City Updates Zoning Code and Streamlines Permit ProcessAmendments ease permit requirements and encourage code compliance

NOVATO, Calif— As of November 23, it will be even easier to do business with the City of Novato. On Tuesday night, the Council approved an ordinance amending the City’s Zoning Code, which will help clean-up the City’s primary tool for implementing its General Plan, and streamline several of its permitting processes. The ordinance will go into effect in 30 days.

“We want Novato to be looked at as business-friendly and we continually look for ways to help business succeed and grow,” said Mayor Denise Athas. “These changes will help add clarity to our process and help improve our customers’ bottom line.”

The City’s Zoning Ordinance, which requires Council approval when there are changes made to the Zoning Code, was last revised in 2001. As the code becomes outdated, the City amends it to reflect changes in laws and local land-use philosophies.

Highlights of the amendments contained in the 110-page staff report include:

• eliminating the need for a use permit for dining establishments seeking to serve alcohol• waiving the need for design review for minor modifications to existing and planned hillside

developments such as small additions, façade and landscaping changes, and small accessory buildings

• modifying the tree removal permit process for both commercial and multi-family properties—eliminating the need to obtain a permit for removal of trees less than 24” wide

• prohibiting medical marijuana dispensaries

The proposed streamlining amendments were circulated among community and business organizations, including the Marin Conservation League and the Novato Chamber of Commerce, in order to incorporate feedback from the communities most affected by the changes. Additionally, the Planning Commission held a public workshop in August, and a public hearing in September. Tonight’s action by Council reflected the second reading of the ordinance, the first occurred on October 9.

“Easing the regulatory burden on business is essential to Novato’s economic health,” said Coy Smith, Chief Executive Officer for the Novato Chamber of Commerce. “Our hope is that these changes will encourage new and expanding businesses to better serve our community.”

Kalb's Q&A for Contractors By Shauna Krause & David Kalb, Capitol Services, Inc.

When something sounds too good to be true you know the likely results. We ‘strip the cover off’ rules on who can and can’t do electrical work with- or without- the proper license. A ‘swift’ review of an unlicensed contractor’s recent bid for work…

Q: I found Capitol Services on the Internet. You look to be experi-enced in licensing matters. I was asked to become a RME on a new license. The person wants to use my Sole Owner license and pay me a fee each month. He said I did not even need to be involved in the company. I’m not using the license at this time, but can you tell me if this is legal? I thought I was supposed to work a certain amount of time each week?

A: There are several significant problems with the above ‘pro-posal’. First, to become a Responsible Managing Employee (RME) you should be involved in the day-to-day operations of your “employer”. Second, as an employee, you should be working at least 32 hours a week (or 80% of the time the company is operat-ing). Third, “loaning” your contractor’s license to someone can get you into trouble with the CSLB. Also, keep in mind that you’ll be required to inactivate your Sole Owner license in order to act as the Qualifier on this new license.

Q: I am writing about Section 7057. Can a supervising contractor for a new house do JUST electrical work without doing any other work? Is he required to have a special license for getting electrical work done by his employee or an unlicensed sub contractor?

A: I suspect you’re asking if a “B” contractor can just do electrical (“C-10”) work on a residential construction project. The answer is nO, since he/she must perform two or more unrelated trades (not including framing) or hold the specialty classification. You can however, take on the project and use a licensed “C-10”sub to do the electrical work. Under no circumstances should you use an unlicensed subcontractor.

Q: I have a quick question that hopefully you could answer. If someone has been acting in the capacity of a General contractor, overseeing subcontractors and laborers in various specialties, but has not had a license, could that “illegal” experience be used to qualify towards applying for a legitimate license?

A: Yes, the CSLB will accept self-employed (illegal) experience as long as it can be certified by someone who has worked with this individual. In a small number of cases the CSLB will also ask for verifiable proof such as pay stubs, signed contracts or tax returns.

The CSLB regularly conducts “stings” to catch unlicensed contrac-tors so it is a good idea to quickly get a license and contract legally.

The CSLB SWIFT Unit recently conducted a sting operation in the Central Valley. Two of the suspects did not provide bids at the sting location, but said they would e-mail/fax their bid to the investigator (who was posing as a home owner) within a few days. After measuring the kitchen and both bathrooms, “Mr. Smith” left. True to his word, the investigator received a bid and then asked “Mr. Smith” to come to her place of employment to review it. The unlicensed individual “contractor” arrived without ever noticing that he was at the CSLB office. He confirmed the estimate and was immediately issued a notice To Appear (nTA) for illegal advertis-ing and contracting without a license.

Back in July, I ran the following article from the CSLB, but have recently been asked again for this information. So, I thought it might be time to re-send it to you.

New Mechanics Lien Release Forms Available on CSLB Website

The Contractors State License Board (CSLB) is reminding licensees of revisions that were made to the state’s mechanics lien laws on July 1, 2012. Legal revisions mainly change the wording and format of the mechanics lien notice. Because of the changes, CSLB has updated release forms to reflect the new language. Contractors can use these documents to protect their lien rights on construction projects. The forms are available on the CSLB website (www.cslb.ca.gov).

The 20-Day Preliminary notice is now simply called Preliminary notice. In addition, the wording of the notice to Property Owner statement, required as part of the Preliminary notice, has changed. Subcontractors and suppliers should use the newly worded notice for private home improvement projects. The Preliminary notice should be delivered to the homeowner in person or by certified, registered, or express mail, or overnight delivery, with a receipt of the mailing as proof. You may give notice any time before work starts or products are delivered, and up to 20 days after. If you give notice more than 20 days after work or delivery, your lien rights only apply to the work or products provided 20 days before the notice was given, and anytime thereafter.

The notice of Mechanics Lien wording also changed in the new law. This notice must accompany the lien claim and be sent via certified, registered, or first class mail, with a certificate of mailing as proof. Failure to send the properly worded notice with the lien claim could result in the lien being unenforceable.

The conditional and unconditional lien release forms also have changed. Make sure subcontractors and suppliers sign the new conditional forms as progress payments are owed, and when the project is finished before they are given final payment. Have them sign the new unconditional release forms after they receive progress payments and their final payment. The new law gives homeowners 15 days instead of 10 to file a notice of Completion with the County Recorder. If a notice is filed, the contractor has 60 days and subcontractors have 30 days to record a lien. If no notice is filed, all parties have 90 days to record a lien.

Two New Discrimination Laws Mean Changes for Policies, Posters

Employers will need to change notices, postings and employee handbook policies related to discrimination and harassment prevention to reflect two recently signed bills, AB 1964 and AB 2386.

Religious Dress/Grooming

AB 1964 amends Government Code sections 12926 and 12940 and clarifies that the Fair Employment and Housing Act’s (FEHA) discrimination protections and reasonable accommodation requirements cover religious dress practices and religious grooming practices.As stated in the analysis of the bill, the intent is to “provide clarity and ensure that all religions receive equal protection under the law.” The added language states:

• “Religious dress practice” is construed broadly to include the wearing or carrying of religious clothing, head or face coverings, jewelry, artifacts and any other item that is part of the observance by an individual of his or her religious creed.

• “Religious grooming practice” is also to be construed broadly and includes all forms of head, facial and body hair that are part of the observance by an individual of his or her religious creed.

Importantly, the law specifies that an accommodation is “not reasonable” if the accommodation requires segregation of the individual from other employees or the public.

Employers are required to make reasonable accommodations unless an accommodation is an undue hardship. The amended statute clarifies that the “undue hardship” definition that applies to other types of discrimination, also applies to religious discrimination.

Breast Feeding

AB 2386 amends California Government Code Section 12926 and makes it clear that breast feeding is protected by law and discrimination on that basis is illegal.

The new legislation was enacted, in part, to reflect a decision by the Fair Employment and Housing Commission (FEHC) in 2009 in which an employee was terminated because she was nursing her baby during her lunchtime break.

The FEHC’s decision was designated as having precedential authority, thus such discrimination is a violation of FEHA.The amended Government Code definition of “sex” includes, but is not limited to:

• Pregnancy or medical conditions related to pregnancy.• Childbirth or medical conditions related to childbirth.• Breastfeeding or medical conditions related to childbirth.

The rest of the definition of “sex” remains unchanged:

“Sex” also includes a person’s gender. “Gender” means sex, and includes a person’s gender identity and gender expression. “Gender expression” means a person’s gender-related appearance and behavior whether or not stereotypically associated with the person’s assigned sex at birth.

Quick and easy Smog Checks coming to California

The Air Resources Board has reviewed plans for implementing a new Smog Check program that eliminates tailpipe testing for 2000 model-year and newer vehicles and improves the quality of inspections for older vehicles. Authorized by AB 2289 (Eng, 2010), the new test takes advantage of the advanced monitoring On-Board Diagnostic (OBD) systems that are standard equipment on all newer vehicles.

Instead of measuring tailpipe emissions while simulating driving conditions in a shop, the new test will review OBD data collected during actual operation to identify vehicles with high emissions.

Older vehicles will continue to be inspected using tailpipe emissions but stations will be subject to new performance and evaluation standards. Only stations meeting the tough new standards will be rated as “STAR Certified” and permitted to inspect 1999 and older vehicles. The changeover to the new testing requirements will take place over the next year:

Starting January 1, 2013:

• All 1999 model-year and older vehicles (the model years most likely to have high emissions) will be directed to new STAR inspection stations.

September 1, 2013:

•All 2000 model-year and newer vehicles will be inspected using the OBD-based test. As part of the report on the new Smog Check program, the Board also reviewed the effectiveness of the state’s voluntary vehicle retirement programs. These programs, administered by the Bureau of Automotive Repairs and local air pollution control districts, provide financial incentives to scrap older vehicles and vehicles that require costly repairs. Over the past two fiscal years, these programs have resulted in the retirement of over 82,000 high

emitting vehicles. Retiring older vehicles is an important tool in California’s air quality efforts as Vehicles that are over 20 years old account for only 6% of all miles traveled but are responsible for over 40% of daily smog forming emissions. Adjusting to Your New Work Environment A walk through other areas of the workplace is a common occurrence, but it can also be dangerous if you don’t stay alert. This is particularly true for employees leaving their old, familiar departments and moving into new roles in other areas. New employees receive instructions regarding training and safety precautions. However, when transitioning roles to another area, it can operate very differently; procedures and equipment may be different and safety precautions may vary as well. Safety in New Surroundings Before entering another area, familiarize yourself with any special rules or procedures necessary for your safety. This might mean wearing special personal protective equipment or meeting certain regulations concerning employee actions. During the transition to your new area, be on the guard at corners and close to machinery, and watch for power and hand trucks on the move. Although equipment operators have their own safety regulations to follow, which include watching for pedestrians, be cautious and ready to move. Look both ways before stepping out into an aisle. In aisles wide enough for truck or other equipment traffic, use extreme caution. Don’t try to beat an oncoming forklift or other machinery; you could easily misjudge its speed and fall in front of it. Don’t walk while you’re looking in another direction, you could bump into another employee or a

machine. If you can’t watch where you’re walking, wait until you can. Watch out for slip, trip and fall hazards. Misplaced tools, pieces of materials or other objects pose hazards. Keep floors and aisles clear of these dangers. In addition, do not take shortcuts, regardless of how much time they save. Shortcuts are not approved routes and taking them can cause very serious injuries. At times, it may be necessary to restrict your admittance to certain areas. Whether the restrictions are temporary or permanent, don’t enter the area unless authorized to do so. Safety Precautions Stay safe when transitioning into a new work environment by remembering these basic safety precautions:

Watch out for moving equipment. Look both ways before stepping

into an aisle. Use handrails. Keep your eyes open for slip, trip

and fall hazards. Don’t take shortcuts. Stay out of restricted areas. Ask for direction regarding

unfamiliar safety guidelines.

A new work environment requires employees to keep basic safety precautions top of mind.
