I. TE.NDER DOCUMENT

1. SCOPE OF WORK

1.1 This tender constitutes 'supply, installation, testing and commissioning of PublicAddress System under Buy Back Offer at the Conference Hall in the Mlo AYUSH,AYUSH Bhawan, 'B' Block, GPO Complex, INA, New DeJhi -110023.

1.2 To carry out pre-installation activities related to Supply, Installation, Testing andCommissioning of Public Address System at the Conference Hall in the Ministry ofAYUSH, AYUSH Bhawan, 'B' Block, GPO Complex, INA, New Delhi -110023including end points.

1.3 To provide necessary training to the staff in the Ministry of AYUSH which will coverinstallation, implementation, administration, usage, trouble shooting, interpretationand other activities related to. supply, installation, testing and commissioning of PublicAddress System for the Conference Hall.

1.4 To maintain annually Public Address System for the Conference Hall, if asked for thesame, for 2 years without any charges. Further, to also quote Annual MaintenanceContract CAMC) charges after 2 years of installation and commissioning upto a periodof 5 years.

1.5 The existing BOSCH -rnake Public Address System is required to be takeri by theselected bidder under the Buy Back Offer.

1.6 Tenderers are expected to offer solutions covering all the functionability as mentionedin this Tender Document. Incomplete responses will not be considered and nocorrespondence in this regard will be entertained.

2. TERMS & CONDITIONS

2.1 The firms are required to submit the technical and financial bid separately i.e. either waxor with adhesive· cello tape on both ends. The quotations in Sealed Cover-I containing "TechnicalBid and Sealed Cover-Il containing "Financial Bid" should be placed in another sealed coversuper-scribed as "Tender for Supply, Installation & Commissioning of Public AddressSystem under Buy Back offer at the Conference Hall of the Ministry of AYUSH". Unsignedand unstamped bids in unsealed / stapled envelopes shall be summarily rejected.

2.2 The sealed quotations, complete in all respect should reach this Ministry on orbefore 09.11.2016 by 12 Noon and dropped in the Tender Box kept at the Ground Floor ofAYUSH Bhawan, B- Block, GPO Complex, INA, New Delhi - 110023. The quotations willbe opened at 3.00 p.m. on the same day.

2.3 The tenderer should provide Doc-IV on the letter head of its own firm as a token ofhaving read and understood the terms and conditions contained therein and submit the samealong with the bid. No photocopies of this tender document would be accepted. Wherever theprices are to be quoted this should be written in figures and words as well. Overwriting orambiguity in financial bid shall not be accepted. The quoted prices should also include theimpact of all overheads.

2.4 Conditional bids shall not be considered and will be rejected summarily.

2.5 All entries in the tender form should be legible and filled clearly. If the space providedfor furnishing information is insufficient, a separate sheet duly signed by the authorizedsignatory may be used. No correction either in the Technical Bids or Financial Bids ispermitted. In no case should there be any..change in the format of the Financial Bid. Tenderersare cautioned that 'any disclosure of financial bid at the technical bid stage will make thequotation summarily rejected.

2.6 The financial bid of only those tenderers will be opened who qualify in the technical bid.The schedule date /time for opening of financial bids would be indicated later.

2.7 The bidding firm has to give a Self certificate to the effect that it has not been blacklisted byany Central Ministry/Department,PSUs or Banks etc as per DOC-VI. If it is subsequentlyestablished or found that the bidding firm has given any false information or facts or hassuppressed facts or manipulated the documents, etc. the Earnest Money Deposit or theperformance security deposit, as the case may be, will be forfeited and no excuse what so everwill be entertained therefore.

,2.8 No bidding fin\J. will be allowed to withdraw its bids after technical bids have beenopened. If any firm inte~s to withdraw after opening of technical bids, its EMD will be forfeited.

'\2.9 LIABILITY OF lTHE TENDERER

2.9(a) The contractor shall be responsible to obtain all the necessary approvals from therespective statutory authorities before during and after completion of work as and when'required. The Ministry of AYUSH shall not assist the contractor for liaising to obtainthe approval from the concerned authorities.

2.9(b) From the commencement to the completion of the works, contractor shall take fullresponsibility for the care of works thereof and of all temporary works and in caseany damage, loss or injury happens to the works or any part thereof or to anytemporary works due to lack of precaution or negligence on the part of contractor, it shallbe made good as its own cost.

2.9(c) The Ministry of AYUSH and its officials shall not be responsible for any loss and damage.However, without limiting its obligations and responsibilities as above, contractor shallinsure directly in the joint names of M/o AYUSH and Contractor against:-

(i) All loss or damage from whatever cause during the period of execution of work

(ii) All loss and damage arising from a cause occurring prior to the commencement ofthe period of maintenance and

(iii) For any loss or damage caused by contractor in the course of any operation carriedout for the purpose of complying with its obligation of maintenance as follows:

• The work and the temporary work to the full yalues of such works executed fromtime to time.

• The materials, constructional items and other things brought on to the site by theMinistry of AYUSH Contractor to the full value of such materials, constructionalitems and other things.

• Sufficient insurance cover for the workers and personnel at site provided that suchinsurance shall be effected with any Nationalized Insurance company andcontractor shall, whenever required produce to the Ministry of AYUSH policy onthe policies of insurance and the receipts for payments of the current premiumthereof.

2.10 pAYMENTS-

The General Financial Rules of the Government of India preclude any advance payments andpayments by letter of credit. Such provisions in a proposal will be prejudicial to its evaluation bythe Ministry of AYUSH. The normal terms of payments are 45 days after satisfactory completionof work. The bill/Invoice is to be submitted in favour of Under Secretary, (Estt ), Ministry ofAYUSH, AYUSH BHAWAN, B- Block, GPO Complex, INA New Delhi-1 10023 .The Paymentwill be released through ECS system. The payments will be made only after evaluation by atechnical committee and acceptance thereof by the Ministry of AYUSH.

2.11 EARNfST MONEY DEPOSIT -r.

The Earnest Money o~\ Rs.75,000/- (Rupees Seventy Five Thousand Only) in the form ofDemand Draft drawn in,),favour of "Pay and Accounts Officer (Sectt.), Ministry of Health andFamily Welfare, New Delhi" (without which the quotations will not be considered). Noexemption whatsoever for payment of EMD shall be accorded except in case of organizations

specifically so exempted. The Earnest Money of successful bidder will be returned only after'- furnishing of the performance security. The Earnest Money of the unsuccessful bidder whose

~ technical bid has not been found suitable will be returned. .

The said Earnest Money Deposit will not bear any interest and the earnest money of unsuccessfultenderer would be returned without any interest after finalization of the contract.

2.l2 PERFORMANCE SECURITY DEPOSIT -

The successful bidder will have to deposit a sum of Rs.l,50,0001- (Rupees One Lakh fiftythousand only) at the time of signing the contract as performance security in demand draft/termdeposit or provide a Bank Guarantee for the said amount from a Scheduled bank, pledged infavour of "Pay and Accounts Officer(Sectt), Ministry of Health an d Family Welfare, New Delhi"for the due fulfillment of the contractual obligations which is refundable without any interest ontermination of the contract after deducting any penalty 1 any liability of any kind imposed by theMinistry of AYUSH on account of unsatisfactory services. Performance security/EMD shall beforfeited and credited to the Government account in the event of breach of contractual obligationby the applicant.

2.13 JURISDICTION

The disputes, if any, arising between the successful applicant and Mlo AYUSH shall be settledamicably through mutual discussions, or shall be referred to the sole arbitrator of a personappointed by the Ministry of AYUSH.

2.l4 PRE-BID MEETING

The bidders must assess the requirement for Public Address System to be installed in the Ministryof AYUSH in the Pre-Bid meeting scheduled to be held on 27.10.2016 at 03.00 p.m. andfurnish their Financial Bids accordingly.

2.l5 OPENING OF TECHNICAL BID

The technical Bid shall be opened on 09.11.2016 at 03.00 p.m. in the presence of tenderers ortheir duly authorized representatives, whowish to be present. The authorized representative willbe required to sign the letter of authorization for attending bid opening (Doc-V).

3. ELIGIBILITY CRITERIA

The bidders who do not furnish the details/ documents as under will not be considered:(i) The make ofthe Public Address System is to be BOSCH CCS lOOODDigital Discussion

System.

(ii) Earnest Money Deposit (EMD) of Rs.75,000/- (Rupees Seventy Five Thousand Only) inthe form of Account Payee Demand Draft, Fixed Depo,sit Receipt, Banker's Cheque or bankGuarantee from any of the Commercial Banks in an acceptable form, drawn in favour of"Pay and Accounts Officer(Sectt.), Ministry of Health and Family Welfare, New Delhi".

(iii) Specific authorization from OEM authorizing the tenderer to quote for this tender alongwith proof of being a regular dealership.

(iv) Technical bid as per Doc-II filled and duly signed along with all required documents;

(v) Financial bid as per Doc-III filled and duly signed;

(vi) Minimum annual turnover of Rs. 25 Lakhs per annum during each of the last 3years,ending 31st March 2016. CA Certificate, Balance Sheet, Profit & Loss Account in supportof turnover (along with income Tax Returns of the relevant years) must be provided withthe Technical Bid.

(vii) Successfully executed Supply, Installation and Commissioning of PA Systems in theGovernment/Semi Govt./ Autonomous Bodies or Non-Governmental entities etc. duringthe last five years as per details mentioned below:

(a) Three work order each costing not less than the amount equal to 40% of theestimated cost of this tender, or

(b) Two work order each costing not less than the amount equal to 50% of theestimated cost of this tender, or

(c) One work order costing not less than the amount equal to 80% of the estimatedcost of this tender.

In case the bidder has executed the Work Order(s) under a private sector, the value of thework shall be reflected in the TDS of the corresponding year (s) and the firm shaI'1furnishrequisite Proof/TDS certificate for the same.

(viii) Copies of following Certificates along with the Technical Bid:(a) VAT Registration No.;(b) Service Tax Registration No.; ,(c) ~:Sales Ta~; and .(d) JANNo.,
