Minutes of the 463th meeting of the State Level Expert Appraisal Committee held on 21/12/2018

at Geer Foundation, Indroda Park, Sector – 9, Gandhinagar.

The 463th meeting of the State Level Expert Appraisal Committee (SEAC) was held on 21st December

2018, 2018 at Geer Foundation, Indroda Park, Sector – 9, Gandhinagar. Following members attended

During the meeting, it was decided to verify the status of the project site, with reference to the

construction related activity started, through site visit by Gujarat Pollution Control Board. After

detailed discussion, it was decided to consider the project only after verifying the status of the

project site through physical verification by GPCB and after submission of the following:

1. Revised details with increased parking area provision along with the back up calculation

& parking plan.

2. Layout plan showing provision of clear cut margin space all along the periphery/ boundary wall, excluding the space for peripheral tree plantation, for unobstructed movement of vehicles during the emergency situations.

• During operation phase: Fire extinguishers, hose reel, dry riser, yard hydrant, manually operated electric fire alarm system, automatic sprinkler system in basement, underground static water storage tank-200 KL capacity, terrace tank -40 KL capacity (total capacity), pump near underground static water storage tank (fire pump) with minimum Pressure of 3.5 kg/cm2 at terrace level etc.

During the meeting, it was found that project proponent has submitted a copy of permission

obtained from Airports Authority of India for permissible building height of 101.147 m above ground

level. It was presented that from the total 11 trees existing at the project site, 3 trees will be cut.

Existing party plot building will be demolished for the proposed development. Construction &

demolition waste will be used within premises for back filling, sub-base of internal roads &

pavements whereas the remaining waste will be handed over to AMC. Measures like barricading

the project site, provision of red lights on all the barricades during night hours, central portion will be

demolished first, use of mechanical method for demolition, provision of warning device, water

sprinkling, availability of first aid box etc. will be implemented while demolishing the existing

structure. The project proponent was asked to ensure the strict adherence of the Construction &

Demolition Waste Rules – 2016. After detailed discussion, it was decided to consider the

During the meeting, it was presented that the project site is at a distance of 113.45 m from the

nearby khadi. A copy of system generated auto assessment for height clearance of Airports

Authority of India, submitted shows that the permitted top elevation for this grid is 69 m. After

detailed discussion, it was decided to recommend the project to SEIAA Gujarat for granting

Environment Clearance subject to the strict compliance of the following project specific conditions

as well as the standard conditions finalized during the meeting of SEAC held on 02/08/2017 and

approved during the meeting of SEIAA held on 08/09/2017 for The Building Construction projects

falling under project activity no. 8(a) as per the schedule of the EIA Notification 2006:

CONSTRUCTION PHASE :

WATER:

1. Fresh water requirement during the construction phase shall be 14.0 KL/day and it shall be met

through the local water tankers. No ground water shall be tapped during the construction phase.

2. Sewage generated during the construction phase shall be disposed off through septic tank and

soak pit.

OPERATION PHASE :

WATER:

3. Total water requirement during the operation phase shall be 264.50 KL/day, out of which fresh

water requirement of 176.0 KL/day shall be met through water supply system of Surat Municipal

Corporation (SMC) and the remaining 88.50 KL/day of water requirement shall be met through

treated sewage. No ground water shall be tapped during the operation phase. Metering of the

water shall be done and its records shall be maintained.

4. Sewage generation during operation phase shall be 209.0 KL/day which shall be treated in the

proposed onsite Sewage Treatment Plant.

5. The unit shall install and efficiently operate STP of adequate capacity for treating the sewage to

be generated during operation phase to achieve the GPCB norms at the STP outlet. Treated

sewage conforming to GPCB norms shall be utilized within premises for gardening & flushing

purpose at the maximum extent possible. Only remaining quantity of treated sewage shall be

disposed off through drainage line of Surat Municipal Corporation (SMC).

6. A proper logbook of STP operation and also showing the quantity of treated sewage utilization

within premises & quantity of treated sewage discharged into the drainage line shall be

maintained and furnished to the GPCB from time to time.

7. Dual plumbing system with separate tanks and lines shall be provided for utilization of treated

sewage for flushing.

8. No bore well shall be constructed and existing bore well/s, if any, shall be either sealed or

converted into the recharge well upon completion of the construction work.

9. Rain water harvesting from rooftop and paved areas and ground water recharge through 5 nos.

of percolation wells shall be carried out as per the details submitted. Before recharging the run

off, pre-treatment must be done to remove suspended matter.

AIR:

10. D. G. sets (2 x 125 KVA) proposed as backup power shall be of enclosed type and confirm to

prescribe standards under EPA rules. Necessary acoustic enclosures shall be provided at

diesel generator set to mitigate the impact of noise.

11. The gaseous emissions from the D.G. Sets shall conform to the standards prescribed under

EPA Rules as amended from time to time. At no time, the emission levels shall go beyond the

stipulated standards.

12. The stack height of the D.G.sets shall be equal to the height needed for the combined capacity

of all proposed D.G.sets.

SOLID WASTE:

13. The solid waste generated shall be properly collected and segregated at source. The

biodegradable waste shall be converted into useful end product by treating it into the proposed

onsite Organic Waste Convertor and the recyclable waste shall be sold to vendors whereas the

other garbage shall be disposed off properly as per the provisions made by the Surat Municipal

Corporation (SMC).

14. Fire fighting facilities like fire extinguishers, hose reel, wet riser, automatic sprinkler system

(basement), manually operated electric fire alarm system, underground static water storage

tank – 50 KL x 05 nos., terrace tank – 10 KL x 9 & one electric & one diesel pump of capacity

1800 l/min. & one electric pump of capacity 200 l/min. having pressure 4.0 kg/cm2 at terrace

level etc. shall be provided as proposed.

15. All the staircases and lifts shall open out at ground level from the highest point of building [with

access from each floor] for emergency evacuation. Two staircases shall be provided in each

building having floor area more than 500 m2 on each floor.

16. In basement at least two separate ramps of adequate width and slope shall be provided,

located preferably at opposite ends.

17. Provision for adequate air changes per hour in the basement shall be made so as to avoid build

up of CO in the area.

18. Car park exhaust system equipped with CO (Carbon Monoxide) sensor shall be provided to

ensure operation of exhaust fans as CO concentration levels.

PARKING / TRAFFIC CONGESTION:

19. Minimum parking space of 10,709.97 m2 [6,192.01 m2 in basement + 2,150.43 m2 as open

surface + 2,367.53 m2 in hollow plinth] shall be provided as proposed.

ENERGY CONSERVATION:

20. Energy conservation measures viz. use of LED light in common building areas, solar light for

landscape area, maximum use of natural lighting, reflective/white tiles on terrace floor, solar

water heater on each building, roof top solar panels of 27 KW/h capacity etc. shall be

implemented as proposed.

GREEN BELT:

21. Green belt area of 854.0 m2 comprising of 330.0 m2 tree covered area with 133 trees within

premises shall be developed as proposed. The other open spaces inside the plot shall be

suitably landscaped and covered with vegetation of indigenous tree species.

OTHER CONDITION:

22. The project proponent shall allocate the separate fund of Rs. 85.36 lacks for activities like

provision of drinking water facility including RO Plant and water coolers at nearby village schools,

provision of sanitation facility at nearby village school, provision of solar panels at Jiav village, Unn

Primary school, tree plantation at Surat- Bardoli road, as suggested by SMC/ SUDA, provision of

computers, printers, benches at nearby schools etc. in accordance to the MoEFCC’s Office

Memorandum No. F.No.22-65/2017-IA.III dated 01/05/2018 to carry out the activities under

CER in affected area around the project. The entire activities proposed under CER shall be

monitored and the monitoring report shall be submitted to the regional office of MoEFCC as a

part of half-yearly compliance report and to district collector. The monitoring report shall be

posted on the website of the project proponent.

Copies of village form no. 7 & 12 and NA order submitted by them shows that NA land of F.P. No. 15 of T.P.S. No. 27 admeasuring 9,767.0 m2 for residential use is in the name of Mr. Mansukhbhai M. Kakadiya.

During the meeting, after the detailed discussion, it was decided to consider the project only after the submission of the following:

1. Authentic supporting documents showing that the proposed commercial project is

permissible at the project site.

2. Typical floor plans of the proposed commercial building. Floor wise emergency

evacuation plan should be submitted.

3. Revised details with increased parking area provision along with the parking plans & back

up calculation.

4. Details on solar panels to be installed including their number & capacity, type, location &

available space etc.

5. Details of the activities to be carried out under Corporate Environment Responsibility

along with the details of basis considered for selection of the proposed activity/ies, fund

allocation (as per the MoEFCC’s Office Memorandum dated 01/05/2018), time bound action

plan etc.

1. “Kiran Concord Towers” at Block No. 75, Jahangirabad, Surat proposed by Mr. Ashishbhai

B. Lakhani.

This office has received an application for Environment Clearance of the above project vide

proposal no. SIA/GJ/NCP/80484/2018 dated 25/10/2018.

The project was appraised during the meeting of SEAC held on 27/11/2018. Based on the details

sought during the meeting of SEAC held on 27/11/2018, the project proponent vide their letter

dated 18/12/2018, submitted a notarized undertaking stating that any kind of construction activity

has not been started at the project site even after obtaining Environmental Clearance for the

project. Construction activity for the project will be started only after obtaining Environmental

Clearance from SEIAA Gujarat. Project proponent has submitted consent letters of Kunkani Gram

Panchayat, Segvachhama group Gram Panchayat and Barbodhan Gram Panchayat for carrying

out activities under CER.

The said submission of the project proponent was considered by the committee and as it was found

satisfactory, it was decided to recommend the project to SEIAA Gujarat for granting Environment

Clearance in cancellation of the Environmental Clearance order no. SEIAA/GUJ/EC/8(a)/247/2013

dated 22/07/2013 subject to the strict compliance of the following project specific conditions as well

as the standard conditions finalized during the meeting of SEAC held on 02/08/2017 and approved

during the meeting of SEIAA held on 08/09/2017 for The Building Construction projects falling

under project activity no. 8(a) as per the schedule of the EIA Notification 2006:

CONSTRUCTION PHASE :

WATER:

1. Fresh water requirement during the construction phase shall be 16.40 KL/day and it shall be

met through the local water tankers. No ground water shall be tapped during the construction

phase.

2. Sewage generated during the construction phase shall be disposed off through soak pit and

septic tank.

OPERATION PHASE:

WATER:

3. Total water requirement during the operation phase shall be 458.0 KL/day, out of which fresh

water requirement of 306.50 KL/day shall be met through water supply system of Surat

Municipal Corporation (SMC) and the remaining 151.50 KL/day of water requirement shall be

met through treated sewage. No ground water shall be tapped during the operation phase.

Metering of the water shall be done and its records shall be maintained.

4. Sewage generation during operation phase shall be 361.0 KL/day which shall be treated in the

proposed onsite Sewage Treatment Plant.

5. The unit shall install and efficiently operate STP of adequate capacity for treating the sewage

to be generated during operation phase to achieve the GPCB norms at the STP outlet. Treated

sewage conforming to GPCB norms shall be utilized within premises for gardening & flushing

purpose at the maximum extent possible. Only remaining quantity of treated sewage shall be

disposed off through drainage line of Surat Municipal Corporation (SMC).

6. A proper logbook of STP operation and also showing the quantity of treated sewage utilization

within premises & quantity of treated sewage discharged into the drainage line shall be

maintained and furnished to the GPCB from time to time.

7. Dual plumbing system with separate tanks and lines shall be provided for utilization of treated

sewage for flushing.

8. No bore well shall be constructed and existing bore well/s, if any, shall be either sealed or

converted into the recharge well.

9. Rain water harvesting from rooftop and paved areas and ground water recharge through 5

nos. of percolation wells shall be carried out as per the details submitted. Before recharging

the run off, pre-treatment must be done to remove suspended matter.

AIR:

10. D. G. sets (3 x 125 KVA) proposed as backup power shall be of enclosed type and confirm to

prescribe standards under EPA rules. Necessary acoustic enclosures shall be provided at

diesel generator set to mitigate the impact of noise.

11. The gaseous emissions from the D.G. Sets shall conform to the standards prescribed under

EPA Rules as amended from time to time. At no time, the emission levels shall go beyond the

stipulated standards.

12. The stack height of the D.G.sets shall be equal to the height needed for the combined capacity

of all proposed D.G.sets.

13. The solid waste generated shall be properly collected and segregated at source. The

biodegradable waste shall be converted into useful end product by treating it into the proposed

onsite Organic Waste Convertor and the recyclable waste shall be sold to vendors whereas

the other garbage shall be disposed off properly as per the provisions made by the Surat

Municipal Corporation (SMC).

SAFETY:

14. Fire fighting facilities like fire extinguisher, hose reel, wet riser, automatic sprinkler system in

basement, manually operated electric fire alarm system, underground water tank of 07 x 50 KL

capacity, terrace tanks of 14 x 10 KL capacity, one electric & one diesel pump of capacity 1800

L/min. & one electric pump of capacity 200 L/min. having pressure 4.0 kg/cm2 at terrace level

etc. shall be provided as proposed.

15. All the staircases and lifts shall open out at ground level from the highest point of building [with

access from each floor] for emergency evacuation. Two staircases shall be provided in each

building having floor area more than 500 m2 on each floor.

16. In basement at least two separate ramps of adequate width and slope shall be provided,

located preferably at opposite ends.

17. Provision for adequate air changes per hour in the basement shall be made so as to avoid

build up of CO in the area.

18. Car park exhaust system equipped with CO (Carbon Monoxide) sensor shall be provided to

ensure operation of exhaust fans as CO concentration levels.

PARKING / TRAFFIC CONGESTION:

19. Minimum parking space of 19,248.87 m2 [12,702.62 m2 in basement + 3,473.15 m2 in hollow

plinth + 3,073.10 m2 as open surface parking] shall be provided as proposed.

ENERGY CONSERVATION:

20. Energy conservation measures viz. use of LED light in common areas, solar lights for

landscape areas, 42 KWh roof top solar panels, maximum use of natural lighting, reflective /

white tiles on terrace floor etc. shall be implemented as proposed.

GREEN BELT:

21. Green belt area of 1,600.0 m2 comprising of 769.89 m2 tree covered area with 265 trees within

premises shall be developed as proposed. The other open spaces inside the plot shall be

suitably landscaped and covered with vegetation of indigenous tree species.

OTHER CONDITION:

22. The project proponent shall allocate the separate fund of Rs. 1.87 Cr for activities like provision

of drinking water facilities in Adajan primary school, Palanpore village & Pal nagar prathmik

school, Malagama village school, Asarama village, Provision of sanitation facilities in Bhesan

village, Ugat village, Bhesan Prathmik school & Batha village school, Provision of computers,

printers, benches in prathmik school of Bhesan, Pal & SMC Rander zone school, Provision of

solar panels at palanpore village, at Ugat prathmik school & at Malagama, tree plantation at

Bhesan-Icchapore village road, Gaurav Path road in consultation with SMC/SUDA to be

carried out under Corporate Environment Responsibility in accordance to the MoEFCC’s Office

Memorandum No. F.No.22-65/2017-IA.III dated 01/05/2018. The entire activities proposed

under CER shall be monitored and the monitoring report shall be submitted to the regional

office of MoEFCC as a part of half-yearly compliance report and to district collector. The

monitoring report shall be posted on the website of the project proponent.

2. “Apple Plaza” at R. S. No. 263 Sub Plot- 1, R.S. No. 257/1 & 257/2 Sub Plot- 1, Bhadkodra,

Ankleshwar, Bharuch proposed by M/s. Shubham Enterprise.

This office has received an application for Environment Clearance of the above project vide

proposal no. SIA/GJ/NCP/77780/2018 on 01/10/2018.

The project was appraised during the meeting of SEAC held on 29/10/2018. Based on the details

sought during the meeting of SEAC held on 29/10/2018, the project proponent vide their letter

dated 20/12/2018 submitted that there will be 836 fixed population & 836 visitors in the proposed

commercial building. Total water requirement of the project will be 78 KL/day, out of which fresh

requirement will be 49 KL/day. 59 KL/day of sewage to be generated will be treated in the proposed

onsite STP and treated sewage 29 KL/day will be used for flushing & gardening purpose within

premises. It is proposed to increase parking area provision by providing mechanical parking in

basement. Parking area provision for the project will be 9,487.72 m2 [5,136.58 m2 in basement +

2,709.08 m2 as mechanical parking in basement + 1,642.60 m2 as open surface parking] which is

equivalent to 317 CPS. Emergency evacuation plan submitted shows that the entire building can be

evacuated within 12.50 minutes during peak hours of 5 pm to 8 pm. Project proponent has

submitted photographs of public garden developed by the project proponent near the project site at

village Bhadkodra and fee receipts paid to GIDC for development of roads at village bhadkodra.

Roof top solar panels of 80 KW power generation capacity will be installed.

The said submission of the project proponent was considered by the committee and as it was found

satisfactory, it was decided to recommend the project to SEIAA Gujarat for granting Environment

Clearance subject to the strict compliance of the following project specific conditions as well as the

standard conditions finalized during the meeting of SEAC held on 02/08/2017 and approved during

the meeting of SEIAA held on 08/09/2017 for The Building Construction projects falling under

project activity no. 8(a) as per the schedule of the EIA Notification 2006:

SPECIFIC CONDITION:

1. No any kind of manufacturing activity shall be allowed in the proposed commercial project.

2. The project proponent shall not sell / allot any commercial unit for storage of chemicals,

flammable substances, explosives, fire crackers or any other material of hazardous

characteristics.

3. Common amenities like drinking water facility, sanitation blocks separate for male & female,

first aid facility etc. shall be provided at each floor.

CONSTRUCTION PHASE :

WATER:

4. Fresh water requirement during the construction phase shall be 10.30 KL/day and it shall be

met through the water supply from Bharuch Ankleshwar Urban Development Authority

(BAUDA). No ground water shall be tapped during the construction phase.

5. Sewage generated during the construction phase shall be disposed off through septic tank &

soak pit.

Ankleshwar Urban Development Authority (BAUDA) and the remaining 29.0 KL/day of water

requirement shall be met through treated sewage. No ground water shall be tapped during the

operation phase. Metering of the water shall be done and its records shall be maintained.

7. Sewage generation during operation phase shall be 59.0 KL/day which shall be treated in the

proposed onsite Sewage Treatment Plant.

8. The unit shall install and efficiently operate STP of adequate capacity for treating the sewage

to be generated during operation phase to achieve the GPCB norms at the STP outlet. Treated

sewage conforming to GPCB norms shall be utilized within premises for gardening & flushing

purpose at the maximum extent possible. Only remaining quantity of treated sewage shall be

disposed off through drainage line of Bharuch Ankleshwar Urban Development Authority

(BAUDA).

9. A proper logbook of STP operation and also showing the quantity of treated sewage utilization

within premises & quantity of treated sewage discharged into the drainage line shall be

13. A D. G. sets (1 x 250 KVA) proposed as backup power shall be of enclosed type and confirm

to prescribe standards under EPA rules. Necessary acoustic enclosures shall be provided at

diesel generator set to mitigate the impact of noise.

14. The exhaust of the D. G. Set shall be at least 3 m above roof top.

15. The gaseous emissions from the D.G. Sets shall conform to the standards prescribed under

EPA rules as amended from time to time. At no time, the emission levels shall go beyond the

stipulated standards..

SOLID WASTE:

trained staff shall be deployed to guide the visitors for parking and helping the senior citizens

and physically challenged people to park their vehicles at appropriate parking places (valet

parking).

24. Necessary signage including continuous display of status of parking availability at entry, exit

and all other appropriate places shall be provided which should have appropriate size of letters

and shall be visible from the at least 50 meter distance.

ENERGY CONSERVATION:

25. Energy conservation measures viz. maximum utilization of natural light, LED lighting fixtures in

common areas, use of solar energy in landscape lighting, roof top solar panels of 80 KW

power generation capacity for common area, passage, staircase lighting etc. shall be

implemented as proposed.

26. The energy audit shall be conducted at regular interval for the project and the

recommendations of the Audit Report shall be implemented with spirit.

GREEN BELT:

27. Green belt area comprising of tree covered area of 470.79 m2 with 140 trees within premises

shall be developed as proposed. The other open spaces inside the plot shall be suitably

landscaped and covered with vegetation of indigenous tree species.

OTHER CONDITION:

28. The project proponent shall allocate the separate fund of Rs. 61 lacs for developing public

garden at Ankleshwar in accordance to the MoEFCC’s Office Memorandum No. F.No.22-

65/2017-IA.III dated 01/05/2018 to carry out the activities under CER in affected area around

the project. The entire activities proposed under CER shall be monitored and the monitoring

report shall be submitted to the regional office of MoEFCC as a part of half-yearly compliance

report and to the District Collector. The monitoring report shall be posted on the website of the

project proponent.

3. “Palladium Residency” at Draft T.P.S. No. 71, (Vadod), F.P. No.51 Paikee Sub Plot No. 1, O.P. No. 51, Block No. 88, Vadod, Choryasi, Surat proposed by Mrs. Chhayaben Umangbhai.

The project proponent vide their letter dated 18/12/2018 requested to reconsider the project in view

of order dated 26/11/2018 of Hon’ble High Court of Delhi and order dated 03/12/2018 of Hon’ble

National Green Tribunal. It was noted that the above mentioned project was recommended to

SEIAA for grant of Environmental Clearance vide this office letter dated 05/11/2018 which was

considered during the meeting of SEIAA held on 22/11/2018. As per the decision taken during the

meeting of SEIAA held on 22/11/2018 the project was delisted in view of the amendment

Notification dated 14/11/2018 & 15/11/2018. The request of the project proponent was considered

and it was decided to recommend to SEIAA to reconsider the proposals in view of order dated

26/11/2018 of Hon’ble High Court of Delhi and order dated 03/12/2018 of Hon’ble National Green

Tribunal for grant of Environmental Clearance with all the details & conditions mentioned in the

recommendation letter dated 05/11/2018 of the above project.
