Consideration: Action/Information Date: May 3, 2017 1. APPROVE SINGLE PLANS FOR STUDENT ACHIEVEMENT FOR 2016-­2017 Approve the Single Plan for Student Achievement (SPSA) for Gompers K-­8 School. The plan has been developed and approved by the site’s School Site Council and contains the components of effective planning based on student needs, assessment data, use of staff, parent involvement, and allocation of resources. The plan has been reviewed by Equity, Access, and College & Career Readiness staff for compliance. The school’s approved SPSA for the 2016-­2017 school year will also serve as an interim plan until the following school year’s SPSA is revised and approved. The funding for all programs and personnel outlined in these SPSAs is reflective of the current fiscal year only. 2. APPROVE RECEIPT OF ADDITIONAL RTTP-­ELC / QRIS FUNDING: CSPP

INCENTIVE Approve receipt of additional funding from the Quality Rating and Improvement System block grants. The additional funding is through the California State Preschool Program (CSPP): Incentive Grant, which totals $78,000. The additional funding consists of $4,500 for each of the following 16 CDC sites for professional development and outdoor gross motor materials and equipment: Edison, Addams, Barton, Burbank, Central, Garfield, Grant, Holmes, Lincoln, Mann, McKinley, Muir, Stevenson, Twain, Willard, and Webster. Upon evaluation of enrollment patterns and proximity of school sites, the following changes are being recommended. Approve the boundary adjustment detailed below and shown on Exhibit A. The area would be removed from the Powell K-8 School attendance boundary and added to the Grant Elementary School and Hamilton Middle School attendance boundaries. There are currently 62 elementary and 28 middle school students living in this area.

• The proposed area starts at Atlantic Avenue and Artesia Boulevard; South onAtlantic Avenue to Harding Street; West on Harding Street to De Forest Avenue;North on De Forest Avenue, then along the L.A. River to Artesia Boulevard andEast on Artesia Boulevard to the starting point at Atlantic Avenue.

The boundary changes, if approved, would be effective at the start of the 2017-18 school year. This change would only be applicable to new students and transfers, and no current students would be required to change schools.

INSTRUCTION BP 6146.1 High School Graduation Requirements

The Governing Board desires to prepare all students to obtain a high school diploma to enable them to take advantage of opportunities for postsecondary education and employment. Course Requirements (Education Code 51225.3) To obtain a high school diploma, students in the class of 2015 through the class of 2017 shall complete at least 210 credits in the prescribed course of study in grades 9-­12. Beginning with the class of 2018, students shall complete at least 220 credits in the prescribed course of study in grades 9-­12. Each course is considered as being a year in duration unless otherwise indicated.

1. Four courses in English (40 credits).

2. Two courses in mathematics (20 credits). Beginning with the class of 2018, students will be required to complete three courses in mathematics (30 credits) and beginning with the class of 2019 students will be required to complete four courses in mathematics (40 credits).

At least one mathematics course, or a combination of the two mathematics courses required for completion in grades 9-­12, shall meet or exceed state academic content standards for Algebra 1 to meet the State graduation requirement. (Education Code 41224.5).

Completion, prior to grade 9, of algebra coursework that meets or exceed state academic content standards shall satisfy the algebra coursework requirement, but shall not exempt a student from the requirement to complete two mathematics courses in grades 9-­12. (Education Code 51224).

Students in the class of 2018 and beyond, while encouraged to take rigorous a-­g courses in their junior and senior year, may take applied math courses aligned to a career pathway/industry need to meet the third and fourth year math requirement. Beginning with the Class of 2018, students that are enrolled in a Pre-­Calculus or higher math course as a junior, do not have to take a fourth year of math. Beginning with the Class of 2018, students may take any computer science or Project lead the Way (PLTW) computer science course to meet their local math requirement for graduation.

TALB informed the District on April 7, 2017 that their membership had ratified the Tentative Agreements providing for the modification of the K-­12 and CDC/Head Start contracts through June 30, 2018. Ratification resulted in revisions to the K-­12 and CDC/Head Start bargaining unit contracts, including a 2% increase in all salary schedules for bargaining unit members and a one-­time “off schedule” 1 percent increase, retroactive to July 1, 2016. The tentative agreement makes some adjustments to language in the contract categories of health and welfare plans, adjunct duties, replacement services during conference periods, electronic grading and communication, class size and staffing ratios, evaluation procedures, Head Start days and hours, and Educare job specifications. In compliance with collective bargaining agreement public disclosure requirements of Government Code, Section 3547.5, the “Public Disclosure of Collective Bargaining Agreement” forms for TALB K-­12 Unit and CDC/Head Start Unit have been displayed for public review since April 14, 2017. Penick & Sons, Inc. (“Contractor”) to perform and complete all work required in connection with the New Construction of Browning High School project (“Project”). On numerous occasions throughout the course of the Project, the District notified Contractor and its surety Western Surety Company (“Surety”) about serious concerns over Contractor’s overall performance; Contractor’s failure to conform to the Agreement documents; Contractor’s failure to meet the Project completion date of June 2, 2016; and Contractor’s financial viability and nearly continuous influx of stop payment notices served on the District. The District has worked diligently and patiently with Contractor to resolve the deficiencies on the Project, but to date, Contractor’s performance has not improved and there are defective conditions on the Project that pose a clear and imminent danger, and that require immediate action to prevent the loss or impairment of life, health, and property. Shore v. Central Contra Costa Sanitary District (1962) 208 Cal.App. 2d 465 and Garvey School District v. Paul (1920) 50 Cal.App. 75 hold that a contract for takeover work may be exempted from competitive bidding upon default. Competitive bidding for the defaulted work on the Project would cause unnecessary and further delays. It would work an incongruity and not produce any advantage to the District to competitively bid the completion and repair work due to the immediate need of completing the Project and providing safe and adequate facilities. Given the current state of the work and the uncertainty of the issues left unresolved by Contractor and Surety at the Project, it is necessary to enter into a contract(s) with a contractor to repair Contractor’s work and complete the Project. WHEREAS, on July 22, 2014, the Long Beach Unified School District (“District”), in accordance with Public Contract Code section 20111, publicly advertised Bid No. 20-1415/98 for the New Construction of Browning High School project (the “Project”);

WHEREAS, on September 19, 2014, Contractor and District entered into an agreement (“Agreement”) whereby Contractor would furnish all labor, materials, equipment, tools, and utility and transportation services, and perform and complete all work required in connection with the Project;

WHEREAS, on numerous occasions throughout the course of the Project, the District has notified Contractor and its surety Western Surety Company (“Surety”), about serious concerns over Contractor’s overall performance; Contractor’s failure to conform to the Agreement documents; Contractor’s failure to meet the Project completion date of June 2, 2016; and Contractor’s financial viability and nearly continuous influx of stop payment notices served on the District;

WHEREAS, Contractor and Surety have persistently failed and refused to provide the District with any satisfactory assurances that Contractor will adequately complete its obligations under the Agreement for the Project;

WHEREAS, as of the date of this Resolution, the Surety has refused repeated demands by the District that it complete the Project in accordance with the Agreement;

WHEREAS, the Agreement has not been terminated for the convenience of the District, or for any other reason, and there still exists a contractual relationship between District and Contractor for completion of the Project;

WHEREAS, the Agreement has not been abandoned by either party but Contractor has failed to complete the work in conformance with the contract documents, despite repeated requests by the District;

WHEREAS, the District has worked diligently and patiently with Contractor to resolve the deficiencies on the Project, but as of the date of this Resolution, Contractor’s performance has not improved and there are defective conditions on the Project that pose a clear and imminent danger and that require immediate action to prevent the loss or impairment of life, health, and property, including, but not limited to, the following:

Defective doors that cannot be opened and closed safely;

HVAC Repairs and Completion;

Gymnasium Floor and Thresholds;

Plaster Completion;

HVAC Unit Platform Paint

Drywall Patch at Ductwork;

Intumescent Paint Patch

Culinary Arts Room HVAC;

Added Drywall Layers for Fireproofing;

Architect list of miscellaneous observation items;

Utilities in Elevator Room;

Chemical Fume Hoods;

Steel Roof Screen Supports;

Roofing System;

Pipe crossing at seismic joints; and,

Expansion joint covers;

(The above conditions are hereinafter collectively referred to as the “Defective Work” and estimated for a total anticipated price of $2,513,680);

WHEREAS, Pursuant to Article 2.2 of the General Conditions of the Agreement, if the Contractor defaults or neglects to carry out the work in accordance with the contract documents (“Partial Default”), the District may cure the Contractor’s Partial Default in a specific segregated area of work;

WHEREAS, on February 6, 2017, the District issued to Contractor and Surety a Notice of Intent to Issue Notice of Partial Default based on the defective doors installed on the Project, and issued a notice on March 15, 2017, that the District removed this scope of work from the Agreement because of Contractor’s failure to cure the Partial Default;

WHEREAS, on March 8, 2017, the District issued to Contractor and Surety a Notice of Partial Default with Right to Cure based on Contractor’s defective work on the chemical fume hoods, culinary arts classroom, and steel roof screen supports, and issued a notice on March 15, 2017, that the District removed this scope of work from the Agreement because of Contractor’s failure to cure the Partial Default;

WHEREAS, on March 15, 2017, the District issued to Contractor and Surety a Notice of Partial Default with Right to Cure based on Contractor’s defective work on the roofing system, gymnasium floor, and downspout connections, and issued a notice on April 4, 2017, that the District removed this scope of work from the Agreement because of Contractor’s failure to cure the Partial Default;

WHEREAS, on April 4, 2017, the District issued to Contractor and Surety a Notice of Partial Default with Right to Cure based on Contractor’s defective work on the fencing and gates, mold remediation, and IDF rooms and low voltage systems, and that the District removed this scope of work from the Agreement because of Contractor’s failure to cure the Partial Default;

WHEREAS, immediate action needs to be taken to correct the Defective Work to prevent or mitigate the impairment of safety, life, health, property, or essential public services;

WHEREAS, given the current state of the work and the uncertainty of the issues left

unresolved by Contractor and Surety at the Project, there is a need to complete all remaining work and any remedial and repair work as soon as possible;

WHEREAS, in order to complete all work, it is necessary to enter into a contract with a

contractor to repair Contractor’s work, and complete the Project; WHEREAS, Shore v. Central Contra Costa Sanitary District (1962) 208 Cal.App. 2d 465

and Garvey School District v. Paul (1920) 50 Cal.App. 75 hold that a contract for takeover work may be exempted from competitive bidding upon default;

WHEREAS, competitive bidding for the defaulted work on the Project would cause unnecessary and further delays; WHEREAS, it would work an incongruity and not produce any advantage to the District to competitively bid the completion and repair work due to the immediate need of completing the Project and providing safe and adequate facilities; and WHEREAS, Meakin v. Steveland (1977) 68 Cal.App.3d 490 and Los Angeles Dredging v. Long Beach (1930) 210 Cal. 348 hold that statutes requiring competitive bidding do not apply when competitive bidding would work an incongruity or not produce any advantage.

NOW, THEREFORE, the Governing Board of Long Beach Unified School District hereby finds, determines, declares, orders and resolves as follows:

Section 1. That the above recitals are true and correct. Section 2. That the District’s Governing Board, pursuant to Article 2.2 has determined

that a Default has occurred with regard to the specific items and both the Contractor and Surety have refused to correct the defaulted work.

Section 3. That timely and immediate correction of the Defective Work is necessary to

provide safe and adequate facilities for District students, teachers and staff and to avoid unnecessary health and safety risks.

Section 4. That the Governing Board, finds that award of a contract(s) to correct the

Defective Work through the competitive bid process would cause

unnecessary and prejudicial delay to completion of the Project, which is already in serious jeopardy due to delays caused by Contractor.

Section 5. That the Governing Board by a majority of the vote and pursuant to

Education Code Section 17604 and similar statutes, to delegate authority to its Superintendent, or the Superintendent’s designee, to execute any and all agreements with qualified contractors and to execute any necessary documents to correct the Defective Work, or to otherwise carry out the intent of this Resolution, all subject to ratification by the Governing Board.

Section 6. That this Resolution shall be effective as of the date of its adoption.
