At the farthest corner of the online world lie the hidden recesses of the Dark Web and its Darknet marketplaces. The Dark Web may be accessed for both legitimate purposes and to conceal criminal or other malicious activities. This 1.5 hour session will teach you how to access the Dark Web safely and anonymously, navigate within the many layers of the Dark Web to discover hidden Wiki’s, and dig through Dark Web search engines. CP Review - Real Estate

This session assists those taking the Certified Paralegal (“CP”) Exam review for the real estate property rights and ownership of the knowledge portion of the CP Exam. Our review begins with bedrock concepts of real estate law through the development of modern principles and practices. Family Mediation in the Estate Administration Environment:Dispute Management Techniques

This session will discuss family tensions that arise in the context of trusts and estates. This session aims to answer two critical questions. First, what techniques can be used in the estate planning process to avoid disputes? Secondly, what techniques can be used in the estate and trust administration process to avoid turmoil? Tangible personal property often has limited financial value; however, it has a vast emotional value. Why do so many simple estates become complex fights over the family furniture? Where did grandma’s wedding ring go? Through proper mediation techniques, some disputes can be handled without litigation. Family counseling and legal maneuvering often intersect in an estate dispute setting. This session will discuss proper drafting strategies that protect and indemnify fiduciary clients, such as trustees, executors, and conservators.

Generational Differences - Mind the Gap

Unlike any time in our nation’s history, multiple generations are employed in the workplace. We are working alongside co-workers old enough to be our parents and at the same time employees young enough to be our children. Senior partners are planning for retirement and adults born in the last decade of the 20th Century are entering the workforce. Every generation has a different view of the world. That view is dictated by national and world events, public opinion, and viewpoints. Attitudes and expectations have a great effect on each generation’s view of the workplace. What is important to a 65-year-old employee will probably not have nearly the importance to a 21-year-old employee. Conflict is inevitable and production and morale will rapidly decline without cooperation throughout the company. Once differences are acknowledged and accepted, and respect is given to the employee as well as the strengths of each group, common ground and shared values combine to encourage and increase productivity.

Mock Trial - Part 1 & 2

NALA’s Mock Trial will include everything you need to know about jury trials. Learn how a jury is pulled from the venire; watch witnesses testify in a trial like setting; see Plaintiff and Defense counsel present statements and motions for the Judge and Jury to consider. Motor Vehicle Crash Reconstruction

Motor vehicle crash reconstruction is the science of determining the Who, What, Where, When, Why, and How of a motor vehicle crash. The accident reconstructionist works the accident from the end to the beginning. Receiving the necessary documents from the client, the reconstructionist will be able to assist in the litigation of the case and determine the Who, What, Where, When, Why, and How of the crash. This session will discuss what a reconstructionist will need from the attorney, why it is needed and how the use of it will tell the story of the case. We shall also discuss the methodology of reconstructing a crash to achieve a factual basis for the conclusion, and the tools used to get there. Topics will include site analysis, interviews of participants and witnesses, data collection and analysis, specialty tools used, demonstratives and trial preparation. A reconstructionist should tell you the truth; i.e., what your attorney NEEDS to hear, not what they want to hear. Upon completion of this session attendees will have a better understanding of what a reconstruction entails and how it is completed.

Motor Vehicle Event Data Recorders

Accident Reconstructionists, whether in law enforcement or the civil arena, have a large variety of tools available to assist in the reconstructing of a motor vehicle crash. One of the best tools available for analyzing vehicle systems during the crash sequence is a download from the Event Data Recorder (Affectionately dubbed the “Black Box” by the media).

In this session, we shall discuss the relevant history of Event Data Recorder (EDR) and the Bosch© CDR Tool; how the Event Data Recorder functions; discuss common “Terms of Art” for EDR technology, Event Data Recorder Mythology and legal considerations.

This session is based on the speaker’s favorite statement from the veterans’ advocates’ bible: The Veteran, or advocate, who relies on the VA to develop their claim does so at their own peril.

Review the steps necessary to become an accredited agent for the representation of veterans before the U.S. Dept. of Veterans Affairs. The application process, testing, access to VA records and computer system, and setting up shop. Consultation for veterans filing initial claims, guiding them through the claim process, package preparation, developing claims prior to submission, submission of the claim, dealing with denials, resolving VA’s failure to properly develop claims, medical exams, medical opinions, challenging medical opinions, medical experts, medical treatise and their use in VA claims, tactical and strategic thinking and separating the two. Real Estate Contracts: Trap Doors

Veterans Law and the Paralegal:Sorting Out VA’s Errors and Appeal Decisions

Through review of the foundational concepts of veteran’s law and case studies we will review basic errors made with the initial filing of claims for VA Disability Compensation benefits, the impact of those errors on the veteran, the process of disagreeing with a VA decision, and resolving issues outside of the VA appeals process if at all possible. We will cover the filing of good appeals and obtaining supporting evidence, medical evidence, medical opinions, and legal arguments in support of the claim. Briefly I will discuss dependency and issues related to benefits for the survivors of veterans who die of service related conditions.

The World of Business Organizations and their Structures

This session will discuss the different types of corporate structures, including corporations, limited liability companies, and partnerships, from the standpoint of what they are, how each are legally formed, the advantages and disadvantages of each. The session covers topics such as business planning, corporate governance and maintenance, fiduciary duties of sole proprietors, members, and shareholders and their liability and rights. 1. ESI is a broad term that can encapsulate a whole host of digitally created content. E-mails, Microsoft Word documents, social media posts, company-specific databases, and audio and video files all fall under the domain of ESI. In this session, we will highlight some of the e-Discovery software providers on the market and their features. In addition, we will discuss some tips to use while conducting e-Discovery to save you time and stream line your process.

Elections for the 2019-2020 Affiliated Associations Director and Secretary will take place during this meeting. Nebraska Paralegal Association will present the 2019 affiliate exchange program entitled “Collaborating Committee: Working Together for Ultimate Success” and the 2019 affiliate awards recipients will be announced.
