Minnesota Rules: Amendments and AdditionsNOTICE:HowtoFollowStateAgencyRulemakingintheStateRegisterTheStateRegisteristheofficialsource,andonlycompletelisting,forallstateagencyrulemakinginitsvariousstages.Stateagenciesare

requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.

AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.

Whenrulesarefirstdrafted,stateagenciespublishthemasProposedRules,alongwithanoticeofhearing,oranoticeofintenttoadoptruleswithoutahearinginthecaseofnoncontroversialrules.Thisnoticeasksforcommentontherulesasproposed.Proposedemergencyrules,andwithdrawnproposedrules,arealsopublishedintheStateRegister.Afterproposedruleshavegonethroughthecommentperiod,andhavebeenrewrittenintotheirfinalform,theyagainappearintheStateRegisterasAdoptedRules.Thesefinaladoptedrulesarenotprintedintheirentirety,butonlythechangesmadesincetheirpublicationasProposedRules.Toseethefullrule,asadoptedandineffect,apersonsimplyneedstwoissuesoftheStateRegister,theissuetheruleappearedinasproposed,andlaterasadopted.

Rules to be Adopted After a Hearing.Afterreceivingcommentsanddecidingtoholdapublichearingontherule,anagencydraftsitsrule.Itthenpublishesitsruleswithanoticeofhearing.Allpersonswishingtomakeastatementmustregisteratthehearing.Anyonewhowishestosubmitwrittencommentsmaydosoatthehearing,orwithinfiveworkingdaysofthecloseofthehearing.Administrativelawjudgesmay,duringthehearing,extendtheperiodforreceivingcommentsupto20calendardays.Forfivebusinessdaysafterthesubmissionperiodtheagencyandinterestedpersonsmayrespondtoanynewinformationsubmittedduringthewrittensubmissionperiodandtherecordthenisclosed.Theadministrativelawjudgepreparesareportwithin30days,statingfindingsoffact,conclusionsandrecommendations.Afterreceivingthereport,theagencydecideswhethertoadopt,withdrawormodifytheproposedrulebasedonconsiderationofthecommentsmadeduringtherulehearingprocedureandthereportoftheadministrativelawjudge.Theagencymustwaitfivedaysafterreceivingthereportbeforetakinganyaction.

Rules to be Adopted Without a Hearing. Pursuant to Minnesota Statutes§14.22,anagencymayproposetoadopt,amend,suspendorrepealruleswithoutfirstholdingapublichearing.AnagencymustfirstsolicitComments on Planned Rules or Comments on Planned Rule Amendmentsfromthepublic.Theagencythenpublishesanoticeofintenttoadoptruleswithoutapublichearing,togetherwiththeproposedrules,intheState Register. If,duringthe30-daycommentperiod,25ormorepersonssubmittotheagencyawrittenrequestforahearingoftheproposedrules,theagencymustproceedundertheprovisionsof§§14.1414.20,whichstatethatifanagencydecidestoholdapublichearing,itmustpublishanoticeofintentintheState Register.

Proposed Amendment to Rules Governing Weights and Measures, Minnesota Rules, chapter 7601, Repeal of Minnesota Rules, part 7601.8000.

Introduction.TheMinnesotaDepartmentofCommerceintendstoadoptruleswithoutapublichearingfollowingtheproceduresintherulesoftheOfficeofAdministrativeHearings,Minnesota Rules,parts1400.2300to1400.2310,andtheAdministrativeProcedureAct,Minnesota Statutes,sections14.22to14.28.If,however,25ormorepersonssubmitawrittenrequestforahearingontherulesby4:30p.m.onSeptember6,2021,theDepartmentwillholdavirtualpublichearingviaWebEx.An Administrative Law Judge will conduct the hearingstartingat9:30a.m.onTuesday,September21,2021,andcontinuinguntilthehearingiscompleted.TofindoutwhethertheDepartmentwilladopttheruleswithoutahearingorifitwillholdthehearing,youshouldcontacttheagencycontactpersonafterSeptember6,2021,andbeforeSeptember21,2021.

Subject of Rules and Statutory Authority.TheDepartmentofCommerceproposestoamendMinnesota Rules,Chapter7601,governingweightsandmeasures.TheamendmentsupdateMinnesota Rules,Chapter7601,byincorporatingbyreferencecurrentNISTHandbook44,Specifications Tolerances and Other Technical Requirements for Weighing and Measuring Devices,andNISTHandbook133,Checking the Net Contents of Packages Goods.TheNISTHandbookiscomprisedofspecification,tolerances,andothertechnicalrequirementsadoptedbytheNationalConferenceonWeightsandMeasures,Inc.(NCWM).Thesespecifications,tolerances,andothertechnicalrequirementsarerecommendedbyNCWMforofficialpromulgationinandusebystateweightsandmeasuresagencies.UpdatestotheNISTHandbookaremadeannually.Chapter7601hasnotbeenupdatedsince2005and,assuch,itstillincorporatesthe2005editionoftheNISTHandbook44and133.Theproposedamendmentsincorporatethe2019NISTHandbook44,therebyupdatingtherequirementsandspecificationsforweighingandmeasuringequipmentmanufactured,offered,orexposedforsaleorsoldorgivenawayforuseintradeorcommerceinMinnesotatothosecurrentlyrequiredbyNIST.ThisproposedchangewillallowMinnesotaindustrymemberstoinstallanduseup-to-dateweighingandmeasuringequipment.Theproposedamendmentsalsoincorporatethe2019NISTHandbook133.ThisamendmentwillupdatepackagingandlabelingrulesforpackagedgoodstothosecurrentlyrequiredbyNIST.ThisamendmentwillallowMinnesotaindustrymemberstoadheretoauniformsystemforpackageaccuracy.TheproposedruleamendmentsalsochangetheslopingrequirementsinRule7601.4010,subpart3forwashoutslabs.Thechangeeliminatesacommontypeofvariancerequestwhichoccurswhenscalesarebuiltnexttobuildingsoronhillsides.TheproposedruleamendmentsalsorepealRule7601.8000,whichgovernsbiodieselblendquantificationmethods.ThisruleisnowobsoletebecauseanationallyacceptedASTMmethodforquantifyingbiodieselblendsnowexists.Finally,theproposedruleamendmentsremovereferencestopreviouslyrepealedruleparts.

ThestatutoryauthoritytoadopttherulesisMinnesota Statutes,section239.06.AcopyoftheproposedrulesispublishedintheState Registerandattachedtothisnoticeasmailed.Afreecopyoftherulesisavailableuponrequestfromtheagencycontactpersonlistedabove.
