Requested Services Notice

State of KansasDepartment of Transportation

Notice to Consulting FirmsThe Kansas Department of Transportation (KDOT) is

seeking to enter into two agreements for the services of two consulting engineering firms, whose combined ef-forts will provide statewide sign truss and light tower inspection on the state highway system for KDOT Proj-ect 106-KA-4359-01. Although each consulting firm will have a separate contract with KDOT, the scope of services will be coordinated to provide consistent and uniform requirements to update KDOT’s existing inventory data-base. The statewide workload will be divided geograph-ically between two consulting engineering firms, with some overlap for QC/QA purposes. The ultimate scope of services will be performed in three phases, each of which is subject to KDOT’s receipt of adequate funding. Phase one will encompass structural inspections for sign structures (statewide total approximately 1490), KDOT-owned traffic signals (statewide total approximately 45), and high mast light towers (statewide total approximate-ly 1600). Subsequent phases two and three may require reinspection of those trusses and light towers identified in phase one as candidates for differing or more frequent inspection intervals. The majority of these structures are concentrated in Kansas City, Wichita and Topeka, and along interstates and major freeways at interchanges. The services shall be performed in accordance with standards set forth in the Federal Highway Administration’s pub-lication entitled Guidelines for the Installation, Inspection, Maintenance and Repair of Structural Supports for Highway Signs, Luminaries, and Traffic Signals (March 2005) and KDOT’s Policies and Procedures for the Inspection of Sign & Light Structures (July 2, 2014).

Sign Structures/Light Towers inspections shall include on-site inspection of structures and towers in order to:

• verify and update inventory information in KDOT’s current database, such as location, condition and structural components/materials,

• determine and assess current structural condition based on element level inspection methodology and

• provide recommendations for maintenance actions.KDOT may elect to perform some of the inspections

itself during phase two and three, the extent of which is to be determined.

Results of the inspections will be submitted monthly in one or more electronic formats used by KDOT. KDOT is currently using a specific software program (Kansas Ancillary Walls and Structures or KAWS) for its inven-tory database. Electronic copies of any reports, photos or inspections will also be required as deliverables.

Requirements: Interested consulting firms must: (a) be prequalified by KDOT in category 322—Bridge In-spection and (b) submit a Letter of Interest on or before noon (CST) January 12, 2017, to David Nagy, P.E., As-sistant to the Director of Design/Contracts Engineer by email to [email protected] with the subject line read-ing “Truss & Tower Inspection [Firm Name]”. Letters of Interest in the form of a PDF document (maximum

size 4 pages) should express interest in the project and describe particular qualifications for the professional services sought by KDOT, including any special ex-pertise, skill, equipment, cost reduction strategies, ex-perience or knowledge of the firm, its employees and any subconsultant the firm intends to utilize. If a firm is not currently prequalified by KDOT but is interest-ed in obtaining prequalification, then please view the requirements and categories at the website address of http://www.ksdot.org/divengdes/prequal/default.asp. For licensure and other requirements applicable to the practice of technical professions within the State of Kan-sas, please consult the website of the Kansas Board of Technical Professions at http://www.ksbtp.ks.gov/. All firms doing business with KDOT must be registered and in good standing under the laws of the State of Kan-sas and comply with applicable state and federal laws, rules and regulations.

Note: The basis of compensation for consultant ser-vices will be actual direct cost plus fixed fee. Therefore, consultant firms must: (a) be able to provide an indirect (overhead) cost rate meeting federal requirements of 23 CFR 172.11(b)(1); and (b) be capable of incurring, invoic-ing and accounting for costs in conformity with generally accepted principles established in the Federal-Aid Poli-cy Guide and the Code of Federal Regulations, Title 48, Chapter 1, Subchapter E, Part 31 (48 CFR Section 31.000 et seq.). All costs invoiced must be substantiated by appro-priate documentation.

Qualifications-Based Selection Process. Based on the qualifications submitted in the Letter of Interest and oth-er information available to KDOT, on or about January 31, 2017, KDOT intends to shortlist four firms and noti-fy all firms submitting Letters of Interest of the names of the shortlisted firms by return email. Thereafter, KDOT will issue a Request for Proposal (RFP) to the shortlisted firms soliciting a technical proposal. At KDOT’s option, shortlisted firms may be interviewed by telephone con-ference call or asked to attend meetings or participate in other discussions with KDOT. Technical proposals will be evaluated on the basis of the factors listed be-low, evenly weighted, to rank the most qualified firm in order of preference as first, second, and third, etc. Eval-uation factors: 1) the quality of the response to the RFP; 2) qualifications and experience of consultant personnel proposed for services; 3) proposed approach to per-formance, safety practices, data gathering procedures, and accuracy of services; 4) past performance history; and 5) cost saving measures and/or strategies. The two highest ranked firms will be asked to enter into nego-tiations with KDOT. In the event KDOT cannot reach agreement with either of the two highest ranked firms, it will terminate negotiations with such firm and com-mence negotiations with the next highest ranked firm, and so on, until either agreement is reached for a satis-factory scope of services for a fair and reasonable price, or KDOT decides to pursue other alternatives. KDOT intends to conclude or terminate negotiations on or be-fore March 1, 2017.

Notice Concerning Proposed Air Quality Construction Permit

Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed air quality construction permit. The Lowen Corporation has applied for an air quality construction permit in accordance with the provisions of K.A.R. 28-19-300. Emissions of Volatile Organic Com-pounds (VOC), Individual Hazardous Air Pollutant (HAP), and combined/total HAPs were evaluated during the permit review process.

The Lowen Corporation, PO Box 1528, Hutchinson, KS 67504-1528, owns and operates a real estate signs and color graphics manufacturing facility located at 1111 Air-port Road, Hutchinson, Reno County, KS 67501 at which equipment and activities/operations associated with printing were installed.

The proposed per-mit contains limits for carbonaceous biochemical oxygen demand, total suspended solids, ammonia, E. coli, dissolved oxygen, Nitrate + nitrite, whole effluent toxicity, and pH, as well as monitoring for total phosphorus, total Kjeldahl nitrogen, total nitrogen, chlorides, priority pollutants, temperature, and flow.

Owner/Operator: Ryan J and Laci N Foltz; Description: Acquisition of 80 acres of agricultural land and related improvements and equipment to be used by the owner/operator for farming purposes. The project is being financed by the lender for Ryan J and Laci N Foltz and is located at Section 6, Jefferson Township, Dickin-son County, Kansas, approximately 8 miles south and 2 miles west of Abilene, Kansas.

The bond, when issued, will be a limited obligation of the KDFA and will not constitute a general obligation or indebtedness of the state of Kansas or any political sub-division thereof, including the KDFA, nor will it be an indebtedness for which the faith and credit and taxing powers of the state of Kansas are pledged. The bond will be payable solely from amounts received from the respective borrower, the obligation of which will be suf-ficient to pay the principal of, interest, and redemption premium, if any, on the bond when it becomes due.

Notice of Hearing on Proposed Administrative Regulations

The Kansas Department of Health and Environment, Division of Health, Bureau of Family Health, will con-duct a public hearing at 10:00 a.m. Wednesday, March 22, 2017, in room 530, Curtis State Office Building, 1000 SW Jackson, Topeka, to consider the adoption of pro-posed amended maternal and child health regulations K.A.R. 28-4-587 and 28-4-592. These proposed amended regulations pertain to school-age programs. They were developed cooperatively with the Kansas Department for Children and Families (DCF) to implement federal requirements pertaining to the Child Care and Develop-ment Fund (CCDF) State Plan.

A summary of the proposed regulations and estimated economic impact follows:Summary of Regulations

K.A.R. 28-4-587. Staff member qualifications; profes-sional development training; staffing requirements. The proposed amended regulation adds a requirement that a completed application be on file for each staff member,

documenting his or her qualifications. The amended reg-ulation requires each staff member to complete orienta-tion before being given sole responsibility for the care and supervision of children and expands the subject areas to be included in orientation. Required clock-hours for an-nual professional development training are increased for program directors. Staff members will now have to com-plete a specific number of clock-hours annually.

K.A.R. 28-4-592. Safety and emergency procedures; reporting requirements. The proposed amended regula-tion adds details for development of an emergency plan and requires the plan be provided to parents and legal guardians. Staff members are required to practice annu-ally the procedures for moving children in an emergen-cy. The frequency of tornado drills is increased. Details are provided for cleaning and sanitizing contaminated surfaces. There are updated requirements for reporting suspected child abuse or neglect.Economic Impact

Cost to the agency: There is no additional cost to the agency. Any costs will be absorbed in the current budget.

Cost to licensees: Currently each operator is respon-sible for providing orientation to each staff member counted in the supervisory ratio and annual professional development training for staff members. Alternatively, operators may arrange for other entities to provide the training. There are already in place a number of train-ing opportunities available through resource and referral agencies, statewide training providers, and some of the county health departments at no cost or little cost. The department is working with these entities to ensure that the training requirements can be met, across the state, through a variety of methods including classroom in-struction and online courses.

Costs to other governmental agencies or units: There is no known cost to other governmental agencies or units to implement these proposed amendments.

The time period between the publication of this notice and the scheduled hearing constitutes a 60-day public comment period for the purpose of receiving written public comments on the proposed amended regulations. Article 1.—GENERAL PROCEDURES CONCERNING PARTIES

133-1-1. Definitions. (a) As used in this article, each of the terms defined by K.S.A. 77-502, and amendments thereto, shall have the meaning specified in that statute.

(b) Each of the following terms shall have the meaning specified in this subsection:

(1) “Director” means director of the office of adminis-trative hearings.

(2) “KAPA” means the Kansas administrative proce-dure act, K.S.A. 77-501 et seq., and amendments thereto.

(3) “OAH” means the office of administrative hearings.(4) “Presiding officer” means the administrative law

judge assigned to preside over an administrative hear-ing. (Authorized by and implementing K.S.A. 2016 Supp. 75-37,121 and 77-562; effective Jan. 20, 2017.)

133-1-2. Assignment of administrative law judges. (a) Any state agency head or a designee may request that the director assign an administrative law judge to act as the presiding officer in an administrative hearing that is neither subject to KAPA nor listed in K.S.A. 77-551, and amendments thereto, and for which the agency head is responsible. The request may be made in writing, by tele-phone, or by electronic transmission.

(b)(1) Upon receiving a request for assignment of an administrative law judge, an administrative law judge of OAH shall be assigned by the director, unless the direc-tor determines either of the following:

(A) The existing caseloads of the administrative law judges would prevent OAH from providing a timely hearing.

(B) There is a conflict that would subject the adminis-trative law judges to disqualification.

(2) In making each assignment, the relative experience, caseloads, and expertise of the OAH administrative law judges, as well as potential conflicts, time frames, and

other relevant resources and factors, may be considered by the director.

(c) After the assignment of an administrative law judge, the requesting state agency shall forward to the director written documentation of the basis for the administrative hearing, which may include any of the following mate-rials:

(1) A request for an administrative hearing;(2) a petition for a hearing from a party to the state

agency proceedings;(3) the order that is the subject of the request for a hear-

ing; or(4) any other documentation of the event or action that

forms the basis for the administrative hearing under ap-plicable law. (Authorized by and implementing K.S.A. 2016 Supp. 75-37,121 and 77-562; effective Jan. 20, 2017.)

133-1-3. Conduct of proceedings. (a)(1) Each admin-istrative hearing to which an administrative law judge is assigned under K.S.A. 75-37,121(b), and amendments thereto, shall be conducted in accordance with KAPA, unless other applicable statutes or regulations provide otherwise.

(2) Each administrative hearing to which an adminis-trative law judge is assigned under K.S.A. 75-37,121(d), and amendments thereto, shall be conducted in accor-dance with any applicable statutes, regulations, ordi-nances, or other law.

(b) All parties to the state agency proceedings may be required by the administrative law judge or the director to submit motions, objections, briefs, and other pleadings in a format established by the director and with the num-ber of copies prescribed by the director.

(c) When an administrative law judge is assigned to an administrative hearing under K.S.A. 75-37,121(d), and amendments thereto, the order issued by the adminis-trative law judge shall contain the elements required un-der any applicable statutes, regulations, ordinances, or other law. (Authorized by and implementing K.S.A. 2016 Supp. 75-37,121 and 77-562; effective Jan. 20, 2017.)

133-1-4. Electronic filing. (a) As used in this regula-tion, each of the following terms shall have the meaning specified in this subsection:

(1) “Filing” means any pleading, motion, objection, proffer of evidence, discovery request or response, brief, or any other formal communication by a party regarding the docketed administrative proceeding for which the fil-ing is relevant and the filer is a party.

(2) “OAH e-filing system” and “system” mean a pub-lic, web-based internet portal established by OAH to which the parties to a proceeding are given secure and password-protected access for the purpose of sending or receiving electronically submitted filings regarding their proceeding.

(b) In any proceeding for which the director has ap-pointed a presiding officer, any party to the proceeding may submit any filing to the presiding officer by using mail or telephone facsimile. Additionally or alternative-ly, any party may submit any filing for its proceeding using the OAH e-filing system, subject to the following:

(1) The system may be used only by parties who meet the following requirements:

(A) Have submitted to OAH a written and signed con-sent to the terms of use for the system that are specified by the director; and

(B) have completed the system’s online registration for the specific proceeding to which they are a party.

(2) The only modes by which signed consent to the terms of use for the system may be submitted to OAH are personal service, mail, telephone facsimile, or scanning and electronically mailing the signed consent document to the electronic mail address specified for only this pur-pose by the director.

(3) Once a party’s signed consent is received by OAH, the party shall be sent by OAH, in a manner specified by the agreed terms of use, directions and information for completing that party’s online registration for the system.

(4) Any party may satisfy its duty to serve a copy of its filings to any other party using the OAH e-filing sys-tem, but only if both the serving party and the recipient party have completed their prerequisite signed consent and online registration for the immediate proceeding to which they are party.

(5) Only OAH personnel and the parties to a given proceeding shall have access to submit online or to view online any filings for their proceedings. Whether filed electronically or through other means, records of a pro-ceeding shall be available to nonparties only as provided by the Kansas open records act, K.S.A. 45-215 et seq., and amendments thereto.

(c) No person may submit a filing or use the OAH e-filing system for a proceeding to which the person is not a party unless the presiding officer has recognized the person as an authorized representative of the party on whose behalf the person is filing or using the system.

(d) All orders and notices issued by the presiding offi-cer shall be served in conformity with K.S.A. 77-531, and amendments thereto.

(e) A party’s inability to utilize the OAH e-filing sys-tem shall not constitute a basis for an extension of time in which to file any matter with the presiding officer or with opposing parties. This inability shall not affect any

applicable filing deadlines imposed by law or by order of the presiding officer.

(f) For purposes of determining whether an error was committed by the OAH e-filing system before the effec-tive date of a default or initial order, any party to the pro-ceedings in question may request that OAH perform an audit of the system and deliver the audit findings to the presiding officer if all of the following conditions are met:

(1) The requesting party alleges that it was unable to make a timely filing due to an error of the system.

(2) The timeliness or existence of the filing transaction in question is material to the disposition of the party’s case.

(3) The party submits its audit request before a pro-posed default order for its case has become effective or before an initial order in the case has been issued.

(g) For purposes of determining whether an error was committed by the OAH e-filing system during an appeal pursuant to K.S.A. 77-527 and amendments thereto, any party to the appeal may request that OAH perform an audit of the system and deliver the audit findings to the agency head if all of the following conditions are met:

(1) The requesting party alleges that it was unable to make a timely filing during the course of the appeal due to an error of the system.

(2) The timeliness or existence of the filing transaction in question is material to the disposition of the party’s appeal.

(3) The party submits its audit request before a final order on its appeal has been issued.

(h) Concise documentation of the results of any sys-tem audit performed in accordance with this regulation shall be incorporated into the record of any case in which a system error was alleged.
