12.1.2 D.R. Cook Monumental Masons, Balaklava

David Cook has submitted a concept plan for the refurbishment of the frontage to the Black and White Café, Ayr Street, Jamestown. The concept plan confirms that a verandah will be constructed as required.

12.1.3 Kelly Toyota Development Application 764/223/08 The Environmental Resource and Development Court Conference was held on 16th May 2008 at 11.30 a.m. at Jamestown Council Chamber. Commissioner Green conducted the Conference. A directions hearing will be held on 23 June 2008 to set the date for the ERD Court hearing.

12.1.5 Plan Amendment Report - Jamestown Industrial/Commercial

rezoning Professor David Jones and Daniel Hermann have prepared a Statement of Intent for the Plan Amendment Report which has been lodged with Planning SA and is currently with Government Agencies for comment and will be forwarded to the Minister of Urban Development and Planning, Hon Paul Holloway MLC, after a 2 week period of Government Agency assessment.

12.1.6 Planning Applications Several applicants have commenced the building of Carport/Sheds without receiving planning approval. Council newsletter will contain a warning to residents that under no circumstances can building work

Robinson that the Office of the Liquor & Gambling Commissioner be advised that Council has no objection to the Jamestown Café being issued a Restaurant License for the existing dining room area of the premises only. Clark that the Office of the Liquor & Gambling Commissioner be advised that Council does not support the Jamestown Café’s application for a Restaurant Licence.

13.2 ON-GOING PROJECTS 13.2.1 GEORGETOWN MASTER PLAN

Following a meeting with members of the Georgetown Community Development Association and the Georgetown into the Future Committee on Monday 5th May, the community of Georgetown has decided to accept Council’s recommendation to develop a Master Plan for the town. Council will assist the community of Georgetown to develop an application to Planning SA (through the Places for People Program) for funding to assist with the cost of developing a Master Plan.

13.2.2 JAMESTOWN CHILD CARE As a result of Council’s unsuccessful application to the Federal Government’s Long Day Care Capital Funding Program (due to ineligibility), for capital works funding to establish a Long Day Care Service at the Jamestown Pre-school, Council has proceeded to liaise with State and Federal Government Departments to gain further assistance with the issue. At present, Jamestown is caught in an administrative dilemma, the State Government Department of Education and Children’s Services (DECS) has recommended a Rural Integrated Service model for Jamestown (Long Day Care provided in conjunction with Kindergarten at the Pre-school centre), but the State Government does not provide capital funding associated with a Rural Integrated Service. Capital funding is available from the Federal Government but only for facilities which are existing Long Day Care services. The Jamestown Pre-school requires extensions (capital works funding) to legally cater for Long Day Care children as well as Kindergarten children. The challenge is, how does the Jamestown Pre-school get Long Day Care status as a Rural Integrated Service in order to be eligible for Federal Government capital works funding? Council has put this question to both the State and Federal Government to gain their assistance and guidance with the matter.

Further to the issue, Council is exploring all options for childcare in Jamestown and has had informal discussions with private childcare providers.

13.2.3 RESPONSE TO FINANCIAL REQUESTS FOR THE 08/09 BUDGET

In response to the letter sent to local community groups (by the Manager of Finance), Council has received a large number of community requests for funding, to be considered in the 2008/09 Council budget. The applications for funding assistance are being further assessed. There are a number of community groups that are eligible for external funding; this is particularly applicable to projects being proposed by sporting clubs with most of the funding requests being eligible for grants through the Office for Recreation and Sport.

Council has sent a letter to all community groups which submitted a funding request to acknowledge their submission and to advise that Council will work with community groups where alternative sources of funding can be identified. The community groups that are eligible for external grant funding will be contacted and assisted to make grant applications.

13.2.4 LOCAL GOVERNMENT ASSOCIATION CLIMATE CHANGE FORUM

The Local Government Association held a Climate Change Forum in Port Pirie on 29th April. Included within the forum was discussion about the predicted impact of climate change on Australia, in particular the Mid North of South Australia, and the role of local Councils in mitigation and adaptation to climate change. Council’s role in mitigation involves working with the community to reduce greenhouse gas emissions (reducing the impact of climate change). Working with the community to mitigate greenhouse gas emissions includes working with the building sector (street facing of buildings, water efficiency, electricity efficiency, insulation, etc), and educating the community at a local level to make practical changes to reduce electricity consumption. The second role for Council’s is to conduct a risk analysis of their region, and make adaptation plans to enable the Council region to cope with the climate volatility that is expected to occur. Northern Areas Council’s involvement in the ICLEI Water Campaign and the Climate Change Adaptation Program will ensure that plans are set in place to assist the communities within our council region to cope with the impacts of climate change in the future.

13.2.5 LAURA ZOO

Country Arts SA has transferred the funding for the metal-art animal zoo from the Spalding Community Management Committee to the Laura Community Development and Tourism Association. Artist, Craig Ellis will be conducting a workshop in Laura (planned for August) to assist interested community members to design the metal-art animals. The logistics of the workshop are currently being planned.

13.2.6 REGIONAL PARTNERSHIPS PROGRAM

Council has been informed that the Regional Partnerships program has now closed for new and uncontracted projects. No new Regional Partnerships applications will be accepted by the Department of Infrastructure, Transport, Regional Development and applications currently under assessment will not be considered for funding. Applicants who were notified by the previous government that their project had been approved for funding under Regional Partnerships but do not have a funding agreement executed by the Australian Government are advised that any offer or expectation of funding (express or implied) in relation to the project on the basis of a draft agreement, or on the basis of any other approval or representation that funding will be made available for the projects, is withdrawn. The Department of Infrastructure, Transport, Regional Development and Local Government will continue to fund those Regional Partnerships projects that have an executed funding agreement in place with the Government. Requests for additional funding for Regional Partnerships projects with an executed funding agreement in place will not be considered. Projects that have sought a Review of the previous Government's decision will not be considered.

GOVERNMENT ANNOUNCES NEW “BETTER REGIONS PROGRAM” On 13 May 2008, the Federal Government announced a “Better Regions Program” ($176 million) to encourage economic and community development and invest in local infrastructure such as: revitalisation of towns’ main streets; multi-purpose community and resource centres; major sport and recreational venues; and community transport infrastructure. Council will look to resubmit projects (that were not funded through the Regional Partnerships Program) to the Better Regions Program when funding guidelines and the application form is released.

14.21 ALTERATION TO THE APPILA BOUNDARY

In the October 2007 meeting, correspondence from Max Sayer, was presented to the meeting regarding the geographical Names Boundary for the Appila district. The information regarding the change in the boundary was forwarded to residents that are to be affected by the proposed change, in accordance with the correspondence from the Office of the Surveyor General. Residents were asked to fill out a survey stating if they supported the boundary alteration or do not support the alteration. This survey was sent out twice as the initial response was quite low. In all 19 residents were contacted regarding the alteration. Council received 11 returns and all of these residents are in favour of the boundary change. (210.3.4) MANAGER’S COMMENT: It appears that the respondents are all in favour of the boundary change to become part of the region known as Appila. If supported by Council the resolution will be forwarded to the for further action.

Manager’s Report: Council will receive a rebate of 54.5% (maximum 55%) on Council’s annual workers compensation contribution paid to the Scheme. This is an excellent result for Council, reflecting very low amount paid in workers compensation claims for this Council and an excellent score from Council’s annual OH&S Audit. The result is an indication of an effective OH&S program at this Council.

Re: Funding for Stormwater Management

The letter states in part: “The State Government agreed to contribute $4million per annum adjusted in accordance with the Consumer Price Index for a period of 30 years. This funding commitment provides certainty and replaces a previous year-to-year allocation to the former Catchment Management Subsidy Scheme.

The Authority has resolved that stormwater projects must demonstrate a significant flood mitigation component as well as addressing wherever practicable value adding opportunities such as stormwater reuse and water quality enhancements to be eligible for funding”.

CEO’s COMMENT: Council will continue to pursue funding options with the State Government for projects that are in need of implementation.

17.2 DEPARTMENT FOR FAMILIES AND COMMUNITIES, HOUSING SA,

Mario Vitagliano, A/Director/Property Services Re: Following the receipt of Council’s letter, Housing SA requested a licensed valuation of the four (4) units only at 1-4 Cross Street, Gladstone, excluding the land component to determine the current market value, based on current comparable sales evidence. The valuation assessed the current market value of the units’ buildings only in their current condition, to be $130,000 in total and is offering the properties for sale to the Northern Areas Council based on this valuation. (ILT2044 / 120.7.1)

CEO’s COMMENT: Council may wish to express a view on acquiring these properties (for community purposes, eg as off-site units for the Caravan Park). However it is questionable whether the units represent “value” at $130,000 given that they have not been able to attract tenants for some time. The CEO will arrange a meeting with Housing SA to discuss an appropriate sale price that is satisfactory to Council.

CEO’s COMMENT: The existing drain referred to in the letter from Trevor Mace crosses Section 395 Hd of Andrews. Section 395 is owned by Mr Longmire of Spalding. Mr Mace, and many others, have worked on the supposition that the drain through Mr Longmire’s property is covered

by an easement in favour of Northern Areas Council. Further investigatory work undertaken by Council has determined that the existing drain through Section 395 Hd of Andrews is land in the ownership of Northern Areas Council being Section 541 Hd of Andrews. It is Trevor Mace’s recommendation that the existing drain be widened (considerably) through the acquisition of land from Mr Longmire. Council attended a meeting on 16 April 2008 (on site at Spalding) with a view to discussing these matters with Mr Longmire, but the meeting closed abruptly when Mr Longmire indicated that he had no interest in further negotiating the matter. For this matter to proceed Council will need to determine its preferred course of action. Assuming that Council is of the view that the additional drainage works are necessary, a possible course of action would be to write to Mr Longmire advising that Council wishes to purchase additional land from him (to widen the existing drain) and that Council will have the land valued before proceeding to compulsory acquisition. Through that process an independent assessment of land values can be determined with Council paying fair compensation to Mr Longmire.

RESOURCES MANAGEMENT BOARD, Rob Freeman, Chief Executive Re: South Australian Murray Darling Basin Natural Resources Management Board and Northern and Yorke Resources Management Board recently completed the annual review of their initial plan (regional NRM plan). As an outcome of the review process the Board has proposed amendments to its regional NRM plan including a proposal for a regional NRM levy for 2008-09.

The Minister for Environment and Conservation is responsible for the determination of council contributions to the regional NRM levy. Seeking Council’s comments on behalf of the Minister in relation to the proposed regional NRM levy contribution amount for 2008-09, pursuant to section 92(4) of the Act.

17.11 CENTRAL LOCAL GOVERNMENT REGION INC

Re: Various Issues

The CEO and Chairman attended a Central Local Government Region meeting on Friday 9 May 2008. The following issues were discussed:

• Constitutional recognition for Local Government: the ALGA is coordinating view of local government across Australia on this issue.

• NRM: the State (LGA) Executive Committee is commissioning an independent research study on all viable options for the collection of the NRM levy. Northern & York NRM has advised CLGR that the 2008/09 levy will be based on the 2007/08 amount plus a CPI increase.

• Financial Sustainability: Councils are required to have their Infrastructure & Asset Management Plans and Long Term Financial Plans in place by November this year.

• CWMS (Community Wastewater Management Scheme): Councils participating in the CWMS are encouraged to align rates to SA Water metropolitan sewerage rates. NAC are progressively working in this direction.

17.12 REGIONALISATION OF SA STRATEGIC PLAN

Council has received an invitation to participate in community forums regarding the regionalisation of the State Strategic Plan. Forums will be held at Port Pire on 29 May 2008 at 6:00 pm and Clare on 30 May 2008 at 12:00 noon. Councillors wishing to attend either session can advise Bernadette to arrange transport.

17.13 JAMESTOWN INDUSTRIAL ESTATE

Council has received notification that the RDIF application associated with the upgrade of power at the Jamestown Industrial Estate has been approved. The grant payable to Council is $150,000. Council is also progressing with the acquisition of S405 Hd Belalie as an extension to the Industrial Estate. In order to meet the requirements of Council’s Development Plan the present owner has agreed to a boundary adjustment which will have the effect of ‘isolating’ that part of his original allotment that Council will be purchasing. Although some work has been done to determine an optimum future subdivision of the site Council has to await the outcome of the Development Plan Amendment before lodging formal subdivision with Planning SA.

17.14 LOCAL GOVERNMENT ASSOCIATION CONFERENCE

The CEO attended information sessions at the Local Government Association General Meeting during May. A copy of the notes from the presentation re: Affordable Housing was attached to the Report for Member’s Information. (ILT2086/120.7.5)

17.18 ROAD TRAINS UTILISING THE JAMESTOWN-HALLETT ROAD A Councillor reported to me seeing Road Trains utilise the Jamestown-Hallett Road, which we understand is not a gazetted Road Train route. Road trains have been reported on this road on a number of occasions, and Council does not have the authority or capacity to “police” such breaches. It can only be assumed that drivers are utilising the

Jamestown-Hallett Road as an alternative to accessing the Barrier Highway via Peterborough. I contacted Peter Short, Regional Manager, Northern and Western Region, Department for Transport, Energy and Infrastructure to bring this matter to his attention. Phil Stratton, Department of Transport, Energy and Infrastructure has confirmed that to date the department has not issued any Road Train permits on the Jamestown to Hallett Road. Having said that, the Department is currently considering a request for a permit on this road. In regards to the report of these vehicles currently travelling on the Jamestown to Hallett Road, I can advise that counters will be installed to capture the necessary data to identify any movement trends. This information will then be forwarded to Colin Wright, Regional Co-ordinator for the Compliance Officers to focus on this road in relation to enforcement.
