This quote is noteworthy given the fact that it predates John Marshall’s appointment as Chief Justice of the Supreme Court by thir-teen years. Marshall was commenting in his capacity as a delegate to the Virginia conven-tion tasked in 1788 to consider ratification of the U.S. Constitution. There was, at that time,

considerable skepticism in the Commonwealth regarding the wis-dom of creating courts with federal jurisdiction.

After declining an appointment to the Supreme Court in 1798, Mar-shall was eventually appointed Chief Justice in 1801 by President John Adams. He would go on to serve until 1835 during the admin-istrations of six presidents: Adams, Jefferson, Madison, Monroe, J.Q. Adams and Jackson. Marshall was the longest serving Chief Justice and the last born in colonial America. During his tenure, he authored the opinion in Marbury v. Madison and the majority opinion in McCulloch v. Maryland.

CIRCUIT COURT NOTESRobert A. Greenberg, Administrative JudgeCIRCUIT COURT SECURITY CHANGESAs referenced by Bar President Jim Mood, in the February 2018 newsletter, and further explained by Administrative Judge Robert A. Greenberg at the February bar luncheon, a committee has been formed to study and implement new security procedures in the Cir-cuit Court. The committee is being chaired by the Honorable Harry C. Storm, Associate Judge, and includes members of the BAMC, the Office of the States Attorney, the Office of the Public Defender, the Clerk of the Circuit Court, court ad-ministration and the Mont-gomery County Sheriff’s Office.

Beginning in February and continuing throughout the committee’s study period, se-

curity personnel will be imple-menting two monthly random screening days for all persons entering the Circuit Court. On those days, everyone entering the Circuit Court will be sub-ject to search. Attorneys, clients and staff should be prepared for a brief delay in entering the building, and should adjust their arrival times accordingly to assure a timely appearance for hearings and trials.

Any members wishing to be heard regarding our security procedures may submit com-ments, in writing, to Judge Storm or Jim Mood. I appreci-ate your cooperation in help-ing to assure the safety of the attorneys, litigants and staff while in our Circuit Court.

CRIMINAL RESOLUTION CONFERENCESI have received requests for clarification regarding the Post-ponement Policy for Criminal Resolution Conferences. Below is a quick reference guide that may be of assistance.

• Requests to postpone a Res-olution Conference for any reason, made orally in open court on the day of the Res-olution Conference, shall be immediately referred to the Administrative Judge or his/her designee. This includes but is not limited to instances where the De-fendant has not been trans-ported, one of the essential parties is ill, discovery has not been provided, or an in-terpreter is unavailable.

• Consent or joint requests to postpone an original Res-

olution Conference date, made prior to the day of the Resolution Conference, that do not require the postponement of any oth-er scheduled date may be made by contacting the Se-nior Judges Administrative Assistant, Ember Sylvester, at 240-777-9029. (Note: re-quests will only be consid-ered if a date is available on the court’s docket.) No writ-ten request need be filed.

election has ever succeeded in this County. That has not been the case in other jurisdictions. Recent elections saw success-ful challengers in both Freder-ick County and Prince George’s County.

Since 2002, the BAMC has con-tinuously endorsed the Sit-ting Judge Principle. It will continue to do so. The Sitting Judge Principle is rooted in the exceedingly rigorous vetting process to which each judicial applicant must submit prior to securing an appointment. Our judicial selections process assures the citizens of our County that the individuals ap-pointed to our courts possess the intellect, experience and ju-dicial temperament demanded by the job.

The current protocol for trial court appointments dates to 1970 when Governor Marvin Mandel issued a Gubernatorial Executive Order which created judicial nominating commis-sions. The Trial Courts Judicial Nominating Commission is responsible for identifying for the Governor those attorneys who are “most distinguished for integrity, wisdom and sound legal knowledge.” Ev-ery subsequent governor, both Democrat and Republican, has continued the terms of the ex-ecutive order.

Applicants for judicial appoint-ments begin the process with a lengthy and comprehensive application which inquires about education, legal experi-ence and personal information. The completed applications are distributed to more than a dozen diverse bar associations including our own bar associ-ation and the specialty bars. Each applicant can submit to interviews with those bar as-sociations who, in turn, make recommendations to the Judi-cial Nominating Commission. The BAMC has significant in-put in the judicial application process. In addition to review of the applications and person-al interviews by our Judicial Selections Committee, we con-

duct an online referendum of our membership.

The Judicial Nominating Commission conducts its own interviews of the candidates and considers the input of the other bars which conduct in-terviews. Once the process has been completed, a list of quali-fied candidates is submitted to the Governor for consideration. The applicants who are recom-mended are each interviewed personally by the Governor pri-or to the appointments being made.

Unfortunately, the Maryland Constitution permits individu-als who decline to participate in the vetting process or who are unsuccessful in doing so to simply pay a nominal filing fee and run against the appointed, sitting circuit court judges. The most common arguments in support of the current system are that the judicial nominat-ing process is a “beauty pag-eant” and does not sufficient-ly promote diversity on the bench.

The beauty pageant argument is, of course, based on an enor-mous fallacy: that the judicial nominating process should be optional with our judges se-lected by the ultimate beauty contest — a general election. I have worked the polls in each contested election since 2002 and can assure you that the public has essentially no knowledge of and little interest in the judicial elections. Elec-tion campaigns simply cannot adequately replace the rigor of the judicial nominating pro-cess.

A diverse bench is, without question, a valid and worthy concern. But we don’t need contested elections to accom-plish this goal. One need only consider the trial court ap-pointments made by Governor Hogan in Montgomery County since the 2016 election, seven on the circuit court and seven on the District Court. These most recently appointed judg-es were chosen from the very best of our profession. They are not only incredibly talented

(Continued from page 1) and experienced but also rep-resent the diversity for which we strive. As a result of these appointments, we have courts that better reflect the commu-nity that they serve.

A final point concerns the ju-dicial independence to which John Marshall referred more than two centuries ago. How can our judges be truly and com-pletely independent when they must submit themselves to a political process such as contest-ed judicial elections? True inde-pendence requires that they be permitted to perform their ju-dicial functions without regard

to the possible unpopularity of any particular ruling.

Our Association has contin-uously endorsed the Sitting Judge Principle since 2002. It has done so because the cur-rent judicial selections process works. Due in no small part to the participation of the BAMC, it insures the appointment of the most qualified candi-dates and has resulted in a di-verse and exceedingly talented bench. For all of these reasons, the BAMC will continue to vig-orously and enthusiastically support and endorse the Sit-ting Judge Principle.

Ideally, you want clients that are a “good fit” for you and your law firm. As we all know, sometimes clients are not a “good fit”. In some instances, we are unable to withdraw represen-tation because of our ethics rules or because the court will not permit it.

When I was practicing, I read an article that suggested that it’s a good idea to drop 10% of your clients each year. I re-viewed our difficult clients and did drop some. Most of them wanted to stay and some agreed to become a “good fit".

I’m not suggesting that you get rid of your difficult profit-able clients. I am suggesting that you ask yourself “what makes a great client?”, write it down, and then try to discover in the interview whether the potential client will be a “good fit”. I’m also suggesting that you find a better way to interact with difficult clients that you want to keep.

Some difficult clients are worth representing. However, it’s not in your best interest to have a lot of clients that stress you and your team. Practicing law can be stressful enough without a lot of difficult clients adding to your burden.

I spend a lot of time coaching my clients on how to handle difficult clients. If you need some ideas, feel free to contact me. It’s important for you and your firm not to be the closest target when it’s the other party that harmed them.

Whether you let go of a difficult client or rehabilitate them, it can be helpful to take a good look at your difficult clients. “Nowhere do the rules of ethics justify a decision to concede guilt.”

On January 17, 2018, the Unit-ed States Supreme Court heard oral arguments in the case of McCoy v. Louisiana, an appeal from a Louisiana Su-preme Court ruling affirming a murder conviction and death sentence in a triple homicide case. On direct appeal, the de-fendant argued his conviction should be reversed because of ineffective assistance of coun-sel. Throughout the trial, Mr. McCoy claimed he was inno-cent and offered an alibi de-fense that he was out of state at the time the murders occurred even though he did not have any witnesses to support his alibi defense. Notwithstanding his protestations, Mr. McCoy’s counsel conceded his guilt to the jury during opening state-ment and at closing argument in hopes of avoiding the death penalty that was ultimately handed down.

The Louisiana Supreme Court rejected Mr. McCoy’s argument that his counsel should have advanced his “unflinchingly maintained claim of inno-cence,” determining that to do so would violate the attorney’s obligation under Rule 1.2(d) which precludes a lawyer from counseling a client to “engage or assist . . . in conduct that the lawyer knows is criminal or fraudulent.” The Court be-lieved that presenting the alibi defense through the defen-dant’s testimony put the attor-ney in an ethical conundrum based on the perception that Mr. McCoy committed perju-ry when articulating his alibi defense. However, the Court’s observation was based on sup-posed “overwhelming” evidence of guilt and not on his coun-sel’s actual knowledge that Mr. McCoy was in fact guilty. In re-jecting Mr. McCoy’s appeal, the Louisiana Supreme Court held that “conceding guilt, in a hope of saving a defendant’s life at

the penalty phase, is a reason-able course of action in a case in which evidence of guilt is overwhelming.”

Amicus Briefs filed by the American Bar Association and by ethics professors from 10 outstanding law schools urged the Supreme Court to reverse Mr. McCoy’s conviction. Both amici took Mr. McCoy’s lawyer to task for violating ethical rules by conceding his client’s guilt. The law professor’s brief explained that “Larry English (Mr. McCoy’s attorney) was bound by the rules of ethics – as well as the Sixth Amendment and basic agency principles – to confirm his representation accordingly. Yet in his opening statement to the jury and again in closing, Mr. English affirma-tively told the jury that Mr. McCoy was guilty”. The profes-sors argued that Mr. English vi-olated Rule 1.2(a) which requires a lawyer to abide by the client’s instructions regarding the ob-jectives of representation and, as a result “violated his profes-sional obligations and denied his client the fundamental right to challenge the prosecu-tor’s allegation of guilt.”1

The amici further argued that Rule 3.3, relied by the Louisiana Supreme Court, did not compel Mr. English to confess Mr. Mc-Coy’s guilt because this Rule “does not allow the lawyer to refuse to offer the testimony of

the defendant client if he only ‘reasonably believes’ that the client intends to testify falsely”. The record was clear that Mr. English did not know for a fact that the evidence was false. Other arguments advanced by the amici stressed that a crim-inal defense attorney’s effort to seek an acquittal is always a lawful and ethical objective of representation and just be-cause Mr. English believed the evidence against his client was “overwhelming” was no justifi-cation for a decision to concede Mr. McCoy’s guilt.

The McCoy’s case illustrates the dilemma faced by a lawyer representing a criminal charge with a death penalty offense where there is overwhelming evidence of guilt. Mr. English

felt that the best way to spare his client’s life was to admit Mr. McCoy’s guilt. Although this may have been a rational deci-sion, the Rules of Professional Conduct compel a different re-sult because in this case, as in all cases, a lawyer is the agent of the client and is duty bound to follow the client’s instruc-tions and should in all cases be obliged to put the prosecutor to its proof of the crime.21There is no indication in the record before the Supreme Court that Mr. McCoy complained to the Louisi-ana attorney disciplinary authori-ties about the conduct of his attor-ney at trial.2Although Maryland has abolished the death penalty, the ethical rules cited in this article are should guide a lawyer’s conduct in other circum-stances

At last, I finally pulled the plug and dumped my Com-cast Business landline tele-phone service. For decades I've been held hostage to Comcast's one size fits all overpriced business phone service and forced to pay out for unwanted TV service and endure other unwanted, ex-pensive features. So a few months back, I switched to an entirely different telephone system for my law office “land lines”.

VOIP is the acronym for Voice over Internet Protocol, and I can't recommend it enough. It’s less expensive, highly flex-ible, easily movable and offers a much deeper set of calling features offered to businesses than the current crop of hard wired providers — Comcast and Verizon.

In contrast to conventional hard wired phone service, VOIP uses the Internet to make and receive calls. VOIP has been around for many years and has long since been available to individu-als through carriers such as Vonage. In recent years VOIP has developed into a highly credible alternative telephone

communications service which is in use by many of the largest Fortune 100 com-panies. Even more recently, a number of specialized car-riers have offered systems tailored and priced for small and mid-sized business.

With my new VOIP phone setup, I can make and re-ceive business calls and faxes both in the office and on the road, at home, and overseas. No matter when my clients call my business number, I can easily take the call (after screening by my new, live, 24/7 receptionist) from any-where. The reverse is also in place, as now I can easily call out from anywhere on my smartphone, new VOIP office phones or from home and my clients see my office number and HooverLaw LLC on their caller ID. It's awesome!

MENTAL HEALTH COURT:The first “graduation” is being scheduled for April 5, 2018, ten-tatively at 1:30 p.m., to recognize the significant improvements a number of participants have been able to achieve. Everyone is welcome.

BOND REVIEWS:After the original bond hear-ing is held, second or subse-quent hearings will be per-mitted to address changes of conditions, additional infor-mation or the like, and also be-cause of bond reviews filed by defense Counsel. In general, these hearings will be held in Courtroom 513 after the regu-lar bond reviews. Such hear-ings may not be in front of the original judge who heard the initial review. PTSU vio-lations will also be in 513, but generally only on Tuesdays and Thursdays, and in a differ-ent courtroom only if another judge becomes available.

JUDICIAL CONFERENCE:District Court will be on a greatly reduced schedule be-tween May 23 and May 25, 2018, while the Maryland Judi-cial Conference is held. Bond hearings, domestic violence orders and peace orders will still be heard, but largely with “Visiting Judges” handling the dockets.

There are few people in Amer-ica today who have not experi-enced the challenges of addic-tion either individually, through their families or among their friends. It is no secret the opioid epidemic has reached unprec-edented levels but drug addic-tion and treatment for drug addiction has been a problem in our society for decades.

Last year, the  New York Times  highlighted the chal-lenges addiction presents to the legal profession, citing studies that indicated one in three practicing lawyers are “problem drinkers,” defined as individuals who engage in “haz-ardous, harmful and potential-ly alcohol-dependent drinking.”

The Bar Association of Mont-gomery County has not shied away from this important is-sue facing our profession. Its Lawyer Assistance Committee is a confidential group that tries  help those  experiencing

any mental health or substance use disorder. On March 7, the committee is hosting Brian Cuban, a lawyer and broth-er of  Dallas Mavericks owner Mark Cuban,  who will speak about his book, “The Addicted Lawyer: Tales of The Bar, Booze, Blow and Redemption.” Cuban has been a vocal advocate of en-suring lawyers have resources to cope with the serious stress-es that come with the job.

Addiction  is a serious problem in the legal community — not merely the tendency to use alcohol and drugs to offset stresses but also the pressure to sideline self-care in favor of meeting deadlines and in-tense workloads. There are no clear answers to this problem but we will not find solutions without open discussions. Cu-ban recommends firms and bar associations do exactly what this event will do — highlight resources in the community

for lawyers who fear they are suffering from addiction and make sure they are aware that there are paths to recovery.

Alisha Jacobsen, an attorney and a recent member of the Lawyer Assistance Committee, heard Cuban on the Maryland State Bar Association’s website. Ja-cobsen shared the link with the committee, which then invited Cuban to Montgomery County.

“Brian’s book,  The Addicted Lawyer, is an honest portray-al of his and others’ struggles with drugs, alcohol and eating disorders, but he also provides various sources for  recovery,” Jacobsen said.

Jacobsen added she has expe-rienced the ripple effects of ad-diction, growing up with fam-ily members and friends who suffered from alcoholism   She hopes the event will shed light on potential routes to recovery because, as she explained, “Fortu-

nately, with some, I saw the pos-itive effects of recovery as well.”

What can you do to help? Talking to your firms about sponsoring events like this one is a place to start (the Lawyer Assistance Committee is still looking for sponsors of this event). There are also countless nonprofits and organizations throughout the state that serve as resources for people facing addiction.

“An Evening with Brian Cu-ban” will take place March 7 at 5:30 p.m. in Courtroom 3E of the Montgomery County Circuit Court. Cuban will be signing books at the event fol-lowing his presentation. PRO BONO PROGRAMBy Debbie Craven, Program CoordinatorPlease consider volunteering!  It truly is a team effort and our volunteers are a critical part of that team. Through the Mont-gomery County Bar Founda-tion, the Pro Bono Program provides free legal services to eligible low-income residents of Montgomery County. In the first 6 months of FY18, the Program has helped, on vari-ous levels, almost 1300 Mont-gomery County residents. I am asking you to think about volunteering for our program. Volunteering can be as simple as showing up to one of our evening walk-in clinics located throughout the county; accept-ing a simple divorce case or a more complex contested cus-tody case.  Among other legal issues are debt collection, bank-ruptcy, limited employment, limited immigration, wills and power of attorney.

Sadly, our Program is begin-ning to “burn out” our dedicat-ed panel of volunteer attorneys

that time and time again are committed to supporting our mission: “equal access to jus-tice”. The success of our Pro-gram heavily relies on our vol-unteers. You bring your talents, experience, and insight into the life of our community res-idents. Only you have the abili-ty to make a difference.  

There are two ways for coun-ty residents to receive FREE LEGAL SERVICES in civil cas-es – at a legal advice clinic or through the client intake line for referral to an attorney vol-unteer for direct representa-tion. The legal advice clinics operate in five locations across the county and provide resi-dents the opportunity to walk in and meet with an attorney volunteer without scheduling an appointment. Eligible cli-ents present their legal prob-lems to an attorney and receive free immediate legal advice and/or referral to a non-profit or government social service agency that may be ready to lend a hand.

We have an extensive list of family law related cases pend-ing placement. We participate in the Judicare Project. Con-

tested custody and complex family law cases are referred at a reduced fee to experienced family law attorneys. Attorneys can seek reimbursement of $80 per hour with a cap of 20 hours per case. The Pro Bono Pro-gram requires that the attorney must accept a pro bono case for each case accepted under the Judicare Project. Our Family Law Training Session known as the Rita Rosenkrantz Fami-ly Law Training will be held on April 23 & 25, 2018. It is never too early to register! 13th year B'nai Mitzvah: The Simon E. Sobeloff Jewish Law Society was created to provide a social vehicle to network, en-courage charity, and build a camaraderie among attorneys while celebrating their Jewish heritage and Jewish values in the law. The Society serves as a forum for advocating and educating on those matters of mutual interest to Jewish At-torneys.  In celebration of its 13th birthday (B'nai Mitzvah), the Society elected to spon-sor a project where it could fulfill a need that would ben-efit the Jewish Community.  The project that the Society elected to pursue was to pro-vide residents of the Charles E. Smith Life Communities,

Revitz House, with Advance Directive, HIPAA Release, and Last Will and Testament for no cost or fees.  On the evening of January 15, 2018, eleven mem-bers of the Sobeloff Society met with approximately 60 residents to discuss how they could take advantage of the B'nai Mitz-vah program.  Residents were treated to a Power Point pre-sentation on why they should plan in advance for life altering events while enjoying the many desserts catered by the Sobeloff Society.  As of this writing, mem-bers of the B'nai Mitzvah project are busy preparing documents for everyone and anyone who returned an Estate Planning Workbook.  A document signing party is scheduled to occur in
