Flood Insurance Alert:Major Changes Began April 1

Changes in regulations for the National Flood Insurance Program (NFIP) began on April 1st. The regs continue the implementation of the Biggert-Waters Flood Insurance Reform Act of 2012 and the Homeowner Flood Insurance Affordability Act of 2014.

The point — to make the NFIP more actuarially sound via premiums in line with true risk.

So renewals from now on will require premium increases, other fees and Reserve Fund Assessment changes. There are lots of other changes:

Write-your-own (WYO) policy changes will •  now be sent out 90 days in advance and not 45.

Premium rates will jump an average of •  4% to 6% and when factoring in fees, surcharges and assessments, the average will be 9%.

Non-residential business properties could •  jump as much as 25%.

PIA National sent a bulletin out on changed to the National Flood Insurance Program (NFIP). It said the Federal Emergency Management Agency (FEMA) has released the long-delayed NFIP Manual for the April 1, 2016 changes.

At the same time, it has issued a separate bulletin with critical information for PIA agencies that write flood. It is Bulletin w-16021 — Clear Communication of Risk: When Congress passed the Homeowner Flood Insurance Affordability Act of 2014 (HFIAA), its Section 28 requires that FEMA advise every policyholder of what their flood risk is. This is referred to as the Clear Communication of Risk mandate.

After much discussion, FEMA decided it will outreach to insureds in two phases. This bulletin [w-16021] outlines what business will be placed in which phase, its timing, and includes all instructions and notices to insurers.

Here’s what PIA National says it is important for you to know:

ONE This is a material change from how the NFIP has operated. Until GW14, NFIP has been a “once-&-done program”, i.e., write it correctly as it comes new into the NFIP, and then it just renews.

Originally, agents and WYOs were the parties charged with determining the flood zone and rating particulars. However, the law was changed to make the lender the party that determines flood zone (irrespective of what an agent or WYO may believe). The Flood Insurance Producers National Committee (FIPNC), the Insurance Institute for Business & Home Safety (IBHS) and Write-Your-Own carriers (WYOs) have made this and many other factors known to FEMA, as to why a policy may need to be corrected for reasons that are not under the control of agency or the WYO.

TWOHence, agencies must appreciate that while the name of this outreach is about communications, the underlying purpose is the review, update and if necessary re-underwriting of the NFIP book. Congress and FEMA want to be sure that every piece of business written in NFIP is written correctly.

THREETherefore, it is important that agencies review this entire bulletin. Members need to receive guidance from their WYO, as to the timing and for a copy of the final notice sent to policyholders.

FOURReview your book of NFIP business. Suggested practice guidance advises that agencies may wish to identify what portions of their current NFIP book will be affected by the 1st and then 2nd phases. This will allow an agency to better prepare for and anticipate who and what nature of calls they may receive; how to handle these per advance consultation with your WYO; and also spot early any particularly complex/special treatment NFIP insureds you may have. For these “special” accounts, the agency may wish to organize the documentation in and for that file, and determine if, and if so when might the agency discuss this with their WYO to assure that everything and everyone are aligned.

What It Means to Agencies: As PIA agencies know, having the right carrier-partners is a crucial part of making it work well for agency insurance customers and agency. It is no different when writing NFIP business. A.M. Best took a survey of insurance professionals and asked which presidential candidate would be best for insurance. Donald Trump won out. And won easily.

In the statement accompanying the A.M. Best Winter 2015/2016 Insurance Industry Survey, the ratings firm said, “On the political front, insurers appear very aware of the ramifications of the 2016 presidential election. Here, the landscape for the insurance industry could look very different, depending on which candidate becomes president.”

In conclusion, A.M Best said, “Overall, there appears to be a favorable perception of the Republican Party’s stated intent to eliminate the Affordable Care Act in its current form. Bernie Sanders’ proposal for Universal Health Care, as well as Hillary Clinton’s proposed policies on prescription drugs, were likely reasons for the negative responses.” n

The National Safety Council (NSC) is concerned. So are the Obama administration and Congress. Doctors are over-prescribing opioids and most prescriptions run longer than the Centers for Disease Control and Prevention (CDC) recommended three-day period. Any longer than three days — the CDC said — and the drugs cause brain damage.

The survey was done of 201 family or internal medicine physicians who spend at least 70% of their time treating patients in an office setting.

How bad is it?

The NSC says 99% of doctors fall into this •  category.

And of that 99% a whopping 23% •  prescribe them for at least a month.

Here’s what else theNSC found:

74% of doctors overestimate the •  effectiveness of opioids.

They incorrectly believe morphine and •  oxycodone are the most effective ways to treat pain.

But over-the-counter pain relievers like •  ibuprofen and acetaminophen are actually the most effective.

Here’s more: 99% of doctors say they have seen doctor • 

shopping patients wanting opioids. That same number have seen people who • 

are abusing opioids.Just 38% of those doctors recommended • 

those patients seek addiction treatment.Just 5% have treated that abuse • 

themselves.

It gets worse: 71% of doctors prescribe opioids for • 

chronic back pain.55% prescribe it for dental pain. • It is not appropriate for either case.•

AIG CEO Peter Hancock missed his profit goals in 2015. As a result, Hancock and other AIG executives are losing incentive pay. For Hancock it’s 29% or about $1 million. For his non-equity incentive plan for 2015 Hancock will pick up $2.5 million. In 2014 that figure was $3.5 million.

In a regulatory statement on the pay cut, AIG said, “Mr. Hancock and our other executives received an earned award equal to 78 percent of their target amount. Payment of 50 percent of this amount is deferred until 2017.”

Meanwhile, AIG continues to move forward with its plan to sell United Guaranty Corp. The initial public offering has been filed for $100 million. That is a placeholder to calculate fees but it will likely change.

JP Morgan Chase and Morgan Stanley are underwriting the deal.

In 2015 United Guaranty had a net income of $359.8 million. That was down 8.6% from 2014. Revenue fell 11% to $922.6 million. n

AIG Pay Cuts for Missing Profit Goals

67% of the surveyed doctors base the •  prescription on patient expectations and not what is best for them.

50% of patients are more likely to visit •  their doctor again if opioid alternatives are prescribed.

84% screen for prior opioid abuses but •  just 32% screen for a family history of addition.

Dr. Donald Teater is a medical advisor for the National Safety Council. He said, “Opioids do not kill pain; they kill people. Doctors are well-intentioned and want to help their patients, but these findings are further proof that we need more education and training if we want to treat pain most effectively.”

How bad is the problem? So bad that drug overdose has overtaken auto crash deaths as the leading cause of preventable death for American adults.

The Obama administration is going to ramp up efforts to battle opioid addiction. The Department of Health and Human Services (HHS) has finalized a policy that gives the 23 million people receiving health insurance via Medicaid the same mental health and drug addiction benefits as those with private health plans.

The administration will also release $120 million in grants to battle opioid addiction and $93 million of that will go to community health centers.

Congress is getting into the act, too. A bipartisan bill passed the Senate that creates a national task force to study and fight such addiction. It will also increase the availability of naloxone, a drug that treats opioid overdose. n

The National Association of Insurance Commissioners (NAIC) says insurance has a lot to learn about cyber attacks and their relationship to insurance. In 2015 personal information data (PII), financial records and medical histories were routinely grabbed by hackers.

How many were impacted? About 112 million. Or so says the Office of Civil Rights which is an agency housed in the Department of Health and Human Services. The hacking of Anthem in February and Premera Blue Cross in March account for 90 million of the losses.

Government has its fair share of hacks, too. But you know that already. What you may not know is the ObamaCare federal website HealthCare.gov has seen 316 cybersecurity incidents since it began functioning. And the Government Accountability Office (GAO) says the website continues to be vulnerable,.

Taken from the website are names, birth dates, Social Security numbers, addresses, financial info and other personal information. Of the over 300 incidents, 41 involved information that was not properly secured.

The state exchanges also are at risk. The NAIC Cybersecurity Task Force has introduced a new Data Security Model Law for health and other insurers that puts standards in place for data security and breach responses and it outlines the responsibility of regulators when a breach occurs.

“Because insurance is a data-driven industry, regulators must understand what data is being collected and for what purpose. Today, regulators and companies have a need for data beyond what has been traditionally collected.

But what regulators need is greater insight, not just more data,” the NAIC said.

What this doesn’t do is prevent breaches. BakerHostetler’s 2016 Data Security Incident Response Report outlines just what happened in 2015 and how:

Phishing, hacking and malware accounted •  for 31%

24% came from employee mistakes• 

One of the new favorites of cyber criminals is ransomware. It gets into your computer and freezes it up. To get access to your data you must pay a ransom. Most often it is several hundred dollars.

The situation is growing so perilous that the FBI has asked businesses and software security experts to assist and it sent out an alert. Anyone experiencing a ransomware attack is asked to report it to the FBI so it can be investigated.

Hardest hit are healthcare firms and law enforcement. n

America’s Health Insurance Plans (AHIP) told Morning Consult that health insurance rates are going to rise in the coming months. Not only that, in many cases those rate hikes will be huge.

The association’s CEO — and former Centers for Medicare and Medicaid Services head — Marilyn Tavenner said market shifts and the continuing rise in the cost of health care will drive the increases. “I’ve been asked, what are the premiums going to look like? I don’t know because it also varies by state, market, even within markets. But I think the overall trend is going to be higher than we saw previous years. That’s my big prediction.”

How bad is it? Tavenner didn’t say but a report in thefiscaltimes.com said some states saw a 76% hike in deductibles in 2016. Those increases could continue next year. And she pointed out the factors that will lead to those jumps:

The continuing rise of medical costs• Prescription drug prices are rising a lot• Market forces and Affordable Care Act • 

(ACA) limitations are causing insurers to raise their rates

Risk mitigation programs from the •  ACA make it harder for insurers to pay for inadequate risk coverage

AHIP’s Clare Krusing said health insurers are aware of these and will keep them in mind when setting rates next year. “Plans are just beginning to file their rates, and it’s a long process with state and federal regulators, until those are approved. Certainly plans are going to evaluate market conditions and regulatory approvals, and that will all impact their participation overall [in the ACA].” n

Pedestrian Fatalities on the Rise

That’s the biggest increase ever recorded.The report quotes numbers and statistics and all and finally gets to the reason for the alarming jump. And it is alarming says one of the report’s authors Richard Retting of Sam Schwartz Consulting. “Pedestrian safety is clearly a growing problem across the country. It

is important to understand the data underlying these crashes so states and localities can apply the right mix of engineering, education and enforcement to counteract this troubling trend,” Retting said.

26 states saw pedestrian fatalities rise• 21 saw them fall• 3 stayed the same• 

The report breaks it down even more:

In 2015 there were 2,368 pedestrian •  fatalities around the country

In 2014 we saw 2,232• The percentage of pedestrian deaths in • 

2015 is 15%Pedestrians accounted for 14% of the • 

traffic deaths in 2013That’s up from 11% in 2004• 

As a comparison, bicycle deaths rose from 1.7% in 2004 to 2.2% in 2013.

So what’s causing the staggering increase in pedestrian deaths?The report finally gets to the point and says it could be the growing use of cell phones with walkers and drivers. A lot of people these days are walking for economic reasons and because they’re concerned about the environment as well as walking for their good health.

And a lot is a lot! More than four million of us — the Census Bureau notes — are walking to work and the number biking to work is 860,000.

Pedestrian fatalities happen more in states with larger urban centers than those without. The PIA Western Alliance state of California is one of them. Others are New York, Florida and Texas. These states account for 42% of all of the pedestrian fatalities registered.

When you start accounting for percentages of population the states with the most fatalities include the PIA Western Alliance states of New Mexico and Arizona. n

The delegation said they met with Senator Deb Fischer and Senator Ben Sasse. On the House side they were only able to meet with staff because the House was not in session. In session or not, PIA NE IA President Mike Bowman said attending is one of the most valuable things you can do for the independent insurance agent and the insurance industry as a whole.

“We didn’t just send an email, we actually flew all the way there, visited each office and dropped off the PIA info and our business cards. I think we make enough of an impact that the staffers will read through our info and find that it will help them assist the Senators in making decisions when it comes to voting time,” he said. “PIA is an aggressive, activist organization that is never afraid to speak up and speak out on behalf of our members and clients”.

Mark Suhr has been attending the annual event for over ten years. He said, “With the congressmen out on a break, the congressional offices were very relaxed and the meetings seemed much more low key with the aides. It was great meeting with Sen. Deb Fischer and Sen. Ben Sasse. They were very receptive to our advocacy efforts on our issues.”
