Why Is It Important To Read Food Labels? • Manufacturers can change their ingredients and nutrition at any time • Wording on the front of a box or container of food can be deceiving compared to the ingredient

list • Important serving size information is needed from the nutrition facts on labels for calculating

sugar in cereal and yogurt Enriched Grain vs. Whole Grain

• All grains served on the CACFP must be enriched or whole grains • At least one grain served per day must meet whole grain-rich requirements and be recorded as

such on your menus • Utilize your “Identifying Whole Grains” handout • All of the cracker examples below state something about “whole grain” or “whole wheat” on the

front of their packages, but when you view their ingredient lists they begin with an enriched grain

Calculating Sugar In Cereals & Yogurt • Always use the serving size information from the label, NOT from the CACFP serving size

Recordkeeping Requirements • All records must be kept up-to-date, which means recorded by midnight each night • Records must be kept for 3 years and 3 months for CACFP purposes

o The most recent year must be kept on site, prior years may be kept of site if accessible within 24 hours

o You may need to keep records longer for tax purposes, please consult your tax preparer for guidance on how long you should keep records

• Helpers, co-licensed providers, etc. must know where your records are located to show your monitor during home visits

• Enrollments must be filled out for all children in care when they begin at your daycare, and must be renewed annually

o Parents may choose to decline their child participating in the CACFP, but providers cannot require parents to decline for any reason

o If a renewal enrollment is not completed on time, it results in a gap in active enrollments and you may lose reimbursement for any children that have gaps in enrollments

Meal Counts

• Attendance and meal counts must be recorded daily • Meal codes must be used to record meals and snacks per child • Infants must still be recorded on the meal count even though they have a separate menu • Meal counts cannot be recorded in advance • If you must keep track on paper that is not CCNI forms, your records must look like the

Menus • Must be recorded by midnight daily • Infants have a separate menu and move to the regular menu on their first birthday • One whole grain-rich item must be served and recorded on your menu each day • Juice can only be served once per day, and no juice for infants • Lists are no longer allowed on paper claims for items like cereal, crackers, etc.

Claims Submission

• Claims are submitted once per month after the last meal or snack is served and recorded for that month

• Paper claimers should ensure they have enough postage on their envelopes (large envelopes take a minimum of 4 regular stamps)

• All documentation for the claim should be submitted before or with the claim for that month including, but not limited to: enrollments, variances, formula and/or special diet statements, notes such as “school out” notes for school agers claimed during the school year

• There is a 60-day deadline in which you have to submit a claim after the month ends o CCNI’s policy to guarantee payment may move that date up from the 60-day deadline in

order to allow us time to process your claim once it is received Claims Review Procedures

• CCNI may contact you while processing your claim for missing items or clarification on something on your claim – please respond to us as soon as you have time available to do so

• CCNI will not hold your claim and/or reimbursement without your permission, so if you do not respond by a deadline given for missing documents, you may lose reimbursement and not be able to get it back

• Please open and read any reduction notices you receive in your reimbursement mailing and contact us immediately if you have questions or wish to dispute a reduction

o Adjustments involving reimbursement to you must be completed within the 60-day deadline for that month’s claims

Reimbursement System

• You can find the next month’s reimbursement schedule in your newsletter each month • CCNI almost always has a noon on Thursday deadline for claims submission for each week

o Exceptions for holidays and CCNI staff trainings Civil Rights

• Providers participating on the CACFP cannot discriminate against anyone for their race, color, national origin, sex, disability, or age

Civil Rights Training for Family Day Care Home Providers, Monitors and Sponsoring Organizations All providers and sponsor organization staff who interact with Child and Adult Care Food Program (CACFP) participants must complete annual civil rights training. This program fact sheet addresses potential civil rights concerns and how to ensure that program benefits are made available to all eligible participants.

Discrimination is any different treatment, which makes a distinction of one person or group from others, either intentionally or by neglect, based on the federal protected classes: race, color, national origin, sex, disability, and age.

Key Points

1. Ask parents to complete racial/ethnic data for each enrolled child. If parent refuses, provider or monitor is to record for the parent, based on their perception.

2. All potentially eligible and current participants are to be informed of the benefits of CACFP and children enrolled in care must be allowed equal opportunities to participate.

3. All participants must be treated in the same manner (including seating arrangements, meal times and service, etc.).

4. Denial of a meal or meals as a disciplinary action against a participant is prohibited.

5. Overt identification or sharing of a child’s eligibility status for Tier 1 meals is prohibited.

6. Reasonable steps must be taken to ensure that persons with limited English proficiency are able to access the CACFP.

7. If interpreters are needed, children should not be used as interpreters. Volunteer interpreters should be trained on confidentiality.

8. Reasonable accommodations must be made for children with disabilities to ensure their equal

access to participate in CACFP. For example, alternative meals or meal components must be provided to children who have a special diet statement for a medical necessity.

9. Complaint procedures: Complaints may be filed based on race, color, national origin, age, sex or disability; Never discourage individuals from filing complaints or voicing allegations of discrimination; To file a complaint, refer to the USDA Nondiscrimination and Complaint Procedure as outlined on the following page.

10. State agency will assess if sponsoring organization has implemented non-discrimination and civil rights requirements.

11. Resolution of noncompliance: Stop inappropriate actions; Failure/refusal can result in loss of federal assistance.

Consult with your Sponsor Organization regarding any questions you may have.

1. Be patient; 2. Be polite; 3. Avoid sarcasm; 4. Don’t be afraid to apologize; 5. Treat others the way they want to be treated,

or at least be aware of what that is.

If a conflict occurs:

1. Remain calm; 2. Explain the situation; 3. Get help, especially if you feel threatened; 4. Use alternative dispute resolution techniques,

such as mediation, when necessary.

Using Respectful Language

It is also important to convey equal opportunity in messaging and interactions with participants. This includes using inclusive, respectful and culturally sensitive language. For example, it is more respectful to put the person first. Instead of saying “a disabled person”, use the phrase “a person with a disability”. When in doubt, just ask someone who is more familiar with the preferred terminology.

Nondiscrimination statement:

In accordance with federal civil rights law and U.S. Department of Agriculture (USDA) civil rights regulations and policies, the USDA, its agencies, offices, and employees, and institutions participating in or administering USDA programs are prohibited from discriminating based on race, color, national origin, sex, disability, age, or reprisal or retaliation for prior civil rights activity in any program or activity conducted or funded by USDA.

Persons with disabilities who require alternative means of communication for program information (e.g., braille, large print, audiotape, American Sign Language, etc.), should contact the agency (state or local) where they applied for benefits. Individuals who are deaf, hard of hearing or have speech disabilities may contact USDA through the Federal Relay Service at 800-877-8339. Additionally, program information may be made available in languages other than English.

To file a program complaint of discrimination, you have two options: 1. Complete the USDA Program Discrimination Complaint Form, (AD-3027) found online at Filing a Program Discrimination Complaint as a USDA Customer, and at any USDA office; or 2. Write a letter addressed to USDA; provide in the letter all of the information requested in the form. To request a copy of the complaint form, call 866-632-9992. Submit your completed form or letter to USDA by one of the following methods:

Child Nutrition Labels and Product Formulation Requirements A Child Nutrition (CN) label or a Product Formulation Statement (PFS) provide meal pattern contribution

information for commercially prepared, combination food items. CN labels are available only for main dish

entrees that contribute to the meat/meat alternate component of the meal pattern. Some commercially

prepared, combination foods may not have a CN label. This is because the CN labeling is a voluntary program. If

a commercially prepared, combination food item does not have a CN label, contact the manufacturer for a PFS.

If a food item does not have a CN label or PFS, the food item will not be creditable in Child Nutrition Programs.

Read on to understand how this crediting information should appear on CN labels, how to keep documentation

of CN labeled food items, what is a CN label with a watermark and Product Formulation Statements as

required for Child Nutrition Programs of the U.S. Department of Agriculture (USDA).

The CN Label will always contain the:

• CN logo which is a distinct border.

• Meal pattern contribution

statement.

• Six-digit product identification

number.

• USDA authorization.

• Month and year of approval.

How to Document a CN Label:

There are three options for keeping documentation of CN labeled food items. CN Labels that are photographed

or photocopied must be visible and legible.

CN Label with a Watermark and Invoice

A CN label with a watermark includes the disclaimer “Copy Not for Documenting Federal Meal Requirements”

and may be printed from a manufacturer’s website or provided by the manufacturer during the bidding process.

This is acceptable documentation of crediting information only when an invoice is attached showing purchase of

the product.

Product Formulation Statement (PFS)

A Product Formulation Statement (PFS) provides crediting

information for processed products that do not have a CN

Label. A PFS always contains:

• Manufacturer’s letterhead.

• Name of product and product code number.

• Math calculations showing how the manufacturer

determined the meal pattern contribution.

• Crediting statement.

• Signed and dated by an official of the manufacturer.

To determine if a product has a PFS, contact the

manufacturer. The product packaging will contain the

telephone number or mailing address. Explain that you

need the child nutrition information for the commercially

prepared product. They may ask for the Universal Product

Code (UPC) number so have this information available as

well.
