Minnesota Rules: Amendments and AdditionsNOTICE:HowtoFollowStateAgencyRulemakingintheStateRegisterTheStateRegisteristheofficialsource,andonlycompletelisting,forallstateagencyrulemakinginitsvariousstages.Stateagenciesare
requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.
AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.
Whenrulesarefirstdrafted,stateagenciespublishthemasProposedRules,alongwithanoticeofhearing,oranoticeofintenttoadoptruleswithoutahearinginthecaseofnoncontroversialrules.Thisnoticeasksforcommentontherulesasproposed.Proposedemergencyrules,andwithdrawnproposedrules,arealsopublishedintheStateRegister.Afterproposedruleshavegonethroughthecommentperiod,andhavebeenrewrittenintotheirfinalform,theyagainappearintheStateRegisterasAdoptedRules.Thesefinaladoptedrulesarenotprintedintheirentirety,butonlythechangesmadesincetheirpublicationasProposedRules.Toseethefullrule,asadoptedandineffect,apersonsimplyneedstwoissuesoftheStateRegister,theissuetheruleappearedinasproposed,andlaterasadopted.

EmergencyExecutiveOrders.Thegovernor'sauthorityisspecifiedintheConstitutionoftheStateofMinnesota,ArticleV,andin Minnesota Statutes§4.035.EmergencyExecutiveOrders,forprotectionfromanimminentthreattohealthandsafety,becomeeffectiveimmediately,arefiledwiththesecretaryofstate,andpublishedintheState Registerassoonaspossibleaftertheyareissued.OtherExecutiveOrdersbecomeeffective15daysafterpublicationin the State Registerandfilingwiththesecretaryofstate.Unlessotherwisespecified,anexecutiveorderexpires90daysafterthedatethegovernorwhoissuedtheordervacatesoffice.
Office of the GovernorExecutive Order 21-06: Providing Public Safety Assistance during Potential Civil Unrest
I, Tim Walz, Governor of the State of Minnesota,bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:
TheupcomingtrialsoftheformerofficersinvolvedinthedeathofGeorgeFloydhaveraisedthepotentialofcivilunrestintheCitiesofMinneapolis,SaintPaul,andnearbycommunities.TheMayorsofMinneapolisandSaintPaulhaverequestedassistancefromtheState,includingtheMinnesotaNationalGuard,tosupportpublicsafetyandsecurityandtopreventorrespondtopotentialcivilunrest.Inadditiontootherstateresources,theNationalGuardcansupplementlocallawenforcementeffortstokeepthepeace,ensurepublicsafety,andallowforpeacefuldemonstrations.Permydirection,theNationalGuardhasalreadybegunplanningandpreparingforactivationtostateservice.
Forthesereasons,Iorderasfollows:
1. TheAdjutantGeneralwillordertostateactivedutythepersonnel,equipment,andfacilitiesneededtocoordinateandsupportpublicsafetyandsecurityservicesintheCitiesofMinneapolisandSaintPaulandcommunitiesacrosstheStateofMinnesota,atatimedeemedappropriatebytheAdjutantGeneralinconsultationwiththeGovernorandforsuchperiodoftimeasnecessarytocoordinateandsupportpublicsafetyandsecurityservices.
2. TheAdjutantGeneralisauthorizedtoprocurethegoodsandservicesneededtoaccomplishthemission.
3. TheDepartmentofPublicSafety’sDivisionofHomelandSecurityandEmergencyManagementwillcontinuetocoordinatetheprovisionofon-sitesupportandassistancetoaffectedlocalunitsofgovernmentandassesstheneedforsupplementaryemergencyassistance.
4. ThecostsofthisassistancewillbepaidfromthegeneralfundasallowedbyMinnesotaStatutes2020,section192.52.
ThisExecutiveOrderiseffectivefifteendaysafterpublicationintheStateRegisterandfilingwiththeSecretaryofStateandwillremainineffectuntilitisrescindedbyproperauthority,theneedforNationalGuardassistanceends,orDecember31,2021,whicheveroccursfirst.
AdeterminationthatanyprovisionofthisExecutiveOrderisinvalidwillnotaffecttheenforceabilityofanyotherprovisionofthisExecutiveOrder.Rather,theinvalidprovisionwillbemodifiedtotheextentnecessarysothatitisenforceable.

TheconditionsthatdonotallowcompliancewithMinnesotaStatutes,sections97A.0451to97A.0459,areasfollows:thatdistributionofpermitsforaccesstomajorwildlifemanagementunitsissubjecttomodificationonanannualbasisastheDepartmentofNaturalResourcesrefinesthemannerbywhichtheseasonisconductedtoprovidehigh-qualityhuntingopportunitiesandassureequitabledistributionofharvest.Turkeypopulationandharvestdataisgatheredannuallyandanalyzedinlatesummer.Adjustmentstopermitareaboundariesarebasedonannualandlong-termpopulationdataaswellasinputfromthepublic.
TheSt.MichaelsMeadowsWildlifeManagementAreacannotsustainfirearmshuntingduetoitssmallersizeandproximitytoaresidentialhousingdevelopment.
ChangestotheCarlosAveryWildlifeManagementUnitSanctuaryimproveopportunitiesforyouthordisabledhunterswhoareparticipatinginspecialhunts.
ChangestoCrossLakeandCampRipleyGameRefugesinCrowWingandMorrisoncounties,respectively,provideadditionalhuntingopportunityonrefugeswherethereisaharvestablesurplusofwildturkey.
ThecrowseasonisbeingamendedtocontinuetomeetthemaximumfederalcrowseasonspecifiedinMinnesotaStatutes,section97B.731,subdivision3.
