The Watershed Institute has been identified as a qual-ified entity to provide certain on-call engineering servicesto the Kansas Department of Agriculture, Division ofConservation. Pursuant to its current ‘‘Agreement for On-Call Engineering Services’’ with The Watershed Institute,the Kansas Department of Agriculture, Division of Con-servation issued a notice of authorization to proceed fora ‘‘Review and Assessment’’ of existing streambank res-toration projects in the Cottonwood, Delaware and Neo-sho rivers. The authorization to proceed was issued onAugust 25, 2015, on a total bid price of $8,316.

South Central Kansas EconomicDevelopment District

Notice to Contractors and Vendors

The South Central Kansas Economic Development Dis-trict (SCKEDD) in Wichita administers the federallyfunded Kansas Weatherization Assistance Program in a13-county region in south central Kansas. SCKEDD is inthe process of contracting with the following:

• A vendor who can supply HVAC equipment, includ-ing wall, console and forced-air furnaces.

• Vendors who can supply cellulose insulation, ASH-RAE 62.2 ventilation systems and various weatheri-zation materials.

• A contractor that is a licensed electrician capable ofservice upgrades, wiring repair and replacements,panel replacements, adding dedicated electrical cir-cuits for furnaces and installing mechanical ventila-tion systems per ASHRAE 62.2 standards. Fan kitswill be provided by SCKEDD.

• A contractor that can provide licensed plumbingwork for supply line and waste line repair or replace-ment and water heater replacement.

• A roofing contractor that can provide full and partialresidential roof repairs and replacement.

• A general contractor that can perform weatherizationwork in the following counties with estimated num-ber of units in parenthesis: Barber (2), Chautauqua(1), Cowley (8), Elk (1), Harper (2), Kingman (3), Mc-Pherson (5), Pratt (1), Reno (10), Rice (3), Sedgwick(85), Stafford (1) and Sumner (3). Because SCKEDDemploys weatherization crews, only the work thatcan’t be performed in-house will be contracted out.

Weatherization work includes performing air sealing,repairing broken windows, adding weather-strips toexterior doors, installing plastic vapor barriers incrawl spaces, insulating foundation walls and floorsusing fiberglass batting material, installing densepack-blown cellulose insulation in exterior walls, in-stalling roof vents and insulating attics with blowncellulose. Mobile home weatherization work includesrepairing duct work systems and installing blown fi-berglass insulation into bellies, walls and roof cavi-ties. Work will be performed on single-family dwell-ings and mobile homes. All weatherizationcontractors will be responsible for complying withthe EPA’s Renovation Repair and Painting (RRP) reg-ulations as enforced by KDHE in Kansas. KDHE andKansas weatherization requires all licensed firms toemploy only certified renovators to perform weath-erization work.

Contractor requirements include, but are not limited to:• Capability to be licensed in all municipalities served

by SCKEDD weatherization• RRP renovation firms licensed with KDHE• All workers licensed as RRP renovators with KDHE• All workers have completed LSWP training provided

by the Department of Energy• Worker’s comp and general liability insuranceContracts will be for a one-year period through October

31, 2016, with an option to extend the contract for up tothree additional one-year periods at the discretion ofSCKEDD and the approval of the Kansas Housing Re-sources Corporation. A mandatory bidder’s conferencewill take place to answer all questions regarding the dis-tributed bid packets. If you are unable to attend in person,teleconference capabilities will be provided. The bidsheets provided will require contractors and vendors toprovide line-item prices by county for all items listed.

Contractors are required to provide references withtheir bid package as a high value will be placed on qualityof work. SCKEDD may choose any or all of these factorsto evaluate contractor bids: price, quality of references,timeliness in completing work, quality of completedwork, timeliness in billing, quality of billing, and anyother factor as specified in the bid package.

The facility is located at 21017Scott Road, Parsons, Kansas, and has EPA IdentificationNumber KSR000511964.

KDHE is providing notice of its intent to renew theRCRA hazardous waste management permit for the fa-cility. The proposed renewal permit will require Day &Zimmermann Kansas LLC to continue hazardous wasteoperations and corrective action at the facility.

In October 1985, the state of Kansas received final au-thorization from the U.S. Environmental ProtectionAgency to implement a hazardous waste managementprogram in lieu of the federal program, except for thoseportions covered by the 1984 Hazardous and Solid WasteAmendments (HSWA). In September 2013, authority forthe corrective action portion of the RCRA program wasdelegated to the state of Kansas.

The draft permit sets forth in a concise document all ofthe applicable requirements that KDHE will require thepermittee to comply with during the 10-year duration ofthe permit. The draft hazardous waste permit includesstandard permit conditions, general facility conditions,container storage requirements, thermal treatmentrequirements, air emission requirements for containers,corrective action requirements for groundwater and soil,and corrective action requirements for solid waste man-agement units (SWMUs) and areas of concern (AOCs).Section 6 addresses corrective action for all releases orfuture releases of hazardous waste or hazardous constit-uents from any SWMU or AOC at this facility. Section 6also includes general conditions, process steps, and a fa-cility submission summary for corrective action activities.

The draft permit is being considered for issuance underauthority of K.S.A. 65-3430 et seq. and K.A.R. 28-31-4through 28-31-279a, and Subtitle C of RCRA, as amendedby HSWA. Documents that support the permit conditionsspecified in the draft permit are part of the administrativerecord. Applicable regulations are found in 40 CFR Parts124, 260 through 264, 266, 268 and 270, as specified in thispermit. All citations found in the draft permit to federalregulations are for the sake of convenience. Some modi-fications to federal regulations by applicable state regu-lations are noted in this permit, but all modifications tofederal regulations by state regulations are incorporated.To the extent that state regulations exclude any sectionsof applicable federal regulations, those sections are not ineffect. In the instance of inconsistent language or discrep-ancies between conditions found in the permit, state reg-ulations or federal regulations, the language of the morestringent provision will govern; otherwise, state law gov-erns.

State hazardous waste laws require that the public begiven at least 45 days to review the administrative record

for the draft permit prior to KDHE taking a final action.The purpose of having a public comment period is to en-sure that interested parties have the opportunity to eval-uate the conditions specified in the draft permit and toprovide their input into the permit decision-making pro-cess. 7-23-14. Assessing documents submitted as evi-dence of United States citizenship. (a) In assessing doc-uments submitted as evidence of United States citizen-ship, each election officer shall consider the followingfactors: first name, middle name or initial, surname, dateof birth, place of birth, and sex.

(1) The first name and the middle name or initial, ifprovided, shall be consistent with the information pro-vided on the person’s application for voter registration.Hyphenated names shall be permitted if not inconsistentwith the information provided on the person’s applica-tion for voter registration.

(2) If the name on the document is inconsistent withthe applicant’s name as it appears on the application forvoter registration, the election officer shall perform thefollowing:

(A) Ask the applicant for a second, government-issueddocument confirming the voter’s current name;

(B) if the applicant is unable or unwilling to provide asecond, government-issued document, allow the appli-cant to sign an affidavit pursuant to K.S.A. 25-2309 andamendments thereto, stating the inconsistency related tothe applicant’s name and swearing under oath that, de-spite the inconsistency, the applicant is the individual re-flected in the document provided as evidence of citizen-ship; and

(C) if the applicant is either unable or unwilling to pro-vide a second, government-issued document and refusesto sign an affidavit, inform the applicant of the applicant’sright to appeal to the state election board, pursuant toK.S.A. 25-2309 and amendments thereto.

(3) The date of birth indicated on the document sub-mitted as evidence of United States citizenship shallmatch the date of birth provided on the application forvoter registration. If the dates of birth are inconsistent,the election officer shall inform the applicant of the ap-plicant’s right to appeal to the state election board, pur-suant to K.S.A. 25-2309 and amendments thereto.

(4) If the place of birth is indicated on the documentsubmitted as proof of United States citizenship, the placeof birth may be used to assess the applicant’s status as aUnited States citizen. If the document does not contain aplace of birth, this fact shall not result in an unsatisfactoryassessment.

(5) If the sex indicated on the document does not matchthe sex indicated on the application for the voter regis-tration, the election officer shall perform the following:

(A) Ask the applicant for a second, government-issueddocument confirming the voter’s sex;

(B) if the applicant is unable or unwilling to provide asecond, government-issued document, allow the appli-cant to sign an affidavit pursuant to K.S.A. 25-2309 andamendments thereto, stating the inconsistency related tothe applicant’s sex and swearing under oath that, despitethe inconsistency, the applicant is the individual reflectedin the document provided as evidence of citizenship; and

(6) If a document submitted as evidence of UnitedStates citizenship contains an expiration date and thisdate has passed when the document is submitted for pur-poses of voter registration, the document shall nonethe-less be considered in assessing qualifications to registerto vote.

(b) If an applicant for voter registration fails to submitevidence of United States citizenship before the deadlineto register to vote before an election, the applicant maysubmit a valid citizenship document by mail or personaldelivery to the county election office by the close of busi-ness on the day before the election or a valid citizenshipdocument by electronic means before midnight on theday before the election. ‘‘Electronic means’’ shall includefacsimile, electronic mail, and any other electronic meansapproved by the secretary of state. For each documentreceived in accordance with this subsection, the countyelection officer shall perform the following:

(1) Accept and assess the citizenship document;(2) add the applicant’s name to the voter registration

list as a registered voter; and(3) if practicable, include the registrant’s name in the

poll book for the upcoming election. If poll books havealready been printed, the county election officer shall, ifpracticable, communicate the registrant’s name to the ap-propriate polling place with instructions to allow the reg-istrant to vote a regular ballot. If the registrant’s name isnot communicated to the election board at the appropri-ate polling place by the county election officer before theopening of the polls on election day, the registrant shallbe allowed to cast a provisional ballot. If any applicant towhom this subsection applies fails to submit satisfactoryevidence of United States citizenship in accordance withthis subsection and the applicant casts a provisional bal-lot, the ballot shall not be counted.

(c) A registered voter who has previously provided suf-ficient evidence of United States citizenship with a voterregistration application in this state shall not be requiredto resubmit evidence of United States citizenship withany subsequent voter registration application. 7-23-15. Incomplete applications for voter regis-tration. (a) If the county election officer assessing an ap-plication for voter registration determines that the appli-cation does not contain the information required by law,including satisfactory evidence of United States citizen-ship, the county election officer shall designate the ap-plication as incomplete. Each county election office shallmaintain a list of incomplete applications for voter reg-istration.

(b) Any voter registration applicant whose voter reg-istration application has been designated as incompleteunder subsection (a) may complete the voter registrationapplication, without submitting a new voter registrationapplication, by providing the required information that

was not provided with the original voter registration ap-plication within 90 days after the voter registration ap-plication was received by the county election office.

(c) If a voter registration application was designated asincomplete under subsection (a) and the application is notcompleted by the applicant under subsection (b), thevoter registration application shall be deemed insufficientby the county election officer and the county election of-ficer shall designate the voter registration application ascanceled. Each voter registration applicant whose voterregistration application was deemed insufficient underthis subsection shall be required to submit a new voterregistration application in order to become registered tovote. Amendments to K.A.R. 81-1-1. Definition of terms.This regulation provides definitions for administrationand enforcement of the Kansas Uniform Securities Actand amendments are proposed to add or make technicalchanges to definitions of the following terms: ‘‘EFD,’’‘‘FINRA,’’ ‘‘IARD,’’ ‘‘NASD,’’ and ‘‘Nasdaq.’’ The pro-posed amendments to definitions do not result in any ec-onomic impacts on the agency, persons regulated by theagency, other government agencies or the public.

Amendments to K.A.R. 81-2-1. Forms and adoptionsby reference. This regulation specifies forms required orallowed for use by persons regulated by the agency andalso lists statutes, rules and other documents that areadopted by reference for use throughout the other regu-lations of the agency. Forms and adoptions by referenceprovide for uniformity, cooperation and coordination ofregulatory requirements among agencies and regulatoryorganizations with regard to policies and subjects for uni-formity as specified under K.S.A. 17-12a608. The pro-posed amendments delete forms no longer in use, addnew or updated forms that are specified in other regula-tions being amended, and update adoptions by referencedue to changes in statutes and rules of the SEC andFINRA. New subsection (e) is proposed as an amendmentto clarify that definitions within SEC statutes, SEC rulesand regulations, and FINRA rules adopted by referenceapply if the definitions are in conflict with definitions inKUSA and regulations under KUSA. A new subsection(f) is proposed to clarify that there is no intent within theregulations adopted by the commissioner to require theSEC, FINRA or other regulatory organizations to comply,administer or enforce the statutes, rules or policies undertheir jurisdiction that are adopted by reference in K.A.R.81-2-1, or to require the commissioner to act on behalf ofthe SEC, FINRA or other regulatory organizations. Noneof the proposed amendments result in any economic im-pacts on the agency, persons regulated by the agency,other government agencies or the public.

Amendments to K.A.R. 81-3-1. Registration proce-dures for broker-dealers and agents. The proposedamendments to this regulation provide technical updatesincluding: deletion of (a)(2), which duplicates a statutoryprovision; replacement of NASD with FINRA as definedin proposed K.A.R. 81-1-1; addition of registrationrequirements for broker-dealers that are not required tofile with the CRD system; replacement of financial state-ment and net capital disclosure requirements of broker-dealers with an adoption by reference to the FINRA andSEC requirements for annual reports with audited finan-cial statements; clarification of requirements for new bro-

ker-dealers not yet subject to the FINRA and SEC annualreport requirements; and other technical updates regard-ing filing requirements for agents of intrastate broker-dealers and renewals of registrations. None of the pro-posed amendments are expected to result in any materialor determinable economic impacts on the agency, personsregulated by the agency, other government agencies orthe public.

Amendments to K.A.R. 81-3-5. Sales of securities atfinancial institutions. This regulation pertains to broker-dealers that provide services on the premises of financialinstitutions where retail deposits are received, and spec-ifies various requirements intended to ensure that cus-tomers understand the distinction between the physicallocation and services of the financial institution and thelocation and services of the broker-dealer. The proposedamendments update the definition of ‘‘broker-dealerservices’’ within the regulation, and add a requirementfor broker-dealers on the premises of credit unions to dis-close to customers that securities purchased or sold inbroker-dealer transactions are not insured by the Na-tional Credit Union Share Insurance Fund (NCUSIF). Pre-viously, the regulation made reference only to FDIC in-surance, which pertains to retail deposits at banks. Noneof the proposed amendments to this regulation are ex-pected to result in any economic impacts on the agency,persons regulated by the agency, other government agen-cies or the public.

Amendments to K.A.R. 81-3-6. Dishonest or unethicalpractices of broker-dealers and agents. This regulationimplements K.S.A. 17-12a412(d), which prohibits uneth-ical practices of broker-dealers by specifying the conductor failures to comply with standards that constituteunethical practices. The proposed amendments to thisregulation update references to NASD conduct rules andFINRA rules in subsection (d). FINRA continues to ad-minister and enforce NASD conduct rules that have notbeen replaced or updated by FINRA rules since the con-solidation of NASD and the regulatory functions of theNew York Stock Exchange into FINRA as described indefinitions of FINRA and NASD in the proposed amend-ments to K.A.R. 81-1-1. The proposed amendments to thisregulation do not result in any economic impacts on theagency, persons regulated by the agency, other govern-ment agencies or the public.

Amendments to K.A.R. 81-3-7. Supervisory, financialreporting, recordkeeping, net capital, and operationalrequirements for broker-dealers. The proposed amend-ments to this regulation provide technical updates by ref-erence to terms defined in K.A.R. 81-1-1 and update SECnet capital rules adopted by reference in proposedamendments to K.A.R. 81-2-1. The updates are necessaryfor purposes of uniformity as provided for under K.S.A.17-12a608. The proposed amendments to this regulationdo not result in any economic impacts on the agency, per-sons regulated by the agency, other government agenciesor the public.

Amendments to K.A.R. 81-4-1. Registration of secu-rities. This regulation specifies filing and fee require-ments for applications to register securities by coordina-tion or qualification. The proposed amendments updatesubsection (b) with respect to Regulation A offerings by

inserting a reference to Tier 1 offerings as a result ofamendments to SEC rules under Regulation A that be-came effective on June 19, 2015. Regulation A now in-cludes Tier 1 and Tier 2 offerings with different param-eters and treatment under federal and state securitieslaws. Tier 1 offerings continue to be subject to registrationrequirements of state securities laws, but states are pre-empted from requiring registration of Tier 2 offerings.Anti-fraud provisions of state securities laws still applyto Tier 2 offerings. Although the federal preemption ofregistration requirements of KUSA and K.A.R. 81-4-1 forTier 2 offerings could possibly result in fiscal effects onthe agency and persons conducting Tier 2 offerings, theimpact is expected to be immaterial in relation to overallagency operations and aggregate offerings of securities inKansas. The economic impact on issuers conducting Tier2 offerings under Regulation A would include cost sav-ings related to applications for registration, such as theregistration fee and costs to resolve compliance deficien-cies, however, it is not deemed possible to estimate thosesavings. The volume of Regulation A offerings has beenvery limited in recent years and it is not deemed possibleto accurately estimate whether federal preemption willresult in increased volumes of Tier 2 offerings.

Amendments to K.A.R. 81-4-4. Registration require-ments for not-for-profit issuers. This regulation specifiesthat debt offerings of not-for-profit issuers are requiredto be registered as provided for under K.S.A. 17-12a201(7)(C) unless an exemption under other provisionsof KUSA can be claimed, or unless the issuer meets otherconditions with reference to Sec. 3(c)(10)(B) under the In-vestment Company Act of 1940. The proposed amend-ments update statute references and add a clarificationfor the exception from registration for an issuer excludedfrom the definition of investment company under Sec.3(c)(10)(B) of the Investment Company Act of 1940. Theclarification requires that the security is to be issued inexchange for assets contributed to a fund pursuant to Sec.3(c)(10)(B) of the Investment Company Act of 1940. Theproposed amendments to this regulation do not result inany economic impacts on the agency, persons regulatedby the agency, other government agencies or the public.

Amendments to K.A.R. 81-5-7. Exchange exemption.This regulation specifies securities that are exempt fromregistration under KUSA as provided for under K.S.A.17-12a201(6)(B) by designating securities markets onwhich the securities are listed or approved for listing. Theproposed amendments delete a substantial portion of ex-isting provisions in this regulation that duplicate the ex-emption provisions of K.S.A. 17-12a201(6)(A) for federalcovered securities that are exempt as a matter of federalpreemption under Sec. 18(b)(1) of the Securities Act of1933. The proposed amendments to this regulation do notresult in any economic impacts on the agency, personsregulated by the agency, other government agencies orthe public.

Amendments to K.A.R. 81-5-15. Notice filings andfees for rule 506 offerings. This regulation specifies no-tice filing and fee requirements for offerings for whichexemption is claimed under SEC Rule 506 as authorizedunder K.S.A. 17-12a302(c). The proposed amendmentsadd a provision for electronic filings of Form D through

the EFD system as defined in proposed amendments toK.A.R. 81-1-1, and add a reference to K.S.A. 17-12a307with regard to authority of the commissioner to modifythe fee required for a late filing of Form D. The proposedamendments to this regulation do not result in any eco-nomic impacts on the agency, persons regulated by theagency, other government agencies or the public. Theelectronic filing provision does not alter the fee require-ment for filing Form D and the referenced statutory au-thority for allowing modified late fees does not affect pastand current practice.

Amendments to K.A.R. 81-5-17. Standard manuals ex-emption. The proposed amendments to this regulationupdate the names of manuals designated by the commis-sioner for the transactional exemption from securities reg-istration that is provided by K.S.A. 17-12a202(2)(A)(iv).The amendments also clarify that the manuals may be inprinted or electronic form. The proposed amendments tothis regulation do not result in any economic impacts onthe agency, persons regulated by the agency, other gov-ernment agencies or the public.

Amendments to K.A.R. 81-5-21. Invest Kansas Exemp-tion. This regulation specifies requirements and condi-tions for an exemption from securities registration forKansas-based issuers to offer securities to Kansas resi-dents only, with a limit of $1,000,000 for all sales of se-curities of the issuer within a 12-month period. The pro-posed amendments modify or clarify some of theconditions under subsection (a) of the regulation and re-duce limitations currently in subsection (b) with regardto combination of this exemption with other exemptionsunder KUSA. Proposed amendments increase the maxi-mum amount that any non-accredited purchaser of se-curities can invest from $1,000 to $5,000 along with a pro-vision that two or more non-accredited purchasersresiding at the same primary residence who have a closefamily relationship are treated as a single purchaser forpurposes of the $5,000 limit. The requirements for the no-tice filing are being amended to specify that Form IKE isrequired to be filed before the use of general solicitation,but the alternative requirement to file a notice before thetwenty-fifth sale of securities, if that occurs before usinggeneral solicitation, is eliminated. Subsection (b) is beingamended to eliminate a restriction on the use of exemp-tions under K.S.A. 17-12a202 in conjunction with the In-vest Kansas Exemption. That subsection continues to pro-scribe use of exemptions under other regulations inconjunction with this exemption. The proposed amend-ments to this regulation do not result in any economicimpacts on the agency, persons regulated by the agency,other government agencies or the public. The increase inthe maximum allowable investment from $1,000 to $5,000was previously authorized by Special Order, so theamendment for that increase in this regulation will haveno additional economic impact on non-accredited pur-chasers or the issuer.

Amendments to K.A.R. 81-6-1. Prospectus. This regu-lation specifies form and content requirements for theprospectus to be used in registration statements for reg-istrations by coordination or qualification, and the pro-spectus delivery requirements for registrations by quali-

fication. The regulation is being amended to replace thereference to discontinued SEC form SB-2 with SEC formS-1, which is used for registrations by coordination withSEC registrations, unless some other form is required bythe SEC and allowed by the commissioner as providedfor in this regulation. The proposed amendments to thisregulation do not result in any economic impacts on theagency, persons regulated by the agency, other govern-ment agencies or the public.

Amendments to K.A.R. 81-7-1. General statements ofpolicy for registration of securities. This regulation re-quires compliance with NASAA Statements of Policy, asapplicable, that are adopted by reference in the regulationand also specifies financial statement requirements forregistration statements of issuers subject to this regula-tion. The proposed amendments update the adoptions byreference to include the dates the statements of policywere last amended by NASAA so that compliance withthe most recent versions of the statements of policy isrequired by this regulation. A new subsection (c) is pro-posed to clarify that whenever definitions of terms withinthe context of statements of policy adopted by referenceare in conflict with definitions in KUSA or regulationsunder KUSA, the definitions in the NASAA statementsof policy shall apply. The proposed amendments to thisregulation do not result in any economic impacts on theagency, persons regulated by the agency, other govern-ment agencies or the public.

Amendments to K.A.R. 81-7-2. Statements of policyfor specific types of securities offerings. This regulationrequires compliance with NASAA Guidelines and State-ments of Policy, as applicable for specific types of secu-rities or issuers that are adopted by reference in the reg-ulation, and it also specifies suitability provisions thatmay be required for registration and financial statementrequirements for registration statements of issuers subjectto this regulation. The proposed amendments update theadoptions by reference to include the dates the guidelinesand statements of policy were last amended or adoptedby NASAA so that compliance with the most recent ver-sions of the statements of policy is required by this reg-ulation. A new subsection (g) is proposed to clarify thatwhenever definitions of terms within the context ofguidelines or statements of policy adopted by referenceare in conflict with definitions in KUSA or regulationsunder KUSA, the definitions in the NASAA guidelines orstatements of policy shall apply. The proposed amend-ments to this regulation do not result in any economicimpacts on the agency, persons regulated by the agency,other government agencies or the public.

Amendments to K.A.R. 81-14-1. Registration proce-dures for investment advisers and investment adviserrepresentatives. The proposed amendments to this reg-ulation provide technical updates including deletion of(b)(1)(B)(i), which requires filing a copy of the investment

adviser’s surety bond if a surety bond is required byK.A.R. 81-14-9(e), and replacement of NASD with FINRAas defined in proposed K.A.R. 81-1-1. Subsection (e) thatspecified surety bond requirements for investment advi-sers was deleted from K.A.R. 81-14-9, and therefore, thereference to that subsection in this regulation should bedeleted. The proposed amendments to this regulation donot result in any economic impacts on the agency, per-sons regulated by the agency, other government agenciesor the public.

Amendments to K.A.R. 81-14-5. Dishonest and uneth-ical practices of investment advisers, investment advi-ser representatives, and federal covered investment ad-visers. The proposed amendments to this regulationprovide technical updates including the addition of ref-erences to K.A.R. 81-2-1 to adopt sections of the federalInvestment Advisers Act of 1940 by reference, additionof a reference to FINRA rules, and wording and sentencestructure changes for improved readability and clarity.The proposed amendments to this regulation do not re-sult in any economic impacts on the agency, persons reg-ulated by the agency, other government agencies or thepublic.

Amendments to K.A.R. 81-14-11. Kansas private ad-viser exemption. This regulation provides an exemptionfrom registration for investment advisers and associatedinvestment adviser representatives having their principalplace of business in Kansas if they provide investmentadvice solely to fewer than 15 clients, do not hold outgenerally to the public as investment advisers, do not actas an investment adviser to investment companies orbusiness development companies pursuant to provisionsof the federal Investment Company Act of 1940, and arenot subject to any disqualification provisions described inRule 262 of SEC Regulation A. The proposed amend-ments include technical updates for adoptions by refer-ence in K.A.R. 81-2-1, and a new provision (B) under sub-section (b)(2) to clarify that investment advisers that filereports with the IARD system as exempt reporting ad-visers pursuant to SEC Rule 204-4 are exempt from thenotice filing requirements specified by subsection (b)(1)of this regulation. That exemption has existed as a matterof interpretation and practice by the agency under theregulation, but not stated in the regulation as proposedby the amendment described above. The proposedamendments to this regulation do not result in any eco-nomic impacts on the agency, persons regulated by theagency, other government agencies or the public.
