Civil/Military Aviation Safety Cooperation: EU-EASA framework: Military domain (Art. 1(2) BR)

Military matters/activities/services in the domains of airworthiness, operations, licencing, ATM/ANS and aerodromes are exclusively subject to national legislation and fall under the sole responsibility of the Member States (MS).

It is the responsibility of MS:

to identify which are those military matters/activities/services under their responsibility according to Art. 1(2) BR.

to regulate those matters/activities/services .

Civil/Military Aviation Safety Cooperation: Assurance of civil aviation safety standards

NEVERTHELESS:

Art. 1(2)(a) BR – MS shall ensure that military (airworthiness) activities or services have due regard as far as practicable to the BR objectives (civil aviation safety standards).

Art. 1(3) BR – MS shall, as far as practicable, ensure that military facilities (aerodromes) open to public use and (ATM/ANS) services provided by military personnel to the public offer a level of safety that is at least as effective as that required by the BR essential requirements.

EU Legislator has:

recognised a need for the military to ensure equivalent safety standards and smooth functioning of the inevitable interface between civil and military aviation.

put an obligation on the Member States to take measures in this respect.

Civil/Military Aviation Safety Cooperation: Assurance of civil aviation safety standards

Member States:

Obligation to ensure “due regard to”, „as far as practicable“ or “at least as effective” the fulfilment of the civil aviation safety objectives provided in the BR.

Obligation is limited/softened in recognition of the fact that full compliance with EASA safety provisions/objectives could be qualified by national military/defence constraints or needs.

Civil/Military Aviation Safety Cooperation: Assurance of civil aviation safety standards

Both the MS sovereignty on defence and security matters and the general need to ensure safety of civil aviation and its interface with the military are safeguarded.

At this stage, no EU competence to regulate the safety conditions under which military matters/activities/services are to be handled. Method by which this is achieved is left totally open.

MS may choose to achieve those objectives by either deciding to follow all/part of the EU-EASA rules, or by other means that produce the same end result.

Fulfil safety objectives:

To ensure military safety standards equivalent to the civil ones.

To ensure appropriate level of safety in the interface civil/military.

Civil/Military Aviation Safety Cooperation: Other objectives

To facilitate a liberalised internal market of EU military aeronautical products.

To ultimately reduce complexity, time and costs avoiding duplication of capabilities, in particular in case of international military aviation projects.

Civil/Military Aviation Safety Cooperation: Means

First, harmonisation of military requirements and processes based on the existing harmonised EU civil aviation safety standards (among others: initial and continuing airworthiness, occurrence reporting, airworthiness directives).

Second, implementation at and mutual recognition among the Member States of those harmonised military standards.

Civil/Military Aviation Safety Cooperation: Institutional Framework: EASA-EDA

Cooperation should take place mainly using the existing EU-Institutional framework.

EASA as centrepiece of the EU aviation safety system has an important role to play in the achievement of the aforementioned safety objectives through close cooperation with the Military.

At the same time, EASA needs to become familiar with the military regulatory environment and its potential impact on the civil domain.

Civil/Military Aviation Safety Cooperation: Institutional Framework: EASA-EDA

European Defence Agency (EDA) as EU body is the natural counterpart for EASA for such cooperaton.

EDA Mission is to improve EU Defence capabilities aiming at creating civil-military synergies and avoiding duplication.

EDA Steering Board: Ministers of Defence of 26 MS (decision-making power).

Civil/Military Aviation Safety Cooperation: Scope – Total System Approach

Aviation is global in nature and therefore requires a total system approach with common aviation safety rules covering all its interlinked elements.

Aviation safety has to be coherent in all its elements.

The EU-EASA framework in in fact a single safety system with interrelated and interdependent Actors ranging from:

Design organisations + aircraft manufacturers,

Operators,

Air crew,

Air traffic controllers + ATM/ANS service providers,

Airports.

Civil/Military Aviation Safety Cooperation: Scope – Total System Approach

The extension of the EU-EASA safety rules to all aspects of aviation under a “Total System Approach” and the creation of a Single European Sky (SES) is therefore logical and technically consistent.

Civil and Military share the same airspace covered by the EU-EASA “Total System Approach”.

Consequently, civil-military cooperation needs to take due consideration of this comprehensive safety system and should adress the different interlinked elements conforming it.

Scope: Detect and Avoid system as principal requirement for the military to enter into non-segregated airspace i.e. General Air Traffic.

Final remarks: General principles

EU-EASA aviation safety framework based on the “Total System Approach” makes necessary a close reinforced cooperation between the civil and the military to ensure a high level of safety within the Single European Sky.

EASA has a major role to play as the EU body responsible for aviation safety, in close cooperation with EDA, as its natural counterpart.

Final remarks:

Proposed short-medium term approach

To continue and reinforce cooperation with EDA in the field of airworthiness within the EASA RAG/TAGs and MAWA TFs.

To define cooperation with EDA in the other complementary fields of the “Total System Approach”. MAWA model can be used as a benchmark.

Development of a MOC between EASA and EDA to formalise and define the aforementioned cooperation.

Creation of the EASA Civil/Military Coordination Cell with the participation among others of EC, EDA, SESAR and ECTRL, Industry to provide guidance on the coordination and the implementation of the civil-military cooperation among all relevant actors in EUROPE.

Final remarks

EASA considers that civil-military cooperation is absolutely necessary to ensure and maintain a high level of aviation safety in EUROPE.

THEREFORE:

EASA is willing to further contribute to the development and reinforcement of such cooperation within the framework of its mandate and available resources.
