Executive Meeting Minuets continued on the next page

The May 2015 Massachusetts Locksmiths Association Executive Board Meeting was gaveled to order by MLA President DJ Dabenigno at 7:00 PM. Present at the meeting along with President Dabenigno was Vice President Michael Kippenberger , Secretary Fred Darcy , Treasurer Kenneth Beltram , Archives and Database Chairman Mario Lituri , Membership Committee Chairman Carl Feinberg , Mini Show Chairman Jacob Feinberg , Licensure Committee Chairman John Casey , Membership Committee Members Barbara Baker and Mike Turmel and Associate Member / Distributor Representative Cathy Accomando of Commonwealth Lock , Cambridge , Massachusetts .

Secretary’s Report - Secretary Fred Darcy reports that all MLA business conducted is as

reported in the April 2015 MLA Newsletter. Further , Secretary Darcy reported that Mini Show Chairman Jacob Feinberg did a great job in running the MLA Mini Show which was held on Wednesday , April 8 , 2015 at the Lexington Elks Hall , Lexington , MA and that Licensure Committee Chairman John Casey did a great job in putting together this years Locksmith Flea Market which was held on Sunday , April 19 , 2015 at the Sons of Italy Hall , Woburn , MA ..

Treasurer’s Report – Treasurer Kenneth Beltram gave a breakdown of the current finances

of MLA and reports that all is well. Membership Committee Report – Membership Committee Chairman Carl Feinberg reports

that four new members have had their applications voted out favorably for membership in the Massachusetts Locksmiths Association. That vote took place on May 6, 2015 and all four were notified on May 7, 2015.

Following are the names of our four new MLA Members. William F. Palmer – Regular Member #816 - Raynham Lock & Key Paul F. Troy - Apprentice Member #1250 – Gerry’s Hardware Michael Sterns – Apprentice Member #1251 – Home Depot Wilbraham Paul Schmitt – Student Member #1252 - D C A M M, Jamaica Plain The following applications are pending. Jose Rodriguez, J&O Construction, Brockton, MA George Polanski, SY Locksmith Hallmark – Carl Feinberg reports the passing of members Carl Cioffi and Henry Brunelle. Newsletter – Carl Feinberg reports that all is going well with the newsletter. The newsletter

is now in digital format. Program / General Body – President Dabenigno reports that Bob Makowsky will be giving a

presentation on safe sales and logistics at the next MLA General Meeting which will be held on Wednesday, May 13, 2015, 7PM at the Lexington Elks Lodge, Lexington, MA.

Promotional & PR – President Dabenigno brought forward an idea of having a get together

of MLA members at a Lowell Spinners baseball game in either July or August .President

Dabenigno went over the ticket price per person, a buffet at the ballpark for MLA members, etc... He will review the pricing with membership in the future if there is adequate interest in attending such an event by the membership .MLA would be recognized at the ballpark if the event is held.

Membership Committee Member Barbara Baker inquired about the Massachusetts

Locksmiths Association radio ad which was supposed to be aired on WMEX 1510 AM Radio. Treasurer Beltram reports that he has not heard the MLA ad after listening for countless hours to the radio station. Secretary Fred Darcy reports same. President Dabenigno directed the inquiry to Vice President Michael Kippenberger who made the original motion for the expenditure of funds for the ad to air. Vice President Kippenberger will contact Francesca at WMEX to ascertain if the ad has aired and if it has, what dates and times.

Licensure Committee – John Casey spoke on the scammer issue and will be contacting

Joe Demers and Jim Dwyer regarding potential legislation To help with stopping the actions of scammers who prey on innocent consumers. This

legislation would be consumer protection legislation. Locksmith Flea Market – John Casey gave a breakdown of costs and a review of this years

Locksmith Flea Market Archives and Database - Archives and Database Chairman Mario Lituri reports that he is

still working on a large volume of materials. Mario also reports that he will be meeting soon with Treasurer Ken Beltram and Membership Committee member Rick Weisse regarding review of the MLA by Laws.

Mini Show & Yankee – Mini Show Chairman Jacob Feinberg reported that the Mini Show

went well. He thanked Associate Representative Cathy Accomando of Commonwealth Lock for obtaining the metal rulers purchased by

MLA that were handed out to all attendees at the Mini Show and for the continued support of MLA by Commonwealth Lock .

There were 24 tables and 20 vendors at the event. The new method of conducting the

raffle went very smooth. Jacob expressed his thanks to all of the vendors that attended the Mini Show for their generosity in supplying the raffle items. 24 MLA members and 5 nonmembers won raffles at this years event.

Treasurer Ken Beltram requested that an invoice from the Lexington Elks be forwarded to

him for the hall rental (overall) and for 1 table which was damaged accidentally at the Mini Show. BBQ / Christmas Party – President Dabenigno reports that Kevin Kelleher of Kelleher

Associates will again be sponsoring the MLA BBQ. There will also be a mobile showroom at the event. Josephs Catering will again be catering the BBQ. President Dabenigno reviewed the food menu and quantity

of food needed for the event with Executive Board members. The MLA BBQ will be held June 10, 2015 at the Lexington Elks Lodge, Lexington, MA...

Website – President Dabenigno reports that all is well, no issues and that the consumer

portion of the website dealing with phony locksmiths that he and John Casey put together is also working well.

made inquiry about the MLA ad which is supposed to air on WMEX radio 1510 AM. See Promotional / PR above for details.

Mini Show Chairman Jacob Feinberg made a suggestion that MLA should ask advertisers

in the MLA newsletter if they would like to give a company history which would be printed in the MLA newsletter, starting with distributors. One company would be highlighted each month.

Announcements – President Dabenigno is requesting that MLA members participate in

forwarding a pricing survey which reflects what they charge hourly for locksmith work, what they charge for various locksmith services, etc... This survey would be similar to the annual price survey which appears in the Locksmith Ledger. Submission of this survey is voluntary.

Licensure Chairman John Casey made inquiry as to whether future MLA Executive Board

meetings would be held at Bertucci’s Restaurant in Medford , MA as Bertucci’s management has made changes as to how the private room would be reserved . President Dabenigno has spoken with Bertucci’s management and has advised them that we (MLA) need a quiet and private area to conduct business and that we cannot share that room during meetings. He has also advised them that we cannot incur additional expenses to reserve the private room.

The May 2015 Executive Board Meeting was adjourned at 8:52 PM. Respectfully Submitted Fred Darcy, RL, Secretary, Massachusetts Locksmiths Association Secretary’s Note – On May 13, 2015 I had contacted President Dabenigno regarding

a You Tube video dealing with phony locksmiths .President Dabenigno informed me that the same You Tube video was on the MLA consumer protection part of the website that he and Licensure Chairman John Casey had worked together on and that I should check out that portion of the website to observe this and other videos on the topic.

I must say that DJ and John Casey put together a very thorough and eye opening

presentation with video of multiple phony locksmiths performing unnecessary damage, drilling and forcing locks and overcharging consumers who had contacted these companies through ads over the internet or phone book.

As an individual who has worked many years as a police officer and fraud investigator as

well as working as a locksmith , it is my opinion that we need to encourage consumers to visit this website to educate them on what is going on and how to protect themselves from being a another victim of this sort of scam .

The May 2015 General Meeting of the Massachusetts Locksmiths Association Was held at the Lexington Elks Lodge , Lexington , MA..

President DJ Dabenigno introduced MLA Member Bob Makowski who gave a class on safe service call procedures.

Bob handed out an outline to all that attended which covered who the technician

should have contact with , who to discuss the particular safe work with , Issuance of combination cards , customer having the original dated combination card for warranty work and explanation of how to use the combination to an authorized person only . Bob further told attendees to note on the service slip that the combination process has been fully explained to the customer, make sure that the customer remains in the room anytime there are contents in the safe and when testing the combination, make sure to throw the door bolts several times with the door open.

After having tested the combination at least three times, try closing the door and

throwing the door bolts in and out several times to test the smoothness of the combination. Test the combination with the door closed. Make sure that the combination lock bolts

slide in and out smoothly. Have the customer test the combination. Take note of the customer spinning the dial

or standing to one side of the dial while testing the combination. When the customer is satisfied and all questions have been answered, have them sign

the service slip. Bob spoke of policies and procedures regarding the change key for the safe. He went

on to discuss the various types of safes that are available as well as UL certifications of safes and how such label must be removed from used safes being sold. He spoke about the use of burning bars in safe work and brought in 2 for members to see and described delivery procedures of safes, maintenance of carbide bits, etc...

President Dabenigno thanked Bob for his very thorough presentation. After a brief break, President Dabenigno brought the General Meeting to order. President Dabenigno thanked Bob Makowsky for being the guest speaker and for his

presentation on safe procedures. Secretary’s Report – Secretary Darcy read the minutes of the May 2015 MLA Executive Board Minutes. Treasurers Report – President Dabenigno reports that all is well as was reported by

MLA Treasurer Beltram. Membership – Membership Chairman Carl Feinberg reports all is going well and is as

board Minutes of this evening. Newsletter – Carl Feinberg reports that all is going great. Program – Mike Kippenberger Jr. brought up an idea to President Dabenigno of

having an MLA night out at the Lowell Spinners baseball game. The Spinners are a minor league affiliate of the Boston Red Sox. President Dabenigno has suggested that the MLA would split the cost of the tickets with members. Adult prices are $30.00 per ticket and under 16 years of age ticket price is $26.00. If there are more than 50 MLA attendees, MLA would have a representative throw out the first pitch.

Promotional / PR – Vice President Mike Kippenberger Sr. contacted Francesca from

WMEX 1510 who has assured him that the MLA ad has been playing 3 times per day randomly and on Saturday mornings at 7AM.

Licensure Committee – Chairman John Casey reports that he is still working on

various issues regarding consumer protection legislation, etc... Archives and Database – as reported in the MLA Executive Board Minutes of May,

2015. Mini Show and Yankee – Mini Show Chairman Jacob Feinberg reports that all went

well. He advised of payment of rulers by MLA for Mini Show. Yankee – MLA Vice President Michael Kippenberger Sr. is Chairman of the MLA

Yankee Committee. He will be attending the Yankee Convention this October and will be representing the Massachusetts Locksmiths Association.

MLA President DJ Dabenigno who is also on the Yankee Convention Executive Board

will also be at this years event. BBQ / Christmas Party - The MLA Barbeque is scheduled for Wednesday, June 10,

2015 at the Lexington Elks Lodge. The event will be sponsored by Kelleher and Associates. There will also be a mobile showroom on location. Josephs Catering will again be catering the event.

O’Keefe approached and suggested that we should eliminate the reading of the minutes at future meetings as they are printed in the MLA Newsletter for all to read.

Chapter 2 of Roberts Rules of which MLA subscribes advises that it would not be

prudent to not read the meeting minutes as the minutes are a legal document for the organization and that if a legal action is brought against the organization , the courts use those minutes as evidence . Roberts Rules also points out that the minutes provide an opportunity for corrections and oversight.

Generally, the reading of the minutes takes up less than 5 minutes of the total meeting

time. This is time well spent to keep our membership informed and to give them the ability to correct the record or add to it.

I understand that many members work long hours and want to get home, however we

still must conduct the business of MLA in a proper and orderly fashion so that we will remain on solid ground for many years to come.

Robert’s Rules of Order

What Is Parliamentary Procedure?

It is a set of rules for conduct at meetings that allows everyone to be heard and to make decisions without confusion.

Why is Parliamentary Procedure Important?

Because it's a time tested method of conducting business at meetings and public gatherings. It can be adapted to fit the needs of any organization like ours. Today, Robert's Rules of Order newly revised is the basic handbook of operation for most clubs, organizations and other groups. So it's important that everyone know these basic rules!

Now that the Association has gone digital with notifying our members, we can speed up the process of discussing new topics and voting on them. Before we would have to wait a month so it could be published in the newsletter, now members will be able to submit Motions, Discussion Topics, and Petitions to Address the Body before the Regular Meetings so discussion and a vote can take place at the meeting. Motions, Topics, and Petitions must be made no later then the day before a Regular Meeting. They will then be moved into an area on our agenda and discussed at which point. Below is our fixed order of business. Motions, Topics, and Petitions will be discussed when we reach the order or business in which it regards to.

Unlicensed Locksmiths Charged In Sting Operation

NEW ORLEANS, LA (Press Release) – An undercover operation by State Fire Marshal investigators, which began last week culminated yesterday in criminal and civil charges being lodged against five (5) men.

In response to complaints regarding unlicensed local and out-of-state locksmiths doing business in the Greater New Orleans area, the State Fire Marshal conducted a double sting operation late last week resulting in four (4) individuals being snared.

Investigators had been informed by several licensed locksmiths of the existence of internet ads that contained New Orleans-area telephone numbers for locksmith services by companies believed to be headquartered out-of-state. When the numbers were called, callers were routed to a call center in a different state that would then dispatch an unlicensed operative here in Louisiana.

One particular number was listed to a company known only as “24 Hour Locksmith” which, according to the State Fire Marshal’s office, is unlicensed to conduct business in this state.

None of the companies identified during the operation are currently licensed through the State Fire Marshal’s office, which is the licensing and regulatory agency with oversight of approximately 1,500 companies, including but not limited to locksmiths.

The first operation, staged in New Orleans East, ended with three (3) citations being issued after plain- clothes investigators, posing as business owners, met with unsuspecting individuals who had been dispatched by an out-of-state call center to provide quotes on rekeying several locks in a vacant New Orleans business space. Such work requires licensure.

The men and companies that were cited for unlicensed activity are Robert B. Grant, Ontario, Canada; Alvin D. Silva, Jacksonville, Florida (“24 Hour Locksmith”); and Clifford R. Johnson, Chalmette (“Zippy Locksmith”).

In addition to the individual citations issued, “24 Hour Locksmith” and “Zippy Locksmith” received citations for proposed civil fines of $1,500 each. The proposed fines for the men were $500 each. Cease and desist orders were also issued to the trio and their respective companies.

Failure to comply with such an order subjects one to both civil and criminal penalties, including possible prison time.

The second sting, which was conducted in Gretna, snagged a local man whose family-owned company, “The Lock Clinic,” has been under a cease and desist order since May 2010.

After the man arrived at a home and began a dialogue with a plain-clothes investigator, he then removed a lock set from an exterior door while investigators surreptitiously videoed him. A uniformed officer was then called in to approach the person.

The man, identified as Bryan S. Dowell, of Mandeville, denied affiliation with “The Lock Clinic,” but later admitted that his brother, David Dowell, who owns and operates that business, had dispatched him to the home.

Bryan Dowell was subsequently issued a citation with a proposed fine of $1,500 and a cease and desist order before being released.

Yesterday, investigators charged David J. Dowell, Jr., owner of “The Lock Clinic,” with a criminal misdemeanor for violating the May 2010 cease and desist order of the State Fire Marshal. Also, while in the business, investigators observed business cards advertising work on safes and locks, both of which services require a license.

In addition, David Dowell, Jr. received notice regarding a proposed civil fine totaling $6,500 for violating the cease and desist order and performing locksmith services without a valid license from the State Fire Marshal’s office.

In another instance yesterday, Don G. Saracino, of Slidell and owner of “Zippy Locksmith,” was issued a citation for a proposed civil fine of $1,500 for operating an unlicensed locksmith business, as well as a cease and desist order.
