Thi~ ~chedulc sets forth procedures agreed upon between the Federal Avi a t ion Admi nistrat10n (FAA) and t.he Directora te Ceneral of Air Communications (DGAC) to carry out the objec t ives of t.he Agreement. between the United StateD of America and t he Republic of I n dones i a concer n i ng the a i rworthine8$ cert if i cation, approval , or acceptance of imported civil aer o na utica l p r oducts, hereafter referred to as the b i lat eral airworthiness agreelUeut (BM).

11 . Bas is. The basis f or this Schedule, which is authorized by Section 8 of the BM, is s t a t ed 1n Section 1 o f t he BAA .

12. 'l'ennination. Either Part y may t erminate t hi s SChedule upon six months written notice to the other Party.

13. Obi ectives. The ob j ectives uf t hif:! Schedllle a r e stated i n t he Basis and Scope clauses of the BAA and are intended to enf:!ure thal Lhe maximum p r act i cal credit i$ given to the expor t i ng Stat e's cer tification syst em and t o ensure Lha t ;

Under the present BAA, design approval is limited to civil aeronautical products for which the FAA is the basic type certificating authority.

1.34. Specipl art;;tngements. The pr.ocedures pr.ovide for the r-esulutiun by the FM and the OGAC by special arrangement, as necessary, o t urgent or unique situations not envisaged in this Schedul e, ptoviding the situat ion fallS within the scope and pUICpuse o f the llilA.

~4. Def.i.ni t ions. The defini tions i n Sect i on 4 o f the BAA aICe inco:qJoICated by ICefeICence in this Schedule. AS used in this Schedule, t_lle following definition!l are provided to supplement those definitions.

(a) Compli.ance means that, after examination by analysis, test, etc., the type design of a pr-oduct is found to !l<l.tisfy the notified <l.irworthiness criteria.

(b) Component means a part, material , or subassembly intended for use on <l.n aeron<l.utic<l.l product.

(c) Conf o rnu.tv means that a pICoduct is examined aga inst pertinent type design, test, <l.nd Tlality control data and is found tu me",t those data.

(d) ~orting Civ il Ai rworthiness Authority mG!ans the national ur-~j"aIliz"tiQn within the exporting State, charged by the laws of the exporting State with ICegulating the airworthiness cert ification, approval , or acceptance of aeronautical products. The exporting civil airwOICthineS8 authurity will be referred to herein <l.S the exporting authority.

(e) Equivalent Saf ety l'indin!J means a determination that a l ternative action t<l.ken provides <l. level of safety equ<l.l to that provided by th", requir",ments for which equivalency is being sought.

(f) Exempti on means acceptable !lonCQmpliance with a r.equirement when processed through the appropriate regulatory procedure by the airworthiess authority and found to be i n the public interest and not to have an adveICse effect on safety.

(g) Familiarizat i on means the process whereby t he i mporting authority obtains information and experience on an aeronautical pl;"oduct designed in the export i ng State in order to : prescribe <ldditional technical conditions for that pro<lucL; provide corrective a i.rworthiness action in the event that the pICoduct experiences service difficulties during its operation in

CHAPTER 2. PRopue!' TYPE DESIGN APPROVAL PROCEDURES.

20. General. In accordance with the scope of the current BAA, the information in this chapter is applicable to U.S. type design approvals consistent with the limitations stated in the BAA. Approval of t he type design of a produc t , or changes t o the type design of a product, by the importing authority shall be based, to the maxi mum extent practicabl e, on technical evaluations, tests, illspections, anu compliallce c"'t-tificatiolls made by the exporting authority . The appropriate form of design appr oval is to be i ssued by the i mporting author ity for an imported product if U te exporting authority, aftet' consultation with the importing authority, certifies to the importing authority that the product type des i gn has been exami ned, tested, inspected, and found to meet the airworthiness crit"':t:-ia prescribed by the importing ;mthority, which the importing authority has found t o be equivalent t o its own national airworthiness standards for a similar product.

21. 'lYpe Design Approval APplication Consideratiolls.

210. Un ited S t a t es. An FAA t ype design approval f or a product is a prerequisite:

(a) For issuance of a U.S. airwort hiness certificate;

(b) To permit a non·U.S.-registered aircraf t to be ope~ated unde r lease hy a U.S. · certificated ai~ carrier or commercial upe rator under Federal Aviation Regulat i ons (FAR) Parts 121 or 135; or

(c) To pe:t:lnit a :(C"elateu produCl (e .g., e ng i ne, appl iances) to be installed on an aircraft having a U.S.

::! 11.. ReplJblic of I nOonesia . A DGAC t ype des ign approval for a product is a prerequisite:

(a) For issuance of an ROI airworthi ness c f:'rti f icatf:';

(b) To permit a non-ROI-reg i stered a ircraft to be opf:'r;-ated under lease by an ROI'certificated air carrier or commercial operator under Civil Aviation S~fety Regulations (CASR) Pa rts 40 o r 42; or

(c) To permit a related product (e.g . , engine, appl i ances) to be i nstal led on an a irc r a ft having an ROI airworthiness c eI"tificatf:'.

The DGAC wi ll ass i gn a higher pri ority t o applications f or t .ype design apPI"oval of an import product when OIle of the above situations is shown to exist . The DGAC docs not generally grant t ype design approvals for products manufactured outside ROI which are not intended for ROI utilization, except f or products to be insta lled on ROI -manufactu red products. Therefore, non-ROJ applicants for design approval should provide the DGl\.C with evidence of intended ROI utilization or installation on an ROI ­manufactured product a t the time of appl i cation.

ilpplicati,ons for I'lVI. type des i gn appr oval shall be senl by lhe DGAC t() t he Aircraft CertificatioIl Office (.1\(.'0 ), Long Beach, California. All U . S. applications for ROI type design approva l .'<hall b", ",,,,n t to lhe FAA ACO i n the applicant's geographical area, and the FAll. ACO will forwaI"d the application to the DGAC. Applications should include a generill description of the prOd1.1ct including :

(a) A three·view drilwing for ilircraft or a Cr08S ­section dr.awing for. engJnes and propellers;

(h) A stil.tement of the applicable airworthiness and environmental standar'ds f()r' design approval as established by the exporting authority for its own domestic design approv::ll;

(c) Any Bovel or uIl.utjual design featuI"es known to the applicant at the time ot application which might necossitate j ssuance of either FAA or: DGAC a ir:woJ:"thiness speci a l conditions;

(d) Any expected exemptions or eTlivalent safety f indings rela t ive to t he exporting authority's airworthiness standards for type design approval; and

(e) The estimated date of completion.

221. I nitial familiar i ",at ion b q efincr. On major projects, as soon as practicable after' the application has been received and accepted by the importing authority, and when the design is suffi c i ently de fi ned, a f amilia. riza.t i on briefing on the product may be requested by the importing autho1:·ity. The briefing shal l be held tlt a mutually agreeable location for attendance by t he importing authority, the exporting authori t y, and the appl icant. The primary purposes of the briefing will be to permit:

(a) The applicant to describe the design to the impOJ:"ting authority. This briefing (or series of brief i ngs) shall cover all aspects of the delSigu. Emphasis should be placed on any novel, unusual, or critical design features which might necessitate issuance o f e ither importing authority or exporting authority special conditions or new appl ications of existing standaT.ds;

(b) The importing authority to engage in detailed technical discussions with the exporting authority and the applicant on the design, including particular applications or interp r etat ions o f the airworthiness standilrds of the exporting State and the i mporting State; aud

(c) For products wi th a prior service histor y. the ctppl icant and the exporting authority to brie f t l1e iropo r- ting authori ty UIl th", p ruuuct service his t<.ay, including ~' orT",ctive measures to precl ude occurr ence of incidents or accidents.

(b) Once the i mporting author i t y's L.ype cer-tificatioIl basis has been established, the airworthiness standards for type certification hy the importing authority Sh,1.11 be agreed jointly by the importing au t hori t y and expor ting authority so as to:

(i) Give maxi mum credit to t he export-ing a.uthOlCity's dumestic cert if ication system; and

(ii) Prov i de t he importing au tho rity a baS is to find compl i ance with its own national airworthiness sta.ndards or to find t.ha t. equivalent crit.eri" l1ave been met, h,1.>'led nn an e xport ing authori t y cert ification of compl iance wi th the agrO:'eu a irworthiness standards.

(c ) Thus, the air-wo rthiness standar'ds uef ined by the import. i ng ".ut.hority will c onsist 01' the airworthiness s tandards as a ppl ied by the exporting aut hority under its own domestic certification system, p lus any additional technical conditions speci fi ed by t.he importing aut.hority to est ablish an equivalent level of sa fet y with i t s own domes ti c standards f o r a similar produc t .

223 . Additional t echni cal condi t i ons. The additional technical condi t i ons nay inc l ude any or all of the fol lowing:

(a ) Addi tional a irworthiness condit J.ol1s b ased on differences in the basic airworthiness standards, inter.pr e t ations, applications, policies, and guidance m.:l.terials between t he two States . I n the case of t he U. S., t he bas i c a irworthinRSS staML1.rds arc set out in the FAR Parts 23 through 35. In th", case of ROI , the basic airworthi ness standa r ds are set out in the CASR Part s S, 6, and 8 .

(c) Airwort hiness condi t_i ons based On an evaluation of equivalent safet y findings and <:'xempt ioIlS "ranted by the exporting authority to th8 appl icant tor domestic oert i f i ca t ion;

(d) At the option ot tho applicant. operation;:tl r equirements o f t he i mport i ng authority f or a pa rti cul ar k i nd or oondition of operation which would affect the design or perfm:mance of t_h e product . Thi>'! could inClude the p rovi si.on of addi t ional equipment required to mee t t he operat ional requirements of the importing authority, as well as supplementary adv isory inform."lti.on in the aircraft fli.ght ITk"lnual; the provifl i on of an aircra ft operating manual wi t h procedures for t he dispatch at the aircraf t with inoperative equipment; and the provision by the export i.ng author.i ty of advi sor.y maintenance i nformation . This latter infonnation will ass i st an airc:c:lft op~rator in satisfying the importing authority that hc has an acceptable maintenance spec if icat i on f o r h i s a irc r aft operat i on; and

(e) Act_ions deemed necessary for conti nued safe operation in t he import ing S t a t e as a resul t o f t he .impor t ing authority review of the service history and the actions taken by the exporting author i ty to correct. unsafe conditions on products of a type d<:,~ign previously certificate d by the export ing authority and having accumul ated a measurable service history.

221. Data submi t t a l and de s i gn r e v i ew . Requ i r ed technical data representing the product will vary with the type and complexity o f t he p r oduct i nvol ved. Preceding the i ssuance of type certification. the importing autho:r;-ity may request additional t eChnical design data, may review the product, and may fly the p r oduct for fami lia ri za tion pur poses. Also, wIlen deemed necessary by both the exporting authority and Un" import i ng author ity, the importing ;:mthority rn."ly fly, or conduct a detailed review of, the p roduct to assure compliance wi t h t he addi t ional technical conditions . The appl icant shal l submit a l l data to the exporting authori ty f or verificat i on and transmi ssion to t he importing authority. Requests for additional technical data, reviews. and fli.ght tests as described here shal l , in the spiri t of t he BAA, be t he mini mum necessary t o assure t hat t he i mporting authority acquires the needed familiarity.

(a ) Both the FAA and the DGAC may issue supplemental type cert.ificates (STC) to grant approva l for changes to a type des i gn for which a type certificate has been prev iuu"ly granted. The importing authority shail consider approving a change in type design on a product made by a n appl i cant i n the export ing State, provided the product b«s been type certificated by both the FAA and the OCAC for standard category <lirworthiness certific,,-tion.

(b) lI.pplic«tion for S'.l'C relating to products certificated in nonstandard catcgories and design <lpprov,,-ls for f i eld modi fication authorized under FAA field approval procedures (FAA Form ACA-337) shall be dealt with on a case-by · case basis, simi l ar to type certificates of nonstandard category.

230. Application for STC . An applicant shal l submit STC appl i cations to the exportj.ng authority wjth a r equest that the application and related information be fOLwarded to the import ing ,,-uthority. E,,-ch <lpplication will provide the following i n f ormati on:

The conformi t y certification i ssued by the supplier's airworthiness authority should nat b<" misconstrued al1 being an export. airwort h i ness approval, since t hey do not constitute a n "i:n'orthiness determi nat ion. such determinations remain the responsibi l ity of the product manu f acturer and its a i rworthiness a u thority. The certifications only serve to "ttest to the product manufacturer's air worthiness au t hority that a component confo rms t o the design, t es t , and qua li.t y cont.rol r equ i.rements wh i Ch t hat a irwort.h iness a u t hori t y has not i f i e d t o t hO:' su!,>pliO:'L" s "iL"Worthiness authori ty. Accordingly. when a product manufacturer desires to ship a componen t d irectly to an operator/user , it must make the necessary airwor thiness determination.
