2020 Jackson County Commissioners’ Minutes Minutes of January 6, 2020 The Board of County Commissioners met in regular session on Monday, January 6, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes. Environmental Services and Noxious Weed Director Scott Kieffaber asked if he could order chemicals early this year to avoid price hikes that could emerge and the Commissioners approved. Scott stated he had a request from someone to do community service at his department and the BOCC said they did not approve due to liability and insurance concerns. 2020 Jackson County Commissioners’ Minutes

Minutes of January 6, 2020The Board of County Commissioners met in regular session on Monday, January 6, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

Environmental Services and Noxious Weed Director Scott Kieffaber asked if he could order chemicals early this year to avoid price hikes that could emerge and the Commissioners approved. Scott stated he had a request from someone to do community service at his department and the BOCC said they did not approve due to liability and insurance concerns. Road and Bridge Director Dan Barnett reviewed the U.S. Department of Transportation Federal Motor Carrier Safety Administration Drug and Alcohol Clearinghouse requirements for CDL drivers that begins this year. Dan explained that he has a laptop set up at the office for his employee’s convenience so they can get registered in the federally mandated program. Dan stated that he is getting new bids for a trailer because the purchase order he submitted is no longer available to order. Dan discussed his concerns with a 2008 welding truck that has 170,000 miles on it and the 3 foreman trucks that have between 130,000-170,000 miles on them. The welding truck is looking at needing a repair estimated to cost $7,000.00. One of the foreman trucks has also started needing regular repairs. Dan also stated he has a track hoe that needs replacement soon as it has 20,000 hours. He is going to seek bids for 2 trucks.

Holton Recorder reporter Ali Holcomb and County Counselor Alex Belveal joined the meeting.

Jackson County EMS owners Brent Teter and Jay Watkins met with Commissioners to negotiate a contract for ambulance services in Jackson County. Commissioner Elmer asked questions about on call staffing versus on duty staffing for the second truck. Brent explained how the schedule works and why the subsidy is higher when there is more full-time on duty staff. He stated that Jackson County has a much lower subsidy than other counties. Brent explained that they utilize the included 64 hours of staffed second truck during peak times they have determined based on the calls they usually receive. Commissioner Kathrens asked why a subsidy was necessary for a business that has been in operation for

over 20 years. Brent and Jay explained that their business accepts assignment on all major insurance providers which allows them to write off some expenses for the patients and the county subsidy greatly supports their payroll, keeping the rates lower for the patients they provide care for. Chairperson Zwonitzer stated she appreciated all the information they presented and that she was in favor of receiving quarterly reports from EMS so they can stay acquainted with the services provided to county residents.Commissioner Elmer made a motion to adopt Resolution 2020-01 Cash Basis and Commissioner Kathrens seconded. Motion carried 3/0.Commissioner Kathrens made a motion to adopt Resolution 2020-02 Banking Institutions and Commissioner Elmer seconded. Motion carried 3/0.Commissioner Elmer made a motion to adopt Resolution 2020-03 Official Newspaper and Commissioner Kathrens seconded. Motion carried 3/0.Commissioner Kathrens made a motion to adopt Resolution 2020-04 Cancelling Warrants and Commissioner Elmer seconded. Motion carried 3/0.

Commissioner Kathrens made a motion to reappoint Janet Zwonitzer as Chairperson for 2020 and Commissioner Elmer seconded. After some initial protest from Chairperson Zwonitzer, she reluctantly agreed to accept the position and motion carried 3/0.

Emergency Management Director Pat Korte submitted an Emergency Vehicle Designation for Edward Kester.

Banner Lake Reservoir Director Lu Griffiths informed Commissioners that the VFW New Year’s Eve firework show at the lake went well. Lu continues to complete regular maintenance.

Brittany Bruce representing NexTera met with Commissioners to discuss an interim agreement to permit oversize loads on county roads so they can access private land for tree clearing. Commissioner Kathrens made a motion to approve the interim agreement with NexTera and Commissioner Elmer seconded. Motion carried 3/0.

County resident Jody Holthaus requested information about the transmission lines near her property and was directed to contact Brittany with NexTera.

Recessed for lunch from noon to 1 p.m.

County Clerk Kathy Mick reviewed the final numbers regarding the 2019 budget and transfers of funds.

Received notification from Mary Edwards that Netawaka no longer needs funding for the senior citizens.

Bruce Rinkes joined the meeting to discuss the transmission lines.

Courthouse Custodian Jerry Mencl informed Commissioners that he had received an estimate for about $5-600.00 for the installation of a 5 gallon on demand hot water heater for the break room at the courthouse. The Commissioners agreed to proceed with the installation.

Left chambers to visit the Denison Quarry and surrounding areas.

Commissioner Kathrens made a motion to approve the December 23 rd minutes as amended and Commissioner Elmer seconded. Motion carried 3/0.

Commissioner Kathrens made a motion to update the 2020 holiday schedule to include a half day off for New Year’s Eve on Thursday December 31, 2020. Commissioner Elmer seconded and motioned carried 3/0.Received a letter from KCAMP explaining the reimbursement received from them to Road and Bridge for a Risk Avoidance Grant they offer. It is to be put towards facility lighting, signage, surveillance equipment and warning signs. The $1,946.41 check was split between Road and Bridge and Environmental Services.

Commissioner Elmer made a motion to approve $5,000.00 from the alcohol tax funded Parks and Recreation account for the Royal Valley Recreation Association and Commissioner Kathrens seconded. Motion carried 3/0. The Royal Valley Recreation Association is a combined organization that serves both the Hoyt and Mayetta communities.

Environmental Services and Noxious Weed Director Scott Kieffaber reported his department’s tonnage totals for the 2019 year. He submitted a renewal agreement for Developmental Services of Jackson County employment program. Commissioner Kathrens made a motion to approve the agreement with DSJC and Commissioner Elmer seconded. Motion carried 3/0.

Road and Bridge Director Dan Barnett submitted a new purchase order to replace a previously approved order for a new trailer. He stated that his department has been clearing roads and completing tree limb removal after the ice. Dan reminded the Commissioners that Jackson County is hosting the Northeast Kansas Highway Officials meeting on March 26th at the fairgrounds building.

Dhiren Chatterji, owner of the Super 8 motel in Holton joined the meeting. He discussed the property he owns and the amount of taxes he pays annually. The BOCC stated they would check into what could be done at the county level to assist with his property taxes. Chairperson Zwonitzer explained that the State of Kansas sets the appraisal guidelines.

Banner Lake Reservoir Director Lu Griffiths reported minimal tree damage at the lake from the ice. He stated he has been advertising 50 acres of hay ground for lease. The Commissioners would like to do five year leases instead of one year leases when hay land is open for bidding next year. They will allow the original farmstead landowners currently leasing to renew their leases as long as they choose to keep it.

Sheriff Tim Morse and Undersheriff Darrel Chapman presented their office’s annual report for the 2019 year.

Minutes of January 15, 2020The Board of County Commissioners met in regular session on Wednesday, January 15, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

Courthouse Custodian Jerry Mencl informed Commissioners that he had found the breaker to fix the lights. The Commissioners thanked him for all his hard work especially with the weather and keeping the sidewalks cleaned off.

Commissioner Elmer made a motion to approve the January 6 minutes as amended and Commissioner Kathrens seconded. Motion carried 3/0.

Minutes of January 21, 2020The Board of County Commissioners met in regular session on Tuesday, January 21, 2020 at 9 a.m., Chairperson Zwonitzer and Commissioner Kathrens were present. Commissioner Elmer was absent due to illness. Deputy County Clerk Tara Peek recorded the minutes.

The Commissioners stated they would discuss with Commissioner Elmer before taking action on the bids. Dan informed Commissioners that he had a complaint about 246 Road this morning and that his department is out with scarifiers on motor graders working on the icy roads. Dan informed Commissioners that he had supplied NexTera with a list of local contractors and lodging businesses.

Hamm Quarry representative Marvin Zielsdorf met with Commissioners to seek the next steps for Hamm to get a quarry opened in the county. He stated that the testing shows the rock looks good and the area is at 226 and G Roads, a half mile from Highway 16. The Commissioners asked Marvin to complete paperwork in the Appraiser’s office. Appraiser Jason Claycamp joined the meeting and stated that he will need the Commissioners to agree to a road agreement before he approves the zoning change and special use permit.

Chris Gordon from Delia Fire joined the meeting to request that Melody Matyak be appointed to serve on the fire board in Ramon Ramirez’s position as he has resigned. Commissioner Kathrens made a motion to approve the appointment of Melody Matyak to the Delia Fire board and Chairperson Zwonitzer seconded. Motion carried 2/0.

Courthouse Custodian Chad Phillips gave an update on building maintenance. He stated that the hot water is working in the break room. He gave thanks to the BOCC for allowing him to use his vacation

time to go on an extended trip. They discussed the ice and damages made to the electrical utility coming into the courthouse the previous week. Thankfully, the Holton City workers repaired it on Sunday afternoon so the courthouse had power again for the work week. Chad asked the Commissioners what they would like him to start with in regards to the remodeling of the large courtroom. The BOCC asked Chad to start with estimates for the ceiling and wall.

Banner Lake Reservoir Director Lu Griffiths said he had some branches that were damaged but not too much because he had done a lot of trimming recently. Lu stated that he would be going to get blueprint drawings for the proposed community building later in the week.

Commissioner Kathrens made a motion to reappoint David Allen to the Judicial Nominating Commission for a term length of March 4, 2020 through March 4, 2024 and Chairperson Zwonitzer seconded. Motion carried 2/0.

Environmental Services and Noxious Weed Director Scott Kieffaber reported that he was expecting delivery of the sprayers and trailer he purchased today. They will be taken to Road and Bridge so they

can install the hitches and accessories needed. Scott stated the 2004 truck is in the shop for repairs. He has picked out colors for the lean to and Chris Gross Construction will start soon on the project.

Road and Bridge Director Dan Barnett joined the meeting. At 9:08 a.m. Commissioner Kathrens made the motion to enter into executive session for attorney client privilege with Dan Barnett, Alex Belveal and Tara Peek present. Commissioner Elmer seconded and motion carried 3/0. Session opened at 9:40 a.m. No action taken. Dan reported that he has the rebuilt motor grader coming back today from Foley. The BOCC and Dan discussed a maintenance issue at the 190th and V Roads area, west of Denison.

Approved two oversize permits to Dakota Matting (Soldier Creek Wind, LLC) for a Tigercat 822D Feller Buncher and Doosan DX140LC Excavator.

Discussed an increased monthly fee for Banner Creek Animal Hospital to accept stray dogs from the unincorporated areas in the county. They have been receiving $600.00 per month since 2015. The Commissioners agreed to offer $800.00 per month for 2020 to offset increased costs for the dogs’ care. Commissioner Kathrens made a motion to approve agreement 2020-06 Banner Creek Animal Hospital Stray Dogs and Commissioner Elmer seconded. Motion carried 3/0.

Commissioner Kathrens made a motion to approve the appointment of Steven Willett to the Planning Commission and Zoning Appeals boards and Commissioner Elmer seconded. Motion carried 3/0. His appointments will expire in December 2022.

Banner Lake Reservoir Director Lu Griffiths received one bid for hay ground at $31.00 per acre. Commissioner Elmer made a motion to accept the bid for $31.00 per acre from Stous and Commissioner Kathrens seconded. Motion carried 3/0. Lu stated he was going to sheetrock the entrance shack and is still waiting for a transformer to be installed before he can work on the new campsite pedestals. Lu continues to maintain the grounds and haul limbs away.

Bruce Rinkes representing CFS Engineering gave an update on their assessment of the proposed transmission line haul routes. They will complete a pre video once the weather allows.

Anna Wilhelm with the tourism board submitted a grant for approval. Commissioner Elmer made a motion to approve $1,000.00 from tourism funds towards the advertisement of the barn tour organized by the Jackson County Historical and Genealogical Society. Commissioner Kathrens seconded and motion carried 3/0. Anna submitted updated Tourism Council By-Laws. The only change was the address.

Recessed for lunch from noon to 1 p.m.

Newly appointed Chamber Director Ashlee York met with Commissioners to get clarification of funding sources from the county.

Road and Bridge Director Dan Barnett rejoined the meeting. The Commissioners reviewed the truck bids submitted during last week’s meeting. Commissioner Kathrens made a motion to purchase a 2020 Dodge Tradesman 3500 regular cab 4x4 truck from Ellis Boys Chrysler Dodge for $41,582.00 and Commissioner Elmer seconded. Motion carried 3/0. Commissioner Kathrens made a motion to purchase a 2020 Dodge Tradesman 3500 crew cab 4x4 truck from Ellis Boys Chrysler Dodge for $44,895.00 and Commissioner Elmer seconded. Motion carried 3/0. Probst Electric Project Managers Shay Carwile and Zachary Hutchison joined the meeting. Bruce Rinkes with CFS Engineering rejoined the meeting. Shay explained that as a subcontractor of the NexTera Wind Energy project they have been accessing privately owned land to remove trees where the transmission lines will be and installing gates. Dan explained that he has found some entrances that are only dirt and rock and have no culverts to allow drainage. Shay stated he believed they were installing corrugated metal entrance tubes and apologized for any completed improperly. The Commissioners explained that the interim agreement they approved was for oversized loads to access land for tree clearing only and that any work or entrances on the county right of way would need to be permitted individually by the Road and Bridge Department. All oversize loads would also need to be approved through the same permitting process. Shay stated that all the equipment is legal limit and later they will have some cranes that will be the heaviest equipment brought in. They have been clearing trees and installing gates to private land. He explained that he thought they were allowed to gain temporary access for field entrances to the privately leased land and he was unaware that they needed permits for those as well. Bruce Rinkes shared that CFS has only just received the bridge files and has not yet completed inspections. Shay asked about the delivery of poles he was expecting to receive on Monday and was told that there is no agreement for the road use for transmission lines in place yet. The County is only allowing tree clearing equipment once properly permitted by Dan Barnett. Shay stated he believes there was some miscommunication and apologized. Dan expressed his desire to have closer contact with the entities working on this project and also brought up setting restrictions on their work during school bus route times.

Received a letter from the Census Bureau requesting boundary confirmation for our county. County Appraiser Jason Claycamp informed the BOCC that he already submitted this information.

Minutes of February 3, 2020The Board of County Commissioners met in regular session on Monday, February 3, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

Environmental Services and Noxious Weed Director Scott Kieffaber discussed the e-waste pricing offered from Teknix Solutions for the scrap computers. He stated that the price for a complete laptop is $.70 per pound, incomplete laptop and towers at $.50 per pound and all other e-waste at $.02 per pound. Scott stated that the epoxy floor would be started today at the office. This means the Noxious Weed office is closed for the week. In the spring he would like to get bids for a concrete slab at the landfill where a dumpster sits. Scott reported that the recycling trailer at Royal Valley school in Hoyt has been consistently being filled with trash and takes much longer to sort the recycled materials out. He will be attending the Hoyt City meeting to address the issue. He mentioned purchasing another recycling trailer

and placing it at the lake during the busy season for use. February 24 th he will attend a meeting with City of Holton for a building permit for the lean-to addition.

Road and Bridge Director Dan Barnett stated that there would be a pre-construction meeting for the D and 129 Roads bridge on February 24th at 10 a.m. Commissioner Kathrens asked about a concern on 246th Road involving a possible water line break from a well or maybe a spring. Ed would like it diverted to the ditch to preserve the road. Dan reported that the contractors working on the transmission lines have brought in a motor grader to repair the roads they are using from 75 highway east to the county line. Dan hoped the Denison Quarry could possibly open later this week. At 9:43 a.m. Commissioner Elmer made a motion to enter into executive session for matters of personnel with Dan Barnett, Kathy Mick and Tara Peek present. Commissioner Kathrens seconded and motion carried 3/0. Session reopened at 9:50 a.m. No action taken. Discussed permitting requirements and road use for the transmission lines.

Commissioner Elmer made a motion to appoint Addie Larson to the Kanza Mental Health and Guidance Center Board of Directors and Commissioner Kathrens seconded. Motion carried 3/0.

Banner Lake Reservoir Director Lu Griffiths reported he was almost finished with the drywall in the entrance shack and had been trimming trees. He is working with the water conservation office to re-bid the proposed wetlands area and is also working with Quail Forever and the water conservation office to create a pollinator/wildflower area. This Saturday there is a fundraiser planned for the community building at the lake. Lu asked for approval to spend about $4,500.00 to have G&R Directional Drilling place conduit for the electrical wiring in Campground B where the additional pedestals are being installed. This would make it easier to repair and make additions in the future.

Commissioner Kathrens made the motion to approve $1,500.00 from the alcohol tax generated prevention fund to be used towards toy balls and fidget spinners handed out to kids from the Sheriff’s Office and Commissioner Elmer seconded. Motion carried 3/0.Recessed for lunch from 12:15 p.m. to 1:15 p.m.

NextEra representatives Brittany Bruce, Robin Dunn, Mark Trumbauer and Bobby Barnett, Tanner Yost with Kirkham Michael, CFS representative Bruce Rinkes and Alan Anderson with Polsinelli joined the meeting to discuss the transmission lines coming through the county. County Clerk Kathy Mick and Road and Bridge Director Dan Barnett were also present. Chairperson Zwonitzer stated they were weary of entering into a road use agreement after the interim agreement was breached last week when a permitted load was transported down a minimum maintenance road not approved for travel, causing damage. Janet also mentioned the many temporary entrances put in place to private land crossing the county’s right of way without prior county approval. Brittany apologized for the mix up and stated that NextEra has a reputation they want to uphold so they will do what they need to make it right. Dan stated he had looked at the entrances with Larry Boatright from NextEra last week to address some concerns. Robin Dunn suggested that moving forward they can submit permits a few days in advance for approval and Bobby recommended having weekly meetings with Dan at his convenience. Bruce Rinkes

asked if they had a detailed activity worksheet and how they planned to work through the county, starting from one end to the other or jumping around. They explained that there will be many crews working the entire line and will vary day to day. Dan asked how they decide what constitutes adverse weather conditions and who makes the call to stop activity. Robin explained that they work as long as they are able to maintain the conditions and work safely. Dan stated that he was told they would have a maintainer on site starting today. Tanner added that it varies by county how they maintain. Some will maintain as they go and possibly upgrade and others add rock later. Bruce stated that the soil type here is clay and very different than the sand in western parts and that we have a lot more springs and surface water which will be more difficult to work with. Bruce stated that the rainfall totals here are much higher and roads have higher traffic too. Robin stated that the roads will get damaged, but they will fix them as needed for traffic and once completed they will be put back to original or better. Dan stated that he wants to conduct a drive through at the end of the project where he can create a punch list of problem areas he wants addressed. Robin accepted responsibility for the miscommunication and promised they will provide reclamation of the roads as the county sees fit. He stated sometimes drainage issues may arise later and they will still come back and fix anything needing repairs, even if its 2 years after the project. He added that they talk to the landowners about their families and schedules so not to interfere too much with traffic and place signage for safety. The crews are on hold until the agreement is official. Dan asked about the supplies located on 254th and X Roads and if that was a laydown area for the project. Shay explained that they placed some gates and tubes on private land temporarily until they can get access granted to move forward with the project. Dan asked for an estimate as to how many more loads they expect to bring in to which the response was about 92. He asked how many more entrances and it was estimated that 11 were already in place and probably 3 times that would be installed total. The poles would come in one at a time and be delivered to their exact location unless weather hinders their placement. Tanner Yost from Kirkham Michael gave a brief overview of how his engineering services calculate their reports and evaluations, using BrR bridge rating software and truck types determined from what NextEra has provided, in regards to the heaviest possible load weight.

Commissioner Kathrens made a motion to approve the minutes of January 27 th as written and Commissioner Elmer seconded. Motion carried 3/0.

BOCC decided to send the new recycling sprayers and trailers to Hoffman Brothers in Hoyt for their new hitches.

Minutes of February 10, 2020The Board of County Commissioners met in regular session on Monday, February 10, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

Road and Bridge Director Dan Barnett discussed the agenda for the Northeast Kansas County Highway Officials Conference to be held in Holton on March 26th. Dan also shared information regarding the federal aid funds exchange program for 2020. County residents Keith Kelly and Larry Kathrens joined the meeting. Keith Kelly asked about the recent purchase of 2 Dodge trucks for the Road and Bridge Department. He stated that Commissioners should accept low bid and not use taxpayer money if they wanted to buy a one ton Cummins engine. He questioned whether the specs were the same for the truck bids. Larry Kathrens shared a photo inventory of road concerns he has. He also had issues with the rock quality being used and referred to it as subpar. Dan stated that they had been using Mid States Materials, two-inch road rock. Today they were able to begin hauling out of the Denison Quarry with a better quality road rock. They have not opened to the public yet as they await installation of equipment that will allow the ability to print electronic tickets. Dan stated that they have been getting rock from

quarries in Cummings, Wheaton and St. Marys. They discussed the possibility of Hamm opening a quarry in the county and that the rock is expected to be similar to the Circleville quarry, though it is a different ledge. Larry Kathrens asked why the county does not purchase screened rock and it was explained that the clean rock costs more and putting it on the road would be like putting down marbles, Commissioner Kathrens stated, it would not stay in place. Commissioner Elmer added that the rock quality is less of an issue than the drainage problems. The moisture and weather has prevented the cleaning out of the ditches. Larry asked why the county doesn’t close the minimum maintenance roads when they are not needed to be used. Larry stated they felt that there is too much time being wasted on maintaining the dirt roads that could be used to work the rock roads. The Commissioners explained that the minimum maintenance roads need to remain open for farmers and landowners’ purposes. Keith Kelly asked if there is a plan of attack for the roads and ditches. Chairperson Zwonitzer explained that there is a plan, but they do have to pull people away from scheduled maintenance at times to address issues that arise, especially with the weather. Keith asked if records are kept to show what has been completed on roads and the Commissioners explained that Dan Barnett does keep those logs at the Road and Bridge Department. Larry Kathrens asked if the Commissioners had thought of using private contractors to fix the road ditches so they will drain. Chairperson Zwonitzer stated that Dan had proposed that before and they decided against it. Commissioner Kathrens stated he thought it would be problematic to hire one local contractor and not upset the others that did not get the job. Larry stated that maybe they would have ditches that drain if done by a contractor and he feels the county has the best equipment available and poor workmanship. Larry stated that the blade is what has ruined the roads with poor operation in addition to the drainage issue. Commissioner Elmer stated that the cost of hiring private contractors is prohibitive for the county and although they may be able to hire 50 miles of road to be done, what good would that do for the other 750 miles of roads in the county. Larry stated that he does a lot of work in Atchison County and they have better roads than Jackson. He stated that the townships hire contractors for the ditching there. Commissioner Elmer explained that they have more funds to work with in Atchison County. Larry asked if all the dealerships get a spec sheet to guide the bidding process and Commissioner Elmer stated that the Road and Bridge Director does provide that when requesting bids. Keith asked if that is in county only and if they had considered buying through the state. Commissioner Elmer explained that the dealerships are using government discounted pricing when they bid. Larry asked why the truck bids were not the same, that some bids were for ¾ ton and some for one ton. Dan clarified that the requests asked for ¾ and 1 ton, single and extended cabs. Everyone got the same spec sheet. Dan wanted diesel engines for the purpose of getting more mileage hopefully. Dan explained to Keith that FAS routes are the number one priority as they are emergency routes and widest right of way, 27 feet width with substantial ditches and then secondary routes is his goal. The plan is to build up material from farmers who allow in order to help build the base, then rock, scarify and add lime. Keith asked about addressing specific drainage issues like where water is crossing roads first instead of FAS routes. He wants to know if anybody goes out in the rain to observe the drainage issues and records that information for maintenance purposes. Dan stated the foreman give a list of issues they see and they get addressed when they can. Moisture problems have made some projects take a lot of time to complete. As opportunity allows they have started correcting some drainage concerns. Keith asked if they have enough personnel. Dan said no but he has been approved to hire one more person. He

explained they do pull people away from roads to clean ditches and something else can suffer when pulled away.

County Counselor Alex Belveal informed the Commissioners that Treasurer Linda Gerhardt has identified a property that still owes $66.02 real estate taxes so she will be sending a letter to notify the owners. Received an entry of appearance for Rex Larrison and a motion to modify the restraining order to allow him to enter the sliver of land Sharon Jenkins was awarded so she can proceed with selling to him.

Scott Foster, owner of Foster Ford, stated he felt insulted in regards to the truck bids recently reviewed by the Commissioners. He read a statement he prepared aloud. He stated he was appalled that the low bid was not accepted. He mentioned that he has operated 35 years of business in Jackson County and contributes to the tax base. He felt the bid process was not followed by the elected officials. Commissioner Kathrens stated how will they know if the Dodge will outlast or outperform the Ford if they don’t try it. Scott stated the Ford consumer reports prove the Ford truck is the best selling truck for 43 years. Commissioner Kathrens stated that, for example, with motor graders different brands perform differently and they have not always chosen low bid. Some brands and models are better than others for different purposes. Commissioner Kathrens asked Scott how many times had his low bid not been accepted in 35 years from the county and Scott stated one other time his low bid was rejected for a vehicle purchased for the Appraiser’s office. Commissioner Kathrens explained his basis for selecting the Dodge over the Ford, citing the towing capability and engine longevity.

Received an invitation to the Pines open house for their addition on February 15 th.

Appraiser Jason Claycamp met with the Commissioners to discuss the zoning regulations in regards to moving trailer houses within the county. Completed the 2020 Initial Boundary Validation for the U.S. Census Bureau.

Randy and Kathy Robinson joined the meeting to discuss X4 Road where there is a low water crossing that needs work. Randy stated he has 80 acres of farm land that he needs to access and the low water crossing prevents him from doing so. Dan agreed that the area needs attention but he won’t be able to work on the issues until it dries up, which could be a long time. Dan would like to put in two, new oversized pipes and a toe wall once the weather permits. Dan stated he could possibly get an excavator out there to open up the ditches to help for now.

The Commissioners discussed the road use agreement they have been working on with NextEra.

Courthouse Custodian Chad Phillips gave an update on the meeting room availability. Approved a courthouse lawn use request for the Art Walk on May 2nd.

County resident Terry Smith joined the meeting and stated he wanted to know why the county spent the additional money on the trucks purchased for Road and Bridge when they could have used that money to buy rock for the roads. Commissioner Kathrens explained why they chose to purchase the diesel engine Dodge trucks. Terry stated he felt the county should accept the lowest bid.

Banner Lake Reservoir Director Lu Griffiths stated he was purchasing 14 fire rings and has been continuing to trim trees and perform regular maintenance. He will be working with Riley Electric to get boring completed for the new electrical pedestals. He shared that the recent community building fundraiser sold 72 tickets.

Youth Services Director Brooke Smith met with Commissioners to give an update on the reorganization proposed by Governor Kelly. Brooke explained that there is $96,000.00 available in DOC funds to be used in evidence based programming. They are still having a discussion on how to target the funds whether that be mentoring or parenting classes. Brooke reported that her new employees are doing very well and will attend training next week.

NextEra representatives Mark Trumbauer, Robin Dunn, Spencer Jenkins and Chris Sledge, CFS representatives Kenny Blair and Lonnie Martin joined the meeting to discuss the transmission lines coming through the county. Minutes of February 18, 2020The Board of County Commissioners met in regular session on Tuesday, February 18, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

Noxious Weed and Environmental Services Director Scott Kieffaber stated he was preparing to send out bids for chemicals. He reported that after talking with the City of Hoyt about the trash problem in the recycling trailer that the city would add a flyer reminding residents of the acceptable items in their water bill. He will also attend the next senior lunch in March to educate residents on the recycling materials accepted in the container. He has been in contact with the Whiting mayor to schedule a recycling trailer to be used by its residents. Scott stated the hitches for the new sprayers are being installed.

Road and Bridge Director Dan Barnett reported he had met with NextEra, Probst Electric and CFS representatives to discuss their plan for the week. Dan submitted an initial settlement option from KCAMP for an insurance payout for the 1993 Mack semi that was damaged in an accident recently. Dan stated he was going to negotiate the offer. Commissioner Kathrens reported that there are no signs in the 238 and H/J Roads area designating the minimum maintenance status of the road. Holton Recorder reporter Ali Holcomb joined the meeting. At 9:28 a.m. Commissioner Kathrens made a motion to enter into executive session for attorney client privilege with Alex Belveal, Dan Barnett, Tim Morse and Darrel Chapman present. Scott reported that he has made arrangements with the Whiting mayor to offer a recycling trailer a few days a month starting in April as long as the city board approves. Scott stated that on March 10th he has a solid waste meeting scheduled. Scott submitted used pricing for recycling trailers to be reviewed. He hopes to purchase one from Kickapoo Tribe that is no longer being used. Commissioner Kathrens asked Scott how the cost share program works for noxious weed chemicals and Scott stated he would need to get more information. Commissioner Elmer left at 10:34 a.m. for a doctor appointment.

Banner Lake Reservoir Director Lu Griffiths reported he is hosting 4 th graders on April 24th for educational activities sponsored by Quail Forever. He continues to repair grills and trim trees. He has been locating sewer lines in preparation for the new electric pedestals. He discussed looking into a new website design.

County Clerk Kathy Mick gave an update on grant policies she has been working on. Kathy also explained how the taxation will work on the transmission lines after their 10 year exemption given by the state.

Anna discussed a shortfall in bed tax funds and asked the Commissioners if they could appropriate some alcohol tax generated parks and recreation funds to cover some of the grants or the council would possibly cut some grant approvals if the event does not bring in overnight stays. No decision was made.

Sean Willcott met with Commissioners to discuss the process of passing a resolution to allow his microbrewery to sell alcohol without a portion of business requiring food sales. He believes it may need to be voted on the next ballot. The Commissioners thought that he should discuss with the City of Holton and ABC, that the county’s resolution was for unincorporated areas only.

Banner Creek Reservoir Science Center CFO Gordon Lamme requested funds of $10,000.00 to help with costs to update safety and security at the center. They would like to add a sidewalk to the observation deck and IT upgrades for the network and firewall. These upgrades would allow them to utilize the high speed internet. The security upgrades are necessary for replacement of some cameras that were damaged from lightning. High winds took out their sign so they would also like to replace it with a mobile sign that can be taken to events. Gordon explained that the center draws hundreds of people every year as it is the highest powered scope in a 5 state area along with the darkest viewing sky due to its rural location. No decision was made.

The Board of County Commissioners met in regular session on Monday, March 2, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

County Appraiser Jason Claycamp informed Commissioners that the zoning regulations do not have any setbacks for power lines.

Noxious Weed and Environmental Services Director Scott Kieffaber reported that the bicycles had been picked up by the person who repurposes them. Scott asked for approval to seek bids to have the Noxious Weed and Recycling/HHW buildings repainted. He is scheduling Earth Day activities with Holton students. Scott reported that the City of Holton approved the building permit for the lean-to addition.

Road and Bridge Director Dan Barnett reported that he had received excavator bids from Caterpillar, John Deere and Komatsu. The bids will be opened after the demonstrations this week. Dan submitted the first invoice from CFS Engineering. County resident Debbie Coleman joined the meeting to voice her concerns on 142nd Road. She stated that there have been trucks hauling rock out of the quarry during school bus route times and she believed that was supposed to be restricted. She stated that trucks are not following the speed limit and asked questions about dust control and road maintenance she thought was to happen before the quarry was used. The Commissioners explained that the dust control would be applied before May 15th and they will discuss her concerns with safety and speed with the quarry operators and Sheriff. Dan informed Commissioners that he would be advertising for some seasonal mowing positions and requesting oil bids for chip and seal projects this summer. Dan presented the Commissioners with some sample agreements from other counties to hire out for rock hauling. He would like to consider contracting with local business owners for a per load fee to haul rock throughout the county. Dan reported that a pipe collapsed at the Q and 134 Road area and is being replaced. NextEra reported to Dan that they will soon be bringing transmission line poles in for placement. Commissioner Elmer and Dan informed the board that they had met with Prairie Band Potawatomi Nation Road and Bridge Director Chago Hale to discuss 158th Road and because Dan does not have the resources or manpower to assist he suggested Coughlin Brothers who did a portion of 254 th Road last summer. Dan submitted his proposal for the insurance adjustment on the semi damaged in a recent accident. He is waiting for approval from KCAMP.

County Counselor Alex Belveal gave an update on the injunction filed to remove a restraining order from Sharon Jenkins property. Alex also discussed a Civil Rights policy for the county.

At 10:31 a.m. Commissioner Elmer made a motion to enter into executive session for attorney client privilege with Alex Belveal, Tara Peek, Kathy Mick and Lu Griffiths present. Commissioner Kathrens seconded and motion carried 3/0. Session reopened at 10:36 a.m. No action taken.

Banner Lake Reservoir Director Lu Griffiths reported he has been hauling gravel to the parking lots and roads at the lake. The conduit has been installed in campground B and is ready for Riley Electric to start wiring.

The Board of County Commissioners met in regular session on Monday, March 9, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

Road and Bridge Director Dan Barnett and Jerry Cashier from Evergy joined the meeting. Jerry informed the Commissioners that Evergy will be replacing the existing line in Jackson County that was built in 1955. The new line will remain the same for the most part with a few shifts. Currently they have crews out clearing right of way and installing new gates. The start date for the replacement is September and they will be bringing in bucket trucks, a drilling rig and large steel poles. They do not have a haul route identified yet but they will be proposing a road use agreement when they have more details. Keith Kelly joined the meeting. Dan submitted an offer from KCAMP regarding the damaged semi-truck. Commissioner Elmer made a motion to approve the settlement of $18,495.45 and a buy-back of $2000.00 for the truck. Commissioner Kathrens seconded. Motion carried 3/0. Road and Bridge will use the settlement to repair the truck and obtain roadworthiness certification from another party to be submitted to KCAMP. Dan informed Commissioners that Coughlin Brothers are submitting an estimate for 254th Road west of Highway 75, 2 miles of rebuild. Dan explained that the company offered a free bid and have made improvements to their trimming process. Commissioner Kathrens stated that he was not impressed with the work they did last summer and it was not in the budget to get it done. Commissioner Elmer asked what other option do they have to get the road maintained if they do not use an outfit like Coughlin Brothers. It was decided that they should give it a couple years to see how it holds up before making any plans to do another section. Dan submitted a preliminary plan for chip seal roads and their maintenance for the next 4 years. It was decided that they would drive the roads and get a better idea of what needed prioritized first. They discussed patching spots instead of overlaying portions because of budget constraints. Dan proposed using haydite instead of the ¼ inch chip material because it is less angular and lighter weight. It is the recommended material and not as hard on the equipment used for chip sealing. Dan mentioned the possibility of lowering the county speed limit on rock roads from 55 mph to 45 mph. He stated patrons are requesting this reduction. The Commissioners asked County Counselor Alex Belveal to look into what it would take but had concerns over the enforcement and cost for county wide signage. The Commissioners and Dan discussed options for watering the quarry road until the dust control can be applied. At 10:06 a.m. Dan requested an executive session to discuss matters of personnel and Commissioner Elmer made the motion with Sally Alley, Kathy Mick, Alex Belveal and Dan Barnett present. Commissioner Kathrens seconded and motion carried 3/0. Session reopened at 10:21 a.m. No action taken. Dan informed Commissioners that the excavator bids will be ready for review on the 16th. The 3 bidding companies have been giving demonstrations at the 94th and T4 Road area. Dan will begin the interview process for the brush crew position.

Courthouse Custodian Chad Phillips informed Commissioners that the refinished window seals in the Appraiser’s office are near completion. He plans to replace the vanity in the women’s employee restroom and seek bids for a wall renovation in the courtroom.

Martha Smith and Logan Bausch from NEKES gave their annual report. In 2019 they approved 34 new wastewater permits, 28 completed systems, 82 property resale evaluations and 5 well screens. They also

received nuisance complaints about deplorable living conditions, improper dumping of sewage, squatting and excessive trash. They reminded the Commissioners that they have a Facebook page to help convey environmental information to the counties they serve. Chairperson Zwonitzer reported an area with excessive trash that had been reported to her for NEKES to investigate.

Banner Lake Reservoir Director Lu Griffiths submitted a hay lease contract for Larry Holliday and Diane Levick for gate attendant. Due to rain he has put off the wiring for the new camp spots.

Angie reported that Jackson County has one positive case of Covid-19. She will continue to have daily contact with this person while they are in quarantine at their home. She has communicated with all health care providers so they can be prepared. Angie explained the testing process where they do the testing in the parking lot and then if there is a positive result they start contacting people and places that may have been exposed to by the person. She encouraged social isolation, working from home and washing your hands regularly to avoid infection. Jason Belveal and Jeff Morrow joined the meeting. There was discussion about the Governor sending her non-essential staff home. Alex Belveal asked about recommendations for the courthouse. Suggestions included the possibility of locking doors to the public, assisting patrons by appointment only, lengthening time in between people to properly disinfect and check employee temperatures. Chairperson Zwonitzer thanked Angie on behalf of the BOCC for her dedication to keeping Jackson County safe. Angie explained the concerning groups as those who have traveled to certain states, cruise ships and internationally. Judge Marek was asked about the District Court’s directives given and he explained they are limiting services and pushing trials back. Korey Sawyer asked about the Attorney’s office in regards to their limited ability to space out their 8 employees. It was suggested they could move some into the conference room or Memorial Hall if necessary. They discussed ideas for screening people who enter the courthouse for business. Linda Gerhardt joined the meeting to discuss how the State of Kansas closure will affect her office’s ability to complete driver’s licenses and registrations on vehicles.

Commissioner Elmer made a motion to adopt Resolution 2020-09 State of Local Disaster Emergency for Jackson County and Commissioner Kathrens seconded. Motion carried 3/0.

Road and Bridge Director Dan Barnett stated he was going to accept bids for rock hauling at an hourly rate. Different truck types could vary in cost. Dan also reported he has a barrel bed truck with a broken frame from wear and tear that is probably not cost effective to have repaired. He now has 3 new International trucks, 3 semi-trucks, 3 orange trucks purchased from the State and 2 belly dumps. Additionally, there are 11 motor graders each covering about 110 miles of road to maintain. Dan wants to seek bids from outside the county to haul additional rock so they can get more improvements done.

Currently because of rainy, wet conditions most operators have been sent home. They will have to work as much as they can when weather allows even if it’s on weekends. Commissioner Kathrens stated he would like to see more information on the cost of this before making any decisions. Chairperson Zwonitzer suggested writing a letter to Representative Francis Awerkamp, Senator Dennis Pyle and Representative Randy Garber asking them to seek legislation allowing counties to do so since the State of Kansas is responsible for the oversight of all county appraisers and the formulas they use to determine rates. She also asked County Counselor Alex Belveal to look into whether they had the ability to extend the due date from May 10th to June 10th for property taxes. Commissioners Elmer and Kathrens agreed.

Minutes of March 23, 2020The Board of County Commissioners met in regular session on Monday, March 23, 2020 at 9:00 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

Road and Bridge Director Dan Barnett stated he was going to accept bids for rock hauling at an hourly rate. Different truck types could vary in cost. Dan also reported he has a barrel bed truck with a broken frame from wear and tear that is probably not cost effective to have repaired. He now has 3 new International trucks, 3 semi-trucks, 3 orange trucks purchased from the State and 2 belly dumps. Additionally, there are 11 motor graders each covering about 110 miles of road to maintain. Dan wants to seek bids from outside the county to haul additional rock so they can get more improvements done. Currently because of rainy, wet conditions most operators have been sent home. They will have to work as much as they can when weather allows even if it’s on weekends. Commissioner Kathrens stated he would like to see more information on the cost of this before making any decisions. Minutes of March 30, 2020 The Board of County Commissioners met in regular session on Monday, March 30, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes.

Environmental Services and Noxious Weed Director Scott Kieffaber reported that they had recently completed some dirt work and gutter repair to keep water diverted from the foundation. Scott stated he had not received much interest for the paint bids he sought for the exterior of the metal buildings. He is continuing to find contractors to bid the job. Scott submitted a list of projects he would like to address for his departments in the 2020 year. He plans to begin rotating a recycling trailer to Whiting soon and working alternating days in the office to maintain social distance. Chairperson Zwonitzer made a motion to approve the annual solid waste meeting minutes and Commissioner Elmer seconded. Motion carried 3/0.

Road and Bridge Director Dan Barnett submitted a permit for ROW from the water district for a property that does not yet have their entrance installed. It was decided to wait on approving the permit until the entrance is completed. Dan estimated that it costs $138 per hour for Capitol Trucking to haul rock from the Big Springs quarry to the Holton stockpile where county trucks then load the material and deliver to sites. Dan would like to hire local contractors to haul on call and at will in the $90-$100 per hour range. They discussed using local quarries to carry material directly to where it is needed to get the most accomplished while keeping the costs as low as possible. Chairperson Zwonitzer stated she was okay with doing so and Commissioner Kathrens stated he wanted to review the proposed contract before deciding. The BOCC discussed the Denison quarry haul route and the issue they are having with commercial trucks using roads not designated. Chairperson Zwonitzer stated she would like to see more signage and enforcement on the route. Additionally, Dan stated that NextEra has been caught off of their designated haul route as well and the county now has two consultants from CFS Engineering overseeing the project. They will start assessing fines for failure to stay on the route.

Emergency Management Director Pat Korte requested renewal of the disaster declaration. Commissioner Elmer made a motion to approve 2020-12 State of Local Disaster Emergency for Jackson County and Commissioner Kathrens seconded. Motion carried 3/0.

County Appraiser Jason Claycamp joined the meeting to update the Commissioners on the recent zoning meeting and approvals. Commissioner Elmer made a motion to approve Resolution 2020-13 Zoning Change to A2 Commercial for Hamm Quarry and Commissioner Kathrens seconded. Motion carried 3/0. Commissioner Kathrens made a motion to approve 2020-14 Zoning Change to A2 Commercial for Hamm Quarry and Commissioner Elmer seconded. Motion carried 3/0. TG Hamm and Ernest Frea joined the meeting in regards to the zoning changes for the quarry they plan to open. They propose that the county will receive 200 tons of rock per every 20,000 tons sold plus a 5 cent royalty. They would also provide signage and dust control. The Commissioners requested a route be designated and TG agreed they could do that. He stated he would get a road agreement started and send to the County Counselor to review. They were hoping to begin this summer but with the wind farm rock needs they would likely start in the fall.

Banner Lake Director Lu Griffiths informed Commissioners that bathrooms and playgrounds at the lake are closed due to Covid-19 concerns. Camping is still allowed as long as proper social distancing remains in effect. He will begin mowing soon. Deb Dillner joined the meeting by phone to give an update on the grant and fundraising efforts for the community building to be built at the lake. She stated that including commitments they have raised $127,000.00 so far. She asked for an additional $5,000 to help with grant paperwork booklets and building plans or for the printing to be done by the county. She added that the concrete work for the basement and storm shelter is estimated at $35,000.00 and that she has been asked by the public why the county is not contributing more than the $25,000.00 they committed. She stated that they are still taking brick orders and donations and that she is overwhelmed and humbled by the support from the community.

County resident Luke Schreiber called to address a concern he has for senior citizens’ ability to get meals in the small town communities. Chairperson Zwonitzer stated she would discuss with the Elderly Services Director Amanda and get more information.

At 11:29 a.m. Commissioner Elmer made a motion to enter into executive session for matters of personnel with Alex Belveal and Tara Peek present and Commissioner Kathrens seconded. Motion carried 3/0. Session reopened at 11:35 a.m. No action taken.

County Clerk Kathy Mick and Treasurer Linda Gerhardt joined the meeting to discuss limiting office hours to half days. Linda explained that renewals will have a 60 day extension once the Governor lifts the disaster declaration. She stated that taxes will still be due May 10 th and the State of Kansas can only extend that due date if they so choose.

Chairperson Zwonitzer stated she was fine with it and Commissioner Elmer said he wanted to try it and see how it goes. He would like to see the use of ten trucks and no end dumps to see what they can get accomplished. It may not take the entire 30 days. BOCC discussed road concern emails and voicemails they received. The concerns were reported to Road and Bridge Department.

Lu Griffiths reported changes they have made at the lake amid Covid-19 concerns. The swim beaches, bathrooms and kayak shack remain closed. They will not allow the chapel to be used for Easter services. They have started mowing and are open for camping and fishing. He is working on preparing community building bids for the grant now extended for submission in July.

The Commissioners attended a phone conference with Granite Solutions offering their services to assist in IT services to help employees work from home. The Commissioners thanked them for their presentation and declined their services.

Commissioner Elmer made a motion to approve the March 30th minutes as written and Commissioner Kathrens seconded. Motion carried 3/0.

County Treasurer Linda Gerhardt joined by phone to ask about extending the tax sale deadline as she has received calls from taxpayers regarding the sale. The Commissioners stated they would like to keep the deadline for the back taxes to be paid.

Road and Bridge Director Dan Barnett stated they have been working on pipe and tube replacements. Dan would like to auction some equipment needing expensive repairs. He has 4 dump trucks that have been sitting for over a year that need repairs that cost more than the value of the trucks, an old welding truck and an old excavator. Commissioner Elmer stated he would like the beds saved from the trucks and Commissioner Kathrens agreed that would be good. Dan stated that NextEra will have N Road closed for one day while they install a jump span bridge. Dan would like to see what it would take to get 254 Road between S and T Roads milled because of the destruction caused by NextEra. He plans to wait until their project is done and expects they will cover the costs associated with it being milled and completing 5 passes of overlay. He continues to have Thursday morning meetings with NextEra every week. Chairperson Zwonitzer shared a concern for 222 Road.

At 9:35 a.m. Commissioner Elmer made a motion to enter into executive session to discuss personnel with Alex Belveal, Tara Peek and Scott Kieffaber present. Scott reported that they will start rotating a recycling trailer from Soldier to Whiting for 4 days a month. He reminded the Commissioners that the license they carry to sell chemicals for noxious weeds does not include dandelions or clover. They do have specific regulations they must follow and some patrons have been turned away from purchasing chemicals because their intended use is not within the regulations.

Banner Lake Director Lu Griffiths reported he has been cleaning up debris from the hard rain and winds. The Commissioners approved a contract for Park Host at the south side of the lake for the season for Will Harder starting April 15th.

Emergency Management Director Pat Korte submitted activity logs through March 21st. She would like to keep offices closed and reevaluate the courthouse closing on April 30th.

Youth Services Director Brooke Smith joined by phone to give an update on her department. They have been taking turns staffing the office and working remotely. She will have a mailbox drop mounted outside the office soon. She is working on completing grant paperwork and will be submitting for signatures soon.

County Counselor Alex Belveal submitted a draft for review by the BOCC regarding allowing liquor by the drink without a food sales requirement to be placed on the November ballot per request from Sean Wilcott, owner of the microbrewery business in Holton. Commissioner Elmer made a motion to adopt Resolution 2020-18 Ballot Proposition Allowing Alcoholic Beverages with no minimum food requirement and Commissioner Kathrens seconded. Motion carried 3/0.

County Appraiser Jason Claycamp submitted a letter of resignation. BOCC thanked him for his work over the years. Jason stated that Carol Griffin will stay during the transition, delaying her retirement.

Environmental Services and Noxious Weed Director Scott Kieffaber submitted a quote from Riley Electric to have electricity installed at the transfer station at the landfill. Currently they use battery or propane to power when needed. The Riley Electric quote includes 120/240 volt wiring in metal clad cable from the shop building then underground to the transfer station. The bid is $1985.00 for materials and labor and an additional $820.00 for Haug Construction to complete the trenching for Riley Electric. Commissioner Kathrens made a motion accept the bid for $2805.00 total and Commissioner Elmer seconded. Motion carried 3/0. Scott also submitted a bid from Eisenbarth Construction for $6,026.00 to complete two slabs and a sidewalk. $2,016.00 materials and labor costs for a 4x36 slab 6 inches thick and a 4x12 sidewalk 4 inches thick at the recycling center. $4,010.00 materials and labor costs for a 540 square foot slab and rock demolition at the landfill. Commissioner Elmer made a motion to approve the bid for $6,026.00 and Commissioner Kathrens seconded. Motion carried 3/0.

Road and Bridge Director Dan Barnett submitted the annual bridge inspections from Elite Engineering Services. Dan informed Commissioners he sought bids from Vance Brothers and Ergon for chip seal oil and only received a bid from Vance Brothers. Commissioner Elmer made a motion to approve the Vance Brothers bid for $1.75 per gallon of RS-1H+ material plus $.08 per gallon for freight and Commissioner Kathrens seconded. Motion carried 3/0. Dan received the following bids for approximately 3500 tons of chip material:

Commissioners Kathrens and Elmer both stated they wanted to use this service for a trial period and then evaluate from there. The BOCC agreed to allow 10 full days of hauling material to start with. Commissioner Elmer made a motion to accept the bid from Ehrhart Excavating for $90.00 hourly and Commissioner Kathrens seconded. Motion carried 3/0. Dan informed Commissioners that a jump span bridge has been put in place on N Road by NextEra. They are providing the proper traffic control while it is in use. Dan stated that NextEra has done some patching on 254th Road but it will need repaired after they complete their project. He will pursue bids for this at NextEra’s expense per the road use agreement. NextEra has also flattened some tubes and damaged a concrete banister near 262 and Q4 Roads. They will be repairing all damages that transpire during their installation of the transmission line. Dan informed Commissioners he was already getting calls from landowners asking to keep the entrances permitted to NextEra and he will look at each request one by one to determine if it’s acceptable. Commissioner Kathrens asked Dan to look at road concerns at 178th and T Roads, V and 142 Roads and T Road from Birmingham south. Ed also reported that a tube recently replaced near Mark Bowser needs rock and that he had spoken with Dan Pollock about the county getting rock from his property. Dan stated he would look into what the costs would be to get a crusher from Hamm or Mid-States. Chairperson Zwonitzer mentioned using some of the larger rock for rip rap where it’s needed. Dan informed Commissioners that KDOT has a 15/85 county/state cost share program that he would like to use to purchase rock for FAS routes, however the program wants engineered design builds so he is trying to get more information as to how to proceed. The Commissioners asked about his department’s needs for supplies and Dan stated he had recently ordered some hand sanitizer, but he is wanting to acquire wipes, gloves and masks if the county can find any to order.

Courthouse Custodian Chad Phillips reported his findings of hail damage to the courthouse and senior center buildings. He is waiting for KCAMP’s guidance for the next steps in the claim process.

Chairperson Zwonitzer shared an email from tourism council member Anna Wilhelm. The following events have been cancelled at this time: Art Walk, Kansas Archaeological rock show, Glory Days, Quilts in the Courtyard and Prairie Pickin’ Festival.

Banner Lake Director Lu Griffiths reported that the north side camping was full over the weekend. The south side had 2 campers. The new electric spots at B are waiting for a transformer to be installed. Lu informed Commissioners that he has some contractors staying in that campground and he proposed that campground B be allowed to have monthly reservations. He would like to offer this starting May 1 st as a way to pay for the work done to get the electric there and to also help with the shortage of lodging available with so many contracting projects occurring in the county. The area has 2 hydrants that will have hoses that campers can attach to fill their tanks. These 9 spots would be available to anyone who wanted to pay to rent for a whole month at a time, first come first served, not just contractors. The other campgrounds will continue to have limits on how many days they can be reserved. The summer employees have started working and mowing has begun. Swim beaches, bathrooms and rental shack remain closed. The office is open in the morning and park hosts are available to assist patrons.

County Counselor Alex Belveal gave an update on the upcoming tax sale. The petition has been drafted and packets are being prepared. Currently there are 35 parcels listed on the sale.

Patron Katie Simmons emailed the Commissioners a request to place painted rocks on the courthouse lawn. BOCC agreed to allow her to do so. Received emails from Anita H. and Rick and Kerry Wright requesting the BOCC to take a stand to end the Jackson County Emergency Public Health Order issued on March 19th.

Sheriff Tim Morse and Undersheriff Darrel Chapman joined the meeting to give input on how to open the courthouse safely. Sheriff Morse explained the procedures used at the jail and Sheriff’s Office.

Holton Recorder reporter Ali Holcomb joined the meeting and asked about the reopening plan for the courthouse. BOCC explained they were hoping to open May 18th with limitations to maintain social distancing and other health precautions.

Road and Bridge Director Dan Barnett submitted fuel bids as following:

Haag Oil $8,950.00 ($1.07 per gallon unleaded, $1.13 per gallon diesel) Knotty Pine $9,335.00 ($1.11 per gallon unleaded, $1.18 per gallon diesel)

Commissioner Elmer made a motion to approve the bid from Haag Oil for $8,950.00 and Commissioner Kathrens seconded. Motion carried 3/0. Dan stated that they were replacing a pipe at O4 and 107 Roads. He informed Commissioners that the 450 Ford with 100,000 miles was having engine issues and is in the shop until they get more information. The 2011 John Deere 770G motor grader is needing repairs to its transmission, brakes and final drives. It has about 8,000 hours on it and the repairs are expected to cost about $45,000.00. The value of the grader is estimated at $154,000.00. The BOCC agreed to have the grader repaired and use it until the 12,000 hour range. Chairperson Zwonitzer inquired how the contracted rock hauling was going and Dan informed Commissioners that it had not yet started because the Denison Quarry ran out of crushed road rock. They are hauling from Big Springs for now and will use the contracted hauling once the local quarry is stocked. Dan requested an executive session. At 9:38 a.m. Commissioner Elmer made a motion to enter into executive session with Dan Barnett and Alex Belveal present to discuss matters of personnel. Commissioner Kathrens seconded and motion carried 3/0. Session reopened at 9:44 a.m. No action taken.

Midwest Coating joined the meeting to discuss the roof top hail damage done to county buildings recently. They submitted bids as follows:

Matt stated that these buildings all had a spray foam roofing material and they all have hail damage. In his opinion the foam is a subpar material and is now compromised. The wet insulation will need to be torn out and replaced. No action was taken. At 10:17 a.m. Commissioner Elmer made a motion to enter into executive session for attorney client privilege with Chad Phillips, Alex Belveal and James Gambrell and Commissioner Kathrens seconded. Courthouse Custodian Chad Phillips stated that he would like to see the courthouse roof replaced rather than repairing the damaged spots because it will last longer and have a warranty. The foam has not held up well.

EMS owners Brent Teter and Jay Watkins, Sheriff Tim Morse and Undersheriff Darrel Chapman joined the meeting to discuss the blood draw procedure EMS is contracted to complete for the Sheriff’s Office. Sheriff Morse stated that they have been getting charged for ER visits for taking persons needing blood drawn to the Holton Hospital. Jay explained that they did not have access to the space at the jail where they usually do them because of restrictions due to Covid-19 so for the safety of their employees they had them sent to the hospital. Sheriff Morse stated he was unaware that EMS was denied access to the building and offered two rooms that could be used by EMS for blood draws. Undersheriff Chapman asked EMS to let him know how their office can help prepare the space or supply any PPE they may need upon arrival so they can be ready and on the same page. Sheriff Morse explained the restrictions in place at the jail for safety of inmates and personnel. He has a designated pod where detained people are placed for 14 days before they can enter into the remaining areas. EMS will return to taking blood draws at the Sheriff’s Office. Brent gave a few updates about EMS, stating they had a 25-30% decrease in calls since the pandemic. They have a designated employee who is implementing their Covid-19 procedures. They have halted the EMT classes for now and recently completed a food drive for the local food bank where they filled an ambulance. Next, they plan to have another fill an ambulance drive for hygiene and household items. May 1st was their 20th year anniversary as an operating business. They have plans to open a communication center in Holton mainly for their transfer station services but extended an invitation to assist with any dispatching needs should they arise. EMS will email the 2019 report for the Commissioners to review.

Banner Lake Director Lu Griffiths reported another busy weekend at the lake. All community areas remain closed and they are disinfecting picnic tables.

Victims Services Director Lisa Hyten joined the meeting to discuss a grant opportunity to obtain resources like personal protective equipment for Covid-19. She offered to fill out the application and the deadline is May 20th. This federal grant is for 100%, no match required. The Commissioners gave their approval to apply.

At 11:48 a.m. Commissioner Elmer made a motion to enter into executive session to discuss personnel with Jason Claycamp and Alex Belveal present. Commissioner Kathrens seconded and motion carried 3/0. Session reopened at 11:58 a.m. No action taken.

Scott Kieffaber reported the lean to addition is built and they are waiting on guttering to be installed. The recycling trailer and drop off area has been packed full so it is apparent that patrons are doing some spring cleaning during the shut down. Scott informed Commissioners that Riley Electric have installed lights and power to the transfer station at the landfill $120.00 under budget. Scott recently sold the old courthouse mower and tires on Purple Wave for $1,935.00. The Commissioners discussed how his offices could conduct business as the county reopens. They would like to limit one customer in the office at a time at the Noxious Weed building. They could also bring chemicals outside when sold. Scott is still waiting for painting bids to repaint the exterior of the metal buildings.

Road and Bridge Director Dan Barnett shared the final costs to repair the John Deere at $48,122.59. This repair includes brakes, final drive and transmission with a 6,000 hour warranty. Commissioner Kathrens asked Dan about the tree needing removed from county right of way and Dan explained he had contacted Mick Tree Service and is waiting for the area to get dried out so they can get to it. Dan informed Commissioners that the 2007 Ford F450 has cracked injector and a bad motor. The truck has about 86,000.00 miles on it. Dan stated they have been hauling road rock from Grantville as the Denison Quarry is still out. The closer Denison Quarry has been crushing rip rap but will hopefully begin crushing road rock again later this week.

The BOCC returned a call to Adam Foster about a road concern but there was no answer. Commissioner Elmer asked Dan to look at the 106 and I Roads area.

County resident Oren Long presented the Commission with a resolution he had drafted and a copy of the letter to the editor published in last week’s Holton Recorder. Oren stated he believed the Governor shut down was a violation of the Constitution, specifically the First and Fifth Amendments. Oren’s resolution took issue with orders issued by Governor Kelly and would declare Jackson County as a “sanctuary county for the Constitution and Bill of Rights”. The Commissioners expressed their gratitude for Oren’s well presented views and will discuss before taking any action.

Chairperson Zwonitzer made a phone call to Brett Wagner with Governmental Services regarding a CDGB grant program.

Commissioner Kathrens made a motion to adopt Resolution 2020-20 Title VI Civil Rights Emergency Management Grant Policy and Commissioner Elmer seconded. Motion carried 3/0.

Commissioner Kathrens made a motion to approve $2,500.00 requested for Whiting Ball Club and Commissioner Elmer seconded. Motion carried 3/0.

Scott informed Commissioners that cardboard prices have gone up from $30 per ton to $130.00 and he had the skylights repaired for $725.00 by Morton Buildings that were damaged from a storm. The storm also damaged a camera and they are working with The Computer Doctor to find a comparable replacement. Scott asked if he could host a meeting for Northeast Kansas Weed Directors on June 10th and the BOCC approved the meeting as long as they comply with appropriate social distancing. Scott was asked if he was able to get a recycling trailer purchased yet and he responded he had not been able to get in contact with the seller.

Road and Bridge Director Dan Barnett and Bob Ehrhart joined the meeting to discuss the trucking he has been contracted to do. Bob explained the cost differences hauling rock from Grantville versus Denison. Grantville costs about $10 per ton compared to $1.83 per ton from Denison. Bob explained he did 700 tons on Friday alone and about 3 loads per hour. The BOCC thanked him for his hauling and would continue to use his services. Dan explained that the rock budget was already spent for the year and requested additional funding. The BOCC said they would discuss and let him know. Dan explained that 254 Road between S and T is tore up from NextEra’s use for the transmission line work. Dan is putting together costs for the county to complete the repairs at their expense. This would be a temporary repair and would be resurfaced properly by NextEra after their project is complete.

County resident Oren Long joined the meeting to discuss his proposal. He will attend next week with a group of supporters to discuss again.

Courthouse Custodian Chad Phillips discussed the service agreement with McElroys. Commissioner Kathrens made a motion to enter into agreement 2020-14 Preventative Maintenance with McElroy’s and Commissioner Elmer seconded. Motion carried 3/0.

County Counselor Alex Belveal gave an update on the tax sale. Friday was the deadline to pay and the sale is set for August.

City Manager Kerwin McKee joined the meeting to discuss a partnership for the CDBG grant funds available. It was decided that more businesses could be helped if the county applied. Holton City would only be able to disperse funds within Holton City limits if they applied and were awarded funds. The fee for applying is $3,325.00 and the City of Holton would work together with the county. Wednesday is the public hearing for the CDBG grant application. Chairperson Zwonitzer and Chamber Director Ashlee York will be assisting business owners with applying all day tomorrow at the courthouse.

Sheriff Tim Morse and Undersheriff Darrel Chapman joined the meeting to check in and discuss how the courthouse reopening was working for everyone.

Banner Lake Director Lu Griffiths reported a very busy time at the lake with some people unhappy they couldn’t get a spot. He discussed adding maybe 10 spots to campground C in the future.

Treasurer Linda Gerhardt joined the meeting to give input on the reopening and how it has been working for her office today.

Commissioner Elmer made a motion to approve agreement 2020-15 CFS addendum for engineering services and Commissioner Kathrens seconded. Motion carried 3/0.

Dan Barnett rejoined the meeting to discuss the rock budget. The BOCC explained they would give an additional $300,000.00 from the .4%, fuel and grant matching funds, $100,000.00 from each fund. Commissioners Kathrens and Elmer stated that the county cannot move forward with Ehrhart’s hauling since the rock budget is in such bad shape. Dan stated he would make it work. Commissioner Kathrens asked about the status of a tree being removed to which Dan replied it had not been done yet due to weather. Commissioner Kathrens asked about a concern at 238 and H Roads and Dan stated the county will be placing a tube there. Commissioner Elmer reported a wash out at 142 and Q3 Roads.

Commissioner Kathrens made a motion to approve the amended minutes of May 11th and Commissioner Elmer seconded. Motion carried 3/0.

The BOCC asked Kate Immenschuh if she was interested in the appraiser position to which she replied possibly. The Commissioners stated they would discuss and talk to her next week.

Road and Bridge Director Dan Barnett reported that the Denison Quarry is now stocked with road rock. His department is prepping the patching machine and getting chip rock ready. Dan discussed a concern for signage on 94th where people are getting stuck on a minimum maintenance road. Dan reported grader operators were home for the day as it was raining all day and the truck drivers were hauling chip rock. The rain has pushed dust control back as well.

Chairperson Zwonitzer made a motion to approve Neighborhood Revitalization applications for John and April Lemon, Frank Gilliland, and Ryan Roberts and Commissioner Elmer seconded. Motion carried 3/0.

Emergency Management Director Pat Korte submitted emergency vehicle designations for the following: Jeffrey Moszeter, Dalton Strader and Robert Lynch.

Commissioner Kathrens made a motion to adopt Resolution 2020-24 State of Local Disaster Emergency for Jackson County for 60 days and Commissioner Elmer seconded. Motion carried 3/0. Jackson County had two Commissioners sign off on Resolution 2020-24. The third Commissioner, Chairperson Zwonitzer, participated via phone due to being at home on quarantine and the resolution was voted on, approved 3/0 and put in place by all three Commissioners.

County residents joined the meeting to support Oren Long’s resolution: Melinda Wareham, Roger Jameson, Rick and Kerry Wright, Steve Cappleman, Mike Wagner, Barry Flohrshutz.

County resident Oren Long joined the meeting to discuss his proposal. He stated that he had prepared a more sophisticated version of the resolution he had presented last time. He explained that Governor Kelly has issued a one size fits all executive order and he gave examples of county data across the state. Oren stated that the WHO had forecasted about 1 in 400 people dying from the coronavirus, most of which are already health compromised. Oren stated that a lot of people already have one foot in the grave and the other on a banana peel and the virus is this year’s banana peel. He stated that people are losing jobs, businesses are closed, and people are without money. He asked that the BOCC not make new law but instead enforce the First and Fifth Amendments which he says Governor Kelly’s order violates. Oren stated that this is 100% political and an attempt to turn the booming Trump economy into a sinking ship so they can win an election. Kerry Wright spoke to ask the BOCC to do what they can to make sure the health director is held accountable. She shared that her father in law lives in a nursing home in Nemaha County and has not been held during this pandemic due to restrictions for allowing visitors. Pastor Steve Cappleman voiced his opinion that the hospitals are not over run and the economy is crippled. He stated that by calculated choice through either the wet market or a lab, China allowed the virus to infect the world. He stated that China is with the Democrats and that America is a free society with God given rights. Roger Jameson stated that politicians are utilizing all aspects to bring about social change. He feels Governor Kelly is violating constitutional rights. Melinda Wareham asked that the BOCC be leaders in the state and to set an example. She wants to be able to go where she wants and to live normally without being shamed for doing so. Rick Wright stated that the country was founded on freedom and all decisions have risks. He asked the BOCC to allow county citizens the right to make their own decisions. Commissioner Elmer stated he would like to hear all sides before making any decisions. Rick Wright and Melinda Wareham said they voted for the Board and others did not show up. Commissioner Elmer explained that he wasn’t disputing their views, that he just wanted to hear from

others as well. Keith Kelly stated that there are no sides, just let the people decide for themselves. County Counselor Alex Belveal and Undersheriff Darrel Chapman discussed the enforcement of executive orders with the citizens.

Courthouse Custodian Chad Phillips joined the meeting. ADS representative John Stous presented the BOCC with his thoughts on repairing the hail damage on various county spray foam roof structures. County Clerk Kathy Mick reported that she had spoken with the insurance provider and they have everything they need. She is waiting to hear their final decision. Stous stated that he would repair the damages for whatever cost the insurance company would pay and he would include a warranty. He stated that he believed the courthouse roof to be 22-28 years old and that it has held up very well. He explained that some of the roofs appear dirty because of a change in product that they used in the past but that they can be cleaned. He stated that the single ply style that Midwest Coating gave an estimate for will add thousands of screws causing problems as thermal conductors, possible wind uplift damage and asbestos exposure. He stated that the high-performance spray foam he offers will have a better UV rating than the single ply system and also be repairable, sustainable and energy efficient.

At 11:06 a.m. Commissioner Elmer made a motion to enter into executive session to discuss matters of security with Darrel Chapman, Kathy Mick, Alex Belveal and Tara Peek present. Commissioner Kathrens seconded and motion carried 3/0. Session reopened at 11:14 a.m. No action taken.

Banner Lake Director Lu Griffiths reported a full weekend. He is proposing adding some more camping sites with electric hook ups on both the north and south side. He will get the estimated costs ready before presenting. He continues to follow KRPH recommendations and keep the bathrooms, swim beaches, playgrounds and rental shack closed.

County Clerk Kathy Mick submitted grant administrative bids as follows:

Health Officer Angie Reith and Emergency Management Director Pat Korte discussed next steps for the county as the Governor’s executive orders expired at midnight. They explained that until a decision is made there is nothing in place and Angie reports that the county has had their first death from the virus. Angie suggests that because of pockets of positive tests she would like to follow the guidelines offered by Governor Kelly until June 8th. There has been a high increase in positive results the past week and she needs time to gather the information to fully evaluate the county’s health risk. Angie discussed the Phase 2 portion of the Governor’s Ad Astra reopening plan and the Commissioners stated they would like to increase the 15 person mass gathering limit to 30 individuals. Angie agreed and they will meet again June 8th to revisit. Commissioner Elmer made a motion to adopt resolution 2020-23 Confirming the Emergency Order of Local Health Officer’s directives and Commissioner Kathrens seconded. Motion carried 3/0. Jackson County had two Commissioners sign off on Resolution 2020-24. Commissioner Kathrens made a motion to approve the Haag Oil bid and Commissioner Elmer seconded. Motion carried 3/0. Dan submitted a right of way request from RWD #3 at 150 th and U Roads. Commissioner Kathrens stated he had been working in the Mayetta area and has been driving a different route each day to view roads. Commissioner Kathrens stated that someone is dropping the ball in the south part of the county and it needs drastic changes. He listed his concerns as follows:

190th Road from Denison east to Z Road 158th Road from Mayetta east 166th Road from Highway 75 east of Mayetta before T Road T Road from Birmingham south D Road north of Highway 16

Keith Kelly added that on S Road between 134 and 142 Roads there is 3 places where the water is creating its own ditch. Commissioner Kathrens added that S Road to 198 th Road has grass growing it’s been so long since it’s been bladed and he has been getting a lot of calls about roads. Dan stated he had also received calls and he will be out south later today. Commissioner Elmer asked Dan about a stretch of chipped roadway on E Road that doesn’t look good. Dan explained that mechanical issues caused the

deterioration and they would have the patching machine out soon to fix it and reevaluate. Commissioner Kathrens asked Dan about the patching on 254 Road east of the highway and Dan replied that it is done and there is only bad spot so far. Commissioner Kathrens stated that the county is going backwards instead of forward on the roads and Commissioner Elmer disagreed. Dan stated that the weather has caused issues and some areas have improved while others have suffered. Chairperson Zwonitzer stated she wants to work together to generate ideas on how to help contribute to getting things in better shape and a plan to make it happen. She asked Dan to bring a rock report to next week’s meeting that shows where it has gone as the rock budget for FY2020 has been depleted..

Courthouse Custodian Chad Phillips presented the BOCC with a court schedule for June. Chad offered for his department to work the door when needed. Commissioner Kathrens made a motion to approve the May 21 st minutes as written and Commissioner Elmer seconded. Motion carried 3/0.

Brothers, Andy and Corky Cook, joined the meeting to discuss road concerns. Andy stated that the roads are getting worse and worse every year. As the roads deteriorate, the repairs on his trucks are getting more expensive. He stated that he hasn’t seen a grader on his road in 6 months and they are not cleaning out ditches. Corky stated that he has never seen the roads this bad. He has been hauling logs in 5 counties and Jackson County is terrible and he wants to know why. The brothers stated that the road conditions are ridiculous and rough on their equipment. Commissioner Elmer stated that when hiring blade operators they get few applicants because of the pay rate and usually have no training. The brothers stated that they need to rip the bottom of potholes and bond the material, people are driving on the wrong side of the road to avoid holes and someone will die. They also shared their feelings about ditching a priority for proper maintenance. Andy suggested dropping a grader off at his house and letting his brother Corky fix his road. Andy asked Commissioner Kathrens why he didn’t teach the operators to run the blade since he knows how to run equipment and Commissioner Kathrens said he couldn’t be both a Commissioner and a teacher. Commissioner Kathrens stated that the leadership is lacking the ability to teach and responded to Andy’s suggestion of using a ripper to fix holes, saying the rippers have been removed from the back and they are now using scarifiers that are worthless in his opinion. The brothers stated they want a solution and asked what has changed. Keith Kelly stated that he felt that if something is not working than why keep doing it over and over again for the same result. He suggested more training and increasing pay along with leadership. Commissioner Elmer added that they have been able to get some training completed. Sheriff Morse and Chad Phillips joined the meeting to discuss the entrance procedures at the courthouse. County Clerk Kathy Mick, Treasurer Linda Gerhardt, Register of Deeds Tammy Moulden, Emergency Management Director Pat Korte, Banner Lake Director Lu Griffiths and District Court Clerk Jennifer Strathman joined the meeting to discuss the courthouse operations going forward. The courthouse will continue to have the south entrance available only and will be reevaluated at the next meeting.

Lu plans to reopen the playgrounds and swim beaches this week. He is waiting to open the rental shack and bathrooms until he sees how other campgrounds do since they’ve opened. He will consult with the health department for more input. He has a meeting scheduled with Riley Electric to get estimates for new spots.

At 11:37 a.m. Commissioner Elmer made a motion to enter into executive session for attorney client privilege with County Counselor Alex Belveal and Tara Peek present. Commissioner Kathrens seconded and motion carried 3/0. No action taken.

Royal Valley Superintendent Aaric Davis, Counselor Ashley Wick and students Hadley Gregory and Emma McKinsey, Holton High School Principal Rod Wittmer, Teacher Debbie Harshaw and students Kyler Rose and Olivia Summers, Jackson Heights Superintendent Adrianne Walsh, District Clerk Sheri Dibbern and students Kati Woltje and Sadie Raborn presented the BOCC with the activities they have completed through Jackson County Communities that Care Coalition (JCCTCC) and Jackson County Youth Coalition (JCYC). Royal Valley students reported attending a training camp in Dallas, Texas that focused on problem solving strategies in the community including vaping. They educated fourth graders in Tobacco 101 about the dangers of smoking, held a Mental Health Matters day in November and planned an anti-drug spirit week. They also greeted students entering the buildings and had assigned seating at lunch one day to encourage meeting new people and kindness. PBPN sponsored both RV and JH to assist with prizes for seatbelt wearers driving to school. Jackson Heights students spoke about Miss Kansas coming to speak to the students on Kansas Day, signing pledges to remain drug free, handed out consequence fact sheets to those not wearing seatbelts during the safety check and performed a skit at the pep rally. Holton High students did a training for 6-8th graders on vaping, participated in the sticker shock campaign at local liquor retailers, attended a zoom camp to learn about leadership, suicide prevention and community involvement, signed anti-bullying pledges, painted thumbnails red to remind students to prevent texting when driving, held a coloring page contest at the elementary and was sponsored by State Farm for their seatbelt campaign. They also hosted a speaker, Jordan Roberts, who informed students on the dangers of tobacco and vaping and had a bike helmet give away available to any citizen who entered the drawing at a basketball game.

Commissioner Kathrens stated he noticed that some work had been completed on 254 Road and asked Dan if the tree in the N and 280 Roads area had been removed yet. Dan replied that Eric was able to cut the tree down and Commissioner Kathrens said he appreciated him getting the tree taken care of. Dan asked the Commissioners about the dust control supplied by Mid States on the haul route at the Denison Quarry. He questioned how the 150 feet is applied at intersections and it was agreed that they would discuss with Mid States. Dan has given a list of residents to Mid States so they can contact them and offer additional dust control for a reduced rate. Dan updated the BOCC on the progress of NextEra’s transmission line project. He said they were mostly hauling mats and wire for now and will begin the reclamation and recovery process soon. They could be done by November possibly. Commissioner Kathrens reported a washout at 270th and B roads. Commissioner Elmer asked about road work needed on K north of 110. Chairperson Zwonitzer stated she would get a list together of roads in her district for Dan to review. Dan stated that his department has started installing drive entrances and placing rip rap where needed. He is needing to hire mower operators. Dan is getting an estimate for a box bridge near 270 and T1 Roads that needs repairs. Commissioner Kathrens asked Dan about progress on the loader from the landfill and Dan stated that the shop has not had a chance to get to it yet, but they have loaned their loader to them until they get it repaired. Beth Fenske joined the meeting to show the BOCC the cemetery markers she had ordered denoting military affiliation. County Health Officer Angie Reith and Emergency Management Director Pat Korte joined the meeting to discuss recommendations for reopening within the Jackson County. Angie reported 6 days now since they have had a positive case of Covid-19 and 1 person remains in the hospital. Angie suggested setting an advisory for limiting gatherings to 50 people and to continue to social distance, wash hands and wear masks when possible. She explained that assisted living and nursing home facilities have guidelines from the Kansas Department of Aging and also corporate policies to follow. Angie stated that as long as our numbers stay low that she sees phasing out completely on the 22nd of June. Chairperson Zwonitzer discussed the recent NEK Multi County Health Department board meeting she had attended. They discussed adding an addendum for procedures during pandemics that would allow each county BOCC to become their own health officials to make decisions for their own county if needed. The addendum would also clearly state that that each county appoints their own count health officer, rather than the 3 county board doing so. County Counselor Alex Belveal and the Atchison County Counselor are working together to create the addendum. Commissioner Kathrens made a motion to adopt 2020-25 Confirming Advisory of the Local Heath Officer and Commissioner Elmer seconded. Motion carried 3/0.

Minutes of June 15, 2020 The Board of County Commissioners met in regular session on Monday, June 15, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes. Holton Recorder reporter Ali Holcomb joined the meeting.

Mayetta Fire Board members submitted a board member nomination for Delaina Miller and the Commissioners approved the request.

Road and Bridge Director Dan Barnett submitted a preliminary road use agreement with Evergy. He reported using haydite material instead of the usual limestone chips for patching chip and seal as the patching machine is made for haydite. The BOCC discussed the roof damage at the road and bridge office. Dan informed the Commissioners that he and the insurance adjuster had went on the roof and the newer part has screw holes left from when it was replaced and water appears to have leaked through the insulation and ceiling tiles. The older part of the building the only damage was to the caulking sealant around the former skylights. Dan reported that the bridge at 126 and B3 Roads is complete. They will begin on 129 and D Roads next. The pipe at O4 near Bausch’s property has been replaced. E and 214 Roads there is a damaged structure that Dan is getting prepared for repair. Dan reported that Hamm had won the chip bid for this summer and the chip they received seems to be dirty so he is awaiting gradation reports before using. Dan has given NextEra a preliminary list of areas to be addressed. 254 Road between S and T will need 7 layers of chip seal completed at NextEra’s expense. Dan has not heard from the State about funding programs he applied for.

County Counselor Alex Belveal gave an update on the tax sale.

County resident Tina Alford joined the meeting to share her concerns about a staff person at the Jackson county jail. The BOCC said they would discuss with Sheriff Tim Morse and have him call her.

Discussed the CESF grant that was awarded to the Sheriff’s Office and how to use some of the funding to have cleaning personnel for the courtrooms and jail. Ali asked about the CDBG grant funding awarded to the county and how the funds will be dispersed. Chairperson Zwonitzer explained that the grant administrator will set up meeting with the applicants to find those who qualify based on their employment of low to medium income employees. Chairperson Zwonitzer estimated receiving 40 preliminary applicants.

Banner Lake Director Lu Griffiths reported another full weekend. The newly opened rental shack has been very busy. He discussed the final items needed for the grant for the community building at the lake. The BOCC agreed to pay for the printing costs when they submit the paperwork. Lu is waiting for an estimate from the City of Holton for another transformer.

County resident Marvin Vance joined the meeting to ask the BOCC about getting a permit to rebuild his old garage in its same location. The BOCC referred him to the Appraiser’s office.

Met with Elderly Services Director Amanda Spalding about the senior citizen meal site program. She estimates about half carry out and half delivery currently. She has concerns for reopening the dining room and center due to social distancing regulations. She would have to limit the number of people allowed in the building. Amanda stated that Marshall County is doing a trial reopening this week to see how it goes and she will talk with their director for feedback. The BOCC asked Amanda to continue doing delivery and carry out only and they will revisit on July 6th to discuss an opening date.

Received a phone call regarding a road concern on U4 Road.

County Clerk Kathy Mick discussed cemetery markers recently purchased and the Commissioners stated they were pleased with the products and gave their approval to purchase more as needed.

Session reopened at 9:08 a.m. No action taken.

Road and Bridge Director Dan Barnett reported that he got the gradation report back on the chip material from Hamm Quarry in Grantville and it did not meet specifications. Hamm offered a $4 off per ton discount if Road and Bridge would load up, return and pick up the better grade rock. The Commissioners did not accept the $4 offer and asked Dan to renegotiate. Dan stated that he is waiting

for the hydrology report before repairing a box bridge structure west of E Road. He has another box needing repaired at 270 and T Roads. This one has no match funding available, so he is still putting the numbers together. Dan reported NextEra will soon be removing the jump spans from N and M Roads. Dan is utilizing dump truck drivers to operate mowers for the time being. Keith Kelly asked Dan about 142 Road and Dan stated they are still working on it and should be getting dust control later this week. Dan suggested asking for more footage on the dust control when they renegotiate the agreement in December. The county has been using a water truck to treat the road and water from the quarry’s pond. County residents Diane and Doug Keith and Keith Lassiter joined the meeting. Diane asked where her tax money is going because she is unhappy with her road maintenance. She stated that she lives on the Jackson and Jefferson County line and there is a difference in the roads. Chairperson Zwonitzer offered to get a breakdown of her tax statement if she would like to review. Dan explained that with the weather conditions the past 2 years and limited funds it has been difficult to keep up. Crews are often pulled to work on chip and seal and other projects during summer months. Keith Lassiter asked how many motor grader operators there are in the county to which Dan replied 11. Keith stated that Jefferson County blades at least once per month and Jackson County only comes when it gets so bad that he has had to call and request maintenance. Keith stated his taxes have tripled since 2005 and he wants there to be a route plan in place so the roads are regularly maintained. Diane added that she has had to mow the grass growing in the road and that their vehicles are taking a pounding. They also stated that 206 and X Road on the west side has very deep ruts and that their grader operator does a good job filling them in but once it rains again they get washed out. Dan explained that the drainage and ditching problems do take away from road maintenance and they are trying to accomplish both. Keith Lassiter had another concern regarding the hitches required for renting the spraying equipment from the Noxious Weed department saying that it was a rare size and a ball should be provided. Diane Keith had a concern for Noxious Weed as well, stating she had seen an employee spraying near her property and the chemical drifted into her pasture where she has horses she doesn’t want exposed to chemicals. Dan stated he would get a schedule for regular maintenance created with the foremen. Commissioner Elmer gave Dan some information on some pipes he found for sale at a lower price.

KCAMP representatives James Gambrell and David Luke met with Commissioners in regards to the county’s recent hail damage claim. Chairperson Zwonitzer explained that the BOCC had questions about the policy and the processes for determining the figures. David stated that the KCAMP board in 2016 decided to not cover cosmetic damage on buildings valued less than $250,000.00 but they would cover damages, such as from water leakage. Chairperson Zwonitzer asked if they used the one bid they received to create their offer for damages and James explained that they use an index program to estimate repairs based on the like types and in this case that would be roofing materials. He stated that the bid was used along with the program to determine the payout but they would consider other estimates from same type roofing companies if the county would like them to reevaluate. James said they could choose to upgrade but KCAMP would only pay out for same scope of roof type. David went over the usage of risk management services by Jackson County for the 2019 year and informed the BOCC of a maintenance training opportunity in July for any county employees that would like to attend. The buildings needing repairs from hail damage or water leakage are the courthouse, Road and Bridge,

senior center, Sheriff office and Sheriff maintenance building. Additionally, the recycling center had some damages to skylights and a camera.

Banner Lake Director Lu Griffiths reported another full weekend at the lake. Lu submitted paperwork needed for the Friends of Banner Creek Reservoir community building grant for the Commissioners to approve.

Midwest Coating representatives joined the meeting to discuss their product with the Commissioners. They explained the process for applying the layover material and offered two varieties, one with a 15 year warranty and the other with a 20 year warranty. No action taken.

Jackson County Conservation District Manager Brian Boeckman met with Commissioners to submit the NRCS budget request and give an overview of the programs and services offered in 2019.

Public Health Administrator Angie Reith and Director of Operations Kristina Romine joined the meeting via phone. Angie reported one new case since the last advisory. She stated that Kansas Department of Aging and Disability Sevices is preparing to release guidelines for Long Term Care facilities to reopen and during the second week of July the Kansas State Board of Education will release its recommendations. Angie plans to release a strong advisory to continue social distancing, wearing a mask and hand washing.

At 1:58 p.m. Commissioner Elmer made a motion to enter into executive session with Kate Immenschuh and Alex Belveal to discuss personnel and Commissioner Kathrens seconded. Motion carried 3/0. Session reopened at 2:10 p.m. Commissioner Kathrens made a motion to approve Agreement 2020-17 appointing Kate Immenshuh as the County Appraiser beginning July 20 th and Chairperson Zwonitzer seconded. Motion carried 2/1. Commissioner Elmer opposed because he thought the starting salary should be offered at a lower rate. The BOCC asked Kate to look into how they can approve a variance for building a new garage in the same location as the old one as requested by a county resident.

Scott Misenhelter joined the meeting to say he was pleased with the county mowing the right of way and wanted to acknowledge Dan Barnett as the Road and Bridge Director. He stated he was pleased with the road work that has been completed and thinks in due time Dan will be able to satisfy everyone.

Commissioner Elmer made a motion to approve the June 15th minutes as amended and Commissioner Kathrens seconded. Motion carried 3/0.

Holton Recorder reporter Ali Holcomb and Keith Kelly joined the meeting.

Environmental Services and Noxious Weed Director Scott Kieffaber asked about tracking mileage on the trucks used for his department. He stated that the 2004 brown truck’s odometer does not always work properly. It has about 93,000 miles on it. The 2008 Ford F-250 truck has 42,000 miles and has been having brake issues and many other repairs. Scott informed Commissioners that KDHE had recently completed inspections at the landfill and HHW locations and both passed. Scott discussed picking up a recycling trailer he recently purchased online from Wyoming. He proposes using a couple Road and Bridge personnel to drive out there to retrieve it. He stated the trailer needed for hauling would require someone with a CDL license. Commissioner Kathrens stated he didn’t know if anyone from Road and Bridge would be available while they have summer projects going on. Scott will discuss with Dan. Scott informed Commissioners that a trailer load of old, wet paper had been dropped off at recycling and that he declined it as it would need to be disposed of at the landfill instead. Scott stated that the two four wheelers used by his department are needing replaced and Commissioner Kathrens said he wasn’t against replacing the older one. Scott informed Commissioners that he received a $1000.00 allowance from KDOT for spraying weeds along the highways. At 9:15 a.m. Commissioner Elmer made a motion to enter into executive session with Scott Kieffaber present for personnel and Commissioner Elmer seconded. Motion carried 3/0. Session reopened at 9:21 a.m. Senator Jerry Moran’s representative Jason Osterhaus joined the meeting.

Road and Bridge Director Dan Barnett informed Commissioners that NextEra plans to be out by the 4 th of July holiday and he has scheduled to take care of the rip rap needed on the Bausch property. He is getting estimates for a tube on 270th Road between H and I Roads. Dan submitted an agreement with the county and county resident Luke Cochren to split the cost for 1000 tons of 1 ¼ inch road rock material from Mid-States Denison Quarry for X Road between US Highway 9 and 286 th Road and 286th

Road from X Road east to the second driveway at Parallel Farms. The agreement states that the county will haul and grade the material and the roadway will continue to be open to any and all public traffic and in no way will be controlled by the cost share representative. The agreement states that Commissioner Kathrens verbally agreed during a phone call and was signed by Luke Cochren and Dan Barnett. Chairperson Zwonitzer stated that she did not believe that the county can legally enter into this type of agreement and Commissioner Elmer agreed. Commissioner Kathrens asked why not and stated that he feels it’s a good deal for the county and the county should entertain offers to help pay for rock. Chairperson Zwonitzer stated that there could be a more justifiable 1.5 miles that needs that rock and asked where Commissioner Kathrens came up with that 1000 tons amount. Commissioner Elmer told Commissioner Kathrens that he doesn’t have the authority to make this decision. Commissioner Kathrens explained that he was approached by Luke Cochren and he asked Dan Barnett to have an agreement ready to bring to the meeting Monday for the Board to review. Commissioner Kathrens stated he did not discuss tonnage with Luke Cochren and that amount was likely determined after Luke Cochren talked to Dan Barnett. The rock has not been hauled yet and the Commissioners decided they would seek advisement from County Counselor Alex Belveal on the matter. Dan submitted a proposal he received from Steve Duryea to utilize the county’s ROW to install lighting on 150 th Road to US Highway 75 in stages. Chairperson Zwonitzer stated she wanted to review the plans further before making a

decision. Dan reported he had received the bridge inspection report for the haul route for Evergy and that dust control on 142nd Road should be completed this week. Commissioner Kathrens asked Dan how the landfill’s loader was coming along and Dan stated not good, they have made some progress but haven’t had much time to work on it. Dan stated that he spoke to Scott Kieffaber about retrieving his recycling trailer and he would allow two employees to pick it up.Received notification from the United States Department of the Interior Horton Agency that Prairie Band Potawatomi Nation has purchased land and placed it in trust (removing the property from tax rolls). The parcels are located within the tribal reservation boundary. Chairperson Zwonitzer explained to Jason Osterhaus that the county does not challenge any parcels placed in trust by the tribe when they are located inside the reservation boundaries.

At 10:12 a.m. Commissioner Elmer made a motion to enter into executive session for matters of personnel with Jason Claycamp and Commissioner Kathrens seconded. Motion carried 3/0. Session reopened at 10:20 a.m. No action taken.

Corky Cook joined the meeting. He stated he appreciated his road getting bladed since his last visit but he still has concerns. He stated that there is no terrace or ditching. Corky stated that Commissioner Kathrens was voted in to get the roads fixed and he needs help. Corky stated that the county is out of material and he questioned how the rock budget has changed over the years. He stated that farmers don’t take the time to come in to meetings because they don’t believe it will help. Chairperson Zwonitzer asked Commissioner Kathrens how he planned to fix it and he replied with a better use of resources. Corky added, work ethic. Commissioner Elmer stated that the weather conditions have changed the past few years resulting in difficulties. Corky stated that he has road rage from driving on the county roads, it is costing him a lot of money and he will be back.

County Counselor Alex Belveal joined the meeting. She reviewed the agreement submitted by Dan Barnett with county resident Luke Cochren and stated that it was not valid because a Commissioner cannot take action on behalf of the Board. Commissioner Kathrens stated that he did not enter into an agreement, that he asked Dan to draw one up and bring to the meeting.

Banner Lake Director Lu Griffiths reported another full weekend. He discussed the addition of a gazebo and fire pit with seating proposed by Daniel Little for his Eagle Scout project. The Commissioners agreed to allow Daniel to build his project at the lake in an area chosen by Lu. Recessed for lunch from noon to 1 p.m.

Sheriff Tim Morse and Undersheriff Darrel Chapman joined the meeting to review his office’s budget requests for 2021. Sheriff Morse stated he wants a 3% pay increase for his people because he has a good pool of employees right now and he wants to keep them. Sheriff Morse stated he has been Sheriff for 10 years and his operating budget has remained the same or similar during this time.

Emergency Management Director Pat Korte joined the meeting. Brett Waggoner and Garrett Nordstrom with Governmental Assistance Services submitted their proposal to administrate the county’s CARES funds. They stated that they would accept a 5% fee of the expenditure total as payment for their services. They have already begun working on the CDBG grant awarded to the county. Commissioner Elmer made a motion to approve agreement 2020-19 (State of Kansas Grant Agreement 20-CV-034) with Kansas Department of Commerce for the CDBG funds and Commissioner Kathrens seconded. She stated there are 7 active cases in Jackson County at this time. Angie said she does not recommend masks for children under two years of age or persons with anxiety or other medical conditions. Sheriff Morse explained that at this time a violation of such an order is a civil infraction and he only enforces criminal infractions. Commissioner Elmer made a motion to adopt Resolution 2020-28 Modifying the Governor’s Order for Mask Wearing Mandate and Commissioner Kathrens seconded. Motion carried 3/0. The resolution strongly suggests wearing masks but does not mandate them in Jackson County.

Minutes of July 6, 2020The Board of County Commissioners met in regular session on Monday, July 6, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes. Keith Kelly joined the meeting.

Road and Bridge Director Dan Barnett submitted the following fuel bids: Haag Oil $12,800.00 Knotty Pine$ 13,180.00

Commissioner Kathrens made a motion to approve the Haag Oil bid for $12,800.00 and Commissioner Elmer seconded. Motion carried 3/0. Commissioner Kathrens reported a covered tube and removed entrance in the 262 and N Roads area that was called in to him. Dan discussed a ROW permit that was submitted by a developer for a Dollar General store at Mayetta. County Appraiser Jason Claycamp joined the meeting to discuss the zoning regulations for the proposed location of the store. Jason explained that currently the site is not in compliance for on site septic due to its size. The parcel needs to be 80,000 square feet to meet that requirement. The other option would be for them to annex to the City of Mayetta and be connected to city water utilities. The Commissioners will wait for the proposed store to meet regulations before approving the entrance they requested. Dan informed Commissioners that he was able to get a $6 per ton reduction from Hamm for the switching out of chip material. The crews have been out patching roads heavily. Dan stated that July 9th was the announcement date from KDOT for match fund grant recipients. He had applied and is hoping to get some funds from the state to put towards material for the roads. Dan stated that NextEra has all the poles hauled in and they will be starting the rehabilitative process. Some of the landowners are requesting to keep the temporary entrances put in by NextEra and Dan is handling the requests to be sure they meet specifications. The jump span bridges have been removed and material is being hauled out of ditches. Commissioner Kathrens suggested placing the material removed onto M Road. Dan also reported that the dust control has been applied on the Denison Quarry haul route. Dan stated that crews are rocking in the area of 222 and Y Roads for a landowner who is paying the county to bring the minimum maintenance road up to rock road standard. Corky Cook joined the meeting. Corky reported a divot in the road south of Larkinburg Church about a half a mile. He said thank you for grading the road. Corky asked what the cost difference would be between rocking the road and using material from the ditches to build up the road and then rock for a 100 yards and 30 or 36 feet wide. Dan said he would get figures for him. Corky stated that the roads have declined the past 8 to 10 years and the grader does the best he can with what he has to work with, but he needs more rock to make it happen. Corky stated that he feels surrounding counties have better roads. They discussed cleaning out ditches and using the material to help build the road base back up. Commissioner Kathrens said they weren’t making excuses but the deterioration will take time to fix and they want to do it correctly. Chairperson Zwonitzer added that some other counties have a township road system instead of county wide. Commissioner Elmer stated that some of the rock in past years has not been the best quality. The Commissioners explained that they have doubled the rock budget since they have been in office but the rock prices have also

increased. This year’s rock budget was $600,000.00 and it was depleted by June so they added an additional $300,000.00, bringing the rock budget to $900,000.00 for 2020. Dan explained the grant opportunities he applied for that were gone during the Brownback administration that are now available again under Kelly’s. He is hoping to be awarded some funds through that program. Commissioner Elmer suggested the possibility of adding another maintainer to decrease the miles per grader and Commissioner Kathrens and Corky stated they would prefer more material. Corky questioned how the roads cannot have enough graders when some are maintained by the reservation and currently contractors maintain their haul routes. That should mean less material and more workforce available in his opinion. Corky discussed the secondary ditches causing a lot of the problems. Dan explained that some contributing factors are the increase in the county’s population causing way more traffic and much heavier vehicles and equipment. Commissioner Kathrens again stated that there is no fast fix and they need to do it right the first time. Keith Kelly asked Commissioner Kathrens what he meant by building a road right and Commissioner Kathrens replied with proper drainage and ditching and proper material and maintenance. Keith asked about enforcing the county’s right of way and addressing tube problems with landowners. Dan agreed that farmers have been encroaching in the right of way and there needs to be enforcement to take it back for proper drainage.He also asked the BOCC if they know the determining factors then why are they not discussing to develop a plan and maybe sit down with other counties and discuss their processes. Chairperson Zwonitzer said that she has discussed roads with other County Commissioners and they say the same thing, that their constituents feel other counties’ roads are better. Keith suggested having a collaborative group to develop a plan and change practices, don’t continue to do something if it’s not working. Keith suggested dust control as a means to help preserve roads. Corky agreed they should try it and see if it helps. Dan explained that his department has a limited number of people and limited budget with 1,000 miles of roads to cover. Corky stated that the problem isn’t the help, it’s the money. NEK-CAP Housing Coordinator Belinda Estes met with Commissioners to review and approve the Emergency Solutions Grant for the year. She submitted quarterly reports for the 1-3 quarters. Commissioner Elmer made a motion to approve agreement 2020-20 NEK-CAP Homeless Grant and Commissioner Kathrens seconded. Motion carried 3/0.

County resident Les Crawshaw joined the meeting to discuss issues he is having with a phone line near his home. He stated that the county mower recently cut it and when he notifies CenturyLink it takes days for them to come out and get it repaired. He is concerned for his neighbor who relies on the phone line for her Lifeline unit. Les stated that this line has been cut many times and it’s always in the same area. The Commissioners stated they would have Dan Barnett discuss this with CenturyLink so it can be buried properly to keep it from getting damaged.

County Counselor Alex Belveal reviewed the proposed Hamm Quarry road use agreement with the BOCC.

The Commissioners approved updating the county employee’s free Banner Lake pass to include all employees who are eligible for health insurance benefits. Previously the free pass was only issued to employees working 40 hours per week.

Undersheriff Darrel Chapman joined the meeting to give an update on roof bids for hail damaged county buildings. Commissioner Elmer made a motion to approve the bid from Midwest Coating for $113,116.80 and Commissioner Kathrens seconded. Motion carried 3/0. This will provide the Sheriff North Building, Sheriff Maintenance Shop, Courthouse, R&B Bridge Shop and Senior Citizens/Health Department buildings with a 60 mil Mule-Hide TPO overlay and 20 year warranty.

Brett Waggoner and Garrett Nordstrom with Governmental Assistance Services joined the meeting to discuss the administration of the Federal CARES money that Jackson County is eligible to use. They stated that the first round for reimbursement is to be submitted next Monday. They reported meeting with department heads last week and plan to schedule meetings with school and health officials next. Commissioner Elmer made a motion to approve agreement 2020-21 CARES Grant Administration with Governmental Assistance Services and Commissioner Kathrens seconded. Motion carried 3/0.

Road and Bridge Director Dan Barnett submitted the following roof bids for the R&B maintenance shop: Midwest Coating $28,882.67 (45 mil Mule-Hide TPO-7272 square foot) JT Roofing $24,800.00 (silicone metal roof sealant-7000 square foot)

No action was taken. Dan reported he is still waiting to hear from KCAMP about coverage for the water damage inside the foremen office. Schulz Construction will be taking care of that part of the roof damages.

Elderly Services Director Amanda Spalding met with Commissioners to discuss the reopening of the senior center. Currently her average meals served per day is 132 (carryout and delivery). She stated that she would like to continue carryout and delivery services for now and wait to reopen the center. The social distancing requirements and extra cleaning would pose a challenge with the amount of meals they are preparing each day. Amanda stated that she would have to limit the number of people who wanted to dine in and also hire more employees service the dining room properly. The Commissioners agreed that the senior center should remain closed for now and they will revisit opening later. The Commissioners aproved ordering shelf stable meals to have on site that would be good for 9-12 months.

Representatives from Senne Construction joined the meeting to discuss a proposed renovation for the County Attorney’s office which would be submitted to the State for CARES project funds.

Court Services Officer Ted VanDonge joined the meeting to discuss CARES funds available to his office.

Commissioner Elmer made a motion to approve the June 22nd and June 29th minutes as amended and Commissioner Kathrens seconded. Motion carried 3/0.

The Board of County Commissioners met in regular session on Monday, July 13, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes. Keith Kelly and Holton Recorder reporter Ali Holcomb joined the meeting.

Environmental Services and Noxious Weed Director Scott Kieffaber reported that there was a lot of trash dumped at the bins over the holiday weekend. They sold $12,000.00 in chemicals last week, so spraying season is going and busy. Scott stated that he was going to seek bids again for painting the buildings and had made arrangements with Dan to get the recycling trailer retrieved from Wyoming.

Road and Bridge Director Dan Barnett informed Commissioners that he is $20,000.00 over in rock budget and he has the guys on hold. He will take the funds from his .4% budgeted fund. He reported that Jackson County did not get awarded any grant match funds from the State. Dan stated that he does not yet have his budget ready to present but he will come back later to do so.

Received a phone call from Guy Cameron stating the courthouse lawn was a disgrace when he came to the farmer’s market over the weekend.

Corky Cook joined the meeting and stated he and Dan had met up to review his road concerns.

Appraiser Kate Immenschuh joined the meeting to discuss Oren Long’s concerns for his address. Kate explained that his 911 address will be different from his mailing address because of the location of his current driveway. He will retain his mailing address and mailbox.

County Treasurer Linda Gerhardt met with Commissioners to report she wants to accept only in county residents for driver’s license services. She reported that many people are coming in from surrounding counties and feels more comfortable limiting service to county citizens only at this time. The Commissioners thought that was a good plan.

Shannon Stingley joined the meeting in regards to concerns that he had after a recent arrest where his puppy was given to someone claiming to be his girlfriend. The Commissioners explained that they do not have authority over the Sheriff’s Office but they would give his contact information to Sheriff Morse.

Banner Lake Director Lu Griffiths submitted his budget request with no request for increase. He stated the lake continues to be full over the weekend. He will be seeking bids for a new mower and 4x4 truck.

County Health Nurse Angie Reith joined the meeting via phone. She stated that the county has 6 new cases of Covid-19. Emergency Management Director Pat Korte joined the meeting. They discussed their recommendations for the 4H board in regards to the upcoming carnival and parade. They agreed that they would not suggest either event taking place because of the increase in cases but the fair board can make their own final decision.

He presented his plan for meeting the deadlines and a schedule of priorities. He stated that he would have a better idea of the funds needed to meet everyone’s requests next week and he will bring a list of items and projects requested.

Dan joined the meeting to submit his budget request for 2021. He is asking for an additional $610,000.00 in funds.County Clerk Kathy Mick submitted a first draft of the proposed 2021 budget leaving all funding the same as prior year for the BOCC to review.

County Co-Counselor Jason Belveal joined the meeting as County Counselor Alex Belveal was in court proceedings. Hamm Quarry attorney Patrick Watkins and Hamm representative Gary Hamm joined the meeting to discuss the road use agreement for the proposed quarry near Soldier. The county had requested a one year term for the contract and Hamm would prefer to have an automatic renewal so they can be assured that they can operate for years after their initial investment costs. Both parties agreed that the automatic renewal could exist with a provision added that allows either party to request a meeting to renegotiate road maintenance or royalty terms at any time. Commissioner Elmer asked what the expected life of the quarry is and Gary replied 20 years and that they have already started looking to expand.

Assistant County Attorney Jeff Morrow joined the meeting to submit a proposal from Senne Construction for the remodeling of their office space. He is waiting for more bids to come in as well.

Road and Bridge Director Dan Barnett submitted right of way permits. He informed Commissioners that a wing wall collapsed on a double cell concrete box bridge structure at 270 and T1 Roads. His department will repair it once they have consulted with an engineer. Crews are still patching on 110, S and K Roads. He plans to do 2 weeks of grading after patching and then they will start chip seal overlays. Keith Kelly asked the Commissioner about the work order application that was purchased for Road and Bridge to use. He asked if they thought they were getting their money’s worth. Chairperson Zwonitzer explained that she has been so busy with Covid-19 related issues she has not thought about the application and asked Dan to give his input. Dan explained to Keith how the app works and why they purchased it. The app stores everything in the cloud so there is no papers to get misplaced or lost. Dan stated it wasn’t working as well as he would like but there is a learning curve that will take some time. Keith questioned the expense of the program and why they didn’t use text, email or other free services to keep track of jobs. Dan replied that they do use those methods as well and showed Keith the app from his phone to give him a better idea of what exactly it can do. TG Hamm joined the meeting to present the final draft of the Hamm Quarry Road Use Agreement. Commissioner Kathrens made a motion to approve Agreement 2020-24 Hamm Quarry Road Use and Commissioner Elmer seconded. Motion carried 3/0.

Prairie Band Potawatomi Tribal Land Planner Steve Duryea and Jennifer met with Commissioners to review their proposal to add lighting to the sides of the road leading to the casino. Attorney Russ Brien joined by phone on behalf of the tribe. Dan Barnett asked about the traffic engineering and approval for the lumens to be used. He stated that he was okay with the project as long as they had a maintenance agreement and proper engineering completed. The Commissioners agreed to review once the information was available. Commissioner Elmer made a motion to approve Bob Gay and Keith Reicherter to another term on the Mayetta Fire Board and Commissioner Kathrens seconded. Motion carried 3/0.

Chamber of Commerce requested county support for purchasing lights around the square. The bid for replacing the lights is $8,000.00 to replace building bulbs and in trees.

Motion was made and approved to accept the bid from Ferris for $11,599.00. Lu turned in bids for bathrooms to be funded through CARES Act.

Minutes of August 17, 2020The Board of County Commissioners met in regular session on Monday, August 17, 2020 at 9 a.m., Chairperson Zwonitzer and Commissioner Elmer were present. Commissioner Kathrens was absent. County Clerk Kathy Mick recorded the minutes.

Recycling Director Scott Kieffaber provided a paint bid reference. No decision was made. Received the mileage report for the 2008 Ford at Recycling/HHW.

The recycling containers are still getting full on weekends and material is being left on the ground.

Road and Bridge Supervisor Dan Barnett provided a lone from Husker Steel concerning an estimate start date of mid-October if the Commissioners decide to accept their proposal.

Dan is preparing the Chip and Seal crew. He may have to rent a broom because the hydraulic pump is out of the County’s and he cannot find one to purchase. He will check with the Tribe and the City of Holton to see if they have one the County can use. If not, he will need to lease one.

If the County decides to accept Husker Steels proposal, the County will need to rent a hammer on the excavator. The hammer would also be used to break up the rock donated by Pollock’s.

Signed request and petition to occupy county right of way for Telcom Construction to plow 500 feet of 6 pr 24 gauge, including a bore under M road from Pedestal to house at 24569 & US 75 Hwy.

The Commissioners decided to pay for a large ad in the Holton Recorder for $132.00 which will run online also. The ad requests business info for CARES Business Grant Information.

Janet provided copies of reports from Brett Waggoner Grant Administrator for Cares.

Les Crawshaw met with the Commissioners concerting a cut Century Link line again between X-Y on 134th road. The Fiber Optic is not buried and is exposed for miles due to a rock ledge. The line is nicked by the grader operator and service is interrupted. Dan will contact Century Link.

Chairman Zwonitzer signed the Kansas Department of Corrections Division of Juvenile Services FY 2020 Quarterly Budget Adjustment Report.

Received a letter from 3 Rivers requesting Cares Act funds. It is too late for this round of funds. Janet will deliver the letter to Brett Wagner, Grant Administrator.

Banner Creek Director Lu Griffith reported that he is working on the trails.

Lu reported that individuals are still requesting a reservation system for camping. Lu explained how the current system works. Campground C can be reserved from 7 days minimum and 14 days maximum. Lu would like to at 12 spots in C for approximately $25,000. Campground B is for long-term camping.

Received the Extension newsletter.

J. Richard Lake requested information on cost and improvements at the Road & Bridge Shop and the loss revenue by removing it from the tax rolls.

Anna Wilhelm emailed her notes concerning Silver Haired Legislature. If they cannot meet this year, they will advocate for expanded Medicaid, fully fund Senior Care Act and funded Senior Transportation.

Chairperson Zwonitzer called the meeting to order. Commissioners Elmer and Kathrens were present.

County Clerk Kathy Mick reported the results of the hand counted race requested by the County Commissioners at the County Canvass. Kathy Mick reported that the only discrepancy was ballots that were not properly marked so the machine was unable to read the vote, but the board was able to tell the voter’s intent so 5 votes were added to the tally. Ed Kathrens made the motion to accept the results and close the canvass of the August 4, 2020 Primary Election. Commissioner Elmer seconded and the motion carried unanimously.

Bill made the motion to purchase a bridge package from Husker Steel in the amount of $149,815 for a bridge to replace culverts at 270 & T1 opposed to continues rocking/grading of this minimum maintenance road in the other direction. Ed seconded and the motion carried unanimously. Signed agreement with Norfolk Contracting Inc, to provide labor necessary to assist Jackson County on the construction of d a 24’-6 wide by 60’-0 long bridge by driving abutment 10 pieces of piling. Install busmen pile caps and bearing plates, and weld superstructure girders and install superstructure diaphragms in the amount of $19,000.

Reviewed offer from Senne Company to design and construct office space for the County Attorney’s office on the 4th floor of the Courthouse at and estimated cost of $225,000 with a completion date of January 31, 2021. This project is contingent on CARES fund committee approval.

Signed payroll notes for Janessa Edwards hired at $15.01 for dispatch and Tasha Leishong hired at $15.01 for dispatch.

Commissioner Kathrens made the motion to adopt the road use agreement between Jackson County and Evergy. Commissioner Elmer seconded and the motion carried unanimously.

Acknowledge receipt of an email from Brook Smith, Juvenile Intake Director requesting an evaluation on her progress and salary increase due to her proven ability. The Commissioners contacted the Juvenile Intake Board of Director requesting that a salary increase be recommended through the board.

Blue Cross Blue Shield Representative Doug Martens met with the Commissioner to inform them that the rates for health insurance for county employees will increase 25% for 2021. By increasing co-pays and deductibles he made to other proposals that were increases of 18.54% and 15.89% increases. The Commissioners are exploring other insurance proposals.

Minutes of August 24, 2020

Chairperson Zwonitzer called the meeting to order at 9:00 a.m. Commissioners Kathrens and Elmer were present. County Clerk Kathy Mick recorded the minutes. County Counselor Alex Belveal was also present.

Noxious Weed Director Scott Kieffaber asked if painting the buildings were going to be dropped for now. The Commissioners agreed to table the idea of painting the metal buildings at this time due to the cost.

Road and Bridge Supervisor Dan Barnett informed the Commissioners that the bridge at D-129 will be ready for pre-construction meeting in a couple of weeks.

Evergy Representatives Jerry Cashier, Jessica Kack and Dennis Lawlar met with the Commissioners to discuss the signed road agreement, overweight and over length moving permits an it was agreed that the water trucks are exempt from haul routes as long as bridges have been checked for load limits on the routes they take.

Discussed the vacation leave that employees will loose on October 24th this year. The Commissioners decided to extend the cut off period to November 30 this year. A memo will be written to the employees.

Ted VanDonge met to discuss the letter he sent to the Commissioner stating that all the members of the board recognize the dedication and attentive work Brooke has demonstrated in her role as the director of youth services for the 2nd Judicial District and that they unanimously recommend her for a raise.

Commissioner Elmer made the motion to go into executive session for a period of 15 minutes and was second by Commissioner Kathrens. The meeting closed at 10:45 a.m. extended 10 minutes and open at 11:12. No decision was made.

Banner Creek Director Lu Griffith gave the lake report – south side full as of today, there are two spots open on the north side on A, have four spots open on B. Lake was full this weekend of campers. There are some contractors camping but it’s sort of winding down.

Lu agreed to pay half of the hammer lease that attaches to an excavator to break up the rock donated by Pollock’s when Road & Bridge rents a hammer to remove an old cement box.

Lu will re-do all the hay leases except the ones that are with the previous owners. Also need a timeline of when to get the hay off the property.

The Commissioners agreed to allow Lu to bid up to $2,000 on a tree spade at an auction.

The Commissioners approved the 12 new spots in Camp Ground C at an approximate cost of $30,000 for water, electricity and gravel.

Commissioner Elmer made the motion to reopen after lunch, Commissioner Kathrens second and the motion carried unanimously. The meeting opened at 1:05 p.m.

The Commissioners requested that the Clerk’s office figured the different options for health insurance for 2021 as provided by Blue Cross Blue Shield to see if they can fit it within the current budget.

Discussion with County Clerk Kathy Mick and Custodian Chad Phillips about the new roofs being installed by Midwest after the storm damage and other bidder Stous’ correspondance.

Road and Bridge Director Dan Barnett informed Commissioners that his department was to begin chip seal projects today but the rain has delayed those plans. He discussed a concern from a county citizen about the ditching work recently completed making it difficult to mow for the citizen. Commissioner Kathrens asked Dan about getting a hammer rented to use on busting out the bridge needing replacement and also for rock donated by Dan Pollock. Dan is still looking for one to rent. Discussed S Road from 126 to 142 Roads where the west side ditch has been washed out. Dan stated he would go look at it later in the day.

Reminded everyone about the Hallauer/Holthaus fence viewing scheduled for September 8 th.

Banner Lake Director Lu Griffiths reported recent events held at the lake, a youth shoot and prairie walk with a botanist. Lu will be adding native grasses and wildflower species and hopes to add a hive of bees. He also plans to increase the security cameras at the Boy Scout area.

County Clerk Kathy Mick and County Counselor Alex Belveal discussed updating the Covid 19 and FMLA policy and procedures.

Received a letter from Delia Pride seeking funds for a leaking roof. They would like assistance to purchase a metal roof at $3,750.00 estimated cost. BOCC suggested they request CARES funding for this project.

Received a JH Cobra Backers letter requesting membership.

County Appraiser Kate Immenschuh gave an update on the zoning board and filling the open position. BOCC asked Kate to include Neighborhood Revitalization forms to the Building Permit paperwork.

Discussed getting the other quotes requested from health insurance companies soon to deliberate on whether to change coverage for the 2021 year.

Commissioner Kathrens made a motion to approve the Covid 19 Pay Policy and Commissioner Elmer seconded. Motion carried 3/0.

Minutes of September 10, 2020The Board of County Commissioners met in regular session on Thursday, September 10, 2020 at 9 a.m., Chairperson Zwonitzer, Commissioner Elmer and Commissioner Kathrens were present. Deputy County Clerk Tara Peek recorded the minutes. Senne Construction representatives Matt McGivern, Kenny Hartter and Randy Haas met with the BOCC to discuss the remodel on the fourth floor for the County Attorney’s Office. Pat Korte, Brett Wagonner and Jeff Morrow were present. Matt explained that the contract submitted by Senne works within the given budget and allows them to select their own architect. They stated they would select an economical option with value. Chad Phillips, Darrel Chapman and Tim Morse joined the meeting. They discussed the timeline and design and demo taking place concurrently. Darrel suggested adding an estimate for design and demo of the entire floor for future growth. Holton Recorder reporter Ali Holcomb joined the meeting. Senne Construction would have a contract ready to be reviewed on Monday. Sheriff Tim Morse submitted contracts for review from KBS to County Counselor Alex Belveal.

County Clerk Kathy Mick went over the budget with the BOCC and Ali present.

Senne Construction representatives Matt McGivern and Kenny Hartter joined the meeting to discuss the Attorney’s Office renovation. They stated they were willing to work with any architect chosen by the county and suggested Architect One and Schwert Design. They also suggested Topeka based PKMR for engineering services since they have worked at the site before and are familiar with the building. Senne Construction has allocated $13,000.00 towards architect and engineering fees within their bid. They plan to start demo on the 28th and possibly some electrical work as well. County Counselor Alex Belveal joined the meeting and reviewed the contract submitted by Senne.

County Clerk Kathy Mick joined the meeting to discuss the 2021 budget.

Banner Lake Director Lu Griffiths reported the north side camping was full again and the south was not. He stated he was bidding on a spade through Purple Wave auction site. The Commissioners approved $3,000.00 for the purchase of the 36 inch spade. Lu informed Commissioners that he was trading in the current lake truck for a 2011 Ford ¾ ton 4x4 extended cab from Foster Ford for $16,500.00.

GAS representative Brett Wagonner joined the meeting to discuss the CARES funds and the business grant application design. Chamber Director Ashlee York joined the meeting and agreed to distribute the applications to Jackson County businesses.

HMN Architect Shawn Harding joined the meeting to discuss his bid for design of the Attorney’s Office. He submitted a bid for the partial renovation and also for a remodel of the entire 4 th floor space. Undersheriff Darrel Chapman joined the meeting to discuss the remodel as well. The Commissioners approved HMN’s bid for the partial renovation at a cost of $17,365.00. (Sheriff Morse added that his grandmother, Mrs. Anderson, gave her approval of Shawn as he was a “polite and studious” 5 th grade student of hers.)

Sheriff Tim Morse, Kris Kobach and Sarus Systems CEO Dan Drake joined the meeting. Kris introduced Dan and his product to the BOCC. Dan explained the science behind his scent crusher product used for killing bacteria causing scent for hunting purposes and his new product that has been developed and proven to kill Covid-19. One unit sanitizes a 1250 square foot space in about 90 minutes. He also has a closet style unit that equipment can be placed inside to be sanitized. The units use water vapor and sanitizing tablets to release Ozone that kills the virus. Sarus Systems is based in Wichita and the mobile unit he brought for demonstration purposes cost $15,000.00. Orders made now will likely be fulfilled in December. No action was taken.

Environmental Services and Noxious Weed Director Scott Kieffaber asked the Commissioners about getting a newer truck with more towing capacity to be used at the recycling center. He reported that the white truck has less than 50,000 miles and he would trade in the brown truck. BOCC requested he get bids from all the local dealers. Scott submitted photos of the new recycling trailer after they had painted it. It is at Boyett Sales and Service getting lights installed. Scott shared that he had received a phone call complimenting landfill employee Ed Rostetter. Keith Kelly spoke to his great customer service as well.

Road and Bridge Director Dan Barnett informed Commissioners that he had received a payment from Farm Bureau of $5,659.43 to replace a damaged guard rail on Q Road just south of Banner Road. Dan stated that he has a meeting with NextEra where they will discuss reclamation on private landowners’ property. Currently all temporary entrances are still in place. Dan stated the bridge work at 270 and T1 Roads is still in progress. Dan discussed issues with CenturyLink lines exposed and vulnerable to breaks by county road maintenance. The chip and seal projects are near completion. Dan will meet with NextEra to discuss the plans to repair a portion of 254 Road. Dan stated that it has 7 layers of chip now and that cannot be milled and redone all at once. They will likely have to come back next year to add some layers. Dan informed Commissioners that he had some calls because the railroad crossing on 110 Road was closed for a couple days. The county was not notified ahead of time by the railroad but he did get notification on the next closing so he was able to get signage out to inform drivers.

Circleville Mayor Mike Hare and council member Chelsea Shupe met with Commissioners to request funding to help with their park renovation project. They were able to purchase a used playground set recently and volunteers installed it. They are planning to enclose the area with a border and lay matting down. They would like to purchase a 5-inch base of pea gravel at an estimated cost of $2,300.00. Chelsea explained that she has worked to find a grant to assist with their project but all the grant funds available have been shifted to Covid-19 related expenses only. Commissioner Kathrens made a motion to approve $3,000.00 from the alcohol tax generated parks and recreation funds to Circleville City for their park project and Commissioner Elmer seconded. Motion carried 2/0.

Banner Lake Director Lu Griffiths reported he did not get the spade from the auction. The Commissioners approved for him to purchase a new one for $4,400.00. Lu stated the north side remained full of campers over the weekend. The south side camp host will not be returning for next season so Lu will advertise in the newspaper for a replacement.
