run-off into nearby water bodies, etc. However, the total mine run off is diverted to the mines pit for recharge cum harvesting purposes.

xviii. Regular monitoring of ground water level and quality shall be carried out in and around the

mine lease by establishing a network existing wells and installing new piezometers during the mining operation. The periodic monitoring [at least four times in a year Pre –monsoon (April-May), Monsoon (August), Post monsoon (November) and Winter (January): once in each season] shall be carried out in consultation with the State Ground Water Board/Central Ground Water Authority and the data thus collected may be sent regularly to Ministry of Environment and Forests and its Regional Office, Bhubaneswar, the Central Ground Water Authority and the Regional Director, Central Ground Water Board. If at any stage, it is observed that the groundwater table is getting depleted due to the mining activity; necessary corrective measures shall be carried out. Status of Compliance:-

Regular monitoring of ground water level and quality will be carried-out by utilizing the ground water level meter periodically as specified. The data will be submitted to authorities regularly after commencement of the mines operations, as the mines operation is stopped since, Nov 2011.

Singhbhum, Jharkhand. xix. Monitoring of the springs shall be carried out for the quality & quantity of water regularly so

as to ensure that there is no adverse impact on the same due to the project. Records in this regards shall be maintained. Status of Compliance:-

Regular monitoring of water bodies Karo River (U/S), Karo River (D/S), for quality will be carried-out periodically as specified after commencement of the mines operations, presently the mines is not in operation since, Nov 2011.

xx. It shall be ensured that there is no change in the hydrology of the area due to the project

Status of Compliance:- It is being ensured.

xxi. Suitable rainwater harvesting measures on long term basis shall be planned and implemented in consultation with the Regional Director, Central Ground Water Board. Status of Compliance:-

Suitable rainwater harvesting measures on long term basis has been implemented inside the ML area with the provision of the implementation of the site-specific measures like settling pits, check weirs at the strategic points inside the ML area to control the silt carry-over along with run-off into nearby water bodies, etc. However, the total mine run off is diverted to the mines pit for recharge cum harvesting purposes.

xxii. Appropriate mitigative measures shall be taken to prevent pollution of the Karo River, in consultation with the State Pollution Control Board. Status of Compliance:-

Suitable rainwater harvesting measures on long term basis has been implemented inside the ML area with the provision of the implementation of the site-specific measures like settling pits, check weirs at the strategic points inside the ML area to control the silt carry-over along with run-off into nearby water bodies, etc. However, the total mine run off is diverted to the mines pit for recharge cum harvesting purposes.

xxiii. Vehicular emissions shall be kept under control and regularly monitored. Measures shall be taken for maintenance of vehicles used in mining operations and in transportation of mineral

from mine face to the beneficiation plant. The vehicles shall be covered with a tarpaulin and shall not be overloaded. Status of Compliance:-

Preventive Measures will be taken for maintenance of vehicles used in mining operations and for transportation of mineral. The vehicles will be covered with tarpaulin and steps will be taken to ensure that the trucks should not be overloaded, after commencement of the mines operation.

xxiv. Blasting operation should be carried out only during daytime. Controlled blasting shall be

practiced. The mitigate measures for control of ground vibrations and to arrest fly rocks and boulders should be implemented. Status of Compliance:-

Controlled blasting will be done by using the Non-el technology. It will be followed in day time. Ground vibrations will be monitored so as to confirm the results very well within the norms.

xxv. Drills shall either be operated with dust extractors or equipped with water injection system.

Status of Compliance:-

Latest technology drilling machine with inbuilt dust extraction system will be utilized.

xxvi. Mineral handling area shall be provided with adequate number of high efficiency dust

extraction system. Loading & unloading areas including all the transfer points should also have efficient dust control arrangements. These should be properly maintained and operated. Status of Compliance:-

Regular water sprinkling will be carried out by engaging water tankers on the haulage roads, loading & unloading areas and other mineral handling points for dust suppressions.

Fixed - auto water sprinkling arrangement will be provided at mineral dispatch roads.

Apart from these arrangements, dry fog system along with hoods over conveyor belt will be installed in Crushers & screening plants for dust suppression.

xxvii. Sewage treatment plant shall be installed for the colony. ETP shall also be provided for workshop and waste water generated during mining operation.

Status of Compliance:-

Sewage treatment plant is not applicable, as there is no such township / workshop in the project.

xxviii. The project authorities should undertake sample survey to generate data on pre-project community health status within a radius of 1 KM from proposed mine. Status of Compliance:-

The project has undertaken the sample survey on the community health status within 5 Km radius from the mines area,

xxix. Pre-placement medical examination & periodical medical examination of the workers engaged in the project shall be carried out & records maintained. For the purpose, schedule of health examination of the workers should be drawn and followed accordingly. Status of Compliance:-

Initial Medical Examination & Periodical Medical Examination of the workers engaged in the project is being undertaken periodically for permanent and outsider employees along with the pre-medical examination of persons employed, who are engaged in the process of mining & are likely exposed to dust to observe any contractions due to exposure to dust. This is being carried as per in compliance to Mines Act 1952 & rules 1956 and amendments there to. The examination is being carried periodically for all the employees of the Project. The various tests include PFT, X-Ray, and lung spirometry etc. The above is being carried including all the tests as per FORM “O”.

xxx. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be removed after the completion of the project. Status of Compliance:-

Not applicable, as there is no such construction activity within the project area.

xxxi. The critical parameters such as RSPM (PM10) and NOx in the ambient air within the impact zone, peak particle velocity at 300m distance or within the nearest habitation, which-ever is closer shall be monitored periodically. Further, quality of discharge water shall also be monitored (TDS, DO, PH and Total Suspended Solids (TSS). The monitored data shall be

uploaded on the website of the company as well as displayed on a display board at the project site at a suitable location near the main gate of the company in public domain. The Circular No. J- 20012/1/2006-IA.II(M) dated 27.05.2009 issued by Ministry of Environment and Forests, which is available on the website of the Ministry www.envfor.nic.in shall also be referred in this regard for its compliance.

Status of Compliance:-

All these critical parameters will be monitored periodically & uploaded in the company website bearing the address www.nkpk.co.in and a display board showing different monitored parameters i.e. AAQ; PM10, PM2.5, SO2, NOx, STP, ETP discharge, for surface run off discharge from the mine (treated) etc. will be placed at the main gate of the project site of the company in public domain after commencement of the mines operations.

xxxii. A Final Mine Closure Plan along with details of Corpus Fund should be submitted to the

Ministry of Environment & Forests 5 years in advance of final mine closure for approval. Status of Compliance:-

We have submitted a Bank guarantee of Rs. 3.63 lakh for rehabilitation of 14.526 Ha mined out area @ 25, 000/- Ha as a part of the management of the mines closure of the Project. It has been approved by IBM in the scheme of mining on 23.02.2012.

GENERAL CONDITIONS

i. No change in mining technology and scope of working should be made without prior approval of the Ministry of Environment & Forest. Status of Compliance:-

Presently the mine is not in operation since, Nov 2011, however we have adopted the Mining method of the project as opencast mechanized having excavators, rock breaker, dumper combinations and sorting and sizing of the Iron Ore.

ii. No change in the calendar plan including excavation, quantum of mineral iron ore and waste

should be made. Status of Compliance:-

As there is no mines operation since, Nov 2011, there is no change in the calendar plan for excavation of the mineral ore, details of the last two years are as Table 4.

iii. Conservation measures for protection of flora & fauna in the core & buffer zone should be drawn up in consultation with the local forest & wild life department. Status of Compliance:- Site Specific Wild life Conservation Plan has been prepared by M/s. FEM Project, Ranchi with the budgetary provisions of Rs. 133.00 Lakhs towards implementation of the different activities of wild life conservation plan in consultation with the State Forests & Wild Life Department & submitted at Chief Wild Life Authority, Jharkhand vide letter No.NP/205/2013, dated 23.05.2013 the same has been recommended by PCCF for final approval. Copy of the same has been attached as Annexure – 6.

iv. At least four Ambient Air Quality – Monitoring stations should be established in the core zone as well as in the buffer zone for RSPM (Particulate matter with size less than 10 micron i.e.,

PM10) and NOX monitoring. Location of the stations should be decided based on the metrological data, topographical features and environmentally and ecologically sensitive targets and frequency of monitoring should be undertaken in consultation with the State Pollution Control Board. Status of Compliance:-

5 No’s of AAQ monitoring stations got established covering the core (1 no.- Mine Lease Area) as well as buffer zones (4 nos.- Merelgada, Nuamundi, Jojo Camp Colony and Barajamda). The locations of the stations have been decided based on meteorological data, topographical features and environmentally and ecologically sensitive targets. The frequency of sampling is weekly two times for each station.

v. Data on ambient air quality [RSPM (Particulate matter with size less than 10 micron i.e., PM10) and NOX]should be regularly submitted to the Ministry including its Regional office located at Bhubaneswar and the State Pollution Control Board / Central pollution Control Board once in six months. Status of Compliance:-

Six monthly ambient air quality monitoring data will be submitted to authorities regularly on six monthly basis, after commencement of the mines operation.

vi. Fugitive dust emissions from all the sources should be controlled regularly. Water spraying arrangement on haul roads, loading and unloading and transfer points should be provided and properly maintained. Status of Compliance:-

Water tankers along with auto-fixed type water sprinkling arrangements will be provided for water spraying in all areas, dry fog system with hoods over conveyor belts will be provided at crushing & Screening Plant after commencement of the mines operations.

vii. Measures should be taken for control of noise levels below 85 dB (A) in the work environment. Workers engaged in operations of HEMM, etc. should be provided with ear plugs / muffs. Status of Compliance:-

Workers engaged in Operations will be provided with earplugs / muffs. Besides having acoustic enclosures for all machines operating cabins will be provided. It will be monitored by Noise Level Meter by confirming the results well within norms.

Singhbhum, Jharkhand. viii. Industrial waste water (workshop and waste water from the mine) should be properly

collected, treated so as to conform to the standards prescribed under GSR 422 (E) dated 19th May, 1993 and 31th December, 1993 or as amended from time to time. Oil and grease trap should be installed before discharge of workshop effluents. Status of Compliance:-

We will provide, site specific ETP cum Service centre along with work-shop for treatment of work shop effluents with the provision of the oil & grease trap pit.

ix. Personnel working in dusty areas should wear protective respiratory devices and they should

x. Occupational health surveillance program of the workers should be undertaken periodically

to observe any contractions due to exposure to dust and take corrective measures, if needed. Status of Compliance:-

Initial Medical Examination & Periodical Medical Examination of the workers engaged in the project is being undertaken periodically for permanent and outsider employees along with the pre-medical examination of persons employed, who are engaged in the process of mining & are likely exposed to dust to observe any contractions due to exposure to dust. This is being carried as per in compliance to Mines Act 1952 & rules 1956 and amendments there to. The examination is being carried out periodically for all the employees of the Project. The various tests include PFT, X-Ray, and lung spirometry etc. The above is being carried including all the tests as per FORM “O”.

xi. A separate environmental management cell with suitable qualified personnel should be setup under the control of a senior executive, who will report directly to the Head of the Organization. Status of Compliance:-

As the project is not in operation since, Nov 2011, the funds earmarked for environmental protection are kept in separate account and it will be utilized for the said purpose only. regarding date of financial closures and final approval of the project by the concerned authorized and the date of start of land development work. Status of Compliance:-

We will abide by the conditions.

xiv. The Regional Office of the Ministry located at Bhubaneswar shall monitor compliance of the stipulated conditions. The project authorities should extend full cooperation to the officer (S) of the regional office by furnishing the requisite data / information/ monitoring reports. Status of Compliance:-

We will extend all our cooperation during any such inspections by the Authority.

xv. The project proponent shall submit six monthly reports on the status of compliance of the stipulated environmental clearance conditions including results of monitored data (both in hard copies as well as by e-mail) to the ministry of Environment and Forests, its Regional Office, Bhubaneswar, the respective zonal office of Central pollution Control Board and State pollution Control Board. The proponent shall upload the status of compliance of the environmental clearance conditions, including results of the monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of the ministry of Environment and Forests, Bhubaneswar, the respective zonal officer of Central pollution Control Board and the State pollution Control Board. Status of Compliance:-

The six monthly compliance reports of the stipulated environmental clearance conditions are being updated and submitted to authorities regularly in both hard copies as well as by e-mail to the concerned authorities.

The said data is also being uploaded & updated in the website of the company i.e. www.nkpk.co.in. The details of the same are as Table 7.

Parisad/Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions / representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the company by the proponent. Status of Compliance:-

The copy of the environmental clearance letter is updated in the company’s website i.e. www.nkpk.co.in and a copy of clearance letters are also communicated to the concerned authorities.

xvii. The State Pollution Control Board should display a copy of the clearance letter at the Regional office, District Industry Centre and Collector’s office/ Tehsildar’s Office for 30 days. Status of Compliance:-

This will be compiled from SPCB, Jharkhand

xviii. The environment statement for each financial year ending 31st March in Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of environmental clearance conditions and shall also be sent to the respective Regional Office of the Ministry of Environment and Forests, Bhubaneswar by e-mail. Status of Compliance:-

The project is submitting the environment statement for each financial year ending 31st March in Form-V. The environment statement for the year 2013-14 is submitted to SPCB, Jharkhand and also to the Regional Office of the Ministry of Environment, Forests and Climate Change Bhubaneswar by e-mail and copy of the same is also uploaded in the company’s website i.e. www.nkpk.co.in.

xix. The project authorities should advertise at least in two local newspapers in the district or State in which the project is located &widely circulated, one of which shall be in the vernacular language of the locality concerned, within 7 days of the issue of the clearance letter informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution Control Board and also at web site of the Ministry of Environment and Forests at http: / / envfor.nic.in and a copy of the same should be forwarded to the Regional Office of this Ministry located at Bhubaneswar. Status of Compliance:-

The project proponent has already advertised in the two local newspapers i.e. Hindi (vernacular language) in THE HINDUSTAN dated 25.12.2012 and English in THE TIMES OF INDIA date 25.12.2012.
