Community Development and Libraries
• In the months of January and December alone staff at Mackay Regional Council Libraries
loaned 118,306 items and joined 900 new members. • 14,952 of those items were loaned on the self check out terminal (SCOT). Gordon White
Library broke the loans record for our self check out terminals in January with 5,362 items loaned.
• There were 4,843 online renewals. • The mobile library commenced its first fortnightly service to Koumala, Swayensville and Hay
Point, in the Sarina area.
• Exchange librarian, Graham Taylor, commenced work at Gordon White Library. Graham is from Leeds in England. Donna Priddle has gone to Leeds to work in his place. The exchange will last for a period of 12 months.

• Community Development Officer with a focus on rural communities has been appointed and commenced 6 January.
• Position of Youth Development Officer – Sarina Youth Centre has been filled with new Officer commencing 27 January.
• Community Development Administration Trainee commenced 20 January. • Interviews have been held for students wishing to participate in the Matsuura Sister
City tour to be held in September 2009. • 30 members of the Sarina Community attended a public forum to discuss the possible
development of a PCYC style facility in Sarina. A steering committee has been formed and quotes are being sought from consultants for the development of a proposal.
• A community advisory committee has been formed to support work being undertaken by Locality Development Officers, Walkerston, Northern Beaches and Andergrove, (as per the funding agreement with the Department of Communities). A number of Council programs have taken the opportunity to members of this committee in order to gain feedback from community members and to provide information about upcoming works and activities.
• Andergrove community meet and greet sessions are proving to be very successful with numbers attending the monthly session increasing.
• Application has been made to Multicultural Affairs Queensland, seeking funding to continue the work undertaken by LAMP Officers.
• Application has been made to Multicultural Affairs Queensland to employ a Community Development Officer to work specifically with the Australian South Sea Islander Community.
• Skate competition held at Kemmis Park during school holidays attracted approximately 100 young people.
• Approximately 80 young people participated in the BMX competition held at John Breen park during the school holidays.
Recreation Services
Management
• A draft Service Level Agreement (SLA) between Mackay Regional Council and Pioneer Swimming Club Inc. was developed and discussed with executives of the Pioneer Swimming Club Inc. The purpose of the Service Level Agreement ("SLA") is to describe a bilateral understanding between Pioneer Swimming Club Inc. and Mackay Regional Council in regards to the use of Council’s Swim Centres and associated services.
• Work continued on the planning of the Minor Works (Landscape) package at the Bluewater Lagoon, scheduled to be undertaken during the winter period.
• Recruitment activities: Sports & Recreation Officer (permanent), commences 10 February.
Aquatic Facilities • Minister Desley Boyle MP, Queensland Minister for Tourism, Regional Development and
Industry visited Mackay on 9 January and inspected the Bluewater Lagoon.(As attached – Photo 1).
• The new Mackay Regional Council and Suncorp UV signs and sunscreen provision stations were installed at the three (3) Mackay based public aquatic facilities.

• Public Address (PA) system was commissioned at the Bluewater Lagoon early December. The system consists of twenty-one (21) speakers and several hand-held radios and microphones to ensure noise impact for nearby residents is minimised. The PA system plays pre-recorded (safety) messages, opening hours information and can be used for urgent matters by Lifeguards, Café Operators and Security Personnel.
• 2009 Mackay Local Directories, including the photo on the front cover of four (4) children in the middle lagoon, were issued to Mackay businesses and residents.
• (As attached – Photo 4). • The new “Orca Squad Training program” commenced on 27 January at Memorial Swim
Centre. This new program expands Council’s existing swimming lesson program, by catering for swimmers who have mastered the highest level within the Learn-to-Swim program.
• Total attendance Bluewater Lagoon: 67,133 (December 2008) and 38,232 (January 2009). Property Services
Management • Attendance at Asset Management Workshop. • Commenced the process of undertaking Condition Inspections of Council buildings that are
maintained by the Property Services Program. • Continued participation in the Council buildings office alterations project. • Commenced discussions with relevant program Managers in regards to ongoing parking
issues associated with the Gordon Street Administration building, GE building and Wellington Street building.
Property Co-ordinations • Reviewing of all Council Leases • Attendance at Mirani to inspect Leased premises • Attendance at Mackay Base Hospital to liaise with Directors in respect to Bridge Road
development site. • The Andergrove Community Hall was damaged by fire late on Christmas night 2008. Council
has an insurance claim in place. Cleaning has been undertaken and a building contractor should be appointed in February to undertake repair work.
• Specifications have been sent out and quotes have been called for the City Library Glass Replacement Project.
• A second Electrical Engineer has been engaged to prepare specifications for the electrical upgrade of the Mirani Caravan Park.
• Two vacant Community houses were tenanted and the third vacant unit will be tenanted in early February.
• Mirani Community/Youth Hall kitchen work is underway. • Team Leader Maintenance has been appointed. Sarina Sugar Shed
• The Sugar Shed closed for the Christmas break from Christmas Day and re-opened on the 5th
January 2009.
• Sales at the Sugar Shed for December 2008 have shown an increase of approximately $2,000.00 on last year’s sales for the same month. January was well up on last year due to the fact the Sugar Shed opened in January – last year the Shed was closed from Christmas eve until the 1st February.

Convention Precinct and Events
Management • Tenders for Convention Centre tabletopware, furniture, AV and staging equipment have been
let. • Manager Convention Precinct & Events facilitated the visit of the Hon. Desley Boyle,
Minister for Industry & Tourism. The Minister visited both the Bluewater Lagoon and Convention Centre accompanied by local MPs.
• The Convention Precinct program formally commenced management of City Centre revitalisation events including the Victoria Street Sunday market.
• Several meetings with Festivals and Events community stakeholders have been conducted
Mackay Entertainment Centre • The Christmas free concert featuring the Mackay Choral society attracted more than 600
people. The Irish Mass, performed for the first time in Mackay was a highlight and received a standing ovation
• A wide range of maintenance on all of the Centre’s equipment was undertaken during January • LED lights were installed above the stairs leading to both mezzanines • Stage one of replacing all of the Centre’s fluros with more energy efficient ones has

Creative Kids: a showcase of children’s artwork, 2008
• The final Kidspace for 2008 was held on Tuesday, 9 December. Approximately 150 attended the activities.
• Artspace Volunteers successfully applied for an RADF grant to contract Tim Mosley to instruct Volunteers in the use of specialist photographic equipment and ‘Page Turner” software. With these skills, Volunteers will record the Artists’ Book collection so visitors to the gallery may access the books through a virtual experience. Artspace Mackay will become a leader in providing access to a major Artists’ Book collection See photographs attached
• Artspace-to-go Holiday Art Workshop was held at Gargett Gallery on Tuesday 13 January 2009. 10 students participated in this workshop.
• Holiday Art Workshops were held at Artspace Mackay on Wednesday 14 January. 22 students participated in these workshops.
• 863 visitors attended the Kids: Contemporary Australia on Tour. This event is a Queensland Art Gallery and Gallery of Modern Art free drop-in activity day held at Artspace Mackay on Saturday 17 January 2009.
• The 2008 Queensland Art Gallery and Gallery of Modern Art catalogue featured a promotional article on Artspace Mackay.

7.4 GRIFFITH UNIVERSITY PROJECT - DESIGNING FOR SAFETY IN THE LICENSED ENVIRONMENT

Purpose
To seek in-principle support from Council for a project to be conducted by Griffith University. The Project aims to develop a comprehensive prevention model that is capable of both achieving a reduction in aggression and violence in the licensed environment and sustaining this reduction over many years.
Background/Discussion
Aggression and violence in and around drinking establishments remains a significant world-wide problem. In an attempt to address and improve upon this situation in Australia and New Zealand, five sites have been selected by Griffith University to implement a project that aims to develop and operationalise a research design that will help build an effective, sustainable and comprehensive regulatory model to prevent alcohol-related violence and aggression. The comprehensive model will integrate different approaches to police enforcement, regulatory action, staff training and community mobilisation. The sites were selected by scooping current programs and problematic areas in Australia and New Zealand, and by engagement and interviews with key stakeholders at a regional and local level to determine preparedness and willingness to undertake trialling of the model. Key stakeholders in the project will be the police, licensed venues, hospitals, ambulance and local government. Much data will be collected and collated including such things as alcohol-related data, policies specifically associated with alcohol-related violence, annual police reports, security and incident logs, accident and emergency data – presentations and admissions, epidemiology data around alcohol-related injuries etc. Mackay Regional Council will be asked for details of specific partnerships with other agencies focusing on alcohol-related violence, demographic data and any local government representation on committees, projects or programs specifically associated with alcohol-related violence. The process of development and operationalisation of the model is anticipated to take place over twelve months followed by a second, three year phase to implement the design and evaluate its impact in the selected sites.
Consultation
Broad consultation has taken place by Griffith University and has involved all relevant key stakeholders.
Resource Implications
Involvement in this project will not require financial input, however there will be staff time involved in gathering the information required from Mackay Regional Council programs.

Conclusion
This project has the potential to achieve reductions in alcohol-related violence in and around the licensed premises of our local area, bur more importantly on sustaining those reductions over a long period of time. Council Rsolution

CARRIED 7.5 PROPOSED AMENDMENTS TO THE MIRANI SHIRE PLAN - RESPONSE
FROM FIRST STATE INTEREST REVIEW - AMENDMENT NUMBER 1 OF 2007
Purpose To present the response from the first State Interest Review for Amendment Number 1 of 2007 of the Mirani Shire Plan, and recommend responses to enable Council to proceed with public notification of the proposed scheme amendments. Background/Discussion The former Mirani Shire Council adopted their Planning Scheme (known as the Mirani Shire Plan) on 13 June 2007. The Mirani Shire Plan took effect on 9 July 2007. Following the commencement of the IPA planning scheme various issues became apparent, making it necessary to undertake a range of amendments. At Mirani Shire Council’s Ordinary Meeting held on 28 November 2007, the Council resolved to propose amendments to the Planning Scheme and submit for State Interest Review and that this information be reported back to Council for consideration. The proposed amendments were held in abeyance by Council pending a decision on amalgamations. Following commencement of the Mackay Regional Council, a briefing was undertaken on 2 July 2008 in order to review the amendments proposed by the former Council. On 7 July, Council submitted proposed Amendment Number 1 of 2007 of the Mirani Shire Plan to the Department of Infrastructure and Planning to allow the State to consider its interests in the proposed amendments. Council received the response from the first State Interest Review on 18 November 2008. Of the 7 submissions made, all were from the one State Agency, being Department of Natural Resources and Water. All of the matters raised are considered reasonable and it is recommended that Council accept all of the 7 responses. As shown in the attachment the

comments received are of a minor nature. Department of Natural Resources and Water requires that Council change the proposed planning scheme amendments to retain the requirement for a minimum 40 metre vegetated buffer over the full length of the lot boundary, in accordance with State Planning Policy 1/92: Development and the Conservation of Agricultural Land. Consultation A meeting was held with Department of Infrastructure and Planning on 2 September 2008 to discuss comments received by the Department of Natural Resources and Water on the proposed amendments to the planning scheme. The main topic of discussion involved the vegetated buffer requirement and if the 1800mm fencing requirement should be removed altogether. Following discussions between DIP and NRW it was agreed that the requirement for a 1800mm solid barrier fence could be removed. The process for Council to amend its Planning Scheme is prescribed in the Integrated Planning Act (IPA). An overview of the process, for making amendments to planning schemes (as specified in Schedule 1 of IPA) to date is as follows: • On 28 November 2007 Council resolved to propose the amendments; • On 7 July 2008 the amendments were provided to the Minister; • On 1 September 2008 comments were received from NRW as part of the first State
Interest Review; On 18 November and in accordance with section 11(2)(a) of the Integrated Planning Act 1997), the Minister advised that Council may notify the proposed amendments. This approval is conditional upon a number of minor amendments. A copy of the Minister’s approval is attached. Council now needs to consider conditions imposed as part of the State Interest Review process in order to proceed with notifying the proposed planning scheme. If Council agrees to the proposed changes recommended by NRW, then Council may commence the public notification phase of the amendment process. If Council does not agree with the conditions, then further discussions will be held prior to seeking further approval to commence public notification. The proposed amendments will be made available for public inspection at Council Offices, Libraries and on Council’s webpage. Information sessions will also be conducted at both the Mackay and Mirani Council Chambers. Owners of properties where it is proposed to rezone land will receive written correspondence and advised of the proposed changes. Owner’s of adjoining properties will also be advised. A minimum of 30 business days is required for the public consultation stage of the amendment process under the Integrated Planning Act. It is recommended that Public consultation meetings are held in February/March 2009, thereby allowing stakeholders sufficient time to familiarise themselves with the proposed amendments. The remaining actions required to finalise the amendment process, are: • Amendments to be publicly notified for comment in the local newspaper for a
minimum of 30 business days;

• A copy of the proposed amendments are made available for purchase during the public notification period;
• Council to consider properly made submissions; • Council to determine its response to each properly made submission; • Council to provide a copy of the proposed amendments (with any revisions) to the
Minister; • Minister to reconsider potential adverse effects of further amendments to State
Interests; • If no further State Interests are to be considered, then Council resolves to adopt the
proposed amendments; • Council reports back to all persons who lodged properly made submissions,
explaining how it dealt with their submission; • Final amendments are published in the local newspaper and government gazette; • A copy of the amendment is made available for purchase and Council’s web page is
updated; • A copy of the amendments is provided to the Chief Executive Officer of the
Department of Infrastructure and Planning. Once the amendments are gazetted, the relevant sections of the Scheme will replace the current Mirani Shire Plan. Additional Issue At a subsequent Mirani Shire Council Ordinary Meeting held on 27 February 2008, the former Council resolved to propose an additional amendment to the Mirani Shire Plan Scheme, further to those as resolved at the Ordinary Meeting held on 28 November 2007. The additional proposed amendment relates to the Urban Expansion Zone for the town of Mirani. It was proposed to rezone Lot 1 on RP702237 from Urban Expansion to the Rural Zone and correspondingly to rezone Lot 1 on RP718791 and part of Lot 2 on RP725159 from Rural to Urban Expansion (Refer Attachment B). Following a briefing to Mackay Regional Council on 28 January 2008 it was decided not to proceed, at this stage, with the inclusion of the Resolution by the former Council as part of the public consultation stage of Amendment Number 1 of 2007. This issue will be held in abeyance pending the investigation of other planning applications under appeal. Resource Implications Proposed Amendment Number 1 of 2007 for the Mirani Shire Plan will require planning and administrative resources to undertake and complete the consultation process and adoption stage. Conclusion The proposed amendments will correct minor errors, introduce and amend administrative and use definitions, amend or delete code provisions, introduce a new Tourism zone, reflect State Planning Policies. 7.6 REVIEW OF MACKAY RETAIL & COMMERCIAL STRATEGY

Purpose
To present to Council a Report prepared by MacroPlan Australia that reviews Council’s retail and commercial hierarchy strategy.
Background/Discussion
Following the significant population growth in recent years. The increase in population has resulted in an increase in demand for retail and commercial space and identified shortcomings in Council’s current Retail and Commercial Strategy. During discussions with Council in early August 2008, Council agreed to seek independent advice and review the Retail & Commercial Code in the Mackay City Planning Scheme, particularly as it relates to number, size and location of the higher order retail Centres. The

intent was to review the assumptions and data that underpinned the requirements of the Code in light of the population growth that has occurred and current shopping trends. The outcome of the review was to provide guidance to Council on a strategic direction for retail and commercial centres, based on up-to-date information on the retail and commercial ‘market’ in Mackay and the predicted future. This information and advice could then assist Council in dealing with the new demands. The review is also to be used as a basis for the development of a new Retail & Commercial Code when Council commences its ‘consolidated’ planning scheme in the near future. After inviting quotations from a number of qualified consultants, MacroPlan Australia was appointed in September 2008. The MacroPlan Report (Mackay Retail & Commercial Strategy – February 2009) examines the socio-economic situation in Mackay, the current retail & commercial hierarchy and the amount of floorspace required at various timeframes up until 2021. The Report also provides Council with suggested changes to the Mackay City Planning Scheme and a suggested framework for assessing retail/commercial Development Applications. MacroPlan also undertook a benchmark assessment of three other regional centres in Queensland to obtain an understanding of how Mackay’s distribution of centres compares to the other regional cities. The benchmark assessment covered Townsville, Rockhampton and Gladstone. The MacroPlan Report proposes a number of recommendations across distinct areas (underlined). In summary, the recommendations deal with; 1. Strategic recommendations dealing with Council’s Planning Scheme 2. Supporting and enhancing Council hierarchical approach to retail and commercial

assessment considerations 4. A extensive list of recommendations for operational and Scheme amendments dealing
with the Retail Hierarchy & Assessment Directions, and 5. Further Supporting Strategy Actions designed to ensure that the Mackay City Centre
continues to function as the intended highest order business centre in the region, Council carefully consider any significant change to the future development of the airport and to ensure currency and relevance that Council review this Strategy every 5-years.
Councillors have previously been issued with a copy of the MacroPlan Report and the Final version has rectified a small number of identified typographical errors and spelling mistakes. The MacroPlan Report is over 140 pages, and to reduce bulk a copy of the Report recommendations is shown in Attachment 1 of this report.
Consultation
In preparing the Strategy Report, MacroPlan had discussions with Councillors, senior officers and representatives from the following organisations/companies.

MacroPlan have indicated that there was general support by those consulted for Council’s review of the retail and commercial market in Mackay. The stakeholders were supportive of Council’s proactive approach in undertaking the policy refinement process. Briefings to Council on the need for the review and, by the consultant and Council officers, about interim findings were conducted on 6 August 2008, 12 November 2008, 17 December 2008 and 28 January 2009. Whilst competitive influences amongst some of the stakeholders ensured that 100% agreement on all matters did not occur, the MacroPlan Report however has identified a number of “generally agreed” matters, including:
• All parties were supportive of Council’s proactive approach in undertaking this policy refinement process
• The ongoing population growth of the Mackay Region supported an appropriate level of new and existing facilities.
• All parties expressed a desire for improved certainty through a refined retail hierarchy strategy in terms of their existing and future developments
• Recognising ongoing support for the specialised role of the City Centre and the positive impacts of recent enhancements associated with residential/retail developments and urban improvements.
• Caneland Central’s role in providing regionally specific activities was generally supported.
• In a regional economic strategy context, the development of a refined retail hierarchy and associated planning tools was considered to better support the desired economic outcomes of the region.
• That out of centre developments (from the existing hierarchy) undermined investment in existing centres.
• The approach of applying household numbers to the type of centre was not generally supported.
• A planning assessment approach that recognised the preferred roles of the centres and is supported by less restrictive assessment requirements.
In considering the socio-economic data compiled about Mackay and the comments received from the Stakeholders, MacroPlan have included in the Report a number of key principles for Council to consider including the Planning Scheme to support the Retail Hierarchy and assist in the assessment of development applications at any of the Centres. These principles are designed to encourage sustainable economic development. In summary they are;
i. Maximising economic development & employment – Important to ensure enough retail floorspace is provided in the study area that maximises economic development and employment in this and other sectors.

ii. Demonstrating need – Each Centre should have its own catchment that reflects their position in the retail hierarchy and the need for additional retail floorspace should be demonstrated in a particular catchment.
iii. Mitigating Impacts – Impacts of proposed developments on existing Centres, with regard to sales, should be limited.
iv. Reducing length of vehicle trips – Centres should be established to reduce the length of vehicle trips, especially for convenience and food retailing.
v. Reducing the number of vehicle trips - The number of vehicle trips can be reduced if an appropriate mix of retailing is provided to allow comparative shopping.
vi. Encouraging a mix of uses – Apart from a diversity of retail, other supporting and complementary uses need to be accommodated in sub-regional and regional centres.
The Report also proposes Council consider adopting a modified retail hierarchy structure, one which reflects industry standards. The modified hierarchy also proposes to increase the number of sub-regional centres from one (Mt Pleasant/Greenfields) to two, by including Rural View.
Resource Implications
There is no immediate resource implication resulting from the MacroPlan Report. It does however recommend the need for regular reviews of the retail and commercial hierarchy and there will be further refinement studies of some aspects required when Council develops the new Regional Council Planning Scheme.
Conclusion
The MacroPlan Report provides Council with an assessment of the current and forecast need for retail and commercial floorspace in Mackay. Further, the Report recommends changes to the Retail Hierarchy incorporated into the Mackay City Planning Scheme to reflect industry standard terminology and function and proposes a number of elements that should be considered in any future changes to the Retail & Commercial Code within the Mackay City Planning Scheme. Maps showing the existing Network of Centres - Retail Hierarchy and MacroPlan’s proposed Retail Centres Hierarchy are shown in Attachment 2 of this report. Specifically, the Report recommends a number of matters for Council to consider in relation to encouraging improvements in the City Centre, providing enhanced direction for Sub-regional & Neighbourhood Centres. Whilst the Report does not assess specific retail/commercial development applications, it does provide Council with a very good background on the retail market in Mackay and provide the basis for policy settings when considering assessment reports. The Report however does provide Council with an analysis of alternative retail centre development scenarios. The Reports recommendations provide Council with guidance to consider current applications and on possible amendments to the Retail & Commercial Code. To assist Council in ensuring the future development of retail centres the Report recommends the amendment of the Code to encourage more sustainable travel behaviour, more employment and social self-sufficiency,

encourage centres to be located near good quality public transport and demonstrate retail need and consideration of impacts on existing retailers. Council Resolution

This report is to request that the Council nominate Cr David Perkins as the Portfolio Councillor for Tourism and Economic Development to attend the “New Regions New Directions” Economic & Regional Development Conference 2009 scheduled to be held in Townsville from 4th to 6th March 2009.
Background/Discussion
The LGAQ are hosting their fourth Queensland Economic and Regional Development Conference in Townsville with more that 150 delegates expected to attend from local

government, regional economic development and tourism organisations, state and federal governments and private practice. The event will explore regionalism, local governance and place based economic development with greater opportunities for partnerships and collaboration to further economic and regional development outcomes across Queensland. The program will include a look at what is happening at Commonwealth, State Government and at a local level to tackle contemporary issues including adaptability to climate change, skills formation, housing availability, land use and infrastructure planning. Balancing the sustainability for communities against the protection of key economic drivers such as mining and minerals exploration, agriculture and tourism will also be key discussion points.
Resource Implications
Costs of attendance are catered for in the current budget.
