Sealed tenders are hereby invited on behalf of the Director, National Dairy Research Institute) for ANNUAL JOB/WORK CONTRACT FOR OFFICE ASSISTANCE, CLERICAL ASSISTANCE, SUPPORTING SERVICES , COOKING,DRIVING, BOILER/ELECTRICAL SERVICES – 56 0030.

The terms and conditions of the contract which will govern any contract made are those contained in the General conditions of contract applicable to the contracts and the special terms and conditions are detailed in the tenders forms and its schedules. Please submit your rates in the tenders form if you are in a position to furnish the requisite services in accordance with the requirements stated in the attached schedules.

2. An earnest money of Rs.1,52,500 (Rupees One lakh fifty two thousand five hundred only) of the annual bid value must be deposited in the form of demand draft/pay order favoring “ICAR Unit, NDRI” payable at Bengaluru. The particulars of the earnest money deposited must also be super scribed on the top of the envelope by indicating the draft/pay order number and date, failing which the tenders will not be opened. The tenders will not be considered if earnest money is not deposited with the tenders.

3. The tenderer is being permitted to give tenders in consideration of the stipulations on his part that after submitting his tenders, he will not resile from his offer or modify the terms and conditions thereof. If the tenderer fail to observe and comply with the foregoing stipulation the aforesaid amount of EMD will be forfeited by the Institute. In the event of the offer made by the tenderer not being accepted, the amount of earnest money deposited by the tenderer will be refunded to him after he has applied for the same, in the manner prescribed by the Institute.

4. The Schedules of the tenders form should be returned intact and pages should not be detached. In the event of the space provided on the schedule form being insufficient for the required purpose, additional pages may be added. Each additional page must be

numbered consecutively and be signed in full by the tenderer. In such cases reference to the additional pages must be made in the tenders form. If any modification of the schedule is considered necessary it should be communicated by means of a separate letter along with the tenders. Overwriting/erasing in rates to be quoted by the tenderer will not be allowed otherwise the tenders may be rejected.

5. The tenders are liable to be ignored if complete information as required is not given therein or if the particular asked for in the schedules to the tenders is not fully filled in. Individual signing the tenders or other documents connected with the contract may specify whether he signs it in the capacity of (i) a sale proprietor of the firm or constituted attorney of such sole proprietor, or (ii) a partner of the firm if it be partnership in which case he must have authority to refer to arbitration dispute concerning the business of the partnership whether by virtue of the partnership agreement or power of attorney or (iii) constituted attorney of the firm if it is a company.

6. If tenderer does not accept the offer, after issue of letter of award by Institute within 15 days, the offer made shall be deemed to be withdrawn without any notice & earnest money forfeited.

7. In case of partnership firms, where no authority has been given to any partner to execute the contract/agreement concerning the business of the partnership, the tenders and all other related documents must be signed by every partner of the firm. A person signing the tenders form or any other documents forming part of the contract on behalf of another shall be deemed to warranty that he has authority to bind such other and if, on enquiry it appears that the persons so signing had no authority to do so, the Council I Instt. Shall without prejudice to other civil and criminal remedies cancel the contract and hold the signatory liable for all costs and damages. Each page of the tenders and the schedules to the tenders and annexure, if any, should be signed by the tenderer.

8. The original copy of the tenders is to be enclosed in double cover. The inner cover should be sealed. The outer cover should be super scribed " FOR OFFICE ASSISTANCE, CLERICAL WORK, SUPPORTING SERVICES, DRIVING, BOILER/ELECTRICAL/COOKING SERVICES AT NDRI, BENGALURU, with address of this office and the tenderer shall place two envelopes clearly marked containing technical bid and financial bid separately in the main envelop. All Tenders should be sent by Registered Post. Tenders to be hand delivered should be put in the tenders box, which will be kept in the Chamber of Administrative Officer, NDRI, Bengaluru not later than 22-08-2015 at 10.30 AM.

9. The rates quoted by each firm for ANNUAL JOB/WORK CONTRACT FOR OFFICE ASSISTANCE, CLERICAL ASSISTANCE, SUPPORTING SERVICES, COOKING, DRIVING, BOILER/ELECTRICAL SERVICES contract in tenders be given both in words and figures failing which the same is liable to be rejected. Tenderer is at liberty to be present or to authorize a representative to be present at the time of opening of the tenders. The name and address of the representative who would be attending the opening of the tenders on tenderer's behalf should be indicated in the tenders. Name and address of permanent representative, of the tenderer if any, may also be indicated.

10. The Institute is not bound to accept the lowest or any other tenders and also reserve to itself the right of accepting the tenders in whole or in part. You are however at liberty to Tenders for the whole or any portion or to state in the tenders that the rates quoted shall apply only if the tenders are considered fully. Other conditional Tenders will not be accepted.

11. An amount equal to 10% of the total value of job contract as Performance Security/Security Deposit is to be deposited by the selected agency/successful tenderer only

after receiving a communication from the Institute. In the event of non-deposition of the same, the earnest money shall be forfeited.

12. No interest on security deposit and earnest money deposit shall be paid by the Institute to the tenderer.

13. Service tax or any other tax applicable or made applicable after awarding the contract in respect of this contract shall be payable by contractor and NDRI will not entertain any claim whatsoever in this respect. However the service taxes or any other tax which is as per the rules of the Govt, shall be deducted at source from monthly bills of the successful tenderer, as per rules/instructions made applicable from time to time by Government.

14. Director, National Dairy Research Institute reserves the right to reduce or terminate the period of contract or to extend its duration in the interest of the Institute, for any justifiable reasons, not mandatory to be communicated to the tenderer.

15. Decision of Director, National Dairy Research Institute, shall be final for any aspect of the contract and binding to all parties. Disputes arising, if any on the contract will be settled at his/her level by mutual consultation and in case of failure of settlement dispute shall be referred to the sole arbitrator to be appointed by the Director, National Dairy Research Institute, . The decision of the sole Arbitrator so appointed shall be final and binding on the parties. Arbitration proceedings shall be governed by the Arbitration & Constitution Act, 1996.

16. Acceptance by the Institute will be communicated by FAX, Express letter or any other form of communication. Formal letter of acceptance and work order of the Tenders will be forwarded as soon as possible, but the earlier instructions in the FAX/Express letter etc. should be acted upon immediately.

17. ELIGIBILITY CRITERIA

a) The Bidder should be a Pvt Ltd Company/Partnership/Proprietorship firm registered under Companies Act, 1956, who possess the required licenses, registrations etc., as per law with 5 years of Experience in the relevant field.

b) The tenderer having experience of providing Security/House Keeping/Manpower services during last 5 year ending 31.3.2015 to Central Government Dept/Research centers/Institutions/ Private Organization only need to apply and should be executing service of similar nature as mentioned in the scope of our tender document and produce proof the same in the form of orders, contracts of other documents of similar nature.

c) Having successfully completed one similar work costing not less than Rs.60.00 lakhs per year in the last three years.

1. Similar works under this clause means providing Security/House Keeping/Manpower services to Client(s), such as Central/State Government Dept./Research centers/Institutions/Private Reputed Organizations like Wipro, Infosys, Cognizant, CISCO, etc .

2. The bidder should be having minimum of 5 years experience in providing Security/House Keeping/Manpower services providing Services to Government Research Centers/Institution(s) Establishment(s) Private Reputed Organizations etc.

3. Bidder should have among its clients Government Dept/Research Centers/Institution(s),Establishment(s) Organizations in public sector for whom they have been providing Security/House Keeping/manpower services. Names and

addresses of such clients along with details regarding name of contract person, telephone number, nature, amount and period of the contracts along with value of contract should be furnished along with Technical Bid.

4. The bidder should have an average annual financial turnover of Rs.2 (two) crores each year for the last three years from 2011-12 to 2013-14/2012-2013 to 2014-15. Audited CA certified statement of accounts, documents in this effect shall be duly submitted.

5. There should be no case pending with the police against the Directors or the Company (Agency). The vendor should have not been blacklisted by any organization/Govt. Department. An affidavit in this respect is required to be given by the tenderer.

6. The bidder should not have rescinded/abandoned any contract awarded by any of his clients before the expiry of prescribed period of contract. The bidder shall give details of all disputes he/she had with his/her clients and furnish the status of arbitration, if any.

7. The Contractor should have an office in Bangalore.8. The Contractor having and certified with ISO 9001-2008 Certification shall only be

considered (Certified prior to floating of tender) 9. The contractors should be having valid license issued by Dy chief Labour

commissioner (Central). Ministry of Labour for undertaking similar nature of works.10. The Agency/Contractor should be registered with Karnataka Private Security

Agencies Act for providing Security Services.

18. All the following documents/vouchers are required to be enclosed in sequence, as under, to prove the credibility, competence and eligibility of the firm along with the tender form which are the terms and conditions of the tender document:-

a) Registration certificate of the firm under the Govt. of India/State Govt.

b) Minimum turnover of the firm not less than Rs.2.00 crores per year (Rupees two crores only) during the last three financial year and enclose the copy of certified balance sheet.

c) Last Five years continuous experience of the firm in the field of providing security services in Central Govt. establishments/Autonomous bodies of Govt. of India/ Corporations of Govt. of India/reputed public or private organizations. Provide the details in enclosed tabular form.

d) Duly certified copies of the satisfactory services where the Tenderer is providing/had provided the services in the last Five years.

e) Employee EPF registration certificate issued by govt. etc.f) Employee ESI registration certificate issued by govt. etc.g) The contractor/agency must have a registration with the Contract Labour (Regulation and

Abolition) Act, 1970. The contractor shall obtain the labour license under this Act. h) The firm should produce proof of having at least 100 Security Guards/Manpower on its roll

registered under ESI & EPF separately. Enclose the list of staff and copy of challan also.i) Service tax registration certificate issued by Govt. etc.j) EMD of Rs.1,52,500/- (Rupees one lakh and fifty two thousand five hundred only ) in the

shape of Bank Draft in F/o “ICAR Unit, NDRI, Bengaluru..k) The firm must have a license for operating Security Service/Agency from State/Central Govt.

n) Contractor shall disclose any pending arbitration cases filed against the firm.

Scope of Work:

The services as detailed below are to be provided to the Section/Units/Senior Officers of NDRI, located at SRS NDRI,Bengaluru

TERMS & CONDITIONS :

1. The staff should follow strict attendance and alternative arrangements are to be made by the agency whenever any staff goes on leave/rest under intimation to this office.

2. Changing of Staff shall be intimated to NDRI,Bengaluru.

3. Director NDRI, reserves the right to reject any or all quotations in whole or in binding on the contractor/agency in respects of clauses covered under the contract.

4. The staff provided should also maintain secrecy and discipline in the premises of Institute.

5. The staff provided should be capable of reading and writing Hindi and English with

a) For Office Assistance – A minimum qualification of graduation from any reconzined University having computer knowledge (MS Office) with 02 years experience in the office work and maintenance of office record.

b) For clerical Services – A minimum qualifications of 10 + 2 School leaving certificate, experience of working office on software with knowledge of MS Office Software.

c) For Supporting Services: - A minimum qualification of matriculation or equivalent.

d) For Driving Services – A minimum qualification of 10 th pass from any recognized Institution with two years experience.

e) For Para Veterinarian: Matriculation/10 + 2 with Diploma in Animal Husbandry or JOC in Animal Husbandry and Veterinary Sciences.

f) For Boiler Services – Successful completion of Trade Certificate for IBR boiler operation,

g) For Pump Operating services - SSLC with plumbing trade certificate and fixing, dismantling & installation of pumps in open well, borwell etc..

h) For Cooking services – 10th Standard Pass, Experience in cooking for 100 persons , good health and hygienic practice, Managing kitchen by cooking 3 times a day, Manage the food operations of Guest House and Canteen as desired.

i) Skilled working services in Dairy Plant: SSLC with trade certificate in food/confectionery or 8th Standard with experience in dairy / food – Operation of Dairy plant , preparation of dairy product, cleaning and washing of dairy plants. Any other duty assigned.

h) For Electrical Services : ITI with Certificate with wireman license issued by the State Electricity Board. Experience – 3 to 5 years.

6. Agreement is terminable with one month notice on either side. In case of termination of this contract on its expiry or otherwise, the personnel deployed by the service provider shall not be entitled to and have no claim for any absorption in the regular/other wise capacity in NDRI.

7. The contractor shall not sublet the work without prior written permission of the NDRI.

8. The contractor or his workers shall not misuse the premises allotted to them for any purpose other than for which the contract is awarded

9. The selected agency shall provide the necessary personnel for at NDRI, Bengaluru as per labour acts prevalent in State. The agency shall employ good experience & reliable persons with robust health. In case any of the personnel so provided is not found suitable by the NDRI, the NDRI shall have the right to ask for his replacement without giving any reason thereof and the agency on receipt of a written communication will have to replace such persons immediately.

10. The persons so provided by the agency under this contract will not be the employee of the NDRI and there will be no employer-employee relationship between the NDRI and the person so engaged by the contractor for all purposes.

11. Payment for service contract will be made monthly upon submission of pre-receipted bill along with attendance sheet of the manpower, payment vouchers duly signed by contractual employees and EPF challans for submission of DPF contribution.

12.The Tenderer should indicate only the lump-sum amount in respect of all the services covered under this contract. No request for alteration in the rates once quoted will be considered during the contract period.

13. The rates to be quoted should include cost of each and every item including transportation cost, manpower cost including all State/Central taxes etc. also. The Institute shall not bear any extra charge on any account whatsoever i.e., EPF and ESI contribution etc.. Wages are to be paid to the contractual manpower will be as per the directions of Ministry of Labour & Employment , Government of India. Order No.1/3(3)/2015-LS-II, dt: 30-3-2015. Bids quoting ‘Nil” service charges/consideration shall be treated as unresponsive and will not be considered. The firm must make provisions for increases in VDA in the services charges itself as and when VDA increases, the persons deployed are to be paid the revised VDA.

14. The contractor will discharge his all legal obligations in respect of the workers/supervisors to be employed/ deployed by him for the execution of the work in respect of their wages (strictly as per minimum wages as per the Order of Chief Labour Commissioner, ©,Min. of Labour & Employment, Government of India, ) and service conditions and shall also comply with all the rules and regulations and provisions of law in force that may be applicable to them from time to time. The contractor shall indemnify and keep indemnified the NDRI from any claims, loss or damages that may be caused to it on account of any failure to comply with the obligations under various laws. In case of any dispute, the decision of Director, National Dairy Research Institute, shall be final and binding on the contractor.

15. Income Tax will be deducted from the payments due for the work done as per rule.

16.. The contract is subject to the condition that the tenderer will comply with all the laws and acts of Central Govt., State Govt. relating to this contract made applicable from time to time.

17. The selected agency shall provide the necessary personnel at NDRI as per labour law. The agency shall employ reliable persons with good health in age group of 21 to 45 years. In case any of ther personnel so provided is not found suitable by the NDRI. The Agency shall have to replace such personnel immediately.

18. Risk Clause: NDRI reserves the right to discontinue the service at any time, if the services are found unsatisfactory by giving a show-cause to be replied within a week and also has the right to award the contract to any other agency at the risk and cost of current agency and excess expenditure incurred on account of this can be recovered from Performance Security or pending bills or by rising a separate claim.

19. The service providing agency shall be solely responsible for the redressal of grievances/resolution of dispute related to personnel deployed and NDRI shall in no way be responsible for settlement of such issues whatsoever.

20. For Driving Services -the normal office hours of the NDRI is from 9.300 am to 5.00 p.m. Monday to Saturday. However, NDRI reserve the right to depute the contractual personnel on Saturday/Holiday/Sunday//beyond office hours whenever the need arises.

21. For Driving Services – The personnel so deployed must have a valid and appropriate Driving License for driving Maruti , Gypsy, Ambassador, SX4, Maruti Van, Tata Sumo , Tata Indigo, etc. vehicle of NDRI. He would be required to drive the vehicle, maintain the log book and attend to any other non-driving duty assigned by the office.

22. contractor/agency will furnish to the NDRI the full particulars of the personnel sponsored, including details like name, father’s name, age, photograph, permanent address, telephone number etc and will also ensure the verification of the antecedents of such personnel from their ex-employee/police and also ensure that they possess the requisite academic technical qualifications and experience for rendering the requisite services to the NDRI.

23. The tendering agency shall be liable for depositing all taxes, levies, cess etc. On account of service rendered by it to the NDRI to the concerned tax collection authorities from time to time as per extant rules and regulations on the matter.

24. The personnel provided shall be under the direct control and supervision of the contractor/agency. However, they shall comply with the oral and written instructions given on day to day basis by the officer(s) authorized by the NDRI from time to time. They will be bound by office timings, duty, placement, locations etc. as decided by the NDRI.

25.The contractor/agency shall make payment of remuneration/wages to its personnel before 7 th of every month by cheque in presence of an authorized representative of the NDRI after making the payment, the contractor shall raise the bill on the NDRI for payment of the settled amount. They will submit to the NDRI a copy of the payment vouchers duly signed by the workers for each month along with copy of challans for submission of EPF contribution.

26. Any loss, theft, damage to the life and/or property of the employees of the NDRI and/or property of the NDRI shall be compensated by the contractor’/agency if the cause of such loss, theft

or damage is on account of default, negligence and/or lapse of the personnel deployed by the contractor/agency.

27. In case of breach of any terms and conditions attached to this contract, the security deposit of the contracting agency will be liable to be forfeited by the NDRI besides annulment of the contract.

28. The terms and conditions as stipulated in the tender documents and enclosed herewith shall be part of the agreement.

29. The Director, NDRI, reserves the right to reject any or all quotations in whole or in part without assigning any reason therefore. The decision of Director, NDRI, l shall be final and binding on the Contractor/Agency in respect of clause covered under the contract.

LIQUIDATED DAMAGES CLAUSE:

1. An amount equivalent to two days of contract amount subject to a minimum of Rs.2000/- will be levied as liquidated damages per day. Whenever and wherever it is found that the work is not up to the mark, it wiII be brought to the notice of the supervisory staff of the firm by NDRI and if no action is taken within one hour liquidated damages clause will be invoked.

2. If the required number of workers are less than the minimum required, as a penalty, Rs.500/- per worker per day will be deducted from the bill. No Security Guard performs double duty, in case if they are found performing double duty or remain absent from the duty a penalty of Rs.1000/- per point shall be recovered from the contractor’s bill.

3. Any misconduct/misbehaviour on the part of the manpower deployed by the agency will not be tolerated and such person(s) will have to be replaced immediately.

The Director, National Dairy Research Institute, reserves the right to reject any or all Tenders in whole or in part without assigning any reasons there off. The decision of Director, National Dairy Research Institute, shall be final and binding on the contractor/agency in respect of any clause covered under the Contract.
