Notice of Available Grant Funding

Grant funds are available from the Federal Sexual As-sault Services Grant Program (SASP) for calendar year2015. The purpose of SASP is to provide intervention, ad-vocacy, accompaniment (e.g., accompanying victims tocourt, medical facilities, police departments), supportservices and related assistance for adult, youth and childvictims of sexual assault; family and household membersof sexual assault victims; and those collaterally affectedby the sexual assault victimization. This grant programrecognizes the need to place increased focus on sexualassault in order to address the lack of available directintervention and related assistance services and theunique aspects of sexual assault trauma. Women and menof all ages, as well as children, can be victims of sexualassault.

There is approximately $281,770 available for grantawards. Available grant funds may be awarded to rapecrisis centers and other nonprofit, nongovernmental or-ganizations or tribal programs for programs and activi-ties that provide rape and sexual assault services for thedefined grant project purposes. Priority will be given toapplicants that are rape/sexual assault crisis centers pro-viding direct intervention and related assistance to vic-tims/survivors; to dual programs that provide sexual as-sault and domestic violence services to enhance theprovision of direct intervention and related assistance

services tailored for victims of sexual assault; and for pro-jects that increase support for underserved populations.

The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period.Interested parties may contact KDHE to determine if theEPA’s 45-day review period has been waived.

The effective date of the permitis from January 1, 2015 through December 31, 2019.

One (1) utility boiler is affected by this permit action,identified as Unit No. 4 in 40 CFR Part 73 Table 2, locatedat 3200 E. 30th St., Hutchinson, KS 67502, and operatedby Westar Energy, P.O. Box 889, Topeka, KS 66601, andwould receive 16 sulfur dioxide (SO2) allowances for eachyear from 2015 through 2019. The Hutchinson EnergyCenter proposes to comply with the Acid Rain Programemission requirements by holding enough allowances tocover all sulfur dioxide emissions.

Issuance of this permit would not affect the responsi-bility of the Hutchinson Energy Center to meet all otherexisting local, state and federal sulfur dioxide emissionrequirements.

28-19-720. New source performance standards.(a)(1) 40 C.F.R. part 60 and its appendices, as revised onJuly 1, 2010 and as amended by 76 fed. reg. 10524 (2011),76 fed. reg. 37967-37977 (2011), and 78 fed. reg. 6695-6700(2013), are adopted by reference except for the following:

(A) Subpart CCCC;(B) provisions that are not delegable by the USEPA to

the state or for which only the USEPA administrator re-tains authority, including the subparts, sections, and par-agraphs containing any of the following:

(i) Alternative methods of compliance approvable onlyby the USEPA administrator;

(ii) emission guidelines;(iii) delegation of authority;(iv) hearing and appeal procedures;(v) requirements regulating any stationary source lo-

cated outside of Kansas; or(vi) requirements regulating any geographic area lo-

cated outside of Kansas; and(C) provisions no longer in effect on the effective date

of this regulation.(2) Subpart CCCC in 40 C.F.R. part 60, as in effect on

July 1, 2005, is adopted by reference, except for the fol-lowing:

(A) Provisions that are not delegable by the USEPA tothe state or for which only the USEPA administrator re-tains authority, including the sections and paragraphscontaining alternative methods of compliance approvableonly by the USEPA administrator; and

115-2-3. Camping, utility, and other fees. (a) Eachovernight camping permit shall be valid only for the statepark for which it is purchased and shall expire at 2:00p.m. on the day following its effective date.

(b) Any annual camping permit may be used in anystate park for unlimited overnight camping, subject toother laws and regulations of the secretary. This permitshall expire on December 31 of the year for which it isissued.

(c) Any 14-night camping permit may be used in anystate park. This permit shall expire when the permit hasbeen used a total of 14 nights, or on December 31 of theyear for which it is issued, whichever is first.

(d) Camping permits shall not be transferable.(e) The fee for a designated prime camping area permit

shall be in addition to the overnight, annual, 14-night, orother camping permit fee and shall apply on a nightlybasis.

(f) Fees shall be due at the time of campsite occupancyand by noon of any subsequent days of campsite occu-pancy.

(g) Fees set by this regulation shall be in addition toany required motor vehicle permit fee specified in K.A.R.115-2-2.

Article 7.—FISH AND FROGS

115-7-3. Fish; taking and use of baitfish or min-nows. (a) Baitfish may be taken for noncommercial pur-poses by any of the following means:

(1) A seine not longer than 15 feet and four feet deepwith mesh not larger than 1⁄4 inch;

(2) a fish trap with mesh not larger than 1⁄4 inch and athroat not larger than one inch in diameter;

(3) a dip or cast net with mesh not larger than 1⁄2 inch;or

(4) a fishing line.(b) Each fish trap shall be tagged with the operator’s

name and address when the fish trap is in use.(c) Baitfish taken, except gizzard shad, shall not exceed

12 inches in total length.(d) The possession limit shall be 500 baitfish.(e) Live baitfish, except for bluegill and green sunfish

from non-designated aquatic nuisance waters and bait-fish from designated aquatic nuisance waters, may becaught and used as live bait only within the commondrainage where caught. However, live baitfish shall notbe transported and used above any upstream dam or bar-rier that prohibits the normal passage of fish. Bluegill andgreen sunfish collected from non-designated aquatic nui-sance waters may be possessed or used as live bait any-where in the state. Live baitfish collected from designatedaquatic nuisance waters shall be possessed or used as livebait only while on that water and shall not be transportedfrom the water alive.

(f) No person shall import live baitfish that does notmeet the requirements of K.A.R. 115-17-2 and K.A.R. 115-17-2a.

115-7-10. Fishing; special provisions. (a) A personwho takes any fish from a body of water shall not tag,mark, brand, clip any fin of, mutilate, or otherwise dis-figure any fish in a manner that would prevent speciesidentification, examination of fins, recovery of tags, ordetermination of sex, age, or length of the fish before re-leasing the fish back into the body of water, unless a per-mit authorizing this activity has been issued to that per-son by the department.

(b) No person may possess any live fish upon depar-ture from any designated aquatic nuisance body of water,except during a department-permitted fishing tourna-ment. During a department-permitted fishing tourna-ment, any individual may possess live fish upon depar-ture from designated aquatic nuisance waters along themost direct route to the weigh-in site if the individualpossesses a department authorization certificate as a par-

ticipant in the tournament. Designated aquatic nuisancewaters shall be those specified in the department’s ‘‘Kan-sas designated aquatic nuisance waters tables,’’ datedJuly 24, 2014, which is hereby adopted by reference.

(c) Each person who purchases live baitfish from a com-mercial bait dealer shall possess the receipt while fishingwith the live baitfish.

(d) No person may fish or collect bait within a fish pas-sage, fish ladder, fish steps, or fishway. ‘‘Fish passage,fish ladder, fish steps, or fishway’’ shall mean a structurethat facilitates the natural migration of fish upstream on,through, or around an artificial barrier or dam.
